to the government of the Federation (SGF), Mr. Boss Mustapha, who has been hosting the series of meetings in his office. Pepple said the committee will have to submit both the N30,000 minimum wage demanded by the unions and the N24,000 proposed by the government to President Muhammadu Buhari for onward submission to the National Assembly and urged the unions to shelve their planned strike. She said. “We have concluded and we had a little challenge with what we call chapter five of our record and that is why we resort to negotiation again and the figures we concluded with and the committee has passed it to them. The Federal Government suggested N24, 000, and Labour and organised private sector gave the figure of N30, 000. There is no stalemate, we have finished and signed it. What we are insisting is that the strike should be called off. “N24, 000 and N30, 000 were the figures we used for the negotiation, remember that Labour gave the figure of N52, 500, but when we put that figure together, plus the figures we got from the states when we wrote to them, about 21 of them responded and some of them gave us figures which we put in the basket.” On his part, Minister of Labour and Employment, Senator Chris Ngige, said the two figures will be forwarded to President Muhammadu Buhari. He said, “We are making progress. The governors figure should be the Federal Government’s figure, we are just trying to carry them along, that is why we made the discussion tripartite plus, yes the figures are standing, you know that there are other processes, it has to go through the council of state, through an executive bill that will be transmitted to National Assembly. The Federal Government figure of N24, 000 is noted, because it is based on affordability and the ability to pay. “The Labour is satisfied, we are doing the needful. The only aspect of it now that we need to do, is to fix an appointment of handing over the report to Mr. President. Yes, we are reconvening tonight (last night) because that appointment has to be gotten, the President has gone home and have taken the feelers to the place, and as soon as we get the appointment, we will reconvene and know what to do. The state government has no choice now, because they have attached themselves to us.” The leaders of the Nigeria

Labour Congress (NLC), Trade Union Congress (TUC) and the yet to be registered United Labour Congress (ULC) have yet to take a decision to shelve the strike. None of the officials were willing to talk to newsmen when approached for comment. Meanwhile, Senate President, Dr. Bukola Saraki, has appealed to both the Federal Government and the leadership of the Nigeria Labour Congress (NLC)/ Trade Union Congress (TUC) to work together in order to avert the proposed workers’ strike in the interest of Nigeria. Saraki, in a statement by his Special Adviser (Media and Publicity), Yusuph Olaniyonu, urged the two sides to demonstrate sensitivity and concern for the plight of ordinary Nigerians who are already battling with the harsh economic conditions in the country. He expressed appreciation for the patience displayed by the labour leaders as he noted that the issue of the new minimum wage could have been resolved long before now. He said, “My Appeal is for the two sides to immediately move fast, shift from their extreme positions and create a new middle ground in the negotiations for the new minimum wage. The shift in positions can be done even before the period of the commencement of the proposed strike action so that we do not further create tension within the economy. “At this point, the interest of the people should be paramount in our minds. Any labour strike will cause inconvenience and discomfort to our people. While the government and labour are representing the interest of the people, it is important to also ensure we avoid any action that will not show sensitivity and sensibility to the plight of the people”. However, Justice Kado Sanusi of the National Industrial Court said in Abuja on Monday that it was not necessary to make a fresh order on the planned nationwide strike by the organised labour because its order of last Friday stopping the strike is subsisting. The judge alluded to the order while ruling on a fresh suit filed by a civil society group, Kingdom International in Abuja on Tuesday. The Daily Times recalls that the NIC had on Friday restrained the Nigerian Labour Congress (NLC), the Trade Union Congress (TLC), Federal Government, Attorney General of Federation and Incorporated Trustees of the Nigerian Governors Forum from taking any further step on

the planned industrial action pending the determination of substantive matter filed by the Federal Government. On Monday, the civil society group, Kingdom International’s lawyer, Mr. Okere Nnamdi, had informed the court that he had filed his client’s ex parte motion alongside other processes on November 1. He, therefore, urged the court to grant the prayers, including the one seeking an order of substituted service of the court processes on the governors whom he had joined as the 10th to the 45th defendants in the suit. But the judge immediately asked the lawyer if it would still be necessary to proceed to hear the application, in view of the Friday’s order made by the same court. Okere conceded that he was aware of the order made by the judge on Friday. The Federal Government had filed its suit following the threat by the organised labour, comprising the National Labour Congress, the Trade Union Congress, and the United Labour Congress, to embark on strike if its demand for increase in the national minimum wage from N18, 000 to N 30, 000 was not met. Contrary to the labour’s demand, the Federal Government said it could only pay N24, 000 as minimum wage and the state governors under the aegis of the Nigerian Governors ’ Forum, had stuck to N22, 500. The lingering dispute between government and the labour prompted the Federal Government to seek and obtain the court order stopping the strike last Friday. The fresh ex parte application by the group is seeking to stop labour from embarking on the strike and to also compel government to commence the process of paying the N30, 000 minimum wage was filed by a civil society group, Kingdom International. In a related development, the Academic Staff Union of Universities (ASUU) has stated that the nationwide industrial action which the union started on Monday will continue indefinitely until government fulfills its demands. The National President of the Academic Staff Union of Universities (ASUU), Prof. Biodun Ogunyemi, in a telephone interview on Monday, stated that it has given the government enough time to fulfill the Union’s demands, adding its demand was all about funding and making the nation’s tertiary institutions good for learning. “Our only demand is funding of the tertiary

Ekiti PDP stakeholders insist on Olujimi as leader ...Says dissolution of SWC is inevitable Gbenga Sodeinde, Ado Ekiti Ekiti State Peoples Democratic Party (PDP) Stakeholders Forum has insisted that the Senate Minority Leader, Mrs Biodun Olujimi remains the leader of the party in the state. It also said that there was no going back in its call for the dissolution of the State Working Committee (SWC) of the party. The forum while reacting to position of the Ekiti PDP House of Representatives Caucus on its Saturday resolution predicated its decision to install Olujimi as the new leader on her political antecedents and present status. The House of Representatives had on Sunday dissociated themselves from the party stakeholders’ meeting held in Ado Ekiti on Saturday, pledging their loyalty to the leadership of the immediate past Governor Ayodele Fayose The party leaders in state had at the meeting adopted Olujimi as the new leader of the party in the state and Southwest. They also called for the dissolution of the State Executive Committee of the party urging the PDP National Working Committee (NWC) to constitute a caretaker committee to run the affairs of the party in the state. The stakeholders in a statement issued on Monday 5, November, 2018, by the forum’s Public Relations Officer, Mr Gbenga Akinola and made available to newsmen in Ado Ekiti on Monday said the PDP constitution does not recognize any Caucus within the party including the so called Reps Caucus. The statement read: “On behalf of members, leaders and stakeholders of our great party in Ekiti State, let it be on record that Olujimi is a onetime SA Health, Reps member 2005, deputy governor 2006, Commissioner for

Works, 2007-2010, Federal Board Chairman, Senate member 2015 to date, PDP BoT member, National Convention Committee member, making her the most informed, visible political office holder in the whole of Ekiti state. “On the lingering issue in our party in Ekiti, we want to reinstate that Senator Olujimi remains the authentic and incontrovertible political leaders of our party in the state.” On the PDP federal lawmaker positions, he said” Reps Caucus was not known to the party’s constitution and that they were imposed on the party in 2015 in spite of the fact that they were all Labour Party returning that were not confirmed as PDP members for the two years membership term of the party. “They are far distanced from the political happenings at their home state. The stakeholders are expecting that they come around to work for their own victory and the party in the presidential election in 2019 and address the illegality and offences of the SEC as contained in our party constitution Section 58 subsection 1(d) page 99. “We adopt the position of our former governor after the presidential election in 2015 that the then party National Chairman, Makarfi should be removed from office saying “failed team should go home”. The party leaders told Lere Olayinka to stop disparaging the founding fathers, leaders and committed members of party, saying on what capacity was he speaking? We expect his handlers to put him on leash. On the issue of the council chairmen in the state, the stakeholders said they were part of the problems from the onset as they were handpicked by the former governor to occupy the position. The party leader appreciated the PDP National Vice chairman, Southwest, Chief Eddy Olafeso for his intervention in the crisis.

Legacy of monumental development in Kogi

The promise in the first series of my declaration to make a personal sacrifice for the success of our struggle for freedom remains sacrosanct. On your part, my brothers and sisters, you must make courage your watch word in our journey to the ultimate destination, if we must overcome those who torment you and your children. Be reminded that courage, according to the late distinguished American Senator of all times, McCain is never the absence of fear but the capacity for action despite fear. We do not subscribe to violence as a means of expressing our disgust against the rotten system foisted on us, because, violence, is alien to our culture in kogi west. We have instead, opted for a civilized approach of systematic re-awakening of the political consciousness of our people, to begin to honour and protect the Sanctity of our sovereign right to elect leaders of our choice. Even the much denigrated “Oyinbo” imperialism” was magnanimous and merciful to have allowed the “conquered” people the right to elect their leaders without coercion or political manipulation. If our fathers could stand to defend the inalienable right of all Nigerians, under the dreaded colonialists, then, why can’t you and I surpass their achievements with all the ideological and political sophistication at our disposal in the 21st Century? This is food for thought. I therefore call on all patriots, and all right

