Dana Point Man Killed in April 8 Car Crash at Selva and Golden Lantern Identified THE LATEST: A Dana Point man died shortly before 3 p.m. on April 8 when his Chrysler PT Cruiser was hit broadside by a Cadillac Escalade in Dana Point, authorities said.

The deceased has been identified by the Orange County Coroner’s office as Thomas Raith, 69, of Dana Point.

According to Lt. Russ Chilton, Dana Point chief of police, Raith was making a left turn onto Golden Lantern from Selva when the Escalade hit his vehicle on the driver’s side.

Raith was pronounced dead at the scene. The man driving the Cadillac was transported to the hospital and is believed not to have sustained serious injury.

Capo Unified to Host Career Fair Saturday THE LATEST: The Capistrano Unified School District is set to host its largest career fair of the year this Saturday, April 16, from 10 a.m. to 2 p.m. at the CUSD Education Center, located at 33122 Valle Road in San Juan Capistrano, according to a district press release.

Managers and supervisors from Capo Unified’s departments will be on-hand, recruiting potential employees for both teaching and non-teaching positions. Human resources personnel will also be available for questions throughout the day.

Presentations by Tim Brooks and Rich Montgomery, executive directors of the district’s human resource services, will take place at 11 a.m. and 12:30 p.m.

Attendees who need assistance using a computer will be able to receive help from 9 a.m. to 3 p.m.

CUSD Selects Central Location for Mandarin Program, Pleasing South County Parents THE LATEST: South Orange County parents with children in the Capistrano Unified School District’s Mandarin Immersion Program can look forward to shorter commutes at the middle school level thanks to a 5-2 vote by the board of trustees Wednesday night to approve the program’s pathway from Marian Bergeson Elementary School to Niguel Hills Middle School in Laguna Niguel. The primary alternative considered was matriculation from Bergeson to Fred Newhart Middle School in Mission Viejo.

Currently, CUSD’s Mandarin Immersion Program, or MIP, has two classrooms per grade level, kindergarten through third grade, and one classroom of 32 students in fourth grade at Marian Bergeson Elementary School in Laguna Niguel. Beginning in kindergarten, instructors teach MIP students in 80 percent Mandarin and 20 percent English, transitioning to a 50-50 model for third through fifth grade.

By 2020, CUSD estimates that 145 middle school students will be enrolled in MIP. Wednesday marked the fifth and final reading of the amendments to CUSD’s language immersion and international baccalaureate admissions, including updates to the recommended matriculation pathway for MIP. Based on previous feedback from trustees, staff’s recommendation was for MIP to matriculate from Bergeson to Fred Newhart Middle School to Capistrano Valley High School.

That recommendation did not settle well with MIP families who reside in south Orange County cities such as San Clemente, Dana Point and Capistrano Beach.

According to a CUSD survey, south county families account for about 20 percent of MIP enrollment, while 46 percent of students live in Laguna Niguel and Aliso communities.

Backed by a petition with more than 50 signatures, eight south county parents addressed the board Wednesday asking that Niguel Hills be selected to harbor the middle school level of the program, as it would be a much faster commute and more centrally located, especially for parents with kids at multiple schools. Parents spoke mainly about having equal and fair access, stressing that they would not be able to manage the commute to Mission Viejo and would have to leave the program in Newhart were selected.

would be Niguel Hills. A few trustees countered that Niguel Hills currently does not have the capacity to support the influx of students, and renovating classrooms there would take funding away from maintenance for other district facilities.

Alpay offered a motion, seconded by Trustee Jim Reardon, to adopt the staff recommendation with the exception of changing the MIP middle school from Newhart to Niguel Hills.

Reardon, who was initially neutral on the matter, said even though it seems like Newhart would be a minimal increase in distance, traffic in the area during commute hours lengthens the drive considerably.

“I think there’s been a compelling case made here that we’re disrespecting San Clemente and Dana Point,” Reardon said.

“I drive these roads every day; I know how long it takes just to get to La Paz on the freeway from San Juan Capistrano. I wouldn’t want to do it from San Clemente.”

Superintendent to Hold Forum on Facility Needs, Funding THE LATEST: Superintendent Kirsten Vital of the Capistrano Unified School District is set to host a third “Superintendent’s Forum” on Monday, April 25 at 7 p.m. in San Clemente, according to a district press release.

