remained adamant despite subsequent advises by the Attorney General of the Federation (AGF) and Minister of Justice, Mr. Abubakar Malami (SAN) and the then Minister of Finance, Mrs. Kemi Adeosun, that the presidential directive be complied with. Investigation further revealed that the Accountant General is relying on a purported contradictory oral directive by the Chairman of the Governor’s Forum and Zamfara State Governor, Abdullaziz Yari, who gave an oral instruction that funds meant to pay consultancy/ legal fees, estimated at about $350 million, be withheld. The Chief of Staff (COS) to the President, Abba Kyari had, by a letter dated June 28, 2018, disclosed that President Muhammadu Buhari has approved the settlement of all claims related to the Paris Club loan reimbursement. In the letter copied to Malami and Adeosun, Kyari also sought the legal opinion of the Attorney General of the Federation (AGF) on the issue. Malami, in his letter dated July 11, 2018 (in reaction to the COS’ request for legal opinion) and another letter dated August 20, 2018 (in response to request for legal opinion by the Minister of Finance), identified some 3rd party claimants, who were entitled to be paid various amounts as consultancy/ legal fees for the services they rendered to states and Local Governments in relation to the Paris Club refund. In the August 11, 2018 letter titled: “Legal opinion
on 3rd party claims,” Malami identified one of the consultants as Hon Ned Munir Nwoko, who sued the Nigerian Governors’ Forum (NGF) and seven others in suit: FHC/ABJ/CS/148/2017 and claimed that he was engaged by NGF to provide legal/consultancy services on the Paris Club refund. Malami noted that parties to the suit, including Nwoko and the NGF, entered a consent judgment on May 9, 2017 “to the effect that Hon. Nwoko is entitled to be paid a negotiated percentage on every refund made by the Federal Government to the states. “Hon. Ned Munir Nwoko, covered under paragraph 5 of my letter dated 11th July, 2018 has stated that, in view of the unwillingness of the NGF to negotiate and pay him his full entitlement in line with the consent judgment, he is reverting to his initial claim of $71,936,881.36. “He is therefore seeking for the payment of the sum of $68,658,192.83 as outstanding sum due to him from NGF. “The EFCC investigation report, dated 1st August 2018 equally confirmed that the judgment creditor (Nwoko) was engaged by 14 states to recover excess deduction with respect to the Paris and London Club debts,” Malami said. The Justice Minister also warned that since the consultants and other 3rd party claimants have obtained garnishee orders against the Federal Government and the Central Bank of Nigeria (CBN), the Federal Government was under obligation to settle these 3rd party creditors
before making disbursement to the states and LGs. Malami said: “I wish to reiterate the fact that the payments under consideration are to be made before final payments are made to the state’s and Local Governments to avoid a situation where the Federal Government will be forced to bear any unwarranted liability on this subject matter.” In view of Malami’s advice, then Minister of Finance, Mrs. Kemi Adeosun, in a letter dated September 14, 2018 asked the Governor of Central Bank of Nigeria (CBN), Godwin Emefiele, to set aside the consultants’ fees, estimated at $350 million from the $2,689,279,365 reserved as the final claim to the states and LGs under the Paris loan refund arrangement. Part of the letter by Mrs. Adeosun reads: “Please find attached herewith the approval of His Excellency, President Muhammadu Buhari, dated 29th August 2018 in respect of the final claim on Paris Club loan reimbursement of overdeductions from allocations of states and Local Governments. “I specifically refer you to paragraph 6 which authorised that the final claim of $2,689,279,365 be paid to qualified states, and paragraph 10(x) which recommended that the sum of $350 million be provided for settling legal/consultancy fees, etc. “In view of the above, you are requested to credit Escrow Account domiciled

2019 polls: Seven years jail term awaits vote buyers, sellers, says ICPC Yakubu Salisu, Kano
The Commissioner in-charge of Education, Independent Corrupt Practices Commission (ICPC), Muhammad Ashiru, has warned that anyone caught buying or selling his or her voters’ card, is liable to seven years jail term. He made the call on Monday in Kano during an awareness campaign programme organised by Dispute Resolution and Development Initiative in collaboration with the commission and Youth Alliance Foundation on vote buying. According to him, vote buying is corruption, bribery and gratification punishable under the ICPC Act with minimum of five years jail term and seven years maximum to both the buyer and seller. Ashiru, who decried the
new trend of vote buying which has become so pronounced, revealed that the commission has decided to use the Anti-Corruption Academy of Nigeria to train key INEC officials on how to conduct credible elections devoid of any form of corrupt practices. He said section 6A of the ICPC Act has empowered the Commission to persecute electoral offenders based on other laws that fight bribery, gratification and other forms of corruption, adding that the act of vote buying possess great danger to the democracy of the country and must be fought in earnest. The Executive Director, Dispute Resolution and Development Initiative, Dr. Mustapha Muhammad, attributed artificial poverty created among the people by some politicians as the main reason why people sell out
their votes not minding the consequences. Muhammad said as a result of acute poverty, people fail to think rationally as they are left with no option but scamper for daily food as a result, anyone offering them peanuts to rob them of their mandates would be considered a saviour. Furthermore, Muhammad described vote buying as a new dynamic of corruption which is fast eating into the fabric of our democracy, stressing that all hands must be on deck to fight the act which is capable of destroying the whole democratic system of the country. He called on the general public to resist any politician offering them money in any form for their votes and go for those with credible antecedents in order to continue to enjoy the dividends of democracy.

The Nigerian Army said on Monday that it has no option than to call for the closure of Amnesty International offices in Nigeria due to its determined efforts to destabilise the Nigerian nation. It said Nigerians should be wary of Amnesty International (Nigeria) because it been discovered that “its goals are to destabilise Nigeria and to dismember it.” Army spokesman, Brigadier General Sani Kukasheka Usman, who stated this on Monday, maintained that if such recklessness embarked upon by Amnesty International offices in Nigeria continue, the army would be left with no option than to call for their closure. He noted that the Nigerian branch of Amnesty International which has hitherto been well respected has deviated from the core values, principles and objectives of the original Amnesty International domiciled in the United Kingdom. “There is credible information that the Nigerian branch of the
International Non-governmental Organisation is determined to destabilise the Nigerian nation,” the Army spokesman said. He said that Amnesty International Nigeria has embarked on its goal through fabrication of fictitious allegations of alleged human rights abuses against the Nigerian security forces and clandestine sponsorship of dissident groups to protest, as well as unfounded allegations against the leadership of the Nigerian military. “They have tried over the years using Boko Haram terrorists’ conflicts, Islamic Movement in Nigeria, some activists and now herders-farmers conflicts.” Nigerian Army said that the NGO is at the verge of releasing yet another concocted report against the military, ostensibly against the Nigerian Army. “Consequently, Nigerians should be wary of Amnesty International (Nigeria) because its goals are to destabilise Nigeria and to dismember it. The Nigerian Army has no option than to call for the closure of Amnesty International offices in Nigeria, if
such recklessness continues.” Meanwhile, President Muhammadu Buhari has said that the Federal Government is increasingly concerned about the role that Amnesty International (AI) is playing in the war against terror in Nigeria, adding that AI is damaging the morale of the Nigerian Military. Senior Special Assistant to the President on Media and Publicity, Garba Shehu, stated on Monday, adding that while President Buhari cherishes and encourages the noble ideals on which institutions like Amnesty International are founded, the organisation’s operations in Nigeria seem geared towards damaging the morale of the Nigerian military. “It often appears as if the Nigerian government is fighting two wars on terror: against Boko Haram and against Amnesty International. “The obvious bias and inaccuracies in Amnesty International’s recent country reports on Nigeria risk Amnesty’s reputation as an impartial international organisation,” the presidency stated.

President Muhammadu Buhari has appealed to Nigerians to give him time and pray for him in his efforts to make the country great. Buhari made the plea on Monday while speaking to State House correspondents at his 76th birthday anniversary, held at Fore Court of the Presidential Villa, Abuja. He also said that he would continue to remind Nigerians what the administration met on ground and what it has done so far. Meanwhile, Senior Staff Association of Nigerian Universities (SSANU) has wished the President long life and good health as he marked his birthday. The birthday ceremony witnessed special performance by the Guards Brigade of 203 members with the rendition of the National anthem and birthday song for the President. It was the first elaborate ceremony marking his birthday outside his residence since the inception of the administration in 2015.
Fielding questions from State House correspondents after the brief ceremony organised by his aides, President Buhari said: “Well, I am impressed with it, they (his aides) have put a lot of time behind it. I thank and appreciate them very much.” On what to expect going forward, he said: “We will keep reminding Nigerians about what we have done, how we met the country, what we have been able to do from the time we came in to now with the resources available to us.” Speaking in Hausa language, President Buhari said: “Nigerians should continue to pray for me and understand my intentions and give me time.” Also speaking, Secretary to the Government of the Federation, SGF, Boss Mustapha, said it was a joyous day seeing the President strong and healthy. Idris, in the letter titled: “Re: Payment of legal/consultancy fees deducted from states’ reimbursement in respect of final claim on Paris Club loan,” referred to a certain counter-directive by the Chairman of the NGF to withhold the $350m. Part of the letter reads: “The

