we regain power in 2019.” The former minister also berated the Buhari government for what he described as a hoax anticorruption crusade, saying that the process that led to the convictions of exgovernors Jolly Name and Joshua Dariye were initiated by the PDP administration. Justifying why it is pertinent for Nigerians to vote out the APC, Turaki said, “today Nigerians are crying, they are weeping and dying and they believe that the only party that can save them from this malady and psychological trauma is the PDP. The party performed creditably well with landmark achievements and legacies.” According to Turaki, though all PDP aspirants have personal qualities to trounce Buhari in 2019 election, he remains the best candidate that the PDP can present, adding that his contest is not a do or die affair. He said, “If I get the ticket,
I will defeat Buhari. If I do not get it, I will work with whoever gets the ticket to defeat Buhari. But I am offering myself to run on the platform of PDP to help revamp the country from its present decay.” He, however, urged the party leadership to improve upon its openness, fair and equitable conduct of the Ekiti State governorship primary and during the presidential primary election. But when contacted, the APC Vice Chairman (North-West), Alhaji Inuwa Abdulkadir, faulted Turaki’s claim, saying that the former minister is taking nonsense. He said, “The APC is focused and will consolidate in 2019. ‘‘It is wrong for him to equate the President and the APC with a notorious driver and his gang robbing the people. He is not a serious contender for the prestigious position as he is only playing to the gallery.”

The Minister of Power, Works and Housing, Mr. Babatunde Fashola (SAN) has said that Nigeria lost her best opportunity for massive development to stomach infrastructure between 2007 and 2015. Fashola, who spoke on Monday as the guest lecturer at the Herbert Macaulay Memorial lecture (HMML) of the Faculty of Engineering, University of Nigeria, Nsukka, said: “While other oil producing countries were busy building their nations at a time when oil prices peaked, the past administration in Nigeria developed a different form of development known as stomach infrastructure. “We should never forget this. We decided to share the money rather than invest the money just to win elections. The money that should have been used to fund the Abakaliki rice was used to import rice. “This is the opportunity that President Muhammadu Buhari has come to recover through the enormous Development and Recovery Plan. So, when the President is talking of change, he is talking of a time when we will invest in real infrastructural development and not stomach infrastructure. “Unlike before, President Buhari has made a choice and that choice has led to massive development across the country.”
He thanked the Vice Chancellor of the the institution and the Dean of the Faculty of Engineering for the opportunity to deliver the lecture, urging them to ensure that more quality engineers are produced in the school as there are now opportunities for them to excel. In his welcome address, the Vice Chancellor of the University of Nigeria, Nsukka, Prof. Chukwuma Ozumba stated that: “the Herbert Macaulay Memorial Lecture Lecture was instituted by a Special Resolution of the Board of Faculty of Engineering in 1978. This year marks the 40th anniversary of the institution of this lecture HMML. “To deliver this years lecture, we sought for a personality who has had experience in the management of engineeringrelated infrastructure and who presently occupies a very sensitive position where engineering plays significant roles in our national development. “We found such a personality in the person of Mr. Babatunde Fashola, the immediate past Governor of Lagos State and current Minister of Power, Works and Housing. “The relevance of engineering in all facets of life cannot be overemphasized. The Herbert Macaulay Memorial Lecture series
has provided a platform for an in depth discussion of engineering problems and their solutions and has since 1980, made significant contributions to the national development through these engaging discussions,” he said. In his speech, the Dean, Faculty of Engineering, O.U. EFCC secures 139 conviction in 6 months Convictions of 2 ex- Govs, SAN significant - Spokesman
Peter Fowoyo, Lagos The Economic and Financial Crimes Commission (EFCC) has disclosed that it has secured 139 convictions between January and June 2018. A top source in the commission, who confided in The Daily Times on Monday, also stated that the new figure is an improvement of the 89 convictions recorded in May. The source added that the EFCC has remained consistent in its efforts to change the infamous narrative of pervasive corruption in the system. He added that the convictions came from Abuja and its zonal formations in Lagos, Port-Harcourt, Benin, Ibadan, Enugu, Uyo, Kano, Kaduna, Gombe and Maiduguri. The source, who spoke in confidence, added that many ongoing corruption cases are being prosecuted by the EFCC nationwide. According to him, the agency will ensure that the cases are pursued to a logical conclusion, saying that the agency is determined to surpass the 189 convictions in 2017. Speaking on the development, the EFCC’s Head of Media and Publicity, Mr Wilson Uwujaren, said the convictions of two former governors and former Senior Advocate of Nigeria (SAN) and others
were significant. He said, “The 139 convictions, which is an improvement of the 89 convictions recorded in May, is indeed, significant in many respects, particularly, as it includes the conviction of two Political Exposed Persons (PEPs) – Jolly Nyame, a former governor of Taraba and Joshua Dariye, a serving Senator and a former governor of Plateau, who both are currently serving their 14-year jail sentence for criminal breach of trust, misappropriation of public funds, and receiving gratification. “Indeed, the EFCC has remained consistent in its efforts of effectively changing the negative narrative of pervasive corruption in the system, and altering the general perception that there are some people who are above the Law. “Suffice to state, that the record of convictions, also includes that of a former Senior Advocate of Nigeria (SAN), Joseph Nwobike, who was convicted for attempting to pervert the course of justice. “At the moment, several of such corruption cases are being prosecuted by the EFCC across the country, which the anti-graft agency is determined to prosecute to a logical conclusion. He also noted that the agency is determined not to rest on its oars, as it is poised to surpass the 189 convictions secured in 2017. It is instructive to note that the
commission secured 189 convictions between January and December, 2017. The Daily Times recalls that Justice Adebukola Banjoko of the Federal Capital Territory High Court, Gudu, had on May 30 sentenced former Taraba State Governor Jolly Nyame to 14 years imprisonment for criminal breach of trust, two years for criminal misappropriation, seven years for gratification and five years for obtaining by dishonesty, without option of fine. Nyame was found guilty of 27 out of 41 counts of alleged diversion of public funds while he served as governor of Taraba State. He was prosecuted by the EFCC for diverting N1.64 billion while he served as governor between 1999 to 2007. Few weeks after Nyame was convicted for fraud, the same Justice Banjoko also found former Plateau State Governor Joshua Dariye guilty of monumental fraud. The erstwhile governor was charged for diverting about N1.2 billion while he held sway as the number one citizen of the North Central State. Dariye was brought to court on a 23-count charge by the EFCC in 2007. Also, a senior lawyer, Dr. Joseph Nwobike, was convicted of criminal charges on April 30, 2018 by Justice Raliat Adebiyi, of a Lagos High Court, Ikeja for attempting to pervert the course of

For the 5th time, court orders FG to release Dasuki Andrew Orolua, Abuja For the fifth time, a Federal High Court in Abuja has granted bail to a former National Security Adviser (NSA), Col. Sambo Dasuki (rtd), in the sum of N200million and two sureties in like sum. Justice Ijeoma Ojukwu granted Dasuki bail on Monday while delivering judgment on a fresh fundamental human rights suit by Dasuki after the Federal Government refused to release him based on four previous bail granted to him by Justice Ademola Adeniyi (rtd.), Justice Ahmed Mohammed, Justice Hussein Baba-Yusuf and Justice Peter Affen at various times in the Federal High Court and the High Court of the Federal Capital Territory (FCT) Abuja.
Justice Ojukwu further held that Dasuki’s application is not connected to the earlier matters in which he had been granted bail. She held that Dasuki’s continued detention since 2015 by agents of the Federal Government is a gross violation of his fundamental rights and consequently ordered for his release on bail. But the judge said the two sureties must be, either civil servants not below grade level 16 or private citizens who will deposit N100m with the registrar of the court to be returned to the sureties at the end of the trial. For the civil servant, the court ordered that a letter of appointment and letter of last promotion be submitted to the court for verification. In the event that the surety is a private
citizen, he must own landed property in Abuja metropolis and produce the original copies of the property. In addition the surety must produce evidence of tax payment from 2015, 2016 and 2017. The conditions also included submission of copies of sureties passport photographs to the court as well as addresses of residency. Though, the judge frowned at the continued detention of the former NSA by the Federal Government, as “an aberration of the rule of law and the constitution” she refused to award N5billion damages asked by Dasuki for the breach of his rights. The judge however, dismissed federal government’s claim that Dasuki constituted security risk to the nation.