thinking citizens of Kogi West extraction, to think before you leap in the coming 2019 general elections. History has made us to be pace-setter by virtue of our educational achievements. It is incumbent on us to live up to this rating so that future generations can be proud of our legacy. We should not create a bad impression that with “bread and butter” the great Western Kogites can be taken for a political ride or purchased by future despots. A Yoruba adage says “Oruko rere san ju wura ati fadaka lo”. My dear Kogites in the West, I will like to assure you that my second coming, if given your mandate, is to serve as the harbinger of good tidings to the people. I pledge to serve as a catalyst for the rapid socio-economic transformation of my constituency and by extension, Kogi State. I am determined to be remembered for good, by leaving a legacy of monumental development in every nook and cranny of the West. I will at all times collaborate with my colleagues in the National Assembly irrespectively of party affiliation, to bring dividends of democracy to the door step of the common man. Also, for effective service delivery, I will establish two functional complementary senatorial offices, one in Lokoja and another in Kabba for easy accessibility. The two offices will serve as information collating centers where diverse interests of the various communities will be articulated and packaged by competent hands and made available to me for necessary

prompt action. I want to assure you once again my good people, that as a patriot and a completely detribalized Nigeria, no part of my constituency will be marginalized in the distribution of goodies. This is because I feel at home with many communities in Kogi State and I speak some of their languages fluently and this made me a home grown Senator of the Federal Republic of Nigeria. To enable me address the palpable infrastructural state of Kogi West, I am determined to “hit the ground” as soon as I am sworn in by the grace of God and your good will, by setting the necessary machinery in motion to accomplish the task. The functions will be amongst to consult with the Local people so as to determine their priority areas in infrastructural development. The input of the local people will certainly guide me in the preparation of bills and motions to be tabled before the committee of the whole Senate. My good people of the West, I want to assure you once again, that, I unlike others, and as a Kogite proper, will never move my resources and wealth otherwise called capital flight, outside the state at the expense of those who elected me, and the economic development of the state. To do that amounts to nothing, but a great disservice to the people, the state, and “the finger that feeds the individual” and above all an abuse of political privilege. Fellow Kogites, this a reminder of our recent past experience when someone who rode

on our back to power transferred all his acquired property/resources for eight years, to develop a neighbouring state without showing any sense of remorse and the same individual is being conscripted for the same ignoble mission against the wishes of the people. My clear brothers and sisters, our experimental democracy is being put on trial by usurpers. The year 2019 is the magical year, all Kogites are expected to rise up and say NO to despotism. It is only you and me that can save this generation from impeding political intimidation. All lovers of democratic decency and all lovers of truth and progress, are hereby called upon to imbibe the philosophy of “No Retreat no Surrender” for the emancipation of our people, come, 2019. This issue transcends Party divide. It is a Kogi project. Everyone must be concerned and be involved. Finally, my dear brothers and sisters, now, is the time to take our destiny in our hands as 2019 presents the golden opportunity for selfdetermination. I do not claim to be a miracle worker but as a pragmatist with progressive political inclination, my antecedent in the National Assembly over the years, attests to the fact that entirely of my political career revolves around the welfare of the people. In this regards, I wish to solicit your support and mandate in the coming 2019 Senatorial Election in Kogi West to enable me consolidate on my modest achievements.

Minimum wage, maximum conundrum

There can never be any question about the justification for a wage increase in Nigeria. While wages have remained constant for some time, the value of the naira has depreciated with concomitant rises in prices of goods and services. It is therefore perfectly understandable that workers should agitate for wage increase. What is debatable is the timing of the demand as well as the possibility that a wage increase, rather than improve on the fortunes of workers, could indeed worsen their situation. Besides, wage movements are not static; any wage increase will have far-reaching long term implications as it impacts on other areas such as taxes and pensions. From their initial demand of a minimum monthly salary of N65, 000, (as against the present minimum wage of N18, 000), the Nigeria Labour Congress (NLC) and the United Labour Congress (ULC), have descended to N30, 000 which is the new bone of contention. The Federal Government has reportedly offered N24, 500 even as the Special Adviser to the President on Media and Publicity, Mr. Femi Adesina has pointedly warned that the wage increase would be difficult to implement. It is also no longer news that state governors have offered N22, 400 which the Federal Government and organised labour reportedly turned down. That leaves us with an impasse, a conundrum that is snowballing towards another strike, if labour should make good its threat to paralyze the nation starting November 6. The entire wage saga has been one hard knot for Labour and Employment Minister, Senator Dr. Chris Ngige, to crack. Last Friday, speaking after briefing President Muhammadu Buhari and Vice President Yemi Osinbajo, Ngige assured that the Economic Management Team (EMT) would meet to reconsider the matter on Monday, October 29, 2019 with some state governors and the chairman of the Nigerian Governors’ Forum, NGF. Flurry of meetings have taken place in Abuja and Lagos aimed at resolving the impasse. Meanwhile, labour has relocated to Lagos to perfect their strategies for the strike. For its part, Government has been engaging all parties-the NGF, the Organised Private Sector and labour. While labour insists that the Tripartite National Minimum Wage Committee set up by the FG arrived at a consensus figure of N30, 000 via a motion moved and seconded at the last meeting, the Hon. Minister of labour insists that the figure was not reached by mutual agreement and consensus as the FG delegation to the meeting had insisted on the figure of N24, 000 only. As things stand, these groups now owe the nation the patriotic duty to arrive at a consensus that does not throw the national economy completely out of joint. To start with, everybody knows that many state governments are reeling under heavy wage burdens with many being unable to pay the present N18, 000. At the last

count, only about NINE states are able to pay the minimum wage of N18, 000 regularly. The number of defaulting states would have been far higher but for the bailout funds from the Federal Government to the states. One wonders what gives labour the confidence that the defaulting state governments would conjure some magic to begin to live up to their responsibilities. If they cannot pay N18, 000, it is hard to understand how labour expects them to pay N30, 000. This demand looks like a clear invitation to chaos. Of course, the logical consequence will be the return to the retrenchment of workers, embargoes on employment and promotions especially in the public services of the states and the Federal Government. In fact the organised private sector will be off without excuse. If the ramifications of a wage increase were to be limited to the public sector, perhaps it would have been less invidious. Unfortunately, any increase triggers agitation for more wages outside the civil service. Landlords and other service providers have not found a way of distinguishing between public servants and other tenants such as private sector workers or self-employed people who are managing to eke a living from their environment. The implication is that labour, by its uncompromising posture, may throw the nation into a bigger conundrum that it possibly could anticipate. It is also common knowledge that, in the public service, any minimum wage increase will always have a concomitant wage adjustment from that of the lowest paid group with attendant consequential financial implications. It is instructive that the Minister of Budget and National Planning, Senator Udoma Udo Udoma has already indicated that, in the public service of the Federation, this will run into hundreds of billions of naira. Labour owes the nation the patriotic duty to weigh the frightening implications of this unfolding burgeoning impasse for inflation, redundancy declarations and unemployment indices. Besides, with the Boko Haram insurgency and other flashpoints, it is doubtful if any government would fold its arms and watch labour or any group for that matter, paralyze strategic operations of the state. Much more importantly, we do not need a soothsayer to predict that should labour make good its threat to down tools, the minimum wage quest could precipitate the kind of maximum conundrum that will make for huge losses in the fragile economy and unnecessary deaths following closure of public hospitals. Let’s get it straight. Labour will be failing in its duty if it does not engage employers in a manner that enhances the welfare of its members. What is debatable is whether a wage increase is the only avenue for achieving that noble objective. By the way, a worker’s salary is only useful to the extent that it can procure needed goods and services with provision for the rainy day. I will admit that today’s wage cannot satisfy immediate needs

let alone provide for savings. But has labour explored or been exploring other avenues that could enhance workers’ welfare? To some extent, yes; that is, if one factors in the various effort at providing houses for workers. Yet, again, one is tempted to ask, how many workers are able to benefit from these housing programs? The disquieting saga of toying with workers wages has gone on for far too long that there is a sense in which labour could become an accessory to the unfortunate plight of workers through acquiescence in malfeasance, selective amnesia or outright failure of strategy. Over time, what obtains is that labour would hold the Federal Government by the jugular over workers salaries. You begin to wonder why labour cannot shut down those state governments that are notorious for denying workers their emoluments, to the extent of callously compelling them to indulge in the illegality of signing away portions of their salaries and pensions. The most recent case of the misuse of the bailout fund, by some states, reeks of the most callous display of inhumanity by those in whose care the workers have been entrusted. One would expect labour not simply to paralyze such state governments but to ensure that nobody associated with them ever gets elected or reelected. It should be emphasized that the Federal Government is not the culprit here. Labour should devise strategies to make their state councils not only alive but also accountable to workers. If governments are held accountable as advocated above, the need for higher wages could become redundant because governments that are responsive to the needs of their people will definitely lay the infrastructure for development. For instance, if state governments provide good roads, hospitals and schools and assist small holder transport companies with soft loans, the transportation nightmare that erodes the income of workers will abate. If contiguous state governments develop light rail networks, such as the one in Abuja, transportation cost will be drastically reduced. If state governments provide free education (with free books as was done by the administration of Alhaji Lateef Jakande in Lagos State between 1979 and 1983), the financial burden of educating their children and wards will be so drastically mitigated that agitation for wages could decline. But that is not happening. Instead, for many a state government, the difference between public funds and their private pockets is only a function of the type of dress they are wearing. Many are known to have raided their states in the manner of the legendary English pirates of old, on the high seas. As we ruminate over this issue, we cannot but return to the issue of the kind of federation we choose to run. Nigeria can no longer continue to deny that the era when the government could say that its problem was how to spend money, is gone forever. Concomitantly, the federal arrangement that supported that frivolous

