Five things Dana Point should know this week Governor Proposes Record-Setting Budget; State Officials Issue Response THE LATEST: Gov. Gavin Newsom, a Democrat, proposed his second annual budget of $222 billion on Friday, Jan. 10. If passed, it would be the largest budget in California history.

The spending plan would invest in wildfire prevention and preparation, housing and homelessness, as well as K-12 education. In Newsom’s proposal, he states: “There are deep, structural challenges that threaten our state’s future and demand our urgent attention. These problems—catastrophic wildfires and their impacts, the expanding homelessness crisis, and growing inequality of opportunity—have been decades in the making and won’t be fixed overnight. California can and must do more to tackle these challenges and fortify our future.”

The proposal dedicates $2 billion for emergency services, including flood protection and mapping of areas prone to wildfires, floods, tsunamis and mudslides.

It would fund a new Wildfire Forecast and Threat Intelligence Integration Center, in addition to research on better firefighting equipment and ways to protect firefighters.

As for combating homelessness, according to CalMatters, a nonprofit news organization that focuses on policy, roughly 150,000 Californians are living on the streets or in shelters. With $1.15 billion previously set aside for local governments, the proposed budget tacks on an additional $1 billion. That includes $750 million planned for the California Access to Housing and Services Fund, which offers new affordable housing.

State Sen. Patricia Bates and Assemblymember Bill Brough, both Republicans, represent San Clemente in the state Legislature.

In a statement Brough issued, he says California families and businesses deserve an affordable California.

“This will not be solved by tax increases but by lasting reforms to reverse the years of over-taxing, regulating and spending,” Brough said.

Brough did say he applauds the governor for addressing California’s staggering home prices and out-of-control homelessness problem.

actually make homes expensive to build,” Brough stated. “I stand ready to fight and work with the Governor and my colleagues on sensible solutions without further burdening hardworking Californians.”

Bates gave Newsom credit for increasing the Rainy Day Fund reserves, investing in teacher training and enhancing the state’s emergency response capabilities, such as dealing with wildfires.

“It is also encouraging that the Governor wants to reduce the tax on new small businesses, which is telling given his very unfortunate signing of Assembly Bill 5 last year that has hurt workers who want to be independent contractors,” Bates said.

“Yet his desire to spend almost $20 million to enforce AB 5 will further hurt the very workers he claims to be helping.”

Bates called for Newsom to work with the Legislature to “fix AB 5’s job-killing flaws and make the law fair for all.”

As for Newsom’s spending plan on homelessness, Bates emphasized that leaders cannot spend more on the “status quo and expect different results.”

“More funding needs to be combined with more accountability and public safety,” Bates said. “Californians want to help the homeless, but they also want to live in safe and clean communities.”

Santa Ana Sues South County Cities on Homelessness; Cities Respond

THE LATEST: The City of Santa Ana filed a lawsuit against the County of Orange, as

well as the three South Orange County cities of Dana Point, San Clemente and San Juan Capistrano this week, alleging that the municipalities have leaned heavily on Santa Ana to take on the homelessness crisis.

In the complaint filed in federal court on Monday, Jan. 13, Santa Ana accuses the three South County cities of opposing and refusing to establish their own homeless shelters and has instead relied on the Orange County Armory Emergency Shelter Program at the National Guard Armory in Santa Ana (Santa Ana Armory) to resolve their homeless woes.

“Despite state requirements for each city to provide housing for homeless individuals, Defendants have made insubstantial progress or failed to do so entirely, instead unfairly shifting their obligations to Santa Ana,” the filing states.

Santa Ana also accuses the County of Orange of establishing “homeless services almost exclusively in Santa Ana, thereby further contributing to the dense concentration of homeless individuals therein.”

In response to the lawsuit, San Clemente Mayor Dan Bane called Santa Ana’s refusal to allow other cities’ homeless to access the armory “absurd” when it’s meant to be a countywide resource that’s funded in part with grants.

“The notion that certain cities can’t have access . . . I find absurd, particularly given that countywide resources were provided for those programs,” Bane said.

“So, honestly, what this lawsuit appears to be about, is Santa Ana is telling San Clemente and all cities, even though this is a countywide resource, we don’t want cities to have access to a county resource because this is ‘dumping,’ ” Bane added.

Orange County Board Supervisor and Chairperson Lisa Bartlett said the county would continue to work with all of its cities to combat homelessness.

“Each community is facing different

challenges surrounding homelessness and is responding and dealing with those issues as they feel appropriate,” Bartlett said in an email response. “The County as well as the South County cities have placed homelessness as a top priority issue to address with both short- and long-term solutions.”