Olagunju of the Oyo State High Court in Ibadan found Adio guilty on one out of a two count charge brought against her. The count which earned the convict a jail term borders on the allegation of obtaining N9.2 million by false pretence from one Abiodun Olonade, a Nigerian resident in Ireland. Adio was sentenced to seven years imprisonment without an option of fine. The court also ordered that the convict to return the said N9.2 million to the victim.
G4G: UNICEF enrols 15,303 girls in 300 Northern schools Doosuur Iwambe, Abuja Girls for Girls (G4G) Initiative of the United Nations Children’s Fund (UNICEF) has successfully enrolled about 15,303 girls in 300 schools across 18 local government in 3 Northern part of the country. G4G Initiative is a component of the girls education project phase 3 being implemented in Northern Nigeria to help support girls to remain in school and improve their learning achievement. Mrs. Azuka Menkiti, UNICEF Education specialist made this known during a two-day Media Dialogue on Girls for Girls Initiative in Gusau, Zamfara State on Monday. She explained that the programme, which was introduced in August 2017 after series of consultation, is centred on developing girls interest in education, life skills, health as well as building their self confidence. She said, “About 15,303 girls have been successfully enrolled in 813 G4G Initiative in 300 schools across 18 LGAs in 300 pilot schools in three Northern States. “ The 3 States are Bauchi with a total number of 5,284 students, Katsina 5,620 and Zamfara 4,399 pupils”. The Executive Director, Life Helpers Initiative, Mr Tayo Fatinukun, had earlier in his address, said that about 4,099 girls enrollment were spread to 100 selected schools in six Local Government Areas of Anka, Talatu-Mafara, Shinkafi, Kaura-Namoda, Bugudu and Tsafe. He added that each of the schools had three mentors who were trained to relate with the girls on their challenges. He also said that out of the 4,099 girls, 960 among them were trained on social, vocational and health based issues. According to him, the initiative is a school-based safe space, extra curriculum activities established in support of the enrolled girls, especially in the Local Government Areas (LGAs). He said, “Zamfara is one of the educationally disadvantaged states of the federation with very poor and low enrollment, retention level and strong disparity between boys and girls enrollment. “Our targets are the children, women of reproductive age, youth and the community structures. “For this project, since its inception in August 2017, we have been able to enroll a total of 4,099 girls spread across six LGAs of the state. On the challenges faced in the project, Fatinukun said insecurity in some communities and LGAs had hindered the educational progress of some girls.
He said, “Some communities are very volatile and so there is need for the government to provide security for schools in the area. “Low infrastructure development is another threat to the education of the girl child and so there is need to provide conducive learning facilities for the girls.” He, however, called for private donor’s involvement to support the programme so that the results could have greater impact. On his part, the Minster of Information and Culture, Alhaji Lai Mohammed, said that the initiative had helped to support girls to remain in school while also improving their learning achievement. Represented by Zira Nagga, Principal Information Officer, Federal Ministry of Information, Culture and Tourism, Lai Mohammed said there was need to empower the girls through education as they are very important part of the society. According to him, the position of girls in the society buttressed the need to ensure they were empowered, especially through education. He said that they also formed a high percentage of success in developmental processes in any society. “We all know that the G4G initiative is a component of the Girls Education Project Phase 3 being implemented in Northern Nigeria to help support girls to remain in school and improve their learning achievement. The minister said, “At this point, there is need to appreciate that some progress has been made in this bid, but a lot still needs to be done considering the fact that a large number of girl-children are yet to be captured in the programme.” Mohammed, however, commended UNICEF and other partners for creating visibility for development issues relating to the girl child education in the country. Also speaking, Geoffrey Njoku, Communication Specialist, UNICEF, said the initiative was apt because Zamfara State has a higher percentage of out-of-school girls and even out of school boys than any part of the country. Njoku noted that the initiative was one out of the many used in bringing girls back to school. He said, “This project focuses on education of the girl child and not only that; it also entails educating the mothers. “When you educate a mother, the likelihood of her own children going to school is much higher than an uneducated parent. In essence, it is more important that the girl is educated. “The success of the initiative is that it has improved enrolment and retention level of the children.”

Police deny protest over unpaid allowances The Nigeria Police Force has denied that Policemen protested in Maiduguri over non-payment of their Special Duty Allowance. The Force PRO, Jimoh Moshood, said “it is not correct that police personnel protested in Maiduguri today, July 2, 2018 (yesterday).” He further noted that “some of the Police Mobile Force personnel on Special Duty in Maiduguri went to the Borno State Police Command Headquarters on enquiry over the delay in the payment of their special duty allowance in the early hours of yesterday and not on protest as reported in some media. “The Inspector General of Police, IGP Ibrahim Idris, promptly directed the
Commissioner of Police, Borno State to address and inform them why there is delay in the payment of their special duty allowance, and also assure them that since the budget has been approved, the allowances will be expeditiously processed and paid without any further delay. They subsequently returned to their duty posts.” Moshood also said “the IGP has ordered the Commissioner of Police, Police Mobile Force (PMF) to proceed to Maiduguri, Borno State and other States in the North East where PMF personnel are deployed on special duty; to lecture and inform them on the efforts being made by the Force to ensure timely payment of special duty and other allowances to police personnel in the
North East of the country. “The Police Mobile Force personnel that went on the enquiry are not those attached to Operation Lafiya Dole in the fight against insurgency in the North East but those on the category of visiting Police Mobile Force units deployed in Maiduguri on Crime Prevention and other Police duties in the State. “Members of the Public in Maiduguri, Borno State are hereby enjoined not to panic but to go about their lawful duties and other responsibilities without fear or apprehension. “The Nigeria Police Force is a disciplined organization and will not allow any situation to degenerate into disturbance of Public Peace anywhere in the Country.”
Short News Ogun pipeline explosion: We can’t confirm any loss of life - Police Joy Anyim, Lagos Heavy pipeline explosion rocked the Ilara community in Ogijo, Ogun State on Sunday night after suspected vandals had alleged broken a Petroleum pipeline in the area. Our correspondent gathered that the explosion which started at about 10 pm on Sunday July 1st, resulted in members of the community fleeing their home for safety.

Kerosene scarcity hits Bayelsa Akam James, Yenagoa The renewed operations of the Joint Task Force (JTF), deployed to protect oil facilities within the Niger Delta against illegal refineries and other oil related criminal activities has resulted to shortages of kerosene to residents in Bayelsa. Kerosene scarcity was sequel to a raid by the joint military force, Operation Delta Safe to illegal refinery sites in Okaki, Rivers and Nembe in Bayelsa. Checks in Yenagoa by our Correspondent indicated that
the bulk of kerosene and diesel used by residents in Bayelsa were sourced from the two sites which were destroyed by troops. It was further gathered that residents preferred kerosene sourced from the ‘local refineries‘ because it is cheaper and lasts longer than the ones sourced from the established distribution channels. Mrs. Ebiere James, a housewife said that the price of kerosene has increased astronomically within the past few weeks, which made the commodity unaffordable to most households, and other smaller quantity dealers.

Police arrest FCMB security while robbing bank’s ATM Moses Oyediran, Enugu An operative of Enugu State Police Command has shot and arrested a security official of First City Monument Bank (FCMB) in Nsuka, Enugu State, while carting away N3.655 million after breaking into an Automated Teller Machine (ATM) at the bank. The official, identified as Alumona Peter Nkem, an indigene of Abbi community in Uzo-Uwani Local Government Area of the state, was employed in the bank barely three months ago and was arrested at the weekend. The Daily Times gathered that Nkem scaled through the back fence of the bank, having perfectly tied a rope to the fence which he used to drop into the bank’s premises. He disconnected the CCTV camera before breaking into the ATM and removed the amount.
A senior officer who pleaded not to be mentioned in the report because he is not authorised to speak on the matter. confided in our correspondent that Nkem had successfully removed the cash from the machine when one of the police officers attached to the bank sighted him on the roof with his loot. The officer said, “He was in the process of climbing down from the roof of the bank when he was sighted by one of the officers attached to the bank; the officer asked him what he was doing on the roof. “He told him he is one of the security men of the bank and before we could say Jack Robinson, he aimed at the fence before he was shot at”. He added that the suspect must be a chronic criminal for him to have successfully disabled the CCTV camera before entering the bank to carry out his operation. The police said its officers were intensifying their efforts to arrest his accomplices who sped off in a waiting car

Plateau killings: STF parades 11 suspects Kingsley Chukwuka, Jos The Special Military Task Force in charge of security in Plateau State code named “Operation Safe Haven” (OPSH), said it has arrested 21 suspects over the recent killings by unknown gunmen and civil disturbances by hoodlums protesting the attacks. Wabote makes case for local content Idu Jude, Abuja The Executive secretary, Nigeria Content Development management board (NCDB), Simbi Wabote, has said that his leadership is poised to ensuring that the Nigeria oil and gas industry, achieves its optimal need, more especially ensure the existence of modular refineries. Wabote, stated this Monday, while delivering his opening speech at the ongoing Nigeria oil and Gas conference in Abuja.
According to Mr. Wabote, NCDB has just signed the Shareholders Agreement for 30% equity participation in a 5,000bpd modular refinery. More of such interventions are in the pipeline. He said, “We are fully keyed into the Petroleum Industry Roadmap under Strategy No.9. We are actively working on various aspects of the ‘7 Big Wins’ such as capacity building with many training man-hours achieved since last year. We are working on the promotion of domestic utilisation of LPG and the establishment of modular refineries”.

Short News Kwara prohibits tree felling, charcoal production Kehinde Akinpelu, Ilorin The Kwara State Government is set to up a task force to checkmate illegal tree felling as well as the production, transportation and sale of charcoal in the State. The State Governor, Alhaji Abdulfatah Ahmed made this known on Monday when he signed into law an amendment bill prohibiting the production, transportation, storage or sale of charcoal in the State. According to him, the amendment was necessitated by the need to strengthen existing laws against charcoal production and transportation in a bid to protect the environment and preserve our natural resources, especially valuable cash crops that can boost the state’s economy.

