Spring brings light and hope for a better future. Seeing the bulbs come up and the skies brighten is a much needed fillip after a long, wet and monotonous Winter for many people. We are racing through our vaccination programme and I hope to have received my first jab by the time your are reading this magazine. The schools will also be open by now which must be a great relief to parents, trying to home school children at the same time as working from home. We have dared to book a couple of short staycations for this summer and a trip abroad in June 2022 which we hope will be safe. It is still a long wait for many of our local businesses to open on 12th April including non-essential shops, hairdressers, beauty salons, gyms for individual use, and pubs and restaurants will be able to serve customers sitting outdoors. We can take the children to Whipsnade Zoo and our libraries will open from this day. Our hotels and B&Bs in the UK can open for that much needed holiday from 17th May and we can even venture abroad and go for a pint indoors. All this depends on the virus going in a downward projection so until then, we still have to play our part with continued mask wearing, hand washing and social distancing. But the end is in sight. Good luck to us all. Let’s hope we can give you a few pages of What’s On next time, pages which have been absent for over a year now!

My life as a foster brother

My family and I started fostering back in 2012, when I was only nine-years-old. I can boldly say that it was one of the best decisions of our lives - and has changed our lives forever. Since 2012, we have fostered for three different young people. It is safe to say that we have loved them all and they each quickly became part of the family. Obviously, with teenagers, there are tough times - I’ve created enough of my own to know that. However, on this occasion, I would say that the positives outweigh the negatives. Becoming a foster carer gives everyone involved an extra set of responsibilities, and can help to grow younger minds in the form of empathy and patience. For a long time, my mum was the main carer. She had to deal with all the arguments, tears, and awkward conversations; all of which she handled perfectly. I think the main thing that fostering taught my mum was patience; raising a child from a challenging background can be tough. There are a lot of bad habits and insecurities that have to be overcome and she showed dedication and love towards all the people in our care when taking the time to help overcome these issues. For me, the main quality I developed while fostering was empathy. Learning about the troubling backgrounds the young people in our care had come from helped me to put things in perspective and understand how different circumstances can affect a person’s mental state and physical actions. I believe we have successfully managed to shape the minds of the people in our care and prepare them for adulthood and independent living. C

Hey dog lovers Tring Brewery have joined forces with Chilterns Dog Rescue Society - their charity of choice for 2021. The team at Tring Brewery will collaborate with the local rescue centre, brewing twelve monthly specials named after our fun-loving, furry friends. In return for their beery inspiration, Tring Brewery will raise funds and awareness for Chilterns Dog Rescue Society throughout 2021. Chilterns Dog Rescue Society was founded in 1963, rehoming tens of thousands of dogs over 50 years in the local area. In 2017 the society moved into their first dedicated home - a purpose-built rescue centre in Chivery, near Tring. Through the launch of their new location Chilterns Dog Rescue Society can now provide veterinary care and specialist training to dogs that need it the most.

Being a foster brother from a young age has really helped me grow. To understand how different backgrounds can affect people differently helped me empathise with people outside my family and gave me a different view on the world around me. I think that fostering is a brilliant opportunity for adults looking to raise a child of their own or to add a member to the family. Being a foster carer is not for the faint-hearted, but the emotional benefits are more than worth it.

Getting our financial life in order will be a top priority for many as we enter 2021. However, there are a few ways to help make sure you start the year on a positive financial footing. 1. NEW YEAR, NEW FINANCIAL GOALS There’s nothing like the fresh start of a New Year. Which makes it the perfect time to sit down and set some financial resolutions for the next 365 days. Having clear financial goals to work towards will give you a sense of purpose and motivation to spend less and to save and invest more throughout the year ahead. To ensure you achieve your financial resolutions, it helps to break the bigger goals down into more manageable bitesized objectives that you can gradually work through bit by bit to create better financial habits. 2. Do I have personal pensions built up during times spent being self-employed? Pension consolidation could potentially be a way to maximise the value of your investments. It can make it easier to track how well a fund is performing in putting your money to work on the markets to boost your investment returns. However, consolidating a pension isn’t for everyone. 8. MAKE THE MOST OF YOUR TAXEFFICIENT ALLOWANCES Time is running out if you haven’t taken full advantage of your tax-efficient allowances before the end of the tax year on 5th April. A Lasting Power of Attorney for Health and Welfare (LPA) will also allow you to give someone you trust the legal power to make decisions on your behalf in case you later become unable to make decisions for yourself. How can I leave money to charity? How much money can I give away each year in gifts without tax implications? Can I make regular gifts out of my surplus income? Should I put my assets into a trust during my lifetime? 10. CHECK WHEN YOUR NEXT REVIEW IS You’re not sure what to prioritise – your pension, your mortgage or your ISA. You’re

