Five things Dana Point should know this week Stakeholders Differ on Solutions for Managing Capo Beach THE LATEST: The California Coastal Commission (CCC) and OC Parks continue to collaborate over the future of Capistrano Beach Park, a beach that has sustained considerable damage and erosion in recent years. However, residents and local stakeholders are at odds over what that future should look like.

Video footage shows waves overtaking the parking lot on Independence Day, causing further damage to the beach’s sidewalk area.

In October 2018, inclement weather and high tides caused the boardwalk and basketball court to buckle; those amenities, as well as a restroom, have since been demolished.

During a July 10 CCC meeting, both Mandy Sackett and Rick Erkeneff spoke on behalf of the South Orange County Chapter of Surfrider Foundation.

“All these emergency permit durations have elapsed, yet the riprap and sand cubes remained,” said Sackett, policy coordinator for Surfrider. “The sand cubes were a slight improvement, but they’ve remained past their six-month duration and they are starting to break down and become plastic pollution.”

Last month, the county applied for an emergency permit to place additional riprap boulders on the beach and for some sidewalk removal.

“We do not support more boulders on the beach; it doesn’t make sense here, and it’s creating a hazardous situation. More boulders will not solve the problem,” Sackett said.

Erkeneff, a Dana Point resident and vice chairman for Surfrider, echoed Sackett’s sentiments and played footage for the commission that was taken on Fourth of July.

“We’ve been monitoring the issues at Capo Beach. Over Fourth of July weekend, the parking lot was completely inundated, and the parking lot had to be evacuated.

The sidewalks are buckled, the pavement is buckling,” Erkeneff said. “Anything less than taking out the entire parking lot, I think, would be a failed effort. I’d appreciate the consideration for denying future emergency permits for riprap.”

The CCC granted an emergency permit on July 23 for the demolition of damaged concrete sidewalk, curb and gutter, as well as 124 feet of wooden seawall associated with concrete anchor blocks and metal tiebacks.

OC Parks crews will be removing debris, relocating ADA parking and K rails (moving landward) and filling in unsafe holes and drop-offs. Demolition was completed during the last week of July, and removal and completion of the project is scheduled to conclude the second week of August.

For residents such as Toni Nelson, preserving the beach and its coastal access trail is a priority.

“I understand the CCC’s insistence that armoring creates more erosion downcoast,” Nelson said. “I also understand that in the end, Mother Nature will win. What I don’t understand is why on Earth we can’t seem to bring all the stakeholders to the table—the community, coastal homeowners, OC Parks, State Beaches, the City of Dana Point and the Federal Railway Administration—to figure out what we are willing to spend and what mitigations we’re willing to try to save our coast (and, (Cont. on page 4) danapointtimes.com

Nelson’s online petition states support for OC Parks’ efforts to restore the path and protect it with armament and preserve public access.

“I think the county is doing what it can to preserve public access and enjoyment,” Nelson said. “The (sidewalk removal) is a common-sense move that will facilitate a wider, usable beach, at least temporarily.”

If it comes to a choice between beach or parking, Nelson believes the community would vote for a beach every time.

“I’m hopeful the CCC will allow sand cubes and riprap to slow wave action—at least temporarily until stakeholders’ meetings can forge a less offensive solution,” Nelson said. “While the sand cubes do rip apart, the beauty is that they are not dangerous to beachgoers, and they can be opened up and deposited on the beach with little impact. They will at least temporarily protect the beach and the adjacent residential lots.”

But during the July 10 CCC meeting, Director Jack Ainsworth implied that riprap may not be the solution after Commissioner Linda Escalante expressed her shock at the video footage.

“This has been an ongoing problem,” Ainsworth said. “They’ve asked for rocks in the past, which we’ve said no to. We’ve allowed some temporary sand cubes that aren’t doing their jobs. They’re really going to have to reimagine that area for what it’s going to be in the future . . . we are working with the county.”

In an email to Dana Point Times, Charlene Cheng, a spokesperson for OC Parks, said the agency does not have current plans to demolish the parking lot.

“We will be retreating the asphalt parking surface in some locations due to recent damage and the inability to install adequate protection to the parking lot,” Cheng said. “Our next steps are to continue our cleanup efforts to make the site safe to reopen to the public.

WHAT’S NEXT: Cheng said OC Parks is working with the CCC to follow up with a regular permit and is continuing to investigate alternatives to protect coastal access at Capistrano Beach Park.

Teachers Address Hybrid Learning Model During CUSD Board of Trustees Meeting THE LATEST: Teachers discussed issues they had with proposed hybrid classroom Dana Point Times August 7-13, 2020

plans during a Capistrano Unified School District (CUSD) Board of Trustees meeting on Wednesday, Aug. 5.

CUSD will start the 2020-21 school year continuing with online learning, per a mandate from Gov. Gavin Newsom that California schools can only physically reopen when their county is off the state’s COVID-19 monitoring list for 14 consecutive days. Orange County has remained on the watch list in recent weeks.

