Legal details of hiring, ring Understanding rights, responsibilities as an employer

Whether a farm has one employee or many employees, there are things every dairy farmer should understand about the process of hiring and ring employees.

“As an employer, knowing the legal rights and responsibilities in the hiring and ring process is really important,” said Troy Schneider, partner and attorney at Twohig, Rietbrock, Schneider & Halbach Law Ofce.

Schneider provided tips Dec. 28, 2023, during a Professional Dairy Producers The Dairy Signal “Legal ins and outs of hiring and ring.” His law rm has worked in the agricultural eld for over 50 years, providing legal services to farms and agribusinesses.

“When I was growing up, it was typical for farms to have maybe one to two hired men, and the rest of the workforce was family,” Schneider said.

“But today, farms have lots of employees. Some farms have 50 or 60 employees. There’s a whole human resources element to farming these days.”

When hiring a new employee, Schneider warned against making in-

Schneider said farms are required to ll out I-9 forms for their employees, which must be kept for three years after that person is hired and for one year after that person no longer works at the farm.

“Wisconsin is an employment-atwill state, meaning that nobody has a right to their job unless given that right,” Schneider said. “You can hire and re anybody at any time.”

There are certain things that limit that right, however, such as contractually giving someone rights via a written or oral employment agreement.

Contracts for more than a year have to be in writing; however, Schneider said there is a legal concept called promissory estoppel that states that promises made — whether oral or written — are enforceable by law.

“Watch what you say and how you say it because you might be giving employees certain rights that you did not intend to give them,” Schneider said.

Employees cannot be red based on race, color, creed, sexual orientation, etc.

Voluntary termination or quitting can be done by word or action. An employee can say, ‘I quit.’ If an employee fails to show up for work consistently for a number of days, Schneider said that could be deemed a quit situation by their actions.

“When somebody quits, they have less rights under lots of different areas and benet type plans than if they get red,” Schneider said.

When creating an employee handbook, Schneider said to be careful not to unintentionally give employees certain rights. Handbooks should specically include language underscoring the employee relationship is at-will in all circumstances. The handbook should also state that the employer reserves the right to unilaterally make future policy modications within the handbook.

Use permissive language when referring to policies in the handbook, meaning the employer reserves the right to change those policies at any time. It should also be noted that disciplinary procedures mentioned are not exhaustive.

Schneider said employee records are important and should be reviewed when deciding to re someone.

“Every time an employee screws up, document it immediately, and better yet, have them sign some sort of disciplinary procedure,” Schneider said. “Review those, and make sure if you have certain policies on certain actions, there is consistency you’ve created while applying that policy.”

When communicating to an employee that they are going to be let go, pick a discreet location and have another person present as a witness.

“When you’re telling somebody the reasons why they were red, make sure it doesn’t go into any of those prohibitive areas,” Schneider said. “Keep it about job performance-type things. Be careful not to sugarcoat anything either. You can be blunt yet professional.”

Schneider also addressed the topic of payments for terminated employees.

“When you re someone, you have to give them their last paycheck,” Schneider said.

In order to deduct pay to cover damages caused by an employee, the employer must have something in writing. According to Wisconsin Statute 103.455, an employee must have signed something ahead of time stating their employer can deduct from their wages for defective or faulty workmanship, lost or stolen property, or damage to property.

“Without something in writing, you cannot make those deductions,” Schneider said.

Following termination, the employer must also pay the red employee for any unused vacation, paid time-off or sick pay.

“That’s really important, and you have to make sure you have a policy on how those items are accrued and that those policies are clear and consistently applied,” Schneider said.

Tell us about your chapter. The Riverdale FFA Chapter members embody the National FFA Organization motto as they learn to do, do to learn, earn to live and live to serve. Our local chapter has 80 active members, representing one-third of our junior high/high school enrollment. Through various events, students demonstrate their premier leadership, personal growth and career successes. They have attended and succeeded in local, state and national leadership conferences, and judging contests. They have engaged community partners with school farm test plots, greenhouse sales, school forest management, equipment rental and joint fundraising efforts. We participate in National Ag Day, local and state fairs, and roadside cleanup days.

