‘A’Court declines order restraining CCT’ Continued from page 1 alleged misconduct. The ruling of the Court of Appeal followed an appeal marked CA/A/44C/2019 filed by Justice Walter Onnoghen challenging the January 14 decision of the Code of Conduct Tribunal to hear today the two following applications. First, the application filed by the Federal Government seeking an order directing the CJN Onnoghen to vacate his office and directing President Muhammadu Buhari to appoint the next most senior Supreme Court Justice as the acting Chief Justice of Nigeria pending Onnoghen’s trial. The second an application and filed by Justice Onnoghen challenging the jurisdiction of the tribunal to try him. Ruling on the submissions made by Adegboyanga Awomolo (SAN), who represented Justice Onnoghen at the Court of Appeal and the Director of Civil Litigation Federal Ministry of Justice, Emmanuel Omonowa, counsel for the Federal Government on Monday, presiding Justice Abdul Aboki noted that the application before the court is seeking for an order to stay proceeding. “We have carefully reviewed it and we are of the view that no order should be made. The matter is hereby adjourned to 24 for hearing.” The two other justices on the panel, Justices Stephen Adah and P. O. Ige, agreed with the ruling. Earlier when the matter was called, Awomolo had told the court he would abandon his exparte motion since the representative of the Federal Government was in court. He said that all processes on motion on notice have been served on respondent. Omonowa in his reply informed that he was served on Friday but became aware of it today (Monday). He said that he needs three days to respond. He said that the request for Court of Appeal order was not necessary because three separate Courts Federal High Court and National Industrial Court had on January 14 made similar order restraining the Code of Conduct Tribunal from proceeding
with the matter. Federal Capital Territory High Court also made a similar order on January 15. Awomolo, SAN, did not oppose the request for a short adjournment but he asked the court “to make a preservative order because the Code of Conduct Tribunal had scheduled to hear the two applications today (Tuesday) thus destroying the matter.” In related development on Monday, the National Industrial Court reaffirmed its earlier order restraining the Code of Conduct Tribunal from going ahead with the trial of the CJN and adjourned hearing to January 30, to enable the plaintiff serve some of the respondents. Meanwhile, another Federal High Court Judge, sitting in Abuja, Justice I.E. Ekwo, on Monday, issued an order directing President Muhammadu Buhari, Attorney General of the Federation, Justice Walter Onnoghen, Justice Ibrahim Tanko, Code of Conduct Bureau and Chairman, Code of Conduct Tribunal to maintain status quo, pending the determination of a fresh suit on the matter. Action Peoples Party, the plaintiff to the suit marked FHC/ ABJ/ CS 67/2019, had asked the court for an order restraining the respondent from appointing Justice Ibrahim Tanko as the acting Chief Justice of Nigeria. But ahead of the scheduled resumption of proceedings at the Code of Conduct Tribunal (CCT) today, the Nigerian Bar Association (NBA) has called on the Federal Government to immediately discontinue with the trial of Justice Walter Onnoghen, the Chief Justice of Nigeria. “Now that it is obvious that the immediate goal of the Executive is to remove the CJN from office, we urge the Government to follow due process in attaining that goal”, the NBA stated. In a statement signed by its president, Paul Usoro, SAN, the association called on the Federal Government to desist from desecrating the justice sector as well as its sponsored media trial which according to them is criminally destroying the nation’s Judiciary. Citing 292(1)(a)(i) the
NBA said: “A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances in the case of . . . Chief Justice of Nigeria . . . by the President acting on an address supported by two-thirds majority of the Senate.” “The Constitution leaves no room howsoever for the removal of the CJN from office, whether on a temporary or permanent basis, other than through the process aforequoted. Being a country governed by laws, the Federal Government of Nigeria owes us a duty to comply strictly with these provisions of the Constitution for the removal of the CJN. “We therefore urge the Executive Branch of the Federal Government to please retrace its steps and discontinue the entire proceedings before the CCT forthwith and follow the constitutional procedure aforestipulated. “As for the trial of the CJN before the CCT on the assets’ declaration charge, the NBA stands by its Statement of 12 January 2019. Established judicial precedents, dictate that the allegations must be referred to and handled by the National Judicial Council (“NJC”) and it is only after the NJC’s pronouncement thereon against the CJN can the FGN prosecuting agencies proceed against him before any Tribunal or Court of Law. “For as long as the CJN remains a judicial officer, that process avails him and is mandatory of compliance by the FGN. Should the Federal Government however succeed in removing Honorable Mr. Justice Walter S N Onnoghen, GCON as the CJN pursuant to the provisions of Section 292(1)(a)(i) of the Constitution, there would be no need or requirement for the FGN to fulfill the NJC pre-condition ahead of his possible prosecution. With such a constitutional removal from office, Onnoghen CJN would cease to be a judicial officer and the allegations against him would not need to be determined by the NJC ahead of any possible prosecution”, the statement added.

The Federal Government and the opposition Peoples Democratic Party (PDP) sharply disagreed over the veracity of the alleged plot to truncate the forthcoming general election which begins in few weeks’ time. The Federal Government on Monday said it is in possession of credible intelligence confirming that opposition politicians are orchestrating widespread violence to truncate the forthcoming general election. Minister of Information and Culture, Alhaji Lai Mohammed, made the allegation at a world press conference he addressed on behalf of the government in Abuja on Monday. ‘‘As you are aware, Nigeria goes to the polls just 27 days from now. ‘‘However, the Federal Government is in possession of credible intelligence to the effect that widespread violence being orchestrated by the opposition is threatening the 2019 general elections,’’ he said. On the reasons for the plot, the minister said the opposition politicians, having realised that their fortunes had dwindled ahead of the polls, were orchestrating widespread violence with a view to truncating the elections. ‘‘You have definitely seen the massive and warm reception that President Muhammadu Buhari has been receiving across the country, compared to the thinning crowds that have been attending the opposition rallies. ‘‘The desperate opposition is orchestrating widespread violence with a view to truncating the elections, thus triggering a constitutional crisis that could snowball into the establishment of an interim government,’’ he said. Mohammed buttressed the Federal Government’s claims and allegation against the opposition politicians to justify that the government was not just crying wolf. He said: ‘‘We have credible intelligence that bandits and Boko Haram insurgents have been mobilised to engage in massive attacks and other acts of violence in several states across the country. ‘‘The states include Adamawa, Bauchi, Borno, Benue, Kano, Kaduna, Nasarawa, Plateau, Taraba and Zamfara. ‘‘The Benue-based armed criminal group, led by Terwase AKWAZA, also known as Gana, has been commissioned to strike soft targets in Benue, Nasarawa, and Taraba states. ‘‘In Kano State, a group of notorious miscreants have been mobilised by some prominent opposition leaders to provoke massive chaos before, during and after the elections.’’
He added that there was also an international dimension to the evil plan. ‘‘Some armed mercenaries from Niger Republic have been contracted to attack top government functionaries, including state governors, across the North-West between now and the elections,’’ he said. The minister said the Federal Government is taking every possible measure to counter the evil plans by unpatriotic anarchists and would ensure the smooth conduct of the forthcoming general elections. He assured of the President Buhari-led Administration’s commitment to credible, free, fair and peaceful elections was unshaken. Mohammed appealed to all Nigerians to be vigilant in the days ahead. He also appealed to the media to help in sensitising members of the public to the observed threats, capable of disrupting the elections. ‘‘The punchline of our long running campaign on security – if you see something, say something – remains relevant, perhaps even more, at this time,’’ he said. He said all the relevant agencies under his ministry would work together to ensure that Nigerians are alerted to the dangers posed to the forthcoming elections by the unpatriotic characters planning to destabilise the country in order to realise their inordinate ambitions Reacting, the Peoples Democratic Party (PDP) however debunked the claim of security threats by Alhaji Lai Mohammed, describing it as absolute falsehood which must not be taken seriously. Director of Media & Publicity, PDP Presidential Campaign Organisation, Kola Ologbondiyan, said such allegations only exists in the minds of Alhaji Lai Mohammed. Ologbondiyan, at a press conference he addressed on Monday in Abuja on certain issues of urgent national importance as they affect the 2019 general election, said the claims of fresh threats to the security of the nation by Alhaji Lai Mohammed was just the nefarious plans of the All Progressives Congress (APC) government. He said “it is imperative to state that the PDP finds the claims of Alhaji Lai Mohammed, irresponsible and ludicrous. It is just a measure for building the ground for framing up and arrest of leading members of the opposition as he has just confirmed our concerns”. He noted that Mohammed’s claims exposes manifest complicity at very high level and displayed desperation by the APC ahead of the general election. According to him, the PDP calls on Nigerians to hold President Buhari directly responsible for any escalation of violence in the country because it had alerted the nation that the APC and the Buhari Presidency,