China’s RBI: Before we are left behind again

The Chinese conceived the grand Road and Belt Initiative(RBI) as a strategic agenda to change developmental politics of the world. Almost five years after ,the BIR is yielding results that even worst of critics are now acknowledging. RBI is truly disruptive of existing order;it was a daring subtle attacks on the Washington consensus which many experts agreed is not working. While RBI is not about Beijing Consensus,it fills a vacuum of what appears missing in the world developmental terrain-A win win cooperation where stakeholders are regarded as equals.It contrasts with the Western practices which prescribe harsh austerity measures which further pauperises the recipient and which eventually yielded little or no developmental returns. RBI emerges at a time the world is yearning for fresh impetus to addressing world developmental inequality.Fact was the gap between rich and poor nations were widening.Existing western institutions appear overwhelmed or stucked in dominance and exploitative mode of the past that they fail to see the frustration of Africa and the developing world. The public private partnership that later emerges also fail to fully answer the question of development without immediate eye on profits. Projects executed with PPP end up passing huge cost onto consumers ,the already impoverished citizens.The investors is fixated on profits. The world was at a cross roads with many leaders of developing world desperately searching for alternatives. On the horizon then emerged a China that lifted close to 500 million of her citizens out of poverty.Beijing is openly unstopably on the ascension as acknowledged even
by top western experts and academics.The balance of economic power appears shifting and leaders of poor world find a new ally who few years ago was one of them.The switch to the East was dramatic.There was an electric realization that homegrown innovative development is possible. The immediate rush to accept Chinese credit and offers was motivated by several factors some of them already listed above. The key one however is that Beijing gives a vision of poor nations moving out of poverty ,having a strong infrastructures that can drive the growing- out -of poverty efforts . Hence unthinkable roads,railways,ports and power projects were proposed and financed with such ease.Many landlocked countries got unbelievable infrastructure designs and plans which they privately thought is impossible dreams.And many are coming to pass. Many have lamented likely second colonization of Africa.There is a campaign and advocacy against emerging debt diplomacy by Beijing.Excessive lending critics warned may plunge developing world into a new round of slavey. Certain practices of the Chinese have also been questioned.Many legitimate questions are been raised.Many western experts spend much time these days warning Africa to beware of China and her RBI. What amuses me mostly on this campaign and advocacy was the hypocrisy behind it all.Before China helpline,developing world were wallowing in deep poverty and infrastructure run down without any hope of redemption.Developmental pains were tied to fiscal measures such as withdrawal of subsidies,austerity measures and wage squezee,all inhuman conditions that have produced no positive results in the last three or so decades.Even when many things may
be bad with the Chinese option,leaders of Third World are eager to taste something new as long as it produce a new results. And new results are emerging.The Ethiopia-Djibouti high speed rail is marvelous.The East Africa ambitious standard guage railway powered by China is extraordinary.Several landmarks projects are ongoing across the continent. The projects are life changing ,moving Africa out of stone era infrastructure to modernity. Still on the hypcrisy of China bashing over RBI,It is not just developing world that are logging into the web of RBI. It should amazes many in the developing world how even western governments are flocking to Beijing to partake in the RBI economy. In the last two months,top French,British and German ministers have visited China to strike deals and businesses related to the RBI.Europe as a whole is also inking projects related to the silk road and OBOR. Western companies are forming alliances and partnership with Beijing to partake in the multibillion dollar contracts and value chains. But why all these stories.I am having the feeling we are been left behind.We are succumbing to the blackmail while other parts of the world are reaping hugely from RBI.Nigeria and West Africa should avoid being left out.There is an emerging new world order where destinies of nations are been shaped.Nigeria appears to be sleeping and the rest of west Africa seems cowed by France from pushing for mutual benefits from RBI. Southern and East Africans appear smarter. For one, the RBI incidentally covers parts of East Africa.Their regional leaders pushed and lobbied for it.West Africa is largely left out.Bugged down by western
pressure,Francophone West Africa remains a drag on any ambitouus opening up to China. For the Anglophone even Sierral Leone got a rebuke for romancing the Chinese .ECOWAS leaders are stucked in decades of paper works with no developmental manifestation. Nigeria on her part is torn between her closeness to the Western world and the pulling need for Chinese credit.Instead of forging strategic partnership like the Pakistanis and The Ethiopians,Nigeria opts for occassional loans which carry no advantage of strategic friendship with Beijing.The Abuja light rail project epitomizes how unimaginative Nigeria has been in tapping into the Chinese lifeline. But it is not late.If urgent steps are not taken,East and Southern Africa may leave West Africa behind in term of growth,poverty alleviation and infrastructural developments.Already,East Africa leaders are in competition as to roads,rail and ports projects. Dwindling national earning compels innovative sourcing of alternative funding for national development.Waiting on the West is foolhardy as western capitals are also romancing China.Depending on private capital is unhelpful as profit motive is incompatible with developmental pressure facing our people.The Chinese offer with rigorous negotiation seems a way out many developing nations are rewardingly accessing.While our experts continues to pontificate on dangers of purported second slavery,many parts of the world are logging unto an RBI that is encircling and positively transforming the world. As we squandered the huge opportunities of the petro dollars,will posterity forgive us if we sleep off while the world joins a new developmental world order ?

As far as one knows, no court in the United States of America has ever issued an injunction against the Congress, restraining it from summoning any person or preventing it from concluding any proceedings before it. In the United Kingdom, this phenomenon is even unthinkable. Emeritus Professor Ben Nwabueze, SAN has also cited numerous African and Commonwealth countries where this practice of stopping parliament through court injunctions is also unheard of. What Justice Ahmed Mohammed did on March 14 was to allow his court to be used to scrutinize constitutionality, not of a law but, of a pending bill on election. If you are not alarmed by the peculiar pronouncement of Justice Mohammed purporting to restrain the Senate from proceeding on passing of the bill, then you have overlooked a dangerous precedent and a big threat to our democracy. We would all soon be alarmed when in the near future, I bet, a judge would try to stop the parliament from e.g. passing the budget, or from screening ministerial nominees, or from considering committee reports. Apart from being the first judge to allow interpretation of provisions of a bill in a court of law, Justice Mohammed scored another first by restraining Mr. President from assenting to the bill. Judiciary has been restraining parliament but it has never restrained the executive in the exercise of its constitutional powers. Undoubtedly, this would have opened doors for anybody to seek to restrain a President from convening a Federal Executive Council meeting. Perhaps again after unexpected leaders would have emerged during the Ninth
Assembly in 2019, a judge would issue an injunction stopping a Mr. President or Governor from exercising their powers under S. 64 or S.105 of the Constitution to inaugurate a new parliament! But consider a few more examples of where judiciary has unconstitutionally and undemocratically interfered with the exercise of legislative powers. Last February, Justice Anwuli Chikere held that the House of Representatives could not continue with an investigative hearing on the Law School hijab controversy with Miss Firdaus. Also, the court in Adeola Vs. HOR (2015) prevented legislators from casting votes to change their Majority Leader during the dying days of the Jonathan Administration. Again, Mr. Justice Gabriel Kolawole (now of Court of Appeal) stopped the Senate from inviting the former EFCC Chairman to disclose the whereabouts of recovered looted assets and whether some of the assets have not been illegally converted to personal use. The billions of Naira at stake are forever hanging: Ibrahim Lamorde V. The Senate (2015). So many more instances abound. Indeed, an undemocratic precedent is gradually being established in Nigeria whereby when a public official is invited on investigative hearing that is of national interest, he rushes to court and a judge will readily stop the parliament in what is couched as interim order, but in effect a permanent one. Many Nigerian lawyers, and judges, do not believe there is a matter on the face of the earth which the court system cannot or should not entertain. And it is only in Nigeria. But I dare say this Nigerian belief is erroneous. They cite copiously from the Constitution as if we are the only
one in the world that operates a written Constitution, or that the provisions of our Constitution originate from such locations as Daura, Ile Ife, or Benin, or are inspired by philosophies that are exclusively Nigerian. As with the other two arms of government, judicial power is limited by the principle of separation of power. I am sure many lawyers may not like it, but reality is that judicial activism stops where legislative powers begin. Judicial power in any system of government, democracy or autocracy, is not infinite and Nigerian courts should embrace their limit and not arrogate to themselves the power to tell the legislature how to exercise its own power. Let me have the answer when you ask a typical judge, “what is the adjudicatory limit of Nigerian courts?” The fact is Nigeria operates a presidential system of government, and it is the Constitution that has allocated governmental powers between the three arms. The Constitution can only codify so much of hundreds of years of democratic practice of the West, especially the USA. As a code our Constitution, however long winded, can only capture salient features of this system of government, leaving the day-to-day detailed practice to treatises, publications and exchange of ideas and visits which legislators do undertake. Separation of Powers is an established tenet of this system. The Court of Appeal has since held Separation of Powers to mean, among others, that one branch of government should not exert control on another in Hon. Abdullahi Ahmed V. SOHA. Yet, the statement of Justice Mohammed is symptomatic of a wider trend of judiciary-induced roadblock against the
parliament. I am one of those who share the notion that the tendency is extremely high for a negative judicial pronouncement on any parliamentary process and procedure. Whenever it has to exercise discretion in determining propriety of exercise of legislative power, it is unlikely the judiciary will not pothole exercise of that power, even if that decision is incongruous with established global legislative practice. One further example will suffice. For centuries, courts in all democratic countries across the world have been barred from reaching out against legislators regarding whatever they say or do during legislative or committee proceedings. This is called freedom of debate or legislative immunity. Trust Nigerian courts, they nullified the privilege in Hon. Mike Balonwu V. Obi (2007). Of course, this decision has been jettisoned when President Buhari recently signed the newly-passed bill re-authorizing legislative immunity. But if Balonwu’s case was at variance with global parliamentary practice, by all standards of due process it was a constitutionally appropriate judgment: it decided on the propriety of a concluded Act of Parliament. More strange are orders like the ones cited above that tend to prevent ongoing legislative proceedings by any guise. By the provisions of S 4(5), (8), (9) as well as S. 6 of the Constitution, no one has ever argued that the court cannot determine propriety of anything and everything that the parliament has completed doing. However, there is nothing unique in those provisions that make the Nigerian judiciary alone stretch its mandate to settling immature disputes.

