LOCAL NEWS & IN-DEPTH REPORTING Council Approves Staff Reorganization THE LATEST: City Council approved a reorganization of staff positions ahead of planned staff retirements.

City staff told Council members that Director of Public Works Brad Fowler would be retiring by the end of the year, and City Manager Doug Chotkevys said he “told his family in the next two to three years” he would retire.

The new positions include a joint deputy city manager/director of public works/director of community service position and an engineering position.

The recommendation was passed with Councilmen Joe Muller and Richard Viczorek opposing, claiming it wasn’t clear why the new positions were needed.

Five things Dana Point should know this week Commission Letter, Referendum Continue Short-Term Rental Saga THE LATEST: After the Dana Point City Council passed an ordinance to approve short-term rentals in the city, two actions—one from the Coastal Commission and one from residents—figure to extend the debate.

Opponents of the city’s ordinance, which allows homeowners to rent all or portions of their home for between two and 30 days after getting a permit and home inspection, have started collecting signatures for a referendum. The referendum would ask Council to reconsider and repeal short-term rental regulations, or send it to a vote of the people, possibly during a special election.

The city had been working on the regulations for years, and a pilot program has been in effect since 2013. If approved, the referendum would require the city to restart the process of enacting short-term rental rules from the beginning.

One of the opponents’ major complaints with the ordinance is that it cedes too much control to the Coastal Commission.

Though the Commission only has jurisdiction over coastal access, and development (which short-term rentals are considered) in the coastal zone, opponents say the Dana Point Times September 23-29, 2016

language in the ordinance is so broad that any future move the city makes to limit or prohibit short-term rentals would have to pass through the Commission.

Councilman Carlos Olvera, who voted for the ordinance, said the city has “reestablished a positive report with the CCC,” and so the Commission may be amenable to accommodating any future moves to regulate short-term rentals.

“In this new ordinance is language that any changes needed would also be negotiated and not automatically mandated,” Olvera added.

There is precedent for how the Coastal Commission might respond to cities or HOAs moving to block short-term rentals.

The Commission recently sent a letter to a homeowners’ association in Oxnard that banned short-term rentals. The letter claims short-term rentals are a critical piece to providing coastal access, and fines of over $11,000 per day could be levied against the HOA if it persists.

However, the Commission recommended regulations the HOA could enact, and said it would work with the city and HOA to avoid fines and litigation.

Councilman Joe Muller, who voted against the ordinance, said he was concerned from the beginning about the Commission’s level of control.

“Is that going to become an issue in Dana Point considering the new ordinance does not state HOAs have control of shortterm rentals?” Muller said.

The Commission’s jurisdiction is solely within the coastal zone, according to the Noaki Schwartz, public information officer for the Commission, and so, ostensibly, future regulations enacted outside the zone would not require major Commission action.

Medical Board Investigates Dana Point Doctor THE LATEST: A Capistrano Beach doctor could lose his medical license after the Medical Board of California filed a complaint saying he was negligent and unreasonably excused a toddler from vaccines.

According to the board’s complaint, Dr. Robert “Bob” Sears was “grossly negligent in his care and treatment of a patient, a minor, who he saw in his office six different times between April 2014 and May 2015.”

The complaint claims Sears wrote a letter in 2014 excusing the patient from all future vaccinations, claiming the patient experienced organ failure and encephalitis after previous vaccines. However, the board’s complaint claims the letter was not maintained in the patient’s medical chart.

The complaint claims Sears “departed from the standard of care in that he did not obtain the basic information necessary for decision making, prior to determining to exclude the possibility of future vaccines.”

The board is requesting a hearing to decide whether or not to revoke or suspend Sear’s Physician’s and Surgeon’s Certificate; revoke his ability to supervise physician’s assistants, and pay requisite fees if he is placed on probation.

“We take the board’s accusation seriously,” said Rick Jaffe, Sears’ attorney. “But this case is very clear, this child had two unusual and severe vaccine reactions and his situation warranted concern about future vaccination. To continue vacation could have put the child at risk of further harm.”

Poseidon Water Shows Interest in Doheny Desalination Plant THE LATEST: A recent letter from Poseidon Water, a major water project developer, was sent to South Coast Water District (SCWD) with interest in entering a publicprivate partnership (P3) for the Doheny Ocean Desalination Project.

In August, the board approved to begin an environmental impact report on the project, which could cost anywhere from $88 million to $185 million depending on size and capacity.

Poseidon claims the P3 makes financial sense for the district.

“The P3 delivery method would shift the cost responsibility of the project to the P3 proponent during development and construction, while the District will only pay for water once it is delivered,” the letter said.

