Kachikwu added that the petroleum ministry is not aware of the federal government’s plans to sell the liquefied natural gas company. He said, “We are not aware of the federal government’s plan to sell the NLGN.” The investigative hearing is sequel to the adoption of three motions by the House, including that seeking to stop the proposed sale of the NLNG, probing the contract for the modification of EGP3B production platform following the joint venture agreement between the Nigerian National Petroleum Corporation (NNPC) and Chevron Nigeria Limited and the contract for the upgrade of OML 58 upgrade 1, the execution of Obote/Ubeta/ Rumuji pipeline and the

northern option pipeline project. At Tuesday’s hearing, the House committee faulted the variations on the OML 58 upgrade contract awarded by NNPC to Total E&P Limited on the grounds that the figures were too high since the real contract sum had been paid. According to the lawmakers, the cost of the entire contract is staggering, insisting there was the need to ascertain if there was real value for monies paid to warrant the extra-payment through variation. But responding to the query, the NNPC informed the House committee that there was no infraction in the award of the entire contract, declaring that the contract award followed due process. The NNPC Group Managing Director, Dr Maikanti Baru, who was represented by the Chief Operating Officer, Upstream, Bello Rabiu, argued that the project is to

upgrade security in order to improve gas for local and international consumption. He said the contract was duly approved before it was awarded, adding that the contract suffered two variations amounting to $1.6 billion because of unforeseen circumstances and other challenges, including protests from host communities. Baru disclosed that no money has been paid to any contractor as variation because the variation is yet to be approved by the NNPC’s board, adding that “we can’t accept any variation and no money was paid. It has to go to the board for approval”. Meanwhile, the committee has demanded for all the necessary procurement documents leading to the award of the contract, such as minutes of the meeting of procurement planning committee, bid analysis, statistical analysis and NEEDS assessment in line with various sections of the Procurement Act 2016.

NAFDAC raises the alarm over fake imported sardines Doosuur Iwambe, Abuja The National Agency for Food and Drugs Administration and Control (NAFDAC) has warned members of the general public against the consumption of TL Tan Lung and TLC brands of canned sardines. NAFDAC DirectorGeneral, Prof. Moji Adeyeye, who issued the warning in Abuja on Tuesday, explained that TL Tan Lung and TLC

brands were produced by Chinese companies known as Fujian Yongfa Company Limited and Dongshan Dongyi Food Company Limited respectively. While explaining that the products did not comply with the standards set by the 1983 Food Act and was recalled due to presence of nematode parasitic worms in the products, the NAFDAC boss added that TL Tan Lung had been notified that the Malaysian Ministry of Health on April

20, 2018 in Kuala Lumpar, recalled the two canned sardine products. Adeyeye also cautioned all importers not to import the affected canned sardines into the country. “Anybody in possession of the unwholesome canned sardines should submit them to the nearest NAFDAC office. Consumers are encouraged to report all adverse events resulting from the use of these products to the nearest NAFDAC office,” Adeyeye added.

EFCC ‘ll investigate $3.8bn Egina FPSO project Doosuur Iwambe, Abuja The Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Mr Ibrahim Magu, has disclosed that the commission will look into the award of $3.8billion to build Egina Floating Production Storage Offloading (FPSO) platform to Samsung Heavy Industries. Speaking while receiving a petition from two civil society organizations, Nigerian Young Professionals Forum (NYPF) and the Connected Development (CODE) at the EFCC office, in Abuja on Tuesday, the EFCC boss assured the petitioners that

the EFCC as a commission would consider the allegations raised in the petition and subject them to test and consequent investigation. The contract to build the $3.8 billion Egina FPSO project was awarded by the Nigerian National Petroleum Corporation (NNPC) in 2013 to Samsung Heavy Industries. The petition was signed by NYPF’s Chairman, Moses Siasia and the Chief Executive Officer of CODE, Hamzat Lawal. Speaking on behalf of Magu, the EFCC’s Head, Media and Publicity, Wilson Uwujaren, who received the petition said: “I want

to assure you that we will take this petition through the normal process through which we receive petitions in the commission. “For us, this is merely an allegation but we will subject it to test and if it is worthy of investigation, the commission will duly investigate it and you will get to know our findings.” In the petition, Siasia and Lawal, called for a thorough investigation into alleged irregularities surrounding SHI and Samsung Korea and their involvement in the Egina FPSO project. According to them, the investigation should include the estimation of the resulting losses to Nigeria’s economy.

Ahead of the 2019 general elections, the ruling All Progressives Congress (APC) National Working Committee (NWC) led by the National Chairman, Adams Oshiomhole met on Tuesday in preparation for the forthcoming polls. But the party, which seems to be grappling with the challenge on how it will conduct peaceful primaries for thousands of its aspirants, refused to brief the media on the outcome of its meeting. The development came just as the Peoples Democratic Party (PDP) has fixed October for the

emergence of its presidential candidate for the 2019 election The APC NWC meeting, which might not be unconnected with the approval and release of the party primaries timetable which letter was earlier sent to the Independent National Electoral Commission (INEC), was held at the party’s national secretariat in Abuja with all the national executive officers in attendance. Impeachment: Maintain status quo on Saraki, court tells parties Senators want court to stop forceful reconvening of NASS

Andrew Orolua, Abuja A Federal High Court in Abuja has cautioned against any move aimed at unlawfully removing the Senate President, Dr. Bukola Saraki, from office, pending the determination of a suit filed by some senators in the matter. Two senators: Rafiu Adebayo (PDP, Kwara South) and Isa Misau (PDP, Bauchi Central) had dragged the Attorney General of the Federation and Minister of Justice, the Inspector General of Police and the Department of Security Services (DSS) to court in a bid to restrain them from allegedly aiding the forceful removal or impeachment of Saraki from office. Other defendants in the matter are the Senate, the Senate President, Deputy Senate President, Senator Ahmed Lawan (Senate Leader), Senator Bala Ibn Nallah (Deputy Senate Leader), Senator Emma Bwacha (Deputy Minority Leader), Clerk of the Senate and Deputy Clerk of the Senate. Beside the originating summons, lawyer to the two senators, Mr Mahmoud Magaji (SAN), had filed the motion exparte pursuant to Order 26 of the Federal High Court Civil Procedure Rules. At the resumed hearing of the matter on Tuesday Magaji asked Emeka Etiaba (SAN) to address the court on his behalf. Basically, the exparte motion sought an order of interim injunction (in reliefs 1, 2, and 3), restraining the defendants from taking any untoward action or move to forcefully remove or impeach the Senate President from office. Reliefs 4 and 5 prayed the court for

