mainly affected by the insurgency in Taraba, Bauchi, Gombe, Adamawa and Yobe states. He explained that Borno State was not included as a result of the insecurity in the state. According to him, out of the 27,000 farmers, 10,000 out of them were from Gombe State, and attributed the development to their dedication and commitment in terms of farming activities. “For example, 11,525 farmers are cultivating 38,678 hectares of land for maize, sorghum, soya beans, rice and cotton, while the nearest to it Yobe State is cultivating 14,666 hectares of land by 5,676 farmers. He said the programme would cover all the commodities that the North East has comparative advantage of producing which includes rice, maize, millet, sorghum and even small ruminants amongst others. The NECAS President said that inputs would be given to farmers on loan basis and they were expected to pay back in three phases. “Starting with first payment of 40 per cent after the first farming cycle, then they would pay the remaining two cycles of 30 per cent making a total of 100 per cent. “Before now, the size of each

farm had been captured and an identity card was issued to each of the beneficiaries of the project for easy identification and documentation to enable them to access the required support,’’ he said. “The project was a modified version of the ABP, which was aimed at strengthening efforts to attain bumper harvests and expressed the optimism that the new initiative would double the achievements of the ABP, Deware added. He said that under the new initiative, the Central Bank of Nigeria (CBN) had modified the programme to facilitate its direct relations with NECAS so as to ensure timely disbursement and full repayment of ABP loans, unlike what obtained in the past. Deware disclosed that the association has re-absorbed some of the retired extension agents in the beneficiary states and re-trained them on modern technologies in enhancing their job performance. “NECAS under the programme has commenced the recruitment of retired but willing to work extension workers in order to boost support for farmers and ensure proper sensitisation on new farming methods as well as advise on any problem faced by farmers”. He further disclosed that more than 128 extension

agents were recruited for the programme in Adamawa State as it was in other states. Dware said that for the successful implementation of the exercise, the extension workers have been taught the working systems of modern technologies in service delivery and they are optimistic that the training would be beneficial to the farmers. According to him, the efforts are geared toward encouraging increased agricultural production in line with the drive to diversify the economy. He said this has become imperative because the role of agricultural extension agents in the development of agriculture throughout the world is very essential. “It has remained one of the prime movers in the development of agriculture and invariably in the rural development. “There specific objectives as agricultural extension officers were to provide advice to farmers on problems or opportunities in agricultural production, facilitate development of local skills and transfer new technologies to farmers and rural people,’’ he said. He disclosed that NECAS has also developed a suitable extension service that is gender specific and tailored to women farmers.

EFCC secured over 150 convictions in 7 months – Magu

The Acting Chairman, Economic and Financial Crimes Commission (EFCC), Mr Ibrahim Magu, has said that the agency secured no fewer than 150 convictions in seven months. Magu disclosed this on Monday at a stakeholder interactive session held at the Ibadan Zonal Office of EFCC. He added that the agency had ensured the prosecution of all corruption cases irrespective of how highly placed the culprit was. Magu said, “For us at EFCC, we are driven by courage, integrity, professionalism and commitment to the common task of improving the lots of our people at the grassroots as we promote working partnership with all stakeholders.” The EFCC boss stressed that the agency had not and would not engage in a witch-hunt, adding that its activities were in line with international best practices. ‘‘In all that we do, we are guided first by the fear of God and patriotism to our

fatherland and the rule of law. ‘‘I will continue to discharge my duties guided by fear of God, overriding interest of Nigeria and rule of law,’’ he said. Magu, who stated that the commission had recorded notable achievements, added that it became accessible to Nigerians and had brought the anticorruption campaign closer to the people. The EFCC boss solicited the support of all stakeholders, saying the fight against corruption must be collective. He said, ‘‘Like we all know, corruption is the number one problem that has militated against the development of Nigeria, especially the very poor at the grassroots. ‘‘The havoc that corrupt practices has wrought on the Nigerian economy is, no doubt, endless. ‘‘This is why fighting it (corruption) to a standstill is not only a must but the only lifesaver for our country. ‘‘We must all join hands to kill corruption. We must

fight this menace. There is no better time to prop up the anti-corruption campaign than now.” Magu said it was pertinent for all Nigerians to see themselves as stakeholders in the fight against corruption. He called on journalists to see themselves as strategic partners in the fight against corruption and urged them to also expose corrupt practices around them. Mrs Dolapo Dosunmu, the State Director of National Orientation Agency (NOA), who commended Magu for excellent performance, said the agency was making an impact in the country. She called on all stakeholders to see the fight against corruption as a collective one that all must support. Impeachment saga takes new turn as Saraki allies sue FG, others Henry Omunu, Tunde Opalana, Tom Okpe & Andrew Orolua, Abuja

In a preemptive move to stop the Federal Government, the police and the Department of State Service (DSS) from allegedly aiding the All Progressives Congress (APC) to remove the Senate President, Bukola Saraki and his deputy, Ike Ekweremadu, from office, their allies, on Monday, dragged the Attorney -General of the Federation (AGF) and Minister of Justice, the Inspector General of Police and the Department of State Services (DSS) before the Federal High Court, Abuja. Saraki’s associates, Senators Rafiu Adebayo (PDP, Kwara South) and Isa Misau (PDP, Bauchi Central), are asking the court to restrain the Federal Government and its agents from aiding the forceful removal or impeachment of Saraki and Ekweremadu from office. The plaintiffs also named the Senate, the Senate President, Deputy Senate President, Senate Leader, Senator Ahmed Lawal, Deputy Senate Leader, Senator Bala Ibn Nallah, Deputy Minority Leader, Senator Emma Bwacha; clerk of the Senate, deputy clerk of the Senate, the AGF, the inspector general of police and the DSS. The suit marked FHC/ABJ/ CS/872/2018, was filed on Monday by Mahmoud Magaji (SAN). The two senators also filed a motion on notice praying for an order of interlocutory injunction restraining the fourth to 11th defendants and their agents from unlawfully removing Saraki as the Senate President, pending the determination of the substantive suit. The plaintiffs are also seeking for an order of interlocutory injunction restraining the ninth to 10th defendants from unlawfully interfering with the lawful legislative duties of Saraki as the Senate president, until the determination of

the substantive suit. The plaintiffs are further seeking an order of interlocutory injunction restraining the 10th to 11th defendants from harassing, hounding intimidating, arresting or detaining Saraki in respect of the lawful exercise of his duties pursuant to Section 50 (1) (a) of the 1999 Constitution (as amended) pending the determination of the substantive suit. The two senators are also asking the court to make an order directing the parties in the suit to maintain the status quo pending the determination of the substantive suit. In the substantive suit, the plaintiffs want the court to determine among others: “Whether in view of the provisions of Section 50 (1) (a) and (2) of the 1999 Constitution, the president of the Senate who defected to another party as a result of division in his former party, can be made to vacate his office other than in accordance with the provisions of Section 50 (2) of the constitution? “Whether by a combined reading of Section 50 (1) (a) and (2) of the constitution and Order 3, Rule 8 of the Senate Standing Orders, 2015 (as amended), the president of the Senate can be compelled to vacate his office on the ground that he is not a member of the party with majority of senators in the Senate? “Whether by a combined reading of Section 50 (2) (a) of the constitution and Order 3, Rule 8 of the Senate Standing Orders, 2015 (as amended), the president of the Senate can be said to have vacated his office by virtue of Section 50 (2) (a) of the constitution when he has not ceased to be a member of the Senate? “Whether the president of the Senate can be said to have vacated his office as president at the Senate by virtue of Section 50 (2) (b) of the constitution when the 8th Senate of which he is the president has not been dissolved?” Upon the determination of the questions, the plaintiffs are seeking

the following reliefs: “A declaration that the president of the Senate cannot be made to vacate his office other than in accordance with the provisions of Section 50 (2) of the constitution and a declaration that Saraki cannot be compelled to vacate his office on the grounds that he is not a member of the party with majority of Senators in the Senate. Others include a declaration that he cannot be said to have vacated his office by virtue of Section 50 (2) (a) of the constitution when he has not ceased to be a member of the Senate and a declaration that the president of the Senate cannot be said to have vacated his office as president of the Senate by virtue of Section 50 (2) (b) of the constitution when the 8th Senate of which he is the president has not been dissolved. Furthermore, the two senators are seeking a declaration that the president of the Senate cannot be said to have vacated his office by virtue of Section 50 (2) (c) of the constitution when he has not been removed from office by the votes of not less than two - thirds majority of the members of the Senate. In addition, they want a declaration that in view of Section 50 (2) (c) and the fact that the members of the Senate are 109 in number, any number less than 72 out of the 109 members of the Senate cannot validly sit and remove the president of the Senate whether by impeachment or whatever name so called. Similarly, the plaintiffs want the court to declare that by a combined reading of Sections 5 and 150 (1) of the constitution, any of the 8th to 10th and 11th defendants and their agents cannot validly enforce any act of the 1st, 3rd to 8th defendants, whether jointly or severally, to remove the 2nd defendant from office without such act being in compliance with Section 50 (2) of the constitution as amended. The State Security Service (SSS) has refuted report that huge sums of money and other incriminating materials were found at the homes of its former Director General, Lawal Daura who was sacked last week by Acting President Yemi Osinbajo after hooded DSS operatives blocked the entrance to the National Assembly. Report and video clips depicting purported incriminating items allegedly recovered from Daura house went viral over the weekend amidst rumour that his house was searched. But the DSS in a statement made available on Monday by its spokesman, Mr Tony Opuiyo, stated that no such recovery operations had been undertaken by the Economic and Financial Crime Commission (EFCC)or any

other security agency at the DSS’ office or residences of Daura. The statement reads in part, “The attention of the DSS has been drawn to the circulation of fake information and videos in which several items were said to have been recovered from the Katsina and Abuja homes of its immediate past Director General, Lawal Daura. These non-existent items include: N21billion cash; 400 assorted and sophisticated small arms and light weapons/rifles; and Thousands of Permanent Voters Card (PVC) belonging to Niger Republic immigrants. “In another video also in circulation, some persons believed to be personnel of a security outfit were seen forcing open safes stocked with money. The security operatives were described as executing a recovery operation at the Katsina home of the former DGSS.

