Key highlights include oil price benchmark of $60, oil production of 2.3m barrels per day, exchange rate of N305 to 1USD, Gross Domestic Product (GDP) growth rate of 3.01% and a budget size of N8.73 trillion, about N400 billion less than the N9.2 trillion of 2018. The Minister of Finance, Zainab Ahmed, disclosed that FEC also granted approval for a loan of $1.5m from the African Development Fund (AfDB) to finance the multinational Lagos to Abidjan corridor highway development project study. The multinational project will be a highway with six lanes, dual carriage way project that will involve five countries, including Nigeria, Benin Republic, Republic of Cote D’Ivore, Ghana and Togo. The Minister said that the decision was taken at the 42nd meeting of the Authorities of Heads of State and Government of the Economic Community of West African States ECOWAS in 2013. “The African Development Bank in 2016, as a follow up, approved the total sum of $13.5 million for the whole project to finance both the study in form of a loan as well as a grant,” she stated. She disclosed that the entire fund had been distributed amongst the participating countries and the component for Nigeria is $1.5 million. “The FEC has approved that we accept this facility, so that the project study can be commissioned towards the planing of the execution of the highway project itself” Ahmed added. The Minister of Power, Works and Housing, Mr Babatunde Fashola, disclosed that the Ministry presented a

memorandum for the award of contract for the rehabilitation of Lagos -Badagry - Seme road project. The road project which is a total of 46 kilometers, excludes the parts from Eric More to Okokomaiko section in Lagos. He said: “Council approved 46 kilometers from Agbara to Seme border, out of which 24 kilometers will be six lanes, while 22 kilometers will retain the current four lanes to be reconstructed and rehabilitated. “FEC approved the project at the cost of N63.023 billion.” He explained that the road is part of the Lagos to Abidjan corridor while Nigeria side of it is from Eric More to Badagry to Seme border. “Ghana has done theirs, Cote D’ Ivore has done theirs, Togo and Benin have something in place. Some of them have to move because of coastal erosion by the Atlantic, and how to reintegrate all if that is part of the study that is being funded by the ADB to ensure simple and efficient border controls” The Ministry, Fashola added, also got approval for the construction of the road linking Gwarzo to Karaie, a 20 kilometers high way project in Kano State, at the cost of N1.029 billion, as well as approval to terminate and re-award the contract for the 10 megawatts Katsina wind energy project. The project with a total of 37 turbines has 15 already completed while 22 are in different stages of completion. The 15 complete are already generating about 4 megawatts of electricity and are being used by the Power Distribution Company. He explained that the main contractors are not giving government the kind of cooperation needed from them. “We found out that the local contractor that they hired is the one actually doing the job.

“We have decided to terminate the contract, and use the balance to pay the local contractor who has done 15 to instali the remaining 22. “Council approved that at N121.073 million out of the existing contract. So it is not a new contract. It is so that the contractor can complete the work in the next five months. Council also approved the African trans-Sahara highway project from Algiers to Lagos. “The Nigerian section is the Lagos to Katsina border side, transversing Ibadan, Oyo, Ogbomosho, Ilorin, Katsina, Abuja, Kano, etc. “If you look at what the President has done in the last few days, a committee on the African Free Trade agreement protocols, these are the critical infrastructuresthat link us. So, from South to North, from Lagos through the West Coast, are the interconnections on how we relate with other African countries,” he stated. Water Resources Minister, Suleiman Adamu, also announced that Council approved the revised estimated total cost for the construction of Zobe regional Water supply scheme in Katsina State, phases 1 (a) and 2, as part of efforts to complete infrastructure inherited by the Federal Government. The project was first awarded in 1992 but was abandoned, with a new contractor taking over in 2009, but was never paid. Adamu stated that the Buhari administration inherited the project at 75% completion in 2015. He said: “Council approved the augmentation of N12.15 billion to bring the project to a total of N22.1 billion with an additional completion period of 18 months”. He disclosed that the Federal Government recently signed a N10 billion agreement with the Katsina State government for the completion of the phase 1(b) of the project.

The House of Representatives, on Wednesday, passed the Electoral Act (amendment) bill into law, declaring that any elective office holder sacked by an election tribunal can remain in office and enjoy all accrued benefits until the final determination of the matter by the Supreme Court.

This new provision in the extant Act is contained in Section 143 of the amendment bill. According to the explanatory memorandum of bill, the legislation seeks to amend the Electoral Act No. 6, 2010 to make provisions for restriction in qualification for elective office to relevant provisions of the 1999 Constitution (as amended). It also provides for the use of the card reader and

other technological devices in the conduct of elections and for political parties to provide a timeline for the submission of list of candidates, criteria for substitution of candidates as well as limit of campaign expenses. Anti- graft war lands in aviation: Reps probe N60bn looting in defunct Nigeria Airways Henry Omunu, Abuja

The House of Representatives on Wednesday resolved to set up an ad hoc committee to investigate the N60billion allegedly looted by some political office holders and civil servants from the coffers of the defunct Nigeria Airways. To this end, the House resolved to reveal and make public, the identities of those indicted in the white paper with the aim of ensuring that they are prosecuted and made to refund the looted funds. Similarly, the House resolved to reveal the reasons why those indicted in the white paper have not been prosecuted despite the Federal Government’s directive to that effect. Also, the House mandated the ad hoc committee to identify any civil servant or political office holder who may have used his/her office(s) to thwart the prosecution and possible conviction of those indicted by the white paper. The resolutions were passed sequel to the adoption of a motion sponsored by Hon. James Faleke (APC, Lagos) on the need to revisit the Justice Obiora Nwazota Commission of Enquiry into the activities of the

Dogara defunct Nigeria Airways Limited. In his lead debate, Hon . Faleke, who doubles as the chairman, House Committee on Customs and Excise, stressed the need to ensure the release

of the white paper and implementation of the recommendations of the Justice Nwazota Commission of Enquiry which was conducted in 2012. He stated that there was the need to scrutinise the payment of N22.6 billion outstanding entitlements of ex-workers of the Nigeria Airways by the Federal Government. According to him, President Muhammadu Buhari has commenced the payment and offsetting of 50 per cent of the outstanding entitlements owed ex-workers of Nigeria Airways while the balance of 50 per cent in is expected to be paid in 2019. Faleke added that long before the advent of the Buhari administration, “precisely in 2002, the Obasanjo-led Federal Government had established the Justice Obiora Nwazota judicial commission to probe into the operations of the company. He said, “The commission turned in a report which revealed the mind bogging corruption and looting to the tune of N60 billion. The white paper was approved by the Federal Government which further directed the Federal Ministry of Finance and the Police to recover the stolen funds and prosecute the indicted culprits. “I am worried that till date, nothing

But before I knew it, within a few hours, I saw my picture with a story saying that I had actually given Israel ultimatum to return Nnamdi Kanu otherwise, we will send them missiles. “I just laughed. It speaks to what we are talking about fake news because it is probably the biggest threat in the run-up to the elections. “Having said that, I have nothing more to add, to the issue of Nnamdi Kanu. At the appropriate time, the various authorities will make a statement about the issue of Kanu. “But this has proven that all along when Kanu disappeared and the mob was asking the Nigerian army to account for the whereabouts of Kanu; I kept saying that Kanu knows where he is. “He was not in the custody of the Federal Government. We have been vindicated today. Any other statement will be made in due course,” he stated. The Daily Times recalls that Kanu had disappeared for several months after the Nigerian Army launched an exercise code-named “Operation Python Dance” which saw a clash between the army and IPOB members at Kanu’s hometown in Umuahia, the Abia State capital. After the incident, many, especially IPOB members accused the Federal Government of assassinating or kidnapping the IPOB leader. However, months later, Nnamdi Kanu reappeared in Israel where a video footage showed him to have gone to pray at the “Wailing Wall.” Nnamdi Kanu, thereafter, made a live broadcast through the Radio Biafra, on Sunday, where he said that the argitation for the freedom of Biafra will continue. In the broadcast, Kanu also called on the IPOB supporters not to take part in elections in Nigeria.

