employment. But the Federal Government has said despite considering a reduced N8.6 trillion budget proposal for 2019, against the N9.1 trillion approved by lawmakers for 2018, it would give priority to human capacity development, particularly on allocations to health, education, pensions and other benefits to retirees. Nigeria needs aggressive investment in human capacity Continued from page 1 The Commitment to Reduce Inequality (CRI) Index, the second in the series, was recently released by Development Finance International (DFI) and Oxfam, which measures the commitment of governments to reduce the gap between the rich and the poor. BudgIT in Lagos during the week said Nigeria has the unenviable distinction of being at the bottom of the Index for the second year running, noting that more investments is needed in sectors that improve on human development capacity of its people and bridge the gap between the haves and the have-nots. In view of this, BudgIT called on the Government to increase its commitments in policy impact and actions by improving efforts on progressive spending, taxation, and workers’ pay and protection as a matter of urgency in order to move more Nigerians out of the poverty line. The group said, “We affirm that Nigeria needs to invest in its people with an aggressive investment in education, health, access to capital and growth poles that expand youth employment. We also take note that on the World Bank Human Capital Index, Nigeria ranked 152 out of 157 countries. “Beyond the current social investment programmes, President Buhari should forward stronger action in tackling inequality especially systemic long-term investments. We believe this should a major issue towards the 2019 general elections”. BudgIT added that Nigeria’s social spending (on health, education and social protection) is shamefully low. As seen in the index, the scale of economic inequality has reached extreme levels

as evidenced in the daily struggles of the majority of the population and as well with the recent report that Nigeria recently overtook India as the “poverty capital of the world.” The index, which is based on a new database of indicators, now covering 157 countries, which measures government action on social spending, tax and labour rights – three areas are found to be critical in reducing the gap. Just recently, Nigeria was ranked 157th out of 157 which shows that the country is currently spending way too low on key sectors such as health, education and social protection. Nigeria also ranks very low, 104th, on the progressivity of her taxation policy, a stagnated minimum wage, and consistent abuse of labor rights. The CRI index shows that in the past year, Nigeria has seen an increase in the number of labor rights’ violations. The minimum wage has not increased since 2011, put at 55 cents per day. Meanwhile, the Minister of Budget and National Planning, Udoma Udoma, on Wednesday in Abuja, said the Federal Government plans to submit a leaner 2019 budget to the National Assembly before the end of November. He disclosed this at the consultative forum on the medium term expenditure framework (MTEF) and fiscal strategy paper (FSP) 2019-2021. The Minister noted that the government plans to cut down the level of borrowing in the budget from N1.6 trillion in 2018 to N1.5 trillion, while the deficit component would be reduced from N1.9 trillion in 2018 to N1.6 trillion. Consequently, he said allocation for pensions and gratuities would be increased from N241 billion in 2018 to N527 billion next year, to assure workers of their benefits. Udoma said one per cent

of consolidated revenue fund (about N51 billion) would be set aside for basic healthcare fund as well as provision of counterpart funding for immunisation of children. This will be in line with the requirement of the National Health Act 2014. On basic assumptions underlining the proposed budget, the minister said government was looking at a 2.3 million barrel per day oil production capacity (including condensate), reduced from about 2.4 million bpd target proposed in the National Economic Recovery & Growth Plan (NERGP). Despite the recent oil output drop to about 1.9 million barrels a day, Udoma said government was optimistic the 2.3 million barrels a day target was achievable with production now rising to about 2.15 million barrels a day and new oil productions being put into play. Although a $50 per barrel oil price benchmark was proposed in the ERGP, he said with a significant rise in the price above $80 per barrel currently, government has proposed a $60 a barrel oil price for the budget. He said N305 was proposed as exchange rate to the dollar, with government working to keep inflation down after slight increases in the last two months on the heels of 18 months consecutive decline. The projected target gross domestic product (GDP) growth rate for the budget was put at 3.01 per cent, reduced from 4.5 per cent in the ERGP; 3.6 per cent in 2020 and 3.9 per cent in 2021. “Growth is expected to increase from 0.8 per cent in 2017 to 2.1 per cent this year and 3.01 per cent in 2019 with the continued implementation of the ERGP in 2019 and improved outlook for oil prices,” he said.

FCT court won’t tolerate frivolous adjournment of cases – CJ Doosuur Iwambe, Abuja The Chief Judge of the FCT High Court, Justice Ishaq Bello, has said that the syndrome of continued adjournment of cases on the grounds that investigations of cases are ongoing would no longer be tolerated by the court. Speaking during the inauguration of courts’ De-clogging Panel and Settlement Week Committee for the FCT Judiciary, Justice Bello said that the development was informed with the aim to enhance the capacity and

integrity of the system. According to the CJ, the public could also be assured of better access to justice through providing timely hearings, supported by efficient administration leading to just and efficient results. Lamenting daily reported cases of extortion of families of inmates by those with prosecutorial powers in the country, Justice Bello said that most of the victims are extorted on grounds that charges would be reduced or dropped against their wards but cannot voice out against the injustice

because of the ripple effect it may have on the inmates. According to Justice Bello, the decay in the justice delivery system has opened the floodgates for people to be imprisoned without justification. He said, “This decay has opened the floodgates for people to be imprisoned without any justification simply because somebody somewhere decided to influence hostile charges against them. “This was what necessitated the setting up of the De-clogging Panels aside the primary need

Fallen standard of education: NEC directs Govs to declare emergency in 36 states Mathew Dadiya, Abuja

The National Economic Council (NEC) has asked states governors to declare state of emergency in all their respective states in order to urgently address the falling standard of education in the country. In this regard, the NEC constituted an AdCommittee to review and submit recommendations to the Council on how best the education sector could be revived. Edo State Deputy Governor, Philip Shuaibu, who briefed State House Correspondents alongside the Bauchi State Governor Mohammed Abubakar and the Minister of State, Health, Osagie Ehanire, after the NEC meeting held at the Presidential Villa, Abuja, said

that the decision was sequel to a presentation made by the Minister of Education to NEC on Thursday, June 28, 2018, on the National Education Policy. Shuaibu said that governors would declare a state of emergency in the education sector of their respective states and demonstrate their commitment to revamping education. Federal and State governments are to allocate a minimum of 15% of their budgets to education in order to revolutionalise the sector, he said. He added that the NEC also constituted a special task force to manage the funds and oversee the infrastructural overhaul of selected schools for intervention across the federation. He said, “The Committee

observed that a multi-frontal approach is required to tackle the various factors militating against the achievement of the nation’s educational objectives, in view of the multi-dimensional nature of the crisis in the education sector. “The committee strongly recommends that the Federal Government, States and Local Governments collaborate to vigorously implement, and sustain action on the 10 pillars of the Ministerial Strategic Plan developed by the Federal Ministry of Education. “Among the areas of attention are the issue of out-of-school children, promoting adult literacy and special needs education, reviving Science, Technology, Engineering and Mathematics (STEM) and Technical, Vocational

Parties in last minutes submission of candidates’ list as 86 meet INEC deadline Tunde Opalana, Abuja Some of the major political parties made frantic efforts on Thursday to scale the 12 midnight deadline by the Independent National Electoral Commission (INEC) for political parties to submit names of their candidates for 2019 presidential and National Assembly elections. The electoral umpire had fixed between October 11 and 18, 2018 for the deadline on the submission of candidates’ list. Findings at the International Conference Centre (ICC), Abuja, venue of the submission, showed that officials of parties were making last minutes efforts to sort out and compiling names to beat the deadline. The major parties, the ruling All Progressives Congress (APC), Peoples Democratic Party (PDP) and a few others were unable to submit until Thursday night due to unsettled postprimaries squabbles in some states. The Daily Times further learnt that few of the less prominent parties that submitted late deliberately delayed their lists awaiting the fallout from primaries of major parties. It was further learnt that INEC gave entry forms to 86 out of the 91 registered political parties, indicating that not less than than 86 parties scaled the hurdles. INEC chairman, Prof. Mahmood Yakubu, who gave this indication at the venue which served as his temporary office, said all the parties that were given submission enrolment forms will be attended to. 67 senators secured return tickets while 42 lost out. Speaking further, he explained: “On the state of emergency that is to be declared on education, there is a strategic plan developed by the Federal Ministry of Education. Beyond that, the world is going global and technology is driving the world; if you look deeply, our major areas of development beyond infrastructure is the basic education and teachers and the council discovered that we need to also look into the area of technical education out of school children.” “If we address basic education and the foundation is well laid at that level, obviously the secondary and tertiary education would have been half solved. Declaring state of emergency is at the basic and we must look at the indices that make up our challenges especially at the area of technology.” The council said that the ministerial plan is for all the states and local government to key in, so that all will be on the same page, saying that, “it’s not going to be one of those documents that will be kept aside, and we are all unanimous in addressing it and all the states have agreed on this.”