“Consequently, the DSS wishes to inform the public that these videos are false and should be disregarded. So far, no such recovery operations have been undertaken by the EFCC or any other security agency at DSS’ office or residences of the former DG. “There is no doubt that different interests have continued to give varied accounts of the incident of last week at the National Assembly. It may, however, be recalled that the Presidency had pledged to carry out a detailed investigation regarding the alleged National Assembly siege. “The public is, therefore, advised to exercise restraint in their narration of events and as such, desist from spreading fake news or engaging in activities that may mislead or further cause a breach of the peace as well as pre-empt the outcome of investigations.

Saraki either by themselves and their agents to enforce any act of the 1st, 3rd to 8th defendants purporting to have removed the 2nd defendant from office without such act being in compliance with the provisions of Section 50 (2) of the constitution as amended. An affidavit deposed to by Senator Isah Misau in support of the originating summon, averred that the agents of the 10th and 11th defendants have taken steps to flagrantly breach provision of Section 50 (i) and 2 of the constitution by employing their agents and privies to disrupt the plenary of the 1st defendant without recourse to the provision of Section 50 (2) (c) of the 1999 Constitution as amended. Misau stated that the constitutional provision of removing the Senate president as contained in Section 50 (2) (c) of the constitution does not empower the 9th, 10th and 11th defendants to unlawfully interfere with the legislative duties of the 1st defendant by causing the blockade of the National Assembly complex or using their agents to disrupt the lawful duties of the Senate. The deponent posited that the court is statutorily empowered under Section 6 (6) (b) of the constitution to prevent the usurpation of the powers of the 1st defendant by granting the interlocutory reliefs pending the hearing and determination of the substantive suit. He stated further that on August 6, 2018, the agents of the 9th and 11th defendants blocked the major entrants leading to the National Assembly complex and thereafter directed their agents not to allow the senators, House of Representatives members as well as the staff of the National Assembly access the National Assembly complex. “That the essence of that blockade was to pave the way for few members of the Senate to sit and impeach the Senate president without recourse to the provisions of Section 50 (2) (c) of the constitution. Misau contended that the court is statutory empowered to intervene and curtail the excesses of the acts of the defendants which are in flagrant violation of Section 50 (2) (c) of the constitution. No date has been fixed for the hearing of the suit.

In a related development, the anticipated reconvening of the National Assembly to consider the supplementary budget and virement is now shrouded in uncertainty as no specific date has been announced by the leadership of the legislature when it would cut short its annual recess and resume plenary. Deputy Speaker, House of Representatives, Hon Yusuff Lasun, had last week at the briefing by the All Progressives Congress (APC) House caucus given an indication that the assembly would reconvene on Tuesday or Wednesday this week to consider and pass the supplementary budget and the virement. But as at Monday, the Clerk to the National Assembly, Sani Omolori, was yet to publicly inform senators and House members, majority of whom are abroad on holidays when the National Assembly is to reconvene. Usually, when lawmakers are to be recalled from their annual recess to consider matters of national importance, the clerk to the National Assembly would place advertorials in major national dailies, radio and television stations, notifying senators and House members that they would resume plenary at a specific date. Sources said the level of anxiety and uncertainty over the exact date of resumption by the National Assembly is further aggravated by the fact that lawmakers who are Muslims and are performing the lesser hajj in Saudi Arabia would want to be in the country when the National Assembly reconvenes. Also, as at press time, there was no information to the reconvening of the assembly from either the office of the Senate president and that of the chairman, Senate Committee on Media and Publicity, Senator Aliyu Sabi Mohammed. Similarly, spokesman of the House, Hon Abdulrazaq Namdas, confirmed to newsmen that the House leadership under Speaker Yakubu Dogara was yet to decide on when to reconvene the House. The Daily Times further gathered that the leadership of the Senate under Saraki, who acts as chairman of the National Assembly, might be buying time in order to extract a firm commitment from the Presidency, before reconvening, following last Tuesday’s siege on the assembly by

Court adjourns suit challenging Presidential Executive Order 6 The Federal High Court Abuja on Monday adjourned until August 30, the suit challenging the Presidential Executive Order No. 6 of 2018 on the preservation of assets connected with corruption and other relates offences. The vacation judge, Justice Ijeoma Ojukwu, fixed the date to allow the plaintiffs exhibit the order, which was the matter in contention as well as ensure that all other processes were regularised.

Lawyer to the plaintiffs, Mr Obed Agu, told the court that he had not attach the order to the processes he filed earlier because it was in the custody of the defendants. Ojukwu, however, asked him to apply for the said order and make it available to the court. “If you want the court to determine the legality or otherwise of this order, you have to present it to the court. “It is an originating summons

and so any document you want the court to determine must be made available to the court.” Lawyer to the defendants, Mr T A Gazali, said that they were not hiding the order and that if the plaintiffs wanted a copy, it would be made available to them. The defendants in the suit are the President and the attorneygeneral of the federation. The plaintiffs, Mr Ikenga Ugochinyere and Kenneth Udeze, are in court to seek

the court’s interpretation and determination of the Executive Order No. 6. The plaintiffs are asking for an order of court setting aside and/or nullifying the provisions of the Executive Order No. 6 for being unlawful, unconstitutional, illegal, null and void. They also want an order of injunction restraining the defendants from enforcing or giving any or further effect to the order.

157 prison inmates set to write WASSCE as 2 pursue PhD The Lagos Prisons Command has said that education behind bars is getting more interesting with two of its inmates already pursuing their PhDs at the Kirikiri Maximum Prison. The Controller of Prisons, Lagos Command, Mr Tunde Ladipo disclosed this in an interview with the News Agency of Nigeria (NAN), on Monday in Lagos. According to him, there is a renewed interest in education among the inmates across the various prisons in the state. He said that the progress and courage exhibited by the two PhD inmates at the maximum prison had sparked off a new zeal for academic pursuit among other inmates. “The command is committed in ensuring that no inmate is left behind in terms of education, as this is part of the reformation we are carrying out. “Sometime around May or June, two of the inmates who have acquired their Masters degrees enrolled for their

PhD in the newly established National Open University of Nigeria (NOUN) centre at the Kirikiri facility. “One of the inmates is studying Business Management and the other, Peace and Conflict Resolution, and the Vice Chancellor of the NOUN who personally presented them with the letter approving their PhD courses said it is tuition free. “To us, this is ground breaking and very encouraging, as they have shown that they are not limited by the situation they find themselves. And that is part of the essence of our ongoing reformation across the prisons. “As a result of this, the command is also witnessing an increase of enrollment of inmates into various categories of learning at the various prisons schools. “We are indeed happy with the establishment of the new NOUN centre at the Kirikiri Prison, with state-ofthe art facilities such as ultra modern and well stocked

library, computers and air conditioners,” Ladipo told NAN. According to him, a total of 157 inmates across the prisons in the state have registered for the upcoming second series of the West African Senior School Certificate Examination (WASSCE) for private candidates. Giving a breakdown of the statistics of the inmates from the various facilities, he said that 91 of the inmates were from the Ikoyi Prisons, 12 from the Female Prisons, 14 from from the Medium and 40 from the Maximum Prisons. Ladipo said that preparations were in top gear for the examination at the various facilities, to ensure that the inmates come out in flying colours. “I will like to commend the Federal government for its commitment in exposing the inmates to life-changing reforms that are ongoing currently in the prisons, through education and skills acquisition.

“It is worthy to note that government, through the Controller General of Prisons, Ja’afaru Ahmed, recently donated books to facilities across the country for improved research, teaching and learning for the inmates. “This, coupled with the new facilitators we have engaged to complement the existing ones in facilities, will go a long way in improving the performance of the inmates during the WASSCE examination. “Aside intervention from the Federal government in preparing the inmates for the examination, a bank also presented cash donation as well as some fans, in an effort to upgrade the facilities for conducive teaching and learning,” he said. The state controller said that empowering the inmates with education would go a long way in restoring confidence in them, as well as make them less dependent persons, whenever they regained freedom.

