Five things Dana Point should know this week Headlands Developer Files Counter Lawsuit against City THE LATEST: Headlands Reserve, LLC filed a counter lawsuit against the city on Monday stating the city has “fraudulently billed” the developer more than $600,000.

Sanford Edward, developer of the Headlands, said the city overbilled the Reserve $667,661.60 since the first invoice in 2003 after the developer and the city agreed to a development agreement.

In August, the city filed a lawsuit against the Reserve and Edward stating an indemnity agreement was not upheld.

According to the counter lawsuit, the development agreement had a very specific—and limited—indemnity provision.

“Which only applied under two circumstances: when there was a direct legal challenge to the project permits, or if a death or injury occurred during project construction,” the lawsuit stated.

Edward said the agreement also allowed for the Reserve to select legal counsel and a specific control establishing when the city attorney would be involved.

The third thing the agreement did, the lawsuit said, was create a negotiation between the Reserve and the city, which would cap the hourly rate that the city could bill when seeking reimbursement for city legal fees at the city’s standard municipal litigation rate.

Edward said the alleged outstanding legal fees the city claims falls within the indemnification include the creation of a nuisance ordinance that established the operational hours and maintenance provisions for public beach access paths and a settlement agreement that the city separately negotiated with the California Coastal Commission related to the fines incurred after the ordinance was implemented.

The lawsuit said the activities were unrelated to the project permits and did not involve Headlands in any of the legal proceedings or settlement negotiations.

WHAT’S NEXT: “The litigation is senseless; this is the type of issue that should be mediated, but the city has left us no choice,” Edward said in a statement. “We will vigorously pursue this case to its conclusion unless, and until, the Council gets some common sense.”

Homeless Task Force Receives Recommendations THE LATEST: Members of the Homeless Task Force were given three recommendations that would provide housing for more than 40 individuals in the city.

The city has been working with Mercy House, an organization that provides housing and comprehensive supportive services for a variety of homeless populations, to conduct a by-name list that provides data on Dana Point’s homeless population.

Larry Haynes, executive director of the Mercy House, told the task force there are as many as 43 homeless people sleeping in the city as of Sept. 1.

City Council Candidates File Campaign Finances THE LATEST: City Council candidates filed the first round of campaign fundraising and expense reports.

Debra Lewis, as of Sept. 24, has raised the most money, according to the campaign funding reports.

The candidates are listed in the order they will appear on the ballot.

Nadia Khalil filed a Form 470, which states she will not spend or receive more than $2,000, so she did not have any other campaign statements to file.

Paul Wyatt has received $2,275 in contributions from six contributors including himself, Garry Nelson, Toni Nelson, Jesse J. Sowell, Susan W. Hinman and Cynthia Fleming.

Wyatt’s expenditures total to $1,410.94 and include payments to Campaign L.A. for yard signs, Denise Erkeneff for campaign consulting and Smart Level Media for campaign literature and mailings.

Maynard’s expenditures total $230 to Awards ‘N More, The T Shirt Cannery and the Registrar of Voters for campaign paraphernalia; UPS, Staples and Office Depot for office expenses; Vista Print for campaign literature and mailings; city of Dana Point for City Council video; and Task Rabbit for graphics.

the Multi-County Housing PAC in a total of $710. Brough also received a personal loan of $100 to her campaign, and $300 of nonmonetary contributions from Pacific Political, Inc. Her accrued expenses total $3,154, including unpaid bills to Campaign Compliance Group, Pacific Political, Inc. and Kwik Kopy Printing for campaign literature and mailings.

Organizations to Hold City Council Candidate Forums This Month THE LATEST: As Nov. 8 draws close, various organizations throughout the city will hold City Council candidate forums to help voters make their choices.

On Tuesday, Oct. 11, Capo Cares will hold their candidate forum at Capo Beach Church. All five candidates will be present to answer questions posed by Dana Point residents.

Wayne Rayfield, South Coast Water District president, will moderate.

All are welcome to attend the event.

On Wednesday, Oct. 12, the Dana Point Chamber of Commerce along with the League of Women Voters will hold a City Council candidate forum.

Art Walk, Fine Arts Show Planned for City THE LATEST: To celebrate arts and humanities this month, an art walk and a fine arts show are planned for Oct. 10 and 11.

The Dana Point Fine Arts Association will be holding the art show Saturday, Oct. 15 to Sunday, Oct. 16 in the Dana Point Harbor from 9:30 a.m.-5 p.m.

A slice of Germany is making its way to Dana Point for the annual Dana Point Oktoberfest presented by Spaten Munchen.