Before Newsom’s mandate, the Board of Trustees had approved a flexible reopening plan incorporating, in part, a hybrid model allowing options of some on-campus instruction with safety guidelines or all online learning.

Some teachers who called in to comment during the Aug. 5 meeting spoke out against there being no teachers who solely handled online learning under the plan, as well as recommendations that they livestream in-person classroom instruction for students learning online.

“This is absurd and a massive disservice to everyone involved,” San Juan Hills High School teacher Christina Hellwig said.

“Students participating online at home will be passively watching me teach my class to other kids, and I will have to ignore either the in-person group or online group to engage with the other.”

San Clemente High School teacher Casey Swenson said he took issue with plans for grades 6-12 when on-campus instruction returns.

“It may sound appealing to just fold the fully online students into live instruction and hybrid classes, but the reality is the learning environment is rife with inequalities,” Swenson said. “No teacher can do live instruction five days a week in a classroom and simultaneously do daily live interaction with students at home.”

Some people who called in to comment also expressed health and safety concerns over returning to classrooms. CUSD officials said there would only be a consideration of returning to on-campus instruction when it is safe to do so. The reopening plan follows state and county health guidelines.

“No one on this board, least of all me, wants to do anything that’s going to sacrifice teachers or students or anyone else, or create an outbreak in this community,” Board President Jim Reardon said. “We’re doing things very, very cautiously.”

According to school registration data for families in grades K-5, of three options presented under the reopening plan, 55.29% selected a 100% on-campus instruction option, 22.03% chose a half-on-campus and halfat-home option, and 13.46% chose all online instruction. Approximately 8% of families did not respond and so were placed under the 100% on-campus option by default.

For grades 6-12, which only had two options of a hybrid on-campus/online model or all online instruction, 87.60% chose the hybrid model. Approximately 12% chose the all-online model, and 20.47% did not respond and so were placed under the hybrid model by default.

Trustee Gila Jones asked about requir-

ing people in the district to show a negative test for COVID-19 after initially displaying symptoms. The reopening plan has guidelines in place for what to do if a student or staff member displays symptoms or is in close contact with someone who does, which includes sending them home.

Gregory Merwin, chief academic officer for Education and Support Services, said they recommend people who display symptoms to get tested and are looking at ways to ensure they get the necessary tests. Merwin also said medical privacy is a consideration when it comes to whether families can be compelled to share test results. Reardon said staff can look into existing guidelines regarding people returning to work or school.

SoCal Edison Expected to Complete Spent Fuel Transfer This Week THE LATEST: Southern California Edison is expected to transfer the last bit of nuclear waste from its San Onofre power plant into dry storage by the end of this week, completing another step in its ongoing plans to deconstruct the decommissioned facility.

Since early 2018, SoCal Edison has been removing spent nuclear fuel from the plant’s Unit 2 and Unit 3 reactors, placing the material in canisters that are downloaded into its storage facility—the Independent Spent Fuel Storage Installation, or ISFSI. So far, Edison has downloaded 72 of the 73 canisters into the ISFSI. In a tweet from the utility company on Tuesday, Aug. 4, Edison posted a picture of the last nuclear fuel assembly being loaded into the 73rd canister.

John Dobken, spokesperson for Edison, said the canister was likely to be downloaded into the ISFSI on Thursday, but it could potentially be moved to Friday.

SCE Vice President of Decommissioning Doug Bauder said the company isn’t ready to celebrate the end of this chapter quite yet, stressing their priority is safety.

“We’ve been very focused on safety, so we’re very careful not to celebrate early,” he said.

SoCal Edison has had to store its own nuclear waste from the San Onofre Nuclear Generating Station (SONGS) on-site, just like all of the other power plants in the U.S., which doesn’t yet have a permanent repository for such materials.

Federal officials have been unable to agree on a permanent location to store the nation’s radioactive waste since 2010, when the Obama administration cut funding for plans to establish a storage site at Yucca Mountain in Nevada.

The final canister download comes weeks after the California Coastal Commission (CCC) had approved SoCal Edison’s Inspection and Maintenance Program, which is meant to ensure the company can

adequately inspect, monitor and eventually retrieve the canisters for transport.

The approval essentially allows Edison to continue storing the spent fuel through 2035—when it must resubmit an application to either retain, remove or relocate the ISFSI. At that time, the application renewal must also include an updated evaluation of coastal hazards and potential on-site or off-site storage options for the fuel.

This past October, the CCC approved Edison’s coastal development permit, allowing the power plant operator to begin dismantling the twin containment domes at SONGS once the nuclear waste has been removed and transferred to the ISFSI. Initial work to deconstruct the power plant, which went offline in 2013, began in late February and is expected to take about eight to 10 years to complete.

WHAT’S NEXT: Once all the radioactive fuel is downloaded in the ISFSI, Bauder said Edison will shift its focus on more decommissioning activities, starting with work to dismantle the containment domes by preparing for them to be cut up and removed off-site.