The rumoured imminent arrest of Saraki and his deputy, Ike Ekweremadu, by security agents to pave way for their subsequent impeachment is another reason why the reconvening of the National Assembly remains uncertain. The Peoples Democratic Party (PDP) had on Sunday raised the alarm over what it called a plot by the APC and the Presidency to allegedly use compromised security agencies and the Economic and Financial Crimes Commission (EFCC) to invite, arrest and detain Saraki and Ekweremadu. Also, the party alleged that the pressure by the Presidency for the reconvening of the National Assembly is borne out of a sinister motive and not for the purpose of approving the budget of the Independent National Electoral Commission (INEC) for the 2019 elections. “The fresh plot to detain the two presiding officers is part of renewed design to keep them out of circulation, ahead of Senate resumption, so as to enable the heavily induced APC senators, who are now in the minority, to throw up two of their members as Senate president and deputy Senate president respectively, on the excuse that Saraki and Ekweremadu failed to show up for proceedings in the Senate,” the PDP alleged. The Daily Times further gathered that nocturnal meetings have been held over the past 48 hours by Saraki with PDP senators and a few APC senators in order to convince them to defect to the PDP, to fortify the opposition party against any expected move by the APC to successfully impeach the two incumbent Senate presiding officers. While the PDP is insisting on the constitutional backing that the impeachment of the Senate leadership requires a two-thirds majority (73 senators), they however, entertain the fear of the APC’s recourse to illegality aided by the Presidency to execute the unexpected. Indication that the National Assembly may reconvene this week, follows last week’s meeting of the National Assembly leadership with the management of the INEC. Chairman of INEC, Prof. Mahmood Yakubu, after a two – hour meeting with the principal officers of both chambers, had assured that the commission’s budget will be approved this week to provide spending for a six- month series of activities preceding the commencement of the election which is 190 days away. Meanwhile, the APC has described the allegation by the PDP that the Federal Government plans to arrest

Saraki and Ekweremadu as hogwash and baseless. The party also said the victories witnessed at the just concluded bye-elections in Katsina, Bauchi and Kogi states has demonstrated the confidence and trust Nigerians have in the Buhari administration. A statement released in Abuja by the acting National Publicity Secretary of the party, Yekini Nabena, said that he thought by now, the PDP would be tired of what he described as “lame opposition strategy of false alarm, baseless and frivolous accusations”. Nabena said President Buharsi’s administration has repeatedly demonstrated its strict adherence to the rule of law, therefore the alleged plan to arrest or harass the mentioned National Assembly leaders is “hogwash and baseless”. The statement assured that nobody, no matter how highly placed will escape the full wrath of the law if he or she runs fowl of the law. He said, “Clear conscience fears no accusation. Why are the PDP leaders afraid of arrest if their conscience is clear? All law-abiding citizens or residents of the country have nothing to fear about arrest. “If the Senate president and the tree-climbing senator are facing criminal charges in our law courts and his deputy has explanations to make to the Economic and Financial Crimes Commission (EFCC) for acquisition of numerous properties in Nigeria and abroad through questionable sources, the President Buhariled APC administration has nothing to do with them. “The laws of the country are only being applied and they should answer for their acts of infamy”. Commenting on the outcome of the bye- elections, Nabena said: “Since assuming office, President Buhari has demonstrated the political will and remains solidly committed to the task of building a new Nigeria in line with the change agenda promised the electorate and the progressive ideals we stand for. “As a political party, we remain genuinely committed to address our challenges, reconcile legitimately aggrieved interests and emerge as a more united and stronger political fighting force as we face the general elections in 2019. “Like every other country, we have our challenges, but they are surmountable. We have an administration working day and night to surmount them and put the country on the right pedestal. With the continued cooperation and support of Nigerians, we have good reason to look forward to the future with great hope”.

Ambush: Police name 4 slain officers Launch massive hunt for fleeing bandits

Andrew Orolua, Abuja The Nigeria Police have released the names of four its officers killed last Saturday in an ambush attack by bandits in Kaduna. Lawal Daura: An encounter with intelligence chief

It was 24 hours after the official release of my book, “An Encounter with the Spymaster” in July 2017 that I received an invitation from a top retired Airforce officer for a meeting with the then Director General of Department of State Service (DSS), Lawal Daura. Before the invitation, a Presidential spokesperson, Mallam Garba Shehu had publicly attacked the book in a press statement which he described as “an attempt to rewrite the history of the War on Terror Campaign.” Though I was not sceptical or apprehensive about the scheduled meeting that day, I nevertheless told the retired military officer that I wouldn’t be able to attend because I was on a casual dress of Jeans and T-Shirt instead of my usual traditional attire for public outings and visitations. The Officer countered that my dress did not matter. I, therefore joined the team comprising top retired officers from the Nigerian Airforce, Navy, Army, intelligence Services and a strategic officer. Present at the meeting were top DSS directors with the Director-General himself. Meanwhile, that visit to the DSS Headquarters afforded me the second opportunity of a face-face encounter with Lawal Daura. I had previously met him at Heathrow Airport, London on the night of May 14, 2017, probably after he might have met President Muhammadu Buhari who was then on Medical Vacation in Britain. Though one could have misgivings on some of his official roles, Daura naturally wears infectious smiles, decked with disarming contour of glowing white beards. The aura projected him as a harmless and innocent person who cannot hurt a fly. I walked up to him and surprisingly, he responded calmly and briefly to my penetrating questions about his office, especially on his refusal to appoint a spokesperson for his agency and other contentious issues. With reassurance, he gave what he called

genuine reasons for the excuses and excesses. That visit to his office, afforded him the opportunity to inform us about major accomplishments and some misgivings about his office. Ever-smiling, Daura was eloquent, smart and intelligent in response to some of the issues we discussed. Daura who was sacked a few days after his 65th birthday, was born in Daura, Katsina State and started his career in the State Security Service in 1982 and rose to the rank of Director. He was once a spokesperson of the agency and Deputy Director Presidential Communication, Command and Control Centre at the Abuja. He also served as the State Director of Security Service at various times in Kano, Sokoto, Edo, Lagos, Osun and Imo States. It’s not unlikely that some of his achievements may have been overshadowed by the many controversies trailing his tenure as the Director General of the agency. He was particularly responsible for the release of many hostages from the Boko Haram gulag. In fact, the release of UNIMAID lecturers, including a group of oil explorers and policewomen that were held captive for more than half a year could be attributed to his efforts. His agency played prominent roles in the alleged exchange of Boko Haram Commanders with many Chibok and Dapchi Girls. The agency was also directly involved in the arrest of major kidnap kingpins and top ritualists and provided intelligence to other services for such arrests nationwide. He was also responsible for the arrest of a member of the controversial AVM John Ode Presidential Arm Probe Panel for alleged extortion on behalf of other members and for money laundering and illegal possession of firearms. The suspect, retired Air Commodore Mohammed Umar was nevertheless illegally detained for five months by DSS before he was released after a threat by Justice Dimgba. There was also the glaring inter-

agency rivalry among security agencies which triggered the DSS to submit two damning ‘security report’ on EFCC Boss, Ibrahim Magu to the Senate, warning lawmakers not to confirm his colleague’s appointment. Lawal Daura only reported directly to President Muhammadu Buhari and no one else. It is an undeniable fact that in the three years of Muhammadu Buhari’s administration, the DSS under Lawal Daura has succeeded in some of its statutory mandates but unfortunately, it is notorious in defying the constitution by disobeying court orders and detaining citizens arbitrarily. While it sounds childish the claim by political elements that the recent siege on NASS was a conspiracy between Lawal Daura and Senate President Bukola Saraki, the question on the lips of many and begging for an answer is: could the Kwara man be more influential and sophisticated than the Number One man from Katsina? Could the same Senate President influence the flagrant disregard of court orders by DSS in the illegal detentions of former National Security Adviser Sambo Dasuki, and a leader of the Shiite movement, Ibrahim el-Zakzaky since 2015? Could Saraki have engineered the October 2016 dead-in-the-night invasion of homes of senior judges across the country by the DSS with the arrest of seven judges, including two of the Supreme Court who were later discharged except one that died during the trial? Who could have also influenced the violation of a court order and forcible ejection of Former DG DSS, Kayode Are from an Ikoyi property in December 2015? Have we forgotten in a hurry how in November 2017, the EFCC secured an order to arrest Ita Ekpeyong, a former DG DSS and this action was scuttled due to the activities of DSS under Lawal Daura and the roles he played in the saga involving Ayo Oke, the erstwhile DG of

NIA? Could another opposition element to President Buhari also used DSS to clampdown and arrest several lawmakers of Ekiti State House of Assembly in March 2016 and the invasion of the National Assembly and stealing of the Mace of the Senate of the Federal Republic by thugs suspected to have been procured by an APC Senator, Ovie Omo-Agege, from Delta State in April 2018? On whose directive was the unconstitutional attempt to remove Governor Samuel Ortom in Benue State in July 2018 when DSS and the police provided security for eight lawmakers to take over the House of Assembly of 30 members? What about the incident in 2015 when DSS operatives raided the Government House Uyo, Akwa Ibom State purportedly in search of arms, ammunition and a huge stash of United States dollars, and which till date, no charges have been filed three years after? Whose footprints were those? Were journalists spared the fangs of the white-bearded man? Was it the opposition that ordered Daura’s DSS to detain Jones Abiri, a journalist from Bayelsa State from July 2016 to July 2018 without being charged to court? Were the ‘wailers’ also responsible for the detention of Tony Ezimakor, a journalist with Daily Independent who was threatened to disclose his sources of information? By the way, who could have influenced the naked display of nepotism where 51 candidates from Katsina were recruited into DSS as against 44 successful candidates from the entire South-East of five states in 2016? Could Lawal Daura have attained and achieved some of the feats, the pros and cons without the knowledge of the Commander-in-Chief since he only took orders from one person? Or should we agree with the political permutations that his positive deeds are attributed to President Buhari while his negative actions were influenced by the ‘Sarakis’ of this world and other opposition elements?