Poseidon currently has a facility in Carlsbad and are planning another in Huntington Beach. Both have drawn concerns from environmentalists.

Former Dana Hills High School Teacher Sentenced in Child Pornography, Sexual Assault Case THE LATEST: A former Dana Hills High School teacher was sentenced five years in state prison on Sept. 15 for possessing child pornography and sexually assaulting a young teen he met through a volunteer organization, the District Attorney’s office said.

Ezequiel Christopher Barragan, 50, of Aliso Viejo, pleaded guilty to four felony counts of performing lewd acts on a child under the age of 14, three felony counts of lewd acts on a child between the ages of 14 and 15 and one felony count of possession of child pornography. The crimes occurred between 2012 and 2015.

Barragan was a Spanish teacher at Dana Hills at the time of the incident. Over the last 20 years, he was involved in coaching youth sports and also volunteered as a Court Appointed Special Advocate (CASA) for children in Orange County.

Cyclists, Pedestrians to See Safer Paths along PCH

O

n any given day, drivers on Pacific Coast Highway can see a cyclist either riding to San Clemente, or turning onto Palisades and riding into the beach paths. But now, the city is taking steps to improve their bike and pedestrian pathways along PCH, as part of a larger plan to make Dana Point even more bikefriendly.

On Sept. 20, City Council voted in favor of a second phase of work that would make it safer for cyclists and pedestrians walking along PCH in the Capistrano Beach area.

The first phase, which is in the design stages and set to begin construction next year, would institute a two-way bike lane from Palisades to the pedestrian bridge on PCH. From there, a second phase will connect the lanes to Doheny Park Road.

The plan includes removing the existing sidewalk and constructing a new 14 foot-wide concrete path that will protect cyclists from vehicles. There will also be lighting and landscaping installed along the path.

“The goal is to have everyone use it in the evenings,” said Brad Fowler, director of public works. “As it all develops, people will be able to walk into Doheny Village and come back.”

To come up with comprehensive bike grids, the city has been working with the Orange County Transit Authority, as well as the Orange County Council of Governments South Orange County Bicycle Plan and the OCTA PCH Complete Street Plan.

Fowler said the planned path is not the same path that goes into Doheny State Park, but will be outside the park. He said that current path does get a lot of traffic, but the city believes the new path will see a lot of use.

“It will have its beautification, safety,

lights for pedestrians,” Fowler said.

Currently, Fowler said the safest route for bikers coming in and out of Dana Point is through Dana Point Harbor Drive onto Street of the Golden Lantern then to Del Prado and up Pacific Coast Highway. With the phases implemented, cyclists will now be able to continue to and from San Clemente.

Shawn Daurelio, manager at Bike Religion on PCH, says he wouldn’t mind seeing more bike lanes further down PCH. “[The roads] aren’t so bad here, but there are some that drivers aren’t as aware of, and that’s where more people are getting hit,” Daurelio said.

Further down the line, the city has plans to work on the other side of PCH and possibly have a “class four” lane, which is a bike lane separated from vehicle traffic but will allow cyclists to turn off the streets more conveniently.

“You have all those side streets, Crown Valley, Selva, Niguel Road,” Fowler said.

“Cyclists will want to turn off and it won’t make sense to have a two-way lane there.”

The project was selected by OCTA to receive up to $2,073,224 for construction, provided the city contributes the required 12 percent match—$282,712—and pays for non-eligible project improvements.

The total the city would be responsible for is $461,892 including non-construction design services.

Fowler told the Council and staff the funding would come from air quality enhancement funding and existing capital improvement projects.

The construction for phase one is set to begin in 2017 and phase two for 2018, and Fowler said the city will aim to do the work during the off-season. He said he doesn’t anticipate the construction taking more than three months but scheduling has not been set. DP www.danapointtimes.com

Council Candidates Discuss the Issues

n little more than a month, Dana Point residents will head to their polling stations to cast their vote for two new City Council members. To help residents identify which candidates to support, the Dana Point Times sat down with each of the five candidates and asked them the same five questions. In the coming weeks leading up to our special election guide, the Times will run their responses to those choice questions.

The Times asked each candidate, “What is your vision of development in the Lantern District/Town Center and Doheny Village?” and “What do you think needs to be done to improve parking in the city?”

The candidates’ responses are listed in the order their names will appear on the ballot.

Nadia Khalil

Travel Agent When asked about what her vision for the Lantern District is, Khalil said it’s a “continued beautification and enhancement” of the city’s charm.

“Every time anybody that wants to market or advertise Dana Point, the pictures that you see are not of what’s going on today, they’re what you see yesterday. And that’s what people have fallen in love with,” Khalil said. “I don’t know when it became this big marketing project for everything we do, but I see development enhancing the charm and the beauty of the area.”