Its rally in Lagos State ended in a fiasco and recorded fatalities. Its Presidential candidate is known all over the world for inciting supporters against peace-loving Nigerians, when he said that baboon and dogs will soak in their blood,” he stated. The Peoples Democratic Party used the occasion to challenge the Chairman of Independent National Electoral Commission (INEC), Prof. Mahmood Yakubu, to rise above the manifest compromises and conduct the 2019 general election in a transparent manner. Ologbondiyan said the entire nation is worried and the palpable fear of every Nigerian today is whether Mahmood Yakubu can conduct an election, which will indeed be free, fair, credible and transparent. He said “this is particularly as allegations are rife in the public space that the INEC Chairman is being compromised by the All Progressives Congress (APC) and the Buhari Presidency with offers of huge sums of money,
choice property within and outside Nigeria, as well as juicy appointments to his relations as bribes, in return for the rigging of the elections in favour of President Muhammadu Buhari and the APC. “The PDP urges Prof. Yakubu to resist any such pressure. This is especially as many Nigerians fear that this is the reason behind the compromising insistence by INEC to lump together the accreditation of voters and voting, a situation that will muddle up the process and pave the way for participation of aliens, underage and unregistered voters and allocate fictitious figures in favour of President Buhari and the APC. “This scenario is also feared to be the reason INEC is succumbing to pressure by the Buhari Presidency to retain Mrs. Amina Zakari, President Buhari’s relation by marriage, as head of the collation centre, where she is being positioned to alter genuine results and allocate fictitious figures in favour of President Buhari. “We already have information that the geo-spatial centres created by the INEC Chairman in the six geo-political zones have also been dubiously duplicated by Mrs. Amina Zakari in all the zones from where APC and Buhari Presidency intend to assemble fictitious votes and transmit same to INEC’s data base and situation room. “We are also aware that the process of employing Ad-hoc staff that will function as electoral officers, particularly in the Presidential election have already been compromised to favour the APC under Mahmood Yakubu’s watch to manipulate the process”, he said. The PDP, therefore, in the strongest terms, charged Mahmood Yakubu to demonstrate his credibility and ability to conduct free, fair and transparent elections by taking urgent and decisive steps to show that he has
not been compromised by the APC and the Buhari Presidency. To do this, the party demanded that Prof. Mahmood Yakubu immediately rejig the electoral guidelines in a way that accreditation must be first concluded, number of accredited voters ascertained and openly announced before actual voting. He said “anything short of this will only validate the position of Nigerians that INEC has been compromised by the APC. “Similarly, Prof. Yakubu cannot claim to be committed to a credible election with the continued stay of Amina Zakari as head of the collation centre, in spite of manifest conflict of interest. Prof. Yakubu must without further delay remove Amina Zakari from this sensitive position, if he indeed intends to conduct a credible collation of Presidential results. “Furthermore, to hedge any infraction from the dubious duplication of the geo-spatial centres by Amina Zakari, the PDP insists that INEC’s final collation centre must be made open to agents of all the Presidential candidates as well as representatives of national and international observers. “While we note that President Buhari has bowed to pressure by Nigerians and eased out Ibrahim Idris as Inspector General of Police, we urge him to also lend credence to the electoral process by easing out his relation by marriage, Amina Zakari, from INEC. “In the same vein, following revelations that the process of recruiting INEC Ad-hoc staff has been compromised to favour the APC, the PDP insists that Prof. Yakubu must publish the names of all the ad-hoc staff that have been recruited, in their respective constituencies, to enable voters in those areas to assess the independence and integrity of such electoral officers. “We charge Prof. Yakubu to note that this election is very crucial to the survival of our nation and that he is now at the epicenter of the future of our country. He must therefore rise above offers of compromises surrounding him. “We believe that Prof. Yakubu has a name to protect. He must know that there is a life after office. We hope and pray that he will not end up like the disgraced last Inspector General of Police, Ibrahim Kpotum Idris. Prof. Yakubu should know that Nigerians will hold him directly responsible if the 2019 general election is derailed”. Reacting to various insinuations, the INEC chairman Prof. Mahmood Yakubu, said the Commission will not be distracted by comments, criticism or accusation as election come closer. He said “as election move closer, there will be accusations and counter- accusations. But we will not be distracted. We will be more committed to successful conduct of credible elections”.

IGP sets up teams to investigate electoral offenders Disbands IGP monitoring team, others
Andrew Orolua, Abuja The acting Inspector General of Police (IGP), Mohammed Adamu, on Monday, directed the setting up of a Special Election Investigation Teams to handle cases of electoral offenders across the country that are likely to arise in February and March general elections. The teams are to ensure that offenders are arrested, thoroughly investigated and their cases conclusively brought to justice. IGP Adamu, who disclosed this at the median meeting with police management team, all Assistant Inspector General of Police, Commissioners of Police and other top police officers, also announced the disbandment of all quasi-investigation and operations outfits. He said that the disbanded outfits including “the Special Investigation Panel (SIP), and Special Tactical Squad (STS), or any other such Teams under whatever name are hereby disbanded.” On election offenders,
IGP Adamu also directed the teams to liaise with the Independent National Electoral Commission for prompt processing of the cases files of offenders for prosecution. He reiterated his earlier promise to introduce a number of well-thoughtout - reforms initiatives that will restore the traditional policing standards of the force particularly in the area of operations, intelligence, investigation, training, science, technology, and innovations, and monitoring and evaluation. Adamu said that the reforms are coming in cognisance of the fact that “our responsibility as a Police Force is to operate within the extant rules and best international policing practices. It also imposes on us the obligation of respecting, protecting and advancing the rights of all citizens of this country regardless of their socio- economic status.” He said that no police force ever succeed by alienating its citizens, adding that in this light, “we are firmly resolved that, under my watch,

policing will be citizensdriven, rules -driven, and accountability - guided.” IGP Adamu further stated that while “a comprehensive reform that would guide mode of operation, nomenclature and orientation, function delineation, Command and Control, weaponry accountability and mechanism will be worked out for Special Anti-Robbery Squad (SARS), which currently is centralised at the Headquarters is hereby decentralised.” According to him,

P r e s i d e n t Muhammadu Buhari on Monday promised to adopt sound security and economic transformation programmes to address the nagging social and economic challenges facing the country, if reelected. Buhari, who spoke in Hausa language at the inauguration of his re-election campaign in Maiduguri, Borno State capital, also promised to take the fight against corruption to a logical conclusion. He said his administration had achieved significant progress in the campaign against corruption, economic diversification and improvement of security. The President said his administration had adopted practical measures to reduce poverty, provide employment opportunities to the teeming unemployed youths and enhance farmers’ access to fertiliser and inputs. “In 2015; I promised three things namely: security,
economy and corruption. “We reinvigorated agricultural sector; provide fertiliser and other support to farmers. I am happy that we recorded bumper harvest in the past two seasons. “The high yields recorded boost crop production and we no longer spend money on the importation of rice. “On security, our achievements are glaring and I remain committed to the protection of lives and property of the people as well as safeguard the nation’s territorial integrity. “I always sleep with you in mind on security, economy and fight against corruption,” Buhar said. The President also said that his administration would auction houses and other property seized from corrupt officials and transfer the funds to national treasury for execution of viable projects. He called on the electorate to vote for APC and all its candidates to enable them
continue with their policies and programmes. Buhari further sympathised with party supporters who sustained injuries in the collapse of a pavilion at the venue of the rally. Governor Kashim Shettima, in his speech, commended Buhari for the successes recorded in the fight against Boko Haram insurgency, and effective response to address the humanitarian crisis in the state. Shettima said the President had demonstrated love and concern to plight of the people of the state, which assisted to address social, economic and security challenges bedeviling the state. He assured Buhari of support of the people in the state, adding that voters in the state would give the president about 95 per cent block votes. “To reciprocate your love,
goodwill and what you did to us, we shall give 2.3 million votes,” he said. Also, Sen. Bola Tinubu, APC co-Chairman, Presidential Campaign Council, called on Nigerians to disregard calls by former President Olusegun Obasanjo and vote for Buhari for the second time. Other speakers at the event include Rotimi Amaechi, Director-General of the Presidential Campaign Council, Adams Oshiomole, APC National Chairman and Borno State APC Chairman, Alhaji Ali Dalori. Some prominent members of the Peoples Democratic Party (PDP), who defected to the APC, were also received to the party at the event. They include former Governor Muhammad Goni, Alhaji Kaka Bolori, the Director-General, PDP Campaign Council, Musa Abubakar, Baba Shehu, Masta Lawan, Ali GNPP and Grema Terab.
Dangote feeds 30,000 IDPs in Zamfara In yet another massive intervention, the Aliko Dangote Foundation on Monday officially launched a major philanthropic programme in Zamfara State, doling out food items running into several millions of naira to support victims of insurgency. The farmers-herders clash and sporadic attacks by cattle rustlers have displaced thousands, many of whom are currently seeking refuge at Maradun Local Government Area of the state. According to official reports, over 3,000 people have been killed, about 100,000 displaced, of which about 30,000 are in Maradun LGA, and over 500 people kidnapped. Group Executive Director, Government Relations and Strategic Relations, Mansur Ahmed, who presented the food items on behalf of the Group President, Aliko Dangote, said the Foundation was supporting the government and traditional leaders in meeting the needs of the IDPs. Only recently Dangote was rated world’s 6th largest donors, and Africa’s richest person for almost a decade. His Aliko Dangote Foundation has been endowed with a staggering $1.25 billion. He was also listed by Forbes Magazine among the 75 people that make the world turn. Dangote Foundation had also injected over N7 billion to create succour in North East in the wake of the Boko Haram insurgency. Ahmed, an Engineer, said Dangote was very disturbed about the plight of the displaced persons and quickly directed that everything possible be done to provide succor. He said the company was building a 200000ton capacity of rice mill in Maradun and that when completed this year, it would create hundreds of job opportunities for the people of Zamfara State. Responding, Emir of Maradun, Muhammad Garba Tambari, said he was highly elated as the company is the first to intervene by providing food support for

