Dear Sue, The item on Speeding by Melanie from Redbourn Auto Solutions was a welcome addition to your well produced and very worth while latest edition. However, I must take issue with one statement in particular, which unfortunately can only promote an ill-judged level of competence in your younger readers , who are the more likely to want to indulge in speeding. Melanie writes “We’ve all passed our test, so we’re all capable drivers ......” That is indeed the commonly accepted society view. It is definitely the interpretation adopted by so many ‘newly passed’ drivers, causing them to indulge in what so many perceive as ‘dangerous’ driving, including speeding. Sadly, passing the standard driving test needs to be seen as merely the first step towards competence/ability as a driver across the wider range of circumstances and conditions than anyone can ever come across in reaching the ‘pass’ status. Why else do we have an agreed voluntary “P” plate, which too few are willing to display? Should that plate not be compulsory to help debunk the illusion of capability for all recently passed drivers? As an outcome, maybe fewer young lives would be seriously damaged [even lost] through the serious accident records which statistically push up their insurance premiums, as evidence of their lack of capability. 50 years ago, when our roads were far less crowded than today, the Institute of Advanced Motorists [IAM] of which I have been a member for 60 years, whose test is taken as identifying a standard in the top 2.5% of drivers nationally, conducted an experiment on the E4 road stretching from the north of Denmark to the toe of Italy -- a distance of To advertise call 07941 661004

1,500 miles,far longer than most motorists are ever likely to undertake -- whereby two ‘engineered’ identical cars were driven by two drivers [also monitored scientifically] specifically to establish the difference between driving as fast as possible as opposed to driving fast but safely. After 1,500 miles it was able to show that the wear on the fastest car was 10 times higher than on the other one. Incredibly the ‘wear’ on the driver of that car was also 10 times greater than on the other driver. All for a time difference of 1.5 hours [90 minutes]. What better proof could there be of the futility of sheer speed in addition to the safety issues Melanie highlights. IF we really care about Life and Safety then the time for a set of staged driving tests is way overdue. Ian Keech (Caddington) Ian and some of his friends ran a “Bonus Ball” scheme with all profits going to charity. “In August we were able to donate £1,150 to each of Marie Curie and Macmillan. We now concentrate on donating in turn £250 to two smaller charities. So far we have made two such donations -- one each to CALM and Go Beyond,” he said.

Redbourn church’s crowdfunding campaign for water pump in Tanzania

St Mary’s Church in Redbourn is turning to crowdfunding to complete its ambitious fundraising target to build a water pump in their linked village in Mpwapwa, Tanzania. Having chosen the project to support as their Charity of the Year in January 2020, they set out with a target of raising 50% of the £40,000 needed to build the pump.

However, through the extraordinary generosity of the villagers, (and despite the restrictions of the Covid pandemic), they had actually raised over 75% of the total in November and so decided to turn to a crowdfunding campaign to reach the full amount before the end of 2021. At the time of going to print, the Go Fund Me page was showing a total of £36,135. Vicar of Redbourn Revd Will Gibbs says “We’ve been hearing a lot about COP26 and the climate emergency we face. And it’s often those who are least responsible who feel the effects of climate change the most. It can feel like such a big problem and we wonder how we can make a difference. Well, now we can. On 23rd November 2021, NASA backed by the US Airforce, used the services of the richest man on the planet, Elon Musk, via his Space X rocket service, to launch DART (Double Asteroid Redirection Test). The mission was to test deflection technology using the first ever kinetic impactor. The spacecraft will attempt to demonstrate the ability to deflect the asteroid Didymos B by colliding with it at a high speed (approximately 6.6 km/s). DART is a planetary defence against near-Earth objects (NEO). It will deliberately crash a space probe into the double asteroid Didymos to test whether the kinetic effect of a spacecraft impact could successfully deflect an asteroid on a collision course with Earth. The mission will take nine months to complete. One hour before the hit, scientists will see what the asteroid looks like via video streaming. So, what a year for science it has been. It gives us hope that the human race will find a way of surviving the current threats of pandemics, climate change and the fear of being hit by an asteroid. The world throws up new problems but human ingenuity steps up to the challenge.