Daura and threats to democratic order

The decisive action taken by Acting President Yemi Osinbajo on Tuesday in dismissing Lawal Daura, erstwhile director general of the state security service from office is a great plus for Nigerian democracy. The decision of Daura to invade and blockade the National Assembly might well be the most serious threat to the democratic order since 1999. The sanctity of the legislature is the foundation of liberal democracy and the executive branch of government cannot, under any condition, carry out what the Ag. President has correctly called an “illegal act” by invading the complex and preventing legislators from accessing the place. Since the drama on Tuesday, there have been lots of theories explaining the context of what happened. One set posits that Lawal Daura is the mole of the Senate president, Bukola Saraki and that he carried out the action to embarrass the government of President Buhari, which has been battling Saraki for a long time. The other narrative is that Daura has learnt from the script of President Obasanjo, who during his time raided State legislatures and used Nuhu Ribadu, the then chief of the Economic and Financial Crimes Commission (EFCC) to get minority legislators to gang up and illegally remove sitting governors. I find the second narrative more convincing. There are concordant reports that Lawal Daura and the APC chairman met with APC senators on Monday to plan the coup against the Senate leadership. If these reports are true,

then it is difficult to make the case that Daura was working on behalf of Saraki. Bukola Saraki is no angel but unconstitutional efforts to remove him are building his credibility. In this column, I have condemned the concerted action by Lawal Daura and Bukola Saraki to block the appointment of Ibrahim Magu as EFCC Chairman several times, as such I am not saying that the two cannot collude on matters that serve their joint interest. My argument is that when we review the events surrounding Saraki’s travails over the past three years, there have been persistent efforts by the security to deal with him, the most prominent being through the Code of Conduct Tribunal. Indeed, Saraki has to be grateful to God that in his wisdom, President Buhari appointed someone who is very incompetent to head the SSS. Mr. Daura’s tenure has been marked by reckless disregard for the rule of law. We can all recall his actions on October 7 and 8, 2016 when he orchestrated the invasion of the homes of senior judges across the country, leading to the arrest of seven of them. While acknowledging that corruption had become deep and embedded within some judicial circles in the country, the raid was conducted in such a manner as to harm the reputation of the whole judicial arm of government and it therefore became a threat to the democratic order, in the same way that the siege on the National Assembly impacted

the system. It was in this context that the National Judicial Council declared the invasion unconstitutional and condemned it as an affront on the judiciary and democratic order. Mr. Daura has also been at the centre of the flagrant disregard of court pronouncements over the detention of the former national security adviser, Sambo Dasuki, and a leader of the Shiite movement, Ibrahim el-Zakzaky. In spite of numerous court orders, the two have been held in detention. The Shiite leader has been held with his wife since December 2015 and have been refused access to overseas medical attention, in spite of the serious bullet wounds they received on the night of their arrest. It is important to recall that the unconstitutional attempt to remove Governor Samuel Ortom in Benue State some weeks ago has also been traced to Mr. Daura. In that case, security was provided for eight legislators to seek to impeach the governor in an Assembly of 30 members. Lawal Daura was also notorious for detaining journalists and human rights activists. In recent weeks, for example, there has been a major campaign for the release of Jones Abiri, a Nigerian journalist from Bayelsa State, detained for years and only recently taken to court following an outcry from the public. It was therefore uplifting to hear the newly appointed acting director-general of the State Security Service, Matthew Seiyefa, say on his assumption of the office yesterday that the service

is reviewing all cases of alleged unlawful detentions and human rights abuses. He said categorically that: “We will not tolerate the abuse of freedom of Nigerians and we will not be intimidated nor cowed as we will protect our mandate”. It is high time that security agencies revert to the constitutional role of protecting the rights of citizens, rather than violating them. The point must be made that the Lawal Daura affair is a microcosm of a wider crisis in the Buhari administration. It has been public knowledge for a long time that the key security operatives of the regime – NSA Munguno, COAS Burutai, DG Daura and Chairman Magu – have been engaged in serious factional infighting, including engaging in open fights when, for example, the EFCC tried to arrest a former DG of the SSS, Ita Ekpenyong. Public safety and national security cannot be guaranteed when security agencies are working at cross purposes. Lawal Daura was doing what he did because President Buhari allowed him to do it. There has been a breakdown in the operations of security agencies because President Buhari chose to allow then fight each other, rather than fight terrorists, bandits and criminals. We cannot have significant improvements in security provisioning unless and until President Buhari creates order and functionality in the security sector. He must urgently review the sector and appoint people who are ready to work together for the good of the country.

Editorial Commentary The uncommon blatant truth: You reap what you sow

Times Guest Columnist Noel Anosike Just less than half a year for the next general elections, Nigeria is now hotter than any hot water you can think of. No other news can be heard or read now in Nigeria, but only politics. Does it mean that the leadership in Nigeria is no longer four years? Because, after three years of complicated cum contaminated leadership, our ‘’politishines’’ are not talking about dividends of democracy again, or what they will do for the masses, they are busy running around, looking for the political party that will help them go back to their political seats. Is that place their birth right? The truth is that apart from a very insignificant few of them that joined from former ACN and CPC, all these defectors are the members of the old PDP. Whether you are seeing them now as APC or ADC or PDP, etc., most of them are members of the old PDP. Therefore, they are all there for their own personal and selfish interests. Instead of practicing democracy, they either practice ‘’democrazy’’ or ‘’familiocracy’’. They are ‘politishines’, not politicians, they play ‘politricks’, not politics. To be candid, Nigerians by this time ought to be absolutely aware of the incessant exhibition of political jiggery pokery cum abracadabra by these our leaders. They know where they meet, when to meet, how to meet, etc, and we can never be there when they do so. Imagine one of the topmost principal officers of the National Assembly going back to the PDP he dumped three and half years ago. What did he keep there that he wants to take now? Imagine a National Chairman of a political party telling the foremost principal officer to step down or resign. Is it not the same national chairman that was a labour leader, used it to make names but could not make one of the states in the South-South or a popular city among the captivating states or cities, when he was the state governor. Please and please, all these people are the same. No single difference, not even one of them is better. All they are doing now is, having more

strategies and avenues of achieving their overzealous quest for more power and wealth. They are not there for the masses, not for their states, not for their constituencies, not even for their local governments. Some of them will give you Keke Napep (tricycle) before the election. When they win, they will ban the use of Keke Napep. As they are giving you whatever now with their right hand, they are collecting it immediately they win, with their left hand. Their wives, children, siblings, boys and mostly loyalists, are equally in power now. Sometimes, you will see one of them jostling for a ticket with their in-laws or relatives. Just few days ago, two siblings from the same parents in Kastina State, were politically fighting to win the Senatorial seat while the younger one defeated his elder brother; you can name others. The uncommon blatant truth is that Nigerians are tired of all these games. Do we call it game or movie? You people can continue to fight yourselves there, do not involve the masses. After all, your children are abroad enjoying life, electricity, good education, among others while the masses in the country are suffering. You will reap what you sow. How can the PDP come now and be talking about vote buying? How can they talk about rigging? Who started vote buying in Nigeria? Who started rigging in Nigeria? Is it not the PDP? When the members of the PDP were adding numbers in the final results to ensure they win, did they consider the outcome? There is an adage that says, ‘’When an Ewe (female goat) is eating, the kid (child) watches, learn, to practice later. Those doing vote buying now are the same people that bought the votes eight years ago and four years ago in the PDP. You cannot sow corn and expect to harvest pear. The PDP laid the foundation of what it is now accusing the APC of doing. Why are the members of the PDP complaining now? We, Nigerians are no more interested in your fake, fabricated and ironical stories as members of the PDP and the APC are all the same people.