Editorial Commentary The reality of life of integrity in Nigeria (II)
Times Guest Colunmist Femi Falana For instance, the Child’s Rights Act, which provides for compulsory and free education for every child from primary to junior secondary school, has been adopted by all the 17 states in the South and only eight out of the 19 states in the North. It is not surprising that terrorists and other armed bandits have continued to recruit from the large army of children who have been denied access to basic education in several states in the country. Instead of providing fund for public schools the governments have continued to encourage the establishment of private schools for the education of the children of the elite. Whereas 2% of the consolidated revenue fund of the federal government is contributed to the Universal Basic Education (UBE) Fund annually in line with Section 2 of the Free, Compulsory Basic Education Act, majority of the state governments have refused to contribute counterpart fund to enable them to assess the UBE Fund. Hence, not less than N68 billion is laying waste in the UBE account in the Central Bank while millions of children are roaming the streets. According to the UNICEF report of 2012, Nigeria had 10.5 million children who were out of school. That was the highest figure in the world at the material time. The figure has since increased geometrically. Yet, all the governments have refused to comply with the judgments of the ECOWAS court and the federal high court, which have mandated them to provide every child with basic education. Our appeal to the Police Authorities to arrest and prosecute parents and guardians, who refuse to allow their children and wards to acquire basic education, has fallen on deaf ears. The story is the same with respect to the provision of basic healthcare for the people. As public officers and their family members are flown abroad for medical treatment in foreign medical centres the people are left to die in ill equipped hospitals in the country. The federal government has failed to implement the provisions of the National Health Insurance Scheme Act and the National Health Act. Some highly public officers indicted for looting the account of the National Health Insurance Scheme have been given a clean bill of health. Even though the National Health Insurance Scheme Act was enacted in 1999, only four out of the 36 state governments have adopted it. Following the failure of the federal and state governments to implement the Immunisation Act, the Bill Gates Foundation and Dangote Foundation have taken over the duty of ensuring that our children are immunised. Preventable diseases like polio, cholera, meningitis, lassa fever and others are ravaging the populace without any meaningful intervention from the governments. It is common knowledge that the scourge of HIV/ AIDS persists in the country due to the failure of the governments to provide anti -retroviral drugs for the victims. In 2014, the sum of $30 million donated to the federal government by some development partners to fight the
scourge was stolen by a handful of officials in the federal ministry of health. Since the federal government has refused to recover the fund and prosecute the indicted criminal elements the development agencies have suspended the provision of more fund to acquire drugs to fight the menace of HIV/AIDS in Nigeria. In its reaction to Mr. Gates’ speech the federal government assured him of its commitment to invest in human capital development. Beyond such assurance the federal government should review the Economic Recovery and Growth Plan (ERGP) with a view to providing sufficient fund for education, health and economic empowerment of the people in line with the provisions of Chapter 2 of the Constitution. But the controversial 2018 Appropriation Bill which has just been signed into law by President Buhari has not addressed the issue of the welfare of the Nigerian people. In defending its illegal decision to rewrite the budget the national assembly claimed to have corrected the regional imbalance in the Act! The dispute between the APC-led legislature and the APCled Executive is centered on the unlawful enrichment of the legislators through budget padding. The Buhari administration has complained of lack of funds for the infrastructural development of the country. In November 2015, I called on the Federal Government to review the Deep Offshore and Inland Basin Production Sharing Contracts Act of 1993. Although the advice was ignored the Federal government admitted last year that the nation had lost $60 billion due to non-enforcement of Production Sharing Contracts with Oil Majors as required by the law. In March 2016, I requested Federal government to recover over $100 billion which had been looted or withheld from the Federation Account. While acknowledging the letter the Finance Minister assured me that my request was receiving attention. Thereafter, the NEITI disclosed that the sum of $16.8 billion had been withheld from the Federation Account by the NNPC. In another development, the National Economic Council has indicted some Federal government revenue generating agencies over non-remittance of N526 billion and $21 billion (N8 trillion) into the Federation Account between 2010 and 2015. Instead of collecting the outstanding sum of over $200 billion the Federal government is busy celebrating the recovery of less than $2 billion from some politically exposed persons. However, loans are being procured to fund multi billion dollar projects. It is high time, the Nigerian people led by the labour movement mounted pressure on the anti-graft bodies to recover the looted wealth of the nation from agencies of the Federal government and the multi-national corporations. Unless these huge funds are recovered and channeled towards infrastructural and human capital development of our nation, life of integrity in Nigeria will remain a mirage. Concluded

efore the creation of Ebonyi State on October 1, 1996 by the former military Head of State, the late Gen. Sani Abacha, rice was one of the nation’s stable foods and still remains the mainstay of the daily living and earning of the people. For years now, Abakaliki, the Ebonyi State capital, has been known as home of local rice production not only in Nigeria, but in West Africa sub-region. Ebonyi State is one of the most agrarian of the states in Nigeria. Made up predominantly of farmers, with savanna and semi tropical vegetation, humid, sandy and marshy soil, the state is blessed with moisture land for growing of varieties of cash and food crops especially rice. Among the agricultural potential, the production of the famous Abakaliki rice has made the state so popular and a beehive of commercial hub. No visitor who comes to Abakaliki, the state capital, without testifying to the high quality of Abakaliki rice compared with other rice produced locally and internationally. The Abakaliki rice is blessed with so many nutritional values, which are gotten from the salinity in the land of Abakaliki rice mill. It is even better and graded higher by those that experienced its nutritional values. Apart from its nutritional value, the Abakaliki rice is naturally salted with good taste. The reputation of Abakaliki rice is derived from its superior taste. Rice production no doubt has created jobs from which a lot of people feed their families. There are a lot of jobs people do in Abakaliki rice Mill Industry including technical/professional and unprofessional/ causal works, as well as others who sell their wares in the area. The Abakliki Rice Mill, as it is popularly called, is adjudged to be the first indigenous company since the creation of the state. During the creation of the state, at least Abakaliki rice Mill Industry was equally the only existing industry in the state. The first milling engine procured for milling of Abakaliki rice was bought by one Mr. Anekwe Bestman. The relocation of the mill to its present site was done under one Hon. P. O. Nwike, who was then the Executive Chairman, Abakaliki Local Government Area in the then Anambra State. Signatories to the statement included the Chairman,Joseph Ununu; Administrative Secretary, Nwede Richard; Secretary, Usulo Emmanuel and Fidelis Igwe. However, on November 15, 1977, the land used for the construction of the rice mill was leased by the Abakaliki Local Council to Rice Mill Abakaliki, for 99 years upon payment of valuable consideration. In September 1989, the Rice Mill Asociation Abakaliki was registered as a company with the incorporation name – Rice Mill Company Nig. Ltd with registration number RC. 136,800. But on January 1, 2000, the customary right of occupancy with respect to the entire area
of land measuring 1938.464 square metres occupied by the company was issued by the Government of Ebonyi State government. The continued production of Abakaliki rice became endangered in the past administration of former Governor Martin Elechi, due to the face-off between the Abakaliki Rice Mill Company and Ebonyi State Government on the planned relocation of the rice mill to the three rice clusters in each of the senatorial zones of the state. However, respite came with the emergence of David Umahi, as the governor of Ebonyi State. With the dwindling oil revenue, the present administration has re-emphasised the need to revert to agriculture which was the mainstay of the Nigeria’s economy before the discovery of oil. In line with his vision for agricultural revolution especially rice in the state, Umahi has procured 40 tractors for rice production. The Ebonyi State Government has earmarked 40,500 hectares of land for rice cultivation for next year’s farming season spread across the 13 council areas in the state. Each of the LGAs has 2,500 hectares mapped for the rice production while IFAD has six thousand hectares and FADAMA, 2,000 hectares. We are of the opinion that with the above measures, the rice revolution in Ebonyi State will play a major role in ensuring local production of the stable food and reduce importation of foreign rice to barest minimum.