President Muhammadu Buhari has warned Nigerian citizens especially youths to desist from embarking on “perilous journeys” through deserts and sea crossings that normally take their lives, saying that the Federal Government will adopt a national policy on Internally Displaced Persons (IDPs). Buhari noted that the policy which would help to regulate the internal displacement crisis and complement the fight against insurgency was in the process of adoption. The President said this on Monday at the 2018 National Migration Dialogue with the theme, “Realising the Sustainable Development Goals for all including migrants, refugees and internally displaced persons,” at the Banquet Hall, Presidential Villa, Abuja. He said: “I wish to implore our citizens, especially the youth who constitute the larger population of those who decide to take these perilous journeys through deserts and sea crossings and end up losing their lives to desist. “I advise them to tap into various Government programmes in order to change their lives and improve their standards of living.” The president reiterated his administration’s commitment to the realisation of the SGDs with a focus to delivering hope for all citizens and migrants as well. He noted that the 2018 dialogue was holding at a time the world was grappling with migration challenges and countries are exploring measures for enhancing the positive impact of migration on development within the context of the United Nations 2030 Agenda for Sustainable Development. Buhari expressed gratitude to international partners, especially the government of Switzerland through Swiss Development Cooperation, the European Union delegation among others for their support and cooperation. He noted that December 18 has been set aside by the United Nations to celebrate international migrants whose number have risen to 258 million and appreciate their innumerable contributions to national and human capital development. Apart from approving a National Migration Policy which is an overall framework for the governance of migration in the country, the Federal Government has fared well on the implementation of poverty alleviation programs through empowerment, such as N-Power; The Federal Government Enterprise and Empowerment Programs (GEEP) such as; the Trader Moni and Market Moni Schemes, Improvement of Infrastructure in order to provide an enabling environment for entrepreneurs. Earlier in her address, the Federal Commissioner
for National Commission for Refugees, Migrants and Internally Displaced Persons, Sadiya Farouq, said that the event was an indication of the strong commitment of the Nigerian government to the promotion of the plight of her citizens on the move and those forcibly displaced within and outside the country. Ugwuanyi presents N109.19bn universal health coverage in Nigeria budget for 2019 Moses Oyediran, Enugu Health Policy Research Group (HPRG), College of Medicine, University of Nigeria, Enugu Campus (UNEC), has advocated the implementation of the Universal Health Coverage (UHC) in Nigeria, describing it as a key to the development of Nigeria’s health sector. The Coordinator of HPRG, Prof. Obinna Onwujekwe, made the advocacy during a one-day knowledge synthesis/feedback workshop in Enugu to commemorate the UHC day. Onwujekwu said the workshop is geared towards ensuring access to health care without any financial impediment. According to him, it is to also ensure the “use of evidence generated by the HPRG to design and improve how the federal and state government can achieve UHC.” While presenting some research evidences from their studies on Multiple Financing Flows, Strategic Purchasing, Provider Payment Mechanisms, Domestic
Resource Mobilisation funded by Resilient and Responsive Health Systems (RESYST Consortium), Onwujekwu lamented the poor and Ill-equipped conditions of health centers across the country, noting that “UHC holds the key to unlocking the doors to significant health improvements in Nigeria.” “And to achieve this goal, everybody must have financial covering which is where the National Health Insurance Scheme (NHIS) becomes relevant to ensure financial coverage for all,” he said. Onwujekwe, however, observed that Nigeria is not yet “prime for the UHC” because “the health system needs to be strengthened.” He also identified existing impediments such as lack of resources and human capital and urged the government to provide the necessities to ensure full implementation. The General Manager, National Health Insurance Scheme (NHIS), Dr. Eke Jonathan said that NHIS is at the forefront of the UHC “serving as the structure set up to manage the UHC in Nigeria to ensure that funds are provided for the attainment of the UHC goals.” Jonathan added that although UHC has
not been fully implemented, “reasonable progress” has been made towards its actualization. According to him; “States have adopted this policy and are setting up Health Maintenance Organizations and agencies that will work with the NHIS to achieve the goals of the UHC; the federal government though has not signed but is in support of the policy as they recently released N55 billion for basic health care. Therefore I can say for sure that UHC is attainable in Nigeria in the next 5 years.” Other key health stakeholders and health system researchers from Enugu, Anambra and Ebonyi states that were in attendance were Dr. Chioma Ezenyimulu; Executive Secretary, Anambra state Primary Health Care Development Agency; Dr. Nwali Okata, Executive Secretary, Anambra state Primary Health Care Development Agency; Dr. Simeon Onyemaechi, Executive Secretary, Anambra state Health Insurance Agency (ASHIA); Dr. Uche Ewelike, Assistant General Manager NHIS; Prof. BSC. Governor Ifeanyi Ugwuanyi of Enugu State on Monday presented a budget of N109.19 billion for 2019 to the state House of Assembly for approval. Governor Ugwuanyi said the budget was made after due consideration was given to the country’s economic realities. The 2019 budget is 4.5 per cent higher than that of 2018 which was N103.5 billion. The governor said the budget has a recurrent expenditure of N64.5 billion while the capital expenditure is N43.49 billion. Ugwuanyi, who further broke the budget down, said N5.52 billion was set aside for education sector while the agricultural sector would gulp N636.5 million. He said N2.37 million was earmarked to provide affordable healthcare while N742 million was for the provision of water with emphasis on the Enugu and Nsukka water schemes. The governor said his administration was desirous of continuing the compulsory free basic education in the state by upgrading basic infrastructure in the sector. He said the outgoing year had been eventful as his administration recorded landmark achievements within the limits of 2018 budget.

PDP flays Buhari over excuses on cabinet delay …Says it depicts early display of incompetence
Tunde Opalana, Abuja The Peoples Democratic Party (PDP) has decried the Muhammadu Buhari Presidency for attempting to blame former President, Dr. Goodluck Jonathan, for delay by the All Progressives Congress (APC) government in forming its cabinet. PDP National Publicity Secretary, Kola Ologbondiyan, in a statement on Monday said it is unfortunate that the Buhari Presidency will always resort to peddling falsehood as a cover for its failures. “It is a settled matter that President Buhari could not form a cabinet for over five months after his inauguration, primarily due to sheer incompetence, lack of preparedness and the fact that he was overwhelmed by the complexity of the office of the President of Nigeria. “In accusing the Jonathan administration
of frustrating early formation of President Buhari’s cabinet, by allegedly delaying the submission of his handover notes to the Transition Committee, the Buhari Presidency forgot that the head of the Transition Committee, Ahmed Joda, had since May, 2015 publicly dispelled such as false and diversionary, noting that the committee got all the cooperation it needed from the Jonathan’s administration. “Nigerians can also recall how President Buhari refused to hasten the formation of his cabinet following his widely condemned view, in September 2015, that ministers were mere “noise makers”. “President Buhari had expressed his personal unwillingness to appoint ministers when, in an interview with France 24 TV, in France, he said that the absence of ministers was not affecting governance in Nigeria. “According to President Buhari “the ministers are there, I think, to make a lot of noise”. “As for the cabinet, I said we will have
one by the end of the month, and time flies. The end of the month is coming too quickly for my liking”, he said. The party described as ludicrous and the height of hypocrisy for the Buhari Presidency to turn around after three years to blame President Jonathan for his (Buhari) confessed failure. The PDP counselled the Buhari Presidency to note that peddling falsehood and blaming the previous administration for its failures will not help it in 2019. “President Buhari has not only shown, but also personally confessed that he lacks capacity to handle an economy as complex as Nigeria’s. “The only thing left for President Buhari to do is to start preparing to accept defeat in 2019, as Nigerians are now rallying behind our candidate, Atiku Abubakar, who has the solutions and blueprint that guarantee a better future for our nation”, he added.
The Taraba State chapter of the Christian Association of Nigeria (CAN) has organised a Seminar on Transformational Leadership for Christian Leaders and Training of Election Observers to cover the 2019 general elections across the State. Speaking at the ceremony held yesterday at the Secretariat of CAN in Jalingo, the State CAN Chairman, Rev. (Dr.) Innocent Solomon said the decision to organise the Seminar was informed on the need for Believers to understand their roles as it concerns the development of the Society. He said the Seminar was geared towards sensitising Christian leaders to embark on training of credible future leaders that will lead the State and the Country. Rev. Solomon further expressed dismay over what he described as care free attitude of the Body of Christ to transform the Society positively. He however, called on Christian Clerics and Pastors to be mindful of the banner of Christ they are carrying as they encounter with Politicians this political period.
APGA Presidency ’ll tackle Boko Haram - VP candidate Tom Okpe, Abuja Vice Presidential candidate of the All Progressives Grand Alliance (APGA) Chief Jerry Chukwueke, has revealed that the Presidency of his party will tackle Military contractors in government who made the fight against insurgency difficult if voted into power in the next year general election. Chukwueke also said foreign mercenaries will be engaged, to work alongside Nigerian Army, take opportunity of modern equipment and well trained men and women with a view to defeating the dreaded Boko Haram group in a short time. Speaking at a press conference on Monday in Abuja, Chief Chukwueke, who protested his exclusion from the Vice Presidential debate organized by the Broadcasting Organization of Nigeria (BON), declared that both the All Progressives Congress (APC) and the People’s Democratic Party (PDP) failed to present solutions to some of the challenges facing the country. He said: “Facing poverty as an existential threat and insurgency are existential threat, when it comes to fighting Boko Haram, the gallant men and women we have in the Armed Forces are doing a very fantastic job under this condition but our government is prepared to engage the services of military contractors for short period of time.

The whistle blown has been ignored

Two years ago, the Buhari administration adopted the Whistleblower policy as a component of the fight against corruption. The introduction of the policy was sequel to the deliberate refusal of the National Assembly to pass the Whistleblower Bill sponsored by some legislators in 2007. Like the Treasury Single Account (TSA) and Bank Verification No (BVN) the Whistleblower policy is said to have assisted the federal government to recover huge public fund which had been cornered by a few corrupt individuals and corporate bodies. But apart from beating its chest for the success recorded so far in the implementation of the TSA, BVN and Whistleblower policies the trillions of Naira which have been saved or recovered by the federal government have not been deployed to arrest the increasing wave of poverty in the land. However, in marking the second anniversary of the Whistleblower policy it is pertinent to point out that what has been recovered so far is a tip of the iceberg as the Buhari administration has not acted on the information at its disposal in respect of the billions of dollars being withheld from the federation account. On March 8, 2016, I requested the Minister of Finance to embark on urgent and decisive measures to recover not less than $200 billion. Apart from assuring me, rather politely, that my request
was receiving attention the detailed information contained in my letter has not been processed either by the federal ministry of finance or federal ministry of justice. Since my letter was widely published in the media it has generated reactions from some quarters. With particular reference to the allegation that the Central Bank of Nigeria gave out a bail out of $7 billion to 14 commercial banks in 2006, Professor Charles Soludo who was then the governor of the bank, said it was not a bail out but a deposit. Since the fund was illegally removed from the nation’s foreign reserves without appropriation by the national assembly and placed as a deposit in the banks it ought to be recovered together with the accrued interests. And based on information which I had obtained from the National Extractive Industry Transparency Initiative (NEITI), I reported that the NNPC had withheld the sum of $20 billion from the federation account. From the 2015 audit exercise conducted by NEITI the figure has increased to $22 billion and N376 billion. In a petition which I sent to the Presidential Panel on Recovery of Public Property last year, I accused Exxon Mobil of paying $600 million out of the $2.5 billion fixed by the Nigeria National Petroleum Corporation for the renewal of 3 oil blocks in 2009. Even though the oil company claimed to have paid the outstanding balance of $1.9 billion there
is no evidence of such payment. It is hoped that the Presidential Panel will pursue the matter to a logical conclusion. However, the most interesting reaction to my letter came from Dr. Ibe Kachukwu, the Minister of State in the Ministry of Petreum Resources. He concurred with me that the nation had lost not less than $60 billion due to the failure of some public officers to implement the provisions of the Deep Offshore and Inland Basin Production Sharing Contracts Act. Section 16 of the Act provides that the royalties paid by oil companies shall be adjusted upwards whenever the price of oil rose beyond $20 per barrel. Since there was no reason adduced for not enforcing the law for 18 years the authorities of Akwa Ibom, Bayelsa and Rivers State governments dragged the federal government to the Supreme Court to justify why it has refused to implement the law. In a judgment delivered by the apex court on October 18, 2018 the federal government was ordered to take urgent steps to recover all revenues lost to oil and gas exploring and exploiting companies due to wrong profit sharing formula termed as the Production Sharing Contracts since 2003. It is hoped that the federal government will proceed to recover the sum of money estimated to be in the region of $1 trillion. I must not fail to acknowledge that the Economic and Financial
Crimes Commission has commenced investigation into the allegation of crude oil stolen from the country by well known international oil and shipping companies. For instance, it has been confirmed that 60.2 million barrels of crude oil stolen from Nigeria between 2011 and 2014 were discharged at Philadephia port in the United States. If the investigation can be painstakingly conducted it is estimated that not less than $300 billion could be realized as the costs and penalties for the oil stolen from Nigeria and discharged in several ports in the United States, China, India, United Kingdom, France etc. In view of the foregoing, we challenge the Federal Ministry of Finance to proceed to recover the huge funds highlighted in my letter. I can assure the federal government that I do not intend to demand payment of any percentage from the fund to be recovered based on the whistle that I have blown which has been ignored. Having regards to the fact that the public and private organisations that have been fingered in my letter are very powerful and vested the federal government cannot muster the political will to recover the fund that has been withheld from the federation account. Therefore, the Nigerian people who stand to benefit from the judicious deployment of recovered loot should be mobilised by the progressive extraction of civil society organisations to take over the fight against corruption.
Vice presidential debate and matters arising