“The domes, when you see driving by early on, there won’t be a lot of visual changes to the station, but as the decommissioning process moves along, you’ll start to see some of those changes,” he said.—Shawn Raymundo

Man Arrested After Domestic Battery Incident at Doheny State Beach THE LATEST: A man suspected of choking his pregnant girlfriend was arrested on Wednesday, July 29, at approximately 10 p.m. at Doheny State Beach.

According to California State Parks, witnesses saw a woman being strangled by a man and reported the incident to authorities.

“A good Samaritan followed the couple as (the couple) drove off in a van, and called the police,” said Rich Haydon, the State Parks superintendent. “(Orange County Sheriff’s Department) detained the suspect, and the peace officer lifeguard on duty made the arrest.”

Dallin Mifflin, 35, of San Diego, was arrested on suspicion of domestic battery and was transported to Orange County Central Men’s Jail.

The incident is believed to have sparked rumors of a kidnapping attempt after a social media post saw traction in local Facebook groups. A Facebook user posted about an alleged attempted kidnapping taking place Wednesday evening. The post describes a man grabbing a young girl and throwing her in a van before a bystander intervened until police arrived.

Both OCSD and State Parks officials told Dana Point Times there was no such incident.

Bodies of Missing Marines, Sailor Found in Sunken AAV THE LATEST: The remains of the seven U.S. Marines and one Navy sailor who went missing after a training exercise “mishap” occurred last week have been located, Marine officials announced on Tuesday, Aug. 4.

According to I Marine Expeditionary Force (MEF), officials Tuesday found the sunken amphibious assault vehicle (AAV) that was carrying 16 service members on July 30, when the craft began to take on water during a return trip to the USS Somerset from San Clemente Island.

The crew inside the sinking AAV signaled to two accompanying AAV units and a safety boat that their craft had started taking on water about 1,500 meters from the shore.

The bodies of the service members, I MEF said, were identified inside the AAV using underwater remotely operated video systems that the U.S. Navy’s Undersea Rescue Command had provided.

Eight other service members, all of whom had been assigned to the 15th Marine Expeditionary Unit and were aboard the AAV at the time of the accident, were recovered last week. One of those Marines, 20-year-old Lance Cpl. Guillermo Perez of New Braunfels, Texas, was pronounced dead on the scene.

Two others were found in critical condition and were airlifted to the Scripps Memorial Hospital in La Jolla, San Diego.

One of the injured, an AAV crewmember, is now in stable condition, Marine officials announced on Sunday, Aug. 2.

The U.S. Marines, with the assistance of the Navy and Coast Guard, conducted a search and rescue operation to find the missing Marines and sailor. However, after a 40-hour search, officials called off the rescue mission on Saturday, Aug. 1, announcing that Dana Point Times August 7-13, 2020

the service members were presumed dead.

“It is with a heavy heart, that I decided to conclude the search and rescue effort,” Col. Christopher Bronzi, 15th Marine Expeditionary Unit (MEU) commanding officer, said in a statement. “The steadfast dedication of the Marines, Sailors, and Coast Guardsmen to the persistent rescue effort was tremendous.”

According to the latest update from I MEF, the Navy has expedited its efforts to recover the remains of the deceased Marines and sailor, as well as raise the AAV, which sank to a depth of about 385 feet.

“The equipment to properly and safely perform the recovery from the sea floor will be in place at the end of this week, and a dignified transfer of our Marines and Sailor will occur as soon as possible after the conclusion of recovery operations,” I MEF said in a press release.

Three of the deceased service members—Pfc. Bryan Baltierra, 18; Lance Cpl. Marco Barranco, 21; and Cpl. Cesar Villanueva, 21—were native to Southern California, according to Marine officials The other five service members—Pfc. Evan Bath, 19; U.S. Navy Hospitalman Christopher Gnem, 22; Pfc. Jack Ryan Ostrovsky, 21; Cpl. Wesley Rodd, 23; and Lance Cpl. Chase Sweetwood, 19—originated from Northern California and the states of Wisconsin, Oregon and Texas.

The search operation encompassed more than 1,000 square nautical miles of the Southern California coast near the island and included the use of several aircraft and watercraft, with help from the Navy and Coast Guard.

“Our thoughts and prayers have been, and will continue to be, with our Marines’ and Sailor’s families during this difficult time,” Bronzi had said in the statement.

WHAT’S NEXT: The incident has been under investigation and was still underway as of Wednesday, according to the Marines. In the meantime, all waterborne operations training with AAVs have been suspended.—SR Page 5

Vintage Car Parade Celebrates Centenarian in Dana Point Rita Killingback, a longtime Dana Point resident, celebrated her 100th birthday on Wednesday, Aug. 5 with a parade of vintage cars driving by to honor the centenarian.