N6.9bn fraud: Fayose gets N50m bail, trial begins Nov 19 Peter Fowoyo

Respite, on Wednesday, came the way of former Ekiti State Governor Ayodele Fayose, as a Federal High Court, Ikoyi, Lagos granted him bail in the sum of N50 million. Fayose, who arrived in a white Nissan MV350 bus at about 8:20am amidst tight security, is standing trial on charges bordering on alleged N6.9billion electioneering campaign fraud. He was arraigned on Monday by the Economic and Financial Crimes Commission (EFCC), alongside a company Spotless Investment Ltd, on 11 counts bordering on the offence. He pleaded not guilty to the charges while the court had adjourned the case for hearing of his bail application. The court also ordered his remand at the EFCC’s custody in the interim. At the resumed hearing of the matter on Wednesday, the lead lawyer to Fayose, Mr. Kanu Agabi (SAN), moved a motion for bail of the accused before the court. He told the court that the application was dated October 22 and brought pursuant to the inherent jurisdiction of the court. According to him, there is a presumption of innocence of an accused until guilt is established,

adding that the ex-governor is very eager to see the conclusion of the charges before the court and so, will not jump bail. He told the court that Fayose willfully submitted himself to the EFCC, immediately after leaving office as governor, which shows his readiness to face the charge. He urged the court to grant bail to the accused on self-recognisance as a former governor. But the lawyer to the EFCC, Mr. Rotimi Jacobs, SAN, informed the court of a counter affidavit in opposition to the bail. He told the court that although bail is a constitutional right, there were limitations. Jacobs said, “The issue of presumption of innocence has to do with trial and for now, no one is saying he is guilty.” According to him, the prosecution is also eager for an accelerated hearing of the case and urged the court to order an accelerated trial. Jacobs also opposed the application for bail on self recognisance on the grounds that being a former governor was not a yardstick for granting bail, as it does not guarantee attendance of the accused in court. He expressed concerns that intelligence reports reveals that the accused will interfere with witnesses and proceedings, and may jump bail if granted.

He urged the court to refuse bail on his laid down arguments. But Justice Mojisola Olatoregun in her ruling on the bail application, noted that the allegations proffered by prosecution in its counter affidavit were grave, but that the accused would be given a benefit of doubt. The Judge then said: “The defendant is admitted to bail in the sum of N50million with one surety in like sum,” She added that the surety is to present a bond of N50 million from a reputable insurance company or a first line bank which is acceptable by the court. She held that there must also be the production of three years tax clearance, while the accused must ensure he attends court for trial unfailingly, otherwise, the bond will be forfeited. The court also ordered that the passport of the accused should be deposited in the court’s registry and adjourned the case until November 19 for trial. According to the charge, on June 17, 2014, Fayose and Agbele were said to have taken possession of the sum of N1.2 billion, for purposes of funding his gubernatorial election campaign in Ekiti State, which sum they reasonably ought to have known formed part of crime proceeds. Fayose was also alleged to

have received a cash payment of the sum of $5million (about N1.8 billion) from the then Minister of State for Defence, Sen. Musiliu Obanikoro, without going through any financial institution and which sum exceeded the amount allowed by law. He was also alleged to have retained the sum of N300 million in his bank account and took control of the aggregate sums of about N622 million which sum he ought to have known formed part of crime proceeds. Fayose was alleged to have procured De Privateer Ltd and Still Earth Ltd, to retain in the FCMB accounts, the aggregate sums of N851 million which they reasonably ought to have known formed part of crime proceeds. Besides, the accused was alleged to have used the aggregate sums of about N1.6 billion to acquire properties in Lagos and Abuja, which sums he reasonably ought to have known formed part of crime proceeds. The accused was also alleged to have used the sum of N200 million to acquire a property in Abuja in the name of his elder sister, Moji Oladeji, which sum he ought to know also forms crime proceeds. The offences contravenes the provisions of sections 15(1), 15 (2), 15 (3), 16(2)(b), 16 (d), and 18 (c) of the Money Laundering Prohibition Act 2011.

Speaking when he received a delegation of the European Union of the Election Exploration Mission to Nigeria led by Niclay Paus, who called on him on Wednesday, Secondus said that all intelligence available to the

party shows that the ruling All Progressives Congress (APC) has concluded arrangement with INEC to manipulate the electoral process. In a statement by his media aide, Ike Abonyi, the PDP National Chairman said that what happened at the governorship election in Osun State merely underscored the party’s fears that INEC is not ready to be neutral. He said that even though the main agent of the APC in the Commission, a relation of the President, Amina Zakari, was deployed from operations department, the party asked for her total resignation as she

is capable of influencing others within the electoral body. “When we eschewed violence after the electoral theft in Osun State and decided to excise our right to peaceful protest, the Inspector-General of Police directed his personnel to tear gas us notwithstanding the personalities involved in the protest, the Senate President, Speaker of the House of Representatives, five state governors and National Chairman and members of the National Working Committee (NWC) and other critical leaders. “Our fear is strong that the APC and the administration

While three of the commissioners - Alhaji Ibrahim Mohammed (Kaduna), Prof. Aminu Dio Sheidu (Kogi) and Mr. Simon Etim (Akwa Ibom), had their appointments renewed, the other 10 had fresh appointments. The Senate has accused Kaduna State Governor Nasir el-Rufai of complicity in the recent crisis in some parts of the state leading to the death of almost 100 persons and wanton destruction of property worth’s several millions of nsira. The governor took the knock from Senators who took turn to dissect the unfortunate situation in the state during plenary on Wednesday. The Senators as well held the federal government responsible for the festering of killings across the country due to government negligence and conspiracy by elite. Governor el-Rufai’s absence in the state at the inception of the crisis was described as a calculated plan by the governor who was accused of having a fore knowlege of the event. The Senators also said the attacks and killings in the state were indicative of religious and ethnic violence and that relevant leaders are not rising against it. These were consequent upon a motion by Senator Suleiman Hunkuyi (PDP, Kaduna North) who standing on Senate Order 42 and 52 lamented the “unfortunate, unmindfui, inhuman and avoidable Killings” in Kaduna State. He said despite the 24 hours curfew slammed on Kaduna metropolis and environs, Hunkuyi said killings were going on unabated. According to him, the recent attacks on Kasuwan Mageni community of Kaduna State witnessed scores of people killed while a paramount ruler was abducted. He faulted the role of state government in ensuring the release of the victim and further noted that at the moment, following the 24-hour curfew, disturbing peace is gradually returned. The senators were disturbed that gruesome and mindless killings are being carried out in communities across the country with relevant security agencies, and particularly the executive arm of government deliberately

refusing to evolve proactive measures to contain it. The Upper Chamber noted that government is shielding those behind the dastardly act and that except the killers are fishedout, the country would not know any peace. Also, it said security agencies are not discharging effectively its responsibility of intelligence gathering and further challenged it to act responsively. Contributing to the debate, Senator Shehu Sani (PRP, Kaduna Central) condemned the attacks and killings in its entirety, and stated that the situation will persist unless the people embrace peace and tolerance. He said the time has come to avoid hate speech and divisibility to foster tranquility. Also, Senator Danjuma La’ar (PDP, Kaduna South) said “all the crisis in Kaduna state are caused by the governor (el-Rufai).” He alleged that elite know the killers but are only hiding from revealing them. Other lawmakers who spoke on the matter include Sam Egwu (Ebonyi North), Kabir Marafa (APC Zamfara Central) and Philip Gyunka (Nasarawa Central), all condemned the killings and charged security agencies to arrest and prosecute the assailants. Senate President, Dr Bukola Saraki, led the Senators to observe a minute silence in honour of the departed souls. He said it is high time the security problem in the land must be stopped. Consequently, the Senate resolved to immediately constitute a central committee to interface with the executive arm of government so as to evolve adequate security measures and end the killings. While calling on Kaduna and federal governments to quicken the process to the release of the adopted traditional ruler, it further urged NEMA to assist those in need, provide food and medicals to the affected persons. It however, directed security agencies to invest and proffer solutions to permanently avert the killings, as well as call for implementation of recommendations of the Senate on the national security summit.

Apple and Samsung are being fined €10m and €5m respectively in Italy for slowing down older phones with software updates. An investigation launched in January by the nation’s competition authority found that certain smartphone software updates had a negative effect on the performance of the devices. Believed to be the first ruling of its kind against smartphone manufacturers, the investigation followed accusations operating system updates for older phones slowed them down, thereby encouraging the purchase of new phones. In a statement, the antitrust watchdog said “Apple and Samsung implemented dishonest commercial practices” and that operating system updates “caused serious malfunctions and significantly reduced performance, thus accelerating phones’ substitution”. It added the two firms had not provided clients adequate information about the impact of the new software “or any means

of restoring the original functionality of the products”. Samsung told owners of its Galaxy Note 4 phone to install a new version of Google’s Android operating system intended for the more recent Galaxy Note 7 but which users claimed rendered the old model sluggish. Likewise, Apple told iPhone6 owners to install an operating system designed for the iPhone 7, leading to problems for owners of the older model. Both firms were issued the maximum fine of €5m each and ordered to display a notice on their Italian websites informing customers of the watchdog’s decision. Apple was fined an additional €5m for failing to give customers clear information about “essential” characteristics of lithium batteries, including their average life expectancy, how to maintain them or eventually replace them in the firm’s iPhones. Apple acknowledged in December that it had intentionally slowed iPhones with degraded batteries through software updates to avoid sudden shutdown problems, but denied it had ever done anything to intentionally shorten the life of a product.