She added she wants to enhance the city’s “biggest resources” such as the ocean and the history of the city.

She said she would like to see development incorporate resources for younger generations and help them be able to spend time in town and envision their futures in the city.

When asked if she supported Measure H or Measure I, she said she supported H because she was more against I and she felt that the people and authors behind I were not really in it for the city.

Point as the community we all see it as,” Khalil said. “Instead (it was) more of a business approach of what they could do and make instead of what they can give or how they can better our lives.”

Khalil said the simple things are critical to her vision of Doheny Village and it’s “near and dear” to her heart. She said she would want to see face lifts on the existing buildings and see charm go into the village.

“It would be great to have more little restaurants you can go to, more little shops, and clean up the area instead of approving pawn shops in there and more types of businesses, like the dollar store, that don’t bring in the destination travelers, but the transient travelers or residents,” Khalil said.

She believes the businesses that have been there for generations keep the city “mellow and grounded.”

She said she would like to see something happen with Donut World.

“I think they should do something with the Donut World and the people that hang out there for jobs, they all need jobs. But, we can do something like Laguna had done and make an area that is available for them to be hired or give jobs away,” Khalil said.

In regards to parking, Khalil said she doesn’t see it as a huge problem in the city because the destinations that people go to in Dana Point have parking.

She also said the city does not need any parking structures, and parking meters could be installed in the Lantern District.

“If they really want to make parking less of an issue, public transportation would come into play. Trolleys would be more available for a designated area where people can park in and be trolleyed into their destination at the Harbor or whatever is going on in the area,” Khalil said.

When asked if she thought parking could be an issue in the future, Khalil said no, but the city could alleviate parking by offering more public transportation during the busier seasons.

Paul Wyatt

Retired Engineering Executive Wyatt said there are two key factors that need to happen for his vision of development in the Lantern District. He said the first thing is that there has to be a business that will be “a draw to the area.”

Wyatt mentioned that perhaps the city could bring in a performing arts center that the “high school can do stuff with” and it could bring in “pre-concert and preevent traffic to build restaurants and make the area known.”

Wyatt said he believes it could take 10 years or so to completely build out.

“Secondly, because ultimately it will be the buildup of small restaurants and shops, there has to be central parking,” Wyatt said.

Wyatt added that it is important to have a parking plan because each of those businesses coming into town will rely on parking being there to help them when they are ready to establish themselves. Until parking is available there, it’s difficult to build out, he said.

When asked if he believes if the old parking regulations could make it cost prohibitive for builders to come in, Wyatt said he didn’t believe so.

“There’s not much coast to develop in Orange County, period. When developers are looking for spots, they will find some that make sense,” Wyatt said and added, “I think the money’s there, we just have to be picky.”

For his vision of development in Doheny Village, Wyatt said it’s a little more difficult.

“I think it needs code enforcement, when you look at the activity there and you attempt to get violation of code cleaned up, it would be a lot better to go there,” Wyatt said.

Wyatt said it would “be ideal” if there were a maker’s village and that there’s “no better place to put the artisans and board makers than in Doheny Village.”

In regards to parking, Wyatt said the city “is not terrible.”

“Although I would say there’s a problem up near the high school. Looking at where you can add a parking facility for the (Cont. on page 9) www.danapointtimes.com

He added that space could be tight, so it could be challenging to figure out a location.

Wyatt said if Doheny Village is successful, it could become a parking problem, but believes there is “a whole lot of land” that can be utilized.

When asked if he would push for preferred parking districts in the city, Wyatt said preferred parking districts would just push the parking issues to a different area.

“It’s not like you’re going to make it go away, you’re just going to push it to another neighborhood,” Wyatt said.

He said an idea that could work would involve the city’s trolleys.

“Realistically, you’re not going to get rid of cars down here, the question is does all the local traffic have to use cars?”

Wyatt said. “From just looking at how they shuttle people in on the trolleys, if you make it more available to run the trolleys everywhere, you could begin, to even some degree, get high school students in and out. I think there’s a whole set of places you just have to make them readily available.”

Debra Lewis

Small Business Owner Lewis said she hoped there was a “set of rules that everyone can follow” now for development in the Lantern District, which should serve as the foundation for growth.

“We should be proactive; what type of businesses, who are we looking to attract? I see it as a Paris in Dana Point, where people can walk and shop and have a cup of coffee,” Lewis said. “When I talked to people, that was their vision of Town Center. I’m really hoping we move to that.”

But before that can happen, Lewis said the city needs to come up with a parking plan.