Vital will discuss the district’s successes and achievements, while also addressing the current state of Capo Unified’s classrooms and facilities and the need to plan for the future.

“For more than 50 years, CUSD has provided a safe, nurturing learning environment that fosters excellence and creativity for the future leaders of Orange County and beyond,” the release stated. “In preparation for the future, the district wants to engage the community on current and future facilities needs and funding.”

Court Orders Measure I Rebuttal Changes

Judge rules in favor of group opposing Measure H authors’ language in Measure I rebuttal ballot statement

group asking for a court order to change or remove statements made by Town Center Initiative (Measure H) authors in their rebuttal arguments of the city’s competing measure (Measure I) it felt were false or misleading, prevailed Wednesday. The judge ordered two of four statements stricken and two others re-worded.

On April 6, petitioners Robert Theel, Patricia Short, Mike Powers and Harold Kaufman filed a request for a temporary restraining order and/or writ of mandate to stop the rebuttal statements from appearing, as written, on the ballot for the upcoming June 7 election.

Theel, Short, Powers and Kaufman alleged the following statements—by Measure I rebuttal authors Lester Hill, Debra Lewis, Sandie Iverson, Betty Hill and Roxanna Watrous—are false and/or misleading and should therefore not be allowed on the ballot: • Measure I “Eliminates voter approval for changes to the Town Center Plan; Council can continue to change the Plan at will” • Measure I “Expects taxpayers to pay for an irresponsible parking plan; no debt was incurred for Town Center improvement but City reserves were depleted by spending $20 million of taxpayer money” • The use of quotation marks around the phrase “Impartial Analysis” as follows, implying that the analysis was not impartial: “The ‘Impartial Analysis’ was written by the city’s attorney.”

Orange County Superior Court Judge Robert J. Moss ruled in favor of the Measure H opponents. He ordered the “ironically … impartial analysis” comments be stricken, saying he found “nothing ‘ironic’ about this and the only purpose of including the language is to imply that there is something underhanded going on instead of merely complying with a statutory mandate. It is misleading.”

Judge Moss, in his tentative ruling, ordered the language, “Expects taxpayers to pay for an irresponsible parking plan: no debt was incurred to Town Center improvements but City reserves were depleted by spending $20 million of taxpayer money” to be replaced with, “Expects taxpayers to pay for an irresponsible parking plan: no debt was incurred for Town Center Improvements.” But upon further discussion and testimony, instead changed it to “… but City spent approximately $20 million of taxpayer money.”

Following the judge’s ruling, Betty Hill said the campaign to pass Measure H, as a grassroots effort with limited resources and the “power of the city in adopting Measure I, along with the resources of the developers and special interests” pose significant obstacles to its passage, however “we are confident that voters will support Measure H when the facts are known.”

“We wrote the rebuttal arguments to present facts that we felt would be important to Dana Point voters,” Hill added. “We felt voters should be aware that even if Measure H passes, Measure I will cancel Measure H and its requirement for voter approval of Town Center Plan changes if Measure I passes with more votes; that the city attorney wrote the impartial analysis for both measures; and that the city spent about $20 million on Town Center.”

According to Mike Killebrew, assistant city attorney, the city agrees with the petitioners’ (Theel, Short, Powers and Kaufman) assertion that the statement, “City reserves were depleted by spending $20 million of taxpayer money” is misleading.

The project, Killebrew said, was funded with $15.7 million from an unassigned fund balance (not reserves) and $2.5 million came from a capital improvement reserves fund, with direction from City Council to replace it as soon as possible.

The $2.5 million was paid back before the project was complete, he said.

Killebrew also said the city did not touch emergency reserves or cash flow reserves—two of the city’s three reserves accounts and rejected assertions being made by Measure H proponents alleging the project resulted in reserve accounts being lower than ever.

“Our fund balance is healthy and we are financially on solid ground,” Killebrew said. “National rating agencies consider healthy reserves to be 16.7 percent of annual revenues or expenditures; we have 35 percent. I think it’s irresponsible to sit on a pile of money we have collected from taxpayers and do nothing with it. In my

opinion it would be irresponsible not to spend it. We can debate on what to spend it on, but that’s why we have public meetings with City Council to debate and vote on these issues.”