Stop by Sea Terrace Park on Oct. 15 to celebrate authentic German festivities, beers and food. The opening ceremony and traditional tapping of the keg starts at noon, followed by a day of competitions such as the sausage toss, musical chairs and beer chugging. Classic German music and dance parties will be held throughout the duration of the event, which concludes at 7 p.m. when the ceremonial keg is tucked in for the night. An assortment of

On Thursday, Oct. 13, Club 19 at the Monarch Beach Golf Links will celebrate Oktoberfest with golf, German music, craft beer and Bavarian-style food. Golf begins at 12:30 p.m., and the festival begins at 5:30 p.m. Get it all for $245, or just go to the festival for $99.

The fourth annual San Clemente Oktoberfest will kick off on Oct. 22 at the Vista Hermosa Sports Park Fairgrounds.

Festivities start at noon with competitions and games such as keg bowling, beer stein holding, das brat toss and a wiener dog costume contest. Local craft beers will be served for $10 and will include Pizza Port Brewing, Left Coast Brewing, Artifex, Laguna Beach Beer Company, Lost Wind and Legacy Brewing. Entertainment will begin with the Express Band, a classic Bavarian oompah band, and the night will close out with The Aggrolites, a reggae fusion band. Other performers include Tunnel Vision, Common Sense and Vinnie and the Hooligans. Several food trucks will be parked and serving food throughout the day. City Council Candidates Talk about Affordable Living

ith one month to go before Dana Point residents head to their polling stations to cast their votes for two new City Council members, the Dana Point Times sat down with each of the five candidates and asked them the same five questions.

In this week’s issue, we’re featuring the candidates’ answers to the question, “Would you push for future development to reserve a portion of units for affordable housing, on top of the state’s mandates?”

Many feel like Dana Point is unaffordable for middle-income families and young people, in particular. We asked the candidates if they generally agreed with this perception and if the city has any role in carving out housing options outside of the state’s low-income mandates.

The candidates’ responses are in the order in which their names will appear on the ballot.

NADIA KHALIL Travel Agent

Khalil said she would not push for additional affordable housing mandates in the city.

“I would think they would have to adhere to the state’s laws, and I think the laws clearly state within some square footage of development, then there will be affordable housing,” Khalil said. “Not everyone can afford to live here, and everybody else shouldn’t be punished because of it.”

She added she believes affordable housing will be an issue with the recent approval of short-term rentals.

“It’s going to cause real estate to either cause a dive or a hike, but it’s going to be in the wrong direction,” Khalil said.

“When I listen to people state the fact that they have to go into short-term rentals because they can’t afford their mortgage, and the stories of ‘I was single, my husband left me,’… I think that’s an excuse to turn the neighborhoods into hotels,” she said.

Khalil said she’s a single mom and has four children and has been in a situation to which many people can relate.

“But I knew what to do responsibly,” Khalil said. “We sorely missed that lesson to not only giving it to our youth, but also people that come in and are crying poor in order for new laws and regulations to be passed for them. You need to learn how to be responsible like all individuals do.”

Wyatt said there needs to be a bigger population of younger people in the city, and that more affordable housing could help encourage that.

“To make it vibrant, you need people in their 20s and 30s to come in there, it needs to happen to make it possible to live here,” Wyatt said. “I don’t think Dana Point does anything at the moment to deal with that.

When I looked at current projects, like Majestic or Zephyr, there were no carved out affordable units in any of those, which is a bit disturbing.”

Wyatt said that ten percent of those projects, or in any new development, should be carved out for affordable housing rates.

“And then you want to use the state’s mandates to increase density and some of the breaks you get from the state,” Wyatt said. “If Dana Point simply carved out ten percent and then had five percent (more), you’d have 10-15 percent affordable housing; it would make a big difference in what could be done in the area.”

He said the projects will bring in a good profit, and the developers should still be able to make a profit while making affordable units available.

“If you look at the townhouses they’re building in Zephyr, it’s a beautiful area, but those townhouses are valuable and the money they’re going to bring is valuable,” Wyatt said. “You could carve out some affordable housing out of there and still make money on that project.”

Wyatt added he believes short-term rentals will hurt the affordable housing market.

Lewis said she was not all that informed on the affordable housing subject in the city, but she said she would need to look at the area’s mandates and “see where Dana Point is” before commenting definitively on any need for more affordable housing. “(I would need to see:) could we do more? And if so, how?” Lewis said. “What is the way to do it? And, the people support it, it’s another hot button, if you don’t have people coming along with you, you’re going to have angry people.”

Lewis said it would be something she would consider and ask specific questions about.