In a country of 91 political parties in theory but just two in practice, a vicepresidential debate was always going to be a hard sell. For many reasons. When the Nigeria Elections Debate Group (NEDG) and the Broadcasting Organisations of Nigeria (BON) announced the five parties to participate in the exercise, not many Nigerians could, off the top of their heads, name the respective vicepresidential candidates. Okay, we know the presidential candidates that are Obiageli Ezekwesili, Kingsley Moghalu and Fela Durotoye, but, for many, it still hasn’t sunk that their parties are Allied Congress Party of Nigeria (ACPN), Young Progressives Party (YPP) and Alliance for New Nigeria (ANN) in that order. Minus the press statements announcing their emergence, ANN’s Khadija AbdullahiIya, ACPN’s Ganiyu Galadima and YPP’s Umma Getso were unknown persons until the night of the debate. The presidential debate, scheduled for January 19, 2019, was always going to be the real deal. That hasn’t changed, of course. But with the benefit of hindsight — and ignoring the big sin of overlooking one or two other parties who should have been invited — we can thank NEDG and BON for that VP debate. It offered us deep insights into the core of the APC-PDP battle, and even deeper ones into the composition, depth and structure of the alternate parties. It helped us to know that 2019 is about the thief versus the shop keeper. To the discerning, Peter Obi’s parable of the shop and Yemi Osinbajo’s rebuttal, tells a lot about what the two parties genuinely think of themselves, and of each other, in terms of their economic management potentials and their corrupt tendencies. In marshalling his argument, Obi calls out how unemployment levels have risen and Foreign Direct Investment (FDI) fallen in the current administration, despite the much-vaunted anti-corruption crusade.
“You’re not creating jobs, you’re not doing the right thing and you’re just fighting corruption,” he says. “You can’t shut down your shop and be chasing criminals.” Osinbajo’s rebuttal included the refrain: “…if you allow criminals to steal all the inventory in the shop, there’ll be no shop. That’s the problem. And what has happened to Nigeria in the past 16 years is what the World Bank told us, that the major cause of our poverty is corruption.” Obi fell short of expectations in his economy versus anti-corruption argument. His position was to justify the superiority of corruption plus economic astuteness on the one hand over the anti-corruption fight plus economic mismanagement on the other hand. Meanwhile, the expectation was that he would revisit the corruption in the Muhammadu Buhari administration: the fraudulent Nigerian National Petroleum Corporation (NNPC) deals for which Ibe Kachikwu wrote Buhari in 2017, the nepotistic secret recruitments at the Central Bank of Nigeria (CBN), the N200 million grass-cutting scandal over which the president delayed sacking the erstwhile secretary to the government of the federation (SGF) Babachir Lawal for many months, among many others. In the moment when it mattered, Obi forgot all these. It’s good news, actually, because for those who have reduced the 2019 election to a PDP-APC battle, now they know that their vote is either against one of the fight against corruption and economic mismanagement, or for one of supposed economic competence and corruptibility. Sadly, that’s nothing but a reproduction of the devil-and-the-deep-blue-sea scenario of 2015. The next logical step, then, would be to look in the direction of one of the smaller parties offering Nigerians an escape from the APC-PDP hegemony. But, on the evidence of their vice presidential candidates’ displays at the debate, ACPN,
ANN and YPP owe Nigerians an apology. Their candidates — Ganiyu Galadima, Khadija Abdullahi-Iya and Umma Getso — demonstrated unpreparedness for the debate, gross lack of understanding of national issues and utter underestimation of the enormous responsibilities that come with deputising for the Nigerian president. Galadima was there for the limelight. Given a few minutes to open his remarks, he goes on and on about his gratitude for the stage, then reminds us he also featured at the 2015 debate “though as presidential candidate of the ACPN”. Abdullahi-Iya tells us she is “vying for the post of VP because I am concerned about every one of the over 2.1 million children in the IDP camps in the NorthEast, who are scattered all over Nigeria. I am also concerned about the 13 million children who are out of school.” Nothing wrong about caring for children but that can’t be the number one reason for seeking that office. If Abdullahi-Iya had any sniff of the Constitution, she would have known the vice president is the deputy chairman of the Council of State, the deputy chairman of the National Defence Council; and, most importantly, the chairman of the National Economic Council (NEC). Surprisingly, there was no single economy-related question that Abdullahi-Iya answered convincingly. She would be more remembered at the debate for her numerous “good evening, sir” when introducing her comments than for making any noteworthy contribution. Neither did Getso fare any better. Asked what she would do to improve the aviation sector in Nigeria, her response was: “All we need is patriotic leaders. Patriotism will save Nigeria’s aviation sector.” Asked elsewhere to explain what would be the economic thrust of her administration for the aviation sector, Getso answered: “The major thing a typical Nigerian needs to look into is to
see how we can rekindle patriotism in our hearts. To be candid, what Nigeria just needs is patriotic leaders, leaders that have Nigeria at heart. This is just what I’ll say about the aviation sector.” On the simple but far-reaching matter of fuel subsidy, all three alternate candidates played to the gallery: Subsidy must go. Even Obi supported this stance — same tune Buhari sang pre-2015, yet subsidy has remained in his almost four years at the helm. But no one with full grasp of the matter can advocate subsidy removal without addressing the corollary challenge of the ripple-effect spike in cost of transport, housing, food, goods and services; everything. Only Osinbajo did this. The vice-presidential debate has taught us that the alternate parties are not ready. YPP, ANN and ACPN are approximately one-man shows incapable of running a government. If elected, Ezekwesili, Moghalu and Durotoye would struggle to constitute a proper cabinet. It took Buhari six months, it probably would take them a year — unless, of course, they want to populate it with people who have little to offer beyond faith in their principal. None of Ezekwesili, Durotoye or Moghalu has an able deputy; that’s a sure sign of a tumultuous government that would eventually climax in self-implosion, were they to win. It’s time alternate parties understood that the thirst for power and passion for change are not enough to succeed in the seat of governance. Beyond throwing constant jabs, however deserved, at the government of the day, these parties should spend the next four years building proper structures and propagating their ideologies within the party in such a manner that a VP candidate can discuss the party’s ideals almost as eloquently as the presidential candidate. Until then, they are not ready.

CJN and justice delivery
I
n an effort to speed up the dispensation of justice, the Chief Justice of Nigeria (CJN), Justice Walter Onnoghen, recently directed that any case fixed for hearing before the Supreme Court must be heard and determined one way or the other on that date. The policy, as announced by the CJN, is deliberately targeted at the speedy dispensation of justice while a new apex court publication is to encourage lawyers to take advantage of the initiative and ensure they adequately prepare ahead of hearings to avoid any delays. Appeals would be heard and judgements delivered as necessary and in accordance with the Rules of the Court. Consequently, the situation would leave no room for unnecessary adjournments arising from lack of diligent prosecution, poor preparations or nonappearance by lawyers. What this indicates, according to the CJN, is “that any matter that is assigned a date must be heard and determined one way or the other on that date”, ‘’For appeals that may be discovered to have defects, Counsel is advised to take necessary steps to amend such defects before the due hearing date while everyone must come to the court fully prepared for the business of the day,’’ the CJN added. We wish to submit that the policy will help utilise man hours lost to incessant adjournments of cases and probably clear the backlog of pending appeal cases. There are no available data indicating how many cases suffer adjournment on daily basis at the apex court, but an adjournment of a single case has multiple adverse effects on the judiciary. First, it frustrates speedy dispensation of justice the country has been craving for. Secondly, adjournment help lawyers to frustrate cases for their clients who
desperately want to hang a bad cases. In essence, this policy would arrest this ugly trend that have become a clog in the wheel of justice. With thousands of pending appeal cases that filled the Supreme Court diary to the brim and appeals set down for hearing up to the year 2021, no measure should be spare in addressing the issue of delay. We are of the opinion that the CJN has done the right things because the delay in justice delivery has become a major problem of the judiciary that has continue to rob it of public confidence. We therefore appeal to stakeholders particularly lawyers, litigants and heads of other courts to embrace the laudable initiative of the CJN and ensure that the policy works. CJN Onnoghen has earned our commendation for the remarkable steps being taken to guarantee speedy dispensation of justice and no stone should be left unturned in implementing the policy.

