In an exclusive telephone chat with The Daily Times, the Executive Secretary of MOMAN, Mr. Clement Isong, said that major oil marketers believed that the Federal Government will not fail this time. According to him, the payment of the debt by the government will help members of the association pay the banks what they borrowed from the banks to do business, which will enable the lenders bounce back to business while stimulating the nation’s economy. “These debts have not been paid since 2016, but when it is paid as promised, it will help improve the economy of the country. And I can assure that the statement does not represent political gimmicks as been insinuated by some quarters”, he affirmed. The MOMAN boss, however, expressed confidence that the Federal Government will not fail on its promise even as he explained that the Federal Government may not pay all but has to sit with the association to ensure proper
payment process over time. The Chief Operating Officer, Nigerian National Petroleum Corporation (NNPC) Downstream, Henry Ikem-Obih, had disclosed that the Debt Management Office (DMO) will on December 14, pay oil marketers first part of the subsidy arrears of N236 billion as agreed by both parties. “We agreed that after the first tranche is paid, the marketers will form a committee to work on details of how the next tranche will be paid in 2019 and the last paid in 2020. “Government is fully committed to paying the first tranche as promised and will be paid through a promissory note that will be issued by the DMO,’’ he said. Mr. Ikem-Obih said that oil marketers equally owed the government some debt which would not be deducted from the first tranche of payment. Meanwhile, NUPENG and PENGASSAN in a statement signed by their presidents, Messrs Francis Johnson and Williams Akporeha, in Abuja, had informed the general public that they have resolved to hold government accountable to
the December 14 deadline it promised to pay the first part of the debts owed. “With this commitment and firm assurance from the government representatives, the leadership of NUPENG and PENGASSAN have resolved to hold down on taking any action on the issues to allow government fulfills its pledge. “After series of engagements with government representatives and marketers, coupled with the ongoing meetings, consultations, and negotiations between the government and oil marketers, we have been assured by the government that the first part of the debt payment will be made not later than 14th December”. The unions’ leaders assured their members and the public that the decisions were based on upholding the overall interest of the nation, the industry as well as job security of its members. “Our members should, therefore, remain calm and continue to provide their services as required always”. They, however, urged the public to refrain from panic buying or stockpiling of petroleum products.
Vote buying: INEC boss urges NASS to pass Electoral Offences Tribunal Bill Tunde Opalana, Abuja The National Chairman, Independent National Electoral Commission (INEC), Prof. Mahmood Yakubu, has urged the National Assembly to ensure the passage of the Electoral Offences Commission Tribunal before the expiration of the 8th legislature. He said the passage of Bill and subsequent establishment of the Tribunal will drastically reduce the menace of vote buying that has discredited Nigeria’s Electoral processes in recent times. Yakubu made this appeal on Monday at the National Assembly during a one day Public Hearing on Vote-Buying and Improving the Electoral Processes in Nigeria, organised by the National Assembly Joint Committee on INEC and Political Parties Matters. He acknowledged that the bill has passed first reading but advocated a speedy process of enacting the law by the 8th Assembly to give legislative backing to move to end all forms of Electoral Offences including vote buying. The INEC chairman said recommendations of three previous Commissions, the Justice Uwais Commission, the Lemu’s Commission and of recent, the Ken Nnamani Commission are enough ground for the National Assembly for fast-track the process of passing the bill establishing the Commission
into law. The provisions of the Tribunal, he said, are in consonance with provisions of extant laws especially, sections 124 and 130 of the Electoral Act that criminalises vote buying among other inducements. Though vote buying is a global phenomenal and a long term problem in Nigeria, he said concerned stakeholders must proffer solutions. “Vote buying must not be allowed to defile our Electoral processes and our democracy. It is illegal, undemocratic, morally repugnant and defile the sanctity of our Electoral process. “We need to break the chain of voters’ inducement, the chain is systemic and it must be broken. We must stop vote buying”, he said. Declaring the public hearing open, Senate President, Dr. Bukola Saraki, urged the Independent National Electoral Commission (INEC), security agencies and all election stakeholders to ensure that the 2019 elections are free, fair, credible and transparent. He stated that this has become imperative as the country is in a delicate situation where Africa and the entire world is looking forward to what happens in the coming elections. “This is understandable when you consider that our President is the Chairman of ECOWAS. “Moreover, the Chairman of our INEC is the head of Electoral Commissions
in West Africa. With these positions, it is clear that we cannot afford to conduct an election that will not be credible, peaceful, free and fair,” Saraki said. He noted that having set an enviable record in the 2015 general election, the country cannot afford to lower the standard in 2019, adding that “We must up the ante, because whatever we do will have impact on the continent and serve as a representation of Africa on the global stage.” He insisted that vote buying and election rigging remain contemporary challenges that mar the nation’s electoral process, adding “We must deal with them in such a manner that does not detract from the credibility and legitimacy of the coming 2019 polls.” Saraki said: “Let me, at this point, mention that our major concern should be entrenching global best practices in our electoral process, and ensuring that these are backed by legislations to make them sustainable and permanent. For example, the use of Incident Form to bypass the lawful process of accreditation and voting is not good for the country. We must do away with it. “This is one of those issues concerning which, whether there is a law or not, all of us who are stakeholders should come to agreement and address the anomaly. At the very least, this is one minimum

The Presidency has refuted news making the rounds that it ordered a raid on the residence of the sons of Alhaji Atiku Abubakar, the presidential candidate of the Peoples Democratic Party (PDP). The Presidency also debunked the allegations that the account of the vice presidential candidate of the opposition PDP, Mr. Peter Obi, has been blocked by the Economic and Financial Crimes Commission (EFCC). Senior Special Assistant to the President on Media and Publicity, Garba Shehu, on Monday, stated that the story about the raid “ordered by Buhari-led government” on the home of the sons of Alhaji Atiku Abubakar, the PDP Presidential candidate and “the fairy tale on the alleged blockage of the bank accounts of the running mate, former Governor Peter Obi and his family are both untrue, and should be dismissed as just another manifestation of the PDP’s growing expertise in fake news. Shehu stated that Nigerians must be becoming wary by now, of a political party with absolutely nothing to offer in the coming elections and has instead, transformed into a knight in shining armor, slaying the truth. “In this so-called transformation, PDP has changed into nothing but to a ceaselessly flowing stream of fake news. “It is impossible to find in Nigeria today, anyone propagating fake news more than the PDP. “Our advice to Nigerians is: ignore them,” the presidency stated. Meanwhile, the Peoples Democratic Party (PDP) Presidential Campaign Organisation (PPCO) has condemned Saturday’s raid and unleashing of violence on the home of the sons of its Presidential candidate, Atiku Abubakar, by the Economic and Financial Crimes Commission (EFCC), as vicious, outrageous, dirty and reprehensible. The party said the invasion of Aliyu and Mustapha Abubakar’s home, even in their absence, allegedly by Buhari’s government in search of imaginary cache of foreign currency, has further exposed how depraved “the Presidency has descended in the desperate plot to harm,
traumatise and malign the character of our Presidential candidate and his family, having realised that Nigerians have aligned behind him as the next President of our country”. Director, Media & Publicity, PDP Presidential Campaign Council, Kola Ologbondiyan, in a statement on Monday said: “It is indeed appalling that the Buhari Presidency can now go as low as engaging in wicked politics of chasing after family members of a Presidential candidate, who are neither government officials, government contractors nor involved in any underhand dealings, but young students pursuing their legitimate personal educational careers without ill will to anybody. “While nothing incriminating was found in the apartment, the PPCO has been made aware of how the squad, said to be acting on ‘orders from above’ ransacked the house and destroyed valuables belonging to Atiku’s children and we demand an explanation from the leadership of the EFCC. “The PPCO completely rejects the wicked politics that the APC and the Buhari Presidency are importing into our polity. We hereby urge all Nigerians, particularly the youths, to rise in condemnation of these vicious acts. “Only last month, a special security squad of army, police and paramilitary agencies was unleashed to physically harass our Presidential candidate, Atiku Abubakar, at the Abuja airport, upon his return from Dubai. “Similarly, last week, all transactions in bank accounts belonging to PDP Vice Presidential candidate, Mr. Peter Obi, his wife, his family members and their businesses were stopped by agencies of the Buhari Presidency on account of imaginary investigation. “Nigerians are already aware of how opposition leaders and others perceived to be averse to the President Buhari’s re-election bid, on account of his woeful performance in office, are being blackmailed and framed up with spurious charges”, said the PDP. The party urged Buhari to note that, as an opposition presidential candidate from 2003 to 2015, none of his children or family members were in anyway attacked or victimised by the government in

However, the Economic and Financial Crimes Commission (EFCC) has denied raiding the residence of Atiku’s sons looking for foreign currencies or arms. In a statement on Monday, the antigraft agency also denied blocking or freezing the accounts of the Vice Presidential candidate of the PDP, Mr. Peter Obi. In the statement signed by the Ag. Head, Media & Publicity, Mr. Tony Orilade, the Commission described the report that it raided the residence of Atiku’s sons as “nothing but another tales by moonlight”. The statement reads in part: “We have received several calls and email messages asking us to confirm the arrest of the sons of the Presidential Candidate of the People’s Democratic Party, Alhaji Atiku Abubakar, as being alleged in some
quarters. Some only said we raided the apartments of Atiku’s sons looking for foreign currencies. This is nothing but another tales by moonlight. “It is in the news that we have been investigating the former Abia governor, Senator Theodore Orji over alleged N27 Billion Naira money laundering. In the course of investigation, we discovered that he laundered part of the money through his sons. We have been on the trail of some of the purchases made by his son including the cars the boys allegedly bought. “Last Friday, we traced one of the cars to a Nite Club in Abuja. In order not to cause panic, we waited until the business of the club was over and when the owner of the suspected car came to enter to take off, we arrested him and his friend who has a similar brand of car. That was about 5am on Saturday, December 8, 2018. “The two boys we arrested were Ogbonna Orji, 32, and Kelvin Ilonah. While Orji’s Car, a Range Rover is valued at about N100 million, Ilonah’s car also a Range Rover, is valued at about N35 million. “In the course of further interrogation, the two boys led us to their apartment, three flats, and documents retrieved from the apartment showed it was rented for N13 million each per annum. “Another brand new Prado Jeep, a 2017 model was recovered from the boys in the compound. The two boys in question gave useful information to the Commission which is helping in our further investigation. “The EFCC, as a responsible organisation is abreast of the establishment mandate and we shall not deviate from such mandate. “We never went after Atiku’s sons neither were Atiku’s sons among the two boys arrested. There is no link whatsoever to Atiku. “Only last week, the people’s Democratic Part, PDP was alleged to have raised alarm that the Commission blocked and or freeze the accounts of the Vice Presidential candidate of the PDP, Peter Obi. Again, this was another lie which we immediately punctured as there was no truth in it whatsoever, to the accusation. Till now, only silence has prevailed from the camp of the accusers”.