NHIS boss Yusuf and insolent child of impunity

Those tempted to view corruption only in materialist terms, overlooking the abstract subversion of norms and values, will perhaps be forced to have a rethink by simply following the farcical drama currently unfolding at the National Health Insurance Scheme (NHIS). Equating his kinship with President Muhammadu Buhari to a talisman, the embattled Executive Secretary of NHIS, Prof Usman Yusuf, was not content with only breaking all extant service rules, he went a step further by daring constituted authorities at the health ministry to hold him to account. Directed by the then acting president (Yemi Osinbajo) to examine a slew of petitions against the NHIS executive secretary, Minister of Health, Prof Isaac Adewole had little or no difficulty in asking him to proceed on a three-month suspension to enable an unimpeded investigation. Unsatisfied with the defence made by the embattled ES to the weighty charges against him, Adewole had written: “Consequently, you are directed to proceed on three months suspension with immediate effect to pave way for an uninterrupted investigation, in accordance with Public Service Rule.” Tellingly, the workers’ union in the agency were the first to applaud the minister’s action as the right step to curtail what they described as the “primitive stealing going on”. But in a leaked memo dated July 12 (2017) addressed to the minister responding to his suspension over alleged massive graft, among other actions unbecoming of a public officer, the Katsina-born professor pointedly declared that he was not answerable to anyone other than President Muhammadu Buhari (PMB), casually hinting that he would rather sit tight. Drawing confidence apparently from a mis-reading of sections of the NHIS law, he claimed that only the man who appointed him on a renewable term of five years was capable of questioning his actions or conduct. His words: “By virtue of the NHIS Act particularly section 4 and 8 thereof, my appointment and removal from office whether by way of suspension or otherwise is at the instance of the President of the Federal Republic of Nigeria.” The waters would be muddied further following a counter-motion by the House of Representatives ordering Yusuf’s reinstatement. According to the House, Yusuf’s suspension is

prejudicial to an ongoing investigation into the whereabouts of N351 million allocated to the agency between 2005 and 2016. Well, let it be said that the freedom of the House to issue express orders does not include the power to compel the minister’s obedience in the circumstance. In any case, when mighty logs fall on each other in the bush, as they say, common sense dictates that evacuation starts with the one on top. Yusuf’s thinly disguised arrogance surely bespeaks a mindset never seen in public service at that level in recent history. By his academic standing, a man assumed to be professor can hardly be accused of illiteracy and, therefore, cannot be excused for confusing the meaning of delegated authority. By virtue of being a member of the federal executive council, a minister is the president’s agent and the principle of agency therefore entitles him to exercise his principal’s authority in his assigned station. Indeed, legion and weighty are the charges against Yusuf. The last straw that apparently broke the camel’s back was his decision to buy himself a N58 million SUV from NHIS funds, way above his N2.5 million approval limit, without the knowledge nor the concurrence of the supervising ministry, despite the fact that his office already had a number of serviceable SUVs. In the absence of PMB, an acting president is supposed to be in place, whose power the health minister would seem to invoke in directing that Yusuf proceed on suspension. So, only sheer impunity and contempt for everyone, except PMB, could have led Yusuf to word his reply to the minister in the insolent manner he did. Intoxicated by transient power, the little wayfarer from Katsina seems incapable of realising yet that such indiscretion invariably does incalculable damage to PMB, his benefactor. If nothing at all, this will certainly be cited as another exhibit in the now not-so-subtle protestation against the lopsidedness in Buhari’s key appointments, seen as a form of sleaze on its own. Obviously a product of nepotism, Yusuf has instinctively been feeding the web as well. Among his first actions in office was said to be the appointment of his younger brother as general manager (Legal) and his niece, a level 8 officer from the Economic and Financial Crimes Commission (EFCC), catapulted to grade level 13 at the NHIS. Already, there are reports that the suspended

ES has been telling people that he is being “persecuted” for his refusal to meet an “illegal financial request” by the minister. Well, we honestly cannot rule that out. But even if that were true, it hardly absolves this clear case of mutiny. Nor will that be sufficient immunity not to answer the substantive charges of impropriety against him. Therefore, the relevant authorities had better ensured appropriate sanctions are meted to him as restitution for this act of rank insubordination in the first place, even if he is eventually found guiltless of the litany of sins he was originally accused of. Before he landed the “juicy” appointment in 2016, very little was known of Yusuf beside his stint at an obscure medical address in the U.K. and later being found around one influential Kaduna-based contractor. Considering the nature of the operations of the NHIS, not a few industry experts had expected someone with managerial or financial capability would be appointed. When the professor of “hematology, pediatrics and oncology” was eventually named the new NHIS boss, many were inclined to assume that his kinship with President Buhari largely influenced the appointment, more than merit. But no sooner had he assumed office than alarm bells started chiming literally all over at NHIS, the same way the domestic fire alarm is triggered by a whiff of smoke. He seemed in a great hurry to turn the office into a vending machine for contracts that were often grossly inflated and incestuous. First was a phony N400 million training contract allegedly awarded to his “benefactor and confidant”, with a view to decimating the N860 million set aside for “training” in NHIS’ 2016 budget. But in reality, according to one of the petitioners, “In one of the trainings, a course fee of N520,000 per staff for three days was approved without recourse to diligent planning but with the mindset to profiteer (sic) his cronies. After a lot of hue and cry from the general staff, the fee was cut to N270,000 under suspicious circumstances. “Thus the fraud began, most of these trainings which were scheduled to hold across the 36 states and the FCT never held, while those that held was incomparable to the funds which had all being released for the trainings. There was absence of training materials in most of the designated venues of the trainings.

“Multiples payment vouchers ranging (from) N19 million, N18 million (to) N21 million were raised to cover up for the payment of over N400 million for these trainings. “All these spendings he carried out were above his approval limit, but he was always heard to claim that he has the ears of the president, they being from the same state, and whatever your complaints, they will go nowhere.” There is another allegation that the contract for supply of e-library equipment to a company (Promatrix Global Resources Ltd) to the tune of N28 million was pre-paid before execution against procurement rules. In another deal, a princely N150 million was allegedly paid to a consultant “in the training of report writing”. The beneficiary? Yusuf’s own brother. For now, we can only hope the administrative panel will carry out a forensic investigation and ensure justice is served. But while awaiting the outcome, we can at least take solace in being provided yet another aperture onto why output never really measures up to input in Nigeria. Sleaze or “job for the boys” certainly was not part of the promises made to the nation when the NHIS was first unveiled in 1999. Rather, the mission statement outlined its goal as a quest to bridge the deficit in the nation’s healthcare, targeting government employees, the organised private sector, the informal sector, children under age five, disabled persons and prison inmates. Between then and now, a whopping N351 billion has been expended on the NHIS, with little or no impact felt by the citizenry. In fact, 18 years after, national coverage is today put at an abysmal 1.5 per cent. In the current year, revitalisation of over 10,000 primary healthcare centres (PHC) was listed among NHIS’ priorities, targeted at the most vulnerable in the society, including rural women and children. But the funds earmarked for essential drugs for the people are rather diverted into providing luxury and comfort for officials. Life expectancy remains at 52 years. Malaria prevalence rate is still around 11 per cent. Maternal mortality rate is still high. Under five mortality rate is still over 10 per cent. Meanwhile, as things continue to fall apart in public hospitals on account of stolen budgets, more and more Nigerians now resort to churches and shrines in search of healing.