“I think that was a problem with the Town Center Plan. I think that was a problem with the city, they didn’t come up with a parking plan. They just started talking to Majestic and Raintree and said we’ll work that out later,” Lewis said. “I think the first thing we need to figure out is how we’ll get people to go to Town Center and what it is they want to go and do.”

She said she would like to see the city have an identity, and believes it could be based around music.

if we get a venue for them we could not only have the symphony, we could have all kinds of entertainment there, which would draw businesses and restaurants there along with having that destination identity,” Lewis said.

Lewis said she would begin the process by reaching out to people in the community that have been involved with music and see if there’s a location that could house the venue.

“It’s the first piece of the puzzle, where to put it, how to fund it and then go out to businesses and say, ‘Here’s what we have,’” Lewis said.

She added if the city can get an identity and build around it, then “things will fall naturally into place.”

Lewis agreed Doheny Village “needs to be developed,” but said she doesn’t feel the need to dictate what should go into the area.

“It’s community outreach, it’s what do you see here in your neighborhood?”

Lewis said. “I think before I could tell you what goes there, I need a lot more input and information.”

When asked if Lewis believes going back to the older parking regulations would make it cost prohibitive for developers to build, she said her reaction is “that you haven’t even tried it.”

“You have one project, Majestic, that said it doesn’t pencil out for us, well of course they’re going to say that. They’re trying to get it as cheaply as possible,” Lewis said.

She added that the zoning and parking regulations are not “materially different” than what the city had before but would like to build “a better mousetrap.”

Lewis said the city could create a subcommittee to address the parking concerns in the city.

“They go to the various neighborhoods and have forums, ‘Do you have parking issues? What are they?’” Lewis said and added she makes her decisions based off the information she receives.

Lewis said to solve parking issues, she would need to look at “each area and first see what’s available.”

“Some ideas may be great; we just can’t do it there. There are things I’m sure we haven’t even thought of,” Lewis said.

Lewis said collaboration with other cities could make some of Dana Point’s initiatives “more effective.”

“I was at every public meeting where people could have a lot of input,” Maynard said. “I agreed with the plan at that time because everyone had input. I think that I agree with that now.”

She added that she also agreed with the original building heights and mixed use zoning.

When asked if she supported Measure H or I, she said she saw both sides.

“I think the residents need to have input, it’s important. This is a beach community and there’s a certain culture to the beach community, and we want to maintain it,” Maynard said. “They live here and they have a right to a say. I respect the vote, and I respect people that own property and want to do something with it, but it needs to be part of what is going on and what people have a vision on.”

Maynard said parking is a significant issue when it comes to development in Doheny Village, and that discussion and cooperation is key to figuring out a plan.

“It’s important that Doheny Village planners have meetings, but there needs to be a lot more direct input from the residents to ensure parking is dealt with,” she said.

She added that if a parking committee works on the plan, it could be beneficial.

“I just think we should all work together,” Maynard said.

When asked how she would asses parking in the city now and what can be done to meet future parking needs, Maynard said “as long as there’s a study, and input for Doheny Village, then you will know what the needs are.”

In regards to consideration of a parking structure in the city, Maynard said technically speaking, there were already enough spots and “there wasn’t a need for a garage” according to city research on the subject. Maynard said if there’s a point “when there’s a need” for a parking garage, “then it should happen.”

She added that because there was so much discussion with the Town Center Plan when it was approved, there wasn’t “a lot of criticism or negative comments.”

She adds that she understands people may park closer to the business they are visiting, but it could go into residential neighborhoods, “which can be a concern.”

But ultimately, Maynard said she would want to hear from residents.

“I just think I go back to feedback from people, I think there was not enough here and that brought up some of the contentiousness there,” Maynard said.

Brough said since the Town Center Plan passed, “the vision is already structurally laid out” for development in the area.

“It’s really implementing that vision and the people have voted to go back to the 2008 parking vision, which is fine. The voters have spoken. So I think moving forward, we need to implement the plan, get the vision going and complete the projects so we can move on to Doheny Village and on to the Harbor,” Brough said.

When asked if she believes the parking regulations will deter future developers from coming into the city, Brough said “that’s always a possibility,” but she hopes it is not the case.

“I probably would have done things differently in 2008, but I wasn’t there. I didn’t vote on it and no one asked for my opinion on it. I probably would have dealt with parking issues at that time. … We need to go forward and not repeat mistakes that were made,” Brough said.

In Doheny Village, Brough said she would like to hear input from everyone.

“The way I do things is I like to bring everyone to the table. Whether it’s the residents, neighbors and businesses, everyone who has an interest or stake in the project or the city even, (should) come to the table and be allowed to voice their opinions,” Brough said. “I do not believe in excluding people whether they agree or disagree with me. That’s irrelevant. Everybody needs to be heard from because everyone has an opinion on it.”