Henry Omunu, Abuja House of Representatives Speaker, Yakubu Dogara, on Monday, described the Buhari administration’s cash distribution to the Nigerians close to the 2019 general election as vote - buying. He declared that no matter how noble the administration’s intent may be, such endeavours amount to vote buying and inducement of potential voters, which is a clear case of corruption. Speaking at a public hearing organised by the National Assembly Joint Committee on INEC and Political Parties Matters on vote - buying and improving the electoral processes in Nigeria, Dogara said the act of inducing the public with cash in exchange for their votes is a fraud that is covered within Section 124 (1)(a)(b)(c), Section(124) (2)(4)(5) and Section 130 of the Electoral Act. He stated that financial inducement for votes contravenes the fundamental objectives and directive principles of state
policy as enshrined in the constitution, complaining of lack of political will by government to implement laws that would deter violators. The speaker added that “even where arrests are made, prosecutions are unheard of despite the damaging effects of the practice. “Vote buying and other sundry criminal manipulations of the electoral process in Nigeria have left our citizens in a state of unmitigated disaster. “As a result, we have been married off to a mob. A mob that rules us by the example of their power not by the dictates of law. A mob that rules by fear as an inalienable tool rather than by courage. A mob that accepts the status quo rather than challenge it. “Mobs don’t grow others, they only destroy others in order to grow themselves. We follow the mob because we must, not because we are receiving any sense of significance for our own lives from them. “Our democracy has stagnated and will sadly remain so until we eliminate all sham
elections which have the effect of throwing up the worst of us to lead the best of us. “It is instructive to note that the Electoral Act anticipated and captured most forms of electoral fraud, including inducement and vote buying. “I hope we will have the courage at this event to address the distribution of cash to the public very close to general elections by public officials. “I am afraid that such endeavours no matter how noble the intentions behind them may fall within the all-encompassing provisions of Sections 124 (1)(a)(b)(c) and Sections (124)(2)(4)(5) and Sections 130 of the Electoral Act. “Although penalties are not stringent, there is also lack of political will to implement the laws as it is, even if it were to offer feeble deterrence to violators. Arrests are hardly made and even where arrests are made, prosecutions are unheard of”. Furthermore, the speaker reiterated that sovereignty belongs to the people of Nigeria, through which government
derives its authority, powers and legitimacy. “Therefore, any form of contrivance by any person or authority to unduly influence the choice of the voter is condemnable as it is patently an assault on this constitutional guarantee. “Undue influence of voters has always existed in different forms all over the world, however, the recent phenomenon of direct pricing and buying of votes as if in a market square is very disturbing. It is one of the highest forms of corruption,” he stated. Reiterating the need for free, fair, credible and transparent elections, Dogara stressed that it remains the basis for translating the consent of the governed into governmental authority, especially as elections are now so attractive that even pretentious democracies lay claim to holding elections in order to confer some aura of legitimacy on their rule. About thirteen Senior Advocates of Nigeria and scores of other young lawyers were at the Federal High Court, Ikoyi, Lagos on Monday in solidarity with the President of the Nigerian Bar Association (NBA), Mr. Paul Usoro, SAN, who was accused of laundering N1.4 billion belonging to Akwa Ibom State government. Apart from Chief Wole Olanipekun, others are Femi Atoyebi, Ifedayo Adedipe, Fidelis Odita, Biodun Layonu, Sina Sofola, Offiong Offiong, Seni Adio, George Oguntade, Essien Udom, M. Dikko, A. T. Liman and Yele Delano. The planned arraignment could not go on on Monday as the prosecution lawyer, Rotimi Oyedepo, informed the court that the defendant was called repeatedly last week to come and pick his charge and when he eventually picked his phone, he pleaded that he had a function but, will come to EFCC’s office on Friday. The 10 count charge pending before Justice Muslim Hassan is preferred against him by the Economic and Financial Crimes Commission (EFCC). Also named in the charge, is the incumbent governor of Akwa Ibom, Emmanuel Udom, who is described in the charge as being “currently constitutionally immune from prosecution”. Others charged are: The Akwa Ibom State Commissioner for Finance, Nsikan Nkan; AccountantGeneral of Akwa Ibom State, Mfon Udomah; Akwa Ibom State Attorney-General, Uwemedimo Nwoko and Margaret Ukpe. The aforementioned, accused are said to be at large. As early as 7:25 am, lawyers trooped into the court even though the courtroom can hardly contain more than 25 lawyers. Oyedepo further told the
Usoro court that the defendant failed to turn up at the EFCC’s office as promised on Friday so as to hand him the charge for the purpose of his arraignment on Monday. He said: “Since the handing of the charge is fundamental to the proper commencement of this proceedings and same having not being effected on the defendant, I shall be asking the court for a short adjournment that is convenient for the court to enable us serve the defendant and commence proceedings. “ Piqued by the submission of the prosecution lawyer that the defendant come to the antigraft agency’s office to pick his charge, the defendant lawyer, Chief Wole Olanipekun, SAN, told the court that he cannot fathom any section of the Administration of Criminal Justice Act (ACJA) 2015 authorising or insisting on a defendant to come to EFCC’s office and pick his charge. He said: “Milord, may I correct a notion that the defendant didn’t honour a promise to be in their office on Friday. The defendant is the President of the NBA meaning that he is as busy as an ant with engagements here and there. “He has been going to EFCC’s office since June and he has been there up to ten times. It is a common knowledge that the charge had been publicised that he will be arraigned on Monday”. Olanipekun, while not
opposing application for adjournment, urged the court to direct that the defendant be served and then take a date for arraignment. Responding, the prosecution lawyer, Rotimi Oyedepo, said by virtue of sections 122, 123 and 271 of the Administration of Criminal Justice Act (ACJA) Act, it is the duty of the prosecution to bring defendant before the court unfettered for the purpose of arraignment. He contended that the step taking by the prosecution is a proper procedure. “We knew the defendant was busy that was why he was invited politely. I don’t have a service copy here to oblige defendant because I have transmitted the charge to the office of Director of Operation. All I have is my own copy and I didn’t receive any correspondent that I should bring a copy to court,” Oyedepo said. Chief Olanipekun, however, disagreed with the prosecution, saying it is not the procedure for defendant to go to the EFCC’s office in order for him to be served. He urged the court to direct the court registrar to serve the defendant before the next adjourned date. Meanwhile, Justice Muslim Haaaan, adjourned the matter till December 18, 2018 and ruled that the charge be served on the defendant before the next adjourned date.

All stakeholders should demonstrate the fact that a credible and transparent election is far better and more important than who wins that election. “We cannot afford to send the wrong signals with our actions or inactions as we prepare for the next elections. The world must take positive cues from us that we are ready to improve on our process, and make our electoral process more transparent and commendable. This is because perception matters, as you all know. Perception is, in fact, the reality. “At this point, it does seem to me that the onus is on INEC to demonstrate its independence. It should be pro-active and take bold decisions. And this is necessary because the responsibility to conduct a credible poll is solely that of The Commission. This is elemental to retaining the confidence of the electorate. “All of us who are gathered here have the responsibility to contribute ideas based on our experiences and insights on how to cure the ills of vote buying, subverting the popular will and delegitimising the outcome of our elections. “Furthermore, we need to make suggestions on how to curb the unlawful interference by security agents in the voting process. “It is all too clear that security agents are beginning to emerge as major clogs in the election process. Reports of collusion with political actors to disenfranchise voters is very worrying indeed. “We cannot under any circumstances militarise elections, because that defeats the purpose of free, fair and credible polls. In an election, access to the polling units for the purpose of casting one’s vote is the barest minimum. “Once a voter is denied the
opportunity to vote through bullying, intimidation and other forms of harassment, then vote rigging and electoral malpractice have free reign. “The security agencies work for INEC as the electoral body is the one charged by the constitution and our laws to conduct election. INEC must therefore set the rules for their engagement during elections, which they are to follow. “The Commission should further seek the co-operation of the respective security agencies to ensure strict compliance. It is that way that Nigerians can trust the process, and it will be clear to all that the right steps have been taken with regard to the involvement of security agents”. Speaker, House of Representatives, Rt. Hon Yakubu Dogora, charged INEC to ensure adequate supply of Electoral materials to every polling booths on Election Day to prevent disenfranchising numerous intending voters. Dogara cited example of how over 1000 voters were prevented from voting in his polling booth in the last bye- election in Bauchi State by inadequacy of ballot papers supplied by INEC. According to him, INEC polling officers presented just 1500 ballot papers for an election to be conducted in a unit that has over 2000 registered voters while eventually only 700 voters were accredited and voted, shutting out more than 1000 voters from voting. “Undue influence of voters has always existed in different forms all over the world. However, the recent phenomenon of direct pricing and buying of votes as if in a market square is very disturbing. It is one of the highest forms of corruption.” Dogara stated. He said the high prevalence of vote-buying in the electoral system of the country is, without any doubt, of great concern to all Nigerians and members of the global community who truly
love democracy. Speaking of the effect, the Speaker said: “When political office holders defy the law and corruptly assume office, they will always operate as if they are above the law. “Vote buying and other sundry criminal manipulation of the electoral process in Nigeria have left our citizens in a state of unmitigated disaster. As a result, we have been married off to a mob. A mob that rules cannot lead us by the example of their power nor by the dictates of law. A mob that rules by fear as an inalienable tool rather than by courage. A mob that accepts the status quo rather than challenge it. Mobs don’t grow others, they only destroy others in order to grow themselves. We follow the Mob because we must, not because we are receiving any sense of significance for our own lives from them. Our democracy has stagnated and will sadly remain so until we eliminate all sham elections which have the effect of throwing up the worst of us to lead the best of us”. He said though there are enough constitutional provisions of S. 124 (1)(a);(b);(c); and S.(124)(2)(4)(5) and S. 130 of the Electoral Act, penalties are not stringent as there is also lack of political will to implement the laws as it is even if it were to offer feeble deterrence to violators. “Arrest are hardly made and even where arrests are made, prosecutions are unheard of. Condemnation is not enough, it will amount to hypocrisy, if we don’t take the bull by the horn by taking concrete steps to eliminate these evils that make mockery of our hard worn democracy”, he added. Chairman of Inter-Party Advisory Council (IPAC), Peter Ameh, vehemently on behalf of political parties told INEC not to use incident forms in the conduct of the 2019 elections. He said statistics had it that incident forms were used in the conduct of over 65 percent of the 2015 elections.

Oil giants ExxonMobil and power firm QIPP have initiated plans to invest a combined $1.6 billion in the development of gas and power projects in Akwa Ibom soon. The initiative would see QIPP, owned by Emir of Kano, Dr Mohammed Sanusi invest $1.1 billion in the building of a gas power plant with ExxonMobil investing $500 million in a gas project in the area. Governor Udom Emmanuel who announced this weekend at the South South regional workshop and stakeholders’ forum on the ease of doing business in Nigeria held in Uyo said these were part of the plans to boost the economy of the state through strategic investments and business. Emmanuel who was represented by his deputy Mr Moses Ekpo stated that the state government have initiated strategies and policies meant to make investors especially SMEs have limited challenges in carrying out their business in the state. The Governor who said that efforts have also been made to encourage Ministries, Departments and Agencies in the state to discharge their obligations to projects and ensure transparency in the handling of business promotions to enable SMEs thrive in the area.
EFCC says corruption responsible for epileptic power supply Titus Akhigbe, Benin-City The Economic and Financial Crimes Commission (EFCC), has blamed epileptic power supply in the country on corruption. The Zonal head of Edo office of the commission, Mr. Yakubu Mailafia, said this on Monday in Benin, at a rally organised to mark the year’s world anti-corruption day, with the theme, “Say no to corruption, every no counts.” Mailafia also warned all would be vote-buyers in the 2019 general elections to be ready to face the full wrath of the law if found guilty of the law. “Corruption and its evil twin, economic and financial crimes have ravaged our nation and it is evidenced in the decayed infrastructures and other basic amenities. “Indeed, it is the bane of our development. It is the reason our power supply is epileptic, it is the reason our country is still touted as the potentially great nation even after many years of sovereign statehood.