“So that’s something I would look at and say where are we, where is our affordable housing?” Lewis said. “Do we have enough for the state mandate, and if not, how are we going to correct it? If we do [have enough], is there something we can do more? Because we do have homeless people, we have a problem that we as a country, state, have not addressed, and it’s getting worse and worse.”

She agreed with Wyatt that the city needs more young people.

“I think Dana Point could use an influx of younger people. We are a pretty old demographic, and if we’re going to be a vital city, then you need a diverse population, so that may be a good way to do it,” Lewis said.

When asked if she would push for more mandates on affordable housing if elected, Maynard said she believes the city is “pretty much built out.”

“So, there’s not a lot of opportunity for that,” Maynard said. “To be honest, I know the city has worked on it, and is obviously aware; it’s been 10 years or something that they wanted this.”

Maynard said she would need to look into affordable housing before sharing a definitive plan.

“That’s a question I would probably have to look into more detail when I’m in that position to make that decision or take a position on it,” Maynard said. “I realize that there should be (a discussion on affordable housing). And I know the city is working on it, but I’m not up to speed on it, exactly what the status is now. Occasionally I’ll read something on it.”

When asked if Maynard thinks the city is affordable for middle class families or young people, Maynard said “it could be challenging for some.”

“I live in a community where houses start at a million dollars,” Maynard said, adding that the size of families and what homeowners are looking for in a home are key factors in determining if the city only has expensive homes, or has housing options, which might have fewer amenities, at a lower cost.

When asked if she would enforce more city mandates for affordable housing, Brough said she does not believe the city should be involved in such an enterprise.

“I’m a private property, private sector advocate, and I know in Virginia they’re doing some very creative things for affordable housing. But its employer-driven so hotels or whatnot, any business benefits from having their employees near them.

So, if that’s something they want to pursue, then I’d say a business is more than able to pursue it as long as it’s in the code and the law. They’re doing that in Virginia so there are cases out there.” Brough said.

She added that she believes that could be beneficial for employers, “especially with the big hotels,” but it would ultimately be up to those companies.

“I don’t think the city should enforce it, or add more (mandated affordable units),” Brough said.

When asked if Brough believes the city is affordable for middle-class families and younger people, she said “it’s tough.” “(My husband) and I are young, but we have two young children, and it’s a struggle for us,” Brough said. “It’s a choice of what you’re going to give up to live here.”

She added that some of the city’s ordinances, zoning codes and laws make “prices go up,” and it’s “a whole combination.”

“It is a struggle. You’re making a choice to live in an area that’s expensive, so what are you going to give up? You think about choices, life is about choices and that’s one of them,” Brough said. DP www.danapointtimes.com

Letters to the Editor CAREFUL WHAT YOU WISH FOR SUSANNE CHRISTENSEN, Dana Point

Current state: We have a short-term or vacation rental ordinance, which regulates short-term rentals (STRs) by controlling how many people, how many cars, length of stay, etc. The ordinance has been in effect for three years and was previously discussed widely in the community for several years.

On Sept. 6, our City Council voted to include this ordinance as part of the Coastal Plan, which is governed by the California Coastal Commission (CCC) for the area within the Coastal Zone. This vote followed many discussions with the CCC, who had certain requests—some accepted and some declined. A request from the city was that, where there is a conflict between the HOA rules in a community and the ordinance, the HOA rules would prevail. The CCC agreed with this change.

That is huge.

In Oxnard, for example, there’s an HOA within the Coastal Zone that refuses to allow vacation rentals. Two weeks ago, the CCC notified that HOA that it intends to take legal action.

Today, Beach Road, which those opposed to the ordinance cite as their poster child for why vacation rentals should be banned, can use their HOA powers to limit STRs, unlike the HOA in Oxnard. Is Beach Road really the issue then?

Future State: Those opposed to STRs want to repeal the ordinance and, supposedly, put the matter to a public vote. Many also asked the City Council on Sept. 6 to delay the vote until after the election in November. Could it be that they want a new composition on the City Council, so they can push through a different agenda altogether?

One scenario is practically a certainty; the CCC will not approve an ordinance that does not permit STRs in the coastal zone. And so costly litigation with the CCC begins...

Another scenario is highly likely. While it may be difficult now, with an ordinance in place, to regulate STRs with limited enforcement resources, imagine how difficult it will be with no law.

ing the rules despite the city’s well-lauded Municipal Code 5.38. The ordinance is toothless and serves to provide political cover for the City Council to continue to usher intrusive commercial enterprises into residential areas without notice to the neighbors.