or the past couple months, the media has been dominated with the political face-off between Imo State Governor Rochas Okorocha and the Deputy Governor, Prince Eze Madumere and their irreconcilable differences. The relationship of the two friends began crumbling following the resolve of Madumere to succeed Okorocha after many years of service. But the intrigues that have trailed Imo State politics since the entrance into the race of Mr. Uche Nwosu, Okorocha’s sonin- law, have changed the permutation. Okorocha had at different fora, described his deputy as “most trusted lieutenant for the 25 years of service. Among Madumere’s political sins was his alleged connivance with the former National Organising Secretary of the All Progressives Congress (APC), Senator Osita Izunaso, to seize control of the party during the congresses held in May this year. Madumere’s refusal to back down triggered the cold war that presently rages between both camps. Though the Deputy Governor has continued to deny insinuations that he is out to engage Okorocha in a political duel, facts on ground indicate that the governor’s men have removed the gloves. Sources said Madumere had largely been shunted to the background, his office underfunded while the governor’s sonin- law and Chief of Staff, Uche Nwosu, running the Government House, calling shots at every turn. Following deepening mistrust and disagreement between Okorocha and Madumere, the latter has moved out of his official residence, the Deputy Governor’s Lodge. But Okorocha had advised Madumere to shelve his governorship ambition and run for Imo East Senatorial seat while his son-in- law, Nwosu, goes for the plum job instead. That advice Madumere turned down, insisting he was qualified to run for the governorship of Imo State. As the face-off continued to rage, a move to impeach the deputy governor has been launched following the constitution an ad-hoc committee of gross misconduct leveled against him by the state House of Assembly. The six-man committee, which has Hon. Kenneth Ibeh, (Obowo state constituency), as Chairman is expected to report back to the House in seven days. To this end, the embattled Madumere has dragged the Chief Judge, Justice Paschal Nnaji, the Speaker, Imo State House of Assembly, Hon. Acho Ihim and the State Assembly to court to quash the planned impeachment initiated by the lawmakers. Following the planned impeachment,

obviously angry protesters took over the streets of Owerri, the state capital. They leveled unprinted accusations against Okorocha, including masterminding what they perceived as”Kangaroo charges against his deputy”. They accused the lawmakers of being mere rubber stamp in the hands of Okorocha who controls the House as personal estate, without reference to the feeling and aspiration of the citizenry. We are of the opinion that the action Imo State House of Assembly in the ongoing impeachment process against Madumere, which is political in nature, must follow due process. The lawmakers must realise that Nigerians and the whole world are watching them. They must follow the impeachment process as enshrined in Section 188 of the 1999 Constitution (as amended) to the letter. Otherwise they will realise later in the day that their action is illegal and unconstitutional. The Supreme Court verdict over removal of any governor is instructive for the Imo State House of Assembly. A word is enough for the wise as the Imo Assembly seems to be walking in the same previous illegalities by their fellow lawmakers which Supreme Court declared as a nullity, illegal and quashed with warnings to lawmakers to desist from lawlessness and impunity. Time will tell if the lawmakers can walk the talk in the days ahead.

Misau to Ojudu: You should be ashamed of indicting Buhari Tunde Opalana, Abuja Chairman, Senate Committee on Navy, Senator Isa Hamma Misau, has stated that the Presidency should be ashamed that it is pushing the conspiracy script that top officials of the nation’s security apparatus are working for the Senate President, Dr. Abubakar Bukola Saraki. Reacting to the Economic and Financial Crimes Commission (EFCC) statement that debunked the allegations credited to the Senior Special Assistant to the President (Political Affairs), Babafemi Ojudu, that the EFCC was working in tandem with Saraki, Misau said that both the All Progressives Congress (APC) Chairman, Adams Oshiomhole and Ojudu, were spinning the same conspiracy theory to hide the lack of coordination and discipline amongst the security agencies. In a press statement in Abuja on Monday, Misau said “The EFCC’s

statement confirms our immediate reaction that both Ojudu and Oshiomhole have been reading from the same conspiracy script. “Nigerians find it unthinkable that Magu that the Senate refused to confirm - whose EFCC has also prosecuted Saraki for over three years at the Code of Conduct Tribunal (CCT) would now turn around and start working for this same Saraki. Any other such investigation into the matter would constitute another attempt by these same people to present a biased perspective to the assault on our nation’s democracy and its highest lawmaking body,” Misau stated.

Intimidation, vandalism won’t stop us, Senator Abe vows Amaka Agbu, Port Harcourt Governorship aspirant of the All Progressives Congress (APC) in Rivers State, Senator Magnus Ngei Abe, has declared that last Saturday’s destruction of the party’s new secretariat by hoodlums would not stop its official opening ceremony. Senator Abe made the declaration while speaking at Bori, Headquarters of Khana Local Government Area of Rivers State, during a special prayer session organised by women of the Rivers South-East Senatorial District. EEDC urges customers to protect installations Moses Oyediran, Enugu Enugu Electricity Distribution Company (EEDC), Head of Communication, Mr. Chukwemeka Eze has appealed to customers to join hands in helping the company protect its electricity installations from vandals. Calm returns to Maiduguri Airport after soldiers’ mutiny Andrew Orolua, Abuja

The Nigerian Army said on Monday that calm has been restored at Maiduguri Airport after some troops went on protect for two hours on Sunday over redeployment to Marte an enclave of Boko Haram element that was liberated by Nigerian military some years ago. The Deputy Director Public Relations, Operation Lafiya Dole Theatre Command, Colonel Onyema Nwachukwu, said in a statement on Monday that the protest was by “few unscrupulous troops”. “Calm has however been restored, as the Theatre Commander, Major General Abba Dikko has promptly taken charge of the situation after addressing and admonishing the troops”, Nwachukwu said. The statement said it is regrettable that while the command was conducting a redeployment of soldiers at the Maiduguri Airport, following a directive to review troops’ deployment in Maiduguri metropolis, to reinvigorate the security architecture of the city, a few of the troops appeared to have misunderstood it. It explained that “the redeployment

became expedient after a recent assessment of the security situation by the Theatre Command.” Regrettably however, a few of the troops who had misunderstood the development and erroneously assumed it was going to negatively affect their rotation from the theatre of operation became agitated and reacted by firing into the air. “The Theatre Command undoubtedly considers this ugly incident quite regrettable and appropriate measures are being taken to forestall a recurrence”, it added. The Daily Times learnt that the aggrieved soldiers were claiming they had overstayed at the North East fighting insurgents therefore were resisting redeployment to Marte, one of the towns liberated by the military several years ago from the control of Boko Haram terrorists. The protesters are part of the special force deployed to provide air defence and enhance security at the airport. The troops barricaded some section of the airport and fired shots in the air, causing pandemonium, as hundreds of pilgrims waiting to be airlifted to Saudi Arabia for the Hajj, scampered for safety.

One of the protesting soldiers who spoke under condition of anonymity, said the planned deployment was against the directives by the Army Headquarters. “The army special forces deployed to the airport were not trained to engage in ground battle rather trained to provide air defence. “Our task is to provide air defence. Alas, special forces trained to fight ground battle are stationed in Maiduguri and we are deployed to go and die in Marte”. Another soldier lamented that the troops have overstayed in the Northeast fighting Boko Haram, despite the rotation order by the military authorities. He said many of them have spent over three years in the battle field. “Some troops of Operation Lafiya Dole were deployed and worked for over three years in the theatre and not rotated as against the directives by the Chief of Army Staff, Lt.-Gen. Tukur Buratai. “The command is directed to redeploy soldiers back to their bases after spending stipulated time in the theatre of operation. “We have spent over three years in the northeast and we should be transferred out of the northeast and not within,” he stated.

Women face hurdles in exercising right to vote - Survey Mathew Dadiya, Abuja A new survey conducted by Women’s Situation Room Nigeria (WSRN) shows the urgent need for more robust efforts to engage and educate female voters ahead of the 2019 general elections because they face more risk of disenfranchisement. The survey, which was carried out across all six geopolitical zones of the country, exposed lower levels of awareness amongst women about the need to collect permanent voter cards (PVCs) in order to vote. According to the survey, nearly 1 in 5 women incorrectly believe that it is possible to vote with a temporary voter card. The survey further revealed that women have lower levels of awareness about the process for collecting PVCs.

Bakassi Boys: Defence of provocation can’t avail appellant from willful conduct The Appellant is one of the “ Bakassi Boys” leaders and members of the Abia State Vigilante Group known as “Bakassi”, who were convicted and sentenced to death for the murder of two persons; Chukwudozie Nwachukwu and Okechukwu Maduekwe. This appeal is about whether the conviction for murder should be substituted with conviction for man slaughter. FACT The facts as established at the Abia State High Court is that on 9/7/1999, the Appellant and three other Bakassi Boys namely Ezeji Oguikpe, Stanley Azogu and Adiele Ndubuisi were invited from Aba, where the said group is based to Government House Umuahia by Ndukwe Okereke, a State Security Service Official. At the Government House, they met the then Secretary to the State Government, Dr. Elekwachi Nwaogbo, who instructed the SSS official Ndukwe Okereke , to take the Bakassi Boys to the Safari Restaurant at Umuahia, where they confronted the people they met with dangerous weapons, including cutlasses, knives and guns. In the process, the said two deceased persons were killed and their mutilated bodies dragged to the main road. The Abia State High Court found the Appellant, who was the second accused, guilty of the offence of murder, and convicted and sentenced him to death accordingly. The Court of Appeal was also convinced, after reviewing the evidence, that he was guilty of the offence of murder, and affirmed the trial Court’s decision. Further aggrieved, the Appellant has appealed to the Supreme Court on five grounds of appeal ISSUES Appellant formulated one issue for determination in his brief of argument, thus: “Whether the conviction for murder ought not be substituted with a verdict of Manslaughter.” Respondent formulated a similar issue for determination in its amended brief of argument, but couched differently, that is: “Whether or not the Court of Appeal was not right when it affirmed the conviction for the offence of murder handed down to the Appellant.” ARGUMENTS. The Appellant contends that the Court of Appeal “ burdened by sentiments over the setting ablaze of the victims after their deaths”, upheld his conviction for murder “despite the fact that the evidence on record did not support a conviction for murder”. He argued that the defence of provocation was successfully established by the evidence on record and the Court of Appeal “ ought to have set aside sentiments at the admittedly bestial treatment of the dead bodies and substitute the conviction for murder with that of Manslaughter”. He cited the following on the definition of manslaughter, and the ingredients thereof vis- a- vis that of murder, Section 317 and 325 of the Criminal Code Act, Akang V. State (1971) 1 All NLR 46, Stephen V. State (1986) 5 NWLR ( pt. 46) 978 and Ukwunnenyi V. State (1989) 4 NWLR (pt.114) 131. He further submitted that the defence of provocation is an extenuating factor that reduce the harshness of punishment of death for murder; and that it is pertinent to determine whether the said defence availed him, and if so, whether the verdict of murder ought to have been substituted for that of manslaughter. He proffered arguments under the following subheadings: 1. Whether he was provoked? 2.Whether the provocation was grave? 3. Whether the act causing death occurred in the heat of passion. 4. Whether there there was time to cool before the occurrence of the act causing death.? 5. Whether the act causing death was proportionate to the provocation. On whether he was provoked, the counsel referred to Black’s Law Dictionary, 8th Edition on definition of provocation which includes “the act of inciting another to do something especially to commit a crime”and R v. Doughty (1986) 83 Crime LR625.