Learning to swim without getting wet

The National Union of Petroleum and Natural Gas Workers (NUPENG) one of the most militant unions in African labour history, last week marked its fortieth anniversary. Back in 1994 when the military held Nigeria in vile grip, NUPENG sent out a call for the unions to rescue the country. The regime of General Sani Abacha was particularly brutish, nasty and bloody. It was a dictatorship that had no rules, respected none and included the bombing of buses especially those conveying soldiers, as part of governance.. Not surprisingly, other unions including the central labour organisation, the Nigeria Labour Congress (NLC) chickened out. NUPENG, backed by the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN) took on the military in weeks of strikes and protests. Even when the strikes were crushed and its leaders herded into years of solitary confinement, NUPENG held its head high. As part of this anniversary, NUPENG invited me as a Discussant at its Roundtable on “Local Content in the Nigeria Oil and Gas Industry: Wherein lies the interest of Nigerian Workers?” To me, the Local Content in the Nigeria Oil and Gas Industry as explained in the Nigerian Oil and Gas Industry Content Development (NOGICD) Act No 2 of 2010 is not about restructuring the oil industry which has always favoured the foreign ownership, exploitation and control of the industry to the detriment of the Nigerian people and state. It is not about the Nigerian people owning their oil and gas resources or having a greater say in it. It is not about the cry against individuals owning or being awarded oil blocs while most of the states in
the country are so cash-strapped, that they cannot pay salaries. It isn’t about oil workers having a greater say in an industry they have helped to build for sixty one years now. It is not about ending the enslavement of workers in a lucrative industry that has converted almost all permanent work into casual contract with no guaranteed job security. It is not about the Nigerianization of the Oil and Gas industry, 45 years after the Indigenization law. Rather, Local Content in the Nigeria Oil and Gas Industry is like asking that a little sugar be added to a tasteless jug of tea for the consumption a handful of local players in the industry. The main objective in Local Content provides that: “Nigerian independent operators shall be given first consideration in the award of oil blocks, oil field licences, oil lifting licences and in all projects for which contract is to be awarded in the Nigerian oil and gas industry subject to the fulfilment of such conditions as may be specified by the Minister.” The Local Content law is like telling Nigerians, ‘You can sniff indigenization, but you are forbidden from eating its fruit’ Seeking to add local content in an industry in the hands of foreigners is like telling Nigerians ‘You can swim in the river, but don’t get wet.’ It is instructive that the specificity of local content, and how far it can dilute the dominant foreign content in the Oil and Gas industry in the country, is at the discretion of whoever finds himself as the Minister of Petroleum. In other words, the power and the net worth of whoever is the Minister in charge of that Ministry is greatly enhanced by the Act. That in plain language means that if the overall foreign Lords in our Oil and Gas industry can
pocket the Petroleum Minister at any given time, the local content component can be jeopardized. There is a sense it can be argued that the Local Content Act is a long term, if circuitous journey in the desert to reach a Nigerianization promised land. These are in the realms of tactics and strategies; to eventually indigenize the Nigerian Oil and Gas industry without annoying the foreign masters or provoking a Western backlash. Government estimates that lack of local content had from independence in 1960 to 2010 resulted in capital flight of $380billion Dollars and job lost opportunities of about two million. It says that infusing local content, aims at creating 300,000 direct jobs and retaining over $14 Billion in the country out of the $20 Billion spent annually. The Act gives priority for the employment of Nigerians but says where a skilled Nigerian is not available, a foreigner can do such job over four years. In my analysis, this provides a latitude which foreigners can exploit. Also, under the Act, local companies can have “alliance partner” in foreign companies bidding for jobs. In a large sense, this is what subsists in the industry. Additionally, each project has 5 percent management provision for foreigners. This means that the main management positions can be controlled by foreigners. My argument includes the fact that the Local Content in the Nigeria Oil and Gas Industry and its enabling Act does not provide for labour representation in its structures and governing bodies nor protect Nigerian workers from the casualization of permanent jobs, a negative practice prevalent in the industry or encourage
local refining of petroleum products which can guarantee jobs and eliminate the fraud called oil subsidy. It does not change in any fundamental manner, the foreign-ownership structure of the Nigerian Oil and Gas Industry nor address the devastation of the environment due to oil and gas exploitation. The law does not reduce the cost of producing a barrel of crude oil which has hovered between $20 and $23; a far cry from Saudi Arabia which produces a barrel at $8.98 or war torn Iraq which produces at $10.70. Of course, the law is not concerned with the wastage of Nigerian oil resources or its implications for future generations. My basic argument is that our six-decade practice of holding the oil and gas cow while foreigners milk it, should change. I told the oil workers that if the Nigerian people are deprived of the benefits of being oil producers, their own interests as employees, cannot be guaranteed. In my analysis, there is a co-relation between the interests of the Nigerian people and those of workers in the industry. There is therefore the need to harmonize this relationship as we match towards the ultimate goal of controlling our oil and gas resources, utilizing them in a sustainable and beneficial way for this and future generations. Human Rights lawyer and Senior Advocate of Nigeria, Femi Falana advised the oil workers to adopt the implementation of the Nigerian Oil and Gas Industry Content Development (NOGICD) Act as a minimum programme on which to hold the Oil and Gas companies and government accountable. In my assessment, NUPENG still has a lot of fighting spirit. This is good for its members and Nigerians.
Nigeria better off selling palm oil than crude oil

On a whim the other day, I decided to determine what the price per litre of crude oil was. Of course I had been worried sick that this crude oil thing is a big myth. This crude oil, upon which every calculation is based in Nigeria, is a big mirage. I just spoke with a monetary policy person at the apex bank who also expressed worry that some of their core calculations are based on crude oil, and crude oil only. The only assumption that drives our national budget is also crude oil. The first item on all our plans is crude oil – how much of it we want to produce in a given year, and at what assumed price we hope to sell. It is as if the government even budgets for the entire 2 million barrels we drill, in terms of our Organisation of Petroleum Exporting Countries (OPEC) quota on a daily basis, as if the whole extracted volume belongs to Nigeria and is not shared with international oil companies. If this is so, we are living a lie; a big illusion. I also do not see where the cost of producing crude oil is considered in the calculations. Most Nigerians also assume that Nigeria sells 2 million barrels of crude a day, at the prevailing price, and pockets all the money. Nothing could be further from the truth. I don’t know why and how our illusion happened but it needs to be stated that: ● Crude oil is not so valuable; ● Crude oil is not valuable enough to hinge the very existence of this country upon; ● According to the Nigerian Extractive Industries Transparency Initiative (NEITI), Nigeria effectively gets 36 per cent of all the revenue from what we produce. The reason why we may have elevated crude oil to the status of be-all-and-end all must be that a certain laziness of thought overwhelmed our leaders at some point, after all we have absolutely no input in the production of that resource. I mean that Nigeria does not own any aspect of the technology in the production process. We only try to keep the books and we even fail woefully in accounting for this resource. So what exactly are we selling? I believe this laziness is borne of the fact that this is one resource where even though we add no input, we have set up some huge monstrosities called parastatals, like the Nigerian National Petroleum Corporation (NNPC) and run rings around the people, while waiting for millions of dollars that will come from abroad. We do not only have any input in the technology and processes around extracting crude oil, we have no input in the pricing as well. 40 per cent of the current price of crude oil is determined by traders in the spot, forward and futures market for the product. A lot of that price
depends on their whims; what they think will happen in the future. They also sometimes play the market by making the prices work in their favour. Is this the kind of product we should base a whole economy on? A product that also has huge repercussions on the environment? In a country where we do not even have scientists who are patriotic enough to help us identify fake drugs, or fake vaccines, or to even recommend to us what is healthy to eat and what is not, who is to tell us if there are serious long-term effects of all the drilling that is going on beneath the earth crust in Nigeria? To cap it all, there has been no accounting from that sector for almost three decades! Yet a president sits as the minister there. Let us do some basic calculation: ● One barrel of crude oil today sells for about N18,300 (this is $60 multiplied by N305); ● One barrel contains 159 litres; ● So one litre of crude oil today, sells for N115. Even at its peak in 2007/8 when crude oil sold for $140++, a barrel of crude oil in naira terms then, was around N21,000, as the dollar sold for around N150 then. This does not look like a very valuable product. It is certainly not the black gold that we say it is – except the proceeds from its sale is meticulously managed, and painstakingly aggregated. Those who will enjoy the proceed of crude oil must defer their gratification, and ensure that crude oil proceeds power other industries. This resource is not what you spend in advance Our leaders over time bought a dud. Any reasonable human being should know this right from the get go. But this refusal to think goes into our ‘we are blessed’ rhetoric. Over time and till date, our leaders don’t see anything wrong in sitting in office and expecting billions of dollars to drop on their laps. How Many Barrels Does It Take? Check this. At N18,300 per barrel, we need to sell 3,300 barrels to buy a single luxury ‘status’ vehicle for some big Oga in some parastatal. Imagine how many thousands of those we buy every year! An average phone that some small girl in one of our universities will reject as a birthday gift from a sugar daddy, will cost at least 15 barrels of crude oil. Imagine how many phones are used in Nigeria, where we buy the latest and the best that they don’t buy in the countries where the phones are manufactured in! The new headquarters of the Economic and Financial Crimes Commission (EFCC), which Mr. Magu boasted was built at a bargain cost of N24 billion, cost Nigeria a tidy 1,312,000 barrels of crude, even before we start to consider the cost
of drilling. In Nigeria today, it still costs over $30 to drill a barrel of crude (I hear Kachikwu is trying to see how they can crash the cost to $20 but in spite of his faults, I have seen how the man has been frustrated by Buhari at every step). The crude oil trade in this country is what Yorubas call ‘agbana’ (a cursed trade where you hemorrhage money faster than you make it). Only a totally irresponsible person will spend the proceeds of crude oil the way we spend it, or build such a life of Byzantine grandiosity the way we have – among politicians and top government functionaries. Anyone reading this is free at this point to calculate everything we use and buy in terms of crude oil. Note that if we want to actually get the impact properly, we need to only consider our PROFIT on crude oil, not the gross sales value. The closest estimate of our profitability that I came across is from NEITI, whose report early this year shows that out of every one naira we get from our crude oil, we have to pay the international oil companies 64 Kobo in terms of costs and other agreements. Pathetic! But I have good news for us; PALM OIL IS A MUCH MORE PROFITABLE PRODUCT. That’s right! Take a walk with me on this: ● A metric tonne of palm oil sells currently around $500 in the international market; ● A tonne of palm oil is almost like a tonne of water, which is 1,000 litres (palm oil’s density is 0.93 in comparison to that of water – almost the same); ● Therefore one litre of palm oil in the global markets sells for about $0.50; $0.50 is equal to at least N150 – higher than one litre of crude oil at N115, and costs far less to produce (certainly not $30 per barrel); ●Our ancestors have been producing palm oil on their own and trading globally in it since at least the year 1300. We will need little foreign assistance if we can think ourselves; ● It takes very little technology, but we can scale up like the Indonesians and Malaysians, who got most of their palm seeds from here in Africa and each individually produce at least 25 times what Nigeria does today; ● The Malaysians and Indonesians have gone ahead to build sophisticated markets and even developed advanced financial instruments on the basis of palm oil; ● Nigeria imports palm oil from Malaysia/ Indonesia; ● The palm oil market is equally elastic (and also a little less volatile in comparison to crude oil), because it is a product useful for many
industries; ● Palm oil grows in the wild in Nigeria and is naturally sub-opotimised The last time I bought palm oil around Owo, Ondo State, I recall it sold for something like N2,500 for a four-litre jerry can. That is like N625 per litre. At peak, palm oil sold in global markets for up to $1,500 a tonne, or $1.50 (N450) a litre. The highest price of crude oil is approximately N280 per litre (in 2008, crude oil sold for $145 per barrel. Even at today’s exchange rate of N305, a barrel was worth N44,225. A barrel contains 159 litres). So, perhaps we are better off propping up palm oil as our chief export product? What is happening to research on palm oil from the Nigerian Institute for Oil Palm Research (NIFOR) and elsewhere? Is it the lack of patriotism that is wrong with Nigerians or do we have a breed of Nigerians sworn never to allow Nigeria make progress? We have land mass and a weather that is very amenable to grow the produce en masse. Our locals will benefit more from such a drive. We would not need to depend so much on foreign ‘investors’ or technology. It will be less injurious to our environment. Indonesia and Malaysia have made so much progress on palm oil, that some Western activists are even trying to slow down the cultivation of palm oil. They say orangutans are suffering because more land is being taken for palm oil cultivation. Look at us here! Anyway, I don’t intend to start a palm oil plantation. There are probably many more products that will give us less stress on which we can also focus here. We certainly shouldn’t be putting our people through this suffering. Of recent, this terrible government of ours is trying to justify its hopeless budget under the pretext of declining crude oil prices. But I have done enough research to show that the tethering of our economic fortune to crude oil is totally unnecessary. Another research says that indeed we did not suffer from dutch disease, because more money was spent on agriculture after we had discovered crude oil. We suffered instead from the speed with which people looted whatever was budgeted – in every sector. If one considers it appropriately, it will be hard to have respect for so many of the old people who have run Nigeria at any level. They simply laid this land to waste. I wonder who cursed this country. But we can un-curse her. What is happening now is that this current scenario is totally unacceptable. Can we have new thinking please somebody?