HISTORY In March 2013 a group dubbed the Dana Point Residents for Responsible Development (DPRRD) begin collecting petition signatures for the Town Center Initiative (Measure H), feeling it necessary to allow a public vote to correct actions taken by the City Council it felt ran contrary to the Town Center/Lantern District Plan and favored developers over citizens’ wishes.

The Town Center Initiative was certified by council in December 2015 and set for inclusion in the June 7 election.

In January, City Council began exploring the idea of crafting a competing measure to appear on the June 7 ballot.

Councilman Joe Muller and City Manager Doug Chotkevys cited incidences of citizens expressing dismay at having been either confused or misled when asked to sign the Town Center Initiative petition.

The city contracted with Keyser Marston and Associates for completion of an impact report study of the Town Center Initiative.

The study results showed the initiative would be economically stifling of the Town Center Plan and in February council voted 3-2, with Councilmen Carlos Olvera and Scott Schoeffel dissenting, to draft a competing measure for (Measure I) to appear on the ballot.

Along with the full texts of Measure H and Measure I, rebuttals from both sides, reflecting the changes made as a result of this recent ruling, will appear on the June 7 ballot. DP

Dana Point Forges a Middle Path for Beach Access at Strand Beach

S

trand Beach is one of the many jewels in Dana Point’s crown. Formerly a private beach, it was required to be made public several years ago as part of the city’s approval of the Headlands development east of the beach. There are now four footpaths to this newly dedicated public beach, as well as a “funicular” near the north end of the beach, which provides a free tram ride from the parking lot above down the steep slope to the beach.

Since Strand Beach was made public, it has constantly had open, public access from the north as well as the south end of the beach. The issue of controversy was the ability for the public to access the beach during nighttime hours through the middle of the private property at the Headlands.

In the interest of balance, your Dana Point City Council has forged both a literal as well as figurative middle path to provide additional public access to the beach, while protecting public safety and private property rights. We have worked hard over the past seven months collaborating with Coastal Commission staff, and have reached a legal settlement that allows the public access to the beach through the middle of the private property at the Headlands from 5 a.m. to 10 p.m., seven days

It is ironic that the city of Dana Point is our biggest contributor of litter. Thousands of ads and other unwanted materials, allowed by the city, are deposited on private property weekly.

It is unsightly and causes a lot of pick up effort. Shame on Dana Point; there are a lot of more thoughtful cities that do not allow it.

All of my past efforts to get a response from the city on this matter have produced zero interest and I expect the same from this rant.

a week. We believe this compromise accommodates the concerns of all interested parties by keeping safety a top priority by closing the path through the private property from 10 p.m. to 5 a.m., while at the same time ensuring the public continues to always have access to the beach.

But we didn’t stop there. The city’s agreement also provides trail improvements and natural habitat restoration along the trails for the public to enjoy. The city will also work with the Ocean Institute to proJohn Tomlinson vide greater opportunities for disadvantaged students from Title 1 schools to learn about the importance of marine habitat protection.

Once the revised hours of access are approved by the Coastal Commission, the city plans to install enhanced signage at several of the beach access points at the Headlands to notify the public of the new expanded hours.

As the city manager said last week, the Dana Point City Council is a fierce defender of private property rights. However, the law is clear that property near the coast must not infringe on the public’s right to access

I had no idea when I filed a public records request with the city of Dana Point to uncover the true costs behind Council’s ill-fated decision to sue the California Coastal Commission and the Surfrider Foundation that I was opening up a can of worms. What we know so far is that the city has spent over $1 million on legal fees over the course of four lawsuits, essentially on behalf of Headlands, LLC, the developer of the luxury home development, Strand at Headlands. That figure may be low because the Council just added $520,000 in legal fees and litigation expenses to the city budget on March 15. Part of those expenses, $160,000 is budgeted to sue Headlands LLC for apparently refusing to reimburse the city for a significant portion of these legal expenses.

The city fronted taxpayer funds, and now those funds may not be reimbursed. I have submitted further records’ requests to get

our coastline. The city feels strongly that our settlement agreement with the Coastal Commission upholds both the rights of the public to access the beach as well as the rights of private property owners.