16 months after, NHIS Governing Council 2019: Buhari tasks security chiefs on suspends Yusuf indefinitely hitch free election Doosuur Iwambe, Abuja

Following series of allegations against the embattled Executive Secretary of the National Health Insurance Scheme (NHIS), Usman Yusuf, the governing board of the Scheme announced the indefinite suspension of the ES with immediate effect. This development is coming eight months after he was reinstated by President Muhammadu Buhari after he was suspended by the Minister of Health, Prof Isaac Adewole, in July 2017. Announcing the decision of the council to wade its axe on the embattled ES to journalists in Abuja on Thursday, Chairman of the NHIS governing council, Ifenne Enyanatu, said that the decision to suspend Yusuf followed series of petitions over alleged infractions committed by him. The board amongst others accused Yusuf of allegedly inflating the scheme’s 2018 budget by fraudulently inflating the cost of biometric capturing machines”, and attempting to illegally execute N30 billion in Federal Government bonds. She announced that the council also resolved to

raise an administrative panel of enquiry to probe the allegations levelled against Yusuf and establish the truth or otherwise of the claims. “The panel has three months to complete its assignment and report back to us”, she said. According to Enyanatu, the suspension of Yusuf by the board was to allow the panel an ‘unfettered’ space to do a thorough investigation. “We consulted widely and got the approval of the Minister of Health before the suspension of Yusuf,’’ she added. The council said, for instance, that whereas the scheme’s total annual revenue should be on the increase, it has continued to decline since 2015, blaming this on “shortfalls in the remittance of enrollee’s contributions.” It noted that the contributions the scheme is getting from the Federal Government enrolees reduced from N6 billion in 2017 to N4.2 billion in 2018 “whereas a recent forensic audit revealed that about N138 billion is currently trapped in commercial banks”. The Daily Times recalls that in July 2017, the embattled executive secretary was suspended

Yusuf by the Minister of Health, Prof Isaac Adewole, over allegations of gross misconduct and fraud. The minister then set up a panel to investigate the allegations. The panel later indicted Yusuf on most of the allegations against him and recommended stiffer sanction while the minister forwarded the report to the presidency for its necessary action. But in February 2018, President Muhammadu Buhari against the recommendations of the probe panel and without informing the Health

Minister, reinstated Yusuf. The reinstatement ignited an uproar, with a group of workers staging a protest at the agency against the development. Since his return in February, many other allegations of fraud has trailed the controversial ES with the members staff and many management members of the scheme repeatedly calling for his sack. Meanwhile, Mallam Sadiq Abubakar has been directed to take charge as the acting Executive Secretary of the NHIS.

NASS suspends consideration of Electoral Act Amendment Tunde Opalana, Abuja Hope of many Nigerians to expeditious consideration of the Electoral Act (Amendment) Bill, 2018 by the National Assembly was dashed on Thursday as both Senate and House of Representatives stood down debate on the Bill for third reading and possible passage. Though scheduled on Senate’s Order Paper for consideration, the Bill was stood down when the Leader of the Senate, Senator Ahmad Lawan, said: “in view of the sensitive nature of the bill and its importance, it was vital to give the committee more time to do a thorough job”. The Senate President, Bukola Saraki, corroborated his position, then put it to voice vote and it was unanimously adopted. Saraki said the postponement was to enable

the Senate Committee on Independent National Electoral Commission (INEC) to carry out further legislative work on the bill but sources among senators said debate on the bill was stood down to avoid rancorous session in view of what happened on Wednesday. The bill had scaled second reading on October 10, a day after the two chambers of the National Assembly resumed from its elevenweek annual recess. The bill has been very contentious as President Muhammadu Buhari had declined assent to the bill for three consecutive times. This is therefore the fourth attempt by the lawmakers to have the bill passed and assented into law. The Senior Special Assistant to the President on National Assembly Matters (Senate), Senator Ita Enang, while giving clarification in Abuja on the action of the President, said that Buhari

declined assent to the bill due to some drafting issues and the period fixed for primaries among others. In a related development, the House of Representatives on Thursday suspended consideration of the Electoral Act No 6, of 2010 at the committee of the whole. The Daily Times recalls that the House commenced consideration of the report on Wednesday, but the process had to be stopped after members disagreed on the provision in the new amendment to the electoral act, on a possible use of “any other technological device” in an election where the card reader fails or malfunctions. Presiding over the committee of the whole, Deputy Speaker, Hon. Yussuff Lasun, had stopped the consideration of the bill at clause 27 with the promise to conclude on Thursday. The National Assembly joint committee on electoral matters had in its recommendation, in

clause 16(2) gave a proviso to the effect that where the electronic smart card reader repeatedly fail, or malfunction, an alternative technological device “as may be prescribed” by the Independent National Electoral Commission (INEC) may be deployed for purpose of voter accreditation. But at Thursday’s plenary, Speaker of the House, Hon Yakubu Dogara, called the chairman of the Rules and Business committee, Hon. Emmanuel Orker-Jev, to move that the bill be stood down. President Muhammadu Buhari had earlier raised 11 queries about the electoral act the last time it was passed and sent to him for assent. The joint committee of the Senate and the House has worked on the areas of concern. A new date was however not fixed for the resumption of the consideration of the Electoral Act Amendment.

President Muhammadu Buhari has met with the security chiefs and called for concerted efforts of all security agencies to ensure that the 2019 general election is hitch free. The President gave the charge on Thursday during the National Security Council held at the State House, Abuja. He expressed concerned on the areas of post- election violence, noting that desperate politicians may whip up ethno- religious sentiments to create security situation in the country. The council said that there was an attempt to put pressure on electoral body by some notable personalities through demonstrations which was brought under control by combined efforts of security agencies to avoid been hijacked by hoodlums and armed bandits. “Also of concern is the proliferation and stockpiling of weapons by some disgruntled elements with a desire to take laws into their hands at the slightest opportunity,” the President said. The Security Council recommended deployment of security agencies to states to enable the elections to be conducted peacefully and to further doused tension created by the outcome of the

political parties’ primaries and some desperate persons to sabotage the electoral process. Buhari emphasised on the need for continuous sensitisation of the public by National Orientation Agency (NOA) and regular meetings of relevant stakeholders including INEC, international/ local observers and the media ahead of the elections. The security chiefs were led to the meeting by the Minister of Defence, Brigadier General Mansur Dan-Ali (rtd). But, the Chief of Defence Staff, General Abayomi Olonisakin, was absent. Security chiefs who attended the meeting include the Chief of Army Staff, Lieutenant General Tukur Buratai; Chief of Naval Staff, Vice Admiral Ibok Ekwe Ibas; and Chief of Air Staff, Air Marshal Sadique Abubakar. Also present were the Inspector General of Police, Mr. Ibrahim Idris, and the Director-General of the Department of State Services (DSS), Mr. Yusuf Bichi, among others. Government officials also in attendance were the Chief of Staff to the President, Mallam Abba Kyari; Secretary to the Government of the Federation (SGF), Mr. Boss Mustapha; and the National Security Adviser, Major General Babagana Monguno (rtd).

of freeing up the courts’ dockets. “My heart bleeds when I come to think of how the families of those behind bars could get extorted on daily basis on ground that charges would be reduced for their relations or even set free from the prisons. Daily, these people are being extorted and they dare not open their mouths because they fear that they might be aggravating the conditions of their own behind bars.” Giving an insight on how the newly constituted panel would function, Justice Bello said: “If the court discharge any suspect

whom they want to rearrest, the court will not make any new order to rearrest but as soon as they do that, we will give them two weeks within which they must lead evidence”. In their response, the Director General, Nigerian Institute of Advanced Legal Studies, Prof. Adedeji Adekunle (SAN) and the Executive Secretary, Presidential Advisory Committee Against Corruption (PACAC), Prof. Bolaji Owasanoye lauded the initiative. They further urged other heads of courts in the country to key into the initiative to ensure speedy dispensation of cases.

2019: Tension, protest as APC submits party candidates’ list to INEC Tom Okpe, Abuja Tension and protest took over the All Progressives Congress (APC) National Secretariat Abuja on Thursday as the party submits its candidates’ list to the Independent National Electoral Commission (INEC). The palpable tension was noticed between both the senior and junior staff of the party with the movement of the list to INEC by the Director Organization, Alhaji Abubakar Kiary at about 2.25 pm leading other senior staff of the party in a branded APC bus to submit the list. Recall that the election umpire, INEC mandated all political parties up till 12 midnight Thursday to submit the names of their presidential and senatorial candidates. It was observed that so many members of the party across the

country who were not sure of whether the decision of the appeal panel was in their favor were seen having two to three side chat within the party secretariat without knowing exactly whose names were submitted by the party and who was not as no party executive including the National Publicity Secretary of the party, Mallam Lanre Oniru refused speaking to journalists of the development. Meanwhile, a group on the platform of Benue South APC Justice and Equality Movement has taken a peaceful protest to the headquarters of the party, asking the NWC to call the Minister of Agriculture, Chief Audu Ogbeh to order for allegedly substituting the names of elected candidates with those who did not participate at the primary. The coordinator of the group, Mr. Akor Ikwuoche, told newsmen that they were surprised that after winners have emerged and names

were submitted to the appropriate authority by the electoral committee, a Minister from the zone allegedly from overseas called a meeting of few persons and announced to them that he is substituting names of most of the candidates because they were not his choice. “Today, there is no single campaign bill board of President Muhammadu Buhari in the whole of Benue South Senatorial District despite the fact that the Benue South has a cabinet member in person of Chief Audu Ogbe”. The protesters said the attempt to change the names of elected candidates across Benue South may further engender disenchantment among the APC members appealing to the National Working Committee (NWC) to ensure that all those candidates that won the primary elections are allowed to go for the general election as party’s candidates.