displaced persons. He commended Dangote for the gesture and promised to help secure his investment in his Emirate. Chairman of the Maradun Local Government Area, Alhaji Yahayah Shehu Maradun, thanked the Dangote Foundation for the gesture and pray God to continue to bless the Dangote business. Newsmen sighted trucks of food items being offloaded at the silos and at the official presentation of the relief material at the Palace of the Emir of Maradun. Some of the items delivered include trucks of Semolina, sphagetti, sugar, wheatmeal and Macroni. Victims at the IDP camp, who recounted their ordeal, described the crisis as the worst in the country in the past five years. They regretted that the state has been neglected by government and mainstream media. Mrs. Inno Usman, 50, from Mallamai District, lost a husband to the crisis and has eight children at the IDP camp. She said five men including her husband were killed by the marauders. Mrs. Usman described the intervention of Dangote as timely, while urging other donors to emulate the Aliko Dangote Foundation. Another victim, Mrs. Kenan Usman, said her husband was also killed in a gruesome manner and that she escaped with her five children by the whiskers. She said before the coming of Dangote Foundation they have been accommodated at the IDP camp in Maradun since November 2018, regretting that there is no date for their return as the insurgents still hold sway in their various villages. For Inno Aliyu Sani, 60, 21 people were killed including four women, and cows running into hundreds were stolen by the rustlers. “We can’t go back. The killers are still there,” she said. Abubakar Garba from Rudun village said for the past five years marauders had sacked everyone in the village but that government was doing anything address the situation until now.

Vote buying: INEC uncovers fresh plot by politicians, insists on simultaneous accreditation, voting Tunde Opalana, Abuja Determined to frustrate electoral malpractice of vote buying by politicians, the Independent National Electoral Commission (INEC) has discovered fresh plot by politicians to outsmart the Commission. The new plot, according to INEC chairman, Prof Mahmood Yakubu is to use good vendors stationed around polling centres as collection points for vote buying transaction on election days. Yakubu, however, told a team of the European Union Election Observation Mission in Nigeria that the Commission will ensure that the new plot will fail. The chairman said this while receiving the team led by the European Union Chief Observer, Mrs. Maria Arena in his office on Monday. He said “following recent consultations with stakeholders across the six geopolitical zones in Nigeria, the attention of the Commission was drawn to new plans by some political actors to use food vendors around polling units with large voter population as collection points for cash-for-votes as well as other forms of material inducement to voters on Election Day. “We are aware of this trick. It will not work”, he vowed. Not minding the kicking against the
system of simultaneous accreditation of voters and voting by some political parties and lately by former president, Chief Olusegun Obasanjo, he said the Commission will stick to the system as suggested by the European Union observers. Acknowledging the benefits derived past recommendations of the EU Observer mission, the chairman said “we have implemented all the recommendations made by the EU Mission in 2015 that are within the powers of the Commission, including the simultaneous accreditation and voting system which we introduced on 9th January 2016 and thereafter seamlessly used to conduct off-season elections in 194 Constituencies”. Yakubu assured that the EU of its preparation for the 2019 polls. He said “we have had a series of very assuring meetings with the security agencies in order to ensure that processes are protected, the right of voters to vote freely safeguarded, access for observers and the media guaranteed, the election transparent and the outcome a true reflection of the will of the Nigerian people “. He appreciated the EU as one of the long-standing partners of the Commission in deepening Electoral democracy in Nigeria. “Through the EU Support for Democratic Governance in Nigeria (EU-SDGN), we have developed and
validated our strategic plans; deepened our engagement with stakeholders; enhanced the participation of marginalised groups in the Electoral process especially women, youths and Persons with Disabilities (PWDs); built the capacities of our staff, brought together other Electoral Commission’s within Africa to share experience on best practice in the use of technology in elections; and benefitted from the services of elections, and benefitted from the services of election experts in various aspects of the Commission’s operations “, he said. The Chief Observer, Maria Arena thanked INEC for inviting the European observers saying they are interested in the growth of democracy in Nigeria. She said the EU has had six previous election observation missions in Nigeria but currently have 40 observers deployed in different parts of the country. Arena said the Mission will issue two preliminary reports after election days while it will submit its final report two months after the elections with recommendations. The EU Mission promised to work with other international elections observation missions such as the African Union and ECOWAS Mission. The Commission chairman later played host to members of the ECOWAS observers led by its coordinator, Mr Chinedu Chinedu.

FG sacks Baffa as TETFund boss, reinstates Bogoro Doosuur Iwambe, Abuja President Muhammadu Buhari has removed Dr. Abdullahi Baffa as Executive Secretary (ES), Tertiary Education Trust Fund (TETFund). He has been replaced by former ES of the agency, Prof Suleiman Bogoro. No reason was given for Dr. Baffa’s removal. In a statement issued by the Deputy Director of Information at the Federal Ministry of Education, Ben Bem Goong, the FG announced that Suleiman Bogoro, the former Executive Secretary, who was initially appointed by former President Goodluck Jonathan in April 2014 has been reinstated to replace Baffa. According to the statement, Dr. Baffa’s removal is to take effect immediately with the same terms and conditions as it were in his previous appointment and as stipulated in the TETFUND staff conditions of service. Bogoro initially handed over to Baffa in August 2016, having worked with Adamu Adamu, the current Minister of Education, as an adviser. Court restrains EFCC, Police, DSS from arresting Fani-Kayode, Odumakin Doosuur Iwambe, Abuja Justice John Tsoho of the Federal High Court sitting in Abuja has given an order restraining the Economic and Financial Crimes Commission (EFCC), the Department of State Services (DSS) and the Nigerian Police from arresting Mr. Femi Fani-Kayode and Mr. Yinka Odumakin. Ruling on an ex-parte order on Monday argued by Mr Chukwuma MachukwuUme (SAN) on behalf of the duo, Justice John Tsoho held that he was satisfied that the applicants had made a case that their lives were being threatened. Arguing the application, MachukwuUme told the court that the three agencies were planning to arrest and detain his clients over comments they made in regards to the travails of the Chief Justice of
Nigeria, Justice Walter Onnoghen. “The spokesman of the EFCC, Mr Tony Orilede was alleged to have made the threat to arrest them publicly at a conference where he represented the EFCC chairman. “The EFCC is established to pursue corruption and not comments made by Nigerians, expressing themselves,” he said. The lawyer told the court that his clients were currently hiding in fear for merely expressing their freedom of speech adding that their family life had also been affected by the threat. He also told the court that the application was brought pursuant to Section 6 (6)(b) and Section 46 of the 1999 Constitution as well as Order 4 Rule 3 of the Fundamental Rights Procedure Rules. He urged the court to grant the order restraining the respondents from arresting
and detaining his clients pending the determination of the application on notice. After listening to his submission, Justice Tsoho said;”I am satisfied that the applicants have made out a case for the court’s intervention. “Accordingly, the respondents are restrained from arresting and detaining the applicants on the grounds of the applicants’ public statement pending the determination of the application on notice,” the judge said. He granted the application and adjourned the matter until Feb. 4. Daily Times recalls that the Economic and Financial Crimes Commission (EFCC) had last week announced that it will file a libel suit against a former minister, Femi Fani-Kayode, for trying to manipulate the public by spreading false information about the agency’s operations.
The governorship candidate of the All Progressive Congress (APC) and Managing Director, Niger Delta Development Commission (NDDC), Obong Nsima Ekere has accused Governor Udom Emmanuel and the Peoples Democratic Party (PDP) of plans to use former militants from neighbouring states in Niger Delta to cause violence in the 2019 general elections in the state. Ekere also alleged that Gov Emmanuel claimed that the state Police authorities were against him after he failed in his attempt to influence the posting of Police Commissioner of his choice to the state. He made the allegations during the flag off of his campaigns in Uyo on Monday as he debunked claims by the PDP in the state that the APC has perfected plans to use federal institutions to rig the elections in the area The Managing Director of NDDC explained that his administration would create the much needed economic boom for Akwa Ibom in addition to strategic investment in health, social protection and infrastructure. Ekere maintained that APC led federal government has the most secured social protection programme in the history of the country and would be would domesticate in the state when elected. He emphasized that Akwa Ibom people have no business being poor and expressed readiness to return the state to the path of prosperity while building on the achievements of the former governors of the state. “Since Nigeria was formed as a country the APC is the only party that come with social protection programmes for the youth” He further challenged the PDP to make the campaigns issue oriented adding that he would ensure that his campaigns are devoid of ethnicity and hate speeches because the collective interest and unity of the state needed to be protected. 2019 presidential debate and matters arising