Killingback was born in Hasbrouck Heights, New Jersey, in 1920. While she’s settled in various spots throughout the country, including Arizona, she’s made Dana Point her home since the 1970s—before the city was even incorporated.

“She’s still working every weekend at the Landmark Antique Store,” said Killingback’s daughter, Karen Wildermann. “She always keeps going.”

Killingback also has two sons living in Arizona and the Philippines.

Her words of wisdom for living to be a centenarian: “Don’t eat a lot of meat and don’t let things bother you.”

In light of social distancing, Wildermann planned for the “Just Havin’ Fun” Car Group to do a drive-by parade of nearly two dozen vintage cars in front of Killingback’s home on Mazo Drive in Dana Point.

“She’s a hoot. She says anything she wants to, anything that comes to her mind—and she deserves to,” Wildermann said of her mother. “She never slows down; she can’t sit down for too long.”

After living through several wars and seeing the world progress over the span of 100 years, Killingback says, “The most important thing in life is to get along with people.”

South County Businesses Receive CARES Act Funding Orange County Supervisor Lisa Bartlett has awarded $14.5 million in CARES Act funding, also known as the coronavirus relief bill, to small businesses and nonprofit organizations throughout the Fifth District through the Small Business Grant Relief Program.

“So many small businesses that serve as the backbone of our economy have suffered significant financial hardship due to the COVID-19 pandemic,” Bartlett said.

“My goal was to develop a program that would provide financial support to those businesses and get funds into their hands as quickly as possible.”

After an Orange County Board vote in May, $75 million in funding was split equally between the five county districts.

The $75 million comes out of the $554 million that Orange County received from the CARES Act. The funding has gone toward Dana Point Times August 7-13, 2020

testing and personal protective equipment such as medical-grade masks and gloves for first responders and health care officials.

Administrative costs to develop, implement, and administer the program amounted to $450,000 (a 3% cost).

The Small Business Grant Relief Program that launched on June 22 provided economic support of up to $10,000 in

CARES Act funding grants for small businesses and nonprofit organizations experiencing financial difficulties as a result of COVID-19. Grants were awarded to businesses in nearly every business sector.

“Through this successful program, we have supported more than 1,400 businesses and organizations throughout South Orange County,” Bartlett said.

by Debra Lewis was very enlightening. We are sorry to lose her on the council, as she devoted so much time to the issues and investigating them to the fullest.

We appreciate Ms. Lewis and the many hours she spent educating the community on the various council items, especially the short-term rental properties. This is definitely out of balance and needs to be addressed, with 72% owned by investors and 45% from out of town. We will wait for a good plan is acceptable to all and has full recourse for disorderly violations.

We will miss our council watchdog especially on the sober living home issue. Our new council needs to tighten up on this and pass a city ordinance that has been effective elsewhere. I do thank Debra Lewis for all her accomplishments, her legal background and insights that benefited so many. We send a fond farewell to her and a reason that made Dana Point a better city.

Commission. Councilmember Debra Lewis, who just resigned from the Dana Point City Council, and Councilmember Paul Wyatt presented a plan that favored homestay STRs at the exclusion of all other types of STRs. A homestay STR is where an individual rents out a portion of their residence to a third party, while they are still residing in the home. There are a few local residents who may need additional income and are willing to sacrifice their privacy, and presently their health, due to COVID-19, to allow strangers in their home. Now, let’s get real.

How many of us would want to bring our family into a stranger’s home? Certainly not now, nor in the future. This type of short-term rental will serve a very small number of visitors. The Coastal Commission staff advocated this concept as a pilot program but not at the exclusion of other types of STRs that accommodate families.

Rather than blame the city council for ignoring an exclusive homestay STR program that I think is frankly worthless and would never gain Coastal Commission approval, we should applaud the council for recognizing they need to develop a comprehensive plan to serve a broad spectrum of visitors that want to share our lovely community. The council’s focus needs to be on enforcement and a local set of rules to govern STRs.

I am a short-term rental (STR) owner and operator of three Airbnb units in Capistrano Beach, and we live adjacent to our rentals.

The recent Dana Point Council survey concerning STRs creates as many questions as it does insights into the public’s opinion over STRs in Dana Point. I would like all of us to recognize that this issue is critical to a fairly small number of residents, both STR owners and those residents against STRs. A majority of Dana Point residences are really not that troubled by STRs. This is obvious from the survey results, which indicate that concerns with STRs were near the bottom of the list of issues in Dana Point.

One important item not disclosed by the survey and not well known or understood by many of our residents is that the decision on STRs within the coastal zone is not a unilateral choice by the voting public of Dana Point. The California Coastal Commission has significant input into what ordinance Dana Point approves concerning STRs. Any ordinance approved by Dana Point must be submitted to the Coastal Commission for their approval.

Laguna Beach had passed a restrictive ordinance that was rejected by the Coastal

In Jay Thomas’ Letter to the Editor in the Volume 13, Issue 30 edition, he finds it “hard to believe” that we have 44 canisters of spent nuclear fuel at San Onofre, and holds Congressman Mike Levin at fault for not fixing this in two years.