At NBT, homeowners regularly report unpermitted STRs to Dana Point Code Enforcement. Little if any enforcement takes place because the businesses of Dana Point adore the dollars STRs generate. If the city can prove an illegal STR rental (note that vacationers have to be onsite and are not required to speak to an enforcement officer), the owner will be fined a maximum of $2,750 for four annual offenses—less than one week’s revenue (currently $3,000 to $5,000). Code Enforcement sometimes has a temporary effect, but the illegal STR activity always seems to recommence. The ordinance sounds aggressive but is worthless and without consequence.

Many suspect that STR owners have worked with the city and internet STR sites to lobby Council. Code Enforcement sent emails using city mail servers to STR owners advising them of the earlier Council meeting date to ensure they were well represented.

IN REGARDS TO “CITY LEARNED FROM MEASURE H” WILLIAM MATTHIES, Dana Point

Shilpa Bhimani's recent letter regarding short-term rentals asked questions about the situation on Beach Road. I will answer them.

The question was, "If there were supposedly 600 complaints on Beach Road, why does no one at the city have any record of it?"

The city has no record because they do not enforce their code, at least not on Beach Road. How do I know that? Code Enforcement Officer, an ironic title, Ted Harris, told me that our complaints regarding STRs should go to the police or be handled by our district security, not him.

In 2015, there were 624 calls to our security regarding STRs, as of July that year the total was 309. Year to date in July 2016, the number was 365, an 18 percent increase. Why are these numbers so high?

Approximately one out of every five of the 200 homes on Beach Road are available for short-term rental, whether they’re registered with the city or not. Over 40,000 STR vehicle entries/departures a year.

The numbers I quote are gathered by the district and are accurate. Complaints cover everything from noise, illegal fires and parking to theft, vandalism and even an alleged physical assault of an 87-yearold full-time resident by a much younger and very drunk short-term renter.

Property owners who either live in their house, renting out a portion, or live next

door, are responsible people who do not tolerate what the overwhelming majority of absentee owners allow. If the City Council had included a provision requiring onsite management, and most importantly, enforced their code, there wouldn't be well over 600 complaints about STRs on Beach Road.

By the time this letter appears, the referendum date to gather signatures will have passed. If it succeeds I hope we can revisit the STR issue, creating revised enforced code that satisfies both sides of the discussion. If it fails, the forces opposed to STRs, group homes and other related problems within the city, will shift their focus to bring about much needed, widespread change throughout all levels of Dana Point government.

Today I was walking my dogs before 8 a.m., and while crossing PCH at Ruby Lantern, I was within inches of being run over by a car turning left onto PCH. If I hadn't run, I would have been hit. This happens all the time; it's not the first incident.

One time I was crossing PCH at Blue Lantern Street and a car turning left from Blue Lantern onto PCH nearly hit me.

I reported both instances to the Police Department. While reporting the Blue Lantern incident, I was advised by them to go cross at Ruby Lantern. Well it's not any safer there! When will the city take heed of its pedestrians; it's a "ticking bomb.”

nternationally renowned harpist Julio Montero has been gracing San Juan Capistrano and much of Orange County with his world music for years. Montero has been playing the folk harp professionally for three decades now—a career which began in his home country of Spain and has now taken root in San Juan Capistrano.

For Montero, being a musician means truly loving what he does and connecting with the music.

“If you don’t love what you are doing, people cannot love what you do,” Montero said. “It’s like love. If you have love inside you, you can give it. If you don’t have it, you cannot transmit it.

“It’s the same thing with music. Being a true musician is not thinking primarily about making somebody else happy or money. It’s feeling that love—that happiness. After that, everything else comes.”

y now, we all know the Tim Burton formula. Gothic setting and costuming, misunderstood outcast, whimsical music score and at least a little bit of stop-motion or CGI. For over a decade, Johnny Depp and Helena Bonham Carter were his go-to leads, but his most recent release, Miss Peregrine’s Home for Peculiar Children, is his third film with neither. Instead, we have Burton’s second feature starring arthouse favorite Eva Green in this adaptation of Ransom Riggs’ popular novel. The film Dana Point Times October 7-13, 2016

could be viewed as Harry Potter meets the X-Men. Jake Portman (Asa Butterfield) witnesses his close grandfather, Abe (Terence Stamp), die right before him with a mysterious, supernatural figure looming over them. Later, Jake discovers a postcard from Abe’s old boarding home, and Jake and his dad (Chris O’Dowd) think visiting will help deal with Abe’s death. Only Jake discovers the boarding house is very alive in magical ownership by Miss Peregrine (Green), and include her youthful tenants: floating Emma Bloom (Ella Purnell),

creature inventor Enoch O’Connor (Finlay MacMillan) and flammable Olive Elephanta (Lauren McCrostie).