Chief of Staff to the Senate President, Bukola Saraki has dumped the ruling All Progressives Congress (APC), as the country prepares for 2019 general election. Hakeem Baba-Ahmed announced his exit from the ruling party while addressing journalists on Monday. He said the decision to leave the party was a difficult one adding that he had to do that anyway, in order to be in a position to contribute more meaningfully to efforts to rescue Nigeria from rising cases of insecurity and other social malaise. Ahmed, who was appointed Chief of Staff to Saraki in 2017 said his leaving APC has nothing to do with the position of the Senate President. However, prior to his resignation, there have been speculations that Saraki is preparing to decamp from APC due to the not-too-cordial

According to Ahmed, he took the decision to leave APC after due consultation with members of his Akida faction of APC in Kaduna where Senator Shehu Sani belongs. He told journalists that he has sent a letter of withdrawal from APC to the party chairman in his ward, explaining that he was not leaving APC to join another party but believes the ruling party has underperformed. “This statement is to inform the public of my resignation from APC. Tunde who was arrested in Mile 2 traffic at about 5:00 a.m. along with two other accomplices, Samuel Kolawole (23) and Solomon Omini (32) on Wednesdayafter a chase by the operatives of the Rapid Response Squad, noted that the only job he had was robbing motorists and commuters of their belongings between 4:00 a.m and 6:30 a.m as well as at night. He disclosed that his gang of about 20, usually work in twos or threes holding toy guns, machetes, Jack knives, hammers, rods and other weapons to dispossess commuters of phones, money, jewellery, laptops and other prized possessions. According to him, “it’s a job I have been doing now for more than a year. As soon as we approach a car, we tell the occupants to bring out their belongings. Some would cooperate with us and give us their phones and money.
“Some would wind up. I laugh at them because we would break that glass or use our prepared mixture that when thrown at their side glasses, would bring them down gently and we would take all that we want and leave the place. “We do this every day. We know when to come and when not to. We work with the nature of traffic. We target passersby too. Those going to work or traders going to market are our main target. If you are old on the job, you get good targets. I sold the phones I collect for between N3,000 to N4,000 daily”. He explained further, “recently we collected huge money from three occupants of a vehicle. I don’t know the precise amount. We were two, my colleague tried to abscond with the money and I tried tracking him. Unfortunately for me, he noticed me and eventually machete me at a corner in the head. “I lost so much blood and I was there unconscious. The cut was so severe that .three hospitals rejected me. Here I am still alive. I still see this guy and he is still in this business with me.” Tunde stated that he lost his mum at an early age, adding that he was assisting an Indian hemp seller in Mile 2 before he was introduced into traffic robbery.
He maintained that those who lured him into it assured him he was going to make more money doing that than assisting a hard drug seller, who offered him only food. Drama however ensued during the interrogation of the suspects in RRS headquarter in Alausa when a phone, Nokia Touch, allegedly owned by one of the suspects, Samuel Kolawole, started ringing repeatedly. Police detectives quizzing the suspect put the phone on speaker only for the caller later identified as Robert to claim the ownership of the phone, stressing that the phone was collected from him in Mile 2 by armed robbers. Kolawole who had earlier claimed ownership of the phone in his statement said he bought the phone from a colleague of his with SIM card that morning for N1500. The phone was later handed over to Mr Robert who reported at RRS office after calling. Commenting on the development, Police PRO, CSP Chike Oti stated that the police are intensifying efforts towards arresting traffic robbers in Mile 2 and other parts of the state, adding that substantial progress have been made in that area. The three suspects have been transferred to the F SARS office in Ikeja for further investigations.

National and Sub- National Level”, the governor said it was apt as it summarized the philosophical underpinning of what is defined as social contract governance. “Government exists to provide services to the people across the nation, failure to abide by this need and demand means a grave abdication of a cardinal responsibility, and the resultant effect would be deep apathy and a resort to self help approaches by the citizens and that would not be good for us as a country “I strongly believe that as a country we still have so much to do in the areas of education and healthcare. Niger State Governor, Alhaji Abubakar Sani-Bello on Monday reassured rural dwellers in state of his commitment to infrastructural development of their communities. He gave the assurance at Kampani Bobi in Mariga Local Government Area of the state while flagging off the construction and rehabilitation of rural roads under the second phase of implementation of Rural Access and Mobility Project (RAMP-2) in the state. The Governor said his administration was committed to rural development in order to improve the socio-economic status of the people living in the grassroot. A statement by the Chief Press Secretary, Jibrin Baba Ndace quoted the governor as saying “government will not relent in its efforts at ensuring that life in the rural areas becomes a thing of envy by the people living in the urban centres such that ruralurban migration can be reduced to the minimum”. Under the RAMP-2 project, the governor said 403 kilometres of rural roads will be constructed across the three senatorial zones of the state as a follow up to the 176 kilometres of rural roads rehabilitated under the first phase of the project.

2 bag 3 years imprisonment, 7 arraigned for vandalising EEDC property Charles Onyekwere, Abakaliki A Chief Magistrate Court of Anambra East Magisterial District, sitting at Otuocha, Anambra State presided over by Onunkwo Esquire has sentenced one Ejike Chigozie and Amaechi Joe to three years imprisonment each. They were arraigned by the Police for vandalising the Ring Main Unit (RMU) handle of an Injection Substation belonging to the Enugu Electricity Distribution Company (EEDC), in Aguleri, Anambra State. The vandals, who were tried on a two count charge of conspiracy and stealing, offences punishable under section 495(a) and 353(12) of Criminal Code Cap 36 Vol. II Revised Law of Anambra State 1991 as amended, have been moved to Onitsha prison, where they are expected to serve their jail term. Just recently, three suspected vandals identified as David Michael Ifeanyi, Sunday Nweke and Celestine Nweke, were arrested by the officials of the Nigeria Security and Civil Defence Corps (NSCDC), Anambra State Command, for attacking EEDC property. The suspects were arraigned at the Federal High Court Awka, where they
pleaded not guilty to the two count charge slammed on them. In a statement signed by EEDC Head, communications, Mr Emeka Ezeh said the presiding High Court Judge however, ordered that they be remanded at Awka Prison, while the matter was adjourned to 10th October, 2018. In a related development, four vandals identified as, Azubuike Ezebuokwu, Onye Ogunna Frankling, Chigozie Ekweme and Emezu Emeh, were arrested by some members of vigilance group in Mgbidi, Imo State, for vandalizing the Commissioned Eziani Community transformer in Mgbidi, property of EEDC. They were subsequently arraigned before the Federal High Court Owerri on 20th June 2018 where they pleaded not guilty to the two count charge. They were granted bail, but remanded at the Federal Prison Owerri until their bail conditions are met. Meanwhile, the case was adjourned to 17th October, 2018 for further hearing. According to Ezeh, the activities of vandals have impacted negatively on their operations and quality of service they render to their esteemed customers, as they end up depriving customers the opportunity of enjoying our service. “As a result these, we keep committing financial resources to restore vandalised

There are strong indications that the Senate upon resumption from a three week recess, may reject the court judgment on the Kogi East senatorial seat presently occupied by Senator Attai Aidoko Ali. The likely rejection of the court judgment by the upper chamber stems from an order by the court in its judgement asking the Clerk of Senate, as against the Senate President to swear in Air Marshall Isaac Alfa as Senator representing Kofi East. According to legal experts, the order by the court is capable of triggering constitutional crises in the National Assembly over the engagement and disengagement of lawmakers. A prominent member of the Nigerian Bar Association, Barrister Abdul Sadiq Esq, therefore urged the Senate to reject the judgment of the court, and also cautioned the Independent National Electoral Commission (INEC) on the consequences of issuing a certificate of return without carefully studying the implication of the judgment.