What I find hard to believe is that Mr. Thomas seems to have been asleep at the wheel for a few decades (as was Mr. Levin’s predecessor, who seemed preoccupied with showboating on other issues and never giving San Onofre anything more than a shrug and a sigh). The storage had already started before Mike Levin took office. There was nothing to be done to change that. And change requires an extraordinarily complex collaboration with the Department of Commerce, Department of Transportation, various states, cities, counties, U.S. Marines, and so much more—all of which Mr. Levin initiated as soon as he entered office.

If those canisters were moved now, there would very likely be catastrophic results. In the meantime, Mr. Levin has laid groundwork for how and when this will happen (something Darrell Issa never accomplished) and has worked hard to make the site more secure as we wait.

As for “voting for Brian Maryott,”

I encourage readers to go to both Mike Levin’s campaign page and Brian Maryott’s campaign page. There is literally nothing on Maryott’s issues/ environment page addressing San Onofre.

I also remember hearing Mr. Maryott at a candidate forum a few years ago. He lacks the expertise and commitment to address anything about San Onofre Nuclear Generating Station (SONGS). Take a look at Mike Levin’s page on the same subject.

It is chock-full of intelligent approaches to addressing SONGS. Mike Levin’s principal concerns as our congressman have been to mitigate issues with San Onofre and support veterans’ issues. Those are certainly important issues to the 49th Congressional District.

Look at what Costa Mesa did last week.

Passed 6-1: Continuing the economic development and public safety priorities, Costa Mesa voted to add an initiative to the November 3, 2020 ballot to allow cannabis retail and home delivery sales in Costa Mesa. If approved by voters, this will diversify and increase city revenue sources by more than $3 million annually while also allowing the city to shut down illegal operators and remove unsafe products from the market.

We could have taken the lead and controlled a new revenue source our city needs so badly. We are going to get locked out by San Clemente and San Juan pushing Dana Point into the illegal black market and untaxed delivery services that are working in our city currently.

Fifty-six percent of the voters passed Proposition 65 from our city. That should have been enough for the leaders of our community to pass the same proposal that Costa Mesa and nine other cities are placing on the ballot this November.

A Widow and Widower Love Story

I

n 26 years of writing newspaper columns, I’ve heard many warm-yourheart senior love stories. Today, I share with you one of the best.

In 1995, when I owned Tutor and Spunky’s, my Dana Point deli, a customer, Joe L. Brown, and I had become good friends. We talked a lot about baseball; we talked about senior romance.

Why baseball? Joe knew a lot about the subject. He was the general manager of the Pittsburgh Pirates for 21 years, from November 1955 until the end of 1976. Under Joe’s leadership, the Pirates won two World Series in 1960 and 1971.

Joe’s father was the famous comedian and actor, Joe E. Brown.

Why did Joe L. and I discuss senior romance?

Joe believed he would remain single the rest of his life. No one—he was convinced—could fill the emptiness he felt. As a favor, he would escort women friends to functions, but he had no interest in becoming involved.

For Thanksgiving dinner in 1990, Joe was invited to a friend’s home in Coronado. Joe was seated next to a woman named Paulita. Coincidentally, they both

had attended Beverly Hills High School, but did not know each other because Joe was two years older.

Joe said, “We talked for hours. I had been shot through the heart with a lovearrow, but was disappointed to learn that Paulita was leaving for Mexico in two days for the winter.”

That night, Joe confided to a friend: “I’ve fallen in love, but she’s leaving in two days.”

“Call her first thing tomorrow; tell her you want to see her before she goes,” the friend insisted.

The next morning, Joe and Paulita made a date for that night. When Joe picked her up at her San Diego home, he said, “There’s something I’m going to tell you.”

“What is it?” Paulita said.

“I’ll tell you during dinner,” Joe replied.

The restaurant was a few miles away in La Jolla. In the car, Paulita kept asking, “What is it?”

“I’ll tell you during dinner,” Joe repeated.

Paulita had no idea what he was going to say.

Finally, after ordering beverages, Joe mustered the courage. He said, “Yesterday, I fell in love with you. I want to be with you.”

“Aren’t we going a little fast?” Paulita asked.

“At our age, we don’t have a lot of time. May I visit you in Mexico after the holidays?”

“Yes!” Paulita exclaimed.

The next morning, Joe called Paulita: “Be safe. I love you.”

He called her that night to ensure she arrived without incident.

Then, he called his son and daughter.

He said, “I’ve fallen in love.”

They said, “Dad, you’re kidding.”

He said, “Even old people can fall in love. Love doesn’t come out; it escapes.”

Joe and Paulita talked twice a day by phone. A few days later, he said, “I can’t wait until after the holidays. I want to see

“Great!” she said. Joe flew to see her the next day. In the eight days he stayed in Mexico, he proposed to Paulita. She accepted.