an order of substituted service of court processes on the defendants. Adumbrating on the motion, Etiaba said in the event the court was constrained to grant reliefs 1, 2, and 3, “Our alternative prayer is for the court to make preservatory orders in order to protect the res (subject matter) of the suit. The plaintiffs’ lawyer also argued that preservatory orders will take away their fears, stressing that under section 6 of the Constitution, the court has inherent jurisdiction to make such an order. In his short ruling, Justice Nnamdi Dimgba held that in respect of reliefs 1, 2, and 3, which are orders of interim injunction, “I believe the proper order to make is an order of accelerated hearing of the suit so that the court can consider and determine the merits of the substantive case expeditiously. “Even though reliefs 1, 2, and 3, are not granted, needless to say, parties have been enjoined to respect the authority of the court and the integrity of the judicial process and should not take steps that will render the matter nugatory.” Furthermore, the court granted reliefs 4 and 5, and directed substituted service of court processes, the originating summon and motion for injunction on the 1st to 8th defendants through clerk of the National Assembly. In addition, Justice Dimgba ordered substituted service on the 10th to 12th defendants by courier service. Meanwhile, in the light of the originating summon of the suit, the court adjourned the matter to September 6, for accelerated hearing. “Counsels should take necessary steps to serve all the parties with the processes, the court said. In the motion, the plaintiffs are praying for an order of interlocutory

injunction restraining the 4th to 11th defendants and their agents from unlawfully removing Saraki pending the determination of the substantive suit. The plaintiffs are also seeking for an order of interlocutory injunction restraining the 9th to 10th defendants from unlawfully interfering with the lawful legislative duties of Saraki pending the determination of the substantive suit. “An order of interlocutory injunction restraining the 10th to 11th defendants from harassing, hounding intimidating, arresting or detaining the 2nd defendant in respect of the lawful exercise of his duties pursuant to Section 50(1)(a) of the Constitution of the Federal Republic of Nigeria, 1999 (as attended), until the hearing and determination of the substantive suit. More so, the plaintiffs want the court to make an order directing the parties in the suit to maintain status quo pending the hearing and determination of the substantive suit. In a similar suit, marked FHC/ ABJ/CS/843/2018, filed by Senator Rafiu Adebayo against the Senate and 11 others, the court adjourned to September 13, for hearing. Specifically, the second suit is seeking an order restraining the defendants from forcefully and illegally reopening the Senate chamber. The court adjourned and directed parties to file in their processes. Magaji Mahmud, SAN, and Emeka Etiaba, SAN, announced appearance for the plaintiff, while T. D. Agbe appeared for the Attorney General of the Federation and Minister of Justice (10th defendant). David Igbodo entered appearance for the Police, and S. Azi, for the DSS.

Governor Ibrahim Damkwabo picked their presidential nomination forms while Abia State Governor Okezie Ikpeazu also picked a reelection form. Lamido, a former Foreign Affairs minister sent a representative to pick form on his behalf at the Wadata Plaza secretariat of the party while Damkwabo personally picked his forms at the Lagacy House, Maitama office of the PDP. Governor Ikpeazu while speaking with journalists after picking his form on Tuesday, said the good people of the state impressed upon him to seek a second term.

In compliance with the decision of the National Assembly to approve a sum of N143 billion for the conduct of next year’s general elections, the Independent National Electoral Commission (INEC) has adjusted its budget from N189 billion to N143 billion. Speaking with journalists at the end of a closeddoor meeting on Tuesday, Chairman, National Assembly Joint Committee on Electoral Matters, Senator Suleiman Nazif (PDP, Bauchi) confirmed that INEC has submitted a new budget document reflecting the sum of N143 billion as originally requested by President Muhammadu Buhari. Nazif said a sub-committee has been established to look into the details of the new budget submitted by INEC and

it is expected to complete its assignment today. A member of the joint committee, Senator Aliyu Sabi (APC, Niger North) gave assurances that the committee is determined to urgently complete work on the election budget. He denied allegations that the committee was deliberately slowing down the process to frustrate moves to make the National Assembly to reconvene. According to him, part of the reason for setting up the subcommittee was to speed up the legislative process for the election budget. The joint committee had on Monday ended weeks of deadlock after it reached a decision to adopt President Buhari’s version of the election expenses put at N143 billion, directing INEC to reduce its own version to reflect the wish of the President.

A new draft of the Civil Code submitted on Monday to the Standing Committee of the National People’s Congress removed all “family planning-related content,” according a report published on Tuesday in the Communist Party’s People’s Daily newspaper. This suggests that the decades-old birth restrictions wouldn’t be enforced after the law goes into effect, since the code is intended to govern all aspects of private life from contracts to company registrations to marriages. The Bloomberg had also reported in May that the country was planning to scrap birth limits this year. The Peoples Democratic Party (PDP) has urged President Muhammadu Buhari to explain the whereabouts of the N4 trillion unremitted oil revenue and other financial rots in the Presidency as detailed in the audit report by Price Waterhouse Cooper, a firm commissioned by his administration. The party said the report has further confirmed that President Buhari has been presiding over a humongous corrupt administration, while at the same time posturing as Mr. Integrity and pointing accusing fingers at everyone else but himself. been defending the Buhari administration, were shocked by revelations, in the audit report, of the theft of N4 trillion in a sector that is under the direct supervision of honest President Buhari, as minister of petroleum resources; the callous frittering of N50 billion from the coffers of the National Poverty Eradication Programme (NAPEP) and ministry of agriculture, disappearance of N28 billion from the Ecological Fund, using fraudulent borrowing windows, among others sharp practices. “Nigerians are also shocked to learn how some ministers under President Buhari stole N413 million from agencies and parastatals using fraudulent imprests. “It is instructive to note that this latest audit report adds to outstanding revelations of corruption under President Buhari, including the leaked

FG Inaugurates panel on prerogative mercy Mathew Dadiya, Abuja The Federal Government has inaugurated a Presidential Advisory Committee on Prerogative of Mercy, aimed at decongesting prisons in the country. The inauguration was done by the Secretary to the Government of the Federation (SGF), Boss Mustapha on Tuesday in Abuja. Mustapha was represented at the brief ceremony by theAttorney General of the Federation (AGF) and Minister of Justice, Mr Abubakar Malami (SAN), who is the chairman of the committee. He said, “The significance of an occasion like this goes beyond the ceremony itself; it gives a signal for the members so inaugurated to brace up with the responsibility embedded in the assignment. “The committee is a four-year tenured committee constituted to assist Mr. President in the discharge of his constitutional responsibility of not only granting pardon to deserving prisoners and ex-convicts and reintegrating them into the society but also to work towards decongesting the prisons nationwide,” The AGF stressed that the responsibility of the committee is sensitive and enormous, he said that the purpose for its constitution and its guiding principles must be completely adhered to. He said that the terms of reference of the committee are statutory and constitutionally as they are enshrined in Section 175 of the 1999 Constitution. “The inauguration today enables you to kick start the processes leading to nationwide prison visits and consequent recommendation of eligible