How does your chapter volunteer in the community throughout the year? To encourage members to become active and involved citizens in their school, community and country, our chapter plans and hosts a number of activities. As part of our Family Fun Night at the School Farm, we host a haunted walk and movie night for community members. We provide tractors and wagons to Riverdale tractor safety to create informed, safe on-farm individuals. We clean up the Adopt-AHighway stretch on Highway 60. We provide free youth entertainment at Autumn Fest and at Avoca’s 150th celebration with our kiddie pedal tractor pulls. We plan and manage a petting zoo for

Muscoda Morel Mushroom Festival. At the Highland tractor pull, we demonstrate knowledge of safe transportation and courtesy by transporting people on a hay wagon to and from their vehicle parking. We educate elementary students about agriculture by reading and donating books monthly to a district classroom. Our FFA members lead activities that coordinate with each book. During Food for America, we educate fourth graders on caring for animals, wildlife, crops, gardens and farm safety. ConƟnued from FFA | Page 6 public of agriculture and FFA facts and traditions. We visit the Wisconsin Capitol and meet with senators and representatives for FFA Day on the Hill. We host ag olympics for high school and elementary students. During farmer appreciation lunch, we prepared and delivered 150 meals to local farmers during harvest season to thank them for their work. At the Richland County dairy breakfast, members volunteer parking cars to support Richland County dairy producers.

What fundraisers does your chapter do throughout the year? Our fundraising efforts encourage thrift and good nancial management among members through earnings, saving and investment. Funds are used to further agriculture and FFA opportunities to all students. We plant, manage and harvest crops each year to provide funding for students to attend conferences, contests and activities at no cost to them. Funds are also used to update or purchase equipment or implement new ideas, projects and buildings. This is also a great tool for working with community members and agriculture industry partners who donate time, products and knowledge to our education and fundraising efforts. From our strawberry/cookie dough sale, we generate income for members to earn FFA jackets, improve members’ sales skills and provide products to the community. From our greenhouse, we sell plants, such as hanging baskets, petunias, impatiens and a variety of vegetables, to generate income for student awards and state convention as well as provide an educational opportunity for students to care for the plants daily and provide an appreciated product to the community.

What are the biggest events of the year? At our FFA banquet, we recognize all members with degrees, certicates, pins and other gifts as well as acknowledge our star and outstanding members. Parents and community

members are invited to see the members’ accomplishments. FFA ofcers provide an entertaining and informative ceremony and award students and community members for their contributions.

What is unique about your chapter? Our school district owns a 190acre school farm and forest which is operated by our agriculture classes and FFA program. Our 650 K-12 students have access to the farm’s 44 tillable acres for crop production, a sweet corn patch, pumpkin patch, sunower patch, raised garden bed, corn/soybean test plot, several managed forest zones, soil pit, Christmas tree plantation, orchard and recently constructed Jack Meister Agricultural Learning Center complete with a heated and cooled display area, classroom and lean-to for equipment storage. Our chapter owns and operates the farm as a fundraiser and experiential learning opportunity. This has led to our chapter acquiring two tractors, a wagon for hauling people, corn planter, gravity box and the rental of a Case tractor from Ritchie Implement. In January, a new agricultural classroom and lab facilities opened for district students and FFA members. This includes a classroom, animal lab, food science lab area, attached greenhouse and headhouse space.

When was your chapter founded and how has it evolved? Our chapter has evolved as we change to t the needs of the agricultural industry. Members are focusing more on helping roles in agriculture as we see less students growing up in traditional production agriculture. We are fortunate to have many members still on farms in our community, but that number as a whole is decreasing in our nation. Our chapter focuses on the future of agriculture and how we can prepare our members to meet its growing needs.