Restructuring and dynamic governance in Nigeria

The debate on restructuring Nigeria along the path of a weaker and leaner federal government and more autonomous and stronger federating units has been ongoing for some time. Although there has been no consensus on the exact contours of the restructuring process, especially whether states have to remain as they are, or if some states will be merged to become more selfsustaining entities, however there is a virtual consensus for the devolution of powers to the federating units. But the exact powers and duties to be devolved to these federating units is still a subject of controversy. The restructuring argument has been posited as a magic or silver bullet that will cure Nigeria of most of its ailments. It has been stated to be the tonic that will release the energies and harness the potentials of the various cultural, regional, social and geographic entities within the Nigerian federation. The arguments in favour of restructuring have gained more vibrancy and urgency since it became a cornerstone of the campaign position of some presidential candidates. The older generation of Nigerians have a rather romantic memory of the days of the regions, when the autonomy of each area ensured some level of resource control and every region developed at its pace, with the spirit of competition and a race to the top driving them. This discourse agrees with the need for a restructuring which will give greater autonomy to the federating units to harness their resources, build their infrastructure, provide education and health, etc. and pay taxes to the federal government for the maintenance of common policy positions relating to such issues as defence, the currency, etc. However, it is imperative to warn that restructuring alone, not coupled with other reforms, is bound to fail and will give restructuring a bad name so that a clamour for centralisation will arise

thereafter. Restructuring must go inter alia with other reforms, especially around the areas of enhanced anti-corruption laws and policy implementation, transparency and accountability. The postulation is that if more resources and responsibilities are entrusted to state governments, with the current status of an almighty governor, who is an emperor and no one questions, with a subservient legislature in the State House of Assembly, whose principal officers are anointed by the governor, restructuring will provide the leeway for the unbridled stealing of public resources, pauperisation of the masses and mass misery. Governors account to no one but their conscience, which are dead. They brook no opposition in their states and with the party line-up and hierarchy in their pockets, they determine who becomes a senator, a member of the legislature at the federal and state levels and chairmen and councilors at the local government level. Governors are extremely brazen in their misconduct. The best example is their manipulation of local government elections and local government funds. In each state, despite the clear provisions of section 7 of the Constitution calling for a system of democratically elected local governments, most governors appoint caretaker committees. They refuse to hold elections into local governments and when they agree to do so, it is usually towards the end of their tenures. Also, if they conduct local government elections, the results are usually scandals. Governors usually constitute a supine State Independent Electoral Commission that will always announce that the ruling party swept all the contested seats. In many of the states, it is a clean slate as they hardly concede any chairmanship position to the other parties. They could be magnanimous to give the opposition a few councilors. For local government funds, governors using the state-local government

joint accounts, simply steal most of the money. Despite billions of naira accruing to all local governments across Nigeria, hardly can any state government account for up to 50 per cent of the accruals and internally generated revenue since 1999. Since 2015, the federal government has released several bailout packages and paid up previous monies due to the states. The federal government had specifically urged the states to use the monies to pay workers’ salaries and entitlements. However, most of the state governors simply pocketed the monies and refused to pay the poor workers. Criticising a governor in a state is seen as treason. Over the years, the federal government has been more tolerant of opposition, in comparison to state governments. Again, so called progressive state governments have refused to provide information on their budgets, especially the details of what they spend public resources on. They postulate that the Freedom of Information Act does not apply to the states and have taken the challenge up to the Supreme Court, asking the court to rule in their favour. Essentially, governors are proposing a right to manage public resources without a concomitant duty to account to tax payers and the people through whom they derive all their purported powers and authority, vide section 14 of the Constitution. It is within this context that any further powers, duties and resources made available to governors with this mindset is like pouring water into a basket. It will be wasted as it would not lead to development. The poser arises: What accountability and transparency reforms should therefore accompany restructuring? The first is on internal democracy in political parties, which guarantees that no single individual commands the structure of the party in a bid to determine who becomes a candidate or otherwise. Party primaries should be by direct suffrage so that party members will

be free to hold conscience-based positions that may conflict with that of the governor. Requisite amendments to the Electoral Act can secure this. The second is that State Independent Electoral Commissions must be made independent indeed to avoid the manipulation of state level elections. The third is that state level auditor generals need to be strengthened and made really independent to oversee state level expenditure and put the audit reports in the public domain. Strengthening should be through a review of the appointment procedure to take it away from politics, secured tenures, funding from the first line charge and an Audit Service Commission to attend to recruitment, discipline and general policy matters. The second and third can be secured by requisite constitutional amendments. The fourth is about budgetary reforms which guarantee that budget formulation, approval, implementation, monitoring and evaluation should no longer be done secretly. Certain components of education and health should become fundamental rights, with a caveat that provisions must be made for them before other budgetary expenditure. All the information about the foregoing budget issues should be available to the public through relevant portals and the Freedom of Information Act should be applicable to every state. The fifth is that certain definite misconduct, not subject to the discretion of the legislature, must now automatically trigger the removal of a governor from office. For instance, any governor who owes salaries and pensions over and above six months, must be made to vacate office. Legislation and policy can secure the last two issues. The above list is not exhaustive of the kind of laws, policies and action that can improve accountability and transparency at the state level. It is a list designed to kick-start a debate about subnational accountability within the context of restructuring.

Editorial Commentary Revisiting ‘much ado about true federalism’

People talk about ‘TRUE federalism’ as though there is a particular form of it that is sanctified -and to the extent of which all other forms of it which depart from that sanctity, are necessarily sullied and therefore ‘false’ or ‘untrue’. There is so much noise about Nigeria not practicing ‘true federalism’; or rather practicing a ‘unitary’ system in the disguise of a ‘federal’ one. But truth is no system of power-sharing can be practiced in the guise of another. A system of power-sharing is either ‘con-federal’ and therefore neither ‘unitary’ nor ‘federal’, or it is either ‘unitary’ or ‘federal’ to the exclusion of one and the other. Plus there is neither a ‘true’ nor a ‘false’ form of any of the three, the same way that a person cannot be any less or more ‘human’ merely because he is leaner or fatter than others. A ‘confederal’ system is a loose alliance of independent states in full control of their citizens, territories and resources, but bound by a weak center funded by them to take care of issues of common concern –usually military or commercial or both. Neither the degree of the weakness of the center nor the extent of the looseness of the alliance, nor again the scope of the independence of the states, can make it any less con-federal or any more so. It is sufficient only that this ‘loose alliance of independent states’ is ‘in full control of their citizens, territories and resources’, and that they are ‘bound by a weak center funded by them to take care of issues of common concern. It is thus a misnomer to say that a system is a ‘true’ con-federacy –the way we bandy the term ‘true federalism’- when in fact, there is no proof that a ‘false’ form of it exists. Or, away from the extreme of ‘loose’ confederacy, a system can be tightly ‘unitary’, with laws conferring virtually all authority to a central, powerful government which controls all the citizens, territories and resources and, at will, can either benevolently delegate to, or malevolently retract, duties from the constituent administrative units, namely the other tiers of government. A unitary system cannot be any less or more so merely because it delegates or retracts less or more duties to or from these constituent units. It is sufficient only that a unitary system arrogates the power to do or not to do either of these. And so it is equally a misnomer to say that a system is ‘truly’ unitary –the way we bandy ‘true federalism’- when there is no proof that a ‘false’ form of it exists. A ‘federal’ system on the other hand allows, at least, the sharing of ‘power’ and ‘resources’ between a much stronger center and its constituent states which, depending on countries, may or may not enjoy varying degrees either of constricting or of expanding ‘autonomy’ –sometimes even bordering on partial ‘independence’. And although the fundamental attribute of a ‘federal system’ basically is that ‘power’ and ‘resources’ are shared between a strong center and its constituent states, most ‘federal’ systems, almost in a con-federal fashion, are not averse to granting substantial autonomy to states to control even their citizens, their territories and their resources. But this is not to suggest that any such ‘federal system’ that does not do so is any less ‘federal’ than those which do. Bringing us to the same fact, that a ‘federation’ is so called essentially because it allows, even if at the very least, the sharing of ‘power’ and ‘resources’ between two levels of governmental administration, and not necessarily because the central level allows ‘substantial autonomy’ to the constituent parts to control their ‘citizens, their territories and their resources’. Nor will a ‘federal’ system suddenly become ‘unitary’ –as we often allege ours has- merely because it has not moved from ‘sharing power and resources’, to granting ‘substantial autonomy’ to its constituent states to control their citizens, their territories and their resources. And so, theoretically-speaking or even if existentially so, a system is either ‘federal’, no matter how profoundly or superficially so, or it simply is not! And so if a system is not ‘federal’ in structure it can only either be ‘unitary’