ex-convicts and convicts for presidential pardon.” he stated In his remark, a member of the committee and Permanent Secretary in the Special Duties office, Williams Alo, recalled that the President reconstituted the committee on the 19th of June, 2018. Section 175 of the 1999 Constitution on Prerogative of mercy reads “(1) The President may (a) grant any person concerned with or convicted of any offence created by an Act of the National Assembly a pardon, either free or subject to lawful conditions; (b) grant to any person a respite, either for an indefinite or for a specified period, of the execution of any punishment imposed on that person for such an offence; (c) substitute a less severe form of punishment for any punishment imposed on that person for such an offence; or (d) remit the whole or any part of any punishment imposed on that person for such an offence or of any penalty or forfeiture otherwise due to the State on account of such an offence. “(2) The powers of the President under subsection (1) of this section shall be exercised by him after consultation with the Council of State. Armed thugs attack serving Reps member A member of the House of Representatives under the All progressives congress (APC) Hon Muhammad Umar Jega was attacked by armed political thugs in Jega Local Government Area of Kebbi State.

The member representing Jega, Gwandu and Alieru federal constituency was attacked during a rally he organised to thank his followers and tour the entire constituency to cement his relationship with the people. According to him, his rally was approved by the security agencies in the area and was not in company of thugs.

Ganduje signs executive order on access to govt record, information Yakubu Salisu, Kano Governor (Dr.) Abdullahi Ganduje of Kano state has signed an Executive Order for Open Government Partnership (OGP), a move, geared towards the improvement of citizens’ participation and access to government’s information. According to the Chief Press Secretary to the state governor, Abba Anwar, the order is the second of its kind in the country at a time Nigeria is perfecting plans to sign the OGP’s executive order. Part of the principles of OGP as being outlined and agreed upon by participating countries since the original birth of the idea includes but not limited to an acknowledgement that people across the globe are demanding for more openness in running their affairs, a need for greater participation in governance, so as to make their governments more transparent, effective responsive and accountable. The OGP crusade was officially launched under the United Nations umbrella in September 2011 and was joined by eight countries to fight corruption and support all-inclusiveness in governance globally. Nigeria joined the OGP in July 2016 to become the 70th country in the crusade.

Shortly after 07:00 hours, Lucy (real name protected), received a code on her hand-held device supposedly to enable her to cast her vote in the ballot to elect a new leadership for the Nigerian Bar Association (NBA). The two-year tenure of the elected officers of the NBA led by Abubakar Balarabe (AB) Mahmoud, a senior advocate of Nigeria (SAN), was due to lapse at the end of August 2018. Under the constitution of the association, the ballot was to have concluded before the end of July. A cocktail of implausible cock-ups had conspired to defer the completion of the ballot by three weeks beyond the constitutionally permissible date. More than one hour before Lucy received her voting code, shortly after 06:00 hours, however, Auwalu Yadudu, professor of Law and former legal adviser to General Abacha, in his capacity as chairman of the NBA’s Electoral Committee (ECNBA), had announced the outcome of the elections under the supervision of NBA president, A.B. Mahmoud (SAN). In the event, having kept vigil for over 36 hours, Lucy found that she could not vote. The code she has received was useless. The question of how a voting portal that was supposed to have been shut down one hour earlier was still able to generate voting codes when it did may never be answered. Meanwhile, according to the tallies announced by Yadudu, the contest for the presidency of the NBA had come to an end with a winner who scored 4,509 votes to beat his closest rival who got 4,423 votes. A third candidate scored 3,313 votes. He also dispensed other numbers anointing various other

supposed winners and losers. Moments before Yadudu’s announcement, the campaign organisation of Arthur Obi-Okafor, a senior advocate and one of the candidates for the position of president of the Bar, had addressed a letter to him citing “inexplicable and strange surges of votes” for the candidate announced as winner, and alleging “glaring incidences (sic) of hijacked votes”. In his letter, ObiOkafor announced his withdrawal from the contest, declaring categorically that he “cannot accept the outcome of the result”. Swiftly on the heels of Yadudu’s declaration, Ernest Ojukwu, another law professor and senior advocate who also ran for the office of Bar president, denounced the election as having been characterised by “massive vote buying, vote capture, rigging and a skewed process.” The figures announced by the ECNBA suggested a very spirited contest. In reality, the outcome was pre-determined. The ECNBA and the NBA leadership of A.B. Mahmoud (SAN) had presided over the most willfully manipulated ballot in the history of the association. They created electoral chaos and then administered rigging as the cure for it, choosing to invest the authority of the president of the NBA in a manner that makes it compromised and vulnerable to political blackmail. The full story of how this was achieved defies the limitations of the present medium. Four highlights of the story, however, deserve to be told. It is a tale of disqualification à la carte, implausible incompetence, mass disenfranchisement and digital heist.

Disqualification à la Carte

At the beginning of the year, there were four aspirants to lead the NBA. One of them, Afam Osigwe, was enrolled as a lawyer in 1999 and had previously served as the general-secretary of the NBA for two years until 2016. Mr. Osigwe was seen as representing a younger generation

of lawyers in an election in which the energy and votes lay with young lawyers. As an electoral proposition, his ambition was clearly dangerous. If he won, Mr. Osigwe would have retired at least one generation of NBA politicians. So, at the beginning of July, the ECNBA decided to disqualify him. Explaining the decision of the Committee, Professor Yadudu claimed that Mr. Osigwe had “not met the requirement of his membership dues and he could not also clarify his payment of…. bar fees.” This story only made sense to the ECNBA and the NBA leadership. To be eligible to vote, a lawyer had to fulfill four basic requirements. First, the person had to have been enrolled as a lawyer in Nigeria. Second, he or she must have paid their annual practicing fees, as well as branch affiliation dues by the end of March 2018. Third, the person must adhere to one of the 124 branches of the association. Finally, the person must have paid their branch membership dues also by the end of March 2018. Naturally, a contestant for office in the NBA had to fulfill the basic requirements for eligibility to vote. In addition, candidates for office had to also have paid their practicing and branch dues for at least three consecutive years preceding the election. Mr. Osigwe was a member of the troubled Abuja branch of the NBA. Indeed, he had previously served as a chair of the branch. In 2016, the branch had a leadership transition that ended in controversy. The then president of the NBA, Augustine Alegeh, a senior advocate, intervened. Ultimately, the matter went before the National Executive Committee (NEC) of the NBA and thereafter to the Annual General Conference (AGC) of the Association, who decided in 2016 to recognise Mr. Anumnu as the chair of the branch. The AGC is the highest decision making body in the NBA. While there was finality from the NBA leadership, the manner of the decision factionalised the Abuja Branch. With the