Editorial Commentary Global anti-corruption laurel for Nuhu Ribadu

On Friday, December 7, 2018, Mallam Nuhu Ribadu, pioneer chairman of the Economic and Financial Crimes Commission (EFCC) stood before a global audience in Putrajaya, Malaysia—at the 2018 International Anticorruption Day celebrations—as joint winner, with Leonard McCarthy, a former Vice President of Institutional Integrity at the World Bank Group, of this year’s Sheikh Tamim Bin Hamad Al Thani International Anti-Corruption Excellence Award in the Lifetime/Outstanding Achievement category. The Sheikh Tamim bin Hamad Al-Thani International Anti-Corruption Excellence Award is presented annually on International Anti-Corruption Day (9th December) in “recognition and appreciation to those who have contributed to the global campaign against corruption. The Award recognizes individuals and organizations who have dedicated themselves to combat corruption in some capacity. “The greater purpose of the Award is to serve as a tool that highlights exemplary and noteworthy actions and good practices on a global scale, to recognize, promote, collect and disseminate anti-corruption models from around the world; to raise awareness, support and solidarity to the fight against corruption; as well as to encourage and inspire similar and new initiatives towards a corruption-free society. “The Award hopes that through its public image, the visibility of those who are fighting corruption is not only enhanced but also celebrated across the world and hopes to motivate governments, academic institutions, the media and civil society to adopt and understand the principles of the United Nations Convention Against Corruption (UNCAC) and collaborate towards its implementation.” It was an honour well-deserved and few people would have been surprised that Mallam Ribadu was the centre of attention of the global anti-corruption movement at the grand ceremony at the Putrajaya International Convention Centre, which had in attendance the Prime Minister of Malaysia, Dr Mahathir Bin Mohamad, and Emir of Qatar, Sheikh Tamim bin Hamad Al-Thani. The organisers said Mallam Ribadu’s “nomination was carefully reviewed by the Assessment Advisory Board and the High-Level Award Committee and was considered to contain and exemplify the values and virtues that this Award stands for.” As head of EFCC between 2003 and early 2008, Mallam Ribadu put the EFCC on the global anti-corruption map and left no one in doubt that he not only knows his onions when it comes tackling corruption but that he has the courage to boot. Many things prepared Mallam Ribadu for his role at EFCC and the honour accorded him. After studying law at Ahmadu Bello University and graduating from the Nigerian Law School in 1984, he opted for a career in law enforcement. He joined the Nigerian Police where he served both as a general duty policeman and a prosecutor. As a policeman, he engaged criminals in the streets of Lagos, and as a prosecutor, he was involved in almost all high-profile cases the police worked on. But the EFCC presented a different challenge. When the Commission was created in 2003, Nigeria’s image was at the lowest ebb in terms of cooperation with foreign law enforcement agencies to deal with money laundering and other financial crimes. This made it difficult for the county to be integrated into the global financial system. Mallam Ribadu and his team had to start from the scratch to clean up the image of the country and tackle a monster that was giving Nigeria the most headache at the time—the proliferation of cross-border financial scam, known as 419 after the section of the criminal code that deals with advance fee fraud. A small cartel of Nigerians leveraged on loose law enforcement and financial regulations to defraud foreigners who were eager to make a killing from the country. The criminals and their collaborators in banks created a reputation burden for Nigeria. No one wanted to do business with the country. Within the first few weeks of starting the EFCC, Mallam Ribadu decided to take on this group of powerful criminals. Some were brought to justice, while others are still facing criminal charges. After halting the spread of the immediate problem, the
Commission shifted its focus on sanitizing institutions. It targeted banks, financial institutions and law enforcement agencies, ushering a banking reform that created a new dawn and sanity in the financial sector. While taking on criminals and their accomplices who had compromised law enforcement was daunting, the Commission had an even bigger problem to contend with— confronting powerful and well-heeled politically exposed persons (PEPs) whose corruption and mindless profligacy had mired the country in poverty and underdevelopment. The EFCC under Mallam Ribadu investigated and prosecuted governors, ministers, and members of the national assembly, actions that almost cost him his life. Beyond Nigeria, the EFCC under Mallam Ribadu also investigated the operations of multinationals in the country. Of note is the Halliburton investigation, a complex bribery scandal that spanned almost a decade, between 1995 and 2004. During this period, the company, through its affiliates paid about $182 million to senior government officials as bribe for the award of a gas contract. Through the efforts of the EFCC, Halliburton was brought to justice in the United States. The company paid penalties totaling $579 million. EFCC also investigated Bilfinger, Siemens, and other multinationals. Under Mallam Ribadu, training was key to the success of the EFCC. He established the EFCC Academy and brought experts from around the world to train staff on all aspects of financial crime investigations. He also placed premium on establishing working relationship with sister organisations around the world and enrolled Nigeria into the Egmont Group through the creation of the Nigeria Financial Intelligence Unit (NFIU). He established fruitful relationship with the FBI, the Metropolitan Police, UK, the BKA, the Federal Criminal Police Office of Germany, among others. Within the sub region, the EFCC supported the activities of the West African Intergovernmental Action Group against Money Laundering in West Africa or GIABA—a specialised institution of the Economic Community of West African States responsible for facilitating the adoption and implementation of AntiMoney Laundering (AML) and Counter-Financing of Terrorism (CFT) in West Africa—and seconded staff from the Commission to the institution. Even though it has been a decade since he was forced out of the EFCC, Mallam Ribadu continues to advance the cause of anti-corruption and accountability in Nigeria. He continues to mentor young Nigerians in organisations engaged in anti-corruption work. The African Centre for Media and Information Literacy (AFRICMIL) has benefited tremendously from his experience in managing its accountability project, Corruption Anonymous, which seeks to protect and amplify the role of whistle blowers in the fight against corruption. He knows the role whistle blowers played in the success of the EFCC during his leadership. It was only fitting, therefore, that when AFRICMIL nominated him for this year’s Sheikh Tamim Bin Hamad Al Thani International Anti-Corruption Excellence Award in the Lifetime/Outstanding Achievement category, the organizers, the Qatar-based Rule of Law and AntiCorruption Centre (ROLACC), the current secretariat of the International Association of Anti-Corruption Authorities (IAACA), had no problems conferring him with the honour. The Rule of Law and Anti-Corruption Centre (ROLACC) was established under Qatari leadership in 2013 “to construct and develop specialized knowledge and skills for use by individual practitioners and institutions, which would lead to the strengthening of the rule of law and fight corruption in line with international standards and national needs.” This honour for Mallam Ribadu is a testimony to integrity, hard work and dedication. Chido Onumah, Coordinator of the African Centre for Media & Information Literacy (AFRICMIL), served as head of the civil society and crime prevention unit at the EFCC under Mallam Nuhu Ribadu.
OUR POSITION Buhari, NOUN Law and matters arising
W
ithout doubt, Open and Distance Education plays an essential role in personal, community, and national development. The increasing growth in Nigeria’s population, the accelerating demand for education at all levels and the challenge associated with accessibility, call for a more viable and robust means of educating Nigerian citizens, which Open and Distance Learning (ODL) institutes are presently doing. But a situation where law graduates from ODL institutes are not admitted into the Nigerian Law School while graduates are excluded from the National Youth Service Corps, raise questions on public acceptability of ODL as a quality means of acquiring formal knowledge. It is as a result of the foregoing that we commend the recent decision of President Muhammadu Buhari to give assent to the long overdue National Open University (NOUN) Amendment Act. The presidential assent is a welcome development as the action has finally settled the controversy over the status of NOUN graduates. It is instructive to note that the Special Adviser to the President on National Assembly Matters (Senate), Senator Ita Enang, had on Friday in Abuja, informed the State House correspondents that NOUN graduates are now free to enjoy the privileges attached to their certificates by virtue of the president’s assent to the bill. Enang had said, “President Buhari has also assented to National Open University Amendment Act, which allows the National Open University to operate as all other universities, having the same power and functions and the same administrative structures. This is a welcome development as the move will go a long way to clear the dichotomy and misconceptions faced by ODL graduates as majority of the students study with fears of acceptability in the society upon graduation. Education underpins all efforts towards national development, and so the fight against corruption, insurgency and all forms of social vices, which government is poised to win, will be made easier if everyone is educated. Religious, ethnic strife and intolerance, will also be reduced to the barest minimum if education is embraced by all and sundry, coupled with the attainment of the Millennium Development Goals (MDGs), which is hinged on Education For All. As the largest black population in the world and with literacy level of less than 60 per cent, Nigeria has adopted the Open and Distance education mode as a veritable tool for achieving its developmental goals and objectives. Incidentally, the National Policy on Education provides for lifelong learning through distance education and it is refreshing to note that the administration is taking full advantage of the opportunities that open and distance education provides. It is important to state that ODL has a number of daunting challenges that are specific to it.
These challenges are related to its demand for time, effort, energy, skills, knowledge and staff resources. There are also challenges that relate to public acceptability of ODL as a mode of study whose outcomes are comparable to conventional mode of study. This question of acceptability influences the existence of a state of affairs which scholars view as the marginalization of ODL courses in United Kingdom universities but with understandable exception of Open University of UK. We consider the legal backing for NOUN as a progressive minded one coming from the Federal Government, and we congratulate all NOUN graduates and undergraduates. We submit that Open Distance Learning is the best alternative to the challenges of gaining admission into the universities in Nigeria. We also wish to state that the conventional universities cannot admit more than one-third of qualified candidates annually. But we are happy that, in line with global education, the open distance learning, ODL, being run by NOUN will soon completely eradicate the challenges of admission into universities. We are of the opinion that there will be no discrimination between ODL and conventional universities as we believe that there is no age limit, no status limit and no social barrier to sound and qualitative education.