or ‘con-federal’ in its make up. It cannot be a hybrid of one or a crossbreed of the other. The history of these three forms of power sharing arrangements essentially does not admit of classification or definition by halfmeasures: a cup of these systems is neither ‘half-full’ nor ‘half-empty’! It is either ‘full’ or it is simply ‘empty’. Nnamdi Kanu as “Wailing Wailer” Nnamdi Kanu, leader of the separatist Indigenous People of Biafra (IPOB) movement suddenly resurfaced in Jerusalem, Israel at the Wailing Wall, after his oneyear disappearance that resulted in speculations about his whereabouts. Kanu has since issued a statement through Radio Biafra in which he denounced the Nigerian state and boasted that no Nigerian court can do anything to him. Before disappearing from sight, under the cloud of the invasive Operation Python Dance in his home state of Abia, IPOB leader Nnamdi Kanu had accused the Nigerian government of trying to kill him and destroy the Biafran movement that he leads. He has now been quoted as saying: “(The) Nigerian court is a kangaroo court. I did not jump bail. I left because the court failed to protect me. I shall not be honouring the court. I cannot be tried by a court I do not recognize. Nigeria cannot jail me.” Whatever may be the quality of Nnamdi Kanu’s grievances, he must be told in clear terms that he cannot make such claims of superiority to the state as he has done. No non-Nigerian can even say that Nigerian courts are unacceptable and yet engage in acts that could have implications for Nigeria’s sovereignty. Kanu says he escaped during the invasion of his home by Nigerian soldiers. We have condemned that invasion its manner, style and intent. We have defended the right of indigenous peoples to ask for self-determination, under the right circumstances. But no other Nigerian, including Igbos, believes that Nnamdi Kanu is superior to the Nigerian state. He is on record as having said: “I am Nnamdi Kanu, no mortal flesh can kill me. They have not given birth to that very person. Since they didn’t want me to come to court, I shall come back to Biafra land…” If no mortal flesh can kill him, why run away then? Plea-se! Some other reports indicate that when Nnamdi Kanu returns, he will bring “hell”. I am not sure that is a correct public statement to make. I do not see many Nigerians who are looking forward to a promised “hell”. They are in hell already. And they are not likely to rely on the words of a man who vanished, when the Nigerian hell became too hot, but he is now bragging that he will return and lead his followers to a hotter part of hell. When and if Kanu returns, (he is probably just bluffing), he may find a smaller crowd behind him. What will he say to the many families who lost loved ones and property while he and his own family fled to safety? “I owe my survival to the state of Israel”, Kanu says. “I want to send my solidarity to @ GovAyoFayose”, he purportedly added. There may be politics tied to Nnamdi Kanu’s return. Why now, when an Igbo man, has been named by the opposition party as Atiku Abubakar’s running mate? Is anyone using Nnamdi Kanu as a curve ball to frustrate the Atiku-Obi ticket? Who dragged him out of whatever hole he crawled into, now to use him to play politics? However, by his conduct, and utterances, Kanu has watered down the potency of the revolution that he leads. He disappointed many. He has also failed to realise that while he was absent from the battle front, the dynamics of the revolution changed. He wants to hold a Biafra referendum. The only referendum Nigerians are interested in at this moment is a referendum on the Buhari government. Nnamdi Kanu and associates should tarry a while. You can’t just jump off the train of revolution and expect to jump back, at an opportune time, from the Wailing Wall in Jerusalem, with a ticket made of spittle and a sheet of prayer requests.

OUR POSITION

13.2 million out-of-school children and matters arising

N

igeria with the current figure of 13.2million out-of-school children occupies first position on the table of countries with the highest number of out-of-school children in the world certainly calls for sober reflection. More worrisome is the fact that the figure instead of decreasing in the last few years is rather increasing. This statistics which represent approximately 20 per cent of the world’s population of such children is an alarming and ticking time bomb that will spell doom for the country if urgent steps are not taken by relevant authorities to address the situation. We observe that governance in Nigeria has become a circle of family business where politicians secure the future of their children to the detriment of poor Nigerians. Also, inadequacy of funding, lack of teaching tools and modern classrooms, poor numerations and the acute shortage of qualified teachers are some of the factors leading to the fall in the standard of education in Nigeria. Recently, the Multiple Indication Cluster Survey report for 2016 (MICS 2016) revealed that out of the 11.5 million of out-of-school children in Nigeria, Northern states have the highest rate with an average of 69%. The latest data MICS 2016 showed that out of the 11.5 million out-of-school children in Nigeria, 7.5.million (69%) are from the Northern part of the country while the North East has the largest number of out-of-school children followed by the North West. With this number, Nigeria accounts for more than 1 in 5 number of out-of-school children globally and 45% of this number are from West Africa. Within the huge number of the out-of-school children, girls are the majority especially in Northern Nigeria. Education indicators for Northern Nigeria are however different from the Southern part of the country. Nigeria’s future prosperity depends on producing children who are well prepared to take their right place in the society but unfortunately, a large number of Nigerian children are at risk of deprivations of the basic social amenities. Most of these children are situated in the rural areas and hard to reach communities. Majority of them are living in conflict and communities under emergencies, and it has been difficult taking basic amenities to them. All children have the right to better life, an opportunity to survive, develop and reach their full potentials without discrimination, bias or favouritism which cannot be over emphasised. We also observe that the rising number of children engaged in street trading in our major cities is becoming a worsening menace. The problem is further exacerbated by rising poverty and general insecurity in the country. In the North, the ravaging insurgency has added to the problem. If drastic measures are not taken to correct the situation, things would only get worse. Let us learn from France, Britain, Canada and other advanced countries which built the foundation of their countries and rapid technological advancement on good and quality education. It must be pointed out also that in these countries, teachers are amongst the best paid workers. Unfortunately, the reverse is

the case in Nigeria. Having failed to fund public education, the children of the poor are roaming the streets, hawking goods while the rich are educating their children in private schools at home and abroad. But to the detriment of the society, the abandoned children of the poor are being recruited to criminality by terrorists, kidnappers and other criminal gangs. The irony of the crisis is that a government, which claims that it lacks money to fund education is spending several billions of naira to fight insurgency, kidnapping, armed robbery and banditry. We believe that an uneducated population will be locked in a cycle of poverty for their entire lives. Additionally, these children could constitute the next generation of suicide bombers and militants. We are of the opinion that it is high time the government and relevant stakeholders address the problem frontally. It is sad that government’s free education for all pupils up to the first nine years of schooling has not been fully implemented. There is the need to increase the percentage of the annual national budget that goes to education. Schools should be adequately funded and the enabling environment provided for teachers and support staff to deliver functional and effective education to the children. We submit that the improvement of the classroom environment is key to lowering the growing figures of out-of-school children in the country. We also wish to state that teachers must not only be well trained, their welfare must be prioritised while the Federal Government should muster the political will to adequately fund education.

Navy arrests 6 oil bunkering suspects in A’Ibom Isaac Job, Uyo The Nigerian Navy Ship, Jubilee, Ikot Abasi has arrested six suspects for illegal oil bunkering and seized three truckloads of illegal AGO from them. The Nigerian Navy also confiscated storage tanks, generators and oil host used for illegal oil bickering site at Ikot Ibiok, in Eket council area of Akwa Ibom State Parading the suspects yesterday after the arrests, Captain Suleiman Ibrahim, Executive Officer of NNS Jubilee who represented the Commander NNS Jubilee, Commodore Ayerinade Akinwale said they were able to apprehend them through intelligence report, and cautioned people to refrain from involvement in the illegal business.

“We received credible intelligence in the early hours of 23rd October, 2018 at exactly 001 hours (1am). On that basis, we deployed our anti crude oil team and we came to this spot where we are and when we got here we intercepted an illegal operation that is ongoing. “You have seen three trucks which is fully loaded with illegally refined AGO (Automative Gas Oil) and there are also five storage tanks. We are also lucky to arrest six suspects who are remotely connected to this operation. The oil on the ground cause environmental damage. “We can only arrest and hand them over to the NSDC team who would then prosecute the suspects in the court of law. We appeal to all those people involved in these illegal activities to desist from this act

because it is not only an economic crime, it is an environmental crime. But if they refuse, wherever they are and whenever, we would arrest them and make sure they are prosecuted,” he said. In an interview one of the suspects, Eyakeno Isaac, said he was introduced into the business by his friend and it was his first time, adding that he is a mason and was involved in the illegal business because he had no more work as a mason and has to survive. “My friend called me to work here and this is my first time of coming here. My friend that brought me here escaped when the place was raided. I am a 33 years old mason but I no longer get jobs; I have two children and they have been sent out of school”.

Fund Amnesty Programme, ex-police chief urges FG Joseph Inokotong, Abuja A former Federal Capital Territory (FCT) commissioner of police (retd), Lawrence Alobi, has urged the Federal Government to sustain and adequately fund the Presidential Amnesty Programme to maintain the prevailing peace and security in the Niger Delta. Obi meets with EU, WEF delegations on 2019 poll, economic cooperation Vice Presidential candidate of the Peoples Democratic Party (PDP), Mr. Peter Obi, on Wednesday in Abuja, met with delegations from European Union (EU) and World Economic Forum (WEF) to discuss the need to conduct free and fair elections in 2019 and how to grow the nation’s economy through collaboration. Obi, who represented the Presidential candidate of the party and former Vice President of Nigeria, Atiku Abubakar at the two separate meetings, told the EU delegation that efforts should be made to stop the ruling party, APC, from intimidating candidates of opposition political parties who, he said, now live in fear. He said that the EU should insist on a level playing field for all candidates and parties during elections in Nigeria because ``there is a need to get the country back to its feet and make it better for our children’’. He said that campaigns should be based on issues so that the electorate and the international community can come to grasp with the problems of the country as well as the solutions being proffered by each of the political parties and their candidates.

