The short answer is often yes, but it depends. There are numerous tax hurdles to overcome. Even then a deduction may provide limited or no tax savings.

The rules are: If a taxpayer provides more than 50% of a parent’s support they can deduct the medical costs paid on their behalf. This is the case even if the parent cannot be claimed as a dependent for purposes of the dependent exemption. If the parent is a dependent for medical purposes then: Medical expenses paid directly by the child are deducted on their return as if they incurred the expenses. Medical expenses are subject to a 10% reduction, or a 7.5% reduction (for 2016) if you were born before January 2, 1951. There is an addback for alternative minimum tax of the full amount allowed, or if you or your spouse is 65 or older, 2.5% of adjusted gross income if less.

So what does all this mean? First, all expenses paid must be analyzed to determine how much is medical and how much is maintenance. Mere in home assistance may not be deductible. Payments for medical care are deductible, along with certain expenses paid for a person who is “chronically ill”. Chronically ill means the person needs to be protected due to cognitive impairment, or because they are unable to perform at least two activities of daily living (eating, toilet,

bathing, dressing, continence). Assuming you meet all these tests and have a meaningful deduction, do you get a benefit? Since the expenses are treated as if incurred by the payor, limitations on deducting medical costs must be exceeded. Examine Schedule A of Form 1040 to determine if the medical deduction exceeds the phase out based upon AGI. If this hurdle is passed, look at the alternative minimum tax (“AMT”) calculation to insure a benefit remains available. The combination of the deduction phase out and AMT may result in no net benefit.

If the child payor gets no tax benefit, determine if there is a way for the elderly parent to recognize taxable income, to secure some tax benefit for expenses paid. To make this happen, the parent would need to pay their own medical expenses. Gifts could cover expenses. If the parent has retirement plans, consider withdrawing funds in excess of the required amount to generate taxable income. Bottom line, if the payor has significant taxable income, paying an elderly parent’s medical expenses may generate little or no tax benefit. In this case, review the elderly parent’s tax return and financial wherewithal to create some measure of tax savings. The Main Terms of Estate Planning This month I am giving a simple overview of the documents and terms I use daily. •

Durable Power of Attorney – This is a document that allows someone to make financial and other decisions for you. As long as it is properly prepared, the document can be used for anything. For example, when a person gets older and they are not able to manage their affairs due to a number of reasons(i.e. old age, dementia, etc..), the durable power of attorney allows someone to manage their affairs. Healthcare Surrogate - This is a document that allows someone to make medical decisions for you in the event that you are incapable of managing your own medical affairs. This document also allows for your Healthcare Surrogate to talk to your doctors without any HIPAA violations occurring.

Last Will & Testament - This is a document that allows a person to state their wishes in the event of their death. This document will list who will be in charge of a person’s assets and who those assets should be distributed to.

Living Will - A Living Will is a written statement detailing a person’s desires regarding their end of life medical treatment. This document becomes extremely important in circumstances in which a person is no longer able to give their consent. This “Terry Schiavo” document is designed to make sure your family knows your wishes regarding end of life procedures.

Revocable Trust - This document, when all assets are properly titled, allows a person to avoid probate. This document works in cases of incapacity, like Donald Sterling

and the sale of the LA Clippers. You can choose who will be in charge, as well as how your beneficiaries are allowed to use anything left to them. •

Probate - Probate, the last term I usually use, is a court process that distributes a deceased person’s assets. If the deceased person leaves a will directing how his or her property should be distributed after death, the probate court must determine if it should be admitted to probate and given legal effect, choosing if it is valid or not. If a person dies intestate—without leaving a will - the court appoints a Personal Representative to distribute the deceased person’s property according to the laws of Florida.