advent of the A.B. Mahmoud presidency, the issue was re-opened. His mediation efforts were unsuccessful. Rather than return to the AGC, Mr. Mahmoud sought support of the NEC of the NBA to depart from the decision of the AGC and lift the recognition of Mr. Anumnu as the chair of the Abuja Branch. A court order precluding him from doing this was disregarded. Instead, Mr. Mahmoud proceeded to appoint a sole administrator for the Abuja Branch. With the Abuja branch factionalised, it became difficult for members to determine which faction to pay their compliance dues to. Caught in this difficulty, Mr. Osigwe decided at the end of 2017 to “transfer” his membership from the Abuja to the Nnewi branch of the NBA. No one disputes that a member of the NBA can do this under the constitution. Nnewi branch welcomed him and he fulfilled his membership obligations for 2018 with the branch. Equally, no one disputed that Mr. Osigwe had in fact paid his practicing and branch dues for three years preceding the election. For 2016 and 2017, he had paid with the Abuja branch. In 2018, he paid through the Nnewi branch. Somehow, however, Yadudu’s ECNBA and the A.B. Mahmoud presidency of the NBA manufactured in these facts convenient reasons to disqualify an inconvenient aspirant.

Implausible Incompetence

The NBA Constitution requires that voting in its leadership election should be done electronically. This is not entirely too ambitious: the NBA is arguably the most literate association in Nigeria. Every member of the Association brings to the table a minimum of two degrees, one academic and one vocational. This requires the association or its electoral committee to invest in data management, platform security and transparent communication, including voter education. The ECNBA did none of these.

Abia, MSME and Gov Ikpeazu’s footprint

The Presidential Villa banquet hall played host to men of timber and caliber on Thursday, 3rd August 3, 2018 as Abia State was recognised and decorated ‘Most Friendly MSME State of Nigeria’. It was such a frenzied moment in which Abia was given a resounding and remarkable ovation as had seldom been given except in recognition of such an honour conferred in appreciation of a visionary leadership as Governor Okezie Ikpeazu’s. Following the downturn of economy, especially the fall of oil price world over, every functional government started diversifying her economy with a view to boosting the economy to ensuring a sustained better livelihood for its citizens. While some State Governors may still be pondering over the necessary actions to take in order to arrest the trending economic misfortunes that bedeviled our nation, at least, for the nearest future, Abia State Governor, Dr. Okezie Ikpeazu has gone very far in improving the economy of the state through various actions geared towards promoting Micro, Scale & Medium Enterprise (MSME). Initiating, the Governor identified ‘MARKETING’ as a key factor to changing the narrative and fortune of the Abia State economy. His sustained effort cum focus towards marketing/ promotion of the Made-in-Aba products changed the psyche of the Abia artisans, who were known to branding their products with madein-Italy and Made-in-China tags, to confidently and proudly start branding with Made-in-Aba or Proudly AbaMade tags, hence triggering the

turnover and the recognition of Abia as the MSME capital of Nigeria. It is no longer news that Governor Ikpeazu sponsored 30 Aba based youths and artisans to China where they learnt automated shoe production. He didn’t stop there but went ahead to acquire modern automated shoemaking equipment for mass production of shoes in Abia State. His unrestricted interest in ensuring that Aba artisans succeed made him to assist them get orders worth over 2 billion Naira in direct sales, including 50,000 military booths, uniforms, 25,000 shoes for IDP camps, ballot boxes for Local Government Area polls, etc. As a result of Governor Ikpeazu’s promotional activities, the Aba shoemakers now export more than one million pairs of shoes weekly to neighbouring countries. Unlike in the past, the products are proudly branded as “Made in Aba” or “Proudly Aba Made” and are sought for in the international markets. Dr. Ikpeazu’s aggressive promotion of Made in Aba brands, locally and internationally, with fashion shows held in Abuja and New York City in USA respectively has really changed the narrative of business in Aba and Abia State entirely. Knowing also that good road network is key to business growth, Governor Ikpeazu has fixed many roads of great economic importance, including the Brass-Faulks-Ariaria road. He also arrested the Ifeobara pond and delivered Ukwu-Mango from its flooding that had defied all attempts by previous administrations to arrest.

His efforts at promoting Made in Aba brands received support from NGOs like Ford Foundation who funded and launched international marketing campaigns for Made in Aba brands at zero cost to the state via CNN and other international media platforms. It was in appreciation and recognition of the Ikpeazu-led administration effort focused on promoting Made in Aba (Made in Nigeria) products that the Federal Government signed far-reaching executive orders to ease of doing business, fast-track budget submissions, and promote made in Nigeria products. The workaholic Governor is not relenting in meeting up with the expectations of Abia people, hence he has commenced the initial works for the emergence of Umukalika leather and garment cluster. Also, currently under construction is new ultra modern mechanic village at Ogbor Hill, which is expected to be completed early 2019. In addition, Ikpeazu’s administration is in partnership with private sector operators to construct the biggest mall in the South East for Made in Aba Products at Etche road Aba. Ikpeazu’s government, in partnership with the Federal Government, also launched Government Enterprise Empowerment Programme (GEEP) that provides up to N100,000 to selected Abians who are grouped in cooperative societies. So far, the programme has funded more than 18,000 Abians. The state is set to increase the cash amount to N100,000 per participant. The current administration under

Governor Okezie Ikpeazu has organised MSME Clinic in partnership with the Federal Government where about 3000 SME operators exchanged ideas with major stakeholders in Aba, the commercial hub of Abia State. In order to give impetus to young entrepreneurs, Governor Ikpeazu supported the South East Entrepreneurship Development Centre with the headquarters in Umuahia, a Central Bank of Nigeria (CBN) programme, with N100 million take off grant. It is worthy of note that the administration has commenced the processes necessary for the establishment of Enyimba industrial city with 9,200 hectares of land set aside to host the most ambitious industrialisation programme ever executed in the South East region of Nigeria, a project, which has already attracted interest of investors from China, Singapore, South Korea and Nicaragua. There is no doubt that these worthy footprints of Abia State Governor, Dr. Okezie Ikpeazu, has really positioned Abia State for greater economic breakthrough. What the Governor is doing in the state is what is expected of any functional government. If Governor Ikpeazu could achieve this much in MSME alone, it then means that he has achieved much. In the light of the above, it is now glaring that the cap of governing the state actually fits Governor Ikpeazu and there is need to ensure that this good governance continues. Abia people and residents are therefore enjoined to support the Governor and vote him again in 2019.