After Christmas in California with his children, Joe visited Paulita for another 12 days. They set a wedding date.

In February 1991, Joe and Paulita married.

Before they left for Mexico together in 1995, Joe said to me, “I love Paulita as much now as I did four years ago.”

Years later, Paulita passed away. Joe moved to Albuquerque to be near his daughter, Cynthia. He died at 91 on Aug. 10, 2010.

A month later, Cynthia telephoned to thank me for being such a great friend of her dad’s. Her call touched me deeply. He was a great man.

More specific work items included within the general category/type of work listed above include, but are not limited to: mobilization/demobilization; traffic control; community outreach; pavement removal; subgrade and asphalt pavement repairs; cold-milling existing asphalt; asphalt overlay construction; bridge deck treatment with high molecular weight methacrylate; removal and reconstruction of PCC driveways, sidewalk, curb, gutter, cross gutters, and local depressions; removal and reconstruction of pedestrian ramps to meet current disabled access standards; adjustments of existing utility appurtenances to new grade; removal and re-establishment of existing decorative hardscape improvements; landscaping and irrigation; signing and striping; implementation of Best Management Practices (BMP) for storm water pollution prevention during all construction activities; and other general improvements as outlined in the Contract Plans and Specifications for the above-stated project.

3. BID DOCUMENTS: Copies of the Contract Plans and Specifications are available from the City of Dana Point Public Works Department, 33282 Street of the Golden Lantern, Suite 212, Dana Point, California 92629, upon payment of a $145 nonrefundable fee and must be picked up from the City. Bidders must purchase a set of Contract Documents to be placed on the City’s official plan holders list to bid this Project.

Per State Law, the AGENCY has made electronic copies of the Contract Documents available to CONTRACTORS. In order to bid the Project, however, the AGENCY requires every BIDDER to purchase a hard copy set of Contract Documents and to be added to the official plan holder’s list. Bidders who have not purchased a hard copy set of the Contract Documents may not bid this project. 4. COMPLETION OF WORK: The CONTRACTOR shall complete the work within Ninety (90) working days from the Notice to Proceed. Work performed beyond the allowable working days will be subject to service fees and liquidated damages per Sections 6-7.2 and 6-9 of the Project Specifications, respectively.

CONTRACTORS are required to provide written documentation, as part of their bid, if this schedule cannot be met. The AGENCY reserves the right to reject any and all bids on this basis.

5. BIDDING PROCEDURES: Bids must be prepared on the approved Proposal forms in conformance with Section B: “INSTRUCTIONS TO BIDDERS” of the Project Specifications and submitted in a sealed envelope plainly marked on the outside.

6. PROPOSAL GUARANTEE: The bid must be accompanied by certified or cashier’s check, or bidder’s bond, made payable to the AGENCY, or cash deposit, for an amount no less than 10 percent of the total amount bid.

7. STATE OF CALIFORNIA LABOR CODES: Any contract entered into pursuant to this notice will incorporate the provisions of the State of California Labor Code. Pursuant to Sections 1725.5 and 1771.1(a) of the Labor Code, a Contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations. Failure to register as required by the Labor Code may be grounds for disqualification.

Attention is directed to the provisions of Sections 1777.5 (Chapter 1411, Statutes of 1968) and 1777.5 of the Labor Code concerning the employment of apprentices by the CONTRACTOR or any such subcontractor under him. Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, sex, religion, or handicap will also be required.

8. WAGE RATES: This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations, pursuant to the provisions of Section 1771.4 of the Labor Code.

Pursuant to the provisions of Section 1773.2 of the Labor Code, the minimum prevailing rate of per diem wages for each craft, classification, or type of workman needed to execute the contract shall be those determined by the Director of Industrial Relations, for the county or counties in which the work is to be done, which are available from the following website: http://www.dir.ca.gov/DLSR/PWD/ These State general prevailing wage rates are not included in the Proposal and Contract Documents for this Project. Updates, if any, to the State general prevailing wage rates are available from the website noted above.

Contractors are required to meet provisions of California Senate Bill 854 for the payment of Department of Industrial Relations (DIR) established prevailing wages. This applies to all public projects as defined in California Code 22002 for contracts exceeding $1,000.00. Contractor’s shall register with the DIR in accordance with California Labor Code section 1771.1(a) and 1725.5, and will be subject to compliance monitoring and enforcement by the DIR, subject to section 1771.4.

Contractors must submit certified payrolls electronically to DIR. By bidding this Project, Contractor is indicating that they have registered with DIR and have submitted the required PWC-100

Information Form online at www.dir.ca.gov. The City may deem bidders non-responsive if this requirement has not been met.

9. CONTRACTOR’S LICENSE: All bidders shall be licensed in accordance with the provisions of the Business and Professions Code for the type of work to be completed and shall possess the appropriate State Contractor’s License Class A (General Engineering Contractor) at the time of the bid submittal through Contract acceptance (Public Contract Code § 10164).