San Juan Capistrano officials declined to respond to requests for comment.

“As a direct and proximate result of Defendants’ acts and omissions, Santa Ana has been compelled to spend millions of dollars from its general fund budget to address a myriad of health and safety concerns attributable to Santa Ana’s homeless population,” according to the suit.

The city goes to on to allege that the county and the three South County cities have encouraged the establishment of homeless services within its city limits, with the knowledge that Santa Ana’s population of roughly 341,000 is 78% Hispanic and has a median household income that’s near the lowest of all cities in the county.

“This practice has continued unabated for years, as only underscored by the plan

by Defendant County to site a replacement shelter for The Courtyard within Santa Ana and the plan by Defendants Dana Point, San Clemente, and San Juan Capistrano Cities . . . to transport their homeless residents to the Santa Ana Armory,” the lawsuit states.

In a letter to Santa Ana’s legal counsel, Dana Point City Attorney Patrick Muñoz denies the accusations that Dana Point has any custom, policy or practice to transport homeless individuals to the Santa Ana Armory.

“To be clear, Dana Point has no such practice, and has never transported, or arranged for the transportation of any homeless person to the Armory. It cannot be held responsible for or bound by the alleged practices of nearby cities,” Muñoz states in the letter.

The City of Santa Ana has referred to an Orange County Register article reporting that Dana Point and San Juan Capistrano were to join San Clemente in sharing the cost for transportation to the Armory.

“This allegation lacks any evidentiary support and is completely baseless,” Muñoz states. “… Dana Point seeks to avoid spending any additional time, judicial resources, and taxpayer dollars on this baseless and frivolous lawsuit.”

The letter also demands that City of Santa Ana remove City of Dana Point from the suit.

Bane echoed Muñoz’s sentiment, stating that, to his knowledge, not a single homeless individual in San Clemente had accepted the city’s offer for round-trip transport to and from the armory.

“The idea was, when it’s winter months and rainy, to provide access to beds . . . they serve a purpose because it’s dangerous on the street when it’s rainy and wet,” Bane explained. “The city was willing to provide transport back and forth.”

It’s also seeking a prohibition of transporting homeless individuals to the Santa Ana Armory for sheltering purposes.

Santa Ana also sought a temporary restraining order (TRO) against the defendants to halt such actions while the case proceeds, citing comments from San Clemente officials who had planned to transport the city’s homeless population to the public armories in Santa Ana and Fullerton.

On Tuesday, Jan. 14, Judge David O. Carter denied the request, noting that the harms Santa Ana claims are “too speculative and remote to warrant the immediate interim relief of a TRO,” court documents show.

Visit Dana Point Announces New Logo THE LATEST: Visit Dana Point, the destination marketing organization for Dana Point, announced the completion of a large-scale brand rejuvenation project.

Upon Jonny Westom’s appointment to executive director of Visit Dana Point, he set a goal to create a stronger identity for the California beach town.

“I am thrilled to kick off 2020 with all of this exciting news from Dana Point,” said Westom. “From a refreshed brand, an upgraded logo and the announcement of the expanded Dana Point Tourism Business Improvement District, we are continuing to build from the momentum we saw in 2019, which will only increase tourism interest to Dana Point in the months and years ahead.”

To capture the essence of the updated brand, Visit Dana Point has unveiled a new logo to further distinguish its identity, the press release said. The logo was developed over the span of 18 months and 50 renditions.

“The new logo was designed to communicate Dana Point’s connection to the ocean, while juxtaposing the casual, yet sophisticated vibe of the destination,” the release said.

In addition to a refreshed brand and logo, Visit Dana Point also announced the expansion of the Dana Point Tourism Business Improvement District (TBID), which will go into effect on July 1, 2020. The expansion adds seven hotel properties to its portfolio—encompassing all overnight accommodation offerings in the destination. DP City Council Returns for First Meeting in 2020 THE LATEST: The inaugural city council meeting of 2020 will be held on Tuesday, Jan. 21 at 6 p.m., kicking off the new year with a hearing for an appeal of Dana Point Planning Commission.

On Nov. 18, 2019, the planning commission approved the coastal development permit (CDP) for the construction of a new single-family residence at 34312 Shore Lantern. The project includes the construction of a 4,881 square-foot, twostory dwelling with an attached two-car garage. The project complies with all of the applicable development standards, with the exception of the deck over the garage, which encroaches 12 feet into the front yard setback. As a result of feedback at the planning commission hearing and the appeal, staff included condition of approval to require the second-story deck and patio cover over the garage to not project more than four feet into the front yard setback.