2019: Opposition against APC swells as 9 Short News parties adopt Atiku, 6 more to join CUPP Monguno calls for separation Tunde Opalana, Abuja Ahead of the 2019 general elections, opposition against the ruling All Progressives Congress (APC) has continued to swell as nine political parties yesterday signed a Memorandum of Understanding (MoU) with amalgam of opposition political parties, the Coalition of United Politics Parties (CUPP) to adopt the Peoples Democratic Party (PDP) candidate, Atiku Abubakar as consensus candidate. This was as applications by six other parties willing to join the CUPP are being processed. The nine parties signed MoU with CUPP in Abuja to push out President Muhammadu Buhari at the Presidential Polls next year. Recall that over 40 political parties under the aegis of the CUPP had two weeks ago adopted the PDP candidate, Atiku Abubakar. At the MoU signing ceremony at the Shehu Musa Yar’Adua Centre, Abuja, the chairman of the steering committee of CUPP, and former
Osun State governor, Prince Olagunsoye Oyinlola, announced that another set of six political parties had already submitted applications to be part of the coalition. He asked President Buhari and the APC to immediately throw in the towel before they are disgraced at the poll in the 2019 general election. According to him, developments in the country were clear indications that Buhari and the APC were not prepared for leadership. Some of the nine new entrants in the opposition grand alliance are Save Nigeria Congress (SNC); United Patriots (UP); Reformed and Advancement Party (RAP); Alliance for Social Democrats (ASD) and We the People Nigeria (WPP). Oyinlola declared that the exit of the Social Democratic Party (SDP) from the CUPP was basically because it was not able to realize its political agenda within the CUPP fold. On how the CUPP would withdraw candidates of its members’ parties from participating in the election, Oyinlola said:
“We are working against a General and we need to be strategic, so I will not go beyond that.” Barely two weeks ago, opposition parties numbering over 40 adopted Atiku Abubakar, as their consensus candidate for the 2019 presidential election. In doing that, the CUPP disclosed that the decision was arrived at few hours after a closed door deliberation among members of the coalition. The statement issued by CUPP spokesman, Ugochinyere Ikenga, said “Over 41 political parties in attendance endorsed the decision which enjoyed majority support. The coalition said it arrived at the choice of Abubakar after he towered high on the criteria used by the opposition in arriving at the decision. “The criteria include: national acceptability; financial capacity; spread of his political party; leadership capacity; international acceptability; experience ; capacity to rebuild the economy; secure the country and unite all Nigerians.’’

The Chairman, House Committee on Agriculture, Mohammed Monguno, has called for separation of the Federal Ministry of Agriculture and Rural Development budget from other Ministries, Departments and Agencies (MDA). The Chairman stated this at the weekend in Abuja during the oversight visit of the Joint Session of the National Assembly Committee on Agriculture, calling for partnership and harmonisation between the legislative and executive arms in achieving this purpose, explaining that agricultural activities are time-bomb as the rains don’t wait for it. He opined that the late releases of funds to the ministry have seriously affected agriculture development and production, which equally negatively affects Nigerian farmers. He said: “There is the need for the executive and legislative arms of government to collaborate to make sure that agricultural budgetary issues are removed from national budget in view of the fact that the issues affecting agriculture are time-bound.
NIPR says illiteracy responsible for insurgency in North East Samuel Luka, Bauchi The Nigerian Institute of Public Relations (NIPR), has identified illiteracy as one of the factors responsible for the involvement of people of the northeast sub -region in insurgency. Ifelodun community in Egbejila, Ilorin West Local Government Area of Kwara has appealed to government at all levels for provision of social amenities to ameliorate the prevailing socio-economic activities of the residents. The chairman of the community, Alhaji Usman Gatta made the appeal in a meeting of the community with concerned stakeholders on Monday in Egbejila. Gatta noted that the new settlement lacked steady and uninterrupted power supply, potable water supply and motorable road. According to him, the only source of water is well as it is very costly to drill a hand-pump or motorised borehole. The community head also sought for an establishment of a police post in the community to check new insecurity trend of children abduction, rituals, burglary and theft among others. The area, he said being a developing site was always disturbed by street urchins who used to intimidate, harass and exploit their visitors.

The Ijaw Youths Council worldwide (IYC) has urged the National Assembly to invoke its constitutional powers to override President Muhammadu Buhari on the recently passed amended Electoral Act if the President still refuses to assent to the bill. The umbrella youth body of all ethnic Ijaw nationalities in the Niger Delta made the plea in a communiqué issued after a one day symposium organised in Port Harcourt, capital of Rivers State recently. The communiqué signed by Comrade Daniel Dasimaka and Barr Jeremiah Perekeme Owupele, current and former spokesmen of the youth body respectively also routed for restructuring of the federation as the basis for its support of any of the presidential candidates in the 2019 general elections. The communiqué, in its opening remarks states that: “We, Ijaw youths drawn from over five hundred communities from about 85 clans that make up the Ijaw nation met this 11th day of December 2018, in Port Harcourt, Rivers State being the 20th anniversary of the historic kaiama
declaration and after exhaustive deliberations, resolves as follow; “That the peaceful corporate co-existence of this nation is threatened by the combined effects of desperate politicians and the refusal of the president to assent to the amended electoral act. They must desist from such partisan approach that questions the essence of service to the Nation.” The Ijaw Youths Council worldwide, at the one day symposium organized to mark the 20th anniversary of the Kaiama Declaration expressed dissatisfaction that the aims and objectives of the declaration were yet to be fully achieved and called on all Ijaws to be united and focused in other to actualize the struggle. Setting the tone for other speakers at the event, Elder T. K. Ogoriba, the interim pioneer national president of the body who midwife the declaration explained how the declaration came about and concluded that the ills that brought about the declaration were yet to be resolved. “We are yet to see any changes from the long neglect and marginalization that pushed us into issuing that declaration. You and I know that those ills are still very much with us because many of us have sold out the cause for monetary gains,” he said and advised all Ijaws to remain focus on the Ijaw cause.

A Bauchi based NGO, Rahama Women Development Programme has trained and provided soft loans to about 18,000 women across four states of the North East region of Nigeria have been trained on various skills. A Non Governmental Organisation based in Bauchi which trained the beneficiaries also provided them with soft loans to enable them establish their own businesses in order to become self-reliant. The Chairman of the Board of Directors of the NGO, Mallam Mohammed Inuwa Bello revealed this during the inauguration of the Board of Trustees of Rahama in Bauchi. He said disbursements of loan to beneficiaries were preceded by training on financial management to equip the women with basic skills required in running businesses at the grass root level. “We trained over 15 thousand women in Bauchi, Alkaleri, Tafawabalewa, Katagum, Darazo, Zaki, Dass, Misau and Bogoro LGAS in Bauchi state while we equally extended similar support to about three thousand women in neighbouring Adamawa, Gombe and Plateau states in the past 6 years “. Customs to extend relief materials to orphanages, others Joy Anyim, Lagos
The Presidency has given its approval for the Nigeria Customs Service to extend the distribution of relief items to other Internal Displaced Persons (IDP) camps and registered orphanages across the country. Stating this was the Customs Public Relations Officer, Deputy Comptroller of Customs, Joseph Attah during an interactive session with journalists on Monday at the Customs Zone A Headquarters, Harvey road, Yaba. Attah said the decision was based on the fact that relative peace has returned to the North-East as many IDPs are returning to their ancestrol homes and engaging in farming, hence the need to seek other areas where seized can be distributed. According to the Customs Public Relations Officer, “Rice and other perishable items are being given to the victims of the unfortunate insurgency in the North-East. So far, a total of 424, 391 bags of 50kg rice worth over N4 Billion and other seized perishables have been distributed to IDPs in Borno, Yobe, Adamawa and Edo States. “With relative peace in the North-East, many IDPs are now returning to their ancestral homes and engaging in farming.

NCAA commences investigation on Air Peace oxygen mask incident .. Airline insists aircraft air worthy
Chukwuemeke Iwelunmo, Lagos The Nigerian Civil Aviation Authority (NCAA) has commenced investigation into the Air Peace’s Oxygen Mask incident that reportedly occurred in the airline’s Lagos-Enugu service last Friday. This is in line with standards and international best practices. This is just as the regulatory agency has warned all operating airlines to observe the Standard and Recommended Practices (SARPs) as any infractions will be treated in line with the provision of the Regulations. According to a statement by the NCAA spokesman, Mr. Sam Adurogboye, the investigation will be thorough and will include the review of the videos making the rounds in the social media. “The investigation will be conducted in line
with the Nigerian Civil Aviation Regulations (Nig. CARs) 2015. At the conclusion of the investigation, the recommendations will be fully implemented, he added. The NCAA assured all passengers that all aircraft operating in Nigeria are airworthy (fit to fly), “Our Ramp inspections have been strengthened accordingly with the seasonal increase in the volume of passengers”. Meanwhile, Air Peace has dismissed reports alleging that one of its aircraft almost crashed on the Lagos-Enugu route on Friday, describing the claims as an unfortunate misrepresentation of facts. A statement issued by the airline’s Corporate Communications Manager, Mr. Chris Iwarah on Monday said the aircraft experienced a change in cabin pressure en-route to Enugu and its flight crew had to do the normal technical manoeuvre by descending to a level comfortable enough for passengers on board. The carrier debunked insinuations that the aircraft involved in the incident might not have
been properly maintained, explaining that the aircraft secured a renewal of its certificate of airworthiness (C of A) on December 10. The aircraft, the airline added, also went for its mandatory comprehensive maintenance checks (C-checks) abroad and got its certificate of release to service (CRS) in September 2017. C-checks are normally done on aircraft every 18 months. At the end of the checks, a CRS is issued to confirm the maintenance done. Air Peace insisted that its aircraft were not only maintained at some of the best facilities in the world, but also had a reputation for spending millions of dollars on each C-check exercise to ensure its aircraft were in top shape because of the premium it placed on the lives of its customers and crew. The carrier said in line with its strict maintenance and safety standards, it had retained the services of BCT Aviation of the United Kingdom for its routine maintenance programme on ground its base in Lagos 24 hours of the day throughout the year.
The Minister of Interior, Major General A.D Danbazau (Rtd) Monday commissioned the completed office complex of the Nigeria immigration service in the state. Represented by Major General E. E Bassey, Danbazau thanked the state Governor, Okezie Ikpeazu for the cooperation he has been extending to the Nigeria immigration in the state, assuring that the federal government is working hard to put in place adequate and convenient working environment for paramilitary agencies. School of Nursing Obowo matriculates 90 students Prince Nwankwo, Owerri The management of Our Lady of Mercy School of Nursing, Umulogho Obowo, Imo state, has matriculated 90 students comprising 83 females and seven males, on Saturday, at the school premises. The matriculation/capping began with pontificating mass by Bishop of Okigwe Diocese, His Lordship Very Rev. Dr. Solomon Amarachukwu Amatu, and immediately after the mass, he declared the ceremony open. In his speech, the chairman of the occasion, Hon. The Buhari Media Organisation (BMO) has dismissed Amnesty International Reports, describing it as mischievous and a hatchet job for the opposition in the run up to the 2019 general elections. The group said it is obvious with the release of a report titled ‘Harvest of Deaths’ which focused on Herders-Farmers clash in the last three years, but was tilted to make it look like the administration of President Muhammadu Buhari did little or nothing to stem the tide of violence. BMO in a statement signed by its Chairman, Niyi Akinsiju and Secretary, Cassidy Madueke, in Abuja on Monday, said that Amnesty International was out to send out subtle message to eligible voters in a report that was expertly made to appear
balanced. “It is suspicious that Amnesty International went to great lengths to establish what we have always known those herders’, communities had also been victims of mindless orgy of violence over land and grazing routes. “Could it have to do with the fact that the Presidential candidate of the Peoples Democratic Party (PDP) is also a member of the same Fulani ethnic stock like the President? But it is mischievous to create the impression that the conflict is either a three-year old conflict or that it was worse in the last three years”. BMO also queried the real intention of Amnesty International in releasing its report barely two months to the election saying: “If the rights’ watchdog meant well for Nigeria, it should have released the report at a time some Nigerians felt that it
was a one-way attack by Fulani herdsmen on innocent farming communities because of the ethnic identity of President Buhari. “This would have served to correct that impression, but not at a time of relative peace in virtually all the states listed in the report. Could it be that Amnesty is bent on stoking the dying embers of the conflict in those states? “Or why has a group that is meant to be interested in peaceful co-existence not opted to focus on what the government had done right to manage the century-long conflicts between farmers and herdsmen”, adding that the report is on one hand a continuation of Amnesty International’s gripe against Nigeria in recent times, and on the other hand an affirmation of what its management has always said in spite of information to the contrary,” BMO stated.