President Ronald Reagan had a sign in his office that read, “There is no limit to what you can accomplish if you don’t care who gets the credit.” The city has put forth an olive branch to the Coastal Commission and environmental groups, to resolve this long-standing conflict. We ask these groups as well as Dana Point residents and visitors to communally join us in celebrating this plan that was agreed upon in a collaborative process. We hope the Coastal Commissioners will support this agreement reached between our city and their staff. If approved, it will provide all Californians with even greater public access to the previously private Strand Beach as well as other enhancements that will further protect the natural habitat in the area and educate the next generation to value the protection of this amazing coastal resource. City Attorney Patrick Munoz, from Rutan and Tucker of Newport Beach, has now used city staff resources, time, energy and significant taxpayer dollars, to defend a wealthy developer. Part of the Superior Court’s judgment referred to the council’s urgency ordinance—an attempt, with police and council cooperation, to insist that the luxury area was so dangerous that gates were absolutely essential.

The judge found this ordinance egregious and referred to it as “a pretext for avoiding coastal program obligations.”

This week we learned the city has finally settled the six-year series of lawsuits and will be paying $300,000 of taxpayer funds in mitigation damages, a penalty for blocking public access to Strands beach. After these fines are paid, the city (and this means taxpayers) will likely still be on the hook for the prevailing parties’ legal fees, which could be in the high six figures, judging from what the losing side has paid.

SOAPBOX agreed settlement terms, including two new trails, bike racks, benches, signage, gate modifications and a mobile application program to inform beach goers of access hours. A further requirement is that the infamous urgency ordinance be canceled.

So far, the city and tax payers have been punished for a lengthy law suit where the judge stated the city acted “arbitrarily and capriciously.” What accountability can be expected from the city manager, city attorney (both of whom have been in these influential positions for more than a decade), and the City Council members who presided over this travesty since 2010?

This is the same city government that is now bringing us Measure I—their own ballot measure designed to confuse voters and interfere with Measure H, duly balloted after 4,200 residents signed the 2015 Town Center Initiative. The same folks who insisted on litigating to get their way on the Strandsgate controversy now think it’s OK to bully their way into the voting process, presenting a competing initiative to put ordinary citizens in their place.

Please tell them you reject this scheme by voting “yes” on citizens’ initiative H and “no” on council initiative I. EDITOR’S NOTE: A public records request by the DP Times in March found documen-

tation showing the total Strand gates-related legal fees billed to the city by Rutan and Tucker at just over $947,100.

At the Movies: ‘Everybody Wants Some!’ Nostalgia

ichard Linklater’s first film since his 12-year-long, coming-of-age epic Boyhood (2014), is a silly, college sex comedy called Everybody Wants Some! The posters and trailers have been advertising the film as a “spiritual sequel” to Linklater’s 1993 teen dramedy Dazed and Confused, but in reality it might have more of a familiarity to a film along the lines of American Pie 2 (2001). Sometimes a silly sex comedy just wants to be a silly sex comedy, and there’s nothing wrong with that.

For the first week of orientation, Jake and his new friends get to know each other on campus, on the field, in town and at parties. A

s it drew closer, the kids started counting down the days until spring break. No homework. No school. No problem. I envisioned sitting poolside, working on my tan, while the kids swam for hours. There would be no rushing around since most of the afterschool activities were cancelled that week.

It began with a bang. We threw my daughter’s surprise birthday party on the last day of school. Giggling, screeching girls filled our home until late that night. I’m still sweeping up strands of fuchsia clip-on hair extensions and hot pink glitter.

After a day trip to the La Brea Tar Pits with friends, spring break stagnated. Our normally FOUR KIDS bustling cul-de-sac was AND A DOG eerily quiet. Many

I decided we’d make our own fun. I’d take the kids to San Diego for a quick overnight getaway while my husband worked.

After pulling an all-nighter to ensure nobody had to go naked, wear underpants inside out or take a dirty laundry dive, we were off to find our FUN spring break.

By the time we arrived in SD, everyone was ranting and raving about how starving they were. Driving our oversized SUV full of crabby kids in a crowded metropolitan area full of one way only signs proved difficult.

Finally, we found a suitable watering hole.

While impatiently awaiting our food, kids visited the restroom in shifts. Shift No. 1 returned to the table sprinkled in

water and reported that the toilet had shot water at them. I somehow managed to convince them we didn’t need to leave immediately to shower and change clothes, and a family friendly explanation of what and how a bidet is used followed. The hole-inthe-wall Mediterranean fare was delicious and plentiful. One of the kids finding a small black spider meandering through his yellow rice? Not so much. Our lunch came to an abrupt halt and we hightailed it out of there, feeling a bit queasy.