Failure to possess the specified license shall render the bid as non-responsive.

10. CONTRACTOR’S REFERENCES: The CONTRACTOR shall produce references and experience that show, to the satisfaction of the AGENCY, that the CONTRACTOR bidding the project has adequate working knowledge of street improvements/reconstruction work and asphalt resurfacing as the PRIME CONTRACTOR. The CONTRACTOR must have completed, and shall produce as part of its bid, references of five similar Projects as the PRIME CONTRACTOR to the satisfaction of the AGENCY. Furthermore, the CONTRACTOR and/or Subcontractor, and the Project Superintendent for the Project must have experience with the methacrylate bridge deck treatment product and process. The CONTRACTOR bidding the project shall produce references of five similar bridge deck treatment projects completed by either the CONTRACTOR or the Subcontractor as part of its bid, to the satisfaction of the AGENCY. All noted information shall be provided in the locations designated in the bid documents. If these requirements are not met, the AGENCY reserves the right to determine any and all bidders non-responsive, and reject any and all bids on this basis.

These requirements are due to the critical nature of the work and the need for the AGENCY to insure adequate experience is provided to complete the project.

11. SELF PERFORMANCE: In accordance with Section 2-3.2 of the Project Specifications, CONTRACTOR shall perform or provide, with its own organization, contract labor, materials, and equipment amounting to at least 50-percent of the Contract Price. CONTRACTOR’S attention is directed to Section 2-3.2 of the Project Specifications for additional requirements pertaining to “Specialty Items”. The City may deem bidders non-responsive if this requirement has not been met.

12. RIGHT TO REJECT BIDS: The AGENCY reserves the right to reject any or all bids, to waive any irregularity and to take all bids under advisement for a period of 90 days.

13. PROGRESS PAYMENTS: The AGENCY will deduct a 5-percent retention from all progress payments as specified in Section 9-3.2 of the Project Specifications. The CONTRACTOR may substitute an escrow holder surety of equal value to the retention. The CONTRACTOR shall be beneficial owner of the surety and shall receive any interest thereon.

14. QUESTIONS/REQUESTS FOR INTERPRETATION: All questions shall be directed to Mr. Matthew Sinacori, Director of Public Works/City Engineer, in writing via email at msinacori@danapoint.org no later than August 27, 2020 at 5:30 PM. The AGENCY hereby affirmatively ensures that minority business enter¬prises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, sex, or

State Allows Youth Sports Workouts to Resume The California Department of Public Health will now allow for the resumption of youth sports workouts, conditioning and physical education with proper physical distancing, according to another round of new guidance released on Monday, Aug. 3.

The guidance applies to all youth sports, including school sports. However, school sports may remain unaffected by the latest guidelines, as campuses may not physically reopen until their county has been off the state monitoring list for 14 consecutive days, per the state guidelines. Orange County currently remains on the state monitoring list.

Youth sports games, tournaments and any events that would require close contact or would “promote congregating” are still not allowed. Youth sports practices and conditioning will be allowed only when physical distancing of six feet and a stable, preferably smaller, group of athletes can be maintained.

Youth sports are encouraged to work out outdoors, but if activities take place indoors, a cloth face covering is required.

The guidance states that all activities that require heavy exertion should then take place outside without a face covering and with physical distancing.

This is the latest upswing on the rollercoaster of youth sports guidelines in California.

School sports and many youth leagues closed down in mid-March as the state rolled out its first shutdown guidance. Some youth leagues began to resume small operations over the next two months before Orange County released guidance on June 15 that

said youth sports practices were allowed to resume via the state’s day camp guidance.

Youth leagues sprung back into action, and local high schools were set to open conditioning camps on July 6. However, those school camps were mostly shut down before they started following a letter from the Orange County Department of Education and further state guidance on July 8 that shut down all youth sports activities until Monday’s latest guidance.

On July 20, the CIF State and CIF-SS offices shifted the start of high school sports seasons into December and January. However, until schools can physically reopen, those dates remain tentative.

Blake Taylor Earns First Major League Win After a seven-year journey through the minor leagues, Dana Hills alumnus Blake Taylor made his major-league debut in this delayed and shortened MLB season for the Houston Astros on July 24.

Thirty miles away from his high school ballpark, the 2013 Dolphin graduate earned his first major league victory as the Astros defeated the hometown Angels, 6-5, in 11 innings on Sunday, Aug. 2.

Taylor came on in relief with two outs in a tied 10th inning and struck out Matt Thaiss looking to end the inning. The Astros grabbed the lead in the top of the 11th inning, and after fighting through two two-out walks, the 24-year-old left-hander closed down the bottom of the inning to seal the win.

Taylor threw 1 1/3 innings with no hits, no runs, two strikeouts and two walks. In seven appearances this season, Taylor is 1-0 and has not allowed a run in 7 1/3 innings pitched, allowing two hits and two walks while striking out nine.