‘Garba Shehu gaffe on Jonathan’s handover notes to Buhari’
Former President, Dr. Goodluck Ebele Jonathan has said that his administration has absolutely nothing to do with the failure of this government to appoint ministers early enough to inspire confidence in investors because handover notes from a predecessor does not contain the list of ministers for the incoming administration. The former President who spoke through his Media Adviser, Ikechukwu Eze stated that handover notes, being transitioning documents, are usually received by an incoming President from his predecessor at the time of change of government, and not a document that guides a President to appoint his ministers. “Under normal circumstances, a newly inaugurated President needs the support of his ministers, who would handle different departments of Government, to study and understand his handover notes for effective performance of his initial duties,” he stated. Former President Jonathan was reacting to a statement by the Senior Special Assistant to the President Buhari on Media and Publicity, Mallam Garba Shehu in which he blamed the failure of President Muhammadu Buhari to appoint ministers until six months after taking over office on the administration of former President Dr. Goodluck Jonathan. Jonathan said as strange as the assertion may sound, “it still beggars belief that a spokesman of a President who is seeking re-election would still be looking for a scapegoat for the administration’s failure, at a time he should be showcasing his scorecard. Legislators suspend sitting as National Assembly workers begin strike .Workers seal NASS entrance, cut off electricity, water supplies
Tunde Opalana, Abuja Barring any new development, lawmakers in the Senate and House of Representatives will have their plenary suspended while the ongoing four days sit at home industrial action by staff of the National Assembly last. The workers under the umbrella of Parliamentary Staff Association of Nigeria (PASAN) yesterday made good their threat to embark on a four-day strike as activities around the NASS section of the
Three Arms Zone of the seat of power were paralysed. The workers who are demanding mainly for the payment of arrears of 28% increase in their salaries since 2010 stormed the National Assembly in the early hours of Monday blocking all entrance into the complex. The workers have also cut off essential services like power and water supply; effectively crippling any form of activity within the premises. The aggrieved workers had two weeks ago shutdown the
National Assembly stopping lawmakers from sitting; blaming the Management of the National Assembly for their plight and insisting on the removal of the Clerk of the National Assembly, Sani Omolori. Although no official statement has come from the management as at the time of filing this report; the Clerk had clearly dropped the blame at the door steps of the executive when he said there has been no releases to implement the worker’ wage increase captured in the 2018 budget.
The Peoples Democratic Party (PDP) has felicitated with President Muhammadu Buhari on the occasion of his 76th birthday. The party congratulated the President for his good health. At the age of 76, the party said President Buhari has attained a father-figure position and should do everything to respect the aspirations and will of the Nigerian people on all issues, particularly as the nation heads to the 2019 general elections. The PDP in a statement by its spokesperson, Kola Ologbondiyan, urged President Buhari to leave a lasting legacy by doing all within his powers to ensure that the nation he leads knows peace; to ensure that rules are obeyed and that the sensibilities of the people, in our diversities are fully respected. The party posited that the 2019 general elections place a heavy responsibility on the shoulders of President Buhari to guarantee peaceful, credible, free and fair elections, particularly, the Presidential election, by ensuring that all electoral laws and rules are obeyed; that opposition members are not molested; that the amendment to the Electoral Act is signed; as well as to declare like his predecessor, Dr. Goodluck Jonathan did in 2015, that his 2019 re-election ambition is not worth the blood of any Nigerian. The PDP argued that if the President looks at the state of the nation today, “he will discover, and we believe he is aware, that the situation has become horrendous for the average Nigerian”.

Fact admitted requires no further proof (1) Andrew Orolua, Abuja This is an appeal against the decision of the Court of Appeal that dismissed the appellant appeal on the judgment of Bada, J., of the High Court of Lagos State. The facts that gave rise to this appeal was that in 1977 appellant applied to the Federal Electoral Commission to contest election into the Constituent Assembly, and was disqualified by the Commission. He thereafter held a News Conference where he described himself as a retired Captain of the Nigerian Army, and claimed to have served meritoriously and with unblemished record for nine years before he resigned voluntarily. The Nigerian Army confronted with this information, and incensed by their inaccuracy, held its own News Conference where in a public notice dated 2/9/77, it denied the claim and stated the circumstances whereby appellant was compelled to leave the Nigerian Army. The defendant, publishers of the Tribune Newspapers was present at this News Conference by its Reporters, and published the notice distributed to the Journalists present in the Tribune Newspaper of the 5th September, 1977. Appellant thereupon brought this action claiming from the respondent the sum of £500,000 for words falsely and maliciously published by the respondents of and concerning him in the issue of their Newspaper known as the “Nigerian Tribune.” In his statement of claim, appellant claimed that the publication had severely injured his credit, character and reputation, and had brought him into public scandal, odium and contempt. The particulars of the words complained of are as stated below: “Captain Din was dismissed from the Army. Members of the public including the Mass Media have been advised to stop addressing a onetime Military Officer in the Nigerian Army J.M. Din, as a Captain because he was dismissed from the Army with ignominy. In a release issued in Lagos the Acting Public Relations-Director of the Nigerian Army, Major, I.A. Olatunji described a recent Press statement by Mr. Din to the effect that he voluntarily resigned his commission from the Army as unfortunate, irresponsible and shameless. Major Olatunji explained that Mr. Din was tried by a Military Court, and found guilty of certain grievous offences for which he was accordingly jailed for 18 months. He further explained that the ex-convict was subsequently dismissed from the Nigerian Army with effect from December 6, 1971.” “He wondered why a fellow like the ex-Captain Din, fully aware of the circumstances which led to his dismissal could parade himself about telling white lies.”...... In a considered ruling, the trial Judge dismissed the claim of the appellant in its entirely, and in his judgment made the following findings of fact:(1) That the Nigerian Army issued a Press Release in 1977 and forwarded a copy to the appellant:-Exh. “Dl” “D2” (2) That the appellant was dismissed from the Nigerian Army, from 6th December, 1971. (3) That appellant was found guilty of a criminal offence and convicted by a Military Court and sentenced to over 12 months imprisonment, which in all probability was for 18 months, at the Kirikiri Prison. Appellant appealed against the judgment. The appellant raised several issues but essentially that (a) the question of the proof by the defendant/respondent of the fact that appellant was convicted of a criminal offence and sentenced to imprisonment by a Military Court, and (b) the issue of justification and fair comment pleaded by the defendant/ respondent. The Court of Appeal accepted the findings of fact made by the trial Judge and dismissed the appeal on the ground that it lacked merit. Counsel to the appellant challenged the admission of the evidence of the conviction of the appellant which the trial Judge relied upon in dismissing appellant’s claim, and held that it was not necessary to seek further proof of the fact of conviction and sentence of the appellant, since this had been established on his own admission during crossexamination. It was held that the provisions of Sections 131(1) and 224 of the Evidence Act relied upon by Counsel to the appellant, are not applicable to the issue of the proof of the fact of the previous conviction and sentence of the appellant. The Court of Appeal considering the defence of fair comment raised by the respondent referred to the defence of the respondents in paragraphs 7-11 of the statement of defence, and held that this fell within the purview of paragraph 14
of the schedule to the Defamation Law, Cap.34 of Lagos State and was privileged. Appellant has appealed further to this court relying on five grounds of appeal which are substantially similar to those relied upon in the court below...... Learned counsel to the appellant has formulated seven questions as arising from the five grounds of appeal filed. On the other hand, respondent’s counsel has formulated two questions on which he relies..... I will therefore in this appeal adopt the issues formulated by the respondent which are directly arising from the grounds of appeal and are as follows: 3.1 The main question for determination is whether the defendant has to go to the trouble of calling evidence to prove a fact already admitted by the plaintiff in his testimony during the proceedings. 3.2 Whether or not the defence of privilege under section 9 of Defamation Act 1961 would cover the release made by the Military/Authority in the interest of the general public about the circumstance leading to the exit of a former officer of the Army.” These two questions cover the issues raised in the five grounds of appeal filed in this case and all the issues raised in appellant’s formulation. It seems to me that question “3.1 of the respondent’s formulation encompass questions 1, 2, 3, 4, 5 and 7 of the formulation by the appellant. Similarly, question 3.2 of the respondent refers to the same issue as question 6 of the appellant. I shall start my consideration of this appeal with the issue of the proof of the conviction and sentence of the appellant on which the liability of the respondent for the defamatory publication rests.