Oby Ezekwesili, Kingsley Moghalu and Fela Durotoye must have woken up on Sunday morning feeling a measure of resentment towards Nigerians. Quite thanklessly for them, these are the same Nigerians whose votes they seek. At Saturday night’s presidential debate, Ezekwesili spoke about her determination to lift 80 million Nigerians out of poverty. She talked about removing barriers in the way of service-sector operators, as well as disrupting the current patterns of Nigerian politics and breaking the country’s perpetual cycle of leadership deficit. Moghalu harped on the importance of focusing on a holistic strategy for expanding small business and employment opportunities in the rural areas, and of electing a president who understands the economy. With the exception of “I want a Nigeria where the son of nobody can become somebody without the help of anybody”, which made him sound like a motivational speaker, rather than a presidential material, Durotoye made some interesting propositions, too, such as creating 30 millions jobs by investing heavily in agriculture, housing and road construction. Yet, more than 24 hours after the debate, the major conversations have been about the absentees — President Muhammadu Buhari and Atiku Abubakar — rather than the performance of the trio. How riled Ezekwesili, Moghalu and Durotoye must be — even if they won’t admit it — that their presence at the debate is being undermined by the relentless talk about the absentees. This development has clear implications; I will come back to that. On the back of an error-strewn showing at All Progressives Congress (APC) campaign rallies all week, we have to extol the political innocence of anyone who expected Buhari to turn up at Saturday’s debate. In Kogi on Wednesday, Buhari slipped; were it not for the vigilant hands of his entourage, we might have had to deal with the ugly sight of our
president sprawling on the floor. Apart from physically slipping, Buhari also made a slip of the tongue, claiming to have assumed office on May 19, 2015 whereas it was May 29. In Kaduna on Friday, he tripped; had a chair not been somewhere in sight, the president might have ended up on the deck. On Thursday in Delta, Buhari bizarrely described Great Ogboru, the APC governorship candidate, as the “governortorial candidate” — a phenomenal linguistic invention he made after first calling Ogboru “presidential candidate” and subsequently “senatorial candidate”. The same day, he also mixed up the dates he was petroleum minister, giving it as 1978-79, instead of 1976-78. Put in the mix his underwhelming showing at Wednesday’s town-hall interaction, during which Vice President Yemi Osinbajo was largely his saving grace, there was no way Buhari would be debating. His advisers who shielded him from the debate did their job well. Their selfish gain, though, is Nigeria’s loss. We will come back to this, too. Conversely, Atiku’s 59th-minute-of-theeleventh-hour withdrawal is a spectacular own goal — not so much because of the missed opportunity but because of the unintended exposure of the egotistical agenda oiling the electioneering machinery. Perhaps Atiku didn’t realise it, he didn’t necessarily need Buhari at that debate. The president may be his biggest obstacle to the Presidency but the debate was no referendum on the Buhari administration. It was a forum for him to sell himself to the Nigerian electorate — to again defend himself against his popular perception as corrupt, his U.S. trip and, more importantly, his plans for creating jobs, revitalising the economy and restructuring the country, three important anchors of his campaign. Anyone who has ever heard Atiku speak extempore will agree that he has never been found wanting in communicating his agenda for Nigeria. On Saturday, he proved even he had
underestimated himself. A big, big missed opportunity. Atiku’s explanation of the walkout has left a bitter taste in all our mouths. His explanation of coming for a “presidential debate, not a candidacy debate”, and his allusions to Buhari’s unavailability to defend himself, is self-damaging. Apparently, Atiku came for a presidency debate, not a presidential debate. Atiku considers Buhari’s absence “a slight on ALL of us and our democracy” but doesn’t think his own absence carries exactly the same significance? In any case, it is hypocritical of him to censure Buhari for skipping the debate. Olusegun Obasanjo, whose running mate he was, did not debate in 1999. Atiku is not on record anywhere to have publicly condemned it, or to have persuaded him otherwise in private. Buhari refused to debate in 2015 yet Atiku was one of his biggest backers; had Buhari given him front-line recognition in his government after his ascent to power, perhaps Atiku would be here today defending a debate-shy Buhari for 2019. But karma can be vicious, and Atiku can have no complaints. Atiku has since clarified that his only condition for attending a debate is Buhari’s attendance. There is no denying that Atiku has always wanted to be president. He tried in 1992 without luck; he has tried again every election season since 2007. But his current attempt is evidently laced with vendetta; it is his chance to avenge his consignment to political oblivion by a man whose Presidency he immensely contributed to securing. Vendetta and ego are two of the potentially numerous unedifying sub-themes of the Atiku presidential aspiration. Coming back to Buhari, this isn’t the first time an incumbent president will be shunning the debate. Umaru Musa Yar’Adua skipped it in 2007; Goodluck Jonathan skipped the first of the two major debates in 2011 (leaving the contenders to
boycott the second, which he participated in alone). But this is the time we must be most worried — because Buhari’s absence wasn’t completely occasioned by arrogance, but also by senility and the necessity to avoid a calamity. A president who can’t sit at a twohour debate without embarrassing himself cannot last another four years without shaming us all. The presidential candidates of the alternate political parties, with whom I kicked off this conversation, must be wondering why their performances have assumed lesser significance to the absence of ‘Butiku’, as coined by Ezekwesili. The answer is simple: 2019 is still about PDP and APC. It won’t continue forever, hopefully, but they have a say in how quickly the PDP-APC hegemony will be broken. May 29, 2019 may not witness the swearing in of a Moghalu, Ezekwesili or Durotoye as president, but not long after, we will know if they’re opportunistic presidential aspirants or they’re truly here to stay. We will know if, by 2023, these alternate parties would have recognised the need to fuse into a third force to be represented by only one but supported by all of them. We will see if they dismember their campaign teams or expand them over the next four years to build that structure that will count against them at the polls next month. I have said it before and I will restate it: 2019 is already a lost opportunity for Nigeria. A second Buhari presidency is very likely, Yet Buhari, no matter how well-intentioned he is, is no longer in charge of even his own cabinet, much less the country. His coming back, if it happens, will be catastrophic. An Atiku presidency remains a probability; if it happens, the PDP looters already hovering over him will spearhead it. One potential consequence is that our treasury will be afflicted by kwashiorkor. And the alternate parties? Their debate can’t even overshadow the absentees — how do they hope to win?
Nigeria and the 2019 Presidential poll