starting to lose sleep over whether you’re saving enough for your children’s education. And you can’t quite recall whether you have accumulated four, five – or was it six? – pension pots from previous jobs. Now may be time to consider your next financial review so that we can discuss your immediate and future plans, and talk you through your financial goals. A PENSION IS A LONG-TERM INVESTMENT AND IS NOT NORMALLY ACCESSIBLE UNTIL AGE 55 (57 FROM APRIL 2028). The ‘F’ Word A business contact of mine recently posed the question what name they should give to a hamster they had recently purchased. Without any hesitation, I suggested ‘Furlough’. As an employment lawyer, this tells you what word is at the forefront of my mind. I think I have used the word ‘furlough’ more times this year than any other word in my vocabulary. Okay, that’s an exaggeration but you will get the point I am trying to make, and this is a word that none of us had ever used (or heard of) before March 2020. It has clearly been an incredibly challenging year and in the context of employment law, the Coronavirus Job Retention Scheme has undoubtedly been the most talked about legal development since the Government decided to abolish Tribunal fees, and of course it will (as it stands) run to 31st March. But what else does 2021 hold for employers from a legal perspective? With the extended Coronavirus Job Retention Scheme, the Government decided to withdraw the Job Retention Bonus, the £1,000 paid to the employer for each employee who was retained by the employer after the closure of the job retention scheme. The Government have since spoken about an alternative ‘retention incentive’ but further details are pending. In April 2021, we will have the usual raft of increases to statutory payments (including an increase to the maximum weekly wage for redundancy payments) and also the cap for compensation in unfair dismissal claims, which currently rests at £88,519, will increase. For those employers who engage freelancers (or operate in the recruitment sector), we have changes to the IR35 rules that come into force on 6th April 2021. These changes apply to the private sector (but with an exemption for small businesses as defined) and were actually changes postponed from April 2020 because of the pandemic. In essence, the effect of this change is to impose an obligation on the company who engages the contractor to account for income tax and national insurance on the payments To advertise call 07941 661004

made to the contractor, if they are inside IR35. It is worth making sure your contractor arrangements are in order before those changes take effect. It will also be a busy year in the Employment Tribunals. We saw an unprecedented number of employment claims submitted in 2020, largely due to dismissals arising from the pandemic and many of those will go to trial this year. The Tribunals are certainly going to have to grapple with some difficult issues – employers who made redundancies instead of utilising the Coronavirus Job Retention Scheme, employers who dismissed those employees who refused to return to work after lockdown, claims where the employees will assert that they were dismissed for raising health and safety concerns arising from the pandemic. These issues will no doubt be the subject of much legal debate and the appeals will run for several years. 2021 will not therefore represent the end of the ‘F’ word, but let’s hope it represents the end of Covid19. We’re all entitled to get a little excited as the end of lock down is in sight. It has been an arduous long battle, but as we start embracing the new normal in its varying stages, we are allowed to get enthusiastic about venturing further to see loved ones or those we haven’t seen for a while. So, it’s time to ensure we can travel safely... but according to the experts, although we’re ready for the freedom, our cars are not… What stats are worrying Highways England? A Highways England survey revealed that more than half (54%) of drivers did not know when their next service is due and 32% admitted they only carry out basic vehicle maintenance (checking tyre pressures or oil levels) at best every few months or never. Oil changes and dashboard warning lights were also likely to be ignored. In another new survey of over 2,000 motorists aged between 18 to 65, just under a third confessed that their car was displaying a warning light, or that they were driving it perfectly aware that it had mechanical issues. This lack of attention to car maintenance could even be putting lives at risk, with 68% of respondents admitting they hadn’t checked their tyres, which is their only contact with the road. A quarter of those who did check them, admitted they knew their tyres needed replacing, but cost prevented them from doing so. To advertise call 07941 661004