A careful perusal of the pleadings and the findings of facts made by the learned trial Judge which were accepted by the Court of Appeal, discloses that appellant was not disputing the fact that he was dismissed from the Nigerian Army on the 6th December, 1971. Indeed the evidence was that he admitted the fact under cross-examination. It is clear from the statement of defence that the defendants are not denying they published the alleged defamatory matter. They are relying on the fact and it is the finding of the learned Judge that appellant was found guilty of criminal offence and convicted by a Military Court and sentenced to over 12 months imprisonment. It is this finding that counsel to the appellant is challenging, despite the fact that appellant during cross-examination at the trial admitted the fact that he was tried, convicted and sentenced to imprisonment of 12 months by a Military Court. Mr. Ladi Williams, learned Counsel for the appellant in his submission contended that counsel’s objection to the question to the appellant whether it was true that he was detained at the Kirikiri Prison as a result of a sentence passed on him, was overruled. Learned Counsel contended that the answer was inadmissible. Mr. Williams argued before us that the trial Judge had relied for his finding of proof of the conviction on this inadmissible evidence. The Court of Appeal also relied on the admission as proof of the conviction of the appellants. Learned counsel, therefore relied on Owonjyin V Omotosho (1961)1 All N.L.R. 304, 308; [1961) 2 SCNLR 57 and Kale V Coker & Ors. (1982)12 S.C.252, 257-8, for the submission
of proof of convictions in those cases where evidence of character is relevant. I reproduce hereunder the provision of Section 224(1)(a) of the Evidence Act which is as follows:Where it is necessary to prove a conviction of a criminal offence the same may be proved:-(a) by the production of a certificate of conviction containing the substance and effect of the conviction, only purporting to be signed by the registrar or other officer of the court in whose custody is the record of the said conviction; Learned counsel for the appellant has argued that the admission by the appellant, which in any case he regards as inadmissible, did not, even if accepted, satisfy the provisions of Section 224(i)(a) of the Evidence Act which speaks of proof “by the production of a certificate of conviction containing the substance and effect of the conviction.” Section 131(1) specifically precludes the giving of evidence of any judgment or proceedings except by production of the judgment of proceedings, except where secondary evidence of it is admissible. Counsel to the appellant’s contention seems to me to rest on the assumption that the fact of the conviction of the appellant is an issue in the proceedings, which if it is, ought to be proved by the party who alleges. In paragraph 4 of his statement of claim, appellant by pleading and stating the natural ordinary meanings of the words complained of to mean (a) that the plaintiff was dismissed from the Nigerian Army with effect from December, 1971; (b) that the plaintiff was tried by a Military Court and
found guilty of certain grievous offences for which he was jailed for 18 months, has put his character in issue. It seems to me hardly disputable that proof of previous conviction is only relevant where it is a fact in issue. Proof of conviction of appellant has become necessary because defendants in paragraphs 3, 9 and 12 of their statement of defence joined issues with the plaintiff as follows: (3) The defendants deny paragraphs 3, 4 and 5 of the plaintiff’s statement of claim and put him to the strict proof thereof. (9) The said Nigerian Army put out a public notice denying that the plaintiff resigned voluntarily from the Army. The public notice informed the public that the plaintiff was tried by a Military Court which found him guilty of a criminal offence and sentenced him to EIGHTEEN months imprisonment as a result of which the said plaintiff was dismissed from the Nigerian Army in December, 1971. The defendant will among other things rely on the public notice dated 2nd September, 1977 issued by the Directorate of Army Public Relations Department, Headquarters Nigerian Army, a copy of which was given to the defendant,” (12) Further or in the alternative, the said words complained of were true in substance and on facts.” Although issues had been joined in respect of the fact of the conviction of the appellant, the admission of that fact by the appellant, under cross-examination altered the situation and rendered the situation not one any longer in dispute. In order to understand this, resort could be had to the elementary rule of pleading that what has been admitted requires no further proof. This is supported by Section 74 of the Evidence Act which provides as follows: No fact need be proved in any civil proceedings which the parties thereto or their agents agree to admit at the hearing, or which, before the hearing, they agree to admit by any writing under their hands, or which by any rule or pleading in force at the time they are deemed to have admitted by their pleadings; provided that the court may, in its discretion, require the facts admitted to be proved otherwise than by such admission. Thus, where both parties have agreed on a fact in issue, no further proof of such fact was necessary as it ceases to be an issue between them:-See Chief Okparaeke of Ndrakaeme & Ors. V. Egbuonu & Ors. (1941) 7 W.A.C.A. 53. In Chief Nwizuk & Ors. v,. Eneyok & Ors. (1953) 14 W.A.C.A. 354, it was held that admissions under this section are not confined to written nor documentary admissions. They include oral admissions if made clearly in open court during the proceedings. Admissions may also be by implication where there is a failure positively to deny an allegation. In Hill V Hogg (1854) 4 Allen (New Brunswick) R 108 it was held that an admission and a confession to the commission may be given in evidence in proof of an imputation. Learned Counsel for the appellant has contended that the previous conviction on which the defendant relied ought to be proved by the production of the judgment of proceedings or secondary evidence admissible under section 96(2) of the Evidence Act. I do not think such a contention is on the facts of this case acceptable, or is such proof necessary in this case. I have already pointed out the proof of the fact of conviction is required when it is an issue to be proved in the dispute between the parties. The court below referred to and relied on the opinion expressed in the book Practice and Procedure of the Supreme Court, Court of Appeal and High Courts in Nigeria by Dr. Aguda at p. 481, and also Law of Evidence in Nigeria by the same author. At page 401, para. 284)4 of the Law of Evidence, where the learned author pointed out that the admission in open court of previous conviction. by an accused is conclusive proof of that fact. It is only when the previous conviction is denied that proof will be required. I have pointed out in this judgment that in civil proceedings, which this is, proof of previous conviction is only relevant where it is a fact in issue. Mr. Adesanya for the respondent submitted before us as he did in the Court below, that the fact that appellant was sent to KiriKiri prison as a result of a sentence passed on him by a Military Court, which is the main issue to be determined in this appeal, required no proof because it was an admission of a fact in issue. Received in audience members of Motion Picture Practitioners’ Association of Nigeria (MOPPAN) at the Presidential Villa, Abuja, urging them to use their platform to promote the growth of the economy. He disclosed that he had signed an instrument of ratification of the World Intellectual Property Organization on audio-visual perform. On funding, the president said that he has directed the Bank of Industry (BoI) and the Nigeria Export-Import Bank to engage your sector by providing affordable working capital. This funding, president Buhari said, will unlock some of the trapped potentials in the entertainment industry, leading to growth. He added that he was tasking the Minister of Finance and Governor of Central Bank to ensure that these financial institutions immediately commence the engagement. Buhari said that in the last two years, Nigeria has established a mutually beneficial relationship with the Kingdom of Morocco, especially in the Agricultural sector. The president said, “In our engagements, I learned that Morocco also has a vibrant film industry that is globally recognized as a shining example of Africa’s entertainment capability. “Based on this, I have directed that, in addition to agriculture, Nigeria should also explore potential partnership opportunities with the Moroccan entertainment industry. I understand some of you were part of the various delegations, at both Federal and State levels, to have visited Morocco to explore partnership opportunities in the last 12 months.”
US Coast Guard lauds NIMASA’s efforts to improve Port security Temitope Adebayo The United States Coast Guard has commended the Nigerian Maritime Administration and Safety Agency (NIMASA) for its efforts to improve security and operational efficiency within Nigeria’s maritime domain. The commendation was given on Thursday in Lagos by a visiting coast guard team led by Lt Commander Janna Ott. The delegation was in Nigeria to inspect facilities and ports. Ott, a representative of the US Coast Guard in International Port Security Programme, said NIMASA had taken laudable steps to improve Nigeria’s compliance with the International Ship and Port Security (ISPS) code. Ott said of NIMASA, “You do have a great team here. They were accommodating. “I thank them for their frank and open discussion in allowing us to give them our observations. Hopefully, they can take whatever we have given them to heart and start working on them right away.” She, however, urged greater vigilance regarding access to the ISPS zones at the ports. “It’s very important that you know in your port facilities who is gaining access and they are authorised to be there before they go through those gates of the ISPS zone,” Ott stated. “You also need to be consistent with the proficiencies of all the security personnel in holding people accountable that are coming through those port facilities. We already had an excellent discussion with NIMASA,” she added. Responding, the Director General of NIMASA, Dr. Dakuku Peterside, said the country had made significant progress in addressing the issue of access control around the port areas. Dakuku, who spoke through NIMASA’s Executive Director, Finance and Administration, Bashir Jamoh, said, “The issue of access control is one of the paramount areas. The access road, access control, those are critical areas. “Similarly, on access control, we just introduced stickers to the ports. We started implementing it early this month.” He said the federal government had taken measures in partnership with the private sector to ensure that all port facilities in Nigeria were easily accessed. The DG said NIMASA had recorded steady progress in its implementation of the ISPS Code, stressing that Nigeria has moved from implementation to enforcement. “The issues you mentioned, we are dealing with them. One of the things we have introduced is training. We are aware that some of the facilities have these issues. Right now, most of them are going into biometric access control, which you observed in some of the terminals, like MRS, Five Star Logistics, etc.”, he explained.

NNPC generates $1bn through DSDP in 3 years- Former Programmer Tom Garba, Yola A Senatorial aspirant in Adamawa State, Alhaji Salihu Garba Mama Aliyu has revealed that the Nigerian National Petroleum Cooperation (NNPC) has generated more than One billion US Dollar in the implementation of the Direct Sales of Crude oil and Direct Processing (DSDP), which was introduced when he was a programmer with the NNPC. Speaking in Yola after declaring to run for the Senate in his district in Adamawa, Alhaji Aliyu
said during his time with the NNPC that he was the architect of DSDP, which yielded so much to the tune of $1.billion. According to him, when the programme was introduced at NNPC that he met oppositions but after some time the program saved about $500 million but as at the time he left to contest the senatorial elections in Adamawa State the programme yielded more than $1billion for the Federal Government. “I had trained many youths on ICT at the NNPC which had learned to manage the nations information technology in the oil and gas sector.
“So far, I am still training more than 50 youths in Adamawa State in ICT, so that they can man the World stage on ICT to help Nigeria move forward”, he explained. He also revealed that he had empowered more than 50 youths in Adamawa and if elected to the Senate he would empower more youths in the Central Senatorial District of Adamawa State. Salihu Garba Mama Aliyu is contesting is the Adamawa Central Senatorial District on the platform of Alliance National Party of Nigeria ANP.