Short News No plan to sell Ajaokuta Steel Complex - Osinbajo Mathew Dadiya, Abuja The Presidency has refuted a report that the Federal Government planned to privatize the Ajeokuta Steel Complex to fund the 2018 budget. Vice President Yemi Osinbajo told Governor Bello on Thursday during a closed door meeting in his office at the Presidential Villa, Abuja. The Kogi State Governor told State House correspondents when he came out from the meeting Osinbajo has told him that the Federal Government did not intend to sale the complex. Bello said, “The Vice President, being the Chairman of the National Economic Council (NEC) we came to make some enquiries from him over the purported sale of Ajeokuta Steel Complex and he has indicated that there is nothing like that. “He said there is no plan by the Federal Government to sale Ajeokuta Steel Company. The VP also said Ajeokuta is an asset of the Federal Government and that they are looking into how best to make good use of that particular complex for the benefit of Nigerians at large,”

Gov Okowa calls for sustainable implementation of pension Nosa Akenzua, Asaba Delta State Governor, Senator Dr Ifeanyi Okowa has urged the Federal Government to work out ways for all states of the federation to key into the contributory pension scheme, because of the overall benefits of the scheme to the Nigerian worker. Governor Okowa made the call on Thursday Asaba during the swearing-in ceremony of Mr Ben Igo and Mr Frank Atube as Chairman and Secretary respectively of the Local Government Pensions Bureau. According to the governor, “the Federal Government should look at ways to ensure that all the states of the federation implement the contributory pension scheme; until more states enlist in the pension scheme, we will not have sustainable pension plan for all our workers.” “It is becoming increasingly difficult to administer pension in Nigeria, Delta State has enrolled into the contributory pension scheme and only eight states as at today have enrolled into the scheme, no doubt, the contributory pension scheme comes with a lot of challenges but it is the best for the future of our country and the states,” he stated. Governor Okowa stressed that “the biggest challenge is the payment of the backlog of past services and we need to find ways of settling these payment of past services because, until we do that, many states will not enroll and they will not have sustainable pension scheme for workers.”

‘INEC to upgrade ICT systems for 2019 polls’ System Analyst, Department of ICT/Voters’ Registry, Independent National Electoral Commission (INEC), Ado-Ekiti, Mr Toba Ayeni, says the commission is working on new technologies to guarantee the conduct of credible elections in 2019. Ayeni, in a telephone interview with the News Agency of Nigeria (NAN), on Thursday, said that the technological innovations being adopted by the commission would drastically reduce indices of electoral malpractices. He said that it would also facilitate effective management of the country’s

elections to meet international standard. “There is no gainsaying that technology has drastically reduced incidences of electoral malpractices such as ballot stuffing, result sheet mutilation, manipulations, over voting, alteration of result sheets and hijacking of ballot boxes in the history of elections in Nigeria. “But as the years pass by, INEC gets more sophisticated with its technologies in order to meet up with international standard. “In the case of Ekiti and Osun governorship elections, the rate of

failure was far much less than what was recorded in 2015 general elections. “This is because of the use of upgraded software and hardware systems. “As we progress, we identify some grey areas and make necessary recommendations and based on that the commission is working on new technologies which are yet to be unveiled. “However, between now and January 2019, INEC will unveil the upgraded ICT system that will reduce excessive electoral fraud in the country,’’ Ayeni said.

No fewer than 3,000 Osun residents are to benefit from the Federal Government free Human Immunodeficiency Virus (HIV) and Hepatitis B test. The South-West Coordinator, Nigeria AIDs Indicator and Impact Survey (NAIIS), Dr Olubunmi Ayinde, disclosed this while speaking with newsmen on Thursday in Osogbo. Ayinde said that NAIIS officials would visit 102 selected communities across the 30 Local Government Areas in the state to sensitise them on the need to know their health status. She said that NAIIS would help government to know the number of people living with HIV and Hepatitis B and C in the states and the country at large. Ayinde, who noted that the test would start on Oct. 29, urged residents to cooperate with NAIIS officials, who would be moving from door to door to collect blood sample. “The essence of the test is for individuals to know their HIV status in the comfort zone of their home.

15 corps members get service extension in Nasarawa

The National Youth Service Corps (NYSC) has extended the service year for 15 corps members who served in the 2017 Batch B, Stream one, in Nasarawa State, for various misconducts. NYSC Coordinator in the state, Mrs Zainab Isah, announced this on Thursday after supervising a low-key Passing out Parade (POP) for the corps members in Lafia. Isah said the affected corps members had their service year extended by various periods for contravening the NYSC bye-laws. “Some corps members erred during the service year. “We have 15 corps members that have disciplinary cases. “Some of them missed the monthly allowances because they embarked on unauthorised journeys and others left their places of primary assignment without permission. “The allowances they missed is what will be used to pay them as they serve their punishment and the period of the extension depends on the gravity of the misconduct,’’ She said.

Rule of law mantra and way forward

Femi Falana

Owing to the refusal of the civilian wing of the political class to demilitarize the polity there has been unsettled debate over the primacy of national security over the rule of law. Majority of political office holders in the country are not committed to the observance of the rule of law. In place of the rule of law the political system has enthroned the rule of might or rule of rulers. The debate over the clash between the rule of law and national security has been reopened by President Muhammadu Buhari at this conference when he enjoined Nigerian lawyers and judges to realize that national security takes precedence over national security. A few days before then, the President had threatened to jail looters who had sabotaged the security of the nation by diverting huge funds earmarked for the development of the country. It is implied in the presidential declaration that the alleged looters cannot be jailed without a trial conducted in criminal courts under the rule of law. In striking a balance between national security and rule of law in a democratic setting I intend to review physical security, social security, human rights, the management of national security by security agencies and the subversion of national security by the government. Since State security is often confused with government security it is germane to explain the two concepts. I shall conclude by making a case for the enforcement of the socioeconomic rights of the masses as our country cannot have national security without social security. National Security, Human Rights and Rule of Law On July 17, July 2018, President Muhammadu Buhari had the rare privilege of participating in the activities marking the 20th anniversary of the International Criminal Court. On that auspicious occasion the Nigerian leader assured the international community that “our cooperation with the Court is borne out of our strong belief in the respect for the rule of law and human rights…” On the basis

of such assurance from the President we are compelled to review the disturbing culture of disobeying court orders by officials of the federal and state governments under the current democratic dispensation. I want to believe that the President is not unaware of the respect for human rights is the fundamental basis of a democratic society that is genuinely committed to the consistent implementation of the rule of law. Human rights are indeed the basic building blocks that governments must cultivate in order to have an effective relationship with the general population. The extent that the protection of these rights is guaranteed signifies the democratic strength of a country. Indeed, human rights and the rule of law are crucial to the well being of any truly democratic society. These rights include not only civil and political rights but also economic, social and cultural rights. They are articulated and entrenched in national constitutions and the Charter of the United Nations, the Universal Declaration of Human Rights and other human rights treaties to which Nigeria has subscribed. Balance between short term and long term Second, a balance must be struck between the short term and the long term, and between the interest of the individual and the interest of the community. Electoral politics put pressure on governments to respond quickly to the needs of voters. Nobel laureate Dr. Amartya Sen pointed out that famines in India have become a phenomenon of the colonial past because Indian politicians today know they would be thrown out of office if they did not respond quickly to food shortage. All this is good but the problem with electoral politics is that the time horizon of political leaders shortens and pandering to the demands of special interest groups may be unavoidable. Larger and longer term considerations are often set aside as politician concentrate on winning the next elections. A democratic system which creates a good balance between the short term and the long term, and

between the individual and the community, will be better able to achieve respect for human rights and security. Third, we must protect the rights of minority groups. No country on earth is homogeneous. Nigeria must be very sensitive to the protection of minority rights. Democracy is therefore a means to achieve better governance, never an end in itself. What is important is to put human beings living in communities at the heart of women, children, physically challenged persons and other vulnerable groups in the society. The word ‘demos’ referring to people has as its specific context of people living in community. We associate counting votes with democracy but there are so many ways to structure a voting system which can lead to very different outcomes. Democracy should always be structured to facilitate good governance, never to make it harder. However, as the global environment changes, as technology changes, our system has to evolve in tandem. For example, with the growing number of Nigerians living overseas, we must find ways to enfranchise them. Maintaining a sense of belonging to a larger Nigerian community is essential. Without voters feeling a sense of commitment to one another, a democratic system cannot work well. In summary, the Nigerian government must comply fully with its national and international legal obligations to uphold human rights in all its actions so as to ensure security through the crucial protection of human rights and the rule of law. The government must demonstrate the commitment in deed and not merely in words to respect the rights and freedoms of citizens and to promote human rights. It is absolutely important that any measures limiting human rights are in compliance with international law. The government should re-commit itself to the achievement of the Millennium Development Goals as a means of addressing underdevelopment and preventing the marginalization of many in the country. There is also the need for a strong and effective

mechanism whether within the National Assembly or civil society to oversee executive action, including when they vote on the budget and monitor its implementation, to ensure that a balance is struck between national security, human security and individual freedoms, and to avert any threats to democracy. National security must be reduced to its absolute minimum — what I call a democratic conception of national security. The use of extraordinary measures in the name of national security for any other purpose should therefore be discouraged. Nigeria’s national security institutions must be effectively regulated and made accountable. The government must adopt broad-ranging measures geared to develop an effective institution with an appropriate organizational culture for a democratic society as well as the direct and mandatory involvement of the National Assembly in after-the-fact review. In the final analysis, it is essential to place further legal limitations on government’s use of special national security measures. The abuse of national security For several years after independence the central pillar of Nigerian national security was the safeguarding of the “sovereign, independence and territorial integrity of the State”. A former Inspector-General of Police once stated that “national security entails the measures, facilities and systems put in place by a nation to secure its citizens and resources from danger and the risk of infiltration, sabotage, subversion or theft etc.” But to a group of civil society organizations the term ‘national security’ implies “the absence of threat to life, property and socio-economic wellbeing of the people”. The latter view tallies with Section 14(2)(b) of the 1999 Constitution which states that “the security and welfare of the people shall be the primary purpose of government; and the participation by the people in their government shall be ensured in accordance with the provisions of this Constitution”