Q U A D R E N N I A L LY, Nigerians exercise electoral franchise; choosing national leaders in pursuit of democratic norms as enshrined in the nation’s constitution. Resultantly, a new phase of the country will be determined on February 16 presidential election. Politicians as usual are putting up diverse strategies in place and masses inundated with nice campaign promises- facts or fictions. Interestingly, the two dominant parties; All Progressives Congress (APC) and Peoples’ Democratic Party (PDP) have records to show for their true colors unlike other political parties that are either newly registered or merely existing on papers. In the INEC’s final release, the list features 72 presidential candidates and their running mates. But couldn’t the electoral umpire create a guideline towards streamlining the number of political parties for presidency, maybe with a proviso for such a political party to control at least a state in the federation or have one member of the National Assembly elected on its platform and not by defection into the party? This will bring some civility in the system. Thus, the battle for control of power for the next political dispensation will most likely, intensely be between the ruling party, APC with incumbent President Muhammadu Buhari as its candidate and PDP with Atiku Abubakar as the leading opposition’s candidate. Whilst APC is about rounding off a term; three and half years in power precisely, PDP had cumulatively occupied the seat of power for sixteen years with three different captains at the helm of affairs accordingly, beginning with Chief Olusegun Obasanjo and Atiku Abubakar as president and vice president respectively for eight
years. The duo was more of a cat and mouse with several attempts to sack Atiku from office as vice president but resisted through judicial instruments. The acrimonies lasted till the end of the administration and almost led to punches with litany of accusations on corruption against each other. The party continued after them, however ruled until kicked-out through the ballot in 2015 election over admitted colossal failures and ineptitude. Saliently, President Buhari’s unanimous endorsement as the champion of anti-corruption war of the African Union is convincingly indicative of Nigeria’s renaissance in the global record and cannot be taken for granted. Prior to this dispensation, the image of the country was abysmally battered that the green-and-white passport befitted eyesores outside the shores of the country. It climaxed that the global community imperceptibly blacklisted the country as “fantastically corrupt” thereby erroneously zeroed our great potentials by hasty generalization. Of course, the rating was justifiable vis-à-vis trending heavy foreign accounts and exquisite properties worth millions of dollars and pounds belonging to Nigeria’s public officeholders and their cronies. On economy, Buhari in nearly one term has outstandingly, relentlessly put machinery in place towards diversifying the economy, thereby changing the nation’s pitiable status of a leading consuming nation it hitherto was on his assumption of office. By this singular act alongside other economic indexes, despite the high cost of living presently evident in the society, optimistically, improvements are imminent with the fundamentals visibly taking positions. Notable economic giants across the
globe particularly Singapore, China, Malaysia, among others similarly took the bulls by the horns akin to Buhari’s policies, and today, they are globally reference points on economic-growth and persistent productivity. Such systematic blueprints are indicative of socioeconomic growth and futuristic significant attainments. And if consolidated with enhanced exploits, incontrovertibly, dividends of democracy that would put smiles on the faces of the masses are foreseeable. It therefore empirically attests to the possibility of actualizing President Buhari’s ‘Next-Level’ packages. Presently, local production of rice and other agricultural produce are encouragingly, gradually meeting local demands notwithstanding the high cost at the moment and if the momentum is sustained as prioritized by this administration, in no distant time, the market forces will drag down the high-prices from its present position accordingly. Another remarkable feat of President Buhari is the willpower to implement the TSA (Treasury Single Account) against all odds which has robotically blocked all the leakages and BVN (Bank Verification Number) thereby curtailing illicit transactions and improving the internally generated revenues for general interests. On infrastructural development, from the number of capital projects; some abandoned now completed or nearing completion, rehabilitated and newly-awarded roads altogether over 350 spread across the nation alongside power generation of 7000mw from less than 2000mw inherited from PDP’s 16 years’ tenure, it is obvious the present government has shown proficiency. Inarguably, these projects in turn systematically provide diverse opportunities to the citizenry.
These days, uncompleted projects that had endlessly reflected in government budgets barefacedly for frauds, embezzlement of public funds at the detriment of the suffering masses are one after another being completed and commissioned for public use, paving way for commencement of new ones. The laudable efforts and exploits of the present administration to move the nation from the rot cannot be overemphasized, and therefore reciprocally demands collective supports. A leader that relentlessly sacrifices all personal interests for the nation deserves great accolades. Without mincing words, the economy at the moment requires consolidation of the laudable policies in place by this administration. The willpower in motion that has effectively improved the nation’s internal revenue generation since this administration came on board shouldn’t be toiled with. With such positive development alongside accountability as can be attested in President Buhari, Nigeria is irrefutably on its way to greatness. Logically, the present administration deserves more time to plainly implement its blueprints to the latter for appraisal of its capabilities. President Buhari selflessly, determinedly came on a rescue mission not just for this generation but for the generations yet-unborn to ensuring that the era of exploitations, wickedness in high places and willful impoverishment of vulnerable Nigerians are brought to abrupt end. Hence, in making our respective choices, national interest should prudently take priority over personal interests. No nation attained enviable heights without some radical actions, strength of mind and sense of purpose.

Editorial Commentary My takeaways from Atiku’s trip to US Times Guest Columnist Paul Ibe
Last Thursday, Atiku Abubakar silenced his critics by travelling to America for the first time in 12 years, thus proving false their speculations about his reasons for not visiting the country. Contrary to their cooked up tales and dementia induced narratives that he feared arrest and would be immediately incarcerated by American security personnel if he dared set foot there, Atiku arrived in Washington D. C., spent the next two days meeting with American Congress men and women and officials of US State Department and the US Chamber of Commerce. The PDP presidential candidate also met with officials of Institute of Peace, the business community and the Nigerian community in and around the Washington D. C. area, before returning to Abuja on Saturday afternoon. Over the years, Atiku had maintained that his reason for staying away from America was administrative: he would go to America if he was granted a visa. And that is exactly what he did. However, Atiku’s visit to America last week was more than just about travelling to prove the naysayers and rumour mongers wrong. These are my five takeaways from his brief but essential trip. Atiku’s presidential campaign has revolved around his policy framework of JOBS: (J)obs, (O)pportunity, (B)eing United, and (S)ecurity. During his visit to America, he met with congressmen and women, US State department, US chamber of commerce, US Institute of Peace, members of the business community in America, and Nigerians in the Diaspora. With each of these groups, he discussed the relevant aspect of his policy framework, to better understand how they could help him achieve these goals after he is elected president of Nigeria. Over the nearly four years of the current APC administration, Nigeria’s relationship with foreign allies has grown limp, with many of President Muhammadu Buhari’s trips abroad notorious for blunders and embarrassments and his most recent visit to the US better remembered for descriptions of his “lifelessness” than for any significant achievements. By his trip and during his meetings, Atiku has shown America, a key ally, that Nigeria can offer a more lively and vibrant leadership. They need not fear about dealing again with any form of “lifelessness”. For the average Nigerian, the severe damage done to our country’s economy by the current administration’s policies,
has been felt most painfully in the plunging rate of the naira to the dollar. However, these disastrous economic policies have had even more damaging consequences to us all. They have forced foreign businesses and investments to flee our country. During his trip to America, Atiku assured American investors that the economic atmosphere in Nigeria would change once the current administration is thrown out. Nigeria would once again be open for foreign direct investments as it was before the current administration came in and put a stop to that with its archaic policies. Many see Nigeria’s bloated youth population as a disadvantage, but this disadvantage can be turned into an advantage. If our teeming youth population is employed, if they have their hands and minds busy, the entire country will benefit from their honest labour, and Nigeria can indeed stand tall in her place as the giant of Africa. If more US firms invest in Nigeria, millions of new jobs will be created for our millions of youth. Atiku knows this, thus his meetings with the business community in America. Atiku understands the enormity of the task that is ahead of him to reverse the negatives (21 million people unemployed and 90 million people made extremely poor with Nigeria being adjudged the poverty capital of the world) that has been enthroned by the Buhari administration and Get Nigeria Working Again. Atiku believes that trading with foreign allies, like America, should go both ways. As he held discussions to open the doors of investment from America to Nigeria, so also did he do for trade from Nigeria to America. In his own words, “I am also eager to find a market in the US for some of the half a million shoes manufactured in Nigeria’s cities of Kano and Aba everyday.” In nearly four years of the current administration, Nigeria has been presented to the world by her own leader, as a country of corrupt people and lazy youths. This is not the true picture of Nigeria, a country of 182 million hardworking people, each desperate for opportunities to shine. Atiku’s trip to America is just the beginning of the world hearing about a new Nigeria. This is just the beginning of the story. And, for the world to hear the rest of that great story, we must all unite to cast our votes for Atiku Abubakar in the forthcoming elections.