Like with Frankenweenie (2012) and Big Eyes (2014), the most refreshing thing about Miss Peregrine’s is seeing new faces work with Burton after having so much Depp and Carter in the past. Green naturally fits in with the filmmaker’s trademark aesthetic and direction. Some of the editing and continuity decisions in the film are a bit peculiar to say the least, but for those older kids who like traditional Burton or fantasy, this might do. DP

The Endless Summer

I

n writing history, you look for the forgotten or least-told tidbits, where some will say of it, ‘I didn’t know that,’ or, ‘Yeah, I was there.’ You assume some events or pictures that have become iconic would no longer be interesting. But OC Parks currently has an exhibit at the Old County Court House in Santa Ana on Bruce Brown. It included a showing of The Endless Summer at Salt Creek last month.

The interesting display presents an inside look at the career of Bruce Brown.

Bruce was born on December 1, 1937, in San Francisco, and grew up in Oakland. The family then moved to Long Beach, where, as a young teenager, he took to enjoying the water on a paddle board before graduating to a surf board shaped by Dale Velzy from his Manhattan Beach shop. Upon graduating high school, the Korean War was taking place and a decision had to be made.

Reading about a submarine base located in Hawaii, Bruce joined the Submarine Reserves after learning those in the top of their class in school were able to choose the submarine to serve on. Surfing in Hawaii was Bruce’s goal. He graduated at the top of his class and was able to pick his submarine, the USS Gudgeon (SS-567). He went to the shipyard in the morning, chipped paint and surfed in the afternoon. By tradition, newbies on board started out as mess cooks, working half day shifts for a month at a time. There went his surfing time.

The USS Gudgeon (SS-567) was a fairly new submarine; it launched in 1952 and was used for special secret operations.

That took him to the Bering Sea, where the Russians hung out, and under the ice pack, all on patrols lasting 90 days.

While in Hawaii, during his two-year stint, he hooked up with John Severson from San Clemente, who he already knew as a California surfer, and was stationed there with the Army. The two of them began to film surfing using his 8 mm home movie camera.

Bruce’s surfing films began in 1958 with Slippery When Wet (shown at Orange Coast College in spring of 1959 and for

which he received $50), then Surf Crazy, followed by Barefoot Adventure, Surfing Hollow Days, Water Logged and the iconic The Endless Summer in 1966. It was when he returned to San Clemente, as a life guard and working at night for Velzy, that Velzy got the idea Bruce could expand surfing if he upped his movie-making skills. So Dale bought him a 16 mm Bolex camera and IT’S HISTORY several telephoto lenses.

Inspired by a photo in the Orange County Register, Allen had photographer Bob Bagley with Brown, Robert August of Seal Beach and Mike Hynson of Laguna Beach—the two stars in the movie—take four photos of the three on the beach. Then graphic designer John Van Hamersveld, working for Severson at the time, created the 1964 surfing icon poster. Brown is in the foreground with the surfboard on his head.

The Endless Summer movie had been compared to Gone with the Wind for the surfing set. The 91-minute documentary set attendance records in spots where some didn’t even know what surfing meant. The success was measured by other movies when in Wichita, Kansas, where Bruce rented a theater by providing a financial guarantee first. For a two-week period, the film out-grossed the theater’s two previous showings, The Great Race and My Fair Lady.

Dana Hills, Monarch Beach Resort Begin New Learning Program

A

new program coordinated by a Dana Point resort and Dana Hills High School is allowing students to getting hands-on learning experience in the hospitality industry.

Twice a week, students from Dana Hills High School leave campus and head across town for a different kind of learning. A new program was created this year that partners with Monarch Beach Resort to allow students to learn about different aspects of the hotel industry.

The students spend time with different department leaders of Monarch Beach Resort to see what it takes to work in the hotel business. On Tuesdays, the students enter a classroom at the hotel and learn about a specific department.

“Leaders from different disciplines will speak for the first 15 to 20 minutes about their journeys, they’ll talk about their roles, and there’s a Q&A,” said Lisa Ferrara, director of human resources at Monarch Beach Resort.

On Thursdays, the students take what they learned and work on a project.

“We ask our leaders to create a project, or a special interest, for a hands-on learning experience,” Ferrara said.

The different disciplines include housekeeping, guest services, reservations, culinary services, accounting and more.