We checked into the hotel, and the kids rejoiced in jumping on the freshly made beds, watching television, waving to passersby below from the balcony, drawing on the notepads, playing “hotel” on the unplugged room phone and making coffee ... just because.

Sunshine hid behind a thick gray blanket of clouds as we ventured out for dinner. The bickering returned and after threatening to ship each of the complaining offspring back to the room, we returned. Together. We warmed up in our jammies, and just as we were settling in for the night ... FIRE ALARM! Through the deafening, relentless siren, I barked at the kids to find their shoes.

The girls immediately began sobbing and dashed around the room gathering belongs they didn’t want to burn. Seeing their sisters fall apart, the boys’ tears began flowing. I tried shouting over the horrendous racket that it was probably a false alarm. My voice went unheard.

And then as quickly as the chaos ensued, it ended. We got word that indeed it had been a false alarm. Nevertheless, all kids were thoroughly rattled and begged to return home. Nope. We were going to stay and have fun, darn it.

So, we talked about what had happened.

“Mommy said the F word,” one kid offered in a hushed and questioning voice. Oh. That. I did recall some forbidden word escaping my lips when it all began. Shoot.

“Well, mommies make mistakes too,” I replied. The whole trip seemed like one giant mistake at that point.

The next morning was rainy and cold.

Really? It certainly hadn’t been what I’d envisioned.

Dana Point Grand Prix Adds Events for 10th Installment DANA POINT TIMES

he Dana Point Grand Prix of Cycling will have a slightly newer look to it in 2016.

The prestigious cycling race is set to host top criterium talents as well as amateurs in the Lantern District of Dana Point April 30 to May 1.

day, April 30 will kick off with the Killer Cove 5K Challenge and 1K Family Fun Run. Both events are new to the schedule this year.

The Killer Cove 5K Challenge will start things off at 8:30 a.m. and will send participants on a scenic route through town. The race is set to start in the Lantern District, then loop runners down into the Dana Point Harbor. On the way back from the Harbor, runners will have to go up Cove Road, which features an 18 percent grade for a quarter of a mile.

Online registration for the Killer Cove 5K Challenge is now open. Early registration cost is $35 and late registration is $40.

The 1K Family Fun Run/Walk will begin a 10 a.m. Early registration for the 1K is open and the cost is $10.

Another new addition to Saturday’s list of events will be the Light-Up the Lantern Parade of Lights. Attendees are encouraged to bring their bicycles and deck them out in lights for an 8 p.m. ride down Del

Volleyball Breaks Through For First League Win The Dana Hills boys volleyball team swept Laguna Hills in three sets on April 12 to pick up its first South Coast League victory of the season.

The Dolphins (17-8, 1-3 league) entered the match on a two-game losing skid.

Dana Hills was scheduled to play Tesoro on April 14. Results were not available at press time. Tesoro entered the match in a tie for first place in league.

Tritons Edge Dolphins Golf in Pivotal Match The San Clemente boys golf team pulled off a crucial win over Dana Hills on April 11 thanks to its sixth man on the roster.

The Tritons and Dolphins were all square 192-192 after a go around on the front nine at Bella Collina Golf Club, prompting a sixth man scorecard tiebreaker. The Tritons sixth man had the lower score and San Clemente was awarded the win.

The win pulled the Tritons even with the Dolphins at the top of the South Coast League standings, and the two will likely share the league title.

Dana Hills continued its solid play with a 191-240 league victory over El Toro at El Niguel Country Club on April 13.

Dana Hills was set to play against the Chargers on April 14. Results were not available at press time.

Softball Falls to Diablos in Extra Innings The Dana Hills softball team came awfully close to pulling off a major upset in its South Coast League opener against Mission Viejo on April 12. The Dolphins pushed the top-ranked Diablos to the brink and forced extra innings, but Mission Viejo was able to score a walk-off run in the eighth inning to seal a 3-2 win.

The Dolphins outhit the Diablos 7-6 in the contest and tied the game up at 2-2 by scoring two runs in the sixth inning.

Dana Hills had a long layoff due to a spring break and had not played a game since March 31.