The former Minister of Justice, Mr Kanu Agabi (SAN) on Monday appealed to the Legal Practitioners and a privilege Committee to extend the award of the rank of Senior Advocates of Nigeria (SAN) to State Solicitors General and Directors of Public Prosecution (DPP) in the country. Agabi, who made the appeal in Abuja at the 2018 annual general conference of the Law Officers Association of Nigeria (LOAN), said the call became necessary because of their contribution and hard work, arguing that they deserve to be
conferred with the status automatically. Speaking during the conference whose theme is: “The Law officer as an unbiased umpire amidst economic challenges and realities towards the 2019 general elections’’, the former AGF noted that since the conferment of the status on the Director-General of the Nigerian Law School is automatic, solicitors general and DPP should also enjoy the same privilege. Tom Okpe, Abuja Chairman of the All Progressives Congress (APC) reconciliation committee in the North East and Governor of Nasarawa State, Alhaji Tanko Al’Makura has said the committee was blunt and thorough in handling the national assignment. Al’Makura, speaking at the national secretariat of the party in Abuja on Monday when he came for the submission of his team’s report to the party leaders with over 350 petitions said because there was no time, his committee had to hit the ground running. The party’s National Working Committee inaugurated reconciliation committee to look into aggrieved members complaints after the party’s primary election in October with a view to reconcile angry party members that were already defecting from the ruling party and heading to the law court for redress. This has brightened the chances of the APC in the forthcoming general elections in the North east. He said, “We are also appreciative of the support and cooperation, maturity of the leadership in these zones. The stakeholders and particularly those who were aggrieved made their presentations in the most expected decorum and etiquettes for venting their grievances without sentiments; misdemeanour. “I believed this is a sign of good omen. But, in spite of what must have happened during the primaries which are usually in every kind of dispensation. One’s position is required but there are many people
angling for it with complaints here and there. But, the commitment of our party members and confidence in our party leadership to vent out their grievances speaks volumes of their loyalty. “I believe this is a sign that we will have victory in the forthcoming election. I believe with the commitment and loyalty of our party members our party, the APC will surely win virtually all the North East in all the categories of elections to be conducted in February God willing”. Almakura who refused to disclose the recommendations of report however, told journalists that the Committee received more than 350 petitions from aspirants. According to him, “Right from governorship primaries up to the State Assembly election we have presentations of more than 350 aggrieved persons. Some were clustered into joint presentation”. Adams Oshiomhole, APC National Chairman who received the report on behalf of the NWC promised to carefully study the findings and recommendations of the Committee assuring that the party remains united and strong to win the 2019 general elections in the North East and the entire nation. “I am excited by the comment you made, the fact that people have not decamped but, have faith in the president and the party, we will do everything to service that faith, we will do everything to justify the confidence they have shown to your committee and to our leadership”, Oshiomhole said.

Tunde Opalana, Abuja The immediate past President, National Youth Council of Nigeria (NYCN), Amb. Murtala Muhammed Garba, has condemned the Minister of Youth and Sport Development, Barr. Solomon Dalung for infiltrating the ranks of the teeming Nigerian youths. He alleged that the Minister applies divide and rule tendencies in NYCN purposefully for political interest ahead of the 2019 general elections. Explaining his grouse with Sports Minister, he said, “since his appointment as the Minister of Youth and Sports Development, Barrister Solomon Dalung has not done anything to unite the umbrella body of the entire Nigeria youths. More defections hit Akwa Ibom APC Short News Isaac Job, Uyo
Another round of defections paralysed the Akwa Ibom state chapter of All Progressives Congress (APC) yesterday as chapter chairmen from 16 local government areas across the three senatorial Districts in the state dumped their brooms in support of Governor Udom Emmanuel of the People Democratic Party (PDP). The chapter chairmen who left the APC party with 20,000 members stormed Ibom Hall ground venue of the defection rally accusing the leadership of the APC of fraternizing with those that conspired with former PDP government in the state to deal with them. Addressing supporters and the state chairman of PDP with Governor Udom Emmanuel, the chairman of chairmen of APC who led the decampees, Mr Sunday Uyire said their return to PDP does not mean coming to struggle for power in the party but to team up with Governor Emmanuel to return to Government House in 2019.

Uyire said the rate of insecurity in the state during the reign of Senator Akpabio was about to manifest in the state as three of his colleagues were receiving treatment following attacks on them arising from disagreement in APC. He further appreciated Governor Emmanuel for giving all the aspirants plain levelled ground to campaign not
as the bad old days when opponents were trailed and lynched in their various homes in front of their wives and children. Receiving the decamped APC chieftains into PDP fold in Akwa Ibom, the state chairman of PDP Obong Paul Ekpo said such defection was unprecedented in the history of politics in the state. “It has not happened in the history of politics that members of another political party gathered on their own to return to another party without any inducement. We didn’t know that our preaching of peace, unity and development has touched our brothers. Therefore we receive and welcome all of you on behalf of the state working committee of our party.” Addressing the former APC members, Governor Udom Emmanuel commended them for showing boldness in the face intimidation. Governor Emmanuel said some of the APC leaders arrived Akwa Ibom from Lagos in a night bus and attempted to steal the show assuring the decamped APC members of acceptance.
Methodist Church warns Ndigbo not to boycott 2019 elections
The Methodist Church of Nigeria (MCN) has advised people of the south east not to buy the idea of boycotting the 2019 general elections in the country. The Prelate, MCN, His Eminence Dr. Samuel Chukwuemeka Kalu Uche handed down this advice in Umuahia during a press conference after a tour of Umuahia Archdiocese of the church, calling on the Federal Government to also release Sheikh Ibraheem El-Zakzaky, an outspoken and foremost Shi’a Muslim cleric in Nigeria. Dr. Uche who expressed his belief in dialogue, advised that political wars are not settled at the field, adding “If we boycott it, others will rule us.” He said that the Igbos are still marginalized and that no Igbo man occupies any position at the top three echelon of Nigeria political position, adding “what caused the civil war is still there and Nigerian is still afraid of the Igbos”. This, he said caused the Indigenous People of Biafra (IPOB) to issue the order, adding that it was the Igbos who brought enlightenment into the country as well as civilization.

Youths protest alleged maltreatment by NNPC in Aba
Youths from Okpokoroala in Uratta Autonomous Community, Osisioma Ngwa Local Government Area of Abia, on Monday protested what they termed “maltreatment” of their indigenes by the Nigeria National Petroleum Cooperation (NNPC). Okpokoroala is the host community of the Aba Depot of the NNPC. The youths, who flocked the road leading to the depot, barricaded the entrances and exits into and out of the depot demanding change of attitude from the company. The protest took a different dimension when the community’s Chief Priest accompanied by some youths brought out an effigy representing the community deity and placed it on the main entrance of the depot while daring anyone to cross it. The protesters, who sang peacefully at the gates, had placards bearing inscriptions like: NNPC recognize your host community; NNPC since 1979 you’ve not offered us office pin as your host, is it fair? Others were “Are we not your host community, why treat us as if we don’t exist? Enough of this 42 years of neglect and no more of such”.

Court orders final forfeiture of NDDC Director, Short News Tuoyo Omatsuli’s N1.8bn properties Ilorin Emir distances self from political Andrew Orolua, Abuja Justice Chuka A. Obiozor of the Federal High Court sitting in Ikoyi, Lagos, on Monday ordered the final forfeiture of a number of properties worth N1.8 billion recovered from the Executive Director, Projects, Niger Delta Development Commission (NNDC), Tuoyo Omatsuli, to the Federal Government. The Judge had, on Thursday, May 17, ordered the interim forfeiture of the properties, following an ex-parte application filed by the Economic and Financial Crimes Commission, EFCC. The properties are: Block 117, Plot 4, Lekki Peninsula Scheme, TPAO 992, Ikate Ancient City, Eti-Osa L.G.A, Lagos, measuring 1804.089Sqm and Plots 1-18, Block 43, TPAO 992, Ikate Ancient City, Lekki Peninsula, Eti-Osa, Lagos, measuring 10,000Sqm. Others are: Plot 1b, Northern Business District, Lekki Peninsula Scheme 1, measuring 1000Sqm and Plot 1; Block 25, Lekki Peninsula Residential Scheme 1, Eti-Osa L.G.A, measuring 2989.10Sqm.
Moving the ex-parte application, counsel to the applicant, Ekene Iheanacho, had referred to paragraph four of the affidavit, detailing how a contractor with the NDDC, Starline Consultancy Services Limited, was paid the sum of N10, 218, 019, 060.59) (Ten Billion, Two Hundred and Eighteen Million, Nineteen Thousand and Sixty Naira) as consultancy fee for levies collected from oil processing companies in the Niger Delta Region. It was further stated that out of the money paid to Starline, a sum of N3, 645, 000. 00 (Three Billion, Six Hundred and Forty- five Thousand Naira) was paid as kickback to Omatsuli through a company named Building Associates Limited. “Some of the funds were used by Building Associates to buy properties in the name of a company, Don Parker Properties Limited, where Omatsuli had majority shareholding,” Iheanacho had further told the court. The applicant also told the court that one Francis Momoh, who is described as the majority shareholder in Building Associates Limited, was introduced as a shareholder in Don Parker Properties Limited so as to disguise the nature of
the crime. After hearing the submissions, Justice Obiozor had granted all the reliefs sought by the applicant and ordered the interim forfeiture of the properties to the Federal Government. The Judge had further directed the Commission to publish the order in any national newspaper within 14 days, notifying the respondents or anyone interested in the properties to appear before the court and show cause why the properties should not be forfeited to the Federal Government of Nigeria. The applicant, in compliance to the court’s order, had published the interim forfeiture order in The Nation Newspaper of May 26, 2018. However, the respondents¬ had, on October 1, 2018, opposed the application, claiming ownership of the properties. Delivering his judgment today, Justice Obiozor held that the properties were acquired through proceeds from kickbacks received by Building Associate Limited operated by Momoh on behalf of Tuoyo. The Judge, therefore, ruled that the property should be finally forfeited to the Federal Government.

Eligibility suit: Gov Fayemi floors Oni ...Court okays Gov’s nomination, dismisses Oni’s suit
Gbenga Sodeinde, Ado Ekiti The Federal High Court sitting in Ado Ekiti has dismissed the suit filed by former Governor Segun Oni challenging the eligibility of the incumbent Governor, Dr. Kayode Fayemi, to run as the candidate of the All Progressives Congress (APC) as a sitting Minister in the July 14 governorship election in the state. Oni, who was All Progressives Congress (APC) aspirant in the election, is challenging Fayemi’s eligibility on the grounds that the governor did not resign his appointment as Minister of the Federal Republic 30 days before the party primaries and well that he was indicted by the Justice Silas Oyewole-led commission of inquiry. The commission of inquiry was set up by former Governor Ayodele Fayose to probe the finances of the state government when he was governor of the
state between 2010 and 2014. Among others, Oni, through his counsel, Chief Anthony Adeniyi, prayed the court to void the votes cast for Fayemi for refusing to resign and the indictment, withdraw the certificate of return issued to Fayemi, declaring Oni as duly nominated APC candidate and as well duly elected governor in the July 14 election. But Fayemi, though his lawyer, Chief Rafiu Balogun, who urged the court to strike out Oni’s suit for lack of merit, saying he was not a civil servant nor an official of APC hence the resignation clause was not binding just as he said an Abuja court had quashed the decision of the commission of inquiry. The case, which had earlier begun at an Abuja Division of Federal High Court, was transferred to Ado Ekiti last week. Justice Uche Agomoh, while ruling on the suit on Monday, dismissed the suit for lacking in merit, saying: “I am of the firm view that the originating summon is hereby dismissed” Agomoh, who resolved the issues for determination in favour of Fayemi, said
the governor could not be disqualified on the basis of the report of the Commission of Inquiry whereby an Abuja court had quashed the indictment. The judge said: “Indictment does not satisfy the definition of conviction. He cannot be disqualified”. Agomoh also said: “The issue of 30 days resignation before election does not apply in this case,” saying the applicant’s claim that Fayemi was an official of APC and a public servant could not be proved. According to the judge, Fayemi, as a Minister of the federation was not a public servant but a political office holder and appointee of the President, hence the 30 days resignation stipulation did not apply. Counsel to Oni in his response, said; “We are going to study this judgment to determine the next cause of action”. In his response, lawyer to Fayemi described the judgement as wonderful, saying “the court agreed with the positions of the law in arriving at the verdict”.
A Group, the Buhari Media Organization (BMO) has accused the Peoples Democratic Party (PDP) of indulging in cheap lies over Peter Obi’s accounts, the running mate to the PDP Presidential candidate in the 2019 general election, to shore up its flagging presidential campaign. The opposition party had alleged that some government agencies had frozen the Bank Accounts of its Vice Presidential candidate, Mr. Obi, his family members and their businesses. BMO said in a statement by its Chairman Niyi Akinsiju and Secretary Cassidy Madueke released in Abuja on Monday that PDP has now resorted to playing dirty after realizing that its chances of electoral success were bleak. The statement reads: “We had recently raised the alarm in the aftermath of the party’s strategy session in Dubai about a resolution to use religious and ethnic sentiments, lies and propaganda as campaign tools. “And not surprising, PDP had been spinning tales upon tales to cast President Muhammadu Buhari and his deputy Professor Yemi Osinbajo as well as the All Progressives Congress in bad light in the run up to the 2019 elections. “What is however surprising is that the party’s spokesman Kola Ologbondiyan is willing to stake his reputation as a journalists by putting his name on a statement reeking of outright lie against government agencies that PDP once claimed to have established in good faith”.
Disengagement: We followed due process, says EBSU Charles Onyekwere, Abakaliki The Management of Ebonyi State University (EBSU) Abakaliki has responded to the statement credited to the governorship candidate of the All Progressives Congress (APC), in 2019 general elections, Senator Sunday Ogbuoji, that he would reinstate the sacked staff of the state university if elected governor of the state. The governorship hopeful made the statement recently in his campaign office while flagging off his campaign where he also criticized harshly the state government for disengaging the workers of the university. Briefing journalists at the main campus of the university alongside other management staff of the university, the Vice Chancellor and former Deputy Governor of the state, Prof. Chigozie Ogbu, frowned at Senator Ogbuoji’s comment. Ogbu urged the APC governorship candidate to understand the fact that the university is autonomous and regulated by National University Commission (NUC) and a set of rules and certainly, not by any politician. “The politicians should find another ground to spread their falsehood and leave the university in peace, Ogbu added. The university Management had recently disengaged 63 of its pensionable staff and the withdrawal of extension of services of 46 contract and 90 adjunct academic staff following staff audit ordered by the governing council of the university.