TIMES LAW REPORT Whether the provocation was grave? He cited Njoku V. State (2013) LPELR (1989) SC, Akang V. State (Supra) and Stephen V. State (Supra), and argued that a reasonable man like the Bakassi Boys who were “blinded by sheer will and desire to see to it that criminals were brought to justice” and who are dedicated and transfixed on a mission to eradicate crime and “clean” the society by arresting and killing thieves” would have reacted the same way they did, by attempting “to arrest and or kill the suspended arms robbers”. On its part, the respondent proffered arguments touching on the ingredients of the offence of murder. which must be established, particularly proof of the common intention to commit the crime. The Appellant, is not contesting the fact that he and the other Bakassi Boys convicted with him caused the death of the two deceased persons. He is saying that there were extenuating circumstances that differentiated killing of the deceased persons from a killing with malice aforethought. On this point, the respondent submitted that for the plea of provocation or incitement capable of reducing a murder charge to manslaughter to succeed,the Appellant must show elements or acts of provocation in the circumstances of the facts available. Citing Galadima V. State(2013) 3 NWLR (pt. 1431) 530. Section 318 of the criminal Code ACT CAP C 38 LFN 2004( in pari materia with the Criminal Code Vol.1. CAP 30.Laws of the Eastern Nigeria, 1963.) Edoho V. State (2010) 14 NWLR (pt.1214) 651SC. Nwokearu V. State (2010) 15 NWLR (pt. 1215) 1, Sheidu V. State (2014) 15 NWLR

(pt. 1429) and Paul Onyia V. State (2006)11 NWLR (pt. 991)267. It argued that there was no provocation at the restaurant and even if the “ Bakassi Boys” were “ incited “ and “provoked” at Aba, as they claimed, the journey from Aba to Umuahia or from Government House to the Restaurant on Azikiwe Road,should have allowed them enough time for their passion to cool down, citing Ajunwa V. The State (1988)4 NWLR (pt 89) 380. It further submitted that the defence of provocation cannot succeed as the alleged incitement is unlawful, and no person who is compelled to obey an order, which is manifestly unlawful, is obliged to obey such order. Citing Section 278 and 279 of the Criminal Code, Obodo V. R. (1959)4 FSC 1, Alagba V. R. (1950) 19 NLR 123 and Abboti V .R (1976) 3 All ER 140 and that there was no provocation offered to the Appellant by Abia State Government nor the deceased persons, causing him to lose his control and leading to the act of killing the deceased persons on that day. Furthermore that there is concurrent finding of facts by the two lower Courts that there was no provocation and this Court cannot disturb same. Ben V. State (2006) 4 FWLR 7507, Onwuama V. DECISION The appellant’s contention against the concurrent findings of the Abia State High Court and the Court of Appeal is that the lower Courts erred by upholding his

conviction of murder, when there were extenuating circumstances differentiating the killing of the deceased from a killing with malice aforethought. The “extenuating circumstances” being that they “ Bakassi Boys” were incited by Officials of Abia State Government to kill the persons identified as armed robbers. He also conceded in his Brief of argument the Bakassi Vigilante Group was an unlawful association. The Appellant admitted that the Bakassi Vigilante Group to which he belonged was an unlawfully association that dealt with alleged criminals with extreme measures “which fragrantly breached the provision of the law of fair hearing” The Bakassi Boys were nothing but outlaws,lawless persons operating outside the law and relished breaking the laws of the land, in their unlawful and misguided quest to dispense justice by killing alleged criminals. Having desecrated the laws of the land with such relish and reckless abandon and been convicted for murder accordingly, the appellant is urging this Court to allow the appeal., set aside the judgment of the Court of Appeal delivered on 5/5/2010 , and substitute his conviction for murder with that of manslaughter, since he was incited by a third party to kill the deceased persons. But there are a few things wrong with that line of defence. Finally, it is more of implicating the Abia State Government in the crime they had committed rather than a valid defence.in law. Secondly, the learned trial judge C.N .Uwa (as he then was ) debunked the insinuation that Abia State Government had a hand in the killing of the deceased persons ...”it is in evidence that the instruction from Government was to come and watch over the area said to have been disturbed by armed robbers the previous night. Certainly, the instruction was not to kill who ever is seen in the area, with no interrogation or arrest .Even if, the deceased and others in the Restaurant on the fateful day, drinking and sleeping were armed robbers ( which they were not) did he deserve to be slaughtered on the spot? If every suspended armed robber or mistaken armed robber was to be slaughtered on the spot by any individual or group, whether individual or security men, Vigilante groups such as the “Bakassi” or even by law enforcement agents like the Police ( who are authorised to fight crime), every one of us would be living in perpetual fear and danger of being killed/ or butchered at any time. This would be unbearable to live in. The action of the “Bakassi Boys” was barbaric in a civilized world, in a peaceful town like Umuahia, in a democratic dispensation, and would have been so even in the primitive Stone Age. The accused persons could not have acted as agents of Government in committing the offence as they tried to make out in their defence ..... our criminal law does not permit it.” Finally, and more importantly for the defence of provocation to avail the Appellant, there must be something said or done by the deceased persons in his presence which caused the Appellant to “ suddenly and temporarily lose his passion and self-control”. In other words the Appellant’s defence that he was incited by the Abia State Government to kill the two deceased persons who did not do or say anything to him and the other Bakassi Boys before they were savagely killed cannot amount to provocation, and his attempt to convince this Court otherwise failed woefully. The Respondent is right, the Appellant embarked on futile journey of proving provocation which does not arise in this case as the testimony of the prosecution witnesses confirmed that the Appellant and his cohorts committed the said crime with “utmost dispatch and barbarity without any provocation or incitement”. Bi-annual amendment of constitution spells doom for NBA – Adesina providing for the establishment and functions of State Council of Nigerian Bar Association. The promise that “creation of State Councils is not to replace NBA Branches” is of no moment. There is no function ascribed to the State Councils in the proposal that the Branches are not presently performing. Experience has also shown that Branches in a State do collaborate and cooperate with one another when exigencies require this. The autonomy and independence of the Branches is of utmost importance to the overall efficiency and effectiveness of the Association. It should also be recalled that as late as 2012 a proposed amendment to include State Bars into our Constitution was vigorously and unanimously rejected at the Annual General Meeting that was held in Port Harcourt. The situation that calls for that rejection remains valid today as it was six (6) years ago.

Dele Adesina It is a common knowledge among all lawyers in this country that the Constitution of the NBA was amended in 2015 under the Presidency of Augustine Alegeh SAN, the immediate predecessor of the incumbent President. Before that time, an attempt was made in 2012 which did not sail through at the Port Harcourt Annual General Meeting. There was yet another amendment in 2009 during the tenure of Oluwarotimi Akeredolu SAN, now the Governor of Ondo State. Another amendment is being proposed for the AGM coming up on the 30th of August 2018 by the President A.B Mahmoud SAN. For the avoidance of doubt I know the role of improvement in all human endeavours indeed it is said that the largest room in the world is the room for improvement. Improving a situation or a process is not synonymous with throwing away a process for a totally new and different one. When you do that, you perpetually get trapped in experimentation. I concede to the good intentions of the present leadership of the Bar. The President’s love and concern for a credible electoral process producing effective leadership is not in doubt. However, it is my considered opinion that a good number of the far reaching and fundamental changes being proposed to the NBA Constitution is not only unworkable but can also be very counterproductive. I believe any amendment to our Constitution must not only strengthen the democratic foundation of our Association, it must add value to the process of the emergence of credible leadership and must be acceptable to the generality of our members. COMPLIANCE WITH SECTION 20 OF THE NBA CONSTITUTION 2015 I was the General Secretary of our great Association between August 2002 and August 2004 and a life member of the National Executive Committee, yet I never received the Notice of the proposed Amendment to the Constitution from the General Secretary of the Bar up to the date of writing this publication. I was only able to get the copy of the Notice courtesy of one of the past Presidents of the Association Austin Alegeh SAN who was gracious to ask his Secretary to send me a copy which I received on the 4th of August 2018. But for this gesture, like very many members of our Association I would not have received the Notice of the proposed amendment. Similarly, I