Allison Ayida and service to the nation

Eric Teniola

Chief Allison Akene Ayida was born on June 16, 1930. He attended King’s College, Lagos in 1952; Queen’s College, University of Oxford, England in 1956; and the London School of Economics and Political Science, University of London, England, 1957. He was assistant secretary, Federal Ministry of Finance from 1971 to 1975; chairman, UN Commission for Africa; and secretary to the government of the federation and head of Civil Service, 1975-1977. He died on October 12, 2018. He narrated the story of his life in a book titled Rise and Fall of Nigeria published by Malthouse Press Limited, from which the following is excerpted: “I was brought up as an only son by my late parents. One of the virtues you imbibe early without a Big Brother, is the habit of a selfsufficient and independent lone ranger. At 33, I was appointed to act as Permanent Secretary to the Federal Ministry of Economic Development, in 1963. I was the youngest permanent secretary in the Federation. It was part of an experiment to try out the then new breed in the civil service as Permanent Secretaries. I had to look up to senior colleagues such as the late Chief Michael Ani for guidance and leadership. “A month after my retirement, the Head of State, General Olusegun Obasanjo arranged an official send-off luncheon party for my wife and I at Dodan Barracks. On returning home at about 5 p.m., we discovered that NEPA (now Power Holding Corporation of Nigeria) had cut off our light. I know the Cabinet Office had paid all outstanding electricity charges and handed me copies of the receipts and the letter informing NEPA that I will be responsible for payment of my bills henceforth. I was naturally upset. I drove to the house of Mr. Askira, NEPA’s Acting General Manager and, to my surprise, he was equally upset. He jumped into my car and we drove to the local station where there was a long queue of expatriate and Nigerian consumers waiting to show their receipts kept by their employers in the

office or begging for their bills not sent before the mass connection. The station manager was sitting in his air-conditioned room totally unconcerned. Mr. Askira waded through the crowd to get to the manager’s office and demanded to see the special list of VIPs on Victoria Island whose lights should not be disconnected as part of the mass disconnection exercise. The first name on the list was A. A. Ayida. Profuse apologies all round. I had learnt my lesson. Such daily occurrences are part of normal life in Nigeria and I have lived happily thereafter with the reality of Nigerian bureaucratic harassment. “Some of us are often asked what life is like in retirement? When, during the Murtala Mohammad/Obasanjo administration, Permanent Secretaries and other senior officers were invited to declare assets, some of the returns were revealing. There was a Permanent Secretary who had been building his only house in his village for over seven years and the halfcompleted bungalow had been financed from his personal savings. The authorities thought the Permanent Secretary was a joker but there were many others in similar predicament. There are many Permanent Secretaries and BrigadiersGeneral and other senior public officers who, in the Nigeria of today, are losing the battle for survival. Some are living in abject poverty. The pension and retirement benefits cannot sustain the family. The public are frequently misled by the successes or affluence of the few. “In the past, the expectations were different. The senior public officer would, before retirement, probably have been allocated a plot of land in Victoria Island or Ikoyi or the GRA in his home state. The spectrum of beneficiaries in the days of Brigadier Johnson as Military Governor of Lagos state, included Permanent Secretaries and top military officers and civil servants and leading university professors and professionals. On retirement, such officers were appointed to the boards of parastatals by successive

governments. Some took Holy Orders, not the church as one of the few booming businesses in Nigeria today, but as a missionary in the service of humanity. Some became farmers—a risky and costly venture. Others went into general business. But the picture has changed dramatically under the prevailing depressed economic conditions. Most retired officers are now compelled to remain idle and unemployed if under 45, and unemployable if over 50 years of age. It is a sad tale of the inhumanity of power and its corrupting influence and abuse. Permanent retirement sometimes means premature death and misery for those who cannot adjust to the emotional aspects and the psychological impact of retirement from public service or positions of influence or power. Suddenly, you wake up one morning, your free official quarters is gone, your chauffeur-driven car gone, your “friends” and “admirers” disappear and you are left with your family and a few trusted friends who had no access to you when the “palace-seekers” were around. The next Christmas, the cards do not arrive. When eventually you get a telephone in your new residence, it does not ring. No callers. When you get to the airport, you no longer enter the VIP lounge and you do not know how to queue for your ticket or rush for your seat in the plane. No more invitations to state banquets. You are likely to be late for your meetings, if any – driving yourself and finding a parking space. “These are the trappings and paraphernalia of power which many a retired officer cannot forgo. Hence, some functionaries cling to public office at all cost. Those of us who found the ceremonial aspect of public office oppressive, will find relief in life in retirement. You suddenly find you have time for your sporting activities, for developing your hobbies, and for social activities, although the invitations no longer come in the same large number. You feel nearer your God and find time for religious activities. There is temptation for the retired officer to live a life of solitude and self-pity and regret. It is a lonely life at the top,

whether in office or in retirement. That is the price of leadership. My advice to those who are about to retire from public office is that they are being given a chance to start life a second time. This time you have a choice. The quality of your new life should be more important than the material considerations. You may not be a Nairamillionaire but you have a million experiences to sustain your new life which you can live in your own way. “It is not my intention to sound too pedestrian and trivial, but it is important since the order of the day is that no job is permanent and most people now live in fear of retirement, instead of looking forward to a full life of bliss in retirement. Let me reiterate my conviction that given the necessary checks and balances, power without corruption is not a distant dream in the administration of Nigeria polity. It is attainable if we eschew double standards in the system of accountability and dispensation of justice and punishment. “Bureaucratic power…should not be a source of political and economic power and self-enrichment but an opportunity to serve the public and the nation. My hope is that the nation will continue to recognise and accord due respect to those who served in the past and deserve the honour to live and die in decent retirement. “If it is in consolation, life in retirement is not as terrible or miserable and desolate as it sounds, if you have the will to survive and the capacity to adapt to a new life style. There is absolutely no need to provide for the rainy day, while in the service, through the corrupting influence of power and abuse of office. It is morally indefensible. “The incidence of corruption in Nigeria has increased and is still increasing; this must be drastically curtailed. This dream can only become a reality if there is a change of heart in all of us under a new leadership by glaring examples at all levels”.

Editorial Commentary With love, from India

Times Guest Columwnist Azu Ishiekwene

My first instinct when I got the WhatsApp message was to dismiss it as fake news. But I held back because the sender is a serious guy. It was a memo from a certain school in Rajasthan, India, called Amity University. In the three-paragraph memo, the Registrar, Vishwadeepak Singh, a retired military officer, had given students a deadline of August 13, to get boyfriends or girlfriends. “Students caught without boyfriend or girlfriend inside the college after the given date,” the memo said, “shall be fined and action shall be taken against them.” To clear any potential ambiguity about the nature of this mandatory love protocol and perhaps also to help sex-starved students manage their desire, the registrar said each student is only allowed to have one boyfriend or girlfriend. In case the students think it is a joke, the registrar warned that violation would attract a fine of Rs1000 and suspension from school! After reading the memo, which gave students barely one month from the date of signing to comply, I raced to google it from other verifiable sources. I found a news video by ABP, an India Hindi news channel in Noida, which was already racing against its own corporate testosterone by providing wall-to-wall coverage of the story. Love still sells! Could this still be some elaborate hoax? Improbable. It’s already over two months since the protocol was issued and there’s no denial from the school yet. Not on its website. Not anywhere else I have searched so far. Amazing India with its thousand mysteries and grooves of romantic lore. Keep in mind, too, that even as it battles rampant cases of rape, India has been quite busy producing some of the most extraordinary conjugal stories, the latest being the decriminalisation of adultery. On my part, I’ve taken the Amity story by faith. I’ve been trying to find any evidence – at least online – about how the school is implementing the memo and what may have happened to any recalcitrant students in Amity. Or could it be that the school has achieved the sexual equivalent of a perfect market, a place where demand and supply make such a perfect match that there’s no slack left? Whatever it turns out to be, I don’t know of many things, in recent times, that could have made Amity as famous as its mandatory love call. Although the school is touted as one of the best private universities in the northern region of India, not many people knew it existed until Singh’s famous memo went viral. Now the school’s website must be logging tens of hundreds of enquiries by prospective students whose social lives as undergraduates would be a remarkable departure from the drudgery offered in schools elsewhere. The transition from old-fashioned convents and unisex schools to Amity must be one of the most extraordinary social changes in our lifetime. No longer will students have to endure the spells of the emotional trauma that sometimes come between them and the opposite sex that they secretly admire. Sigh’s memo may have finally paved the way to emotional security by offering a cure for