Taylor was signed by the Pittsburgh Pirates out of Dana Hills in 2013 and was traded to the New York Mets organization in 2014. Taylor then spent the next six seasons on eight different teams in the Mets system before being traded to the Astros in December 2019. Taylor had been assigned to the minors in spring training but made the Astros roster out of their pre-restart summer camp in July. DP danapointtimes.com

Paddling for a Cause Lifeguards paddle 250 miles to raise awareness about skin cancer and sun protection

as anybody noticed that it’s been kind of flat lately and that the water feels a lot more like February than August?

After a booming start to the summer that saw the best south swell in years bombard our shores amid pleasant water temps, things have certainly slowed down. It’s so 2020.

Thankfully, there’s always something to do in the ocean. A fisherman friend reported snagging his first bluefins of the season. I’m waiting for the invite to the sashimi dinner party, but he keeps telling me he’s strict about social distancing.

Meanwhile, the flat waters have a lot of friends out logging miles on their paddleboards. Last weekend, a group of friends and former co-workers paddled from Catalina to Newport Beach to honor fallen Newport Beach Lifeguard Ben Carlson, who lost his life on July 6, 2014, while performing a rescue during a large swell in Newport.

The Ben Carlson Foundation was subsequently established in his honor to remember his sacrifice and raise funds to provide scholarships for eligible students and lifeguards. In what was a 30-mile trek from White’s Cove on Catalina to Newport Beach Pier, the crew completed the paddle in seven hours—a new record for the annual affair.

rom the mountains to the sea, Sunny Walder loves it all. The 11-year-old Dana Point rising star is not only ripping spots such as Salt Creek and Lower Trestles, she is also one of the top ranked snowboarders in the country.

Just last March, she won a slopestyle event in Mammoth—and she’s just getting started.

This summer, Sunny has been making the most of the surf we’ve had and will be barreling into sixth grade at Niguel Hills Middle School in Laguna Niguel in a couple of weeks.

“I feel like I have always been surfing,” said Sunny, when asked when she first Dana Point Times August 7-13, 2020

wind were brutal. Had tears ready to explode as the pain reached its peak,” surfer Matt Myers recalled. “So stoked for the 23 guys who accomplished this feat!”

And as this story goes to print, there’s another group of lifeguards from 25 different agencies up and down the state of California who are participating in the SoCal PaddleDown for Cancer Relay. At press time, the group was in Newport Beach, and organizers anticipated that the lifeguards would be paddling through Dana Point and San Clemente by Friday.

Learning at Doheny and Salt Creek with her parents, she’s been ripping lately and is eager for the upcoming big-wave season to kick off.

“She loves charging bigger days when the waves are triple overhead for her,” her father, Bryce, explained.

“I like getting a good turn or a steep drop on a big wave; it makes me feel like I am flying,” Sunny said.

And when asked about where she sees surfing taking her in the next 10 years, the theme remains the same.

“Surfing massively huge waves,” she said.

Whether it’s going big on the mountain or in the water, Sunny’s fired up to push her limits and continue to challenge herself. It’s a wonderful thing. Keep it up, Sunny! DP

They’ve been working their way south all summer and will end at Imperial Beach in San Diego. In partnership with the California Surf Lifesaving Association, the goal of the program is to educate youth about sun safety and skin cancer.

“As ocean lifeguards, we spend the majority of our careers in the sun, and we know firsthand the dangers of sun exposure,” says Bill Humphreys, president of the association.

“Through the SoCal PaddleDown, the John Wayne Cancer Foundation is educating the next generation of lifeguards early in their careers on ways to detect skin cancer and prevent long-term damage.”

As we barrel into August and September—my favorite time of year around here—it’s worth taking note of the efforts

to raise awareness about skin cancer. With all that’s going on with COVID-19, escaping to the outdoors is one of the few things we can do and feel safe, but it’s important to remember to wear a hat and lube up before you head out in the sun.

Vital stats worth noting include: Skin cancer is the most common cancer in the United States, and more than 3.6 million people will be diagnosed with some form of it this year.

“One in three Californians will be diagnosed with skin cancer during their lifetime, and these numbers are on the rise,” says Lauren Fraga, senior program director at the John Wayne Cancer Foundation.

“If it’s caught early and treated quickly, more than 95% of skin cancer cases can be cured, which is why educating our youth early on about the dangers of sun damage is so vital to skin cancer prevention.”

This is the eighth year the SoCal PaddleDown has made its 250-mile journey down the coast to help raise awareness for skin cancer and support Block the Blaze. So, if you see a crew of lifeguards paddling by you at the end of the week, give them a cheer and thank them for putting in the hard yards to make sure the youth are learning how to stay protected from the sun.

Finally, if somebody could turn up the temperature of the ocean about 10 or 15 degrees, that would be great. And we could really use some waves, too, while you’re at it.