T
he Nigerian political space since 1999 has experienced a tremendous improvement especially with the level of interest it has generated, that is if the number of persons jostling for the various political offices is anything to go by. As at the last count, the number of political parties in the country has risen to over 90 from the three that heralded the nation into the present democratic space in 1999. But one worrisome trend about it is the declining rate of women participation in the political life of the country, as the womenfolk seems to be facing serious challenge in their ability to break into political limelight. This is even more evident from the recent primaries of the various political parties in the country where the number of women elected to contest for the various offices was very negligible. For example, since 1999 and in fact in the history of Nigeria’s political life, there has not been any elected woman governor, the closest that a woman came to being governor, was when then governor of Anambra State, Mr. Peter Obi, was impeached by the state Assembly and his deputy, Dame Virgy Etiaba, was sworn-in as governor and she held that position for a few months until Obi got the court to reverse the impeachment. Though the activism in women was further awakened in the country since after the Beijing conference and declaration in 1991, which gave birth to the much talked about affirmative action that prompted the United Nations (UN) to subsequently concede 35 percent of all positions to women, nothing much has been done in the country to meet that target of women participation in politics. In the early days of this dispensation, it must be said that President Olusegun Obasanjo made significant progress towards fulfilling that quota, while the administration of Goodluck Jonathan, also appointed more women into key positions, while there were equally a significant number in elective positions. But that progress made in recent years seem to have been short-lived, perhaps due to the ever increasing complexities in the political system and high monetisation of the politics which has become a major challenge militating against women participation. Presently, out of 109 senators, we have seven women senators and out of 360 members of the House of Representatives, we have about 17 women; we had far more women from 1999-2015; there were also lots of woman in parastatals and ministries in the country. Also, an attempt recently to get a bill on affirmative action, sponsored by Senator Oluremi Tinubu through the National Assembly failed because it could not get enough support on the floor of the Senate. At an ECOWAS Female Parliamentarians Association (ECOFEPA) meeting earlier in the year, the President, and Nigerian Senator Stella Oduah said that Nigeria has the lowest female representation in elective positions in West
Africa. Senator Oduah called attention at the 15-member states of the sub-region to the dwindling number of women’s participation in politics in Nigeria to 7 per cent since the 2015 election. She said women have only 6.1 per cent representation in State Houses of Assembly, 3.9 per cent in the House of Representatives, 7.34 per cent in the Senate and almost zero per cent in the executive arm of government. In West Africa, Nigeria ranks even lower than Ghana which has as at 2016 about 10.7 per cent female representation in the parliament and 27 per cent female as cabinet ministers. Togo comes up second with about 17.60 per cent women representation in its national parliament as at 2017, and 18.4 per cent in ministerial positions. Senegal has the highest representation of women in elective positions, ranking 12th in the globe for the number of women in elective position - that is 3 per cent down from its initial ranking. Considering the role of women in nation building across the world and the increasing relevance of women even in the African continent, with the recent election of a woman as the new President of Ethiopia after the end of a Woman president’s tenure in Liberia, it is our considered opinion that it is high time Nigeria gave women more opportunity to express themselves in the political space.

Tinubu described Obasanjo as belonging to the crop of expired politicians who should confine himself to his farming business in Ota, Ogun state rather than writing letters and making indignant comment against a government that is shaping the future of the nation. The national leader of the ruling party lampooned Obasanjo on Monday at the presidential campaign rally of President Muhammadu Buhari in Borno State. According to the former Lagos state governor, Obasanjo failed the yoruba people when he failed to recognize June 12 as democracy day, despite pressures mounted on him to do so. Also, the National Chairman of the APC, Adams Oshiomhole also feasted on Obasanjo who had taken to the media on Sunday, alleging that the Buhari administration was perfecting plans to rig the 2019 elections through the Independent National Electoral Commission
(INEC) and that impunity and insecurity was getting worse under the present government. But Oshiomhole said that under Obasanjo, the norm was that people drew subsidy claims when they had done little or no job. According to the APC Chairman, Borno State suffered unprecedented pains in the hands of terrorists even though funds were appropriated to fight the menace. His words, “for too long the challenge of our country is that there is no relationship between effort and reward, those who make more money are those who do not work, all you needed to be a wealthy man is to know somebody in NNPC and you have your fake subsidy claims. “From all the revelation that have been made, while Borno state was under siege and the governor cried for help, the money appropriated for security for Borno people was diverted to private pockets, not only the PDP but for the generals” Speaking further, Tinubu said that the fact that President Buhari had the courage to recognize June 12 as democracy day, points him out as a democrat. Tinubu who appeared to be taking his pound of flesh on the former president over his allegations, said Obasanjo championed rigging in Nigeria’s electoral process and therefore was incompetent to criticise Buhari over impunity.

budget presentations quitting the relevant constitutional provision that mandated the budget proposal to be laid before the House. The House of Assembly was however, thrown into a temporary confusion on Monday when information went round that Governor Ambode would be presenting the 2019 budget proposal before the House, the occasion was to be devoid of the usual funfair that usually characterized the event in the past. Remain at home, ASUU tells students Titus Akhigbe, Benin-City The Academic Staff Union of Universities (ASUU), Ambrose All University (AAU), Ekpoma chapter, has warned students of the institution to stay away from the school as it is not in a hurry to call off the nationwide strike. It also warned parents to keep their children at home and not exposed them to unnecessary risk of travelling to school. President Muhammadu Buhari has described as “bloody nonsense” the penchant of some Nigerians to hide under the canopy of ethnicity and religion to perpetrate injustice and corrupt acts. Hosting his former staff who worked with him during his tenure as military head of state (January 1984-August 1985) on Sunday night at the State House, Abuja, the President added that recourse to the smokescreen of religion and ethnicity “is just corruption, pure and simple.” Justifying his thesis, President Buhari went down memory lane, drawing lessons from his electoral battles at the courts in 2003, 2007, and 2011, where those who ruled against him were Muslims from the North, but those who defended him were Christians from the South. His words: “I was recently forced to talk to somebody I respect a lot about Nigeria. I said in 2003, when I started out, complaints about presidential election used to start from the Court of Appeal. The president of the court then was my classmate in secondary school for six years.
Himself, myself and Shehu Musa Yar’Adua, were classmates. My lawyer, Mike Ahamba, was Roman Catholic and an Ibo man. My first witness was in the box. Ahamba said he needed the register of voters in certain constituencies and states to prove that votes were just allocated, and not true reflection of what existed in the constituencies. He asked them to record his request and sign. They did so. “When they came to give judgment later, the matter was not mentioned at all. In the panel was another Roman Catholic and Ibo, who raised his hand and said, this is what Buhari’s lawyer had said. Did we write to those constituencies and states to submit the register? If so, why is it not in the judgment? They just shut him up. He had to write a minority judgment. Of course, he’s now our Ambassador in United States of America. “I petitioned the Supreme Court. Who was the Chief Justice? A Muslim, probably a Fulani, from Zaria. After 27 months, we went. Ahamba addressed the court for 2 hours and 45 minutes. They went in, came out after about 45 minutes, and said they were proceeding on vacation the next day. They were away for three months, making it 30 months in all. When
they came back, they dismissed the case within 45 minutes. “In 2007, they repeated the same thing. Who was the Chief Justice? A northerner and Muslim. After 18 months, they dismissed the case. “The third time, who was CJ? A Muslim, Fulani man from Jigawa. After 8 months, he dismissed the case. This bloody nonsense about Nigeria on ethnicity and religion is just corruption, pure and simple. Wherever we find ourselves, let’s pray to God that we maintain our faith. That’s all we have. “I try to do my best, and pray to God to help me. May God Almighty give us the ways and means to continue to do our best for the country. Whatever religion we follow, let’s do it seriously, as finally, we would appear before God. Whether we believe it or not, it will happen. So, we better continue to behave ourselves.” President Buhari described the reunion and interactive meeting as an “emotional one” for him, as he had not seen some of the people since 1985, when the military regime he headed was toppled.
Idu Jude, Abuja The expected resumption of activities in universities across the country may have to wait a little while as Federal Government negotiation with the Academic Staff Union of Universities (ASUU) was deadlocked again. The two parties rising from a four hour meeting in Abuja on Monday failed to find a lasting solution to the crises. Addressing journalists after the meeting, Minister of Labour and Employment, Senator Chris Ngige, stated that the Federal Government and ASUU during the meeting agreed on certain grey areas as part of the demands by ASUU. However, he said that the association in its tradition must go for consultation with its National Executives before calling off the strike. “We know that ASUU has a tradition which is making consultations before calling off the strike. But I just told you that among what they demanded, agreements had been reached with the release of certain amount of money,” he said. Meanwhile, the Minister revealed that ASUU made a demand a love N50 billion, if all its monetary demands are pulled together.

CAN chairman urges Christians not to panic over election, as Kano REC enlightens members Yakubu Salisu, Kano The Resident Electoral Commissioner (REC), Kano, Professor Riskuwa Arabu Shehu, has enlightened Christian Association of Nigeria (CAN) Kano state chapter, on the procedures of election and urged those who have not collected their Permanent Voter Card (PVC) to do so, saying without the card, nobody would be allowed to vote during the forthcoming elections. This is just as the CAN state chairman in Kano, Rev. Samuel Adeolu Adeyemo called on Christians resident in the state not to panic during and after the forthcoming general elections, saying the election would be violent free. Rev. Adeyemo also urged them not to sell their vote, noting that whoever sell his/her vote, has indirectly sold his/her birth right, which he said would enslave them till end of another election. Furthermore, He urged Christians in the state to be united and always put national interest above all other personal views, stressing that they should not allow selfish politicians to manipulate them.