understanding of our economic power can no longer stand. By extension, it makes no sense to have a uniform minimum wage in all the states of the federation. If different states are differently endowed resource-wise, no matter how resource is defined, then the wage arrangement must accommodate these differences and allow for each state to pay according to its ability. It is therefore left to the worker to choose the state in which to work. Anything outside this is a futile effort in self-deception and can only deepen the wage conundrum bedeviling the country. For us to get it right, we should also shun the temptation to think that the present agitation is about Ngige or President Muhammadu Buhari for that matter lest we have the case of the angry fellow who invoked rain and thunderstorm forgetting that his mother was away to the farm. Thus, in the instant case, there is the compelling need to adopt a bipartisan approach at consensus building, in the full realisation that whatever decision is reached will be implemented by administrations that cut across party lines. By the same token, one cannot over-emphasize the need for labour to tone down on its rhetoric and threats. During their first demonstration on Tuesday, I saw some placards saying “Remove Ngige for Minimum Wage”. My immediate impression was that some labour leaders have misinformed their members because in the history of labour and productivity, Nigeria has not had a more vibrant labour minister than Ngige who, by all means, is very much qualified for the job and who has brought Nigeria back to the Governing Board of the International Labour Organisation, ILO, after 10 years exit. Politics aside, the steps being taken by the Federal Government in the areas of infrastructure and social inclusion carry the prospect of enhancing the quality of life of Nigerians. I get amused when people say that the Buhari Administration is commissioning projects started by other administrations. One such project is the Abuja-Kaduna rail-line and the other rail projects all over the country. That will sound implausible to anybody from my town, Nsu in the Ehime Mbano Local Government of Imo State. A hospital started by the government of the defunct East Central State is lying there uncompleted. It is like Ajaokuta Steel Complex, the Second Niger Bridge before now and similar uncompleted or abandoned projects all over the country. If our recommendation to Buhari is that he should abandon the projects he inherited, then we are teaching our children the wrong things. Back to the wage palaver; between government and labour, it is important to realize that Nigeria has technically been at war for about seven years; that the country is sitting on a fragile peace; that some moments in the history of a country call for sober reflection and sacrifice. In my view, this is one such moment. Both labour and the Government owe the people the duty of discretion: let them exercise it.

Election is defined as a formal and organised way of choosing people for a political office or other positions. In Nigeria, elective democracy was introduced in May 1919, when the Township Ordinance gave right to vote for three members of Lagos Town Council to some men. The first election to the council was held on 29 March 1920. The first national election to be held in Nigeria was in 1959, and in 1965. Elections were held in the southern region of Nigeria. After a long period of military rule, the 1983 general election took place. This was however cut short by the December 1983 coup that brought Muhammadu Buhari as Head of State. In 1993, the country witnessed another general election that was adjudged as the most free, fair and credible elections by both local and international observers. The said election was presumably won by Chief MKO Abiola, but sadly the results were annulled by the then Military President General Ibrahim Babangida. From 1999 till date, the country has enjoyed uninterrupted democratic dispensation witnessing four successive elections and the fifth coming up in February 2019. Election makes a fundamental contribution to democratic governance as it enables voters and citizens to choose leaders and representatives and to hold them responsible and accountable for their actions in office as they are only elected to serve the people for a defined period of time as allowed by the country’s constitution. In a developed democracy, because those in elective positions are conscious of the fact that they are required to submit themselves for periodic elections, they tend to put in their best to serve the people knowing full well that their performance will be the determining factor for their re-election. This is why we have high rate of fulfilling election campaign promises; it also go beyond individual candidates vying for various elective positions to the general political ideology. Moreover, where the electoral processes is competitive and forces parties and candidates to expose their records and future performances to proper scrutiny, election serves as a platform for the discussions and debates on public issues and policies. It also serves as facilitator of public expressions. Election thus provides political education for citizens and ensures the responsiveness of democratic governments to the yearnings of the people. It also serves as acts to legitimise the acts of those who wields power. Elections seem to facilitate social and political integrations and it is also a tool to actualize a self-actualising purpose by confirming the worth and dignity of individual citizens as human beings. Whatever other needs, participations in an elections serves to reinforce the worth and self esteem of individual voters. As 2019 general elections draw nearer, voting gives the citizenry an opportunity to have a say in issues pertaining to their lives and through expressing partisanship, to satisfy their needs to have a sense of belonging. Seeing the importance of elections and the powers of the electorate, it is therefore important for the electorate to know those characteristics an individual possess before casting their votes. In that case, the electorate can be glad with the choice of the candidate he or she

made to represent them at all level since the aim is to bring development to their communities. Whether held under authoritarian or democratic regimes, election has ritualistic aspects. Campaigns that precede elections are dramatic events occasioned by rallies, posters, banners, and television coverage, all of which draw attention to the importance of participations on the events. Candidates, groups and political parties and others representing diverse opinions and objectives combine to invoke the spirit of nationalism. Whatever the peculiar national or regional or local variations, elections are events that arouse emotions, and channelling these emotions and passions into collective symbols help in breaking the monotony of national life and focus attentions on the common fate. Most elections do not determine public policies but instead confer on a small group of officials the authority to determine public policies through the instrumentality of laws and other devices on behalf of the whole. Political parties are central to the elections of public officers, the selections and nominations of candidates, a central and vital first stage in the electoral processes, generally lies in the hands of political parties:, an election only serves as the final process in the recruitments of public officials. The party systems can thus be regarded as an extension of the electoral processes. In Nigeria today, we have repeated cases of vote buying which has made the electorate to deprive themselves of the right to question the performance of their elected representatives. This is so because the officials believe they bought the conscious of the people they are representing hence making them act as lords when in the real sense reverse should have been the case. For instance, an average Briton see himself as very busy, that is why he will tell you boldly that the Prime Minister is there to serve and they can hold her accountable for any slightest wrong committed and ultimately remove her from office if need be. This is why you have all elected officers performing based on their campaign promises. It is no longer news that in developed democracies politicians are removed from office for failure to account for just £1,000 or he can be made to explain why the state funds was used to pay for his utility bills. What do we have in Africa? Leaders feeding fat on our commonwealth and at the same time depriving us from questioning their actions because they believe with the state resources in their disposal they can have their way during any election period. This could have been avoided if credible individuals were voted in from the onset of the current democratic dispensation. However, it is not late to remedy the situation if we can collectively look at individual track records and vote wisely and not along party lines, but based on what we think they can offer and reject whatever the obviously morally bankrupt politicians are offering which will continue to make our collective development a mirage . Voting for the right candidates give us the latitude to call them to order whenever we feel they are not representing us well. This will no doubt lead to appreciable development of our country and we will all be glad to have lived a good legacy for the future generations.

OUR POSITION Missing General and matters arising

nother chapter in Nigeria’s chequered history took place on Saturday when the remains of Major - General Idris Alkali (N/8353) was laid to rest at Gudu Cemetery in Abuja, the Federal Capital Territory. The body of missing General Alkali was recovered on Wednesday, October 31, 2018, in a shallow grave found in “No man’s land” Guchwet in Shen, Lafande Community in Jos South Local Government Area of Plateau State after his wife raised the alarm of her missing husband on September 5, 2018. Mrs. Salamatu Alkali had reported to the military authorities on September 5, 2018 that her husband left his home in Abuja to Bauchi on September 3, 2018, and that when she last spoke to him on his GSM number 09056890335, he claimed to have passed Jos and was on his way to Bauchi. Report of the missing Major General Alkali, who retired from service on August 7, 2018, received immediate attention of the Chief of the Army Staff (COAS), Lieutenant General Tukur Buratai, during the combined COAS 2nd, 3rd quarterly Conference held in Abuja. He immediately set up a Search and Rescue Task Force to locate General Alkali dead or alive. The Search and Rescue Task Force Team comprising officers and soldiers from 3 Division of the Nigerian Army quick response team, Operation Safe Haven, Nigeria Police, Vehicle Inspection Office, Fire Service and local divers went on its task combing everywhere in Jos and environs but to no avail until it received credible intelligence to search an abandoned mining pond at Dura Due District. That intelligence collaborated the findings of an appropriate technical intelligence tool that aligned with information by Mrs. Alkali that she spoke with her husband on his GSM number 09056890335. We commend the Nigerian Army that despite the “cultural” obstacles and several insinuations that confronted the assignment to locate General Alkali, it finally achieved the objective of Search and Rescue Operation and did more by unearthing several revelations. It is now clear even to doubting Thomases that the crises in Plateau need to be addressed from its root causes instead of surface dressing we employed any times ugly incidents such as this that takes innocent life occurred. From the recoveries made at the abandoned mining pond at Dura Du where General Alkali car was eventually found, not less than nine other vehicles and several tricycles were pulled out. This is a very sad development in a country where every citizen and foreigners alike enjoyed their right to freedom of movement. We, therefore, join millions of Nigerians who have on several occasions called on the Federal Government to look into the security situation in the country and squarely address them. Just like those consoling the death of Alkali at grave side stated on Saturday, “every Nigerian has the right to live or pass through any part of the country without being harassed or

intimidated by anybody or group of people.” This is a fundamental human and constitutional right of everybody, irrespective of tribe or religious affiliations. The findings by the Nigerian Army revealed that on September 2, 2018 at about 8pm, unknown gunmen attacked a shopping complex located at Lafande community in Dura Du that resulted in the killing of 11 people. That General Alkali travelled on September 2, 2018 on the day irate youths barricaded some roads in protest is instructive. But there is need, more than ever before, for the Army to strictly enforce its rules and regulations on the use of it combat uniform, in view of lingering crises and the attendant suspicious that killings are being carried out by gunmen in military uniform. For instance, the public expressed doubt and suspicious when a pair of boots, combat military uniform were recovered in mside the retired general car after he had retired from service. All military uniform except ceremonial address ought to be retrieved from retired officers and soldiers. Now that the puzzle about the whereabouts of the missing General has been solved by the Nigerian Army, we sincerely commend the Nigerian Army for its investigative prowess and urge other security agencies, particularly the Nigeria Police whose primary role is investigation of crimes to emulate the worthy example of Nigerian Army. The Nigeria Police must wake up and live up to expectations. Enough of unresolved killings in Nigeria.