lovesickness. The greenlight for every student to find the opposite sex of their dream is official, and which freshman or woman wouldn’t like a school that has made such generous provisions to accommodate that errant human frailty, making it easier to channel one’s energy for the more productive business of learning? As for the returning students in Amity, I think the Singh memo should serve as a wake-up call. With nearly equal ratio of men to women and given Rajasthan’s largely Hindu population, returning students would do well to take advantage of the memo before the growing gay army from Mumbai reach their shores, especially after the recent Supreme Court ruling upholding gay rights. I think that the biggest lesson from this innovation, however, is what it offers schools elsewhere, especially here in Nigeria. Given the epidemic of sexual harassment currently facing the country’s top universities, if whistle-blowing is number one on the list of reforms required at the universities and institutions of higher learning, then this ingenuous love protocol ought to be number two. Although no empirical studies have yet been carried out, Singh’s memo got me thinking that perhaps one way to tame randy lecturers might be for students to hook up early on. If lecturers – and indeed everyone out there – know that there are no vacancies, then they might think twice before making their ridiculous and unrestrained advances. Not that the irredeemable he-goats among them would be deterred. I’ve heard it said that some of these perverts believe that the greater the obstacle, the sweeter the conquest in the end. But they will at least know that they face a higher risk of exposure since they’ll not only have to contend with their potential prey, but also with their boyfriends and a vigilant school authority as well. Introducing the Singh memo in Nigerian universities might also be like killing two birds with one stone. Apart from helping to tame predatory lecturers, mandatory love call might also drastically reduce the increasing number of the cult gang wars that claim scores of innocent lives in our universities yearly. Many of these needless wars are rooted in unrequited love. To ensure that demand and supply are always at an equilibrium, the Senate of all the universities must ensure that a proportional ratio of both sexes are admitted. They must also ensure that this memo that is now being retroactively applied in Amity is frontloaded in the compulsory section of their future admission forms. This way, the schools can protect themselves from any legal liability and also from busybody NGOs that might wish to undermine such a laudable policy. For now, I’m keeping a very close watch on the news from Amity. I’m deeply heartened that apart from Bollywood, Zee World and medical tourism, India has once again taken the lead in giving the world another incredible social talisman. Amity should prepare for the biggest explosion yet in its student population and Singh could well be in the race for the 2018 World Innovation Prize in social engineering.

OUR POSITION

Brain drain and matters arising

T

he recent report of about 5,405 Nigeriantrained doctors and nurses working in the United Kingdom hospitals represents a frightening dimension of brain drain in the country. Incidentally, the health sector has witnessed increasing migration of the best brain including many medical personnel trooping out of the country in search of greener pastures. This brain-drain in the health sector, which has always existed at some level, has in recent years taken on an alarming turn with the changes in the state of the Nigerian economy. Investigations revealed that Nigerian doctors have been migrating to the United States, Canada, Saudi Arabia, the UK and many other nations across the globe. Relevant medical agencies in Nigeria could not provide official data on emigrant doctors, but figures released in February 2018 by the British government indicate that no fewer than 5,405 Nigerian-trained doctors and nurses are currently working with the British National Health Service (NHS) in the United Kingdom UK. From the statistics, Nigeria has 80,000 registered doctors; more than 50,000 are practicing abroad. 92 percent of Nigerian doctors in Nigeria are considering finding a job abroad and 70 percent of them are making plans to leave for foreign lands and are taking exams to that effect. What this mean is that Nigerian medics constitute 3.9 per cent of the 137,000 foreign staff of 202 nationalities working alongside British doctors and nurses. Nigerians in the diaspora sent home $22 billion in 2017, a 6.4% increase from the amount repatriated in 2016. This makes Nigeria the highest in the SubSaharan region in terms of diaspora remittances and fifth in the world, thus echoing the positive contribution of Nigerians in the diaspora to the Nigerian economy. This trend has been having negative effects on Nigeria’s health sector. As a result of this, experts say that Nigeria is experiencing a shortage of doctors in most of its hospitals. The ratio of medical practitioners to patients in the country is very low. Official records reveal that Nigeria currently has one doctor to attend to 3, 500 patients in the country, which is a far cry to the World Health Organisation (WHO) recommendation of one doctor to 600 patients. Already it takes an old patient two hours and three hours for new patients to see a doctor on the average. It will not be far from the truth to state that the lapses are due to decades of harsh economic policies, which had led to chronically under-funded health systems. There is no gainsaying that the effects of brain drain syndrome in Nigeria’s health sector are devastating. Today, Nigeria’s health system wobbles and the future bleaks even the more, no thanks to the huge challenges this single problem of human capital flight. Nigeria’s health industry is already left in a state of quagmire. The health institutions/facilities have continued to beg for an overall cleansing; this is a necessary antidote without which health care delivery will remain in total disarray. The flight of medical personnel from Nigeria is not unconnected with the prevailing severe economic recession and hyper-inflation, among many others, which has reduced the purchasing power. Many other glaring and remote factors are culpable for the braindrain conundrum. Despite the dearth of personnel in the well-being sector, it is laughable that only less than one-third of the registered Nigerian doctors practice in the country while over two-thirds of the professionals are migrating abroad, solely to earn better wages and

career development. It is simply stating the obvious that the ugly trend has also reduced the number of dynamic and innovative people in the health care sector, which the stakeholders and keen observers believe to be responsible for the medical quackery in the length and breadth of Nigeria. The dilapidated equipment in hospitals and the mismanagement of the little resources, especially in government hospitals is also not helping matters. Most doctors after graduation do not have the basic framework to allow them to do their job properly. There are rare or no opportunity for professional career development and training. Every health worker, other than a doctor, wants medical research and up-to-date clinical knowledge, which are not accessible in Nigeria. We are of the opinion that the Federal Government must do something quickly to stop this brain drain. It is long overdue for Nigeria to develop robust nationalistic policies and programmes that would promote the common good of doctors and prevent brain drain. By doing so, it will create a healthcare system that delivers good outcomes such that no one needs to travel out as the health of the nation is expected to be paramount to the government and the general citizenry. We also submit that real solutions lie in the courage of Federal Government intervention and legislative actions towards developing a holistic package of measures and conducive environment with upgrade of existing medical facilities nationwide. We must change the narrative with maximum opportunities for local training for all medical graduates under satisfactory, attractive terms and conditions of service that will stop the unhealthy and devastating emigration of the best brains in the country.

Short News Court strikes out Sen Omo-Agege contempt suit against Saraki, Senate Nnewi Building collapse: 11 Togolese trapped Andrew Orolua, Abuja Justice Nnamdi Dimgba of the Federal High Court, Abuja, on Thursday struck out a fresh suit filed by Senator Ovie Omo-Agege, Delta Central seeking to commit the Senate President, Dr Bukola Saraki, to prison over refusal to pay salaries and allowances. The judge struck out the motion following the confirmation that the outstanding salaries and allowances have been settled fully by the Senate. Counsel to Omo-Agege, Dr Alex Izinyon (SAN), who confirmed the settlement of the salaries and allowances subsequently applied for the withdrawal of the contempt charge filed against Saraki. Izinyon praised the leadership of the Senate for the respect shown to the rule of law with the prompt payment of his

client entitlement. He said, “The Court on October 11 granted adjournment for definite hearing of committal proceedings and ordered that the processes be served on the respondents. “Last Friday at about 2pm one of the special assistants to the Senate President said the cheques were ready, he came with 9 cheques which I acknowledged and gave to my client, who informed me that there was a shortfall of about N6m”. Izinyon however told the court that the Senate after admitting that the shortfall was occasioned by an error, have made the payment in full to his client. He said although the Senate had joined issues with his client by filing counter affidavit, he however told the judge that since the issue in dispute has been resolved there was no need for parties to dissipate energy on a settled

matter. Efut Okoi, Counsel to Saraki, told the court that his client as a law abiding citizen effected the payment of the salaries and allowances in compliance with the order of the court and urged others to emulate the gesture. He however did not oppose the application for withdrawal of the contempt charge. Justice Dimgba, accordingly struck out the motion dated August 15, seeking to commit Saraki to prison over refusal to pay Omo-Agege his entitlement. Senator Omo-Agege, Delta-Central senatorial district at the National Assembly had initiated the committal proceedings against Saraki, praying the court to send the Senate President to prison for allegedly flouting the May 10 judgment of the court which had voided his 90 suspension by the Senate and restored his entitlements.