know as a fact that the Chairman of Ikeja Branch Prince Dele Oloke Esq could only get a copy of the Notice from me on Monday the 6th of August 2018. Reports also confirm that very many members of our Association neither got the Notice or the proposed amendment. It is very doubtful therefore if there is compliance with Section 20 of the Nigerian Bar Association Constitution 2015 which obligates the General Secretary “to circulate the Notice and the proposed amendment to delegates at least 30 days before the proposed amendment is tabled at the AGM”. SPECIFIC PROPALS Let me comment briefly on three of the suggested proposals. ESTABLISHMENT OF THE GOVERNING BOARD The leadership has proposed the establishment of a Governing Board to comprise of: The President, 1st and 2nd Vice Presidents, General Secretary, Assistant Secretary, two representatives each from East, North and West, the immediate past President and immediate past General Secretary. The tenure of the Board is a single term of two years. It is to be noted that eight (8) other offices including but not limited to the offices of 3rd Vice President, welfare officer, Publicity Secretary, Assistant Publicity Secretary and 2nd Assistant General Secretary of the Association have all been peremptorily abolished by this

proposal. It will be recalled that an earlier attempt to scrape these other offices have been opposed to by our members for the simple but very important reason that those offices serve as platforms for Junior members of the Bar to climb the ladder of leadership. Nothing has changed to defeat that argument. If this proposal is not reversed, it will impact negatively on the participation of the junior members in the affairs of the Association. Furthermore, it will also negatively impact on the spread of our Officers which today is a veritable vehicle for inclusion and active participatory interests. The proposed Governing Board is just another name for the National Officers meeting. What more, the duties of the members of the Board are the duties of each Officers of the Association as presently stated under the 2015 Constitution. Finally on this, there is nothing in the proposal that tend to reposition the National Executive Committee for independence and effectiveness. Rather than reinvigorating the powers of the National Executive Committee (NEC) an attempt has been made by the proposal to diminish its powers by making the Governing Board (of promotional officers) to be the Policy making body of the Association. STATE BAR The proposed amendment seeks to create State Bars by

SUCCESSION OF GOVERNING BOARD Another significant aspect of the proposed amendment is what the committee described as succession of Governing Board members. It is difficult to see the rationale behind this proposal. First it is totally unworkable, second it is undemocratic and against the principles of the Rule of Law. Besides it is capable of occasioning diminishing leadership and rubbing the Association of the much needed experience, effective and efficient leadership. The NBA has a corporate responsibility to defend Democracy and make it sustainable in our country and most significantly in the interest of the profession. We have a duty both constitutionally and professionally to practically and proactively contribute to the building of a sustainable Democracy and if we don’t have it we cannot give it as no one can give what he doesn’t have. The proposal says that NBA Presidency shall be a product of promotion or ratification at an Annual General meeting like a Law firm or a company. The futility of this proposal is exemplified by recommendation 3 of the proposal which says “where any of the above proposed successors is rejected by the Annual General Meeting… the predecessor’s office shall be open for contest and elections…in accordance with this Constitution”. It follows therefore that if for any reason whatsoever, the promotion of a successor is rejected by the AGM then, the office of the Predecessor shall be open for contest and election.

The question is what then will the proposal achieve when there may be a contest and election in any way. The NBA is and must remain a democratic Association at the centre of which is contest and competition. The current system of electing our officers is good for the Association based on the ideals of Democracy and the propagation of the Rule of Law. All we need in my humble opinion is a full democratisation of the electoral process through the reinvigoration and refining of the Austin Alegeh SAN initiative of electronic voting system. The policy and process of one lawyer one vote must be protected by all of us. It guarantees the putting of democracy to work. Furthermore, it ensures that emerging officers represent the true choice of the members of the Association. CONCLUSION In my memo dated 13th October, 2017 to the Constitution review committee, I said inter alia that a situation whereby all succeeding Presidents take pleasure in amending the Constitution of the NBA year in year out is not right. This has made our constitution unstable. Experience they say is the best teacher. We are not able to build permanent experience or grow our Constitution anymore as we change them almost every two (2) years. I also made the point in my memo that the duty of the Branches who are the ultimate owners of this Constitution to make a tangible contribution through quality discussion and debate of the committee’s recommendations must be fully protected. Regrettably this was not so regarding the present fundamental proposals attached to the General Secretary’s letter of 25th July, 2018. The question is, between 25thJuly 2018 and now, how many Branches have got these proposals and able to discuss them. In the light of the above observations, the only option available is to defer this exercise in order to give maximum opportunity to the generality of our members and the leadership of our Association at various levels to discuss and deliberate on these far reaching proposals. The solution to NBA challenges is not in amending the Constitution every two years. It is in reconstructing our attitudes and make our Constitution work in the running of the Association. SEC urges investors to regularise multiple accounts Motolani Oseni The Acting Director General of the Securities and Exchange Commission (SEC), Ms. Mary Uduk has enjoined investors in the capital market that bought shares with different names to regularise their accounts in order to get the benefit of their investments. This is even as the Capital Market Committee (CMC) has extended the forbearance period to December 31, 2018 to enable investors regularise their accounts. Uduk spoke at a press briefing after the Second Capital Market committee Meeting in Lagos during the weekend. The meeting is a periodic gathering of stakeholders in the Nigerian capital market to discuss capital market related matters. According to Uduk, “During the banking and insurance sector consolidation between 2004-2007, there were a lot of issues in the primary market because the banks or insurance companies came to the market to raise funds and during that period, because a lot of people were coming to the capital market for the first time, they saw the capital market as a place where they can make a lot of money so a lot of them bought shares in different names. “Today those shares are not in the system, because If you are unable to identify yourself properly those shares cannot

be properly captured in the system. We are saying come and regularize that situation and get back your shares which are being warehoused somewhere. There is absolutely no punishment attached to it, the SEC is not punishing anybody, we just want such individuals to come and regularize that transaction between now and 31st December 2018. “The objective of doing that is that it will increase liquidity in the market because the shares are just there no trading on them, not only that, the investors cannot claim their dividends too and that increases unclaimed dividend. “Let them come and regularize so that there will be increase in trading of those shares and they will also claim their dividends so that the balance of unclaimed dividends will also go down”. Uduk also said the meeting agreed that in addition to the physical delivery of Annual Reports and Accounts, the existing pilot exercise of electronic distribution by Public Companies should continue, while efforts are made to enlighten shareholders and obtain their relevant e-mail addresses. The meeting she said, also resolved that following the completion of the work by the committee on Minimum Operating Standard, the Commission would work with Trade Group Associations to implement the Committee’s recommendations “We also enjoined Trade Group Associations who

How high interest rate, others affect business activity in July Motolani Oseni The Central Bank of Nigeria (CBN) monthly business expectations survey report for July has indicated that insufficient power supply, high interest rate, economic climate among other factors are constraining business activity. Other factors include unclear economic laws, insufficient demand and unfavourable political climate. The survey by CBN identified that, “insufficient power supply (64.1 points), high interest rate (58.1 points), unfavourable economic climate (54.3 points), financial problems (50.6 points), unclear economic laws (48.9 points), insufficient demand (45.1 points) and unfavourable political climate (45.1 points) as the major factors constraining business activity in the current month.” On business outlook, respondents overall confidence index (CI) dropped in July when compared to June. The survey stated that, “At 13.6

index points, respondents’ overall confidence index (CI) on the macro economy in July 2018 declined when compared with the level of 34.7 index points recorded in June 2018. “The businesses outlook for August 2018 showed more confidence on the macro economy at 58.7 index points.” “The optimism on the macro economy in the current month was driven by the opinion of respondents from services (9.3 points), industrial (3.6 points), construction (0.4 points), and wholesale/retail trade (0.3 points), sectors, while the drivers of the optimism for next month were services (34.8 points), industrial (16.5 points), wholesale/retail trade (4.6 points), construction (2.8 points) sectors.” “Furthermore, the positive outlook by type of business in July 2018 was driven by businesses that are neither import- nor export-oriented (7.8 points), import-oriented (2.5 points), both import- and export-oriented (2.5 points), and those that are exportrelated (0.7 points). “Businesses expressed less optimism on own operations in July 2018 when

compared to the previous month. “However, respondents from services and wholesale/retail trade sectors expressed relatively more optimism on own operations in the current month with indices of 0.3 and 2.7 respectively when compared with 7.6 and 0.9 reported in June 2018, respectively.” On financial condition and access to credit, the survey by CBN explained that, “Respondents’ outlook on the volume of total order and business activity in July 2018 was less optimistic, as the index stood at 4.6 and 3.5 points, respectively when compared to 16.4 and 16.1 points, respectively recorded in the previous month. “Similarly, respondents’ outlook on financial conditions (working capital) and average capacity utilization declined, as the indices stood at 2.2 and 10.0 index points, respectively when compared with the 11.7 and 23.4 points, respectively recorded in June 2018. “Respondents were pessimistic on access to credit in the review month, with an index of -3.5 points.”