The program came together about a year ago when Dana Hills High School Principal Jason Allemann, met with members of the school district including Pati Romo, executive director of career technical education for Capistrano Unified School District, said Ferrara.

“It’s grown into this very unique partnership,” Romo said. “It’s almost unheard of for students to go into a site and intern

during their school days.”

Romo said it’s a positive experience and allows the students to learn career pathways and real life skills, college skills and people skills.

Allemann said the program is a way for the school to support local businesses and that it could grow to be successful for the students.

“It’s one thing to be in the classroom and learn, it’s another thing to get immediate practice,” Allemann said.

Allemann said this program will allow the students to decide whether they want to pursue a career in the hospitality field or rule it out. Selected students had to interview for a spot in the program.

“We want the resort to find value in employing those individuals,” Allemann said.

“It [could] get a kid a career that makes them happy and be able to support them.”

Ferrara hopes the program will allow the hotel to be able to hire the seniors once they graduate during the summer before they head off to college.

“We hire our beach attendants and pool attendants for the summer, and it would be great to have some of those students return,” Ferrara said. “We can create those relationships each summer.”

So far, Allemann said the program was going well.

“They’re eating it up,” Allemann said.

Ferrara said the program is not only a success for the students, but for the employees at the resort.

“The response we received has been overwhelmingly positive,” Ferrara said. “As we move through it, there’s more and more creativity. They’re excited, I can see a change in them as well and I didn’t expect it.”

Next semester, each student will choose a department in which they want to further their education and essentially intern with the leaders of those areas.

“They’ll identify their preferences,” Ferrara said. “They’re all interested in different areas; there’s a lot of culinary and event management.”

Festival of Whales Logo Contest Winner Uses Passion for Whales as Inspiration

sing his love of whales as inspiration for a design, a Southern California resident took home the top prize in the Festival of Whales logo design contest.

Alex Van Brasch, a Simi Valley resident, was named the winner of the 2017 contest after he received the most votes from the public.

The logo contest was opened to the public, and submissions from all over the world were sent into the Festival of

Whales Foundation Board.

“We got 58 great entries from all over the world,” said Andrea Swayne, event coordinator. “The Festival of Whales Foundation Board had a very difficult choice narrowing it down to five; we had so many excellent choices.”

Each of the submissions had to showcase the California gray whale, the name of the festival and the festival’s dates.

Swayne said when the contest was only open to Dana Hills High School students in the past, the criteria was slightly different

to accomodate the school’s curriculum.

“By removing some of those requirements and opening it to the public, we allowed for greater creativity and received a large cross section of designs in various mediums,” Swayne said.

For Van Brasch’s logo, he said he used colored pencils and pen, and used the computer to add the text and align everything.

When the logo contest was announced, he said he didn’t know if he was going to submit anything.

“Someone had forwarded it to me in a message; I thought about it for a second and didn’t know if I was going to commit,” Van Brasch said. “One night I just started drawing this whale in colored pencil, there was no clear layout for the rest of the design.”

He said he drew the whale bursting out of the water “almost out of desperation.”

“It was also a celebration in a way,” Van Brasch said. “I wanted to bring some positivity to the table. It’s fun, it’s kind of classic but modern.”

He said he didn’t have a clear design for the rest of the logo, he just started creating it.

Swayne said submissions varied from crayons from younger children to submissions from aspiring artists and everyone in between.

“One of the reasons the Foundation Board narrowed it down to that top five was the logos evoked that spirit of the festival, they all had movement, and it showcased the California gray whale,” Swayne said.

She said the board also really enjoyed seeing the logos because they could tell how important the whales were to the artists.

“Even the younger children really had a passion and understood how important it is to learn about these animals and protect them and their environment,” Swayne said.

Van Brasch said he hasn’t been to the festival yet, but he has family in the area and has heard of it.

For the first time, the winner was not decided by the board, but by the public.

“We knew it would be a welcome change for the community to get involved,” Swayne said.

Van Brasch’s logo brought in 1,377 votes, followed by Mark Sandlin of Atlanta, Georgia, who received 438 votes.

Third runner up was Jeff Fleming of Dana Point with 210 votes, followed by Tom Swimm of San Clemente with 184 votes, and Vicki Killeen of Dana Point with 99 votes.

Along with the winning logo, Van Brasch received $500, two whale watching tickets and a choice of four pieces of event merchandise. His logo will appear on promotional materials for the festival including clothing, flyers, signage and more.

Van Brasch said it’s been a humbling experience.

“I’m super honored,” Van Brasch said.

“Any time the local scene embraces you or your work is so great. I know the power of community is very strong, and it’s humbling they’ve been so open to the artwork.”