CJN Onnoghen: CCT hearing and salient issues Andrew Orolua, Abuja As the battle to remove the Chief Justice of Nigeria (CJN), Justice Walter Onnoghen from office range on at the Code of Conduct Tribunal this morning it appears the contentious applications and trial will be put in abeyance. This is so because the Chief Justice of Nigeria, Justice Walter Onnoghen began to fight back by filing an appeal at Court of Appeal challenging the decision of the Code of Conduct Tribunal which fixed today to hear applications relating to Onnoghen arraignment. A senior advocate of Nigeria told the Daily Times Law Report on Monday that although Onnoghen main appeal was not heard by the Court of Appeal, non was the oral application by his lawyer Chief Adegboyanga Awomolo SAN seeking for an order to maintain status quo granted, the Tribunal must take note that its decision of January 4th, 2019 had been challenged. Therefore, it must restrained itself from adjudicating on matter already before the Court of Appeal. The matter is likely to be in abeyance pending the determination of the appeal, the senior advocate said. The Federal Government had on Thursday last week filed a motion before the Code of Conduct Tribunal , asking that the Chief Justice of Nigeria , Justice Walter Onnoghen , be removed as the CJN and the chairman of the National Judicial Council . According to documents filed at the tribunal, in form of a motion by Musa Ibrahim and Fatima Danjuma Ali on behalf of the Attorney- General of the Federation on Thursday, it is to ensure that CJN ,Justice Onnoghen who is the Chairman of the National Judicial Council is not a judge in his case and that the next in line of seniority , Justice Ibrahim Muhammad , becomes the acting CJN pending the determination of the substantive suit . The plaintiff also want the court to compel President Muhammadu Buhari to name the next most senior judge as the acting CJN and chairman of the NJC . The motion on notice was brought in pursuance of Section 6 (6 ) Paragraph 11 (1 ) of the Fifth Schedule, Part 1 of the Constitution of the Federal Republic of Nigeria 1999 ( as amended ). The Federal Government is praying the tribunal for an interlocutory order “ directing the defendant /respondent to step aside as the Chief Justice of Nigeria and chairman of the National Judicial

He has since been personally served with the processes which some lawyer claimed violates the orders the high courts. The fresh move against Onnoghen came after the National Industrial Court , Abuja
, had on Monday restrained the Chairman of the CCT, Danladi Umar , the AGF, the Code of Conduct Bureau and the police from removing Onnoghen. The suit before the National Industrial Court was brought through an exparte by filed a lawyer , Mr Peter Abang. The matter which also came up yesterday could not heard because some respondents to the suit were yet to be served with the processes and the judge was forced to adjourn to January 30 for hearing. On January 14 when Onnoghen was to be arraigned two other Courts ,the Federal High Court Abuja presided over by Justice Evelyn Maha and a Federal Capital Territory presided Justice Halilu had issued similar orders restraining the parties in dispute from taking further steps pending the determination of the cases. But, parties are uncertain whether the orders of the three separate courts directing them to maintain status quo would abide as the federal government continued to advance its cause on the matter by filing motion to remove Onnoghen as the CJN and serving him with processes. While several alleged threats of his arrest
either to forcefully push him to vacate office or frustrate him to resign have also be challenged in Court . Just yesterday , one of the political parties, Action Peoples Party obtained leave of the federal high Court Abuja to serve by substituted means all court processes its had filed to stop the arrest of Onnoghen by the law enforcement agency. It appears Nigerians are stretching the CJN Onnoghen’s alleged misconduct beyond reasoning and to a level that is further ridiculing the Judiciary and some officials of the federal government. The fact that the Vice President Yemi Osinbanjo had said that President Muhammadu Buhari would not interfere with the court processes does not imply that Nigerians will ignore acts not consistence with the provisions of the Constitution of the Federal Republic of Nigeria which made provision for the removal of the Chief Justice of Nigeria. In the wording of the Constitution, whereas section 291(1) of the 1999 constitution, as amended, provided that a judicial officer appointed to the Supreme Court or Court of Appeal, may retire when he attains the age of 65 years and shall cease to hold office when he attend the age of 70 years. According to section 292 (1), “A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances: (a) In the case of (1) Chief Justice of Nigeria, President of the Court of Appeal, Chief Judge of the Federal High Court, President of the National Industrial Court, Chief Judge of the High Court of the Federal Capital Territory, Abuja, Grand Kadi of the Sharia Court of Appeal of the Federal Capital Territory, Abuja and President Customary Court of Appeal of the Federal Capital Territory, Abuja, by the President acting on an address supported by two-thirds majority of the Senate. (b) “In any case, other than those to which paragraph (a) of this subsection applies, by the President or, as the case may be, the Governor acting on the recommendation of the National Judicial Council that the judicial officer be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct”. I strongly believed that it will be better if the parties to this dispute stop heating up the polity and allow the Judiciary to sort out itself.

FG ends estimated electricity billing as Fashola okays 108 firms to supply of pre-paid meters Patrick Okohue The Minister of Power, Works and Housing, Mr. Babatunde Fashola, has assured Nigerians that the government was doing everything towards ending estimated, crazy electricity billing by energy providers in the country, as it has given for 108 firms to supply prepaid meters across the country. Fashola said with this development, the government is close to ending the arbitrary billing regimes and enthrone a modern billing system that will ensure consumers are only charged for power consumed, which is the standard practice across the world. The former Lagos State governor said this during the continuation of his neighborhood consultations/campaign for the re-election of President Muhammadu Buhari in 2019 to two wards in Surulere Local Government Area of Lagos at the weekend. Speaking first at his own ward G3, Fashola reeled out the achievements of Buhari which he said included improved power supply. He said that the 108 metering companies have been given licenses to supply meters, with the aim of
addressing problems of discriminatory and arbitrary billing in the electricity sector. “It is the solution of our government by the President to intervene in the metering gaps, people were licensed as Gencos and Discos. “Discos have the contract to supply meters and we hear the concerns of citizens now saying that they want meters because their bills are going up. “So the President and the Federal Executive Council (FEC) approved the proposal for us, supported by the law, the Electric Power Sector Reform, with that, we can license new operators within a licensed area. “So this time, we are going to create new businesses for meter suppliers under a Meter Asset Provider (MAP) scheme. That policy has been approved. “Nigerian Electricity Regulatory Commission (NERC) has made the regulations around which it will work; 108 companies, small businesses that will also create employment because those companies are now going to be the suppliers of meters. “They are going to employ people to install the meters, they are going to buy meters, they are going to make
meters,’’ he said. The Minister said that the Buhari administration had also provided solar power to 450 shops in the Iponri Market because the traders organised themselves and a private firm was contracted to handle the project. He added that the government was ready to extend the solar service to the Iponri Estate if the residents were ready to have a service centre. While seeking the support of his constituents in Ward G3, Fashola appealed to the residents not to sell their votes, urging them to vote the All Progressives Congress (APC) in the 2019 general elections, telling them however that if the opposition Peoples Democratic Party (PDP), comes in an attempt to buy their votes they should collect their money and still vote APC, “it is your money which they stole from you, collect it and still vote APC.” The Chairman of the Iponri Residents Association, Mr. Tayo Ogunlade, drew the attention of the minister to some dilapidated infrastructure and some parts of the estate that was sinking. He also berated the Goodluck Jonathan administration for not doing enough in the area of road construction, saying that when he assumed office as Minister he inherited a budget of N18billion for roads when as governor of Lagos State he left a budget of almost N50billion for roads in the state. He added however that the present government has raised the budget for roads infrastructure now to almost N500billion in the current budget, “this is despite that the oil price is now much less than what it was during their time.”
Internet users hit 111.6m in December, says NCC Ladsope Ladelokun The Nigerian Communications Commission (NCC) on Monday said that internet users in Nigeria have increased marginally to more than 111.6 million in December 2018. The NCC revealed this made this known on Monday in its Monthly
Internet Subscribers Data for December posted on its website. The data showed that overall internet users increased to 111,632,516 in December 2018 from the 108,457,051 recorded in November 2018, showing an increase of 3,175,465 new subscribers. According to the data, Airtel, MTN, and Globacom gained more internet subscribers during the month under review, while 9mobile was the big loser.
The breakdown revealed that MTN gained the more with 2,221,153 new internet users in December 2018, increasing its subscription to 43,899,957 as against 41,678,804 in November 2018. It further showed that Airtel was second, gaining 799,538 new users in the month under review, increasing its subscription to 29,757,791 in December 2018 as against 28,958,253 in November
2018. It said that Globacom was the third gainer with 293,667 new internet users, increasing its subscription in December 2018 to 28,054,948 from 27,761,281 recorded in November 2018. The NCC data showed that 9mobile the big loser lost 1, 388, 93 internet users in December 2018 with 9,919,820 as against 10,058,713 recorded in November.