N687.2m Fraud: How I kept $2m in my house for Short News Ex-NIMASA DG, Akpobolokemi - Witness Striking Oyo college lecturers call Doosuur Iwambe, Abuja A prosecution witness, Ekene Charles, in the trial of Patrick Akpobolokemi, a former Director-General, Nigerian Maritime Administration and Safety Agency, NIMASA, who is being prosecuted for an alleged N687, 294, 680.00 fraud, on Monday, November 5, 2018, told Justice Raliatu Adebiyi of the Lagos State High Court sitting in Ikeja, Lagos how he once kept about $2m in his house for Akpobolokemi. Akpobolokemi was re-arraigned on Monday alongside Ezekiel Bala Agaba, a former Executive Director, Maritime Safety and Shipping Development, and Vincent Udoye, a former Director, Maritime Safety and Seafarers Standard, on an amended 12-count charge bordering on stealing to the tune of N687,294,680.00. The money, belonging to NIMASA, had been released for the implementation of Voluntary International Maritime Organisation Member State Audit Scheme

(VIMSAS).” One of the counts reads in part: “That you, Patrick Ziadeke Akpobolokemi, Captain Ezekiel Bala Agaba and Vincent Udoye , between October 30, 2014 and May 6, 2015 in Lagos with a dishonest intent converted to your own use the sum of N346, 844, 680.00 only property of the Nigerian Maritime Administration and Safety Agency (NIMASA) released to you for the implementation of Voluntary International Maritime Organisation Member State Audit Scheme (VIMSAS).” The defendants, however, pleaded not guilty to the charges preferred against them. In view of their pleas, the prosecuting lawyer, Rotimi Oyedepo, urged the court to allow him to present his witness, Charles, a Senior Administrative Offcer with NIMASA, in the matter. Giving his testimony, Charles, who worked as Personal Assistant to Agaba, revealed to the court that Akpobolokemi,

in 2014, set up a Committee on VIMSAS and made Agaba the Chairman of the Committee. He said Committee members included staff from various departments in NIMASA, stakeholders and consultants from outside the Agency. “After the Committee was set up, an account was opened for VIMSAS with Zenith Bank and I was asked by the Chairman of the Committee to draw up budgets. Also, various sub-committees came up with their budgets,” he said. The witness further told the court that two budgets were approved for the Committee for VIMSAS and funds were released to the Committee’s account after the budgets had been forwarded to the National Security Adviser for approval. According to him, “The first budget put together by me as directed by the Committee Chairman requesting funds for VIMSAS was N318million , which was supposed to be the only budget for the VIMSAS. But another budget was prepared and approved for the sum of N498.2million.

The striking lecturers and non-academic staff of Emmanuel Alayande College of Education, Oyo, Oyo State, have suspended their more than four months industrial action with immediate effect. Besides, the institution’s branch of Colleges of Education Academic Staff Union (COEASU) has tendered “unreserved apology” to the management of the college for what it called the deplorable conduct of some of its members on November 1. The institution’s academic and non-academic staff had been on strike since June 28, 2018, in protest against delayed payment of salary arrears, which the governing council is said to have now decided to clear in instalments. A communiqué indicated that the truce was brokered at a meeting between representatives of the state government, which owns the institution, and all the stakeholders in the college, held at the Ministry of Education, Secretariat, Ibadan, on Sunday. In the spirit of give and take, the management of the institution also agreed not to press criminal charges against members of the academic staff union at the centre of the “deplorable incident,” details of which the communiqué was silent upon.

Independent National Electoral Commission (INEC) has charged Civil Society Organizations (CSO’s) to be more proactive in educating Nigerians on the dynamics of electoral process. INEC Chairman, Prof. Mahmood Yakubu stated this during the Commission’s Civil Society Organisations (CSO’s) Dialogue held in Enugu on Monday. Yakubu noted that there is need for CSO’s to increase their knowledge on rules and regulations guiding the conduct of elections said “I urge you to acquaint yourself with the law and the changes that have taken place since the last election. The Nigerian people look up to civil society groups and organization for untainted analysis and clear understanding of issues in the electoral process. “Let me also emphasize that as a society develops and as more innovations are brought to bear on the electoral process, civil society groups and organizations must strive to increase their knowledge and understanding of the nuances and dynamics of the electoral process. Without a good knowledge of the constitutional and electoral framework regulating

and guiding the conduct of elections, it will be difficult for civil society groups and organizations to inform properly, advocate rationally and Impart knowledge and sensitize the Nigerian people,” he said. The INEC Chairman who was represented by the National Commissioner and Chairman Information and Voter Education Committee (IVEC) Barrister Festus Okoye who explained that the mission and the vision of the commission is to conduct free and fair election for sustenance of democracy enjoyed the CSO’s to act with integrity while engaging the citizens on the electoral process “and in a no-partisan manner,” He said the aim of the dialogue meeting with the CSO’s is for them to endorse some of the innovations that will be deployed for the 2019 general elections adding “we would want the civil society groups to use this wonderful opportunity to interrogate ad proffer solutions to a wide number of issues such as vote buying, internal party democracy and more especially gender inclusiveness and PWDs representation which have consistently remained low in spite of the efforts of the commission and other stakeholders. has just emerged from the conduct of several off season governorship elections and has continued to improve with successive elections. The 2019 general elections is a few months away, it is expected that the engagements between CSO and the commission will be more regular. I must not fail to state that the CSO’s partnership with the commission has been of tremendous help in strengthening the electoral process through their observations reports, mobilization of citizens to participate and cast their votes in an informed manner and the issues they regard as appropriate and good in shaping and redefining policies. “Your ideas and suggestion have also contributed immensely in drawing up the Commissions guidelines, manuals and regulations. This meeting is not just to share ideas but to share knowledge and experiences from the people committed to the sustenance of democracy. I therefore expect implementable suggestions, constructive criticisms, questions and answers in order to improve electoral process,” he added. Undercover operatives from the Federal Special AntiRobbery Squad (FSARS) of the Lagos State Police Command have arrested three members of a kidnap gang who had allegedly attempted to kidnap a Lagos based business woman called Ijeoma Eze-Okafor. Two of the suspects, Emmanuel Okemayin and Austine Anyia both drivers to the victim and her husband had arranged with their friend Arowosola Adewale to contact a native doctor for charm to protect them during and after the operation. It was gathered that the suspects had unknowingly requested for arms, ammunition and a vehicle from the undercover agents. Parading the suspects at the Lagos State Police Command Headquarters in Ikeja on Monday, the State Commissioner of Police, CP Imohimi Edgal said the command got the information on the planned kidnap on October 10, 2018.

Saraki receives 3,000 APC defectors in Kwara Kehinde Akinpelu, Ilorin No fewer than 3,000 members of the All Progressives Change (APC) in Kwara state have dumped the party and joined the Peoples Democratic Party (PDP). The Sunday’s defection brought the number of defectors from APC to the ruling PDP in the state to about 4000. About 800 former loyalists of an APC stalwart, Prof Shuaib AbdulRaheem, had last week, in two instalments decamped to APC. The decampees gave the internal wrangling among their leader and lack of unity of purpose amongst them as reasons for their action.

2019: Be ready to accept defeat, PDP tells Buhari, APC Tunde Opalana, Abuja The Peoples Democratic Party (PDP) has told President Muhammadu Buhari to abide by his undertaking to accept the outcome of the 2019 Presidential election which, by all indices, will be overwhelmingly won by its Presidential candidate, Atiku Abubakar. The party invites all Nigerians and the international community to note the undertaking given by the Director-General of Buhari’s Campaign Organisation and Minister of Transportation, Chibuike Rotimi Amaechi, to a delegation from the European Union (EU), ostensibly having seen

that the tide is flowing against their candidate. The Buhari Campaign Organisation has seen the handwriting on the wall; that Nigerians across board have reached an irreversible consensus to end the Buhari administration and vote in our candidate, Atiku Abubakar, as their next President and that no amount of smear campaigns, intimidation and threats can shake their will or cow them from firmly defending their resolution after the elections. The Buhari Presidency and the All Progressives Congress (APC) are aware that they have failed Nigerians in every way. They know that Nigerians have seen through their unending lies, deception, propaganda and interminable penchant for beguilement, and

that there is no way they can resist the resolve of the people for a new beginning. This is a government that has gone down in history as irredeemably incompetent, blatantly corrupt, overtly insensitive, incurably vengeful and under which Nigerians are facing the worst form of economic hardship, hunger, starvation, social instability and unabated bloodletting, to the extent compatriots are resorting to slavery and suicide missions as options. The PDP, therefore charges the Buhari Campaign organization and the APC not to, in anyway, engage in any activity that is capable of derailing the electoral process, before, during or after the elections, as such will be firmly resisted by Nigerians.

Short News Tenure elongation cause of crisis in APC - Emokpaire Tom Okpe, Abuja A chieftain of the All (APC), Chief Ibrahim Emokpaire has noted that the lingering crisis in the ruling party is as a result of tenure elongation proposed by some of its leaders supporting the previous National Working Committee (NWC) led by Chief John Odigie-Oyegun. Emokpaire, however called on all party supporters to support the current leadership of Comrade Adams Oshiomhole to ensure victory for the party in the 2019 general elections. A former APC National Chairmanship aspirant, Chief Emokpaire who stepped down for the current National Chairman said: “We can see the handwork of the agent of tenure elongation at play; the same advocates of tenure elongation are mostly behind the removal of the party National Chairman. “The primary election crisis was created by these same tenure elongation agents where election congresses were duplicated across the 36 states. These same advocates of tenure elongation have metamorphosed into election primary crisis in our great party today.