The 46th annual Festival of Whales is scheduled for March 4-5 and 11-12. DP

money for children facing life-threatening illnesses.

GameChanger was created by a Dana Point family after their son was diagnosed with a rare form of leukemia. The group dedicates their time to collecting video games, consoles and more to children in the hospital with life-threatening diseases.

The festival was separated into two different events. One was a gaming event, which included live demos with YouTube and gaming celebrities, virtual reality demos, previews of future released games and more. Water Polo Fends Off Surging Tritons in 10-9 Victory Before he sent his players into the pool for their Oct. 4 matchup with South Coast League rival San Clemente, Dana Hills boys water polo head coach Matt Rosa told his squad to prepare for a battle.

That’s exactly what the visiting Dolphins got out of the Tritons.

The Dolphins saw a commanding lead slip away in the second half, struggling against a physical and fast-paced Tritons team and a loud home crowd, but made a stout defensive stand in the fourth quarter to hold on for a 10-9 victory.

The Dolphins’ defense, which held the Tritons to just one goal over the first nine minutes of play, reverted back to that effective style with the game on the line.

Tied 9-9 in the fourth, the Dolphins took the lead for good when Adam Cole forced a steal and Bryce Dunn scored on a toughangle shot at the other end of the pool for a 10-9 advantage. San Clemente (8-6, 1-2 league) tried to push on offense with two minutes remaining, but were smothered by the Dolphins, who forced a shot clock violation and did not allow a shot on goal the rest of the way.

“San Clemente is a good team with good athletes. I was telling my guys this was not going to be a runaway, we were going to have to battle and we did,” Rosa said. “The defense stepped up big. We had some nice stops in the last few minutes for sure.”

San Clemente started its comeback early in the third quarter facing an 8-4 deficit. Senior Sean Edwards led the charge, recording three steals and two goals in the third. Edwards tied the game with seconds left on a spinning move in front of the net that made it 8-8. The Tritons had six steals in the third, a blocked shot in the field, and outscored the visitors 4-1 to set up the final quarter.

The Tritons third-quarter surge felt similar to a run El Toro put together against the Dolphins in both team’s league opener on Sept. 20, Rosa said. Only in that encounter, the Dolphins couldn’t respond fast enough and lost, 12-11. The team has used that game as a learning experience to lean on.

at the preview meet in 2015, only to come back and claim first in the league finals a few weeks later. The Dolphins defeated all four teams in dual meet competition on Oct. 5.

Lauren Soto, a sophomore, was the Dolphins top finisher at the meet, posting a third-place time of 17:45.3. Leila Keyvan (18:22.3), Sarah Meng (18:26) and Alyssa White (18:28.9) finished in a tight pack to take sixth-, seventh-, and eighth-place, respectively.

The Dolphins’ boys team packed four runners inside the top-10 to claim victories over all four teams in dual competition.

Junior Jack Landgraf took fourth, while seniors Brandon Hough, John Turner and Thomas Wilfert took fi fth, eight, and ninth, respectively.

The Dolphins, who are ranked No. 2 in the CIF-SS Division 1 polls, defeated the likes of No. 8 El Toro and No. 10 Trabuco Hills to enforce the fact that they are the team to beat in league.

The Dolphins will prepare for the upcoming Clovis Invitational on Oct. 8 and the Orange Country Championships at Irvine Regional Park on Oct. 15.

After Solid Run Through Tourney, Girls Volleyball Enters League The Dana Hills girls volleyball team parlayed three consecutive Sea View League victories into a strong run through the Tesoro Classic Tournament last week.

The Dolphins (11-6, 3-0) went 3-2 at the tournament, defeating Canyon, Mission Viejo and rival San Clemente while dropping matches to host-team, and eventual champion, Tesoro and Foothill.

Before heading into the tournament, the Dolphins defeated Mission Viejo, Capistrano Valley and Laguna Hills, respectively, in league play. Dana Hills was scheduled to play a league match against El Toro on Oct. 6. Results were not available at press time.

“I thought it might be (like the) El Toro (game) all over again where we’re not responding well, not being composed,” Rosa said. “I said ‘Let’s get our heads back on straight. Let’s get back with the game plan that got us the 8-4 lead and just make plays here in the fourth quarter,’ and we did.”

Edwards led the Tritons with four goals and an assist. The Dolphins had four players score at least twice, and were led by Jack McLaughlin’s three goals. Dana Hills’ goalie Justin Edwards had 10 saves.

Dana Hills was scheduled to play Laguna Beach in a nonleague match on Oct. 6. Results were not available at press time.