Fidelity Bank Plc in strategic partnership with the Bank of Industry (BoI) has launched the Aba Finished Leather Goods Cluster Financing Programme as part of continuous efforts to promote Made-in-Nigeria goods capable of meeting global standards for export and local consumption. The sum of N400 million in financing provided by BoI will be made available on a quarterly basis to over 300 members of the Leather Products Manufacturers Association of Abia State (LEPMAAS). The funds will be disbursed through the Fidelity Bank while the Ford Foundation would provide technical support to the artisans. Speaking at the formal launch of the initiative in Aba last week Wednesday, the Bank’s Chief Executive Officer, Nnamdi Okonkwo, said the partnership with BoI further underlines the Bank’s staunch commitment to addressing the financing challenges confronting Micro Small Medium Enterprises (MSMEs) in Nigeria. Whilst stating that the financing scheme will further boost import substitution, Okonkwo who was represented by the Bank’s Head, Corporate Bank, Obaro Odeghe, pointed out that the loans will enable them procure requisite materials and equipment for production and expansion. Under this scheme, Obaro said the Bank will provide short-term loans with maximum obligor limits of N300,000 to N500,000 to qualified members of LEPMAAS. According to him, the partnership with BoI is in furtherance of the financial institution’s commitment towards building the next generation of international entrepreneurs in the art of leather products manufacturing in the cluster. “Our long-running support for the growth and development of MSMEs stems from the utmost recognition of their strategic importance, as critical agents of economic development and transformation in Nigeria. “Under the scheme, we will also provide tailored capacity building support to members of LEPMAAS”, Okonkwo explained. To enhance the governance activities of the

LEPMAAS Executives and support BoI’s planned monitoring of loans under the programme, Fidelity Bank donated an ultra-modern and fully equipped secretariat for LEPMAAS. Obaro urged beneficiaries of the financing scheme to ensure that loans are repaid to drive sustainability of the financing programme. Speaking in the same vein, Managing Director of BoI, Olukayode Pitan, noted that the programme was designed to provide a tailored bundle of financial and nonfinancial services including capacity building to qualified members of LEPMAAS. Pitan explained that finished leather products to which LEPMAAS is a major contributor, accounts for over 80 percent of the textile apparel and footwear component of the manufacturing sector. According to him, informal computations put yearly revenue from the cluster at over N10 billion despite the competing volumes of similar goods being imported. “By providing low interest, noncollaterised loans, the Bank has provided flexibility for qualified members of LEPMAAS recommended by their line and zonal chairmen to access up to N300,000 towards the procurement of materials to expand and improve their production activities. “The programme is being implemented alongside Ford Foundation and Fidelity Bank Plc. The Foundation will be providing a grant that specifically focuses on strengthening the capacities of the leaders and beneficiaries even as monitoring structures to ensure loan repayments are instituted. Fidelity Bank will provide account management services to the loan beneficiaries.” Ford Foundation Regional Director, Innocent Chukwuma, said the partnership with BoI was part of efforts to fulfil its commitment to leather manufacturers to encourage local production and increase campaign for adoption of made-inAba. To this end, Chukwuma said the Foundation would be staking a grant of $150,000 in the programme to drive social impact and enhance productivity.

Air Peace begins daily Lagos-Kaduna flight operations Chukwuemeke Iwelunmo Six months after its foray into Kano and Yola on February 12 and 15, 2018 respectively, leading domestic carrier, Air Peace yesterday commenced Kaduna flight operations from Lagos with one of its six-50-seater Embraer 145 aircraft acquired recently. The aircraft which took off from the General Aviation Terminal (GAT) of Murtala Muhammed Airport (MMA) on Monday at about 7: 45 arrived Kaduna, in Kaduna State, one hour later amidst pomp and pageantry, as the airport community welcomed the airline cheerfully.

The inaugural flight to Kaduna brings the airline’s destinations to 13 with 90 flights daily within the country. Moses Cleopas has commissioned a multimillion naira sand dredging project in Azagbene communities in Ekekremor Local Government Area of the state. The gigantic project was executed by a member of the State House of Assembly, Hon. Michael Ogbere. FG must release all detained ‘Biafrans’ in one week –Zionists Moses Oyediran, Enugu Leader of the Biafra Zionists Federation (BZF), Barrister Benjamin Onwuka has issued a one-week ultimatum to the Federal Government for the release of all proBiafra detainees from various prison formations across the country. Dismissed police officer commits suicide after defiling minor, 5 others

A dismissed policeman from Cross Rivers State yesterday committed suicide after allegedly defiling and infecting a nine-year old girl and five others with Human Immune Virus (HIV) in Kolokuma/ Opokuma Local Government Area of Bayelsa State. According to investigation by some members of the International Federation of Women Lawyers (FIDA), the 40 years old was dismissed from the police force for alleged gross misconduct and detained in Port Harcourt prisons and relocated to Bayelsa State. Community sources told our correspondent yesterday that the incident, which angered the indigenes of Kolokuma/Opokuma area of the state, led to a search for the man but he escaped towards Trofani community in Sagbama Local Government Area, where he reportedly committed suicide. The Source, which pleaded anonymity, revealed that the infected victims numbering about six, include his female lover, who had reportedly moved to Delta state after her test proved HIV positive. According to the source, “investigation showed that the man escaped from Port Harcourt prisons sometimes last year and embarked on defilement spree. Over Five under-aged kids were reportedly defiled and infected with HIV. “The Nine year old girl, names withheld, was defiled recently. The victim told her mother about the act but the mother refused to hear her. But when the girl could not walk properly and was sickly. The mother took her for laboratory test and discovered she had been defiled and is HIV positive. “We call on the Bayelsa State Commissioner of health and the FIDA to come to their aid of the victims. They need treatment.” Contacted on the development, the spokesman of the Bayelsa Police Command, Asinim Butswat, said though he has hint on the development, “but it has not been officially reported to the command”.

Otis Hughes appoints new captain for D’Tigress

Former Perfumerias Avenida Salamanca of Spain player, Adaora Elonu was announced the Captain of the Nigeria senior women’s basketball team ahead of the 2018 FIBA World Cup holding in Spain. The appointment of Elonu, who recently got signed by WNBA side, Atlanta Dreams, was announced by D’Tigress new coach, Otis Hughes. Otis said the decision was taken in the best interest of the team ahead of the championship.

He expressed the belief that Elonu’s maturity and experience would serve the team well on and off the court. Elonu replaces the duo of Aisha Mohammed and Kalu EzinnePhelps who captained the team to the 2017 Afrobasket win in Mali. The Shooting Forward’s appointment was applauded by the players who pledged their total support. Elonu, one of the most

experienced and oldest members of the national team was part of the 2015 Afrobasket bronze medal winning team. In the competition, she was voted as one of the competition’s best five players. She was also in the Nigerian side that won gold at the Afrobasket 2017 championship in Mali. She averaged 9.1 points per game and was the team’s highest with 3.9 assists.

Deaf Eagles stood out in Nwankwo Kanu: Things are changing spite of loss to Mali – coach for the better for Super Eagles The Head Coach of the Nigeria Deaf Football Association (NDFA), Banjo Kamiludeen, says the Deaf Eagles distinguished themselves at the finals of the just-concluded West African Deaf Football (WADFU) tournament in spite of their 0-1 loss to Mali. Our correspondent reports that eight countries featured in the tournament which took place in Lome from August 5 to 12. Nigeria lost to Mali three minutes to the end of the match as the Malian’s penetrated Nigeria’s defence and scored. Mr Kamiludeen told newsmen on Monday that the match was tough and was expected to end in a goalless draw, as footballers ”held strong on their wings and keepers took charge of the goalposts”. “Both teams were good, but the Deaf Eagles stood out from the group matches till the finals, but in football, outside a draw, a winner and a loser or runner-up must emerge. “I train the boys. I know their

individual capabilities and team spirit; they took possession of the match and thrilled spectators with their skills but narrowly suffered a defeat. “We had already conditioned our minds for penalty shootouts which would have favoured us because the boys are able and our keeper is good. “In spite of our being the second best in the tournament, I commend the boys for their efforts because eight countries participated and we progressed to the final,” he said. The coach, who commended the Federal Ministry of Youth and Sports Development for sponsorship, confirmed that the 25-man delegation returned to Nigeria on Monday. Our correspondent reports that Deaf Eagles, defending champions of the 2017 edition hosted by Mali, have made it five times to the finals and lifted the trophy three times, back to back in the 1st, 2nd and 3rd editions. The Deaf Eagles were also runners-up in the 4th, 5th and the just-concluded 8th editions of the WADFU fiesta.

Only NFF recognised by CAF and FIFA can sack me – Mohammed Sanusi Mohammed Sanusi, General Secretary of the Nigeria Football Federation (NFF) headed by Amaju Pinnick, on Monday said he could only be sacked by a body recognised by CAF or FIFA. Sanusi newsmen in Abuja that he would not be bothered by any declaration of his being sacked by any group. It will be recalled that the Chris Giwa-led NFF board had on Sunday said it had terminated the appointment of Sanusi as NFF General Secretary. “I wonder how a group of people who did not employ me will think

they have the power to sack someone they did not employ. “How can a body that did not employ me sack me? It is only an NFF that is recognised by CAF or FIFA that can sack me,” Sanusi said. NAN reports that, according to the Giwa-led NFF board, Sanusi’s appointment termination followed the enrolment Order 5, page 3 of the Order of the Federal High Court in Jos. Victor Iroele, Giwa’s Senior Special Assistant on Media, had said on Sunday in a statement that the order was granted to the matter’s first and second applicants.

According to the order, all acts, resolutions and or decisions made or taken by the Executive Committee of the NFF purportedly elected on Sept. 30 2014 were also set aside.