Editorial Commentary Rule of law: The President got it wrong

It is unfortunate that the most important statement made so far at the on-going Annual Conference of the Nigeria Bar Association, an outright derogation of the supremacy of the rule of law, has not yet generated any coherent response from either the Bar or the Bench. President Muhammadu Buhari was guest of honour on Sunday at the NBA Conference and he had the additional responsibility of declaring the Conference open. In his address, he told the gathering of eminent lawyers and judges that his administration will prioritise national security over and above the rule of law. The “rule of law” often sounds like a catchy phrase among lawyers, and there have been so many confusing interpretations of it, especially by politicians, compelling Martin Kettle to advise in The Guardian UK, of November 25, 2006, that “we need leaders who better understand the rule of law.” Kettle is right because here is what President Buhari reportedly said: “….Rule of law must be subject to the supremacy of the nation’s security and national interest. Our apex court has had cause to adopt a position on this issue in this regard and it is now a matter of judicial recognition that where national security and public interest are threatened or there is a likelihood of their being threatened, the individual rights of those allegedly responsible must take second place, in favour of the greater good of society…” Politicians often get away with their own convenient interpretations of the rule of law because of the kind of acquiescent, self-denigrating reception that President Buhari received at the NBA event. The President had just invoked before an audience of officers in the temple of justice, the spirit of the notorious Decree 2 of 1984, and can you imagine? : They all clapped! The Chief Justice of the Federation, Walter Onnoghen would later mention the independence of the judiciary, but nobody thought it necessary to give some talk about the Supremacy of the Rule of Law. The President even dabbled into case law, by referring to some subsisting decisions or judicial recognition of the Supreme Court. Politicians are closet lawyers, of course: the ones who have attended one election tribunal or the other often forget themselves and try to play around with legalism. But it is scandalous for lawyers and the judex to applaud a statement,

which clearly erodes the doctrine of the separation of powers, the independence of the judiciary and the general principles of constitutionalism. Before I go any further, let me state that I am fully aware that because of the popularity of the phrase, “the rule of law”, it has also been grossly misapplied, prompting Professor Akin Oyebode to argue in an essay titled “ From the rule of law to the rule of just law” (1994), that perhaps we should be more concerned about the “abuse of the rule of law” and argue for just law, because the rule of law can only make sense when it is rooted in “substantive and distributive justice”, more so as the “rule of law” has become “a harlot at the disposal of everyone.” President Buhari rather than turn national security into a fetish, must be more concerned about justice. It is only when justice is done that the “greater good of society” can be realised. The doctrine of rule of law can be traced back to the Greek philosopher, Aristotle, but it is often associated with Professor A.V. Dicey who in 1885 provided three basic outlines for understanding it: (1) no man can be punished except under the law and before ordinary courts of the land. That is: You can only be punished according to an established law, not the whims and caprices of government or an individual (2) no man is above the law, and every man is equal before the law, be he king or plebeian and (3) the general principles of the constitution as interpreted by the courts shall prevail. In summary, therefore, the rule of law is about fairness, justice, equality, due process, accountability, impartial application of the law and proper administration of justice. Whatever other interpretations or conventions may have governed Dicey’s original clarification in other jurisdictions, there seems to be a universal meeting of minds to the effect that the rule of law is paramount. Where there are no laws, what you’d find is the rule of men. Thomas Hobbes identifies this as “a state of nature” where cruelty, nastiness and brutishness could be the order of the day. Indeed, any attempt to define the rule of law outside the province of justice, is a journey towards a state of anarchy as defined by Hobbes, or at best, what Lord Hailsham calls “elective dictatorship”. Recruitment of leaders and political parties The Nigerian political space is daily evolving with new ideas, development and initiative by key players aimed at making things better, yet daily people have reasons to complain about things in the practice of politics in the country that gives them concern. Why many believe that things will get better with time, it is a surprise that many people who should know how things are done in other climes where things seem to be working are among those who will fight such innovations being introduced in the country, especially when they suspect that such innovation will not benefit them personally on the long run. One such case is the recent introduction of the direct primary in electing party flag bearers as recently used by the Adams Oshiomhole-led executive committee of the All Progressives Congress (APC) in the governorship primary for the Osun State election. However, though many people complained about the direct primary, alleging all manner of fraudulent activities in the process, there is no gainsaying that the boldness of the party leadership to introduce direct primary in the selection of party flag bearers is an idea whose time has come and rather than fight it, all lovers of democracy should join hands in ensuring that it not only works within the APC, but that other political parties including the main opposition, the Peoples Democratic Party (PDP), embrace it. Before talking about the gains that direct primary will bring into the Nigerian political space, it is important to first look at the shortcomings of the indirect primary, otherwise known as the delegate system. It will not be far-fetched to say that the indirect primary has created a system in the political space where money is the order of the day. It is a system where people are picked from the ward, local government and states, depending on the position being contested, to go into an agreed place to elect the party flag bearer. It is common knowledge that people fight to be elected delegates, not necessarily because they love the candidates or the party so much, but because they know the benefits of being delegates and it is also public knowledge that political office seekers have accused either party leadership or other contestants of hijacking delegates and preventing others access to them to campaign. But in reality, when politicians talk about not having access to delegates, it is actually talking about not having opportunity to buy them over to their side with cash. So, indirect primary has become a case of the highest bidder and the higher the position sought, the higher the benefit that accrues to the delegates. Indirect primary also encourages the godfather syndrome, where a powerful power broker in the particular party in the area seeks to control political activities in his zone and ensures all political office seekers in his area of influence differ to him and nobody can become anything unless he sanctions it. The direct primary as practiced in other developed political climes like the United States of America, from where Nigeria

Besides reducing the cost of prosecuting an election, which would mean that people with ideas but without deep pocket can successfully stand election, as the chances of buying all voters at the primary is seriously reduced, the direct primary also ensures that members of the party take ownership of it and have a say in who bears the party ticket. Direct primary will also help to grow the party as more persons who ordinarily will not want to register as party members because they believe they cannot have a say in the system will be more confident to register as members of the party, knowing that they too will participate in electing party flag bearers. The direct primary option in picking party flag bearers remains one option which will help develop the political space in Nigeria and create room for an all-inclusive system that will on the long run give the people not only a sense of belonging in the party, but a sense of coowners of the party, knowing that their input counts within the system. Therefore, the direct primary option in the selection of party flag bearers is an idea whose time has come.