How Benin national used finger to defile 10-year-old in Lagos Joy Anyim, Lagos A Benin Republic National, Lukman Haruna, is currently being held by the Lagos State Police Command for defiling a 10-year-old girl (name withheld). The suspect had allegedly consistently inserted his finger into the survivor’s private part whenever she helped him run an errand. The Police Commissioner for the State, CP Imohimi Edgal said one Mrs. Abali, a neighbour who observed blood stains in the genital region of the survivor raised the alarm. When asked, the survivor had revealed that Haruna was in the habit of fingering her whenever she went to his place. Edgal further stated that the Command’s Gender Unit received the report November 2nd, 2018 and has since begun investigation into the case. The Commissioner of Police said the suspect will be charged to court as soon as investigation is concluded. Similarly, a house wife who was in the habit of locking up her 14 year old maid in the toilet whenever she is going out has also been arrested.

Neighbourhood watch set to commence operations, says Gov Wike Amaka Agbu, Port Harcourt The Rivers State Governor, Barr. Nyesom Ezenwo Wike, has declared that the Rivers State Neighbourhood Safety Agency would soon become operational for the detection and prevention of crimes across the state. The governor urged traditional rulers to cooperate with operatives of the Agency to ensure that they succeed because the operatives were largely nominees of traditional rulers. Governor Wike spoke during the 108 and 109 General Session of Rivers State Council of Traditional Rulers on Monday in Port Harcourt, capital city of Rivers State. The governor continued: “The Neighbourhood Watch arrangement will soon be fully operational throughout the State to complement the efforts of the security agencies in the detection and prevention of crime and improve the security of lives and property in our neighbourhoods. “Let me remind you that the corps

members were recruited based on your attestations with regard to their character and suitability. Consequently, we will hold you accountable to the performance of the corps and the success of the scheme in your local government areas, communities and neighbourhoods,” he said. The governor urged the traditional rulers to shun partisan politics as getting involved in politics would reduce their social relevance. He wondered why a First Class Traditional Ruler would be involved in partisan politics with the aim of undermining the state government. He said: “If you don’t respect your stool, you will have challenges. Withdraw yourselves from playing politics. If you don’t withdraw yourselves, I will withdraw you. If you take sides, I will also take sides,” he warned. The governor charged the traditional rulers never to allow any politician to breach the peace in their communities during the forthcoming campaigns. “We expect the political parties to play by the rules and embark on peaceful and issue-based campaigns. But you must be on the watch out to ensure that no person or entity violates the peace of your

communities under the guise of political campaigns. “At the end of the campaigns the votes of our people are very important and we expect the INEC to conduct free, fair and credible general elections that will enable our people to freely determine their political direction and destiny. Here again, you also bear individual and collective responsibility to mobilize your subjects to collect their permanent voters cards and vote for the candidates of their choice,” Wike stated. Governor Wike urged the traditional rulers to lend their voices in condemnation of the alleged neglect of Rivers State by the APC Federal Government. “It is time you lend your voices more forcefully to the neglect of the State by the Federal Government, the devastation of our environment by the oil companies, the grand fraud and deception in the Ogoni cleanup exercise and the call for economic justice and fiscal federation,” he said. In an address, Chairman of the Rivers State Council of Traditional Rulers, King Dandeson Douglas Jaja, appealed to the Federal Government to revive the ports in Rivers State to create employment opportunities for the youths.

A Petrol Station Supervisor, a pump attendant and four others have been arrested for masterminding a robbery operation at Skepter Petrol Filling Station at Igbo-Elerin Bus-Stop along Lagos-Badagry Expressway. The suspects Obinna Ofoma, 25 years; Ndukwa Junior, 22 years; William Okon, 22 years; Tony Oluchukwu, 28 years; Charles Mike, 20 years and Freedom Daniel, 20 years had stormed the Petrol Station on October 8th, 2018, dispossessing customers and attendants of large sums, phones and other valuables. Although the suspects had made away with their loots before the arrival of operatives from the Lagos State Police Command and Federal Special Anti-Robbery Operatives, they were however trailed and arrested at their hideout. Briefing journalists on how the suspects were arrested, the Lagos Police Commissioner, CP Imohimi Edgal said, “ Information was received from a credible source that some armed men were sighted at Skepter Petrol Station situated at Igbo-Elerin Bus-Stop, Ojo area of Lagos robbing fuel attendants and their customers. On receipt of the information operatives from Ilemba Hausa Police Station and FSARS Ikeja jointly mobilized to the scene.

Group commends US victory prediction for Buhari Tom Okpe, Abuja A Group, Buhari Media Organization (BMO) has commended the United States of America over what it described as credible and more authoritative the finding by a Congressional body, that President Muhammadu Buhari and his All Progressive Congress (APC) will win next year’s Presidential election. It also applauded the methodology adopted by the body to arrive at its conclusions. In a widely circulated report, the United States Initiative for Peace (USIP), a body set up by the US Congress, had stated that President Muhammadu Buhari is likely to emerge victorious in the 2019 Presidential election. It also said that steps must be taken by the Independent National Electoral Commission (INEC) and the security agencies to avert violence in about eight States including Lagos, Ekiti, Kaduna, Kano, Plateau, Adamawa, Rivers and Anambra. Critical look at FCT High Court new Practice Direction Andrew Orolua, Abuja On the 29th day of October, 2018, at the Annual Legal Year of 2018/2019 of the High Court of the Federal Capital Territory- Abuja, the Honourable, Chief Judge of the High Court of the Federal Capital Territory, Abuja, signed a new Practice Direction and issued same into law, titled; “Practice Direction on Service of Process(es) at the Federal Capital Territory- Abuja.” This paper aims at a review, commendation, criticism and call for compliance by stakeholders. The said Practice Direction is an amendment to the Order 7 of the Rules of the Court, even though, this fact is not directly mentioned in the said Practice Direction. This position of the writer of this paper is verified by the list of arrangement of order which states Order 7: Service of processes. Therefore, the writer of this paper considers this as an omission on the part of the maker of the Practice Direction or the drafter with due respect. By Order 7 Rule 1 (a) of the Practice Direction, the Practice Direction shall apply to all civil and criminal matters relating to service of process (es) by the Court. Also, by Rule 2, the purpose of the Practice Direction is to provide for uniform fees for service of court process (es), mode of proof of service of the court process(es) and uniform fees chargeable for the production of records of the court. Furthermore,according to Rule 3 of the Practice Direction, with effect from the date of coming into effect of the Practice Direction, fees chargeable by the Bailiffs or all Process Servers except Registered Process Servers shall be as provided in the First Schedule attached to the Practice Direction. Furthermore, Rule 4 of the Practice Direction provides the procedures to be adopted by the Bailiff or Process Server outside Jurisdiction of the Court (outside FCT) which are as follows : (a) Depose to an affidavit; (b) Exhibit an affidavit of service of the Bailiff or the local court in the State where service was effected; (c) Exhibit the receipt(s) issued by the transport or airline company through which the bailiff actually travelled or Receipt(s) issued by the hotel(s)/lodge(s) the Bailiff stayed in the course of effecting the service of the process(es). Furthermore, by the provisions of Rule 5 of the Order 7 to the Practice Direction, there is now a procedure to be abided by for the payment of service fees by a party or counsel. This procedure is as laid down in the said Rule 5 thus ‘Pursuant to Order 7 Rule 14(1) of the High Court of FCT civil procedure Rule, 2018- 1 | P a g e (a) A party or Counsel requiring services of Processes shall pay to the Registrar of the Court the appropriate fee for the service of such process (es) as contained in the First Schedule to this Practice Direction to the Registrar of the Court before whom the matter is assigned.(b) The Registrar shall on receipt of the said amount, issue to the Party or Counsel, a non-revenue receipt acknowledging the receipt of the said sum.(c) Thereafter, handover the said sum and process (es) to the Bailiff of the Court who shall in turn acknowledge receipt of the said amount from the Registrar.’. So, it is the observation of the writer of this paper that henceforth, a counsel or party does not deal directly with the bailiff, he might not even know which of the bailiffs served his processes until the service has been effected for his proof of service rather he only deals directly with the court’s registrar and the service fee is only paid to the registrar who issues a non-revenue receipt acknowledging the receipt of the sum and not to be paid into any bank account. Also, it is observed that a party or his counsel can apply for proof of service or the affidavit/certificate of service of the said process for his documentation and he can as well meet the registrar of the court to whom he had delivered the said process to in order to confirm if the service has been effected. well seek to view the notebook of record of service by the bailiff referred to in Rule 6 of the Order 7. Also by Rule 6 of the Order 7, Pursuant to Order 7 Rule 18 of the High Court of FCT, Civil Procedure Rule 2018, the Registrar of every court shall keep an A4 sized, thick back notebook of Record of service by Bailiff. Information to be contained in the notebook should be in accordance with Schedule 2. The writer of this paper is of the hope that this notebook is readily available and that the various registrars of the Courts are aware and have adequate trainings to effect the provisions?!Also, by Rule 7 of the Order 7, all Registrars shall not later than the first week of every month prepare and send to the Office of the Chief Bailiff, a Comprehensive Report of service of process(es) done by the bailiff in their Courts. Finally, by Rule 8 of the Order 7, the fee chargeable by the Court for the production of proceedings shall not exceed the sum of N50.00 per page. This in the view of the writer of this paper relates to Certified True Copy (CTC) of the record of proceedings and no more. This provision should be taken with care and lawyers are advised to be at alert so that this provision is not misinterpreted into being generally applicable to all applications or Certified True Copies. Furthermore, the schedule of fees payable by a party or counsel are defined under Schedule 1.The service fees for serving a process within FCT Metropolis such as: Maitama, Wuse, Asokoro, Ways, Lokogoma, Apo, Gudu, Games village and Durumi is N2,000.00, however, there shall be an addition of N1,000.00 per defendant (where the address is different from that of the 1st Defendant). Therefore, the writer of this paper observes and submits that the facts that there are many Defendants within the 2 | P a g e same address or premises but different plots or on different storey buildings will not attract any additional fees. Furthermore, service of process from FCT Metropolis to satellite towns such as:Gwagwalada, Gwarimpa, Kubwa, Zuba, Kwali, Abaji, Karmo, Life Camp, Jiwa, Gwagwa, Dei-Dei, Bwari, Nyanya, Karu, Orozo, Karshi, Mpape and Lugbe attracts the sum of N3,000.00 only, however,there shall be an addition of N1,000.00 per defendant (where the address is different from that of the 1st Defendant). Therefore, the writer of this paper observes and submits that the facts that there are many defendants within the same address or premises but different plots or on different storey buildings will not attract any additional fees. Also,