NBA President, EFCC trade tackles over professional fees Andrew Orolua, Abuja The Economic and Financial Crimes Commission (EFCC) investigations into the financial transactions of Akwa Ibom State has uncovered what the Commission believed was a crime bordering on money laundering to the tune of N1.4 billion, but more importantly it raises serious controversies over legal practitioners professional fees. What began as part of the routine investigation activities by the Economic and Financial Crimes Commission into the financial transactions of Akwa Ibom State Government has cumulated into a media war, a ten 10 counts criminal charge against the President of the Nigeria Bar Association (NBA) Mr. Paul Usoro and a postponement of his publicized arraignment on Monday, till 14 December. The anti-graft agency which has been battling corruption said last week that its attention was drawn to the speech made by Paul Usoro, (SAN), President of the Nigerian Bar Association during the NBA’s National Executive Council meeting held in Abuja on 6th December, 2018, wherein he had raised his encounter with the anti corruption agency. The EFCC said that during the course of its investigation into an alleged fraud in the financial transactions of Akwa Ibom State Government its operatives stumbled into payments of total sum of N1.4b from the State account direct into the account of a law firm belonging to Paul Usoro. That indeed, it invited Usoro in June this year, to explain his role regarding the inflow of N300 million (Three Hundred Million Naira) from the Akwa Ibom State Government’s Account into the account of Paul Usoro Chambers, PUC. Usoro was also questioned on the aggregate inflow of N1, 110,000,000 (One Billion One Hundred and Ten Million Naira) from the state government’s account into the bank account of PUC. That during his interrogation, Usoro had claimed that the various sums of money received from the Akwa Ibom State Government, under the administration of Gov. Udom Emmanuel, were payments for “legal fees” to him and other “eminent members of the Inner Bar and a host of other members of the Outer Bar that I had engaged to work with me in respect of the Election Petition matter” involving the governor. Usoro is further quoted to have stated that the payments were “independent transactions and that the Akwa Ibom State Government’s payments-on-account were in respect of my Firm’s professional services to the State, while the payments to the senior counsel were made by me for and on behalf of Gov. Udom Emmanuel, at his request”. EFCC said that Usoro raising of the issue of “client-lawyer privilege”, and by employing in argument the words “judicially and historically”, the “issues of fees, as between a lawyer and his client, is a matter of privilege”, was an attempt by him to whipping up sentiment. EFCC said it does not intend to engage the learned silk on the pages of newspapers, on media landscape, stating clearly that it does

have regard for the Rule of Law and in this regard, the said “client-lawyer privilege”, but it should be stated that what is at stake, is the legitimacy of the source of the money used for the various payments. The learned silk, further accused the EFCC of playing the role of “Auditor and/or Regulator of Legal Fees”. This is definitely not the case. It is worth reiterating that while the EFCC has “Special Powers” to investigate suspicious financial transactions, Section 18 (d) of the EFCC Establishment Act 2004, empowers the Commission, to investigate and prosecute any person, who “engages in the concealment or disguise of the true nature, source, location, disposition, movement, rights, with respect to or ownership of property knowing such property is derived from any offence referred under this Act commits an offence”. From all intent and purposes, payment of over N1.4 Billion to Usoro from the accounts of Akwa Ibom State Government for unofficial transaction, is nothing short of criminal diversion of public funds. Based on this, the commission drafted ten count charges against Usoro, which are part of the questions Usoro must answer in Court, particularly as the payments were suspicious. The act of making such humongous payment of over a billion naira to an individual from state vault raises reasonable suspicion of money laundering. This may amount to a disservice to the people of Akwa Ibom state, so the EFCC shall not rest on our oars and allow such financial crime to continue unabated,it added. EFCC also faulted attempts by Usoro to isolate commission from being seen as genuinely partnering or collaborating with the National Judicial Institute, NJI and other national institutions on capacity building.
It added that Usoro by describing such collaboration an anomaly, is like a drowning man who holds unto a straw for survival. It added that the act of making such humongous payment of over a billion naira to an individual from state vault raises reasonable suspicion of money laundering. Unfortunately, Usoro had successfully turned the battle as if it is between the EFCC and the entire legal profession by winning to his side the entire members of NBA National Executive Council . The Council at the weekend issued a communiqué on the matter and raised four critical questions bordering on alleged criminalizing the legal fees and others. The Nigerian Bar Association (NBA), by its National Executive Council communiqué outrightly rejected and consequently condemned moves by the Economic and Financial Crimes Commission, EFCC, to criminalize professional fees payable by clients to legal practitioners in the country for services rendered. The NBA observed that Usoro was investigated by the EFCC based on a Zenith Bank N300m inflow into his law firm’s account on 14 March 2016, and the subsequent outflows from the account to various senior counsel between 22-23 March 2016. It further observed that the inflow was payment by Governor Udom Emmanuel of Akwa Ibom state in respect of an Election Petition Appeal that was determined by the Supreme Court, of which Usoro served as the coordinating counsel. Similarly, NBA noted that N1.1bn transfered into PUC’s Access Bank Account from AKSG was another source of investigation by the anti corruption agency. Apparently miffed by the development,
NEC of NBA said it extensively and exhaustively deliberated on the emerging trend by highlighting some of the nonexhaustive implications of EFCC’s action. NBA stressed that “the EFCC appears to be straining quite hard to criminalize the fees that are earned by lawyers for their legitimate work. Usoro’s case is not the first of these intrusions; we all recall the case of Chief Mike Ozekhome, SAN when the EFCC attempted to forfeit his fees on the pretext that the funds came from illegal sources”. “If these EFCC incursions are not checked, the Bar and the practice of our profession are doomed” NBA resolved. NBA stated that “the practice of law, as we all know, is founded on the independence of the legal practitioner and his courage to advocate on behalf of his client to the best of his ability and conviction. “That independence and the courage of the advocate are now being threatened and trampled upon by the EFCC, NEC noted. “Lawyers now have to work and walk on tip-toe, looking over their shoulders to determine whether the EFCC would be coming after them solely on account of their courage and independence in advocacy. “That does not bode well for the profession or for legal practice generally. NBA further posited that democracy and the rule of law are threatened when the lawyers’ independence and courage in advocacy are fettered howsoever, whether by the EFCC or any other person or organization, consequent upon the lawyers’ choice of clients. The NEC also held that client-lawyer privilege has judicially and historically been acknowledged that issues of fees, as between a lawyer and his client, is a matter of privilege. “The recent decision of the Court of Appeal that was delivered on 14 June 2017 in Appeal Number CA/A/202/2015: Central Bank of Nigeria v Registered Trustees of the Nigerian Bar Association & Attorney General of the Federation affirmed this position. “By questioning lawyers on the legitimate fees that they have earned from clients, the EFCC is breaching the lawyer-client privilege and showing complete disregard for the judgments of the Courts in this regard” NBA stated. Consequently, NBA’s NEC insisted that EFCC lacks the locus standi to meddle into client-lawyer contractual relationship, adding that “The fees that are paid by a client to his lawyer is not only a matter of privilege but is also contractual”. “As we all know, non-parties to a contract are complete strangers thereto and lack the locus standi to question and/or determine the propriety of such contract(s). “The EFCC stands in that position in this and other matters of this nature; it lacks the locus standi to question the basis for the fees” NBA posited. NBA is also contending that only the parties to the contract can question the justification for the fees and in this instance, neither party has raised any such query. However, EFCC is insisting that it is duty bound to question the sources of the N1.4 bn which it suspect to be a proceed of crime. We hope that this question which is now pending in court will could soon be resolved.

The Managing Director/ CEO, Transmission Company of Nigeria (TCN), Usman Mohammed has said they have established transmission, rehabilitation, and expansion programme geared towards stabilizing and expanding the delivery capacity of TCN to 20,000 megawatts by 2021. Mohammed disclosed this on Monday while briefing State House correspondents on the effort being made by the TCN under the present administration to increase electricity generation in the country. However, he said that the Distribution Companies (Discos) have remained the biggest obstacle to achieving improved electricity supply in the country adding that the Discos need a total of N4.2 billion to be able to distribute all the

He said that the fund was approved to TCN under his management due to the transparency and project implementation capacity under the new management introduced in the company. Speaking on the projects sponsored by donor agencies, the TCN chief said the procurement process of the Abuja Ring Scheme has reached an advanced stage, adding that that two contracts for the lines have been signed and the remaining lots for substation projects
have been evaluated and submitted to AFD for No Objection. According to him, it will fund five new substations and a new 330 KV transmission line to Abuja through Lafia, stressing that the line is entirely a greenfield project. The TCN boss listed the five notable projects to include: Abuja transmission ring scheme which is financed by the French Development Agency which attracted $170 million; the Nigeria Electricity Transmission Access Project (NETAP), a $486 million project financed by the World Bank; LagosOgun Transmission Project, costing $200 million financed by Japanese International Agency (JICA); Northern Corridor Transmission Project to be financed by French Development Agency and European Union at $245 and €25 million respectively and Nigeria Transmission Expansion project to be financed by the African Development
Bank at the cost of $410 million. Mohammed said that the NETAP started with advanced procurement in 2017 and was approved by the board of the World Bank in February 2018. He stated that the procurement of the project has reached advanced stage but is yet to become effective as it is still awaiting approval and legal opinion of the Attorney General and Ministry of Justice. He said the Lagos-Ogun Project, was inherited from past management of TCN and has been wholly scoped, designed, with some major aspects already completed. He noted that the project was being delayed due to issues of compensation. They include the construction of five substations and associated 330KV and 132 KV transmission lines in Ogun state and 132 KV substations in Badagry in Lagos state.