Brough said parking in the Lantern District has been decided based off Measure H, but the plan for the Dana Point Harbor parking plan needs to be looked at again.

“Measure H passed, so what’s done is done there. The Harbor has a plan in place, I think a 2006 plan that was before the ‘swipy’ phones and everything. So my guess is that things have changed,” Brough said. “I think it needs to be looked at again, and we need to take a realistic approach and listen and have the experts come in and give their opinion and have their opinion broadcast to the public, and people can agree or disagree and state why.”

She added she believes it’s a council person’s responsibility to “bring people together” and “listen to different views.”

“I do have a lot of experiences of working in the community with Planning Commission and working in D.C. and working on the state level. In all of those areas, I feel bringing everyone together is the best solution,” Brough said.

When asked if she would push for shared parking in Doheny Village, she said she would need to look at the things that are planned before deciding.

“In my mind, a pedestrian-type area is people walking. And the more spots you put on a building, the more people want to drive,” Brough said. “My goal would be to facilitate, obviously have enough parking, but to facilitate the walking idea. If you have people walking and people driving, people don’t always pay attention. You run the risk.” www.danapointtimes.com

Letters to the Editor CITY SHOULD RECONSIDER ITS LITIGATION ACTION KELLY DAVIS, Dana Point

I live across the street from The Strand and walk the trails almost every day. The public trails, parks and open space that the developer dedicated to Dana Point is an amazing and generous gift to the community. I recently read that after reimbursing the city of Dana Point for its legal costs (for more than 12 years and to the tune of $1,540,000), the Strand developer stopped paying when he discovered that the city had been over-billing him. Now, astoundingly, the city is paying an $800-per-hour attorney to sue Sanford Edward and Headlands Reserve, LLC for failure to pay. Why would the city take such drastic actions in order to reconcile a simple accounting error? I don’t believe that the city intended to bill the developer or hold him hostage to pay an inflated bill so why draw the line in the sand? The city should reconsider its hasty actions and mediate with Edward rather than sue him. Seriously, the city should use our taxpayers’ money for more important things, like finally finishing the improvements to the Town Center.

SOUR GRAPES OR SOMETHING MORE? DEANNA SLOCUM, Capistrano Beach

In attending the City Council meeting this week and thanking the City Council for their thoughtful consideration at the Sept. 6 meeting where the short-term ordinance was discussed and approved, I told them that I did not anticipate what a difficult decision they made. I realize this now because of the literally incredible noise being created by those opposed to the ordinance’s passing. The noise has taken the form of a referendum, which, if successful, could cost the city (us as taxpayers) more than $150,000 to hold a special election.

The noise-makers want the city to devote limited budget and resources to overturn a decision made by our elected officials to stamp out less than 200 short-term rentals.

Of course, the noise runs the gamut and most of it is untrue. One of the easiest claims to disprove is from many who opposed the ordinance on Sept. 6 who allege they were “cheated.” They claim the meeting date was moved, and the city only notified the short-term rental permit holders.

Apparently, they neglected to read the headline of the newspaper article they criticized leading up to the meeting—the one entitled “Short-Term Rentals to be Discussed at Sept. 6 Council Meeting,” Dana Point Times September 23-29, 2016

published in the Dana Point Times on Aug. 18.

The noise-makers claim that short-term rental permit holders received a “special notification” of the meeting. Well, that actually would have been appropriate if it were true. I would expect permit holders to receive advance notice of a meeting to discuss the future of the permit program.

I have yet to meet a permit holder who received this alleged advanced notice.

In addition, noise-makers claim that residents were not made aware of this ordinance or its provisions. The ordinance has been a topic of discussion for over a decade. There have been people involved in crafting this ordinance long before many of those complaining about it ever even lived here. At no time was the process closed or restricted to a select few.

I would be careful about signing anything without fully understanding the goal or “gain.”

ORDINANCE GIVES AWAY CONTROL TO COASTAL COMMISSION MARK ZANIDES, Dana Point

The City Council’s adoption of the amendment, which grants the Coastal Commission the right to approve any action which “modifies, limits or prohibits” short-term rentals (STRs) in the coastal zone means that Dana Point will never be able to limit or prohibit short-term rentals, no matter how much damage or destruction to our neighborhoods they do. This is made clear in a Coastal Commission letter dated August 26, 2016, threatening action against a homeowner’s association in Oxnard which sought to ban short-term rentals. The Coastal Commission has stated: “In all instances, short-term vacation rentals increase the range of options avail-

able to coastal visitors. Under the Coastal Act, these types of rentals constitute a high-priority visitor-serving use that provide important overnight accommodations for members of the public in coastal communities and support increased coastal access opportunities.”