On the sustainability of the certification of the MMIA, Mrs. Shin Aba revealed that the evaluation and monitoring team has been equal to the task of ensuring that it was sustained. “When it is the time to renew our certification, then we won’t have much to do. We can only up our game by improving on facilities. IATF 2018: Obasanjo calls for quick ratification of AfCFTA Mathew Dadiya, Abuja Former Nigerian President Olusegun Obasanjo has urged all African countries to ensure the immediate ratification of the African Continental Free Trade Agreement (AfCFTA) and to implement policies that facilitate and support intraAfrican trade. Chief Obasanjo, who is also the Chairman of the Advisory Council of the Intra-African Trade Fair (IATF 2018), made the call on Sunday in Cairo,Egypt during a conversation session on the sixth day of the trade fair organised by the African Export-Import Bank (Afreximbank), in collaboration with the
African Union Commission (AUC), and hosted by the Government of Egypt. Obasanjo described the AfCFTA as an instrument of tremendous transformation which would change the structure of Africa and said that the IATF would help towards the achievement of its ratification. With the AfCFTA, Africa would be saying that it no longer accepted the structure given by its colonisers, he said. “One of the things I hope we will be able to get as quickly as possible is the availability of visas-on-arrival or a common visa for some countries. It hurts that those who want to trade within Africa need to have so many visas.” He also highlighted the challenge posed by differing trade regulations
in different African countries, noting, “When you want to import or export, there are many different regulations from country to country, and we need to get away from that. What we are doing now will help us get away from that as soon as possible.” Chief Obasanjo described 2018 as one of the most significant years for Africa with the signing of the AfCFTA in Kigali in March and the inauguration of the first IATF’. He argued that it was time to move beyond rhetoric and take concrete actions to tackle the challenges impeding intraAfrican trade. The former Nigerian President rejected the notion that Africa lacked the resources to finance its development, saying, “I believe the resources are here
in Africa. It’s a matter of how Africa accesses the available financial resources. Money is cowardly - it only goes where it feels safe and wanted”. Obasanjo commended Afreximbank for its effectiveness in moving forward the intra-African trade agenda and attributed that success to the culture of continuity in the Bank where all the past Presidents have continued to work with and support the current President in pursuit of the development of intraAfrican trade. He, however, expressed regret that Nigeria had yet to ratify the AfCFTA, even though Nigeria led the final negotiations for the agreement and the final agreement was taken to the country’s executive council and it was passed.

Heart foundation votes for lactose-free Valio milk Godwin Anyebe Executive Director of Nigeria Heart Foundation and Honourary Consul of Finland to Nigeria, Dr. Kingsley Akinroye, has encouraged Nigerians to consume Valio milk as proper nutrition can help to conquer any heart-related diseases, noting that Finnish people have a life expectancy of 70 years due to proper nutrition. Akinroye gave the charge at the unveiling of health-giving lactose-free Valio powdered milk in Lagos recently. Lactose-free Valio powdered milk which comes in four variants was introduced into the Nigerian market by a leading pharmaceutical company, Thompson & Grace Pharmaceuticals Limited (T&G Pharma), Lagos. ANN lauds Khadijah Lagos 2019: Ambode officially Abdullahi-Iya’s performance endorses Sanwo-Olu/Hamzat ticket at the vice presidential debate Benjamin Omoike The Lagos State governor, Mr. Akinwunmi Ambode yestreday officially endorsed the governorship candidate of the All Progressives Congress (APC) in the State, Mr Babajide SanwoOlu and his deputy, Dr. Obafemi Hamzat, saying that the duo were prepared for the campaign and ready to take on the task of moving the state to greater heights. The governor, who spoke at a stakeholders’ meeting held at the State secretariat of the party on Acme Road in Ogba, raised the hands of Sanwo-Olu and Hamzat before scores of party leaders and faithful and wished them well in the March 2, 2019 election. The governor said, “As we are looking forward to February 16, 2019, we know it is the Buhari/ Osinbajo ticket that the whole of Lagos will vote for. As we proceed two weeks after on March 2, we also declare that it is the Sanwo-Olu/Hamzat ticket that will come to take over from me by the special grace of God. “I pray for them and bless them that they will take over from me successfully in good health and in good spirit,” he said. He urged those still aggrieved with the fallout of the primaries of the party to follow his example, and accept the party’s supremacy. “The first thing I want to say is to appeal to all our party members who, in one way or the other, have been wronged or aggrieved that they should find a place in their hearts to let it just be the same way that I have accepted the greatness of the
party. “I want us to know that the party is supreme to all our individual interests because it has the common good for all of us and we must find a place in our hearts to let the party reign supreme,” he said. The governor also appealed to the leadership of the party to go a step further by looking for avenues to compensate aggrieved aspirants, saying such was necessary to spur them to work for the party and also move the party forward. According to him, “I want to further appeal to all our leaders and our party leaders also that when there is a platform for reconciliation, we should proceed also to continue to reconcile and when there is a platform for compensation, we should also make those promissory notes so that all our aspirants who are not candidates must be ready to sacrifice for the overall collective of our party. “This is very important so that we can move this campaign forward, because it is only when we win that we can compensate, it is only when we win that we can reconcile and so let us have that collective decision to move APC forward. “We are one party and we are one family and if we are one family and one party, then we should proceed and make APC the reigning party at the centre and the reigning party in Lagos. So, all our stakeholders, all our elders I seek for your cooperation, your solidarity and your support for our candidate at the gubernatorial level, senatorial level, House of Representatives and Assembly and also
Presidency,” Ambode said. National Leader of the party, Asiwaju Bola Ahmed Tinubu, on his part, commended the courage of Governor Ambode and others for accepting the outcome of the primaries of the party, saying their act of sportsmanship deserved to be appreciated. Group dismisses Amnesty’s ‘Harvest of Deaths’ report as mischievous, hatchet job Benjamin Omoike The Buhari Media Organisation (BMO) has accused Amnesty International (AI) of carrying out a hatchet job for the opposition in the run up to the 2019 general elections. This, it says, is obvious with the release of a report titled ‘Harvest of Deaths’ which focused on HerdersFarmers clash in the last three years, but which was tilted to make it look like the administration of President Muhammadu Buhari did little or nothing to stem the tide of violence. BMO said in a statement signed by its Chairman Niyi Akinsiju and Secretary Cassidy Madueke that AI was out to send out subtle message to eligible voters in a report that was expertly made to appear balanced. “It is also suspicious that Amnesty International went to
great lengths to establish what we have always known- that herders’ communities had also been victims of a mindless orgy of violence over land and grazing routes. “Could it have to do with the fact that the Presidential candidate of the Peoples Democratic Party (PDP) is also a member of the same Fulani ethnic stock like the President? “But it is mischievous to create the impression that the conflict is either a three-year old conflict or that it was worse in the last three years.” BMO also questioned the real intention of Amnesty International in releasing its report barely two months to the election. “If the rights’ watchdog meant well for Nigeria, it should have released the report at a time some Nigerians felt that it was a oneway attack by Fulani herdsmen

Last week Friday, Obong Godswill Akpabio, a serving senator and his wife Unoma, displayed another ‘uncommon’ act of desperation that was unbecoming of their social standing when they attempted to usurp the official duties of Mrs. Martha Udom, the wife of Governor Emmanuel Udom and First Lady of Akwa Ibom State. The display took place at the Obong Victor Attah International Airport, during the visit of the Wife of President Muhammadu Buhari and Nigeria’s First Lady, Aisha Buhari to flag-off her “Future Assured Programme.” It was the duty of the First Lady of the state to welcome Aisha but as her plane taxied to a halt and the door opened, Mrs. Unoma Akpabio emerged from the crowd that gathered to welcome the nation’s First Lady, shoved aside the Governor’s wife and positioned herself to receive Aisha Buhari. Mrs. Unoma’s action infuriated the security and protocol officers accompanying Mrs. Aisha from Abuja, who ordered that the door of the plane be closed while Aisha Buhari went back inside. The commotion created by the development almost led to a free for all fight by security officers attached to the various interests at the airport. It took about 25 minutes for normalcy to be restored as Mrs. Udom was given her rightful place to receive the First Lady who embraced her on stepping down from the aircraft. Still not satisfied, Unoma cornered Aisha Buhari as she was being escorted by the Governor’s wife and carried out her own illegal ‘welcome ceremony.’ As these unnecessary distractions lasted, Senator Akpabio could be seen a few metres within the crowd ‘supervising’ the inglorious act surrounded by his supporters as many people at the airport booed him and his otherwise amiable wife. What took place on Friday is not the first time Akpabio, either directly or by proxy, is behaving in a manner that has the potency to breach public peace in the state since August 2018 when he defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC). A few weeks ago in November, Akpabio was alleged to have instigated five lawmakers in the state House of Assembly to impeach the Speaker Hon. Akpabio’s self deconstruction and Gov. Udom’s right to his destiny In August when he formally decamped to the APC after weeks of speculations, Akpabio accused the PDP of plundering Akwa Ibom State since 1999 when the country returned to civilian rule and asked the people to embrace APC as he was out to take the state to the centre. But many people reminded Akpabio that he was part of the leadership of the PDP and one of the most beneficiaries of whatever PDP is accused of doing in the past 18 years. They said Akpabio was commissioner in Akwa Ibom State for six years under the PDP, was governor of the state for eight years under the PDP and was for more than three years a PDP senator before moving to the APC. Not too long ago, Akpabio attracted serious public rebuke when he likened what would take place in Akwa Ibom during the coming 2019 election to Hitler’s invasion of Poland in 1939. He was speaking at a funeral mass in Enugu. Akpabio said, “Recently, I had an occasion in Akwa Ibom State and this is what happened: I went just to make a floor declaration; others do it in the social media, others just sit in their offices, some do it by text messages that they have changed platform, what we call party. But in my own, I just decided to do it in an uncommon way because they call me uncommon transformer. “It was watched in 59 countries and somebody asked what happened there, and I said just how it happened in Poland. When they asked Hitler’s minister for information about the war in Poland, and he said Warsaw saw war and war saw Warsaw. “I will say that in the Ikot-Ekpene arena, when I stepped out, this is my first function after that, Warsaw saw war and war saw Warsaw. We can’t talk politics in the church but in 2019 Warsaw shall see war and war shall see Warsaw. The return will be victory.” To many Nigerians, this was going too low for a person liike Akpabio. Akpabio appreciable level of development while he was governor of Akwa Ibom state from 2007 to 2015 through the provision of needed infrastructures like roads, electricity and water, among others. He invested heavily on education and rural transformation as well as empowerment of young people and women. It was because of his performance in office as governor that many people, including this writer has in the past paid glowing tributes to Akpabio. But the senator is gradually but steadily destroying the image he built for himself over the years and in the process, dragging down also the name of his otherwise amiable and peace-loving wife Unoma. Again, Akpabio has the right to pursue his destiny and in the case of politics, to move to any party of his choice. As a chieftain of now APC, Akpabio is right to canvass support for himself and his party in the coming elections and beyond, but doing that in a manner of door-die is to say the least unpatriotic and therefore unfortunate. Akpabio has no reason to be desperate either for economic or political reasons because he has had the best of times. This was someone that was orphaned at young age and suffered
‘kwashokor’ during the war due to malnutrition but God benevolently showered blessings and mercies upon him, raising him from dust to become one of the most prominent and richest politicians in Nigeria. Yes, Akpabio contributed in making Emmanuel Udom governor of Akwa Ibom State; and so what? Did Akpabio come into this world as governor? It was someone that appointed him as commissioner, two times. He was also helped by someone to become governor? Akpabio should allow the brilliant young man that is now governor of Akwa Ibom state to work and serve his people without unnecessary distractions as is the case currently. This is because the more Akpabio makes headline news for the wrong reasons, the more speculations continue to spread that he is desperate to impress APC and Abuja in order to hide from prosecution over allegations of dishonest management of Akwa Ibom’s wealth while he was in office as governor; and such thought-lines are not good for him. On his part, Governor Emmanuel Udom has for the nearly four years of his governorship of Akwa Ibom
state proved his competence in leadership and governance by providing quality infrastructures while bringing innovations to existing ones as a proof of his entrepreneurship mind. Testimonies abound in the state of Udom’s numerous achievements in all facets of the society. What the Governor needs is to remain both focused and resolute. His eyes should remain on the goal which is bringing more developments to the state as well as prosperity to the people. While we commend the Governor for maintaining the peace in spite of the many unprovoked attacks, he should know that it is his duty to protect his people as well as pursuing his rights to political uplifting. Constitutionally Udom is entitled to a second term in office and having justified his first four years through outstanding performance, he will have no excuse to give if he allows himself to be intimidated out of his entitlement. Udom should therefore deploy all legal means to consolidate his position so that Akwa Ibom and the people can benefit more from his leadership in the next four years. He has the right also to pursue his destiny.