Reps to engage forensic experts Short News HADC screens 216,000 patients over land ownership in FCT Henry Omunu, Abuja The House of Representatives on Tuesday said it plans to engage forensic experts to determine the real owners of plots of land in the Federal Capital Territory (FCT). This action follows reports of dubious land dealings and illegal activities of land speculators in the FCT. The House ad hoc committee probing allegations of unwholesome land sales in the FCT made this known yesterday, at the commencement of an

investigative hearing to establish the authenticity of land owners in Abuja. Chairman of the ad hoc committee, Representative Gaza Jonathan Gbwefi, who disclosed this expressed concern over rising cases of illegal sale of land by estate developers and fake land dealers to unsuspecting buyers in the FCT. He stated that the development was worrisome hence the House is investigating the unwholesome practices in order to put an end to the trend. Rep. Gbwefi argued that one way to solve the challenge was to engage the services of forensic experts to

ascertain the true owners of lands in the territory. According to him, the unscrupulous estate developers have continued with their nefarious activities in spite of series of court orders. He disclosed that for example, there was a court injunction in Abuja, stopping a developer from the further sale of houses to unsuspected citizens which was not obeyed. The chairman maintained however that the National Assembly was not going to condone the continued illegality and pledged that it would do a thorough job to end land racketeering and other illegal practices in the FCT.

The Harmony Advanced Diagnostic Centre (HADC), Ilorin has conducted about 216,000 radiology and laboratory tests for patients since it began operations in 2013. It is an incontrovertible fact that there is remarkable turnaround in our airports under the present management of FAAN which statutorily is responsible for managing all commercial airports in Nigeria and provide efficient services to both passengers and customers in accordance with best global practice. Today, FAAN under the able leadership of Senator Sirika has transformed our airports in terms of infrastructural development and service delivery placing them amongst the best airports in the world”. The statement read further, “Nigeria is one of the best business environments that airline operators have the most lenient service charges and flexible rates from the regulatory authorities. FAAN has over the years created the most effective and user friendly business environment across all airports in Nigeria. Airports charges has not been reviewed in recent times, so the claims is at best baseless and a desperate bid by opposition elements and corrupt cartels in the aviation sector who are not happy with the prudent and transparent leadership of Senator Hadi Sirika. Taking into account the prevalent foreign exchange rate, Nigeria charge one of the least charges.”

“The FAAN charges are in line with the recommended threshold by the International Air Transport Association (IATA) and International Civil Aviation Organization (ICAO). Therefore, the claims by AON and AFRAN are nothing but sheer misinformation to cause unnecessary disaffection in the industry and faint the present FAAN management in bad lights. Both domestic and foreign airlines are exempted from paying VAT as incentives for the operators and while air fares had increased in recent times, the handling rates had not changed. The airlines have consistently changed their fares which have remained to date as one of the most outrageous fares in any country. In the same breath, foreign airlines have stopped paying Bilateral Air Service Agreement (BASA) royalties.” Challenging the “foreign airlines to publish the list of all charges they pay and compare it with charges they pay in New York, London, Paris, Cairo, Johannesburg and other airports across Africa and Europe. We view this as a strategic campaign of calumny to blackmail indigenous airlines from undergoing intercontinental flights and reduce them to continental flights only in a desperate attempt to maximize profits.”

Delta State Governor, Senator Dr Ifeanyi Okowa has urged the managers of National Health Insurance Scheme (NHIS) to collaborate with government of different states of the country and chairmen of local government councils to ensure universal health coverage in the country. The governor made the call on Tuesday in Asaba when the Executive Secretary cum Chief Executive Officer of NHIS, Prof. Usman Yusuf paid him a courtesy call in Asaba. Taraba Govt to set up cassava processing plants ... Flags off distribution of 5m stems IITA cassava variety to farmers

Okerafor Athanatius, Jalingo The Taraba state government has expressed readiness to establish three Cassava Processing Plants in the three Senatorial Districts, with a view to improving its agricultural productivity. Governor Darius Dickson Ishaku, who made the assertion while flagging off the distribution of 2018 cassava stems to farmers said the initiative, came as a result of the excellent performance of cassava farmers in the 2017 cropping season. The ceremony held yesterday at the Headquarters of the State Ministry of Agriculture and Natural Resources, Jalingo. Ishaku noted that the establishment of the Plants was aimed at creating markets for the finished products and also to provide an enabling environment for healthy competition among the cassava producers in the

State. Represented by the Deputy Governor, Haruna Manu, Ishaku added, “Government deems it necessary to give the desired attention to agriculture because of the fact that it is a major source of income of the majority of the people in the State”. The Governor further disclosed that last year, 2017, the State Government procured 2.5 stems of TME 419 cassava variety from the International Institute for Tropical Agriculture (IITA), Ibadan, Oyo State which he pointed out was distributed to farmers in the State. “This year, the State procured over five million stems of the improve cassava variety for distribution to farmers across the State. “The gesture has helped greatly in boosting cassava farming in the State and also motivated many farmers to join the cassava farming business; in addition, it also fetched Taraba State

Short News Gunmen kill ex-councillor in Delta Gunmen on Tuesday shot dead, a former councillor in the Ughelli South Local Government Area of Delta, Mr Blessing Oguori. The Commissioner of Police in Delta, Mr Muhammad Mustafa, confirmed the development in an interview with newsmen in Warri. Mustafa said the incident occurred on Monday at Osubi Road in the Okpe Local Government Area of Delta. He said that investigations had commenced, adding: “we are looking for the suspects whose identities are known”. Witnesses said that the deceased was with the son of one Newton Agbofodo and that the boy was also shot. “Oguori was a former Personal Assistant to Agbofodo and was with the son of his former boss, who was also shot but bullet did not penetrate him,” the witness said.

Group deplores attempt to forcefully install man chief priest A group, Oyo Educated Natives Group (OENG), Eruwa chapter in Oyo State, has condemned a move to install a 41-year year old man, Mr. Ola Olusegun Olatunde, as the Oluawo (Awo-cult chief priest) or make him pay with his life. Economy: FG reiterates need to control rapid population growth Mathew Dadiya, Abuja The Minister of Budget and National Planning, Senator Udoma Udo Udoma, has drawn attention to the dangers of uncontrolled population growth on the economy and emphasised the need to generate national support for measures that can help moderate the rapid rate of population growth in the country. Senator Udoma who chaired the session on “Sustainable development” at the 58th Annual General Meeting of the Nigeria Bar Association holding in Abuja, said on Tuesday that current estimates suggest that more than four million people are being added to the country’s population every year. He pointed out that the figure is comparable to the population of many large cities or those of small African countries. The Minister stressed that if the country is to fully achieve the objectives of the Economic Recovery and Growth Plan

(ERGP), which is to invest in the Nigerian people; expand social inclusion; create jobs and develop human capital, then it has become imperative that new ways to better manage the rate of population growth be fashioned out. Udoma cited that the China example of managing population growth is an important part of any strategy to achieve sustainable economic development. He said that his Ministry, working with the Health Ministry, has been given the responsibility by Strategy 46 of the ERGP to develop policies to help manage the country’s rate of population growth. “Let me say, so that I am not mis-understood, that I am not suggesting that we consider taking measures as drastic as the ones China implemented. But it is important to sensitize Nigerians that we will have to find ways to better manage our rate of population growth if we are to fully achieve the objectives of the ERGP, which is to create the Nigeria of our dreams where

extreme poverty is virtually abolished,” he explained. The Minister emphasised that when the ERGP is fully implemented we should achieve a GDP growth rate of at least 7%. He indicated that at the heart of the Plan is the need to build a globally competitive economy and a nation where we grow what we eat, consume what we make and use what we produce. Reiterating the key execution priorities, the Minister said the Plan is focused on ensuring macroeconomic stability; expanding agricultural production so as to achieve food security; investing in transportation infrastructure; ensuring energy sufficiency, particularly in power and petroleum products; and driving industrialization, particularly through SMEs. He said it is most encouraging to note that, though as a 4 year Plan, the ERGP is still in its early period of implementation, some early successes have already been achieved.