RMAFC to implement horizontal sharing formula next year Akam James, Yenagoa The Revenue Mobilisation Allocation and Fiscal Commission (RMAFC) has disclosed that the implementation of the horizontal revenue allocation formula for states and local government areas as a principle in sharing revenue from the federal account will begin next year. This was stated during a visit at the weekend by a delegation from the commission to the Bayelsa State government House, Yenagoa. The leader of the delegation, Alhaji Aliu Mohammed, noted that they were in the state to verify the data submitted for review by the state government, adding that some time ago the commission sent letters to the 36 states, all 774 LGAs, and the FCT to provide their data’s. He further stated that the last review was done in 2012, which is long overdue, noting that we received the data’s from states, LGAs in 2017. “We hope in the early part of next year we”ll come up with the new Allocation formula, by the law we ought to review vertical 5 years, Horizontal when the need arises” He also said the terrain has been adopted for proper documentation. According to the State Government, if the current formula is not reviewed the generation yet unborn will suffer, adding that we are part of the country and we should be treated as such. The Deputy Governor, John Jonah, while addressing the people noted that the meeting was vital due to the recommendation from the National Economic Council for a new formula, noting that the process might be slow but we will achieve it. He said some entity in the country feels it necessary for some states to get more than the federal government, adding that it’s not just money sharing but more powers to the states. Jonah, said because of the difficulty in developing the terrain, more money should be given to our states when sharing.

GDP: Budget implementation, Forex stability, others contribute to economy growth in Q3 - Uwaleke Motolani Oseni As Nigeria’s economy grew by 1.81 per cent from a year earlier in the third quarter of 2018, Professor of Capital Market, Professor Uche Uwaleke, has said the contributions of the non oil sector to the new Gross Domestic Growth (GDP) growth may have been helped by the implementation of the 2018 budget, relative stability in the exchange rate as well as the Central Bank of Nigeria’s (CBN’s) interventions in the real sector. The latest GDP growth showed that the non-oil sector of the economy continued its growth pattern in the third quarter of 2018, moving from 2.05 per cent recorded in the second quarter to 2.32 per cent. Prof. Uwaleke, explained that the third quarter stastics is better than 1.5 per cent recorded in the second quarter (Q2), and marked an end to the downward trend in the economic growth noticed since the first quarter of 2018. Commenting further on this development, the first professor of Capital Market in Nigeria stated that the performance of the nonoil
sector where marginal improvements were recorded in manufacturing, especially cement production, Transportation and agriculture. “This outcome may have been helped by the implementation of the 2018 budget which kicked-in at the beginning of the third quarter, the relative stability in the exchange rate as well as the CBN’s interventions in the real sector.” Although, he pointed out that the growth is still weak and fragile particularly concerning the sectors that have strong linkages to jobs, adding that the performance of the financial services sector which is critical to the economy is disappointing. “Going forward, there is the need to vigorously implement the capital component of the 2018 budget, invest more in education and health sectors which are lagging, tackle the incessant farmers-herdsmen clashes weighing down on food production and enhance access to credit by target beneficiaries of the various CBN intervention schemes. “Overall, improvement in the ease of doing business will go a long way in increasing the risk appetite of financial institutions in Nigeria which will positively rub off on GDP growth”,
he said. According to the third quarter gross domestic product report released by the National Bureau of Statistics, the nation’s GDP grew by 1.81 per cent (year-on-year) in real terms in the third quarter of 2018. Compared to the third quarter of 2017 which recorded a growth of 1.17 per cent, there is an increase of 0.64 per cent points” the report read. “The second quarter of 2018 had a growth rate of 1.50 per cent showing a rise of 0.31 per cenr points. Quarter on quarter, real GDP growth was 9.05 per cent. “In the quarter under review, aggregate GDP stood at N33, 368,049.14 million in nominal terms. This performance is higher when compared to the third quarter of 2017 which recorded a GDP aggregate of N29, 377,674.03 million thus, presenting a positive year on year nominal growth rate of 13.58 per cent. “This growth rate is higher relative to growth recorded in the third quarter of 2017 by 2.88% points and higher than the proceeding quarter by 0.01% points with growth rates of 10.70% and 13.57 per respectively.”
Court orders final forfeiture of NDDC Director’s N1.8bn properties Joy obakeye Justice Chuka A. Obiozor of the Federal High Court sitting in Ikoyi, Lagos, on Monday, December 10, 2018, ordered the final forfeiture of some properties worth N1.8bn recovered from the Executive Director, Projects, Niger Delta Development Commission, NNDC, Tuoyo Omatsuli, to the Federal Government. The Judge had, on Thursday, May 17, 2018, ordered the interim forfeiture of the properties, following an ex-parte application filed by the Economic and Financial Crimes Commission, EFCC. The properties are Block 117, Plot 4, Lekki Peninsula Scheme, TPAO 992, Ikate Ancient City, Eti-Osa L.G.A, Lagos, measuring 1804.089Sqm and Plots 1-18, Block 43, TPAO 992, Ikate Ancient City, Lekki Peninsula, Eti-Osa, Lagos, measuring 10,000Sqm. Others are: Plot 1b, Northern Business District, Lekki Peninsula Scheme 1, measuring 1000Sqm

Moving the ex-parte application, counsel to the applicant, Ekene Iheanacho, had referred to paragraph four of the affidavit, detailing how a contractor with the NDDC, Starline Consultancy Services Limited, was paid the sum of N10, 218, 019, 060.59) (Ten Billion, Two Hundred and Eighteen Million, Nineteen Thousand and Sixty Naira) as consultancy fee for levies collected from oil processing companies in the Niger Delta Region. It was further stated that out of the money paid to Starline, a sum of N3, 645, 000. 00 (Three Billion, Six Hundred and Forty- five Thousand Naira) was paid as a kickback to Omatsuli through a company named Building Associates Limited. “Some of the funds were used by Building Associates to buy properties in the name of a company, Don Parker Properties Limited, where Omatsuli had a majority shareholding,” Iheanacho had further told the court. The applicant also told the court that one
Francis Momoh, who is described as the majority shareholder in Building Associates Limited, was introduced as a shareholder in Don Parker Properties Limited to disguise the nature of the crime. After hearing the submissions, Justice Obiozor had granted all the reliefs sought by the applicant and ordered the interim forfeiture of the properties to the Federal Government. The applicant, in compliance to the court’s order, had published the interim forfeiture order in The Nation Newspaper of May 26, 2018. However, the respondentshad, on October 1, 2018, opposed the application, claiming ownership of the properties. Delivering his judgment on Monday, Justice Obiozor held that the properties were acquired through proceeds from kickbacks received by Building Associate Limited operated by Momoh on behalf of Tuoyo. The Judge, therefore, ruled that the property should be finally forfeited to the Federal Government.

My legislative network will attract more projects to Osun East - Famurewa Hon. Israel Ajibola Famurewa is the All Progressives Congress (APC), senatorial candidate for Osun East Senatorial District in the 2019 general elections. A two-time House of Representatives member, Famurewa was also the Director-General of the Governor Gboyega Oyetola Campaign Organisation and believes that his achievements in the House stand him in good stead to represent his people in the Senate. He spoke in this interview with our correspondent, HENRY OMUNU. As a House of Representatives member for seven and a half years, what is propelling you to seek to become a senator? It’s not easy representing a very wide federal constituency like mine; I have about four local governments and 42 wards. And even if you are talking about it now, you can say four local governments and four Local Council Development Areas (LCDAs), because LCDAs have been created out of the local governments. Then we have two urban and two rural LCDAs. The two rural development areas are so wide in landscape that you cannot even cover a local government in a day. If you decide to move round a ward, for example in a place like Atakumosa East, moving round a ward will take you like three to five hours, because of the terrain. So it’s not easy representing these people and in some places you have about 34 to 35 communities representing just one ward. In Atakumosa East for example, we have about 400 communities making just one local government. And for you to make your impact felt in all these communities won’t be easy at all. But we thank God for what we have been able to do within the little time and the little resources available to us. What we have tried to do is to prioritise and make sure we spread the projects across the local governments, knowing full well that we cannot touch every community at the same time. But, at least if we can touch a particular community in a zone or region, the others will definitely know that yes, this guy is doing something here and that their own turn will also come. But, the main challenge we face and have been facing is the limited access to funds. Here we have meagre resources to use compared to other constituencies of one or two local governments. So, the major constraint is funding as we have a lot of projects that we intend to put in place for our people, but we have limited resources to actually execute most of these projects. For close to seven years that you’ve been in the House, you’ve never chaired any committee, but you have been able to attract so many federal projects to your constituency that even some committee chairmen haven’t done half of what you’ve done. How was this possible? You know in the parliament, it depends on the way you carry yourself and the kind of network you have with your colleagues. And you know that lobbying is part of the game, so how you’re able to lobby your colleagues to toe your line of reasoning and to do something in your favour is crucial. And also the kind of one-on-one relationship and interactions that I have with people in the ministries and agencies also helped me in that area. And when you talk about my senatorial ambition, definitely we will have a larger place to cover which means more responsibilities on our hands. At the same time, there will be more opportunities and more resources than what we have in the green chamber for now. And I also want to believe that there will be improvement in our budgeting system. At least, if enough funds are released according to the Appropriation Act the problem would have been a bit better than it is now. So I want to believe that there will be improvement as we move on in the democratic process. I know it won’t be easy, but the God that has helped us thus far will continue to be
on our side. Because as we speak, people from other constituencies are yearning to have me represent them in the Senate so that they can also benefit from what my constituents are currently benefiting. You said people in other constituencies in the senatorial district are clamouring for you to represent them. In the event you get to the Senate and become a committee chairman, should they expect more from you in terms of quality and effective representation? You see, for them to be clamouring for my candidature, definitely, they believe that if eventually I become their senator they will benefit more. And I want to trust my God that he won’t fail me and he won’t let me down. And by the grace of God, even going to the senate, my eight years in the House will place me on a good pedestal as I’m no longer a novice in legislative business. I know where to go, when and how to get there. So I want to assure them that they will even get more than their expectation.

So what you’re saying is that going to the Senate will be an added advantage to your people? Definitely, yes! It’s going to be an added advantage to my people. How were you able to outdo other interests and opponents to emerge the APC candidate for the senatorial district? Really, before the coalition with the Social Democratic Party (SDP), in our party the APC, I think we were about five aspirants. The incumbent senator, there’s one gentleman from the North, another person from Ife axis and my humble self - the four of us. Now after the coalition, there was an arrangement between the party’s leadership at the federal level with a leader in the SDP camp. But unfortunately and fortunately, our party leadership at the state level wasn’t part of this arrangement. And looking at the history of this senatorial district in the last 20 years of this dispensation, the Ife axis has been occupying this seat for almost 16 years now, while Ijesha land did only four years. That was when Senator Akinfeyinwa was there between 1999 and 2003. And looking at the district, in Ijesha axis, we have six local governments while Ife has four local governments. So our people have been clamouring that it’s time for the senatorial seat to come to Ijesha land.
So by virtue of that understanding within my party, all other aspirants from Ife axis had their aspirations curtailed leaving the battle squarely on the lap of Ijesha land. And coming to Ijesha itself, they actually needed somebody with the pedigree and institutional memory which makes me more suitable. So that gave me an advantage over other aspirants in the sense that I have been in the National Assembly for almost eight years. On the other hand, the issue regarding the arrangement between the SDP chieftain, Senator Iyiola Omisore and our party’s national leadership, we have been able to settle that one as well. That issue has been resolved. But on the whole, my experience in the parliament gave me an edge over others from our side. Electioneering campaigns have begun in earnest, what would be your message to the people as you go out to canvass for their votes? My message to the people all along has been that I want to represent them and I want to represent them well. And I also want them to have much hope that better days are ahead in the life of this senatorial district if they cast their votes for the APC which flag I’m flying in the senatorial race. So they should see this statement as an assurance of quality representation in all its ramifications.