2019: Atiku can’t beat Buhari – Tony Momoh

L-R: President Muhammadu Buhari and Ambassador of Turkey, H.E. Mr Ahmat Melih Ulueren, during the envoy’s presentation of letter of credence to Buhari at the State House, Abuja... on Thursday.

2019: Journalists tasked not to overheat the polity Yakubu Salisu, Kano The International Press Centre (IPC) has charged Journalists not to overheat the polity as the country gears up to the 2019 general elections. The group made the call during a two-day capacity building workshop for political correspondents which aimed at equipping reporters with necessary skills needed for objective reporting in the forthcoming elections. The Director, IPC, Lare Arogundade, said that, the call became pertinent considering the role the media plays in the politics of the country. According to him, reporters, if not properly trained could end up heating up the polity through unverified reports, being partisan or sentimental in their reports hence, the need for such training which aims at reminding and introducing new professional ways of

reporting electoral processes to reporters. Speaking at the workshop, Dr Ruqayyah Aliyu, Department of Information and Media Studies, Bayero University, Kano, described politics as conflict of interest. According to her, most crises or conflicts resulting from political processes, often start way back before elections. “We cannot separate politics from conflicts as Politics itself, is best described as conflict of interest. “It’s either about someone struggling to remain in power or someone trying to takeover one’s political seat. “The process is usually characterized by series of crisis in our society which we must rise to put an end to or reduce to the barest Minimum through the media” Ruqayyah, also charge reporters to adopt professional ethics while reporting and avoid propagating hate speech, and publish only news worthy of publication not just for his or her immediate locality,

but the nation and world at large. To address the menace of political conflicts, she opined that, political reporters must be responsive in engaging in intensive voter education by sensitising the member of the public particularly on the consequences of election violence. Furthermore, participants at the workshop were also trained on how to use modern social apps in the cause of their reportage to meet up with the modern ways of filing in their reports. Mr Taiwo Obe, Founder, Journalism Clinic, said that, to be current, reporters need to use social media apps as added advantages rather than seeing such apps as threats to their profession. He added that, although, the social media is full of fake and unverifiable news items, there are various means of verifying and confirming such news by contacting verifiable persons or authenticated accounts before rebroadcasting such news.

A former Minister of Information, Chief Tony Momoh, on Thursday said he was confident President Muhammadu Buhari would win the 2019 presidential election. Momoh told the News Agency of Nigeria (NAN) on telephone that the president had done his best as leader to deserve re-election. He said the candidate of the People’s Democratic Party (PDP), Alhaji Atiku Abubakar, could not stop Buhari as he (Abubakar) was only popular with the elite and not the masses. Momoh, a chieftain of the All Progressives Congress (APC), said the Buhari administration had impacted on many ordinary Nigerians, and they would vote him in 2019. He, however, said Buhari would lose some votes in the North because Atiku is from the region, but that the APC candidate would make up in other regions to be able to win. “I don’t think Atiku can defeat Buhari. No, he can’t, Buhari has done well in the delivery of his electoral promises and he will get the support of the people. “Look at the war against insurgency for instance, has he not done well? Is the situation in the North East as it used to be? Of course there is relative security in the region and the people will want to vote for an administration that made that possible.

Flood: Rivers community leader begs FG for long-term remedy for Niger Delta A Paramount ruler in Rivers, King Bubaraye Dakolo of Ekpetiama Kingdom in Kalokuma/Opukuma Local Government Area of Bayelsa, has appealed to the Federal Government to urgently find a long-term solution to the perennial flooding in the Niger Delta region. Dakolo, made the assertion in an interview with journalists on Thursday in Port Harcourt, said the people’s suffering was so much that some had resort to sleeping on treetops with no hope as regards who would ameliorate their situation. Describing the recent flood disaster that ravaged Bayelsa and its environs as worrisome, Dakolo said that shore protection, regular dredging of existing canals and consistent dredging of the River Niger were key to tackling the challenge of flood in the region. “I think the Federal Government should set aside an intervention fund that would specifically carter for shore protection to check overflow of the water bodies as most perennial flooding in the region were attributed to overflow of the rivers,” he said. Dakolo said that having suffered the 2012 flood crises, it was expected that the government should have embarked on a long-term mechanism to guard against a recurrence. “It’s disheartening that after the horrible flood experienced in 2012, the Federal Government has yet to ensure adequate long-term measures to forestall further disaster,” he said.

NNPC absolves self over Abia oil pipeline explosion The Nigerian National Petroleum Corporation (NNPC) has refuted the allegation that negligence on its part caused the oil pipeline fire incident last week Friday in Umuaduru and Umuimo communities in Osisioma Ngwa Local Government Area of Abia State. A release by the NNPC Group General Manager, Group Public Affairs Division, Mr. Ndu Ughamadu, yesterday in Abuja, affirmed that the incident was triggered off by suspected oil thieves who had hacked into System 2E pipeline network of the corporation with a view to intercepting the flow of petrol from Port Harcourt to Aba. Ughamadu said the clarification became necessary in view of the recent statement by a legislator indicting NNPC on the fire outbreak which had claimed lives and valuable properties. The NNPC spokesperson explained that the presence of items such as jerrycans, among others, at the scene of the incident as contained in the preliminary report on the matter indicated that the activities of vandals in the area ignited the flame. He regretted that incessant vandalism of pipeline facilities along System 2Ex Pipeline Right of Way (PROW) has led to the underutilization of the Enugu Depot, saying that the breaches have prevented the corporation from pumping fuel into it. He called on relevant government agencies to collaborate with the corporation to appropriately criminalize vandalism of oil facilities across the country, adding that host communities should also partner the NNPC to tame the scourge.

Reconstitute Osun governorship electoral tribunal, PDP demands Tunde Opalana, Abuja The Peoples Democratic Party (PDP) has demanded the immediate reconstitution of the Osun State governorship election petition tribunal, as further delay will jeopardize the course of justice in the matter. The party flayed the disbanding of the panel by the President of the Court of Appeal, Justice Zainab Bulkachwa, a development which PDP said will send a very bad signal on the integrity of the judiciary, if not quickly addressed. PDP’s national publicity secretary, Kola Ologbondiyan, said the party’s position is predicated on reports that the All Progressives Congress (APC) has been mounting pressure on the judiciary to deny the PDP justice in the determination of the Osun Governorship election dispute at the tribunal. In an efforts to lawfully reclaim mandate, the party said it filed a petition on Tuesday October 15,

2018 in accordance with section 285 (6) of the 1999 Constitution (as amended) which prescribed that judgment must be delivered on or before 180 days. “While the Independent National Electoral Commission (INEC) was served, the APC and its candidate evaded service. Consequently, the PDP on Wednesday, October 17, 2018 applied for substituted service, which was slated for hearing today, Thursday, October 18, 2018, only to be informed that the panel has been disbanded on Wednesday without any reason and without providing a new panel to hear our matter. “The President of the Court of Appeal should note that her disbanding of the panel without setting up a new one, goes to a deliberate attempt to prevent the PDP from serving the APC and its candidate and to meet the constitutional 180 days timeframe for the determination of the case at the Tribunal. “Election petition matters are sui generis, with specific timeframe allotted to various stages, up to

the final determination. The failure to set up a new panel to hear our application for substituted service on APC and its candidate smacks of a shenanigan to deny our party full justice in the matter”, said Ologbondiyan The party claimed that the original panel was disbanded after the APC and its candidate had failed to manipulate and compromise the members to frustrate our case. It therefore urged the President of the Court of Appeal “not to bend to the proclivities of the APC and its candidate to bring the vouched reputation of the judiciary into a shameful disrepute, in their desperation to hold onto a stolen mandate. “It is also imperative to state that the 2018 Osun Governorship election has become the interest of not only Nigerians but also the global community. As such, every institution that has a role in ensuring fairness and justice, particularly, the judiciary, must rise to its responsibility and not succumb to unlawful and antipeople predilections”.

Court grants Shittu’s prayer to serve NYSC processes The Federal High Court in Ibadan, on Thursday, granted the application of the Minister of Communications, Adebayo Shittu, to serve originating summons on the National Youth Service Corps (NYSC) in Abuja. Shittu had in the last few weeks been confronted with criticisms for not observing the mandatory one-year national youth service. Justice P.I. Ajoku ruled that the service of the originating summons be served on the respondents through the bailiffs of the court. “The service of the plaintiff’s processes on the first, third and fourth defendants who are in Abuja shall be effected by the bailiffs of this honourable court,” the judge ruled. The judge, however, adjourned the case till Nov. 19 for report of service. The suit has the Director-General, NYSC; the State Coordinator, NYSC; the NYSC and the Attorney-General of the Federation as the first, second, third and fourth defendants respectively. Earlier, Mr Muktar Aderogba, counsel to the plaintiff, prayed the court to issue and serve the originating summons and the accompanying processes in the suit on the address of NYSC office in Abuja. Aderogba added that he relied on the 12-paragraph affidavit and the written address supplied in support of his application.