The Commission claims that it “understands and appreciates that short-term vacation rentals may raise neighborhood character and operational issues, such as site management, number of occupants, special events, parking, litter and noise limits.

“Therefore, the Coastal Commission has endorsed certain regulations to require on-site management, enforcement protocols, occupancy limits, required parking and other use provisions.” Dana Point is now stuck with its current Dana Point ordinance, which does not limit the number of short-term rental licenses which can be granted. Any later effort by Dana Point to “limit,” much less prohibit, short-term rentals would be rejected by the Coastal Commission.

This amendment is not, as the city staff claimed, “minor.” Nor is it “the best deal we can get” from the Coastal Commission, as Councilman Schoeffel claimed. In fact, there appears to have been no negotiation with the Coastal Commission, but simply capitulation. This amendment is a Trojan horse which will forever give away our right to self-government on this important issue. It is a disaster. All Dana Point residents who care about the future of their city should sign the referendum to repeal 5.38 currently being circulated.

SUING IS A WASTE PENNY ROSE, Dana Point

I heard that the city of Dana Point is suing Sanford Edward for failure to pay the city what it believes he owes them.

But there are two sides to every story and from what I heard, the city over-billed him.

This is a situation that can be worked out in mediation not in a court room. The developer has done an amazing job beautifying Dana Point by restoring the Conservation Park, adding the boardwalk on Strand Beach, the funicular and trails. Suing is just a waste of taxpayer’s money.

During all of this, he also struggles with a relationship with his artsy, free-spirited girlfriend, Lindsay Mills (Shailene Woodley). Meanwhile, in 2013, Ed is hiding out in Hong Kong with reporters Glenn Greenwald (Zachary Quinto), Ewen MacAskill (Tom Wilkinson) and filmmaker Laura Poitras (Melissa Leo) ready to leak the CIA’s secret.

The pros of Snowden are the electronic music score and Gordon-Levitt’s endearing love interest. Woodley puts in a natural and organic performance that shows acting can sometimes make up for the bland material. Gordon-Levitt is also fine as the man himself, but the cons of Stone’s usual caliber—outdated political views and biased narrative—hold the feature back.

For a while there, it seemed like the delicate macaron would be crammed down the face of any half-interested gourmand and sweet Macarons from Pascal. Photo: Matt Cortina tooth possessor. But the trend has died, and in its wake, only the steadfast and excellent purveyors of the heavenly cookie remain.

Pascal is one such place. The house specialty comes in a variety of rotating flavors— we tried mango, raspberry, vanilla and chocolate.

The meringue cookies that make up the macaron were egg-shelled on the exterior and airy inside. They were perfect bookends to robustly flavored filling—the vanilla had the distinct flavor of the bean and was more in the frosting category; while the mango punched with lemon and herb sweetness in a jam-like consistency.

Now, going to Pascal, a new-ish, award-winning restaurant where excellent breakfast, lunch and dinner are also served, and writing about the macarons is sort of like going to Yosemite and writing only about Half Dome. Sure, it’s magnificent, but it leaves out the vast greatness of the place. That said, make macarons the cap of a meal if you go, or the companion to coffee or wine. www.danapointtimes.com

Dana Point Harbor Holds Underwater Cleanup

ore than 6,000 pounds of debris was cleared from the Dana Point Harbor during the annual underwater cleanup last weekend.

The ºevent was part of California Coastal Cleanup Day, where volunteers across the state walked the sands to beautify beaches. In Dana Point, cleanups were scheduled for Capistrano Beach, Salt Creek Beach, Doheny State Beach and the San Juan Creek.

At the Harbor, more than 80 divers brought up items like a TV, two small boats, anchors, a marine toilet, batteries and more.

Above the water, 60 volunteers helped the divers along the docks.

Overall, the event cleaned 180,000 square feet of the Harbor at the West Basin “F” Dock.

Kelly Rinderknecht, coordinator for the Harbor event and general manager at Dana West Marina, said this was the best event yet.

“We’ve had the best turnout, a big haul, there was a lot of heavy items in the haul,” Rinderknecht said. “We had a really good group this year, everyone’s been so excited.”

Prizes were given out for categories such as “Most Humorous Find,” “Whale of

a Find,” “Fishiest Find” and “Most Useful Find.”

Running alongside the underwater cleanup was a cigarette butt roundup.

More than 50 volunteers walked along to pick up 275 pounds of trash from the Marina and park areas throughout the Harbor.

Sophie Kharileh from Laguna Niguel volunteered with other members of the National Charity League Capo Coast Chapter, who picked up more than 400 cigarette butts.