Understandably, the use of cars plummeted in 2020, with vehicles expected to cover just 3,500 miles compared to 8,000 the previous year. 40 per cent of drivers blamed how seldom they were using their cars for not checking mechanical issues – other reasons included tighter finances and delayed MOTs. Because of the 6-month MOT extension (30th March 2020 until 31st July 2020), it has been difficult for people to remember when their MOT is actually due. It also created artificial peaks in the industry (September – January) making it difficult to get a booking. What’s the difference between a service and MOT? Many confuse the two, but both are crucial in keeping you and those around you safe, legally compliant and insurance valid. An MOT is a visual safety check and is a legal requirement to certify the vehicle as roadworthy on the date of inspection. An MOT tester is not allowed to strip down or dismantle parts for an in-depth check, and they shouldn’t need to as the vehicle should sail through its MOT without any additional work being required if it is regularly serviced. The inspection criteria are the same for all vehicles and is set by a government agency. All MOT testers are licensed and tested regularly on their ability to accurately conduct the test. The Government recommendation is £54.85 for an MOT on an average car. (continued on page 26) Please mention

This is an essential part of car maintenance as components maybe starting to weaken mechanically, the oil may need changing, or the air filter, fuel filter, spark plugs may have to be replaced. It also makes the car more economical to run, keeping running costs down and increasing its lifespan. If a car’s servicing schedule is maintained, it should be relatively painless with any niggles being addressed before they become an issue and threaten the longterm health of your car. So, don’t be tempted to miss or delay a service to save money - it could cost you in the long run. A poorly maintained car can result in poor fuel economy in the short term and in big repair bills further down the road. It is hard to compare prices for servicing as it is run differently at every garage according to the quality of the parts used, level of expertise, technical equipment used, and what they consider to be an intermediate, main or full service, etc. If the garage uses servicing based on guidelines from car manufacturers, it will also vary from car to car and year to year! Unlike MOTs, this is an unregulated area of the motor trade, so unbelievably anyone can set up as a ‘mechanic’ and work on cars! The key here is to ensure that you look for quality marks which ensure those working on your car are qualified to do so. What the experts say… Listening to surveys is one thing, but what are the views of the experts? Jeremy Phillips, Head of Road User Safety (Highways England) said: “While the country is in still in lockdown, we want to remind drivers to act now and carry out those important basic checks. Doing regular maintenance, rather than waiting until the end of lockdown, will ensure vehicles still work and preventable breakdowns will be avoided once the nation gets back on the road.” Mark Newberry, Commercial Director at Green Flag, said: “Cars are designed to be driven regularly and the components rely on regular use to stay in tiptop condition. A period of lockdown means many vehicles that may have been running every day could now be used less, which can lead to a number of complications”.

26 Jack Cousens, Head of Roads Policy at the AA warned motorists that cars sat around for long periods of time “can lead to issues”. He said, “With many people either working from home or furloughed, some drivers may be tempted to just let their vehicle bypass the MOT date and only arrange it when they think lockdown restrictions will be eased. However, cars parked up for long periods of time can lead to issues such as; battery faults, seized brakes and flat tyres. These are just some of the reasons why it is just as important, if not more so, to keep your car regularly maintained”. Salman Haqqi, personal finance expert for Money. co.uk warned: “With most regular drivers making smaller, more infrequent journeys, it’s easy to see why some might be tempted to put off repairs and maintenance, especially particularly expensive work. However, doing so could have serious consequences to the safety of your journey, and even invalidate your insurance”. In response to the survey, Highways England and partner Green Flag, are now highlighting the importance of basic maintenance and checks in helping road users to avoid breakdowns or endangering themselves and other drivers. Highways England, AA, RAC, Manufacturers and dealerships are all advising that it is important to perform regular vehicle maintenance, even when the vehicle is not in regular use. It will be great when we eventually get our freedom back and are able to travel a little further, but the overwhelming evidence is that many of us haven’t considered if our cars are safe and ready for us to use. At worst, some have considered it and ignored it! Next time you are out, take a look at how many cars are on the road – around 30% of the drivers are looking at a warning lights on their dashboard or driving knowing they have a mechanical defect. Their insurance will not cover them in the event of an accident. Car Garages were considered an ‘essential service’ with good reason. Please check when your MOT and Service is due. At the very least, get a Safety Health Check booked and keep yourself, and others, safe when we are allowed to venture out. If you’re unsure, give us a call! We’re here to help.