Obi also said that there was need for agencies like the EU to strengthen and support the Independent National Electoral Commission (INEC). The former Anambra Governor said that judging from what happened during gubernatorial elections in Ekiti and Osun states, INEC needs to show that it remains an unbiased umpire in future elections in the country. On the issue of vote buying, Obi described the incidence as a new phenomenon and which must be stopped. ``I contested and won elections when I was in a smaller party. Where would I have gotten the money to buy votes if it was the case then and how would I have gotten back the money especially when I am going to serve the people,’’ he said. EU election observer group following the impending expiration of the tenure of the present group, Obi said that Nigeria deserved a replacement based on the role EU would play in ensuring free and fair elections in Nigeria in 2019. In his comments, the head of the EU delegation, Ketil Karlsen, said that the election observer group has been consulting stakeholders in Nigeria to ascertain whether or not it would be necessary for the union to send a new EU election observer mission. He said that the EU mission had been operating in Nigeria since 1999 and that the union had invested over 100 million Euros in Nigeria’s election process since then. Speaking at the meeting with officials of WEF, Obi emphasised the need for closer working relationship with African countries especially Nigeria because most governments in the continent do not want to work with the forum for fear of being criticized. He said that many governments in Africa implement activities that are`` transactional instead of transformational’’ and therefore needed help to shape their policies.

Members of the All Progressive Congress (APC), in Akure North Local Government Area of Ondo State have expressed satisfaction with the candidate that emerged during the party’s House of Assembly primaries, Abiodun Faleye. In a communiqué attended by the 11 ward chairmen of the local government on Wednesday during an emergency meeting, it was resolved that members of the party have given their approval that Faleye should be the party’s standard-bearer for Akure North state constituency in next year’s elections. Gov Fayemi signs executive order, stops illegal fees in schools Gbenga Sodeinde, Ado Ekiti As part of his promises to secure a pride of place in the education sector of Ekiti state, Governor Kayode Fayemi has signed an Executive Order banning various fees collected by some principals, head teachers and other school officials. Also as a way to prioritize public workers’ welfare, he has equally approved N200 million as car and housing loans for teachers in public schools in the state to boost their morale. The governor had last week paid off part of the leave bonus of the Local Government in the state. Fayemi disclosed that the loans will be disbursed on or before November 15 adding that payment of arrears of salaries owed by the last administration will commence any moment from now. Speaking after signing the executive order at a ceremony held at the Governor’s Office, Ado Ekiti on Wednesday, Fayemi said it also provides for free and compulsory education in government owned primary and secondary schools.

They specifically asked the Court to determine whether the 5th defendant has the power or right to withdraw and spend the sum of $ 462,000,000.00 or any other amount whatsoever from the public fund of the Federation on the payment for or purchase

of Super Tacano Aircraft without prior approval of the 2nd and 4th ( National Assembly). Whether the absence of any provision in the 1999 Constitution of the Federal Republic of Nigeria or any other legislations the President has the right to so acted by the withdrawal of the sum without approval of the National Assembly. Whether the 1st, 2nd, 3rd and 4th defendants National Assembly have any legal or Constitutional powers, duty, privilege jointly or severally to consider for ratification or approval retroactively any withdrawal expenses made by 5th defendant (the President) including $ 462,000,000.00 contrary to the provision of Sections 80,81,82 of the Constitution on the alleged purchased of Super Tucano aircraft.

Ondo State Governor, Oluwarotimi Akeredolu has challenged labour leaders in the state to produce evidence that the state government received the last tranche of the Paris Club loan refund paid by the Federal Government. Flood: Gov Dickson approves additional N100m for relief materials, resettlement of victims Bayelsa State Governor, Honourable Seriake Dickson, yesterday, approved an additional N100 million for the provision of relief materials and the resettlement of flood victims across the eight local government areas of the state. Governor Dickson had earlier approved N50 million towards ameliorating the plight of victims of the disaster. The governor announced the approval when members of the Ijaw Professionals Association (IPA) led by chairman of its Board of Trustees, Gen. Paul Alaowei Toun (retd), paid him a courtesy visit in Government House, Yenagoa. The Tertiary Education Trust Fund (TETFund) has charged the 14 newly enlisted public tertiary institutions in Nigeria to embrace transparency in their implementations of the various intervention lines. Announcing the enlistment of the 14 new public tertiary institutions during a short ceremony in Abuja on Wednesday, the Executive Secretary of TETFund, Dr Abdullahi Baffa said that the approval was granted to 14 qualified institutions out of the numerous request received by the TETFund Board of Trustees. In a statement by the Director, Public Affairs, TETFund, Mr Benn Ebikwo, Baffa advised the newly enlisted institutions to adhere strictly to the operational guidelines of TETFund as well as ensure transparency in their implementations of the various intervention lines. According to Baffa, the brief ceremony held to accord the management of the Fund the opportunity to meet directly with the heads of the institutions and acquaint them with the operations of the Fund and modalities for accessing its various interventions.

2019: Enugu community threatens to withdraw support for PDP over relocation of development centre

The Nigeria Police have refunded N6 million allegedly extorted from a trader, Ugochukwu Oraefo who was reportedly abducted by men of the Special Anti Robbery Squad (SARS) in Onitsha Anambra State. The refund was as a result of petition by the trader’s lawyer, Uche Ijeoma of International Human Rights and Equity Defence Foundation, to the Inspector General of Police, Ibrahim Idris in July 2018. In the petition, Ijeoma had alleged that the SARS (now FSARS) arrested his client and kept him incommunicado for over two weeks. The lawyer said the policemen threatened to wipe out the victim’s family should he tell anybody about his arrest, detention and torture and the N6 million extorted from him. The petition read in part, “The victim was taken into their torture chamber and hanged for close to an hour. “The SARS operatives would later claim that the victim was arrested because he paid N50 million to an unknown caller in 2013, instead of reporting the case.

Economic development: CJN tasks Judges on speedy resolution of financial disputes Andrew Orolua, Abuja The Chief Justice of Nigeria (CJN), Justice Walter Onnoghen, on Wednesday tasked judges on the need to be circumspect in their handling of disputes relating to depositors’ funds. Onnoghen, who noted that the judiciary plays an important role in ensuring financial system stability noted that when dispute concerning the financial sector are resolved on time, it increases public confidence and assurance that deposits and investments are safe and secure. The CJN stated this yesterday in Abuja while declaring open a one day sensitization seminar for judges of the Federal Capital Territory (FCT) and States High Court, organized by the Nigeria Deposit Insurance Corporation (NDIC). He noted that the seminar is geared towards exposing Judicial Officers to the workings of the Banking sector with particular regard to Deposit Insurance Law and Practice and stressed that the theme of the seminar,

Prince Adike stated in Port Harcourt yesterday that the Supreme Court judgement, of Monday, October 22, which nullified the ward, local government and state congresses held by the pro-Amaechi’s faction of the APC, on May 19, 20 and 21, respectively, to elect the delegates that voted for APC candidates for elective offices in 2019 general elections, had consequently nullified the election of candidates chosen through indirect primary. He said: “I call on the national leadership of the APC to respect the judgment of the Supreme Court, recognize direct primary held under my leadership as the chairman of the party in Rivers State and forward the names of all the candidates that emerged through direct primary to INEC.”

Mr. Emefiele stated this in Lokoja, Kogi State, on Wednesday, October 24, 2018, while declaring open the 26th Seminar of Financial Correspondents and Business Editors. In his keynote address on the theme:

“Monetary Policy Implementation amidst Global Economic Protectionism,” the Governor said the selective protection policy on forex restriction to some imports was carefully crafted with a view to reversing the multiple challenges of dwindling foreign reserves, contracting GDP-recession and what he described as an embarrassing rise in the level of unemployment that confronted the Nigeria economy at the time. He noted that the implementation of the policy on 41 items, which he rationalized as unnecessary drains on the country’s foreign exchange reserve, contributed greatly to getting the Nigerian economy out of recession, citing

growth in the real Gross Domestic Product (GDP) and improved reserve accretion as success indicators. According to him, the policy was aimed at stimulating the domestic economy in order to enhance domestic production and protect local industries from undue foreign competition and take-over. Citing the success recorded in the area of import reduction, particularly in rice, in addition to other policy actions of the Bank, he admonished Nigerians to support the policy on 41 items in order to further reduce pressure on the Naira. He also advised that Nigerians should

see the policy as an opportunity to change the structure of the economy, resuscitate local manufacturing, and expand job creation for Nigerian citizens. While also arguing that pragmatic economic nationalism favoured the protection of the domestic economy as long as such an action did not harm its neighbours and trading partners, Mr. Emefiele urged the journalists to continually enlighten their respective audiences on the importance of the subject of economic nationalism to enable citizens better appreciate the efforts of the CBN in improving their lives of Nigerians through its monetary policy initiatives.