Reverend Johnson Ekwe, urging those occupying elective positions to aspire to fulfill their campaign promises before presenting themselves for reelection as the 2019 general election draw nearer. The State Governor, Chief Willie Obiano, stated this while inaugurating the Nkpor Flyover Park. The Governor represented by the Commissioner for Land, Rail and Water Transport, Mr. Uchenna Okafor, disclosed that the project was executive in collaboration with the Federal Ministry of Works,Power and Housing under Private Public Partnership. He stated that the project is strategic in the commercial city which was before now a flash point for robbers and other nefarious activities as it will further help promote safety in the area, adding that the present administration will sustain proactive steps
in adding value to the society. He announced that the second phase of the project will soon commence, with the construction of bus stop on the wings of the highway. By John Ndu, Awka With the demise last year of the 26th Eze Nri in Nri Kingdom, the acclaimed ancestral home of Igbo civilization is once again embroiled in the kingship tussle among the six villages that make up Nri kingdom. However, apex title holder, Dr. Ramas Okoye Asuzu FCON, the Ezeoba Akajiofor Ndigbo Gburugburu, has called for caution and charged kingmakers to go back to the roots. Speaking with our correspondent in his palace in Uruofolo, Anaocha Local Government Area of Anambra State, Okoye traced the movement of the ancient kingdom back to the remotest prehistory. His words: “Nri kingdom is universally acclaimed by historians and oral tradition as the ancestral home of the Igbos and the epicenter of Igbo civilization. It occupies a religious, social and spiritual position regarded as sacred in Igboland. This historical fact is documented even in the Encyclopedia. The kingdom is composed of six villages namely Umudiana, Uruofolo (Uru ofo na Alo), Ekwenaika and Diodo (Nrinamoke). These villages are collectively referred to as Ifite Nri or (Akamkpisi na Diodo). They are the aborigines (earliest settlers) of the kingdom and are also refered to as Ikenga Nri. “In 1043 AD, there occurred a wave of migrations into the kingdom through Aguleri via Ugbene. Led by one Menri, these migrants first settled in Mkpume Onyilenyi in EnuguUkwu. By negotiations and the grace of the people of Ifite Nri, they finally settled at Agukwu which was a farmland of the Ifite Nri community. These settlers today constitute the other three villages of Nri kingdom, namely: Agbadana, Uruoji and Obeagu. They are collectively referred to as Agukwu Nri. Thus the kingdom is structured along a sharp divide namely - Ifite Nri (Akamkpisi na Diodo) and Agukwu Nri (the latter settlers) who are also referred to as Ezi Nri. This structure resulted in the two divides being autonomous as they lived their own separate existence independent of the other with own tradition and leadership.” It was gathered that the storm of division began to gather in 1115AD when Nrinamoke VII (the traditional head of Ifite Nri (Ikenga Nri) took ill. “Neglected by his Diodo clan, Nrinamoke VII was prompted to enlist the care of his nephew, Nribuife who graciously took good care of him. In appreciation of his devotion and care, Nrinamoke VII bestowed on Nribuife the right to the kingship stool which he gladly accepted. But Nrinamoke VII in his wisdom, went further to compel Nribuife to swear on the Ofo na Alo (the symbol of authority) that the kingship which he has bestowed on him must never depart from his (Nrinamoke) palace. “The Adamas (kingmakers from Umudiana) coroneted Nribuife at Ekeagu in Ifite Nri where he established his temple (Obu Nribuife). After his coronation, however, Nribuife relocated to Agukwu quarter of Nri taking with him the Ofo na Alo. By this singular action, the kingdom was inadvertently unified as the Ofo na Alo of the two separate communities have become unified. Thus it was Nribuife who amalgamated the two autonomous communities of Ifite and Ezi Nri as a unified entity collectively known today as Nri. After the death

How to resolve Nri Kingdom Ezeship tussle, by Asuzu of Nribuife and with the Ofo na Alo now residing in Agukwu, they (Agukwu section) of the kingdom took advantage of the situation that has now played into their hands to hatch an unwholesome conspiracy. Through intrigues, subterfuge and calculated distortion of historical facts, they conspired to introduce a rotational kingship system using the blood linage of Nribuife to technically restrict the rotation exclusively amongst the three migrant villages of Uruoji, Agbadana and Obeagu, contrary to the sworn injunction by Nrinamoke VII that the kingship should not depart from the Umunri clan. In this way, they arrogated to themselves a stranglehold on the traditional stool of Nri kingdom,” Okoye said. According to the scholar, this breach by the people of Agukwu Nri sowed the seed of discord and division between Ifite (Ikenga) Nri (the aborigines) and Ezi (Agukwu) Nri (the migrants) which has now lasted for all of 903 years. He continued: “This situation was made worse by the Mbadinuju administration which ignorantly took sides in the matter by giving the Certificate of Recognition to Obidiegwu Onyeso from the Agukwu section and by this singular act compounded the whole issue of succession almost beyond redemption. “These rumblings of division and imminent implosion in the Kingdom came to a crisis point in 1927. The recurrent succession issues came to a head after Obalike from Uruoji village who was crowned King in 1887 died in 1927. After the death of Obalike, it was equitably the turn of Agbadana village to produce a successor. But one Okpoko usurped this right and was vehemently challenged by Tabansi Udene. The situation degenerated to a point that produced a crack in the ranks of the Adama (Kingmakers) prompting them to crown both contenders. With two kings on the saddle, the Kingdom watched as both tried to undo each other even through fetish means. The situation continued until 1935 when Okpoko died mysteriously and Tabansi became the unchallenged Eze Nri in 1937. Tabansi refused to be persuaded to settle the issue of succession during his lifetime and after his death in 1979, the issue reared up its ugly head in very dangerous dimensions.” As a contingency measure, the Kingdom unanimously endorsed Tabansi’s son to ascend his father’s throne in the capacity of a Regent for
7 years to allow time for the order of succession to be decisively settled. But after seven years and with no solution in sight, the Agukwu Community took late Obidiegwu Onyesoh’s son to Aguleri to be coroneted as Eze Nri, contrary to the tradition of Nri Kingdom and without the consent of the Adama (Kingmakers). “But the move was vehemently resisted by the Kingdom. With a new President General, Oba Kelvin Obaegbunam, who promised to reconcile all factions in the Kingdom now in the saddle, it is the popular wish that, in the overriding interest of the ancient Kingdom, Uruofolo community should be the next village to produce a successor to the throne in all considerations. “As a proportional response, the Ifite Nri community also coroneted their own Eze Nri P.C Ogbumuo as Nrinamoke VIII. He was coroneted by the Adama and the Ifite Nri community who proclaimed themselves as Ikenga Nri with an autonomous status that they have thereafter sought to legitimatize in the court. The matter is now at the Supreme Court level.”
For once let us be true to ourselves in name and in fact. Let’s talk peace, not war. Let’s avert this doomsday situation that has the potential of unleashing a devastating catastrophe on the kingdom.
Now, in his capacity as the father of the kingdom, apex title holder and custodian of the kingdom’s values, Okoye sought a way out for his people. “It is a matter of great regret that the historical significance of Nri is becoming extinct as a result of the recurrent bickering going on in the ancient kingdom. The kingdom is in tatters as a result of a deluge of succession issues that has torn the kingdom apart. It is sad that some illustrious sons of the kingdom are fanning the embers of this division in rather very partisan ways. “But the Igbos say that an elder cannot be at home while a she goat gives birth in its tethers. I therefore deem it as my patriotic duty to the kingdom as a worthy son of Nri and the holder of the apex chieftaincy title in the kingdom (Ezeoba Akajiofor Ndigbo Gburugburu), to advice that we resolve the issues tearing us apart in more inspiring and mature ways by showing some form of accommodation for one another and to approach the issue of succession with a sense of equity, justice and good conscience. “We owe the Igbo race a duty of care as role models in the affairs of Igboland. Setting an undignified precedent will amount to a betrayal of confidence reposed on the ancient kingdom by the Igbos. Until we are able to make reciprocal concessions on the issue of succession, our centre will always give way and eventually precipitate a situation that will never be to our collective advantage.” Asserting that no amount of litigation or hate speech can decisively resolve this matter, Okoye said this generation have in their hands the power to cancel out differences by doing the equitable thing that will guarantee a sense of belonging to all Nri sons and daughters. He concluded: “For a long time we have stood the truth on its head. For once, let us be true to ourselves in name and in fact. Let’s talk peace, not war. Let’s avert this doomsday situation that has the potential of unleashing a devastating catastrophe on the kingdom. China invests $16bn in Nigeria ICT sector Ladesope Ladelokun Not less than a whopping $16 billion has been invested by the Chinese companies into the Nigerian telecommunications industry. Nigeria’s minister of communications, Abdur-raheem Adebayo Shittu, made this disclosure at a one-day conference on “Africa-China Cooperation in Information Technology and Digital Economy: Prospects and Challenges,” organised by the Nigerian Institute of International Affairs, in association with Chinese Embassy and Huawei Technologies in Abuja. Currently, the ICT sector has provided
$32 billion in foreign direct investment over the last 15 years. But the minister noted that as part of that ICT ecosystem and guided by the recognition of the boundless potential of the Nigeria as a great nation within the digital economy. According to him, “Chinese companies have invested over $16 billion to date in fixed assets and facilities nationwide to build and support most network operators in the country.” He explained that investments in infrastructure has been an ICT backbone that ignites other critical sectors of the economy such as banking, e-commerce, insurance, as well as oil and gas. He noted further that Huawei Technologies and China Railway Construction Corporation are partnering
with the ministry on NIPOST’s e-post project. “We are committed to providing efficient and multi-functional post information system to improve modernization and computerization of NIPOST,” he added. FG, states and intrigue of NNPC’s remittance to FAAC Over the years, the monthly distribution of accrued revenue to the three tiers of government usually holds between 18 and 22 of every month to enable government pay salaries early. But now it has gradually shifted to 25th and sometimes 27th day of the month thereby resulting in delayed payment of salaries. The issue even become worst in June as the Federal, States and local governments are yet to receive their allocations for the month of May which should have been shared in June because the Committee said that the nation’s oil firm has shortchanged the federation account with billions of Naira and would not take anything less until the full amount is remitted by the NNPC. On Thursday, the Chairman of FAAC and Minister of Finance, Mrs Kemi Adeosun, during the National Economic Council meeting, said she had briefed the State Governors on the deadlock that they have got currently in the Federation Account and have all agreed that NNPC must remit more revenue than the N127 billion it remitted to FAAC. But the NNPC in a swift reaction after the minister’s statement, said that it remitted N147 billion to FAAC and would not add a dime because the amount is justifiable. The minister said that the government operates NNPC as a business, adding “We have invested public capital in that business and we have expectations of return and when that return falls lower than our expectations then the owners of the business, which in this case is the Federal Government and States, need to act. So, that was what caused the deadlocked yesterday and we really felt the figures that the NNPC proposed for FAAC were unacceptable. We felt that some of the costs couldn’t be justified and so we have decided that rather than approve the accounts, we will go back and do further work.” She disclosed that further negotiations and interactions were ongoing with the NNPC. “However, we did briefed both Mr. President and Mr. Vice President on the deadlock and asked for their support and their forbearance in this because of the consequence which is that workers’ salaries might well be delayed in many States as a result of this. In order to get the accurate figures, that we need, we have asked for forbearance and the State Governors and the Federal Government are all in agreement that we need to get to the bottom of these figures. In particular, now that the oil price is now $76 per barrel in the spot market which means that bonny light is about $78,we want to aggressively set aside money in the excess crude account. So, we are very very conscious that this period, this window of relatively high oil price might not last and we would like to be able to save. If we cannot get into the Federation Account the sort of revenues we are expecting then we will not be able to save. So, it was a very important point really underscored by all the Governors and they really want action taken and they are fully in support of the positions of the Federal Ministry of Finance and the Commissioners of Finance not to approve the accounts until we get further explanations on some of the cost being implemented”, Adeosun said. The Nigerian National Petroleum Corporation (NNPC) may not end soon until the latter pays in to federation account, the correct amount. So, we have been going back and forth with NNPC to try and understand these figures before we can accept them. Remember that the FAAC figures have to be formally accepted by the Federation Account Allocation Committee and we were simply not comfortable with the quantum of some of the deductions made and therefore we could not approve those figures.” She further said that there was an interface going on between the Commissioners of Finance Forum, Federal Ministry of Finance, Office of the Accountant General, Central Bank of Nigeria and the NNPC, saying, “We hope