Presidency condemns Obasanjo’s attack on TraderMoni Says he is ignorant of true workings of the microcredit scheme
Mathew Dadiya, Abuja The Senior Special Assistant to the President on Media & Publicity, Mr. Laolu Akande, has condemned the statement purportedly attributed to former President Olusegun Obasanjo regarding Vice President Yemi Osinbajo, and the Federal Government’s TraderMoni microcredit scheme. He made this disclosure while responding to media inquiries regarding the former president’s comments over the weekend. According to him, it is either that the former leader is ignorant of the true workings of Trader Moni and the role of the Vice President in its implementation or perhaps he is on a mischievous mission.” “The former President has demonstrated “a surprising but complete misunderstanding of the workings of TraderMoni, that is if we assume there is no mischief intended.” He continued, “Firstly, the Vice President does not personally distribute money during his visits to the markets. He goes there to assess the progress of the implementation and to create awareness for a programme designed to meet the financing need of 2 million petty traders across the country in the first instance. “Secondly, while one will not bother to further address the issue of timing of the implementation since such issues are now known to be political posturing, it is important to note that TraderMoni is being actively implemented across all states of the federation
and the FCT. It is not only Lagos and Abuja as was insinuated. “These petty traders at the bottom of the economic ladder, with an inventory often less than N5,000, are beneficiaries of the TraderMoni scheme which provides N10,000 collateral/interest-free loans to them, the empowerment that improves their small businesses, their families, while also contributing significantly to the economy. “Thirdly, in what is certainly a curious comment, the former President has also been quoted as describing the TraderMoni scheme as idiotic. To label such people-friendly scheme as idiotic is not only an absurdity, it is also an affront to the sensibilities of these hard working Nigerians, the beneficiaries of the micro-credit scheme”, he explained. Akande, however, emphasized that the Bank of Industry implements the Government Enterprise and Empowerment Programme, GEEP, one part of the current ad ministration’s Social Investment Programme, adding that enumeration agents have been engaged to visit the markets and other points where petty traders are found to confirm that they are traders and also take their biometric information for recording purposes. He said: “After the enumeration, the N10,000 collateral free loans are then disbursed electronically through the petty traders’ phones.” The Presidency spokesperson noted that the TraderMoni is designed to meet the needs of the larger population of petty traders at the
bottom of the pyramid who do not meet the more stringent criteria of BVN, bank accounts, market associations, cooperatives, required for bigger Market Moni loans. “Under GEEP – which has MarketMoni, FarmerMoni, and TraderMoni, at least 1.5 million Nigerians are already beneficiaries of the three-pronged approach of GEEP, while N-Power has created jobs for 500,000 young Nigerians graduates, besides non-graduates. Also, almost 300,000 Nigerians have benefitted from the Conditional Cash Transfer (CCT), which is given to the poorest and most vulnerable among us, and over 9.2 million school pupils are being fed a free meal daily in 26 states under the Home Grown School Feeding Programme. It bears repetition that higher economic growth potentials are associated with lower income inequality. This makes a most overwhelming case for welfare payments like the social investment schemes like the TraderMoni/MarketMoni schemes. Such a micro-credit scheme provides a higher rate of inclusion into the financial bracket and is crucial in lifting hardworking people out of poverty as has been the case in other countries like India and Brazil. Fourthly, the former president also rehashed discredited claims suggesting that TraderMoni beneficiaries were required to tender their PVCs, and questioned the timing of the implementation. Let me, therefore, state again that beneficiaries of TraderMoni are not required
to show their Personal Voters Cards (PVCs) or any document indicating their political affiliations to qualify for the loans. This is why the enumeration is done in the open markets and wherever the traders ply their trade. This issue has been addressed several times by the Presidency in the public space. Therefore the former president’s alleged comments smirk of outright mischief as it regurgitates blatant falsehood. Being a former president, Chief Obasanjo ordinarily should appreciate the impact of such far-reaching social investment schemes, which has provided what is now the largest social safety net for millions of Nigerians and is unprecedented in the nation’s history. Again, the former president’s attack on TraderMoni and the person of the Vice President is an indicator that he may be wittingly or unwittingly playing to the sinister script of the opposition party to spread falsehood and attack the social investment programmes of the Buhari administration, which champions such impactful schemes, and which is now attracting the praise and commendation of Nigerians everywhere. It is pertinent to state that the false allegations against TraderMoni raised again by the former president is sadly a rehash of baseless claims previously made by leading chieftains of the opposition Peoples Democratic Party, whose record of profligacy, corruption, and mismanagement clearly show it has no agenda to uplift the common man or improve the lives of Nigerians.
No level crossing on new Lagos-Ibadan rail line - NRC Chukwuma Eweleumo The Nigerian Railway Corporation (NRC) has said there will be no level crossings where moving trains and vehicles would cross paths on the new Lagos-Ibadan Standard gauge rail line. This is just as hawkers have defied warning by the management of NRC not sell goods inside railway coaches. NRC Lagos District Manager, Jerry Oche, explained that there would be overpass bridges or tunnels where trains would pass through on top or under instead of railway level crossing. “The frequency and speed of the train would not allow both the rail track and the road to meet
each other, it is either train on top and the road underneath for free movement. “We have about 13 of such overpass bridges between Lagos axis and Ogun, from Yaba, Jibowu, Mushin, Ilupeju bypass, PWD, Anifowoshe, Agege and others to Agbado in Ogun. “For this new standard gauge rail line, there is no level crossing where the track and the road will meet each other. “So, a situation where a truck hit the train or moving train hit a truck or vehicle will not arise on the standard gauge. “Unlike the existing narrow gauge where vehicles are crossing the tracks to the other side of the road, no such level crossing in the standard gauge,’’ Mr. Oche said.

This was disclosed by the head barrister Yusuf Hamza in an interview with The Daily Times in his office in Birnin Kebbi, he noted that the number increased unlike the previous years when the federal The government introduced a business incentive strategy (BIS), where the amounts for the registration of businesses were cut to N500. He described the influx of companies and business registration as overwhelming which he said stems from the sensitization campaigns by the commission that covered all the local governments’ headquarters in the state. Group creates voter awareness, collection of PVC through football A non-governmental organization, Tap Initiative for Citizens Development has hosted six football viewing centres in six states across the geopolitical zones of the federation aimed at promoting voter participation in election and collection of the Permanent Voters’ Card (PVC). The event which took place simultaneously during the Chelsea vs Arsenal game was viewed in Owerri, Gombe, Lagos, Cross River, Kaduna and Abuja. Speaking with news men in the Abuja viewing centre which took place at River Plate Park, the Team Lead, Martin Obono said the event was geared towards driving PVC collection and voter education. “Since official data from INEC showed that over 8million people have not collected their PVCs, we are using football, which a lot of young people are passionate about, to drive PVC collection. Therefore, for you to enter the viewing centers, you need to show you Permanent Voters’ Card.” Alfa Alut, a Chelsea fan who was one of those that won an original jersey, said that during the voter education half time show, he leant that choosing a bad coach is synonymous with choosing a bad leader, a bad governor or a bad president. “When the team lead for Tap was speaking

Novak Djokovic dropped a set for the second match running but survived a tough examination by 15th seed Daniil Medvedev on Monday to reach the Australian Open quarter-finals. Gonzalo Higuain ‘to tidy up Uganda’s Yoweri Museveni ‘bans’ sports betting Chelsea deal Tuesday’ Gonzalo Higuain will reportedly arrive in London on Tuesday to complete his move to Chelsea. Higuain is currently on loan at AC Milan from Juventus, with the 31-year-old scoring eight times in 22 appearances for the San Siro outfit during the 2018-19 campaign. The Argentine has been strongly linked with a move to Chelsea in recent weeks, however, with Olivier Giroud struggling for goals this season and Alvaro Morata on the verge of leaving the club. Higuain, who will reportedly pocket £270,000 a week in wages at Chelsea, will arrive in the English capital on Tuesday to officially complete his loan move to the Premier League club, according to The Express. The same report has claimed that Chelsea, who suffered a 2-0 defeat at Arsenal on Saturday, will have the option to extend the deal by a further 12 months at the end of the season. Uganda’s President Yoweri Museveni has ordered his government not to issue or renew licences for sports betting firms, the country’s Finance minister David Bahati has revealed. Bahati said President Museveni issued the directive because of the negative impact the betting craze has had on young people. “We have received a directive from President Museveni to stop licensing sports betting, gaming and gambling companies. The President has now directed the board which has been regulating them…. From now onwards, no new companies are going to be licensed. Those which are already registered, no renewal of licences when they expire,” Bahati told a church congregation at Rugarama Hill in Kabale town on Sunday. He was speaking at the closure of a four-day conference where he represented the President as chief guest. Bahati said church leaders who have been against sports betting can now rejoice because “their prayers have been