service of process within Satellite towns such as: Gwarimpa,Kubwa, Lugbe, Gwagwalada, Kwali, Abaji. Karmo, Life Camp, Jiwa, Dei-Dei, Zuba, Bwari, Karshi,Nyanya, Orozo, Karo and Mpape attracts the sum of N3,000.00 only, however, there shall be an addition of N1,000.00 per defendant (where the address is different from that of the 1st Defendant).Therefore, the writer of this paper observes and submits that the facts that there are many Defendants within the same address or premises but different plots or on different storey buildings will not attract any additional fees. Furthermore, service of processes in States contiguous to FCT such as: Niger, Kaduna, Kogi, Nasarawa, Plateau, Benue and Kwara attracts the sum of N15,000.00 only, however, there shall be an addition of N5,000.00 per defendant (where the address is different from that of the 1st Defendant).Therefore, the writer of this paper observes and submits that the facts that there are many Defendants within the same address or premises but different plots or on different storey buildings will not attract any additional fees. Likewise, service in State noncontiguous to FCT such as: Lagos, Rivers, Borno, Kano, Edo, Taraba,Ogun, Oyo, Bayelsa, Delta, Cross river, Akwa Ibom, Imo, Abia, Enugu, Ebonyi, Katsina, Jigawa,Adamawa, Yobe, Kebbi attracts the sum of N40,00.00 however, there shall be an addition ofN10,000.00 per defendant (where the address is different from that of the 1st Defendant). Therefore, the writer of this paper observes and submits that the facts that there are many Defendants within the same address or premises but different plots or on different storey buildings will not attract any additional fees. Furthermore, it should be noted that a party paying for service or counsel shall by Rule 5 of the Order 7 fill a service form as contained in the Schedule 1 to the Practice Direction and the Registrar shall issue a receipt of confirmation of payment as mandated by the said Rule 5 of the Order 7. Therefore, the writer of this paper submits humbly that any other means of payment laid down including payment into or through bank account(s) is illegal and unlawful as it has no legal basis. On a general note, the writer of this paper commends in no small amount, the great efforts of the Honourable, the Chief Judge of the FCT High Court. This indeed is a very difficult efforts of which the Honourable, the Chief Judge has taken a brave act to undertake. This indeed brings the

issue of bailiffs 3 | Page or ordinary clerk asking for a total sum of N7,000.00 or N10,000.00 to serve a court’s process from Kubwa FCT High Court to Byazhin Layout which is just a few kilometers from the court as the writer of this paper had complained about few months a go. The writer of this paper salutes the courage and the daring efforts of the Honourable, the Chief Judge of the FCT. May God Almighty continue to inspire His Lordship towards a better development and sanitation of the FCT Court’s System and the FCT Judiciary. The writer of this paper appeals for an extension of this efforts to the fees of other lower courts in FCT such as the Magistrate Courts, the District Courts, etc. and same appeal goes to the Honourable, the Grand Kadi of the Sharia Court of Appeal of the FCT and the President of the Court of Appeal of the FCT as this effort is great in the fight against financial corruption in the court’s system and the judiciary. Furthermore, the writer of this paper also appeals for a continuous monitoring as to compliance with this Practice Direction by the appropriate persons. Nevertheless, lawyers, parties, bailiffs, the Judges, the Registrars, and other registered servicing person(s) are all stakeholders in the implementation of this Practice Direction. It would amount to an act of corruption for a lawyer or party to pay any additional fees beyond and or below the prescribed fees. It is also an act of illegality for any court’s staff or bailiff or Registrar to demand for an addition beyond the prescribed fees or without issuing a receipt of confirmation of payment as mandated by this Practice Direction. So, the Independent Corrupt Practices and other Related Offences Commission has a role to play. The writer of this paper further recommends that CCTV camera should be affixed to each place where the fees is to be paid and the collector of such fees should be mandated to remit same to the specified account under the Practice Direction. Furthermore, the writer of this paper is very surprised that the Practice Direction which is not up to or not more than ten leaves could be sold at the price of N1,000.00 only even without a receipt of acknowledgement. The question is who receives the publication fee? The government or a private individual? The same instance occurred at the time of the issuance of the 2018 FCT High Court’s Rules. In these two scenarios, no receipt was issued to the writer of this paper for the payments. So, it is hoped that the same way corruption is fought all around the various areas in Nigeria, same would be extended to the High Court of the FCT by the appropriate law enforcement agencies in the fights against corruption. Finally, the writer of this paper applauds and commends the giant efforts of the Honourable, the Chief Judge of the High Court of the FCT for these wonderful efforts! It is the prayer of the writer of this paper that God Almighty would reward His Lordship’s efforts. Also, other courts are advised to emulate the efforts put forward by His Lordship, the Chief Judge of the High Court of the FCT, in order to sanitize the Court’s system and the Judiciary as a whole. It is also hoped that lawyers and litigants or party paying for service fees would insist on the prescribed fees and report any form of corrupt practices or illegal demand or additional but unlawful demands by any court’s staff or bailiff or registrar to the 4 | Page appropriate authority or law enforcement agency. Therefore, this Practice Direction should be a lawyer’s handbook whenever he aims at service of any court’s process in the FCT, whether such lawyer is within or outside jurisdiction of High Court of the FCT. Buhari reassures of sustained massive investments on infrastructure Mathew Dadiya, Abuja President Muhammadu Buhar has reassured Nigerians that his administration will sustain massive investments to upgrade and develop the country’s transport and power infrastructure. Buhari stated this on Monday when he received members of the Association of Retired Career Ambassadors of Nigeria (ARCAN) led by Ambassador Oladapo Fafowora, at the Presidential Villa, Abuja.

The President told the retired Ambassadors that Nigerians will never forget the ‘‘lost opportunity between 1999 and 2015,’’ when the nation had enormous resources at its disposal. ‘’There is no part of the country I haven’t been to, having attempted to be President four times. ‘’I know the condition of our roads. The rails were killed, there was no power despite the admittance of some previous leadership that they spent $16 billion on the sector. ‘’Today, we are getting our priorities right and we believe that of the three

fundamental issues we campaigned on – security, the economy and fighting corruption-, we have remained very relevant and Nigerians believe we have achieved something,’’ the President said. Buhari also used the occasion to appreciate the People’s Republic of China for financing some of the rail and power projects in the country through concessionary loans. ‘’I will do my best to see that where there are possibilities of making a quick improvement on infrastructure, we will do it,’’ he said.

He also appealed to the Nigeria Labour Congress (NLC) to consider what this government inherited and the more it is doing with fewer resources in putting the economy right. The President took note of some concerns raised by the retired Ambassadors including an appeal for the adjustment of their pension entitlements, retention of diplomatic passport for retired career ambassadors, allocation of land for ARCAN headquarters in Abuja and adequate funding of the Foreign Affairs ministry, among others.

Senate to probe NNPC’s claim on diversion of NLNG’s dividend Tunde Opalana, Abuja Senate President, Dr. Bukola Saraki, has said that the Senate on resumption of plenary will further probe the claims made before the Senator Ahmad Lawan’s Adhoc Committee by the Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), on how and why the corporation was diverting the dividend from the Nigerian Liquified Natural Gas (NLNG) to defray the cost of under-recovery in the importation of fuel. Saraki, while reacting to questions from newsmen at the Ilorin Airport, admitted that he had received series of telephone calls on the issue by many concerned

Nigerians and others who wanted to know the position of the Senate on the issues raised by the NNPC’s GMD before the Ahmad Lawan’s Adhoc Committee. This was contained in a statement by the Special Adviser to the Senate President on Media and Publicity, Yusuph Olaniyonu. The Senate President stated that the disclosure by the NNPC boss in response to enquiries by the Senate adhoc committee probing the issue of illegal payment of subsidy on fuel, called for further investigation by the Senate and also showed that as alleged in a motion moved earlier by Senate Minority Leader, Senator Biodun Olujimi, a lot of illegal and unapproved spendings are going on in the petroleum corporation.