In total, volunteers throughout the city collected 8,410 pounds of trash and recyclables during the cleanup, according to Julia Williams, director of Cleanup OC with the Orange County Coastkeeper.

At the Dana Point Yacht Club, 60.84 pounds of trash and 1.3 pounds of recyclables were collected. At the Dana Point Marine Protected area, 43 pounds of trash and 15 pounds of recyclables were collected. At Doheny State Beach and San Juan Creek, 1,000 pounds of trash and 100 pounds of recyclables were collected.

At Salt Creek Beach, 350 pounds of trash and 200 pounds of recyclables were collected. At Capistrano State Beach, 75 pounds of trash and 40 pounds of recyclables were collected. DP

Girls Golf Trending Upward The Dana Hills girls golf team has steadily lowered its cumulative team score now that South Coast League play has started. The Dolphins, who have bettered their previous score in each of their last four matches, posted their lowest score to date on Sept. 20 in a 197-281 league victory over El Toro at El Niguel Country Club.

Dana Hills (5-3, 2-1) split the season series with rival San Clemente last week, but easily defeated the Chargers on their home course. The Dolphins were scheduled to host El Toro again on Sept. 22.

Results were not available at press time.

Dana Hills will compete in the Rainbow Sandals/Lady Triton Invitational, an 18hole event, at the San Clemente Municipal Golf Course on Sept. 23.

Water Polo Drops Close Game to Chargers The Dana Hills boys water polo team has dominated the South Coast League in recent years, claiming every title dating back to 2012. While there is still plenty of the season left to go, El Toro proved on Sept. 20 that it might have something to say about who takes home the hardware in 2016.

El Toro pulled off a 12-11 overtime victory over the visiting Dolphins to jump to the top of the league standings.

The Chargers held a comfortable 7-3 lead at the half, but the game quickly turned into a shootout. The Dolphins came roaring back in the second half, outscoring El Toro 6-2 down the stretch, forcing a 9-9 tie at the end of regulation.

But the Chargers controlled the game in overtime and took the match.

El Toro’s Chad Nelson led all scorers with five goals. Dana Hills was led by Bryce Dunn and Kai Hanson, who each found the back of the net three times.

The Dolphins (3-4, 0-1 league) were scheduled to play Los Alamitos in a nonleague match on Sept. 22. Results were not available at press time. Dana Hills will travel to play league rival San Clemente on Oct. 4.

Tennis Team Stays Strong Despite Tough Schedule Following its first loss of the season, the Dana Hills girls tennis team bounced back with a big 12-6 nonleague win over tenthranked Mira Costa on Sept. 14. In 2015, Mira Costa advanced to the quarterfinals of the CIF-SS Division 1 Championships.

Dana Hills’ Courtney Swift swept all three of her singles matches, and the doubles teams won six of a possible nine points to seal the win.

The Dolphins (5-1) have not been shying away from quality opponents during the nonleague portion of their schedule.

Dana Hills’ last three opponents all appeared in the playoffs one year ago. The

Dolphins only loss of the season was against fi fth-ranked University on Sept. 13.

Dana Hills is ranked eighth in the CIFSS Division 1 polls.

Girls Volleyball Sweeps Diablos The Dana Hills girls volleyball team opened its bid for a Sea View League championship with a dominating three-set sweep over Mission Viejo on Sept. 21. The Dolphins breezed past the Diablos 25-9, 25-19, 25-12.

Dana Hills (8-4, 1-0) has won two out of its last three matches, and will look to carry the momentum into a league matchup at home against Capistrano Valley on Sept. 27.

After several weeks of lying idle, the Dana Hills boys and girls cross country teams are finally ready for their first competitive meet of the season. The Dolphins will host the annual Dana Hills Invitational on Sept. 24.

The course, which loops runners around the area of Dana Hills High School, is a traditionally fast track and a good litmus test for the start of the season.

The Dolphins’ boys team began the season as the top-ranked squad in CIF-SS Division 1, but has since slipped to the No. 2 spot in the polls. The girls team debuted at No. 5 in Division 1, but are now ranked ninth.

Football Loses Shootout with Santa Monica The Dana Hills and Santa Monica high school football teams found themselves in an offensive slugfest in the west side of Los Angeles on Sept. 16. In the end, Santa Monica proved to have more firepower as it barnstormed its way to a 53-36 nonleague victory.

One week after setting season-best marks in the rushing category, the Dolphins (0-4) went with a pass-heavy approach against Santa Monica. Dana Hills quarterback Corey Cisowski completed 36 of 53 passes for 372 yards and three touchdowns to one interception.

Senior receiver Ryder Lynch caught 12 passes for 133 yards and two touchdowns, and Matt Sanford reeled in nine catches for 52 yards and a score in the loss.