Dana Hills was scheduled to host Mira Mesa in a nonleague game on April 14. Results were not available at press time. The Dolphins (10-9, 0-1) will host Aliso Niguel in a league game on April 19.

Crouse Dominant in No-Hitter Against Tesoro

T

he pitch was perfect. The timing could not have been better.

Dana Hills junior pitcher Hans Crouse had not allowed a hit through 6 2/3 innings against South Coast League rival Tesoro on April 12. His fastball had been electric all day, but his offspeed pitches had been downright dominant.

Facing Tesoro’s Jake Morenc, Crouse jumped out to a quick two-strike advantage. One more pitch would guarantee Crouse’s place in the Dolphins’ record books. He reared back and threw a tight, spiraling offspeed pitch that clipped the outside corner of the plate for a called third strike.

The Dolphins’ players sprinted to the mound to celebrate with Crouse, who had completed the no-hit effort and secured a 5-0 win.

Crouse had 13 strikeouts in the win and allowed one walk, which came in the first inning.

“It’s just crazy,” Crouse said. “I’m just really happy and proud of my teammates and proud of the way I pitched out there.”

After issuing the walk in the first inning, Crouse fell into a groove. The junior rattled off a streak of six straight strikeouts after issuing the free pass to Tesoro’s Brett Auerbach in the opening frame. Five of the strikeouts over the stretch came on called third strikes.

Crouse said he got in a zone following the first-inning walk, but his catcher, senior David Clawson, noticed something click even sooner.

“On the first pitch he had everything going,” Clawson said. “His fastball was probably 94 to 95 mph. His curve was dominant; his changeup was bending away—it was great. He had everything working for him. He was unbelievable today.”

As the Dolphins’ offense started to build a comfortable lead late in the game, Crouse noticed his team staying out of his way when he was in the dugout. The Dolphins’ players eventually stopped talking

to him altogether, a baseball superstition designed to let the pitcher focus solely on his thoughts.

“Once they started not talking to me I knew something was up,” Crouse said. “I saw the zero in the hit column, and a lot of thoughts started going through my mind.

It was nerve-racking out there those last two innings.”

The Dolphins’ (9-8, 3-2 league) defense helped ensure Crouse’s effort would not be wasted.

In the top of the fourth inning, Tesoro’s Spencer Heinsuis was robbed of a hit by center fielder Max Mircovich, who made a sliding catch to his left for the out.

In the fi fth, first baseman Joe DeBaca stretched wide to his right to corral a throw and plant his foot on the bag, negating what could have been an infield hit.

In the seventh, Dolphins’ shortstop Shawn Kany made a charging barehanded play on a slow roller for the first out.

“The play at short (in the seventh inning) was huge. I thought that was a for sure infield single,” Crouse said. “Mircovich, he’s just really athletic out in center field and made a great play.”

Dana Hills took a 1-0 advantage in the fourth inning on a DeBaca RBI single. In the fi fth, Jeremy Ciolek hit the first of two two-run doubles that pushed the lead to 3-0. Ciolek went 3 for 4 with four RBI and padded the lead with his second two-run hit in the sixth inning, giving Crouse some breathing room.

As it would turn out, Crouse would not need the extra run support. His pitches in the seventh and final inning were sharp and, like they had been all game, unhittable. DP www.danapointtimes.com

he seventh annual Mickey Munoz Mongoose Cup stand-up paddleboard event and expo took place at Baby Beach in the Dana Point Harbor on April 9.

Despite some stormy weather, dozens of local SUP enthusiasts, from beginners to professionals, flocked to the beach to join surfing legend and paddle sports enthusiast Munoz, 78, for camaraderie, competition and compassion.

“We had a solid event and a great turnout, despite the inclement weather,” said event coordinator Barrett Tester. “It shows what a strong paddling community we have here in Dana Point and San Clemente, and south Orange County in general. People are very enthusiastic about the sport and really wanted to come out to support the cause. It was a really great time.”

The event raised funds for the Sport of Kings Foundation, an all-volunteer nonprofit that helps those in the surfboard manufacturing industry in California by “continu-

Surfing in the highly competitive WSA Boys U12 division, these San Clementebased athletes advanced out of Round 1 with second-place finishes in their respective heats. After some great surfing by both of them, Ben’s campaign came to an end in the quarterfinals and Bane ended up taking third in the division.