Why did you join FFA? I joined FFA to help others in my community learn about livestock, farming and the importance of agriculture. I am also involved in dairy and livestock showing and wanted to display my animals and abilities at local, state and national shows.

Tell us about your farm and family. Our family farm is Stormdale Holsteins and Cattle Sales. We milk 70-80 cows. The majority are fresh Holsteins heifers; the others are registered Holsteins and Jerseys. We operate a cattle sales business, where we sell fresh Holstein 2-yearolds to dairies for replacements. I also have my own show pig operation, consisting of seven sows, purebred breeds and crossbreeds. I sell piglets to local 4-H and FFA members for show projects at local and state level fairs.

What is your role in the chapter? I am serving as the chapter president. I oversee the organization, run meetings, serve on committees and participate in many contests, conferences and activities.

What FFA contests do you compete in? I compete in the dairy and livestock evaluation Career Development Events. I also compete in the employment skills Leadership Development Event.

grade students to my farm and the school farm to learn about FFA and agriculture. We tour the farm, and other FFA members bring their projects to talk about. The entire event is put on by our members.

How has FFA shaped you as a person? FFA has made me the leader I am today. As president, I am asked to speak in front of large groups, explain events and activities, and conduct business meetings. My communication and organizational skills are constantly evolving. I also served as vice president and sentinel and have gained many leadership skills to get me to where I am today. Through FFA, I have also gained a better understanding of agriculture and how diversied it is. FFA has given me connections and friendships throughout the nation.

What are your duties on the farm? I help with the daily chores, including milking, feeding calves and heifers, cleaning lots, bedding and feeding. I also buy replacement heifers at local sales and assist with recordkeeping and sales.

I’m solely responsible for the care of my pigs.

What are your future plans? Next fall, I plan to attend a technical college to study agriculture business and animal science. After graduation, I want to return to the family farm and continue a livestock dealer business in addition to building my pig operation.

MDA accepting applications for Beginning Farmer Tax Credit The Minnesota Department of Agriculture’s Rural Finance Authority is accepting applications for the Beginning Farmer Tax Credit, an annual program available to landlords and sellers (asset owners) who rent or sell farmland, equipment, livestock, and other agricultural assets to beginning farmers.

Total funding available for the Beginning Farmer Tax Credit program is $4 million. The credits are funded in a rst-come, rst-served manner, so applicants are encouraged to apply early in the year before the stated deadlines. Both the asset owners and beginning farmers must submit applications with lease and/or sale documents to be eligible for funding and to hold their place in line. They may apply before sales close, if needed.

Qualifying asset owners can include individuals, trusts or qualied passthrough entities renting or selling land, livestock, facilities, buildings or machinery used for farming in Minnesota to a beginning farmer. Through changes made to the program during the 2023 legislative session, parents, grandparents and siblings are now eligible for the tax credit if they sell farmland to a direct family member.

However, this does not apply to leases or non-land sales (e.g., livestock, vehicles).

A beginning farmer is dened as a Minnesota resident with the desire to start farming or who began farming within the past 10 years. They must provide positive projected earnings statements, have a net worth less than $979,000 and enroll in, or have completed, an approved farm business management program.

— Indicate involvement in the Jersey breed by personal activities and involvement in state and national organizations (i.e. Minnesota Jersey Cattle Association, 4-H, FFA, etc.)

— Demonstrate an active knowledge of the Jersey breed and the dairy industry.

— Be in attendance and represent the Minnesota Jersey Cattle Association at several functions.

Minnesota Milk recognizes Rugg for service to 4-H, dairy community Although 4-H was an important part of Bradley Rugg’s life from an early age, it wasn’t until a couple of years after college graduation that his specic love for the dairy community came into clear focus: major events, young people and animals.

Decades later, having left an indelible mark on all three, Rugg has been recognized by the Minnesota Milk Producers Association for his leadership and community involvement.

The association will formally recognize Rugg with the Bruce Cottington Friend of Dairy award during its annual meeting in March.