While the Dolphins were busy airing it out on offense, Santa Monica was content with handing the ball off to senior running back Antonio Holley. Holley was the model of efficiency in the contest, turning nine carries into 221 yards and four touchdowns. Holley averaged an incredible 24.6 yards per carry in the win.

Dana Hills led 14-12 after the first quarter, but the Vikings steadily pushed forward to take the lead. Santa Monica outscored the visitors 34-22 over the final two quarters.

The Dolphins will host Los Amigos (2-1) out of the Garden Grove League on Sept.

or five years running, Nate Yeomans’ Fishbowl Classic has captured the essence of what a down-home, local surf contest should be. From resident surf stars, to buck-toothed grommets, to supportive parents, and all of the other characters that make the local surf scene what it is—they all made the effort to come down to Riviera Beach in San Clemente on Sept. 17 and hang out.

“The whole idea was just to give all the local families a day to get together at the beach, hang out, ride some waves and have some fun,” explained Yeomans. “It’s crazy to think that it’s been going on for five years now. It’s one of those things that seems to just keep getting better and better every year.”

This year’s incarnation of the Fishbowl Classic was an opportunity to get back to what surfing’s all about: fun. The format’s simple enough. Local kids are paired with a pro teammate after pulling a name, fittingly, out of a fishbowl. The teams then go out and surf a heat with the kids’ scores counting as a “double whammy,” or twice the pro’s score.

The winning teams advance into a final, where a champion is eventually crowned.

than the groms,” smiled Yeomans.

In attendance was resident hero Kolohe Andino, a trio of Gudauskas brothers, as well as World Surf Leauge (WSL) Championship Tour stalwarts Sebastian “Seabass” Zietz, Keanu Asing and Ryan Callinan. And for the ladies, WSL commentator and San Clemente resident Rosy Hodge was joined by 2015 WSL women’s rookie of the year, Tatiana Weston-Webb, and rising star, Tia Blanco.

“You see how psyched all the kids are and how much fun everybody’s having, it’s such a good reminder of why we all started surfing in the first place,” said Pat Gudauskas. “It’s the kind of thing that grounds you and recharges the batteries. Everybody’s just so stoked to all be together at the beach. It’s epic.”

It mattered little that the surf was an inconsistent two to three feet, or that later in the day the wind came up. Adding an air of absurdity to the function at the junction, instead of wearing the traditional jerseys or singlets usually worn in surf contests, the pros were forced to wear old school, granny-style swim caps. Then there was the jump house that was set up right on the

waterline, complete with a slip and slide into the shorebreak.

By noon, the final was on, and was it ever stacked. Along with their respective grom teammates, Andino, Callinan and Seabass gave the heat a decidedly worldclass feel. But in the end, it was local pro Kevin Schultz and last year’s winner Hagan Johnson that ended up taking the win.

Already a heck of a day at the beach, as the sun dipped below the horizon the party train rolled over to the O.C. Tavern for the awards banquet and some live music.

Hardly a solo effort, Yeomans’ entire family gets in on the act, helping him with logistics, setup and all of the details that have made this event so successful. He also leans a lot on the local community to help turn the dream into a reality. Sponsors like Lost Surfboards stepped up to help cover the cost of the beach permit, as well as donate a new surfboard for the first place finisher.

“We couldn’t do this without all of the local support, both from individuals and businesses. It’s a full community effort, and I have to say thank you to everyone that’s gotten involved,” said Yeomans. DP

ee Hagan Johnson on the beach and the first thing you notice is the 13-yearold’s impeccable style. Blond mop quaffed by the salt water, statement-making checkerboard panel on his wetsuit, surfboard stickered up with a handful of heavy-hitting sponsors— the kid’s undoubtedly on his way.

Last weekend, he became the first surfer to post back-to-back wins at the Fishbowl Classic—no easy feat considering the level of talent. In 2015, he teamed up with Ian Craine for the win; this year, he joined Kevin Shultz to take the title.

“Thanks to Nate Yeomans for throwing a sick event,” said Johnson. “And thanks to the Shorecliffs Surf Team for giving me the opportunity.”

Quickly making a name for himself, last week he found himself in the final of the Open Juniors division of an NSSA Southwest Division contest in Huntington Beach. Further out, in the last year he joined the Volcom surf team on a trip to Indonesia. Then in the winter, he joined the crew for a stint on Oahu’s North Shore. Along the way, he helped carry Shorecliffs Middle School’s surf team to an NSSA National Championship.

As far as talent and contest results go, Johnson’s right in the mix with the best kids in the area. Add to the mix his own personal style, and it’s pretty obvious he’s one to keep an eye on in the weeks, months and years ahead. DP www.danapointtimes.com