The team returns to league play against Aliso Niguel on Oct. 11.

Girls, Boys X-C Stand Atop Podium at League Preview Meet The South Coast League is regarded as one of the most competitive and talented cross country leagues in the Southland.

That much was evident on Oct. 5 during the league’s first preview dual meet at Irvine Regional Park.

The leaderboards were tightly bunched, as eight top-10 squads in both the girls and boys categories battled for early-season supremacy.

The Dana Hills girls cross country team flipped the script from last season’s preview meet by taking first this time around.

he 2015/16 season was one for the record books,” noted San Clemente’s Greg Long shortly after being crowned Big Wave World Champion for the second time in his career. “When I look back on those waves and those sessions, I’ll be able to say I was right there while history was being made.”

The Pacific was supposed to smash us with drought-busting rains. And the deluge of swells churning out of the west was forecast to be nonstop. Long’s one hundred percent correct; Northern California and Hawaii enjoyed more all-time surf days than anyone can remember, but with the exception of a handful of fleeting moments down south, Dana Point and San Clemente were more or less spared the brunt of the much ballyhooed winter weather system.

In April, meteorologists announced El Niño was officially over, begging the question: what now? What do surfers have to look forward to this winter? Initially, Pacific forecast models hinted at the early signs of a La Niña system forming, but the latest round of data indicates this may not be the case.

An El Niño system results when ocean temperatures in the Pacific remain above normal for a sustained period of time, while La Niña conditions refer to the Pacific cooling below its average temperature for a month or more. The National Oceanic and Atmospheric Administration (NOAA) monitors all of this and at the beginning of September noted the chances of a La Niña system this winter was unlikely.

“What needs to happen to really get La Niña conditions underway is for those stronger-than-average winds to blow across the surface of the equatorial Pacific, cooling the surface and helping to keep warm waters piled up in the far western Pacific,” reads the latest NOAA report. “We’ve seen some weak bursts of this activity over the past few months, but nothing has settled in for the long haul. Without this atmospheric feedback, the large area of cooler subsurface waters that we saw back in the late spring has decreased substantially.”

similation Office. “Our September forecast continues to show the neutral conditions that have been predicted since the spring.”

As far as surf goes, typically La Niña and neutral seasons don’t serve our area too well. The main reason is that the powerful storm systems in the North Pacific that generate winter swells moves more northward into the Gulf of Alaska. In a good El Niño year, those storms will spin off of the southern end of the Aleutian Islands, directing the newly formed swell energy in a more westerly direct, which is what South Orange County needs. Because of swell shadowing from Point Conception to the north and Catalina and the Channel Islands to the west, it takes a swell out of the west angled between 260 and 280 degrees to really turn on our local breaks. In La Niña years, the swells come from a more northwest angle of 300 to 320 degrees, and subsequently miss our local waters.

This also means you may want to invest in a thicker wetsuit and a new pair of booties.

While local water temps hovered in the mid 60s pretty much all of last winter, don’t expect the same this season. Plan on those early morning dawn patrols to be a little nippy as the water will probably drop off into the upper 50s during the dead of winter.

There’s no question California could benefit from a lot more rain, but on average, La Niña or neutral winters are typically drier.

After five-plus years of drought, that’s bad news, and for surfers it could mean more degraded sandbars. Last winter, everywhere from Capo Beach to San Onofre lost a lot of sand in the big west swells that hit

the area. Part of what replenishes that sand year after year is the water that comes out of area streams, creeks and arroyos.

Not to say it’s all doom and gloom this winter. The ocean has a funny way of surprising us. Most recently we’ve been enjoying a bounty of last-season south swells, so maybe it’s like the salty old dogs down at San O always say: surf today, worry about the rest later. DP

BELLA KENWORTHY

ringleader of the all-girl skateboard collective known as the Pink Helmet Posse, young Bella Kenworthy’s been keeping herself plenty busy the last couple weeks. It all started at the end of September with a weekend trip up to Surfer’s Point in Ventura for a Western Surfing Association (WSA) contest, where 9-year-old Bella won the Girl’s Under 14 division and made the final of the Under 12 division.

Back home in Dana Point for the first week of October, she spent the week surfing pristine fall conditions at T Street and Salt Creek before shipping off to New York City to work on a skateboard project. Landing in Los Angeles on Sunday at 1:30 a.m., she headed down to San Diego with her four siblings in tow for another WSA contest, making the finals of both the Under 12 and Under 14 divisions.

With the contest over by lunchtime, the Kenworthy family bee-lined it up to Huntington Beach for an NSSA contest, where again, Bella found her way to the finals.