“Let me assure Nigerians that there will be no cover-up. We are confident that the adhoc committee will do a thorough job. All the issues will be unearthed. That is why when the Senate set up investigative committees on issues, we want Nigerians to have confidence in us that we do not act because we want to embark on a wild goose chase. There must be some serious issues to be looked into. The revelations by the NNPC’s GMD have justified the need for this investigation and they have shown that we are acting in good faith. “When in my ruling on the motion raised by Senator Olujimi, I insisted that we want a transparent, honest and non-partisan investigation on the fuel subsidy issue, it was clear to me and my

colleagues that certain irregularities are being perpetrated and we should let Nigerians know the truth. That is why we set up the committee in the first place and to demonstrate the seriousness we attach to the issue, we decided that the ad-hoc committee should be led by the Leader of the Senate, Senator Ahmad Lawan. “We are however shocked that the NNPC’s GMD was claiming that the illegal diversion of dividends from the NLNG which should be paid into the Consolidated Revenue Fund of the Federation for funding the fuel subsidy was done ‘in compliance with the National Assembly directive that NNPC as the supplier of last resort should, and has, maintained robust petrol supply”, he stated.

The Federal Airports Authority of Nigeria FAAN says it is strategizing to ensure that the issues of reports of negative staff attitude, lack of trust, extortion, weak customer relationship management and service failures across agencies are addressed. To this end, the FAAN Managing Director, Saleh Dunoma at the 4th SERVICOM Quarterly Stakeholders Forum in Lagos said as a matter of urgency, the agency is brainstorming and strategizing on the way forward for the upcoming year. Crude oil price hits $72.83 as US’ restriction Iranian export begins Brent crude oil price on Monday rose to $72.83 a barrel, while US light crude was 15 cents lower at $62.99, as United States sanctions against Iran’s fuel exports began. Although, the impacts were softened by waivers, which allowed major buyers to import Iranian crude for a while, however, Tehran said that it would defy Washington and continue to sell. At 2.00 a.m. commodities, US crude was $62.91 per barrel and Brent was last at $72.62. At 3.00 a.m. US crude was $62.68/barrel while Brent was last at $72.41. “Oil bulls have long pinned their hopes on the Iran factor and today’s dearth of upside potential will be a major source of concern,’’ Stephen Brennock, an analyst at brokerage PVM Oil, said. Washington imposed sanctions against Iran on Monday, restoring measures lifted under a 2015 nuclear deal negotiated by the administration of former US President Barack Obama. In response, Iranian President Hassan Rouhani said, in a speech broadcast on state Media that Iran would break the sanctions and continue to sell oil.

Finance Minister tasks tax appeal on professionalism Denies report of looming petroleum products shortage Mathew Dadiya, Abuja The Minister of Finance, Mrs. Zainab Shamsuna Ahmed, on Monday, urged the newly inaugurated Tax Appeal Tribunal (TAT) Commissioners “to discharge their duties with high level of professionalism, integrity, diligence, and fairness to all parties”. The Minister of Finance, who stated this while inaugurating the new commissioners in Abuja, also implored the commissioners to avoid unnecessary delays and adjournment of cases and that their decisions should be in line with tax laws. Ahmed said that the government’s desire to achieve a sustainable growth and development of our economy has informed the concerted efforts by successive governments over the time to reform the Nigerian tax system, among others. According to her, one of the outcomes of the series of reforms is the strengthening of the appeal process and creation of the Tax Appeal Tribunal by the Federal Government in 2010. She noted that the establishment of the Tribunal marked a very significant milestone in

the annals of our nation’s tax dispute resolution mechanism. The minister said, “One of the critical objectives of the government in setting up the Tribunal is to reduce the incidence of tax evasion and improve the taxpayers’ confidence. Others include the need to ensure fairness and transparency of the tax administration and to minimize delays and bottlenecks in the adjudication of tax disputes. “As an essential component of the ‘change’ agenda of the present administration, Nigeria launched a Revised National Tax Policy in January 2017 and a provided tax amnesty platform through the Voluntary Assets and Income Declaration Scheme. Very fundamentally, the current tax policy of the government emphasizes areas of harnessing all necessary inputs towards achieving voluntary tax compliance. Going forward, the government is working towards the strengthening of the operations and legal framework of the Tax Appeal Tribunal in line with the recommendation of the National Tax Policy Review Committee.” Earlier, the Permanent Secretary, Ministry of Finance, Dr. Mahmoud Isa-Dutse, had said, the Tax Appeal Commissioners being inaugurated today are “expected to hold office for a term of three years, which is subject to renewal for another term of three years only” He noted that the Tribunal is one of the windows provided in Nigeria’s tax administration system which offers an aggrieved party the opportunity to explore other dispute resolution mechanisms before gaining access to the Law Courts. Amongst other things, it helps to reduce the caseload of the over-laden regular courts by providing less formal fora for quicker, cheaper and expert resolution of tax disputes in the public interest.

Nationwide strike: Foreign airlines may be exempted - Union boss Chukwuemeke Iwelunmo There are strong indications that foreign airlines operating into the country may not adversely be affected by the planned grounding of activities in Nigeria, following agitation for wage increase by the nation’s unions. This is as aviation unions said they empathised with the domestic operators and other business organisations in the industry that would be affected by the action, saying that as affiliated members of labour centres, they had to comply with their directives. Speaking with our correspondent on phone, Comrade Illitrus Ahmadu, President of Air Transport Services Senior Staff Association of Nigeria (ATSSSAN) said that if the tripartite meeting with the Federal Government failed, the unions would obey the directive of the labour

centres and shut down the airspace. He, however, said that the industry unions were not unmindful of existing Bilateral Air Services Agreement (BASA) arrangements Nigeria had with foreign countries whose airlines operate into the country, stressing that the issue at hand was a domestic one, which should not be allowed to affect international airline operators. He recalled that during the fuel pump price hike of January 2012, the unions allowed international airline operators to reschedule their flights from 6 am to 6 pm, stressing that if the strike went on as planned, such treatment may recur. Ahmadu stated that the unions had allowed international carriers to operate into the country in the past because some Nigerians caught in the web had traveled into the country for holidays and needed to return to their respective countries to resume work, adding that some were equally traveling on scheduled medical.

He said: “The fact is that we are affiliated with labour centres and we are under obligation to comply with directives. So, from the strike notice issued so far, we are to shut down by mid-night of today. However, as we speak, the tripartite discussions have resumed; they are in a meeting and we hope that something good will come out of the meeting so that we will no longer embark on the strike. “You know, we are in a very volatile industry. This is our national problem; we have several bilateral agreements with most foreign nations that their airlines fly into Nigeria. It is our domestic problem. We should not allow it to adversely affect the fortunes of the international operators. We have offered a corridor where we will accommodate them. The primary shut down we have had in this industry so far was during the price hike of former President Goodluck Jonathan.

In its reaction, BMO welcomed the conclusion and the scientific approach USIP employed to arrive at that conclusion. “We are impressed that the USIP said the report is based on its interactions with Nigerians from different sectors and that ‘though many Nigerians feel that the current administration has not fully met their aspirations, this is not likely to cost the All Progressive Congress (APC) government its hold on power’. “We note also that the original intention of the survey was to sample Nigerians’ opinions on the possibility of violence during the elections and

Nigerians on the march for 2019: INEC goes tough, disqualifies 300,000 voters from voting Tunde Opalana, Abuja

As the countdown begins over the 2019 general elections, the Independent National Electoral Commission (INEC) has disqualified over 300,000 voters out of over 80 million registered voters by through fingerprints identification. The chairman of INEC. Prof. Mahmood Yakubu, disclosed this on Monday while receiving a delegation of the ECOWAS Election Monitoring team at the Commission’s headquarters, Abuja. He, however, asked Nigerians to visit the 120,000 voters’ registration centres across the country as the Commission will from Tuesday (today) display votets’ register within the next four days for claims and objections.

The chairman also said the commission shall display the list of candidates for the 29 governorship elections and the 991 states constituencies nationwide!between November 6 and 12,b2018. Giving a breakdown of 1558 constituencies elections to be conducted by INEC in 2019, Yakubu said there will be one presidential constituency, 109 senatorial districts and 360 federal constituencies, 29 governorship elections, 991 state constituencies and 68 constituencies in the FCT for the area council, the chairmen and councilors. Disclosing further that 88 parties will participate in the 2019 polls, Yakubu said: “We have 91 political parties registered out of which only three did not sign notices for their primaries. We have 79 parties indicating interest to contest in the presidential elections, we

have over 1800 contesting for 109 senatorial districts and then over 4100 contesting for the 360 federal constituencies”. He said over a period of 16 months from the 27th of April 2017 to 31st of August 2018, INEC registered 14.5 million new voters in addition to the existing register of 70 million, making it over 80 million registered voters for the 2019 election. Talking about INEC’s preparation for the 2019 general election, the INEC chairman said: “In fact, we can say that the 2019 general election is perhaps the most deliberately well planned election in our history. We have finished the strategic planning, we have finished our strategic programme of action, we have completed the election project plan, we have issued a timetable and schedule plan on activities for the 2019 general elections “.