A poll in 2008 undertaken by Parliament confirmed that 51% believed in this concept. • If you are not married you do not have automatic financial rights. • Any rights are limited to the laws of property and trusts which is a complex area of the law and if you are not a joint owner it is difficult, although not impossible to establish a financial claim on the property. • There is some protection for those with children and the courts can make orders to preserve the home and make other financial orders, in some cases until the children have finished full-time education. • There has been a lot of legal consultation about this area of English law and many calls for reform to protect long-standing relationships where there are children. WE ARE MARRIED AND THEREFORE I AM ENTITLED TO HALF OF EVERYTHING • Whilst the starting point in cases is equality, the court look a number of factors when deciding how the assets should be divided • The most decisive factor in most modest cases is the needs of the parties, especially the needs of the children. • In cases where the assets exceed the needs, the court aims for fairness and therefore it may place more weight on other factors such as the length of the marriage, contributions made. IF I TRANSFER ASSETS TO A THIRD PARTY THE COURT WILL IGNORE THEM • This is not the case and the court can either make an order for these to be transferred back to the spouse or ‘add them back in’ to the pot so that any order reflects the fact that the transferor of that asset has already had that money. • The transfers are likely to become common knowledge as both parties will have to provide the other with full disclosure of their financial documentation which includes bank statements and solicitors will pick up on unusual transactions in this documentation. • The court is likely to take a dim view of a party that has tried to conceal assets IF MY SPOUSE HAS RACKED UP HUGE AMOUNTS OF DEBT, I AM LIABLE FOR HALF OF THIS • The contractual position is that despite being married, the debt is personal and therefore only attaches to the person who has the contract with the creditor (unless you are guarantor). • The repayments are therefore the responsibility of the spouse whose name they are in and if there are missed payments it should only affect their credit. • However, there is always a concern if the debts have become unmanageable as a bankrupt spouse will cause problems for you and debts being secured on the other spouses share of the property could cause the home to be at risk • The matrimonial courts can look beyond the contractual liability and sometimes will consider the debt to be joint when considering the finances if both parties have benefitted from the debt. • It is also possible that regardless of who benefitted from the debt, the debts will be a factor for the court to consider when meeting the parties’ needs – which is hard pill to swallow. Couples who therefore have a spouse who is a spender needs to be aware of the implications.

PRENUPTIAL AGREEMENTS ARE NOT RECOGNISED IN ENGLAND AND WALES • Although a prenuptial is still not automatically binding in England and Wales, the presence of a prenuptial can still be of value and, even if not strictly enforced, is likely to be of relevance as one of the overall circumstances of the case. • They are becoming increasingly recognised by the courts particularly when they are properly drafted with both parties having had full legal advice. • Some of the most common use of prenuptials appear to be where one party has greater wealth that they are bringing to the marriage, are a beneficiary of a family trust or in circumstances where they are protecting anticipated inheritance due during the course of the marriage. • The Law Commission has provided some guidance on how to enter in to a prenuptial to give it as much weight as possible THE CHILDREN WILL ALWAYS STAY WITH THE MOTHER • Whilst it may appear that this is the case, the court is only guided by what is in the best interests of the child. • The use of a shared care arrangement is becoming more frequently used if it is practical and not disruptive for the child. FAMILY LAW DISPUTES WILL COST THE EARTH • Whilst you will inevitability incur legal fees if you instruct a solicitor, the level of cost will depend on the route that you take.. • There are a number of options available to try and minimise cost including mediation, negotiation and fixed fees. • The divorce process is procedural and therefore, if you have limited funds for legal fees and there are financial matters to resolve, the money is best used for that. . • If there are lengthy court proceedings this can result in significant legal fees on both sides so avoid if possible. First community exhibition opens at Harpenden Arts Centre, Eric Morecambe Centre
Harpenden’s newly opened culture venue - Eric Morecambe Centre (EMC) - is hosting the first in a series of community art installations in support of local artists, schools and special interest groups from mid-January 2022. Manager of the EMC, Jo Ditch, outlined her plans to use the wall space productively to encourage locals from the town and surrounding villages to visit the art hub and use the space to showcase the area’s talent.

A storm in a ‘cake’ cup
an interesting case of gay rights v rights to freedom of expression and religion How often have we wandered into a bakery asking them to make a celebration cake, personalised to suit the occasion? Would you ever consider that such a request could give rise to seven years of litigation, culminating in a recent decision by the European Court of Human Rights? No, me neither. But this is precisely what happened when Gareth Lee visited Ashers Bakery, a family run bakery in Belfast, with a request that they make him a cake with a picture of Bert and Ernie from Sesame Street and the slogan ‘Support Gay Marriage’. The bakery refused to fulfil the order because they felt it contravened their Christian beliefs. Mr Lee, a gay rights activist, argued that by refusing to fulfil his order, the bakery had discriminated against him on grounds of his sexual orientation. Mr Lee, backed by the Equality Commission in Northern Ireland issued a claim for discrimination. He also argued that the refusal infringed his political beliefs because at the time he made the cake order, Northern Ireland did not legally recognise same sex marriages. Ashers, backed by the Christian Institute in Northern Ireland, fought the case on the basis they maintained that they had not refused to fulfil the order because Mr Lee was gay, but because the order requested was contrary to their religious beliefs. What followed was a series of hearings and appeals. At the initial hearing, the Court found in favour of Mr Lee and held that he had been discriminated against on the basis of his sexual orientation and his political beliefs. The Judge acknowledged that Ashers had "genuine and deeply held" religious views, but said their business was not above the law. The compensation to be paid to Mr Lee was £500. Ashers appealed to the Court of Appeal but were unsuccessful.
bakery, effectively confirming that the owners of the bakery had to retain their rights to freedom of expression and religion. Mr Lee then took his case to the European Court of Human Rights, but they ruled his case inadmissible, suggesting that not all avenues have been exhausted in the UK. It remains to be seen if Mr Lee will pursue this further. It is a case that has divided opinion. You can see the respective positions, as Mr Lee understandably felt his rights and beliefs have been infringed, but likewise, the bakery felt that their rights and beliefs would equally have been infringed had they fulfilled the order. In such a case, how do you decide whose rights and beliefs should be given preference over the other? Does one of set of rights and beliefs have greater value over the other? Possibly, a material factor in this dispute may have been the fact that the bakery always argued that they were not refusing to serve Mr Lee because of his sexual orientation; rather it was just a refusal to fulfil that specific order. And, in case you were wondering, another bakery agreed to make the exact cake that Ashers refused to make, so despite the outcome of the latest instalment of the litigation, it could be said that Mr Lee was still able to have his cake and was able to eat it!