No work, no pay policy: FG, Labour in fresh minimum wage controversy Joy Obakeye The Federal Government on Thursday disagreed with the Nigerian Labour Congress (NLC) over the new minimum wage demanded by workers in the country. The disagreement was a result of the twist in the lingering controversy, as the government said it would implement the ‘no work no pay’ policy. Director of Trade Union Services at the Ministry of Labour, Mrs Omabie Akpan, and NLC President, Mr Ayuba Wabba, spoke on the matter when they appeared on Sunrise Daily, a Channels

Television’s breakfast show. Following the impasse in the new minimum wage, Mrs Akpan insisted that the government would implement the “no work, no pay policy.” “They (Federal Government) are just implementing the policy now, the policy has been in existence since 2004,” she said. “Government is trying to bring to the attention of the workforce the fact that there exists such a provision in the Trade Dispute Act so that they will abide by the provisions of the law.” According to the government official, it is wrong for labour leaders to embark on an industrial action while negotiations

are ongoing. NLC President, Ayuba Wabba, and the Director of Trade Union Services, Ministry of Labour, Mrs Omabie Akpan. Mr Wabba, however, gave a different opinion, arguing that it was the fundamental right of workers to proceed on strike as enshrined in the labour laws. He stressed that the rights of the Nigerian workers must be protected, as they are what separate them from slaves. “The rights to strike is a core trade union and human rights and that is why our laws recognise the rights of a worker to a strike,” the NLC president said. “That is what differentiates a slave from a worker. A worker can exercise

that right that is provided in our law.” He added, “Section 41 of the Trade Dispute Act provided condition precedent for a worker that is working on areas that are dangerous to proceed on strike by issuing a 15-day notice.” The disagreement between the government and the labour body comes three weeks after the organised labour called off the nationwide strike it embarked upon in September. Wabba explained that the industrial action was due to the refusal of the government to reconvene the meeting of the Tripartite Committee to enable it to conclude its work on the new national minimum wage demanded by workers.

How operational expenses push Lafarge Africa to N10.37bn loss in Q3 Motolani Oseni Due to an increased in cost of sales and total operating expenses for the period ended September 30, 2018, Lafarge Africa Plc has reported a whopping N10.37 billion loss in its unaudited financial statements released on Thursday. The Cement manufacturing company had reported N937.9 million profit after tax in nine months results ended September 30, 2017. Despite reporting 4.7 per cent increase in revenue to N234.3 billion in nine months ended September 30,208, the 7.5 per cent and 26 per cent increase in cost of sales and total operating expenses erode the company’s overall performance in the period under review. As cost of sales closed the period under review at N178 billion from N165.7 billion in nine months

ended September 30,2017, total operating expenses moved from N29 billion in nine months of 2017 to N36.96 billion in nine months ended September 30,2018. InvestmentOne Research, said the nine months results posted by the company on Wednesday was not a surprise, as consequent of its surging net finance cost. According to the Lagos based company report, Lafarge Africa top line performance may have been waned as a result of seasonality in Nigeria on a quarter-on-quarter basis. “Looking at the nine months 2018 performance, the company reported a revenue of N234 billion, showing a 4.75 per cent increase. “The positive performance was mainly driven by strong volume growth in Nigeria and favourable pricing trends in South Africa. However, the 195basis points y/y decline in gross profit margin performance to 23.94 per cent was driven by a 64 per cent y/y rise

in raw materials to N36.9 billion. “In terms of bottom-line performance, the company recorded a negative profit before tax margin of 6.13per cent owing to the disturbing level of net finance expense (N33.48 billion, nine months of 2018) which completely eroded the company’s EBIT of N19.13billion in nine months of 2018. “Overall, the results were headlined by increased in finance cost, revival in South Africa operations as well as effective cost management. Going forward we expect that prices to be stable in the Nigeria market while the potential increase in government capital expenditure may be supportive of top line. We expect to see a better revenue performance in Q4 2018 vs Q3 2018 as the federal government has recently released about N460 billion for CAPEX. We also point that, the cement company has commissioned a new grinding station in Ghana with a capacity of 600KT, we believe this may bode for top line performance in the long run.

Designate Delta ports export zone, Reps charge FG Henry Omunu, Abuja The member representing Warri Federal Constituency in the House of Representatives, Rep. Daniel Reyenieju has charged the federal government to designate the four ports in Delta state as export terminals to reduce the overdependence and congestion on the Apapa port in Lagos. Rep. Reyenieju said that Delta state is the only state in this country that has four ports located in Warri, Sapele, Koko and Burutu. Although, he commended the government for dredging the Escravos bald mouth to open up the channel

for ships, but said the government must leverage on the ongoing dredging by ensuring that the ports are put to maximum utilization. “There is the need for us to also make sure that the port becomes very effective after the dredging because we are not going to spend about N13billion to dredge a place and at the end of the day the place is not going to be put into proper use. “What do we need to do to get the four ports in Delta functional; most especially the Warri port which was built in the 80s and in 2011 was designated as an export processing zone? “What I am calling the federal government to do as a matter of policy has nothing to do with laws; it is just operational policy of the Ministry of Transport and the

Nigerian Ports Authority is to designate the Delta ports as an export zone or export destination”, Rep. Reyeneiju added. According to him, whatever that needs to be exported out of the country should go through that corridor while whatever that needs to be imported can come in through the Lagos port or any other port. “Why I say this is for us not to dredge and at the end of the day the place is not put to use, which would not in any way help our nation. “In doing this, it would generate employment for the locals; it would improve the economy of the local community and equally generate revenue for the federation. “It is another way to make the ports viable”, he stated.

Don’t reckon with fraudsters, Igbo APC leaders in Lagos counsels party stakeholders Stories by Patrick Okohue Piqued by what they described as repeated attempt to siphon the common good of Igbos in Lagos State, the Igbo Leaders in All Progressives Congress (APC) in the state have called on the party’s stakeholders to discountenance alleged Igbo interlopers any reckoning ahead of 2019 general elections. The Apex leader of the group who is also the APC’s Publicity Secretary in Lagos State Mr Joe Igbokwe echoed their stance at a Press Conference held in Lagos, to officially Institute a leadership structure for the Igbos in the state. According to Igbokwe, there was an urgent need to speak with one voice and ensure that a formidable front exist for the Igbo descents, who are loyal to APC and have carved a niche for themselves in the state, rather than have some opportunist who often position themselves to reap from where they have not sown in time past. “We have succeeded in putting this leadership structure together in order to present a united Igbo family to the leadership of APC Lagos for the good of the Commonwealth.

“It has become imperative to do this in order to refurbish, reposition, reorganise and rejig Igbo in Lagos politics. “This is because we have noticed that all manner of people gather themselves every election year and go to extort money from the state, promising to deliver Igbo votes to our party in Lagos. “Over the years we have noticed that these people are funny characters, fraudsters, interlopers and political entrepreneurs whose aim is to make money and nothing more. “They go to swindle our leaders every election year. While they enjoy their loot every election year, the real people that work and vote for our party are left with nothing. While the real party men and women work tirelessly to lift our party up, these political traders abandon their shops to reap where they did not sow,” Igbokwe reiterates. He also noted that the National Leader of the APC, Asiwaju Bola Ahmed Tinubu as well as the Lagos gubernatorial candidate of the party, Mr Jide Sanwo-olu and the party’s chairman, Alhaji Tunde Balogun have been informed about their stance.

Group hails ex-Niger Delta militants’ support for Buhari re-election The Buhari Media Organisation (BMO) has hailed former Niger Delta militants for its decision to work for the victory of President Muhammadu Buhari in the 2019 election. The ex-militants, under the aegis of the Coalition of Progressive Niger Delta Ex-militants (CPNDE) had said in a statement that their decision to support Buhari’s second term bid was based on his efforts at deepening peace and stability in the Niger Delta; by initiating meaningful projects and enhancement of human capital development through the Presidential Amnesty Programme. “We are resolute in our decision to ensure victory for Buhari in the Niger Delta, in the 2019 presidential election. Towards this end, we have commenced consultative meetings to forge a common front. The CPNDE, comprising several, genuine camp leaders, and their foot soldiers, affirm our unwavering support for President Buhari,” the ex-militants added. While hailing the ex-militants’ stance, BMO, in a statement by its Chairman, Niyi Akinsiju and Secretary, Cassidy Madueke said it is a confirmation of Buhari’s disposition to meaningful, life-changing projects

in the country’s oil producing region. It noted that the ex-agitators cited deepening peace in the Niger Delta as a major reason they were backing the President’s re-election bid. “We are elated that a critical segment of the population of the Niger Delta region is keen on ensuring continuity of the new lease on life that President Buhari is introducing into the area. “Members of the Coalition of Progressive Niger Delta ex-militants are indeed patriots who have seen the sincerity of the administration in making life meaningful in the region,” BMO said. The group also assured the ex- agitators that the improved infrastructure in the area would be nothing compared to what they would see on ground during President Buhari’s second term. “From regular seamless payment of amnesty dues, to improving infrastructure even in Otuoke, the region is in for a wonderful time.” It consequently urged CPNDE not to waiver in its determination to work for the President’s victory in a region that the Peoples Democratic Party considers its stronghold in spite of not doing much for it in 16 years.