The above basic terms, among others, are used by members of my firm as well as myself on a daily basis. I hope the above provided some clarification for all the readers out there. “Varicose Veins are more than skin deep”

O

ur body does so much day in and day out, and most of that work goes unseen. Our veins have an important job, carrying our blood back and forth to our heart only to be pumped out again. As we age, this daily toil can become more apparent as veins reveal themselves like road maps, especially on our legs. When they become deeper and wider, such as the case of varicose veins, that is when it can be cause for concern. Not only can varicose veins be unsightly, but they also can be a signal that something else is happening within the body to cause them. Each vein has a tiny valve that helps it do its job, but there can be leaks and the valve can malfunction causing the blood to back up and the vein to bulge. Sometimes, having varicose veins can mean the person with them has cardiovascular problems. Many people will seek out a doctor to get rid of the unsightly veins, but sometimes the doctor they consult with is more of a plastic surgeon or dermatologist and does not probe deeper to understand the root cause of the issue. But Dr. Ariel Soffer, M.D., FACC, knows “varicose veins are more than skin deep.” He is board certified in cardiovascular disease and, for over 20 years, he has focused his practice on aspects of the cardiovascular system, especially varicose veins. According to company spokesperson Adam Kustin, people who have issues with their veins often complain of achy legs or numbness, among other symptoms. In order to ascertain the underlying problem, patients who come into our office undergo an ultrasound. “You and I can walk in and both have the same degree of problems with our veins] and there is no way to tell [the underlying issue] based on the surface,” says Kustin. “It is important to see a doctor.”

The Margate Police Department would like to inform you that a new scam is being perpetrated by criminals in our city. The scam involves an individual impersonating a bank representative (usually a female) calling residents via telephone and telling the would be victim, that they have been the victim of fraud. They are told that their cards were being fraudulently used and the chip on their card needs to be replaced. The victims are then told that a representative from the bank will come to their residence and replace the card. Typically, the Ò representativeÓ will stay on the line until someone shows up at the residence (usually 15-20 minutes). When the other Ò representativeÓ arrives at the residence, they take the victimÕ s credit cards and tells them they will be back shortly with new cards. After taking the cards from the victims, their cards are used until it is maxed out. Usually the dollar amount of fraud is in the thousands or until the transactions are declined due to fraud. when a shaky, stunned and teary-eyed Rosemary reached the podium, she thanked the nearly 1,000 people in the audience at the 29thAnnual woman Volunteer of the Year Luncheon & Fashion show at the boca Raton Resort & club. she had particularly kind words for her husband, ben, longtime partner in giving, and her three children who flew in from around the country: sons Kenneth, from New York and gregory, from Delaware, and daughter, catherine Krieger-Nelson, from Dallas. “I’ve gotten flowers, emails and calls,” said Rosemary in a recent interview, her smiling face still beaming with excitement. “i didn’t expect to get the award. i am still in shock.” many in the audience were themselves in tears as they stood and applauded Rosemary, whose beneficence has helped dozens of nonprofits, from AVDA (Aid to Victims of Domestic Abuse), the YmcA, march of Dimes, george snow scholarship Fund, wayne barton center, st. Jude church, boca Helping Hands and Florence Fuller child Development center, to name a few. Education and Arts Leadership

Among those at her table was AVDA executive Director Pam o’brien, who nominated Rosemary for the award. “she is a true giver who thinks of others before herself,” said O’Brien. “She wants to make sure that women and children in need have a safe place to go.”

the generous lady from boca has a simple philosophy about giving. “You don’t think about it, you just do it. I has to come from the heart.” coincidentally, barely a month after receiving the honor, Rosemary has jumped back into an AVDA cause. she is on the committee planning the Feb. 21 “Heart of a Woman” luncheon fundraiser at the Boca Resort. The speaker will be Michelle Knight, one of the three women abducted, imprisoned and repeatedly raped by Ariel castro at his home in cleveland. Nabbed by the suspect between 2002 and 2004 were Knight (who has changed her name legally to Lilly Rose Lee), Georgina DeJesus and Amanda Berry. They finally escaped in 2013 when Castro was captured, tried and sentenced to life plus 1,000 years in prison. He committed suicide behind bars.