ASSBIFI urges labour minister to inaugurate NSITF board Joy Obakeye The Minister of Labour and Employment, Dr Chris Ngige, has been urged to inaugurate the board of Nigeria Social Insurance Trust Fund (NSITF) to curb corruption and protecdt workers’ benefits. Mrs Oyinkan Olasanoye, the President, Association of Senior Staff of Banks, Insurance and Financial Institutions (ASSBIFI), made the appeal on Tuesday in Lagos at an interactive session with the Labour Writers Association of Nigeria (LAWAN). The session is part of activities marking ASSBIFI’s 40th anniversary. Olasanoye said the union was being pressured to embark on industrial action to press home its demand concerning NSITF but it opted for negotiations and dialogue instead. According to her, strike by banks will affect the nation’s economy negatively. We believe in collective bargaining and will not allow anything to becloud our judgment because workers benefits are being entrusted to NSITF, she stressed. ASBIFFI president restated the union’s resolve not to allow NSITF to die. “We appeal to the minister like

we have been appealing that there should be a board in NSITF. “The Act that put NSITF in place states that there should be a board and the Permanent Secretary in the Ministry of Labour should represent the minister. “So if there had been a permanent secretary, and a board had been put in place, and the minister should not say there are corrupt practices in the organisation when he has a representative there. “We do not think that it is now that he is refusing to inaugurate the board that there will be no be corrupt practices there. Court insists on order restraining DStv from increasing Doosuur Iwambe, Abuja The Federal High Court in Abuja on Tuesday insisted that the ex parte order made on August 20 by the court restraining MultiChoice Nigeria Limited, from going ahead with its recent decision to increase subscription tariffs for its cable television, DStv subsists. Justice Nnamdo Dimgba, who stood by his earlier order in a motion ex parte filed alongside an originating summon brought before the court by the Consumer Protection Council (CPC), warned the defendant against taking any steps that will over reach the court. The suit was prompted by MultiChoice Nigeria announcement in July that from August 1, 2018, a new monthly subscription rate for its bouquet will come into effect. Attorney-General of the

Federation and Minister of Justice, Abubakar Malami (SAN) granted the authority for the CPC to file the suit in accordance with the provisions of Section 10 and 16 of the Consumer Protection Council Act, 2004. Specifically, Justice Dimgba had granted an interim injunction restraining MultiChoice Nigeria or its agents and representatives from continuing the implementation of any increase in subscription rates or price review policy imposing increased charges and costs on consumers pending the determination of the motion on notice. The court also restrained DStv from further carrying on or continuing any conduct or activity which interferes with or has effect of circumventing the outcome of ongoing investigations by the CPC into the company’s compliance or non-compliance with the February

16, 2016 order pending the determination of the motion on notice. When the matter came up on Tuesday, Justice Dimgba, a vacation judge was told by counsel to CPC, Babatunde Irukera that MultiChoice had issued a public statement to the effect that it would not obey the court order. Irukera, who is the director general of CPC, had complained to the court about the conduct of MultiChoice in respect of the interim restraining order made on August 20, directing the defendant to revert to status quo. “My lord, the evidence is that the defendant has declined to comply with the order of court. The definition of MultiChoice is express, not circumstantial. In a public statement, MultiChoice characterized the court order as an affront, and repeatedly said to subscribers who

tried to renew their subscriptions pursuant to the court order that it will not, and has no intention of obeying the order,” Irukera stated. The CPC lawyer told the court that he was in possession of the affidavit. Though, counsel to the defendant, M. J. Onibanjo (SAN) denied that there was such a publication, insisting that the plaintiff ought to have brought a formal complaint. At this juncture, the court restated that its order of August 20, “still subsists and in force,” adding that the CPC knows what to do if an opposing party in a suit flouts a valid order of court. Earlier, Onibanjo had informed the court that he filed a motion on notice together with a notice of appeal seeking stay of proceedings and execution of the order ex parte. The matter has been adjourned to September 3, for hearing.

NCAT introduces latest flight training courses Chukwuemeke Iwelunmo The Nigerian College of Aviation Technology (NCAT), Zaria has introduced series of new flight training courses in its offerings. According to the school management, NCAT is introducing four latest flight courses including: Airline Transport Pilot Licence (ATPL), Multi Crew Course (MCC), Jet Orientation Course (JOC) and ICAO English Proficiency Test. While ATPL course takes a period of 10 weeks for online students, it takes regular students a period of 10 days to finish the programme. For those offering ATPL, there is also provision for a one week revision on what they have been taught earlier. Others such as MCC takes one week while JOC also takes only one week training programme. Forex market gets $210m CBN intervention Mathew Dadiya, Abuja In its desire to ensure availability of forex to customers in various segments of the market, the Central Bank of Nigeria (CBN), has injected another sum of $210 million into the inter-bank Foreign Exchange Market. Figures obtained from the CBN on Tuesday, showed that the apex bank offered $100million to authorized dealers in the wholesale segment of the market, while the Small and Medium Enterprises (SMEs) segment received the sum of $55 million. The CBN stated that customers requiring foreign exchange for invisibles such as tuition fees, medical payments and Basic Travel Allowance (BTA), among

others, were also allocated the sum of $55 million. Mr. Isaac Okorafor, the Bank’s Acting Director, Corporate Communications Department (CCD), confirmed the figures and reassured the public that would continue to intervene in the interbank foreign exchange market in line with its desire to sustain liquidity in the market and maintain stability. The Daily Times recalls that on Thursday, August 23 and Friday, August 24, 2018, the central bank injected a total sum of $543.22 million and CNY 63.21 million into the inter-bank foreign exchange market. Meanwhile, the naira continued its stability in the FOREX market, exchanging at an average of N361/$1 in the BDC segment of the market on Tuesday, August 28, 2018.