The Federation Account Allocation Committee (FAAC) postponed the monthly allocation of revenue to the three tiers of government - federal, state and local governments four times in six months in 2018 due to persistent disagreement with the Nigerian National Petroleum Corporation (NNPC) on under remittance of accrued revenue to the federation account. Yunusa noted that, while NNPC claimed it spent N3.5 billion on product leakage, pipe line vandalism, the Department of Petroleum Resources ( DPR) an agency which supposed to keep such record, claimed ignorance of the amount. He said that if the N60 billion Royalty and N87.6 billion PPT is deducted from the N127 billion remitted by the NNPC, the corporation will still have to balance the federation account N20.6 billion from the Royalty and PPT. The chairman of the forum said that the NNPC has to also remit the money it realized from the sale of crude oil and other petroleum products. According to him, the Finance Commissioners Forum is strongly behind the minister of finance’s position that NNPC must remit all the revenue accrued to it. Mr Yunusa said: “The objective of this briefing is to inform you on our position on the contentious issues between our forum, FAAC and NNPC which is the major revenue driver of the economy. We don’t intent to join issues with the NNPC but we want to make it very clear to NNPC that it is a public company and it is requested that its operations be made public because it is meant to make profit. And as shareholders and stakeholders interested in the running cost of this public investment, the major issue we are having with the NNPC is discrepancies in the figure. You don’t expect us to accept and adopt whatever amount remitted to FAAC by NNPC. The Group General Manager, Group Public Affairs of the NNPC, Mr Ndu Ughamadu, explained that the agreement NNPC had with the governors was that the corporation would make a monthly remittance of N112 billion to FAAC. “This will be subject to sufficient funds from sales of domestic crude allocation for the corresponding month after meeting cash call obligations on Joint Ventures, (JV) deductions of petrol, cost under recovery and pipeline maintenance.“ He said NNPC was able to surpass the terms of agreement with the governors on the monthly remittance for June by N35 billion by taking from the fund meant for settling cash call obligations. The corporation said that it paid $5 billion as it counterpart funding of the JVs to the international oil companies operating in Nigeria. But the chairman of the Forum of Finance Commissioners said: “There are a lot of happenings in the NNPC, we have read in the papers that NNPC said it has remitted what it was supposed to remit to FAAC. NNPC claims it has remitted N147 billion but what the NNPC actually remitted to FAAC is N127 billion. By law NNPC is required to remit all funds accrued from the sales of crude oil. Based on our analyses, this N127 billion is inclusive of royalty and PPT. “How can that be? But the law establishing these agencies (DPR and FIRS), royalty should be given to DPR, while PPT should be given to FIRS in line with the law. NNPC has remitted N127 billion and it claims it was expected to remit only N112 billion, even if they had agreed with the governor’s to remit N112 billion when the oil was sold at $50 per barrel, what stops them from paying more now that the oil price is at $80 per barrel? “Based on what is happening in the economy especially in the oil and gas sector, the oil price is at $80 per barrel and the production is steady which we are producing about 2 million barrel per day we expect that the remittance from the NNPC should add value to what the federal government is doing.”

Delay in justice delivery: Can ADR rescue Nigerian judiciary? Andrew Orolua, Abuja Disputes is inevitable in relationships between human, corporate entities, businesses, groups and many others with their own separate interest. An amicable settlement of such disputes means the relationships between human in a civilised society is encouraged to flourish, to create an enabling environment for growth and development of the society at large. In the other hand, an unresolved dispute often lead to acrimony, retardation and a complete break down of relationships between one and others where an unreconcilable differences is allowed to filter resulting in retrogression, and absence of development and growth. Traditionally, arbitration has been part of our culture and an amicable means at arriving on a satisfactory settlement of disputes. It has been so, until the colonial masters arrived with their method of settlement - litigation in our Courts. Litigation has left us with multiple problems and an unsatisfactory resolution of disputes. The situation has become worse in recent years with unnecessarily delayed of cases, in some instances, leaving disputes that opt to have been resolved within a week to drag up to 25 years in Courts. Besides, unnecessary delays of cases, litigation has also been harmed by its technicalities, exorbitant cost, inhibited access to court and public loses of confidence in our court system. So, when Lagos State Government blazed the trail in 2002 by creating the Lagos Multi Door Court [LMDC], whose basic function is to allow easy access to Justice, reduce delay, generally assist parties to reach agreement that meet their interest ,preserve relationships , save time and money, it was a welcome development. How far has it fair? We must acknowledge Kehinde Aina, a partner in the law firm of Aina , Blankson & Co., the founder of LMDC who established the Negotiation and conflict Management Group (NCMG)in 1996 as a non governmental organizations engaged in ADR advocacy . It is note worthy that after ten years of its existence that is in 2013 the Lagos Muti Door Court resolved successfully 780 cases out of 1, 708 referred to it. The LMDC left 528 cases unresolved within the period, probably due to its teething problems, one of which was the absence of law backing it. That law was eventually enacted in 2007. Same legal practitioners - Aina at the Court of Appeal on Thursday, 28th June, 2018, in Abuja replicated efforts of Lagos State Government on Multi Door Court house with the establishment of Court of Appeal Mediation Centre and the inauguration of the Appellate Mediation at the Abuja, Lagos and Port Harcourt Divisions of the Court. Speaking at the launching , President of the Court of Appeal, Justice Zainab Bulkachuwa said that a cursory glance at our Judicial system reveals that too many cases are filed daily, leading to the inevitable problem of obtaining hearing dates and eventual delay in the process of obtaining Justice. “We are faced with the need to equip ourselves to grapple with the escalating commercial disputes resulting from the growth in business activities and increase in international trade and