UK PM Theresa May delays crunch vote on her Brexit deal British Prime Minister Theresa May delayed a vote on a Brexit deal negotiated by her government - a decision that throws her plan to leave the European Union into chaos. May admitted her agreement would have been defeated by a “significant margin” at Tuesday’s vote, but warned those calling for a second referendum on leaving the EU would risk “dividing the country again”. “It is clear that while there is broad support for many of the key aspects of the deal, on one issue - the Northern Ireland backstop - there remains widespread and deep concern,” May said. The prime minister said she would first ask the EU for more “reassurances” over the main bone of contention: a “backstop” to ensure no hard border on the island of Ireland, which her critics say means Britain could end up indefinitely subject to EU rules after it leaves. Announcing the delay, May was laughed at by some lawmakers when she said there was broad support for the deal and that she had listened carefully to different views over it - the result of 18 months of tortuous negotiations. Despite postponing the vote, the Conservative leader insisted her deal was the best compromise between continued membership of the European Union and a “no-deal” Brexit, which would see the UK crash out of the bloc without key
agreements on trade and movement in place. Nevertheless, May said she would meet EU leaders to express concerns shared by opponents of her deal while making preparations for a “no-deal” scenario. Britain is scheduled to leave the bloc on March 29. Alan Wager, from the group UK in a Changing Europe, said despite May saying she would go back to Brussels “the deal cannot be substantially changed”. “I think she’s going to buy time and bring back the deal in January with a bit less time from MPs to say we’ve got a better option. She’s saying to MPs, ‘look it’s this or nothing’,” Wager told Al Jazeera. “I think we’re looking at a period of instability that’s going to go on beyond March now.” May’s government and parliament at large are divided along a number of divergent views, ranging from those who feel her deal does not go far enough in separating from the EU and others who feel closer cooperation is possible. Meyomessala is a small forest community in Cameroon’s South Region among several settlements on the edge of a biodiversity-rich UNESCO World Heritage Conservation site, known as the Dja Faunal Reserve. It is home to endangered species such as western lowland gorillas, chimpanzees, leopards, forest elephants, giant pangolins, bongo antelopes and buffalos. Nkoulou Bedjeme, an elderly woman, is one of 9,500 Bulu people and indigenous Baka pigmies whose ancestors have lived with the wildlife species for more than 100 years. Two years ago, her husband and brother died, leaving her to take care of 25 children. “We had tried the best we could to protect our land,” she tells Al Jazeera. “Our only source of livelihood that was being threatened by this Chinese rubber project.” Her livelihood depends on farming, hunting, fishing and gathering forest products. Like several others, she says, her problems began when the government allocated vast concessions within and around their villages to a Chinese stateowned chemicals company, Sinochem International, about 10 years ago. “In the beginning, they made lofty promises and we didn’t think we would find ourselves in the mess we are in today. But according to Bedjeme, the company’s rubber plantations are encroaching. They were planned to replace forest land six kilometres away from the villagers’ farmlands but the area was extended up to their backyard. “Two kilometres away from here, you would find the rubber plantation,” she says. She removes from her handbag a copy of a complaint she had written to the government in 2012. “They had to give us 11 million CFA francs ($19,000). Until now, we have received nothing. Our farms and crops were taken.” Civil society organisations, such as the WWF, Green Peace and the Center for International Forestry Research (CIFOR), have raised concerns over the social and environmental impacts of rubber projects implemented by Sud-Cameroun Hevea SA (SudCam), a local subsidiary of the Singaporean Halcyon Agri Corporation, of which China’s Sinochem International Corporation holds majority shares. Halcyon Agri Corporation is the world’s largest rubber processor and supplies the world’s leading tyre manufacturers, including Bridgestone, Michelin, Pioneer and Goodyear. A report by Greenpeace in July said between 2011 and May 2018, the company cleared more than 10,000 hectares of dense rainforest to extend the giant rubber project. In the course of implementation of the project, 45,000 hectares more of forest would be cleared. Satellite images reveal that from November 2017 to March 2018, about 1,000 new hectares of tree cover were affected, according to Greenpeace, which accuses the Chinese company of “a typical example of land grabbing”. Indigenous people who lived in the forest were displaced without compensation or adequate resettlement plan, Greenpeace said, claiming the “eviction” of forest people violates the UN Declaration on the Rights of Indigenous People. It also says the Baka pigmies’ right to consent was violated and that the community’s tombs and sacred sites are being destroyed.

Abuja to host Cycling FCT in January All is now set for Cycling FCT 2019 that will further create cycling infrastructure platforms, entrench cycling as a culture, a way of life that will change lifestyle and improve health in Nigeria, the organisers said on Monday. The Chairman, Cycling LifeScope, Soji Adeleye, told the News Agency of Nigeria (NAN) in Lagos that the event was a sister programme to the last
Cycling Lagos. He said that the the competition would be held in collaboration with the Federal Ministry of Transport and the Abuja Federal Capital Territory Authority as the second leg of Cycling LifeScope Ltd. “The Cycling Lagos debuted in Lagos in 2018 is conceived to become one of biggest sports, tourism and entertainment events in Nigeria and the entire Africa continent which has given birth to others. “The Cycling FCT is also an event that will traverse an engaging two months of activities from January for all category in Abuja and envions. “Activities for the event will be a high profile cycling bazaar that will consist of the main event that will hold
on Jan. 27, 2019. “It will be followed by an Awards Gala Night at the Hospitality Partners Hotel on Jan. 28, 2019,” he said. Adeleye said that the race would be preceded by three municipal location races for all comers which would serve the dual purpose of bringing cycling to the mainstream. “The race will serve as qualifiers and practice runs for those competing in the main event on Sunday. “The main event will offer very attractive prizes and there will be a classic road race of 180km (male) and 95km (female) on the Abuja Municipal circular highway. “It will start and finish at the Parade Ground, FCT, Abuja,” he said. Adeleye added that the idea of the
competition was to take cycling to the heart of the government and for people to help advance the advocacy of cycling. “With Cycling Lagos, most of corporate Nigeria has signed up to the theme and embraced the principles of healthy, sustainable and active lifestyle to their workers and those in their immediate environment. “Abuja with its relatively modern and open dual carriage ways offers a particularly inspirational and unparalleled cycling route for cyclists and what should become an annual international cycling Mecca. “In recognition of the contributions of cycling to the Sustainable Development Goals, concerted effort is being made across the globe to

NFF redeems $10,000 pledge to Super Falcons
Nigeria’s Super Falcons have received the $10,000 promised them by the President of the Nigeria Football Federation (NFF) Amaju Pinnick for winning the 2018 Africa Women’s Cup of Nations in Ghana. It was gathered from a source close to the team that the money was paid on Friday afternoon at the team’s Starview Hotel to each of the 21 players. The officials
were also paid. “The money should have been paid on Thursday but it was not possible,” said the source. Recalled that Pinnick promised to double the players $5,000 winning bonus ahead of the final game when he visited the team in Accra to motivate them. Nigeria defeated South Africa in penalties to lift the trophy for the ninth time.
Meanwhile, the players who have been in Abuja since returning from Accra last Sunday have started leaving the hotel following the postponement of the Presidential reception which was meant to hold today. The Africa champions have been grouped with France, Korea Republic and Norway for next year’s FIFA Women’s World Cup in France.

Portugal international Ronaldo joined Serie A champions Juventus from Real Madrid in a £99.2m deal in the summer. Ronaldo and Argentina forward Messi, 31, have long been regarded as the world’s best players, each winning five Ballon d’Or awards before Real Madrid’s Luka Modric claimed this year’s prize. “I’d like him to come to Italy one day,” said Ronaldo, 33. “I hope he accepts the challenge like me, but if he’s happy there then I respect that.” Ronaldo spent nine seasons at Real Madrid after arriving from Manchester United in 2009,

Gianni Infantino: FIFA to decide on 48-team World Cup in March 2019
FIFA President Gianni Infantino has revealed that the final decision on 48-team format for Qatar World Cup will be made in Miami next March. Infantino reiterated that FIFA will decide in March 2019 whether the 2022 World Cup could be extended to include 48 teams. Thirty-two teams contested this year’s World Cup in Russia, widely feted as one of the most entertaining editions of the modern era. Although FIFA is intent on 48-team future editions of the World Cup from 2026, a decision on Qatar won’t be known until next year. “We’ll decide in March,” Infantino said Sunday on French TV show Telefoot. “We’ve already decided that future editions should feature 48 teams, we all think it’s a good idea.” When the next edition is held in Qatar, it will be the first to be held in the Arab world and the first in a majority-muslim country. Due to the soaring summer temperatures, it will be held over November-December instead of the European summer months of June and July. As a result, the competition has been shortened
by three days — a factor that could be decisive in the considerations on the 48-team format. “It’s not easy because it will be played over 28 days, instead of 31 for a normal World Cup,” said Infantino. In March, FIFA will hold a meeting in Miami, where it could also decide whether neighbouring countries could be allowed to host some of Qatar 2022’s games. “Why not, if it’s feasible ?” added Infantino. “We’re talking to Qatar about the possibility of holding some matches in nearby countries. “Why not dream, it’s not impossible.”

Muazu Shehu, Deborah Pam win maiden national anti-corruption half marathon Muazu Shehu and Deborah Pam have won the men and women categories of the 1st National Anti-Corruption Half Marathon held in Abuja on Monday. Muazu crossed the finish line with a time of 1:04.31 to beat Goyet Gideon (1:04.50) to first place, while Gyang Emmanuel finished third in 1:05.34. In the women’s category, Pam outpaced Fadekemi Olude with 1:17.58 to the runnerup’s 1:21.07, while Elizabeth Nuhu clocked 1:21.39 to finish third. The 1st National Anti-Corruption Half Marathon was organised by the Economic and Financial Crimes Commission (EFCC), in collaboration with the Athletics Federation of Nigeria (AFN). The News Agency of Nigeria (NAN) reports that the event, tagged the “Abuja Marathon 2018”, was in commemoration of the United Nations Anti-Corruption Day. The participants, including members of the Armed Forces, paramilitary agencies and students converged on the Eagle Square, the start and finish point of the race, as early as 6:30 a.m. on Monday. The 21.03km race took participants from
the Three Arms Zone through Maitama, Mabushi, Utako, Wuye, the Abuja National Stadium to the Central Business District, before terminating at the Eagle Square. Addressing participants after the race, EFCC Chairman, Ibrahim Magu, said he was impressed by the turnout and promised that the Abuja Marathon was going to be an annual event. Magu also said the fight against corruption, which informed the race, was a fight for all Nigerians. “I implore you to remember this day and use it as an avenue to support the fight against corruption. Fighting corruption in Nigeria is in national interest and the duty of every Nigerian,” he said. NAN reports that ex-athletes and football players, such as Mary Onyali-Omagbemi, Samson Siasia, Chioma Ajunwa, Garba Lawal and Tijani Babangida, were on hand to pledge against corruption. NAN also reports that the winners in the men and women categories went home with cash prizes of N1 million. Runners-up and third-placed athletes smiled home with N500,000 and N200,000
each respectively. Speaking to NAN after his prize was presented to him, Shehu said he hoped the win would propel him to the international stage. “I will be participating at an invitational in China in Jan. 2019. I hope this win will give me confidence,” he said. On her part, Pam said she would continue to train hard with the aim of becoming an international marathon athlete capable of challenging some of the best in the world.