Poor countries lose $110bn yearly to food-borne illnesses - World Bank Mathew Dadiya, Abuja A new World Bank study has found that the impact of unsafe food costs low- and middleincome economies about US$ 110 billion in lost productivity and medical expenses each year. The World Bank in a report released on Wednesday stated that a large proportion of these costs could be avoided by adopting preventative measures that improve how food is handled from farm to fork. Better managing the safety of food would also significantly contribute to achieving multiple Sustainable Development Goals, especially those relating to poverty, hunger, and well-being. Foodborne diseases caused an estimated 600 million illnesses and 420,000 premature deaths in 2010 according to the World Health

Organization. This global burden of foodborne disease is unequally distributed. The study finds that the gap is the most pronounced “in the middle of the pack,” that is, among lower-middle income countries, and it offers targeted recommendations to address these. “Governments in low- and middle-income countries not only need to invest more in food safety but also invest more smartly,” says Steven Jaffee, Lead Agriculture Economist at the World Bank and study co-author. “This means investing in foundational knowledge, human resources, and infrastructure; realizing synergies among investments in food safety, human health, and environmental protection; and using public investment to leverage private investment.” The study also supports a shift in approaches

to food safety regulation. The traditional approach centers on enforcing regulatory compliance through product testing and food facility inspections, and the application of legal and financial penalties for infractions. Greater emphasis is needed on providing information and other resources to motivate and empower food sector operators to comply with food safety regulation. “The results of regulation should be measured regarding compliant enterprises, confident consumers, and food safety outcomes rather than the number of fines or business closures,” says Jaffee. Relative to their population, low- and middleincome countries in South Asia, Southeast Asia, and sub-Saharan Africa bear a proportionately high burden. They account for 41 percent of the global population yet 53 percent of all foodborne

illness and 75 percent of related deaths. Unsafe food threatens young children the most: although children under 5 make up only 9 percent of the world’s population, they account for almost 40 percent of foodborne disease and 30 percent of related deaths. “Food safety receives relatively little policy attention and is under-resourced. Action is normally reactive—to major foodborne disease outbreaks or trade interruptions—rather than preventative,” says Juergen Voegele, Senior Director of the Food and Agriculture Global Practice at the World Bank. “By focusing on domestic food safety more deliberately, countries can strengthen the competitiveness of their farmers and food industry and develop their human capital. After all, safe food is essential to fuel a healthy, educated, and resilient workforce.”

The Nigeria Labour Congress (NLC) has assured the Federal Government that from Monday, November 6, 2018, the dimension to the proposed nationwide strike will take a new dimension, as the country will witness a total shutdown. The NLC, after its National Executive Council (NEC) meeting in Abuja, issued a communique, advising Nigerians to start stockpiling food and other necessities of life as “workers will ensure a total shutdown of the country.” The communique signed by the NLC President, Comrade Ayuba Wabba, and the General Secretary, Comrade Peter Ozo-Eson, directed its affiliate unions, state councils, civil society allies, those in the informal sector and friends of workers to start immediate mobilization, for the commencement of a nationwide strike. The NEC-in-session of the NLC had therefore met to receive the report on the conclusion of the sittings of the Tripartite National Minimum Wage Negotiating Committee, and approved the decision of the Organized Labour to embark on a nationwide strike. “In furtherance of this, NEC-in-session directed all affiliate unions, state councils, civil society allies, the informal sector and other friends of workers and lovers of democracy to commence immediate mobilization of their members. “The NEC advised Nigerians to start stocking food and other necessities of life as workers will ensure a total shutdown of the country.” The communique read: “The NEC noted with dismay how the Minister of Labour and Employment, Dr Chris Ngige, tried to twist the truth by misinforming the public that the meeting of October 4 and 5, 2018 was inconclusive as the members of the Tripartite Committee on National Minimum Wage did not agree on a figure. “The NEC approved the recommendation presented by the leadership of Organized Labour which viewed the antics of the Minister of Labour and Employment as anti-labour and anti-workers especially with regards to the Minister’s utterances which the NEC deemed as an act of bad faith intended to scuttle the work of the Committee on the new national minimum wage. “The NEC debunked, rejected and condemned the Minister’s claims in the media that negotiations are still ongoing on the issue of a New National Minimum Wage which implementation is already long overdue. “The NEC is disturbed by government’s new offensive against Organized Labour and workers’ rights as contained in a report submitted to the Federal Executive Council by the Minister of Labour and Employment and on which Government has issued a White Paper. “The NEC views this latest posture by the government as calculated to cow workers into submission as well as stop Labour from protesting against Government’s foot-dragging on the new national minimum wage.” The NEC listed Government’s assault on Organized Labour comprises to include: Emphasis on the “no work, no pay” clause in the Trade Disputes Act; and the fixing of tenure for workers holding union executive positions in contravention of the provisions of ILO Convention 87. It also includes the prohibition or exclusion of non-card carrying members of trade unions from leading or being part of negotiation delegations of trade unions reminiscent of the Abacha military era.

Infrastructural development: World Bank, Enugu govt splash N40m on communities Moses Oyediran, Enugu The World Bank in collaboration with the Enugu State Government has doled out over N40million to five communities in the state for infrastructural development, the State General Manager of the Community and Social Development Project (CSDP), Dr Maximus Asogwa has said. Dr Asogwa gave the names of the benefitting communities as Amangwu-Obuofia, Ndiuno-Obuofia, Attakwu-Akagbeugwu, Ogbuosu-Umulokpa and Nimbo, noting that the first three communities are in Nkanu-west Local Government Area while the last two are in Uzo-uwani Local Government Area of the State. Speaking to leaders of the various communities shortly after disbursing 30% first trench of the money, Dr Asogwa reiterated the essence of accountability and transparency during project implementation and pledged the readiness of the Agency to monitor the projects to ensure the timely completion of the works. Asogwa also promised the communities that after utilizing their first trenches, they should write for second and third tranches for completion of projects in each community which are civic and health centres, roads as well as culverts. He further explained that the CSDP is a World Bank intervention project in collaboration with the Federal and State Government, stressing, “It is aimed at reducing poverty in communities. “CSDP is anchored on the principles of Community Driven Development (CDD), where community members take Control of their Development Needs (CDD) recognizes the fact that indigenous people are knowledgeable, and therefore are capable of deciding what they want” “Under the Community and Social Development Project (CSDP) initiative, each benefiting community is entitled to a maximum of Ten Million Naira (N10 m) World Bank assistance, while the community itself will pay 10 per pcent counterpart contribution, which could either be in cash or kind, or both.”

FG proposes lower budget of N8.73trn for 2019 Motolani Oseni The Federal Government of Nigeria has proposed N8.73trillion for next year’s budget, the N9.1 trillion approved by lawmakers for 2018, lower by more than N400 billion. The Minister of Budget and National Planning, Udoma Udoma, stated this Wednesday at the end of the Federal Executive Council (FEC) meeting presided over by President Muhammadu Buhari at the State House, Abuja. Udoma said the council has pegged the price of crude oil per barrel at $60, as well as exchange rate at $305, while daily crude oil production is put at 2.3m barrels per day. He said Medium Term Expenditure Framework (MTEF) for 2019 to 2021 has been approved by the council and that it would soon

be submitted to National Assembly for further consideration. Barely a week now, the federal government hinted that it considering a reduced N8.6 trillion budget proposal for 2019, but promised to give priority to human capacity development, particularly on allocations to health, education, pensions and other benefits to retirees. The Commitment to Reduce Inequality (CRI) Index, the second in the series, was recently released by Development Finance International (DFI) and Oxfam, which measures the commitment of governments to reduce the gap between the rich and the poor. The budget Minister, had said the federal government plans to cut down the level of borrowing in the budget from N1.6 trillion in 2018 to N1.5 trillion, while the deficit component would be reduced from N1.9 trillion in 2018 to

N1.6 trillion. Consequently, he said, the allocation for pensions and gratuities would be increased from N241 billion in 2018 to N527 billion next year, to assure workers of their benefits. Udoma said one per cent of consolidated revenue fund (about N51 billion) would be set aside for primary healthcare fund as well as provision of counterpart funding for immunisation of children. This will be in line with the requirement of the National Health Act 2014. On basic assumptions underlining the proposed budget, the minister said the government was looking at a 2.3 million barrel per day oil production capacity (including condensate), reduced from about 2.4 million bpd target proposed in the National Economic Recovery & Growth Plan (NERGP).