“We are therefore asking the APC leaders in Lagos to see this body as the final bus stop for the Igbo in APC Lagos. It is our wish that henceforth, all matters pertaining to Ndigbo in APC Lagos will be routed through this body. On our own, we promise to provide required leadership, carry everybody along, be fair to

all concerned, show commitment and finally mobilise our people for victory. The list of Igbo Leaders in APC Lagos State, are stated as follows; Engineer Joe Igbokwe, Barrister Oby Onu, Hon. Jude Idimogu FCA, Chief Chris Ekwilo JP (Representing Anambra), Eze Uche Dimgba

(Ezeigbo Ikeja) (Representing Abia State),Eze Nwachukwu (Ezeigbo Lagos),Chief Baba Tata (Representing Imo State),Dr. Engineer Mordi (Representing Igbo Speaking people of Delta State),Mr. James Uche Ugwu(Representing Enugu State), Hon.Unya Smart(Representing Ebonyi State).

CACOL asks Fayemi to declare assets publicly, reposition Ekiti The Centre for AntiCorruption and Open Leadership (CACOL(, has congratulated the new Ekiti State Governor, Dr Olukayode John Fayemi, and lauded his off-the-ground action immediately after he assumed office, but has however requested that he declares his assets and those of his deputy, publicly as he did during his first term in office. In a press statement by the antigraft organisation’s Coordinator of Media and Publications, Adegboyega Otunuga, on behalf of the Executive Chairman, Mr. Debo Adeniran, he noted that, “His Excellency, Dr. Kayode Fayemi, after his swearing-in ceremony on Wednesday, October 17, 2018, immediately sprang into action by announcing a ‘free education programme’ for all pupils in the state-owned primary schools up to junior secondary school. “This is a laudable step, considering the fact that education is one cardinal area the people of the state has consistently prided itself in, aside from the global avowal of the benefits accruable to any government, with an educated populace. “However, for this and many other economic programmes he as the governor, may want to implement to make his second coming memorable and noteworthy, he, like Caesar’s wife must come to equity with clean hands by declaring all his assets and those of his deputy, publicly. “We would recollect that since he left the saddle in Ekiti State, between 2010 and 2014, he had gone ahead to serve as the Federal Minister of Solid Minerals Development under the Muhammadu Buhari’s government. “Suffice it to mention that we are not asking him to do anything novel as he actually declared his assets in his first coming as the Executive governor of the state, even though he could not declare his assets when he was leaving as we would have preferred. Aside from his pedigree that such declaration tends to preserve, it would serve as a baseline to hold other office holders by and

Fayemi

this could be better appreciated if we consider his antecedents as a prominent Rights Crusader and Civil Society advocate. “Our position remains that the course of leadership deficit that has afflicted the nation for so long and our resolve to roll it back, would be better served if he could start on this promising note of accountability. The CACOL boss adds, “We also note the factsheet of Ekiti State as one of few ‘Economic basket case’ of the nation. This is with an annual budget of USD300mn (Three Hundred American Dollars) with a two-third recurrent expenditure gulping the entire amount while a paltry one third of the capital is meant for Capital spending. The federal allocation to Ekiti State in a year, is mere USD110mn (One Hundred and Ten Million Dollars) while its Internally Generated Revenue (IGR) in 2017, was a paltry USD13.4mn (Thirteen Million, Four Hundred Thousand

American Dollars) thus, leaving the state with an urgent need of over Two Hundred Million American Dollars, just to stay afloat. “The essence of this statistical breakdown is to vividly make it clear that unlike the Free Education programme of the Obafemi Awolowo era, the population explosion now would very soon show to the governor that the number of school children in Ekiti State alone today would be almost same figure of entire school children in the defunct Western state, if not more. “While embarking on such populist and laudable programmes may not be outrightly suspect, it is clearly inevitable that Governor Kayode Fayemi, would do well to appreciate the need to diversify the economic base of a parlous economy like that of Ekiti kete and covet the wisdom of biblical Solomon to make the state become viable and its economy a sustainable one.”

Nigeria’s Aruna Quadri hits France for 2018 ITTF World Cup

After leading Portugal’s Sporting to their first win of the 2018/2019 European Table Tennis Union (ETTU) Champions League, Africa’s sole representative at the 2018 ITTF World Cup, Nigeria’s Aruna Quadri has arrived Paris, France, in readiness for the threeday tournament which serves off on Friday October 19. The $250,000 prize money championship will have 20 best players in the world competing to share from the prize money and also amass ranking points. Quadri, who made the final cut based on his world ranking, will start

his campaign from the first round where 12 players will be drawn into foure groups of three players in each group. The top two players in each group join the already seeded eight players to compete in the knockout round on October 20, while the final holds on October 21. The 2018 ITTF African Champion was in high spirit for the tournament and he is eager to reenact the feat that saw him becoming the first African to make it to the quarterfinal stage of the championship with his superlative outing at the 2014 edition in Dusseldorf, Germany. A determined Quadri said he is

looking forward to a good draw with the aim of advancing to the knockout round. “I am here to perform like every other player and I am in good shape after the last weekend’s win in the Champions League. Every player competing in the World Cup, are potential champions and I am looking forward to give my best again and hope for the best against the best in the world,” Aruna Quadri said. The draws for the first round of the World Cup holds on Thursday October 18 at the Disney Event Arena in Chessy, a suburb in the east of Paris, France.

Francis Uzoho: South Africa won’t be easy Super Eagles goalkeeper Francis Uzoho has admitted that next month’s 2019 Africa Cup of Nations qualifier against the Bafana Bafana of South Africa in Johannesburg will not be an easy game, but assures that he and teammates will play the crucial match with the seriousness it deserves. Nigeria face South Africa on November 17 in a matchday-5 clash in Johannesburg in continuation of the Group E hostilities. Uzoho who has made just one appearance for his Spanish second division side, Elche since he joined the club this summer, assures that the three time African champions won’t underrate the Stuart Baxter’s side despite moving top of group E following their back to back victories over Libya. “Personally, the match in Tunisia was more difficult than the one in Uyo,” said Uzoho during an interview with the

media after the game. “The weather was different and it was a much smaller pitch than what we have in Uyo. And so we did not have enough space to run at the Libyan defence in Tunisia, and they were able to somehow contain us. “The Eagles will take the game against South Africa very seriously because we have never underrated any team we have come up against,” Uzoho assured. “We know it won’t be an easy game.” Nigeria top the Group E with nine points from four games. They are one point ahead of South Africa into the much-anticipated clash. Libya are third with four points from four games while Seychelles are bottom with one point. A draw against South Africa will see Nigeria qualify for the 2019 AFCON after missing the previous two editions.

Rohr for Wednesday’s Aiteo Cup final Kano Pillars against Enugu Rangers Super Eagles coach Gernot Rohr will be in the stands on Wednesday when Kano Pillars take on Enugu Rangers in the final of this year’s Aiteo Cup. Rohr himself confirmed to SCORENigeria he will be at the cup final. The Eagles coach has widely been criticised for overlooking players from the domestic league, preferring to work with players based overseas. Eagles A Point Away From 2019 AFCON – Rohr However, he has maintained that the country’s best players do not play locally. The final will be staged at the Stephen Keshi Stadium in Asaba.

The cup winners will represent Nigeria in next year’s CAF Confederation Cup.

Gernot Rohr: Super Eagles won’t miss Wilfred Ndidi against Bafana Bafana Leicester City midfielder Wilfred Ndidi will not be hugely missed when Nigeria take on Bafana Bafana of South Africa in the next match of the 2019 Africa Cup of Nations qualifier in Johannesburg, according to Super Eagles coach Gernot Rohr. Ndidi got his second yellow card of the campaign Tuesday night in Sfax, where the Eagles defeated Libya 3-2 to go top of the Group E log, and that automatically disqualifies him for the next game against South Africa. Rohr however remains confident that either John Ogu or Ogenyi Onazi can fill the void created the disqualification of the 21 year old midfield star. “My team will cope without Ndidi. We have others like Ogu John who can play there and then Onazi too who can also play there. We will cope without him,” Rohr told a section of the media in Sfax. Ndidi has played in all four games for Nigeria during the 2019 Africa Cup of Nations qualifiers. The Super Eagles lost 2-0 to Bafana Bafana in their first leg matcj in Uyo and will be aiming to avenge their

home defeat in the November 17 reverse fixture. Goals from Tokelo Rantie and Percy Tau handed Rohr his first home defeat as Super Eagles boss.

Iwobi permanent solution to Super Eagles lack of creativity – Christian Chukwu Arsenal star Alex Iwobi could be the permanent solution to the Super Eagles lack of creativity in the midfield after he shone in the 2019 AFCON double header against Libya, according to former Nigeria coach Christian Chukwu. Iwobi was played in central midfield against Libya in the absence of captain Mikel Obi, he was influential in the 4-0 win in Uyo and also held his own in the 3-2 victory in Tunisia. He has previously played on the left wing of the Eagles. “Iwobi is a young player who could

be the permanent solution to our problem in the midfield,” remarked Chukwu. “He should continue to work hard so that he could take over the position completely.” Iwobi Earns Rohr Praise An impressed Gernot Rohr described the Eagles midfield led by Iwobi as “brilliant” after the big win in Uyo. “Iwobi in this central (midfield) position is interesting,” commented the Eagles coach. “He can deliver decisive passes and he can also score goals.”