Drink Driving – What does it mean to you?

Hertfordshire Police launch their awareness campaign for Drink Driving over November and December and into January. Why? There is a significant increase in the number of drink-drive related incidents on the county’s roads over this period. So, how much can we drink safely? It’s astonishing to know that the first drink driving legislation was back in 1872 with The Licensing Act making it an offence to be drunk while in charge of carriages, horses, cattle and steam engines! The penalty was 40 shillings or imprisonment. 1968 saw the introduction of the breathalyser in the UK. This decreased the percentage of road traffic accidents where alcohol had been a factor from 25% to 15% in the first year. There were 1,152 fewer recorded deaths, 11,177 fewer serious injuries and 28,130 fewer ‘slight injuries’ caused by road traffic accidents. The enforcement of this continues to reduce injury caused by drink driving, so you can understand why the penalties are so high. If you are convicted for drink driving, some of the penalties are: a minimum 12 month driving ban, a criminal record, a fine of up to £5,000, and an endorsement on your license for 10 years. Even being in-charge of a vehicle with excess alcohol in the body could result in a prison sentence of up to three months, a driving ban and a fine of up to £2,500. The To advertise call 07941 661004

everyday consequences stretch beyond this to: an increase in car insurance, job loss, trouble getting in to countries like the USA, shame of having a criminal record, loss of independence, etc. So, what are the parameters? The current legal limitations are: • 35mg of alcohol per 100ml of breath • 80mg of alcohol in 100ml of blood • 107mg of alcohol per 100ml of urine The above legal limitations are difficult for an individual to determine, so the quantities that were used when the breathalyser was introduced are sometimes still quoted today: I.e. Men can consume four units and women three units with a unit being equal to: • Small glass of wine (125ml) • Half pint of beer (3.5% vol) or • 25ml spirit The Police, NHS and Think! advise that it is not possible to judge how much alcohol you can drink and stay below the limit. The above is unreliable as you are also affected by: • • •

Since 1968, many pubs have also increased the size of a small wine glass to 175ml or 250ml, spirit glass have increased to 35ml, and beers have increased in their alcohol content with some bottled beers being 5.5%. How does alcohol affect how we react? Our brains rely on a delicate balance of chemicals and processes which help to transmit signals from one nerve to another. Alcohol is a depressant which can disrupt that balance and affect our thoughts, feelings and actions. With the first drink, the chemical changes take effect and start to depress the part of the brain we associate with inhibition. We start to feel relaxed, more confident and less anxious. But as more alcohol is consumed, the more depressed the neurotransmitters become resulting in a possible negative emotional response such as becoming angry, aggressive, anxious, paranoid or depressed. Far from the pleasurable effects increasing, which may have been the initial intent. The other affect is on our memory and processing skills. The more we consume, the more these are impaired. After large quantities of alcohol the brain can stop recording into the ‘memory store’ resulting in waking up with a complete ‘blank’ as to what you said and even where you were.
Alcohol takes time to leave the body. An average adult takes an hour to process 10ml of pure alcohol (1 unit) so that there is none left in the bloodstream. E.g. if you drink at lunchtime, you may be unfit to drive in the evening. If you drink in the evening, you may be unfit to drive the next morning. There is no quick way to sober up! A stodgy breakfast may make you feel better as will drinking coffee, but it will do little to help the alcohol out of your system! *** Be ‘drink aware’ when you go out socialising *** Even small amounts of alcohol can affect your ability to drive, so the only safe advice is to avoid drinking any.
The slow processing and depressed neurotransmitters narrow our perception and therefore it takes us longer to respond to situations and hazards. We also become braver with our actions. Drinking alcohol (even just one drink) affects a person’s judgement and reduces their ability to see and hear things clearly. These effects make it much more likely that the driver will be involved in an accident. It is estimated that just one alcoholic drink can increase a driver’s thinking distance by up to 20% How long do the effects last?

Children’s Activities Story time We have loved seeing your little ones at strong time on a Friday afternoon. Rhyme time - coming soon We are still very limited on volunteer numbers so it won’t take place weekly just yet, but we would love to invite you and your babies and toddlers along every other week on a Friday morning.