The devices were discovered by technicians who screen mails sent to the former US officials. In a statement made available on Wednesday, the US secret service said a package addressed to Clinton was recovered late on Tuesday while another package was addressed to Obama’s residence on Wednesday. It, however, said that neither Obama nor Clinton received the packages, “nor were they at risk of receiving them”. The statement reads in part, “Early this morning, October 24, 2018, a second package addressed to the residence of former President Barack Obama was intercepted by Secret Service personnel in Washington, DC. “Both packages were intercepted prior to being delivered to their intended location. The protectees did not receive the packages nor were they at risk of receiving them.” Another package was also reportedly sent to Cable News Network (CNN) offices in The Time Warner building in New York, causing the media house to evacuate its newsroom. The package sent to CNN was addressed to John Brennan, former CIA director. But the three devices intercepted are said to be similar to one found on Monday at the home of George Soros,

billionaire philanthropist and business magnate. The US law enforcement agencies are now investigating the issue. CNN evacuated The New York Police Department (NYPD) also responded to a suspicious device, believed to be a pipe bomb, found at the Time Warner Center, where CNN’s New York newsroom is based. The New York City police commissioner said the package contained what appeared to be a live explosive and envelope with white powder. The package was addressed to former CIA Director John Brennan, CNN reported, citing city and local law enforcement officials. Brennan appears on other cable and broadcast networks. According to the NYPD’s chief of counterterrorism, the explosive appeared to be sent by the same person who mailed suspicious packages to the Clinton and Obama homes, as well as the device found on Monday at the home of billionaire philanthropist George Soros. FBI officials said at news conference that the devices all appeared to be crude pipe bombs. New York City Mayor Bill de Blasio said the attempted attacks were “clearly an act of terrorism”. CNN anchors were on the air from New York discussing the explosive devices addressed to Obama and Clinton when they were interrupted by a fire alarm and cut to a commercial.

The news organisation’s New York staff evacuated the building as a precaution. ‘These terrorising acts are despicable’ The White House condemned the attempted attacks, saying “terrorising acts are despicable, and anyone responsible will be held accountable to the fullest extent of the law”. Press Secretary Sarah Sanders added in a statement that the “United States Secret Service and other law enforcement agencies are investigating and will take all appropriate actions to protect anyone threatened by these cowards”. Vice President Mike Pence, writing in a tweet, also denounced the attempted attacks as “cowardly” and “despicable”. Hillary Clinton was not at her New York home when Tuesday’s package was sent, but her husband, former President Bill Clinton was present, officials told the Associated Press. While at a Florida fundraiser, she said “we are fine” and thanked US Secret Service for intercepting the package “long before it made its way to our home”. House Republican leaders said on Wednesday that the person or people who sent explosives to the Clinton and Obama homes should be brought to justice. House Speaker Paul Ryan said they were “reprehensible acts” and “we cannot tolerate any attempt to terrorise public figures”. With the country deeply polarised under President Trump, the packages brought a new level of tension to the upcoming midterm elections on November 6.

Saudi crown prince promises justice in Khashoggi murder case

Saudi Crown Prince Mohammed bin Salman has called the killing of Saudi journalist Jamal Khashoggi inside the kingdom’s consulate in Istanbul a “heinous crime that cannot be justified”. In his first public comments in the weeks since Khashoggi’s murder, the crown prince, known as MBS, said on Wednesday that the perpetrators would be brought to justice with the help of Turkey. Speaking at the Future Investment Initiative in Riyadh, he said that “some people are trying to seize this painful

moment to drive a wedge between Saudi Arabia and Turkey”. He continued: “I want to send them a message: You will not be able to do that as long as we have a king called Salman bin Abdulaziz and a crown prince called Mohammed bin Salman and a Turkish president named Erdogan. “The rift will never be created. We will prove to the entire world that the both countries are cooperating to punish all perpetrators and justice will be above everything.” Al Jazeera’s Sinem Koseoglu,

reporting from Ankara, said President Recep Tayyip Erdogan spoke with the royal over the phone just before his speech at the conference. It was the first time the pair had spoken since Khashoggi disappeared on October 2. “A couple of hours before that, President Erdogan had a phone call with Jordan’s King Abdulla. When you look at this diplomatic phone traffic, you see that there are mediators who are trying to build up [ties] between Turkey and Saudi Arabia,” Koseoglu said.

At least 52 people died in Madagascar’s prisons last year while awaiting trial due to “appalling prison conditions”, according to Amnesty International. In a report published on Tuesday, the global rights group also said that thousands of people who have not been found guilty of any crime were subject to “life-threatening prison conditions”, including severe overcrowding and poor hygiene, as well as lack of food and medical care. The main causes of death were respiratory problems and cardiovascular diseases, Amnesty said, citing prison authorities. The report was based on visits to nine prisons where more than 11,000 people had been placed in pre-trial detention, the group said. “Many of those being held for extended periods without trial were accused of petty, nonviolent crimes,” said Deprose Muchena, Amnesty International’s regional director for Southern Africa. “The poorest, including women and children, with the least recourse to legal help, are those who suffer the most,” she added. Such “unjustified, excessive and prolonged pre-trial detention” violates international and domestic law, and amounts to cruel, inhuman and degrading treatment, Amnesty said. Madagascar’s Ministry of Justice, in a September letter to Amnesty, said it was aware of the problem. The ministry blamed “population growth and an increase in crime rates” for severe overcrowding and said it has “stepped up its efforts” with new laws and policies to improve conditions. Under Madagascar’s national laws, adults can be held for up to five years and six months without trial and children up to 33 months. Amnesty said Madagascar’s prisons hold more people who have not been

tried than those found guilty. As of October 2017, 55 percent of the total prison population were pre-trial detainees, the report said. One man said he has been in pretrial custody for three and a half years because he was accused of stealing a cow. Describing conditions at a prison in Maintirano, west Madagascar, he told Amnesty: “Forty-two of us sleep in the same room but there is no room to sleep, I sleep on the floor. A lot of people get sick. Some cough, some shiver, some get very cold. “And people fight about food because there isn’t enough… I really want a trial because I really suffer here.” Women and children were disproportionately affected by some of the prison conditions, the report said. For example, pregnant women and women with babies do not have access to appropriate healthcare, and children do not have access to education, the group said. The main reason for long pre-trial detentions in the African country was limited and infrequent court sessions for criminal cases, it added.

Super Eagles captain John Obi Mikel is set to help Nigeria’s amputee team play at the upcoming World Cup. The BBC reports that Mikel will be “donating money and buying kits” to help the Special Eagles play at the tournament, having missed the previous three editions due to financial constraints. “We’ve spoken to a representative of John Mikel Obi who has offered to help the team,” Fred Edoreh, co-ordinator of fund-

The Nigeria Communication Commission (NCC), Tennis League attracted lots of youths across the country to compete for the mouthwatering N17 million cash price for the first, second, third and fourth winners. The NCC tennis league is part of the Corporate Social responsibility of the Commission which aims at harnessing young talents and getting them ready for both National and international competitions. According to Mr Godwin Kienka, Director of the International Tennis Academy, (Organisers of the NCC Tennis League), “the entire point of the NCC Tennis league is to serve as a transition to the professional ranks.” He said the standard of the players will continue rising from frequent trainings and competitions, also the players would be exposed to other states in the country as they keep traveling to states for the competition. His words: “The league has been very exciting, very productive, we are particularly excited by the combination that we have here between Ofiko and the Next Generation, the Ofiko team is parading about National Champion. “The entire point of the NCC Tennis league is to serve as a transition to the professional ranks, we have the Junior Circuit which is bringing them up to 18, all the players playing for the Next Generation are products of the ITA Junior Circuit, now we have a transition which is like the missing link between the junior programme and going professional, now we have the league which is introducing about 60, this week along, we have 6 ties across Nigeria, and that will happen every weekend until the end of November. “The standard will keep rising because they are practicing and competing every week, so apart from exposing and helping the players

One of the players, Sylvester Emmanuel expressed optimism that he would emerge the winner at the end of the competition, stressing

that he has beaten most of his competitors at the group stage. “In Lagos, I don’t have any opponent there that will give me a tough challenge, the ones that will give me tough challenges, I just finished with one in Lagos, and the other ones are in the other groups, I think when the matches will start getting interesting is when we come out of the group stage.” Speaking on the Nigerian Tennis generally, Emmanuel said “Nigerian tennis is still catching up, we need more of this tournament, this one is not bad, they are really trying for the Nigerian players, I was in even surprised that just in a space of about two weeks, I have been to 3 states already, playing tournaments.” When asked what he would do with the money if he wins, he said: “I have been playing tennis for 14 years, am hoping to win this tournament, when I win, I win invest the money in my tennis career, because I don’t have a sponsor currently.”