investment on the one hand and breakdown of relationships on the other hand.” “It is therefore a welcome development that mediation is becoming a viable option when compared to litigation in settling commercial, civil and family disputes within the shortest possible period and with minimal cost.” She said that unlike litigation, through which huge money is lost in the process of resolving disputes, mediation is less expensive, time saving and flexible. It has played a key role in decongesting our High Courts The case that involved the former Vice President of Nigeria, Late Dr. Alex Ekwueme is a locus classicus on this subject. The former Vice President was a party to a contract involving the sale of land in his capacity as chairman of an investment corporation. A dispute arose with the corporation and Estate Agents and the matter was subsequently litigated. “The matter was before the Court for 17 years until the trial Court referred the matter to the Lagos Multi-Door Court house (LMDC). At the LMDC, the matter was recommended for Mediation, and the matter was successfully resolved in one day between 10:00am – 8:30pm.” A matter involving two Businessmen was referred to the Kano Multi-Door Courthouse (KMDC). The defendant owed the plaintiff a sum of 12.9 Million. The KMDC succeeded in resolving the issue in one sitting and both parties were able to re-build their commercial relationship. Just to mention but a few. Hence, we saw the need to replicate mediation at the appellate level. It is against this backdrop that the idea of appellate mediation in the Court of Appeal was born. “ With today’s event, litigation will cease to be the only method of determining appeals in the Court of Appeal. Parties before the Court can now choose between litigation and mediation.” This signifies an opportunity by parties as well as their Counsel to enjoy the full flavour of Order 16 of the Court of Appeal Rules 2016. By virtue of the provisions of Order 16 Court
of Appeal Rules, 2016 Civil appeals in respect of breach of contract, liquidated money demand, matrimonial causes, child custody, parental actions, inheritance, chieftaincy and personal actions in tort are eligible for reference to the Court of Appeal Mediation Centre at any time before an appeal is set for hearing. The Court of Appeal Mediation Centre would provide a platform that will encourage disputing parties in reaching an expeditious resolution of their disputes in good faith; and in a fair and efficient manner. The Centre will improve access to justice, user confidence in the court system, lighten the Court’s docket and invariably afford the conventional Court ample time for such matters or issues that are best solved through litigation. The Court of Appeal Mediation Centre in Nigeria is the first of its kind in the entire West African region. This is a giant stride in the right direction as Appellate Courts in countries like America, Canada, Australia, India, Singapore, and Mauritius have already achieved phenomenal successes in that regard. Sen Umeh seeks immunity for Saraki Stories: Patrick Okohue The senator representing Anambra Central Senatorial zone, Senator Victor Umeh, has said that Dr Bukola Saraki, is the most distracted Senate president in the history of Nigeria. The senator on the platform of the All Progressive Grand Alliance (APGA), said the barrage of distractions Saraki has faced since assuming office, including being dragged into an armed robbery attack, was occasioned by the lack of immunity for his office and heads of other arms of government as is the practice with the executive arm. Umeh, who spoke to journalists in Awka, said Saraki has faced distraction in the discharge of his duties as a Senate President because of injustice and imbalance of power for heads of the executive arm of government to enjoy immunity to the exclusion of the two other organs of government. According to him, “The National Assembly oversights the executive functions of the Federal Government and when the executive arm of government begins to trample on the rights of the legislature there is bound to be conflict and that is what we have seen so far, where the Presidency has overstepped its powers in its dealing with the National Assembly. “Section 88 confers oversight powers on the legislature in dealing with the Federal Government; it is not the other way round.” Umeh described the 1999 constitution as the author of the problems of the legislature, saying it was made solely to serve the whims and caprices of a military dictator. “We have looked at it and we know that these things could be traced to the constitution we are operating. This present constitution, the 1999 constitution, was a constitution that was written for one individual. “He was gearing towards changing from military president to civilian president and he made a constitution that would make
him the overlord; and the people who wrote the constitution gave so much powers to the executive and weakened the legislative arm of the government. “In the constitution, the president and the vice-president are covered with immunity from prosecution against any form of crime; same as governors and deputy governors. “And the head of the legislature or the presiding officers of the legislature were not covered with any form of immunity. In other words, they can be prosecuted for any criminal allegation and so on. “But we (senators) believe that there should be balance of privileges in the constitution. If the constitution that creates the executive arm, the legislative arm and the judiciary and envisage that they should be independent of each other they ought to enjoy equal protection under the constitution. “The privileges ought to be equal. A situation where you leave the entire National Assembly to the whims and caprices of the president makes it to be weak in the discharge of its functions,” he said. Umeh, who listed the hierarchy of the country said the president was number one, followed by the vice-president, Senate President, Speaker of the House of Representatives, Deputy Senate President, Deputy Speaker, and the Chief Judge of the federation and so on. He however expressed surprise that the constitution gave immunity to the president and vice-president, then jumped all the other officials in the line to governor of a state and his deputy and gave them immunity. He said: “For there to be balance in the discharge of our functions, the Senate President, the deputy Senate President, the Speaker of the House of Representatives, the Deputy Speaker of the House of Representatives, the Chief Justice of Nigeria, the Speaker of various Houses of Assemblies and their deputies should have immunity.”

The open letter signed by the Director General, Atiku Presidential Campaign Organisation and former governor of Ogun State, Otunba Gbenga Daniel, while congratulating Jack Ma for his entrepreneurial successes, saying, “I have great admiration for what you have achieved, especially coming from a humble background,” added that “I write this open letter because my attention has been drawn to an egregious breach of Nigeria’s electoral integrity and thus our national security, by the sale of Nigerian Permanent Voter Cards, on alibaba.com. “We are very concerned about this security breach because it threatens Nigeria’s desire to build strong institutions, like the Independent National Electoral Commission. A situation like this could lead to massive vote buying and thus thwart our efforts and instead create
strong men where we want to enable strength in institutions. “Permanent Voter Cards were used in the 2015 Nigerian elections and the alibaba platform was also in existence then, yet we did not have this breach. That precedence leads me to believe that if alibaba.com refuses to lend its platform to those unscrupulous elements who want to thwart Nigeria’s democracy, we would greatly increase the chances of a free and fair Nigerian election in 2019. “Therefore, I appeal to you to use your good offices to permanently remove these items from alibaba.com “Furthermore, I do kindly ask you to consider sharing information with Nigeria’s security apparatus that may help expose any impropriety. “The world is currently witnessing the unfolding of allegations, counter allegations and investigations into election meddling in the 2016 American Presidential elections. These occurrences have ensnared several technology, IT and social media platforms including Facebook, Cambridge Analytica and Twitter just to mention a few. “Their involvement has had far reaching political and economic impact which has affected their market capitalisation and consumer confidence. It is also in the light of preventing such a scenario involving Nigeria and alibaba.com that I make these appeals. I trust that I can count on your cooperation,” he said.

Ekiti 2018: Fayemi apologises to workers, citizens for any past wrongs while in office The All Progressives Congress (APC), governorship candidate in Ekiti State, Dr. Kayode Fayemi has assured workers in the state that he is not contesting the election to revenge against them. According to him, his unfinished business of taking away poverty from the state is the major reason for his coming back. Fayemi who said this on Monday while speaking in an interactive session with workers at the Labour House in Ado Ekiti, used the session to further apologise to workers and citizens in the state over policies his government implemented when he was governor. The former governor noted that he had no intention to sack workers in the state if elected as governors, adding that those peddling the rumour are only distracting the workers from the issue of governance. His words, “I want to tell you workers and the people of the state that I am not on a revenge because nobody has offended me. I never have in my mind that anybody offended me. “Once again, I want to apologise to workers and indeed the people of Ekiti for some of our policies we implemented negatively. The need assessment we did to the Teachers back was not for sack or demotion, but to identify gaps in the education sector and improve upon it, that was our intention. At times, you might have a good idea but implemented at a wrong time. Perhaps, on our part, it was not properly communicated. I have learnt my lessons now.” While disclosing that upon assumption as governor he would ensure the payment of salaries arrears owed to workers within six months, said there would be adequate and genuine communication between the government and the labour unions. Promising that his administration would place more emphasis and priority on the workers welfare, Fayemi accused the present government in the state of abandoning some of the ongoing projects initiated when he was governor. Speaking earlier, the Chairman of the Nigeria Labour Congress in Ekiti, Comrade Raymond Ade Adesanmi while presenting the position paper of the union to Dr Fayemi reiterated that the workers in the state would mobilise against any government that failed to pay the backlog of salaries within three months of inception. He lamented the current condition of workers in the state, adding that they would only support candidate that takes their welfare as priority. “Your excellency, I want to tell you that workers will not take your promise of six months to clear the arrears. We are giving you, if you eventually wins the election three months to pay all the outstanding, otherwise we will mobilise workers against your government. Let government go and borrow to pay outstanding salaries,” Adesanmi said.

Enugu SWAN frowns at non release of white paper on Rangers investigative panel Moses Oyediran, Abuja Enugu State chapter of Sports Writers Association of Nigeria (SWAN), has frowned at the non release of white paper on the report of the administrative panel of inquiry that investigated the poor performance of Rangers Int’l FC of Enugu in 2017. Recall that, dissatisfied with the abysmal performance of the club in the 2016/2017 edition of the Nigeria professional football league NPFL, Governor Ifeanyi Ugwuanyi, inaugurated a 10 man panel of inquiry headed by professor Gab Agu, in September 2017, with a charge to identify all the factors responsible for the problems confronting club side. On completion of the assignment, the panel submitted its report to the state government, but till date, no white paper has been made public
to that effect, a development sports writers in the state said was counter productive. In a communique issued at the end of it’s monthly Congress held at the association’s secretariat at the Nnamdi Azikiwe Stadium Enugu, the body hailed governor Ugwuanyi for the bold step, but insisted that: “even though it looks belated, there is need for government to make the white paper public for record purposes, especially as the assignment was carried out with tax payers money”. The communique signed by the state chairman, Comrade Norbert Okolie, and secretary, Ignatius Okpara, posited that: “while we commend the state government for taking that proactive measure aimed at finding solution to Rangers problems, we believe it will also be nice if the recommendations of the panel is put to work”. It equally urged the state ministry of youth and sports to begin to take