Varsities ranking: FUNAAB bounces back to top 10 Esther Taiwo Federal University of Agriculture, Abeokuta (FUNAAB), Ogun State has bounced back to the rank of 10 topmost universities in the latest Webometrics ranking of the nation’s Ivory Towers released recently. Unlike the previous ranking released in January 2018 when FUNAAB conspicuously missed out on the list of the Ten Best Universities in the country, this time around, the institution staged a dramatic come back to Webometric “Hall of Fame” where it had been a “landlord”

since 2014 when the ranking debuted. Olajumoke Okoya-Thomas has called on the leadership of the party in the state to caution the South West Woman Leader of the party, Chief (Mrs.) Kemi Nelson over her alleged continuous harassment, intimidation and assault. Hon. Okoya-Thomas added in a statement released to journalists that she could no longer bear the “unwarranted harassment and intimidation by Kemi Nelson,” which she said has been manifesting since she was unanimously elected to the office of the Lagos State APC Woman Leader in May this year, a position previously held by Nelson. Okoya-Thomas added in the statement signed by her media aide, Oladipupo Awojobi that the antics of Kemi Nelson is unbecoming of a woman, who has been a commissioner in the state and currently holds the position of the APC South West Woman Leader as well as an Executive Director of the Nigeria Social Insurance Trust Fund (NSITF) “We are constrained to bring to the public knowledge the antics of the South West APC Women Leader, Chief (Mrs.) Kemi Nelson, which culminated in the harassment, intimidation and oppression of the Lagos APC Woman Leader, Hon. Jumoke Okoya-Thomas. “Kemi Nelson came with about six other women to the state secretariat of the APC on Monday 27th August.

“They proceeded to the office of the chairman of the state chapter of the party, Hon. Tunde Balogun, where the state executive members of the party were having a meeting. “One of the women, Ayo AlliBalogun went straight to Hon. Jumoke Okoya-Thomas and told her that they would deal ruthlessly with her. “Rather than reply, Okoya-Thomas left for her office in the secretariat only for Alli-Balogun to go outside the office of the chairman and started a fight with the Personal Assistant of OkoyaThomas, Alhaja Abiodun. “The woman was thoroughly beaten and wounded by Alli-Balogun, who came with Kemi Nelson. “Alhaja Abiodun had to be rushed to a nearby hospital as she lost a lot of blood and sustained serious body injury,” Awojobi said in the statement. Okoya-Thomas was quoted to have said in the statement that she had extended a hand of fellowship to Kemi Nelson upon resumption of office few months back, but that she was rebuffed by her predecessor and wondered what the problem was. N1.6bn fraud: Ex-Jonathan’s aide, Dudafa, others to open defence Monday Justice Mohammed Idris of a Federal High Court, on Tuesday fixed Monday next week, for continuation of trial of Dr. Waripamo-Owei Dudafa, an aide to former President Goodluck Jonathan, and one Iwejuo Joseph Nna, who are standing trial before the court on alleged N 1. 6 billion fraud. Justice Idris fixed the date, after delivering a bench ruling on the applications filed by the two defendants, asking the court to refer the constitutionality of the trial judge who has been elevated to Court of Appeal to continue hearing the matter. The Dudafa and Nna through their lawyers, Mr. Gboyega Oyewole (SAN) and Ige Asemudara, also asked the court to suspend trial pending adjudication on the constitutional issues raised. The defendants in their motion on notice filed before the court, seeking for the two reliefs stated that by virtue of 1999 Constitution as amended, a Justice of Court of Appeal does not offend the provisions of Section 253 of the Constitution, and rob the Federal High Court of its jurisdiction over the charges pending before it. The two defendants in their motions averred that the issue of Fiat by the President of the Court of Appeal to a Justice of Court of Appeal, to preside and continue to adjudicate on matter upon which the Federal High Court has jurisdiction does not violate Section 36(1), 239, 240 and 251 of the Constitution, and tinkered with the independence of the Federal High Court.

The defendants also stated that in view of section 295 (2) of the Constitution, a judge who made a reference of question of law touching on jurisdiction to the Appeal Court, can proceed to continue to hear or determine the pending charge wherein the question arose. They also stated that in view of provision of Sections 34(1)(a)and (c) of the constitution set against the provision of Sections 237, 240, 241, 249, 251, 252 and 253 of the same Constitution, it is not an aberration or degrading treatment to put a Honourable Justice of the Court of Appeal in a situation where he has to mandatorily work by fiat as a judge of Federal High Court. Responding, lawyer to the Economic and Financial Crimes Commission (EFCC), Mr. Rotimi Oyedepo, while urging the court to dismiss the applications, submitted that there are three conditions present before a matter can be referred to Court of Appeal in view of section 295 (2) of the Constitution. The conditions according to Oyedepo are: Constitution, it must have reason in course of trial, and raising issues of substantial law. Oyedepo further submitted it is not appropriate to refer an issue to Appeal Court merely because it is been raised for the first time or it is a matter of general interest. Adding that the Judge is bound not to refer a matter to Court of Appeal, if the interpretation of that law is not that difficult or ambiguous for the court to determine.

Jamie Vardy and Gary Cahill announced their intention to retire from international duty with England on Tuesday, although both did leave the door open to a return in emergency circumstances. Leicester striker Vardy, 31, and Chelsea defender Cahill, 32, were both part of Gareth Southgate’s squad that

reached the semi-finals of the World Cup in Russia. However, both saw their playing time limited and believe the time has come to concentrate on their club careers. “When you get selected, you want to be playing. If you’re playing week in, week out for your club, you want to be going to England to play as well,” Vardy, who started just once at the World Cup in a group stage dead rubber against Belgium, told the Guardian. “If it’s not happening, then for me personally now, at this age, it’s better to be at home, spending that time with my family and training with my club, preparing for the next game after the international break.” Vardy only made his international debut in 2015 after spending much of his career in

England’s lower leagues and scored seven goals in 26 appearances for his country. He has largely played second fiddle to captain Harry Kane under Southgate, but pledged to make himself available if injuries made the likes of Kane and Manchester United’s Marcus Rashford unavailable. “Gareth said that he felt I still had a lot to offer, and we’ve not shut the door completely,” added Vardy. “If the worst came to happen and everyone was injured, then obviously I wouldn’t say no.” Cahill had a more decorated England career with 61 caps stretching back to 2010 and started every game for the Three Lions at the 2014 World Cup and Euro 2016. AFCON: NFF announces new date for Nigeria, Seychelles clash

The Super Eagles will meet Seychelles National Team, known as Pirates on Saturday, Sept. 8, as against the early date of Sept. 7. In a statement by Ademola Olajire, Nigeria Football Federation (NFF) Media Officer, the federation said this on Tuesday in Abuja, that the match would be played at the Stade Linite on the Mahe Island. “The Seychelles Football Federation has confirmed that the 2019 Africa Cup of Nations qualifying, Match day two encounter between the Super Eagles and the Seychelles National Team will take place on Saturday, Sept. 8. “This is against the widely circulated date of Friday, Sept. 7.