Gen Alkali’s killing: Buratai seeks review of Nigeria’s security architecture Andrew Orolua, Abuja

The Chief of the Army Staff (COAS), Lieutenant General Tukur Buratai, has said that the security architecture of the country must be reviewed to ensure that current killings are stopped. He added that the death of Major General Idris Alkali (rtd), who was killed by yet to be arrested persons in Dura Du community in Jos South Local Government Area of Plateau State on September 3, 2018, should be “a wake up call for all including the military to be decisive on the issues of insecurity in the country.” Buratai stated this in Abuja on Monday when he received a delegation of Plateau State Government led by Governor Simon Lalong on a condolence visit over the killing of General Alkali. The COAS said that security is fundamental and remains the focus of governance because without it so many things goes wrong affecting peace which is essential for any meaningful development to take place. He regretted that it is taking the

country too long to realise the need for peace despite its bitter experiences of unrests. Buratai said that the security situation in the country need to be improved upon but regretted that authorities who ought to take responsibility in their areas have renegade their duties. The COAS said that the late General Alkali case is just one among many, adding that several people have been killed in communities whose cases are not investigated. He said that even where investigation are commenced, they are not concluded and suspects are not prosecuted. He said, “We have a very big gap between arrests and prosecution in our hands and as security agencies we must bridge that gap.” He said that one of the cars that was found in the pond was a case reported in 2013 but its investigation was inconclusive. Buratai said that commanders of security outfits in communities must henceforth be held responsible and sanctioned because they knew what is happening in their areas of jurisdiction but choose not to address the issues.

The COAS also urged leaders to speak out and condemn criminal activities in their areas and leave sentiment apart. He advised Governor Lalong to ensure that the cases of those responsible for General Alkali’s death and other security breaches are diligently prosecuted. He assured that those on the run will be arrested. Earlier, while expressing his condolence, Governor Lalong, who was accompanied by some members of Plateau State House of Assembly and members of State Executive Council, described the killing as unfortunate, adding that it was “first time in our life that we are witnessing this type of thing.” The Governor thanked the Army for unraveling the killing that happened at a time Nigerian Army is helping to fight insecurity in the state. He appealed to the army not to be discouraged on what happened as God will expose the causes of insecurity in the state. Lalong also assured the army that the unfortunate incident will not happen again in Plateau State.

He clarified that the union’s action was not in any way linked with the Nigerian Labour Congress (NLC) strike action as ASUU’s struggle and strike action has been on since 2016. “Our own action has been on since 2016. We had 2016 warning strike when

we were asking for renegotiation and implementation of the 2009 agreement. That time, we went to the National Assembly and the Honourable minister promised us that they will start renegotiation. We went back trusting them but the renegotiation lingered for 17 months without anything coming out of it,” he said. He added that the Federal Government has not yet indicated interest to call them to a round table. “We cannot force them to call us for a meeting. We believe that they will call us when they feel it is right. The first thing that government does in this type of situation is to ignore you. When it becomes uncomfortable, that is when they will call you,” he said.

The United Nations Children’s Fund (UNICEF) has said that Nigeria is responsible for 24 per cent of global burden of Human Immunodeficiency Virus (HIV) in the world. Quoting the UNAIDS report of 2017, Dr. Ijaodola Olugbenga, Assistant Director, National Aids and STIs Control Programme, (NASCF) in the Federal Ministry of Health also said that Nigeria contributes one of the largest proportion of new vertically acquired HIV infections among children. He said, “Nigeria is responsible for over 12.4% of the global burden of HIV infected children with an estimated number of 267,000 children living with HIV in the country, he said. He spoke during a two day media dialogue on “Prevention of Mother to Child Transmission” organised by the Child Right Information Bureau (CRIB) of the Federal Ministry of Information and Culture in collaboration with the United Nations Children’s Fund (UNICEF). While reiterating that Nigeria is committed to the goal of eliminating the mother to child transmission by 2020, he said that the country has initiated a number of

policies and strategies to reduce the impact. He lamented that out of the 9,784,285 women in Nigeria estimated to be pregnant in the country per year, based on fertility rate and population, only 40 percent of them make use of established health facilities, adding that mothers who already have the virus give birth to 8.4 per cent of children with the virus in the country. “9,784,285 women get pregnant annually. Out of this figure, only 4,025,074 register for Anti-Natal Care at the health care centers. While 2,682,337 pregnant women test for HIV, 64,811 pregnant women test positive to the disease. “267,000 children are infected with HIV virus in Nigeria, 54,167 children under 14 years are under anti-retroviral drugs, 10,464 children have their viral loads tested, while 4,699 Nigerian children have viral load suppressed. “For Nigeria to be able to address the challenges of the global burden of PMTCT, pregnant women must have access to PMTCT,” he added. Earlier, Minister of Information and Culture, Alhaji Lai Mohammed, urged the media to champion the cause of children to live free of the virus. The Minister, who was represented by Olumide

This is becoming a serious call for concern as the donations are dwindling. There is need for collaborative efforts from agencies and stakeholders to address the situation by redesigning HIV funding plan to meet up with global standard”, she added. HIV /AIDS was first reported as a strange ailment, and first noticed by 5 gay men in Los Angeles, USA in 1982. More than 100 men died thereafter within two months of discovery of the strange condition.

After the end of the foreign bikers visit to the country, the Minister of Information and Culture, Alhaji Lai Mohammed, has said that the successful, two-week tour of cultural heritage and historic sites across the country by local and foreign bikers, under the auspices of the Latin America Motorcycles Association (LAMA), has indicated that Nigeria is safe for tourism and business. The Minister made the remarks in Abuja on Monday while bidding farewell to the foreign bikers at the end of the tour that took them to eight states covering four geo-political zones and the Federal Capital Territory (FCT). He said, “From the report that I have received, this tour is a great success. It is also an attestation to the fact that Nigeria is indeed a safe destination for tourists and business people alike. Yes, there are security challenges here and there - and this is not peculiar to Nigeria. But our country is safer today than it was before the advent of this Administration in 2015, thanks to the political will shown by the Administration and the commitment of our security agencies.” Mohammed said the bikers, who crisscrossed Nigeria by road and returned to Abuja, the starting point of the tour, safe and sound, will be in a better position to tell the world the situation in the country.

“They are not armchair analysts or critics. They are practical men and women who zoomed across the country on their power bikes. No one can tell the story better than them. And the feedback we have received is overwhelmingly positive,” he added. The Minister said the tour, which he flagged off in Abuja on 23rd of October 2018, took the bikers to Niger, Kogi, Enugu, Cross River, Rivers, Edo, Oyo and Lagos as well as the FCT. He listed some of the sites toured by the bikers as Gurara Falls in Niger; the coal city of Enugu; the Millennium Park, Slave History Museum and Tinapa Lake Resort in Cross River; the National Museum in Port Harcourt, Rivers State; the National Museum and other sites in Benin, Edo State; the ancient city of Ibadan in Oyo State; Lagos Mega City and many sites in the FCT. In his remarks, the President of LAMA, Mr. Mario Nieves, described the tour as an ‘’incredible experience’’, saying that he discovered that contrary to what is being portrayed by European historians, Africa has a ‘’beautiful history’’ and an ‘’incredible civilization’’. “There are many people in this world who are trying to hide our history but one thing I learnt here and in South America is that our history has been hidden from us. “They taught us all Africans were always in the bush. They had no history, they don’t write, they don’t do anything and the same

thing with South Americans and North Americans, the Indians, the Azteca that all these people they are animals and they had nothing. No! We had an incredible civilization and we have been lied to,” he said. The appellate court further held that the panel lacked the constitutional power to seize properties of alleged offenders. The judgement of the Appeal Court was sequel to an appeal filed by a staff of the Federal Ministry of Power, Works and Housing , Tijani Tumsah through his lawyer, Kehinde Ogunwumiju SAN.

The panel had approached the High Court and obtained an order forfeiting his properties alongside that of his brother , Ibrahim Tumsah, who is the Director of Finance and Accounts in Ministry of Power, Works and Housing. Not satisfied, Tijani had approached the appellate court, challenging the prosecutorial power of the panel. Besides the Tumsah brothers, the panel had also filed a charge against the Deputy Senate President , Senator Ike Ekweremadu, Senators Hope Uzodinma and Stella Oduah. But in unanimous judgement , a five man panel of the Court of Appeal led by Justice Hussein Muhktar who began to read

the judgement at about 6:15pm held that going by the Act that established the panel,it lacks power to prosecute any offender. The court further held that the powers of the panel is only limited to investigation and not prosecution. In the appeal, Ogunwumiju had asked the court to determine whether the suit culminating in the forfeiture order against his client was validly instituted by the panel before the court below. The appellant also asked the appellate court to determine whether or not the panel could validly rely on the EFCC Act to obtain the freezing order granted by the the lower court on December 6, 2017. Also the appellant asked the

court to determine whether or not the lower court was right when it refused to set aside its interim freezing order of December 6,2016. The court however resolved all the three issues in favour of the appellant. It held that nothing in the Recovery of Public Property Act Cap R 4, LFN 2004 empowers the panel to initiate court proceedings pursuant to its investigative powers for the purpose of obtaining an interim order for forfeiture of property The Court of Appeal said , “ The panel cannot clothe itself with the cloth not given to it by the Act that established it. It cannot take over the responsibilities of the EFCC.

“The power to investigate and prosecute is solely for the EFCC and such cannot be taken over by any person or agency. “ The provision of the Act is unambiguous and not confusing. The powers of the panel is to conduct investigation on any officer who have corruptly enriched himself or breached the code of conduct. “No power or authority is conffered on the panel to prosecute offenders. “ The ex-parte order granted by the lower court as regards the properties of the appellant is hereby set aside. “The court below lacks the jurisdiction to entertain the matter , let alone enter judgement”.

The court held that suit instituted against the appellants at the lower court was not properly instituted. The court further held that the Panel cannot take over the power of the EFCC in prosecuting criminal cases. The court also held that the lower court was wrong for failing to set aside its forfeiture order. Earlier, Justice Muhktar had explained why the judgement was delivered late in the day. According to him, the judgement was earlier scheduled for Tuesday (today) but the panel got the hint that a nationwide strike may begin, hence the need to deliver the judgement on Monday evening .