US army: 62 al-Shabab fighters killed in Somalia air raids
British PM sets date for Brexit deal parliamentary vote
British Prime Minister Theresa May has announced members of parliament will vote on her widely criticised Brexit deal in the week beginning January 14 next year. In a statement to parliament on Monday, May also rejected growing demands for a second referendum on the UK’s membership of the European Union, warning it would “further divide” the country and “break faith” with the British people. The 62-year-old dismissed calls from leading public figures, including former prime ministers Tony Blair and John Major, for a rerun of the 2016 vote suggesting it would do “irreparable damage to the integrity of our politics”. “It would say to millions who trusted in democracy, that our democracy does not deliver,” May said. “Another vote which would likely leave us no further forward than the last.” Brexit chaos Nearly 52 percent of Britons - more than 17 million people - voted to leave the EU during a divisive referendum held in June 2016. Turnout for the poll was more than 72 percent. The UK is now set to leave the 28-member bloc on March 29 next year, two years after it triggered Article 50 the exit clause in the EU’s constitution - and kick-started negotiations with European leaders over a divorce deal. But May’s proposed deal, brokered after months of back-and-forth between London and Brussels, has proved widely unpopular among parliamentarians. Last week, she pulled a so-called “meaningful vote” on the plan, acknowledging it would have been roundly rejected by the UK’s lower chamber House of Commons. The move triggered disgruntled Eurosceptic Conservative MPs to move for a vote of confidence on her leadership, which she narrowly survived in a secret ballot on December 12. In an effort to assuage critics from within her own party and across the political spectrum, May attended an EU Council summit in Brussels the following day, where she pleaded with her counterparts in the bloc to make concessions on the UK-EU withdrawal agreement’s contentious “Irish backstop” clause. EU officials refused to blink, however, and maintained that no amendments to the deal would be forthcoming. But on Monday, May told parliament she had won private assurances from her European counterparts at the Brussels summit that there was “no plot” to keep the UK in the backstop and that they wanted to avoid having to activate the safety net provision
- which would guarantee no hard border is erected on the island of Ireland in the event that post-Brexit trade negotiations between the UK and the bloc prove unsuccessful. “I know this is not everyone’s perfect deal. It is a compromise. But if we let the perfect be the enemy of the good then we risk leaving the EU with no deal,” May said. “Avoiding no deal is only possible if we can reach an agreement or if we abandon Brexit entirely,” she added. ‘Deal not going to change’ Leader of the main opposition Labour Party Jeremy Corbyn, for his part, accused May of “achieving nothing” at the EU Council meeting and leading the UK into a “national crisis”. “She has not made any progress at all… The deal is unchanged and not going to change,” Corbyn told the Commons on Monday in his response to May’s speech. “The prime minister has cynically run down the clock and tried to manoeuvre parliament into a choice between two unacceptable outcomes: her deal or no deal,” he added. In a bid to force a vote on her Brexit deal this week, Corbyn said he would table a motion of no confidence in May as prime minister. Crucially, the motion does not call for a confidence vote in the government as a whole, meaning May’s administration is not obliged to set aside parliamentary time to debate it. Analysts, meanwhile, agreed May’s approach was aimed at funnelling the multi-faceted Brexit debate into a twoway choice come January. “She [May] is going to try and make this a choice between her deal and no deal and say ‘you have no alternative, you might not like what I’m offering but you like the only other pathway [a no-deal departure] even less, so choose the lesser of two evils’,” Simon Usherwood, a reader in politics at the University of Surrey and deputy director of the UK in a Changing Europe group, said. Calls for another referendum The ongoing parliamentary standoff between May and opponents of her deal from across the political spectrum, including from within her own party, has raised the prospect that MPs will veto her withdrawal proposal come January. Thomas Cole, head of policy at the pro-second referendum People’s Vote campaign, said it would be “perfectly legitimate” for the British public to have a second say on Brexit given the parliamentary gridlock. “It’s weighing up the promises that were made in 2016 with reality now.
We all now know what’s on the table and what’s on offer. We can weigh that up with what we would say is the best deal the UK already has and that is as an EU member inside the EU,” Cole told Al Jazeera. “It’s clear that the promises that were made in 2016 by the leave campaign have not materialised there’s not going to be these amazing new trade deals ready to go on day one when we leave the EU, nobody spoke about a transition period back in the 2016 campaign, and the issue of the Irish land border was rarely if ever discussed at all,” he added. According to a recent poll by market research and data analytics firm YouGov, 55 percent of UK voters are in favour of a referendum on the proposed terms of the country’s departure from the EU. Meanwhile, some 53 percent of Britons are now in favour of remaining in the bloc, according to data gathered by the UK’s National Centre for Social Research. But Usherwood cautioned that another referendum could worsen the political divide currently racking Britain. “You’re likely to have all of the same problems as you had with the 2016 referendum [in the event of a second vote] - about which question you’re asking voters and which choice you’re offering,” he said. “Also you have to assume that people are not that interested in the detail of what’s going on and there’s a whole lot of exasperation at this still not being at a conclusion.”
The US military said it killed 62 al-Shabab fighters in six air raids last weekend in the vicinity of Gandarsh in Somalia’s south-central Banaadir province. The military’s Africa Command (Africom) said on Monday that four attacks were carried out on Saturday, killing 34 fighters, and two more on Sunday, which killed 28. “Africa Command and our Somali partners conducted these air strikes to prevent terrorists from using remote areas as a safe haven to plot, direct, inspire and recruit for future attacks,” Africom said in a statement. The air attacks, among the deadliest this year, did not kill any civilians, the statement said. “At this time we assess these air strikes did not injure or kill any civilians.” The US air strikes were aimed at alShabab fighters who were preparing a major attack on a Somali government military base in the Lower Shabelle region, a Somali intelligence official, who insisted on anonymity because
he was not authorised to speak to the media, told The Associated Press. The United States carries out regular air raids in Somalia in support of a UN-backed government there, which has been fighting against an al-Shabab rebellion for years. Last month, the US military said it had killed 37 fighters from the alQaeda-linked group. The air raids bring to 45 the number of strikes the Pentagon has conducted against al-Shabab so far in 2018, military spokesman Colonel Rob Manning said. Last year, the figure was 35. Manning attributed the increase to operations becoming more “efficient”. “We’re getting better and because we’re getting better we’re able to ... find, fix and eliminate those terrorist organisations,” Manning said. The air attacks, in a coastal region south of Somalia’s capital, Mogadishu, were the deadliest in the country since November last year when the US said it had killed 100 fighters.
UN force says Israel-Lebanon border tunnels violate 2006 truce
United Nations’ peacekeepers in Lebanon have said two of the four tunnels allegedly discovered by Israel cross the border between the two countries, violating a ceasefire agreement that ended a 2006 war. In a statement on Monday, the UN Interim Forces in Lebanon (UNIFIL) said it “can confirm that two of the tunnels cross the Blue Line”. “These constitute violations of the UN Security Council Resolution 1701,” the peacekeeping force said in a statement, referring to the agreement that ended the 34-day war between Hezbollah and Israel in 2006. The resolution bans all unauthorised weapons between the Litani River and the UN-monitored border between Israel and Lebanon. Under the resolution, Lebanon’s army is responsible for security on its side of the border in a zone from which any other armed force, including Hezbollah, is banned.
Israel accuses Hezbollah of digging the tunnels. The Lebanese armed group has not commented on the UN operation. On Sunday, the Israeli army said it discovered a fourth tunnel which it proceeded to destroy as part of a military operation launched in early December and aimed at “exposing” and “thwarting” potential incursions into its territory. The UN peacekeepers said they would continue their technical investigations, describing the recent discoveries as “a matter of serious concern,” requesting “urgent follow-up actions” by the Lebanese authorities. In Beirut, Lebanese Prime Ministerdesignate Saad Hariri said his country is committed to the full implementation of the ceasefire agreement and respect of the Blue Line. Hariri said in a meeting with General Stefano Del Col, the UNIFIL head, that the Lebanese army will conduct patrols to deal “with any flaw in the implementation” of the ceasefire.

The Confederation of African Football (Caf) has confirmed that no decision has been taken to force Ivory Coast to host the 2023 Nations Cup rather than 2021. Caf president Ahmad said on television recently that Cameroon has been offered the 2021 finals instead of Ivory Coast. Cameroon were stripped of the 2019 finals due to poor preparation and security. “We confirm no decision was taken by the executive committee,” Caf wrote. “We are waiting first for the host for 2019 and then we will see.”

On Saturday Caf confirmed that Egypt and South Africa have both made bids to host the 2019 tournament, with a decision set to be made on 9 January. Meanwhile the Court of Arbitration for Sport confirmed it has received an appeal from the Ivory Coast Football Federation (FIF) against the “decision” to remove the 2021 hosting rights. “The FIF was surprised to learn that the president of Caf decided on his own authority, without any prior consultation … to reassign the 2021 edition, which was entrusted until then to Ivory Coast, to Cameroon,” an
FIF statement said last week. “The preparation and work required to organise this great competition, which is particularly important for all Ivorian football and the Ivory Coast, constitutes important economic, financial and human investment. “In view of all that has happened, the FIF has gone to Cas to appeal against the decision of Caf.” Caf president Ahmad had also indicated that Ivory Coast has now been offered the hosting rights for 2023. Anthony Joshua: I turned down $50 million to fight Deontay Wilder Nigerian-born British boxer Anthony Joshua has revealed why the fight between him and Deontay Wilder did not happen this year. The unbeaten heavyweight champions were expected to fight for the biggest prize in boxing this summer before they settled for different opponents in persons of Alexander Povetkin and Tyson Fury respectively.