The commission approved the project with the condition, with Commissioner Eric Nelson voting against the project due to concerns with the deck encroachment and one commissioner being absent.

The appellant is a neighbor of the property.

Another highlighted item on the council agenda includes the authorization for a utility box artwork program. Upon council approval, staff could use $10,000 from the Arts in Public Places fund to produce and install nine vinyl wraps for utility boxes.

The Dana Point Arts & Culture Commission has been discussing a new initiative, a utility box artwork program to contribute to the “vitality and attractiveness of Dana Point streetscapes, and create a vibrant and interesting environment,” according the agenda report. At the Arts & Culture Commission meeting on Jan. 8, the commission unanimously voted to recommend the program to city council for consideration and funding.

FAM Director Talks New Role, Addresses Mistruths THE LATEST: When Mary Purdue shifts into her new role as chief development officer for the South Orange County-based Family Assistance Ministries next month, she’ll get to utilize her expertise and skills as a strategist.

“It’s been evident for quite a while now that there’s far too much on this plate, because I’m doing both development and executive director,” Purdue, the current CEO for FAM, explained.

“So, we’ve thought about lots of different scenarios with the board and myself . . . what scenario would be best for FAM, what would be best for me,” she said.

“And really being chief development officer is really my thing.”

As the head of development for the local nonprofit organization, which focuses on providing help to families and individuals on the brink of becoming homeless, Purdue will oversee business development, community relations and fundraising.

For a long while, Purdue was in charge of both operations, running day-to-day activities, as well as managing and coordinating fundraising activities, which is how FAM makes roughly a third of its annual revenue.

“As I thought about that, I thought, ‘Do I want to stay here and do the operational side of it or let’s split this job and let me go do (development)?’ ” she recalled. “So, that became my choice of where I wanted to go and what I wanted to do. So all the operations will be on the new CEO.” Already embracing the community relations side of things, Purdue sat down with Dana Point Times, wanting to set the record straight and address some of the mistruths and misinformation that have been spread about the nonprofit’s operations.

One example Purdue gave was a charge that FAM had been delivering food to the homeless at North Beach, as well as providing three meals a day to the homeless campers staying at the city’s outdoor shelter on Avenida Pico.

“We didn’t deliver food ever, which I read in one place. Somebody sent me something that said we were delivering three meals a day, steak and wine. I go, ‘What?’ ” Purdue said.

Doing so, Purdue said, would go against FAM’s philosophy.

“We want people to come here, we want to see them one-on-one,” she explained, adding: “If somebody is homeless on our streets and they’re new here, we will not continue to provide them food. ‘We will provide emergency food today, but here’s your options.’ ”

Purdue notes that FAM’s goal has always been on homeless prevention, working with families, single parents and individuals to make sure they don’t end up living on the street.

“Most of the people we see are people trying to not become homeless,” she said.

“Ninety-five percent are trying not to become homeless.”

While FAM will provide food and family shelter assistance for a time, Purdue stressed that those seeking help need to be willing to come up with a plan that’ll get them out of their current predicament. For many, that often means they’re struggling to pay their rent and bills for a myriad of reasons.

FAM, she added, doesn’t just offer housing and food assistance, it encourages clients to become self-sustaining.

“Your goal isn’t shelter; your goal is eventually to help people become independent in housing,” she said. “But shelter sure helps to keep someone safe temporarily while they’re working on a plan to get permanently housed, and they have to do the work.”

One program FAM offers that has been successful in helping the homeless is its Homeward Bound initiative, reuniting individuals with their families and friends, or any other support system they may have.

Purdue cited several examples of the program’s success, which she said has reunited 86 people with their loved ones since 2016. Most recently, the city asked FAM to provide its Homeward Bound assistance to two of the remaining individuals who had been staying at the Pico encampment before it closed last month.

“A lot of people have transition years,” Purdue said of her interaction with some of FAM’s clients. “So, let us help you get back to your family or friends, but have a plan and work the plan. It’s not the end-all.”

Regarding the false statements about FAM, Purdue said she doesn’t understand why the community isn’t working together to fulfill a common goal when it comes to homelessness.

“I don’t know why we’re not all rowing together,” she said. “We should be. We all have the same goals.”

Despite the negative comments, Purdue acknowledged that most in the community, city officials and, most importantly, the volunteers know exactly what FAM does. Reflecting on her time as CEO, Purdue praised the work of FAM’s staff and volunteers, as well as other individuals and groups that helped make FAM a successful nonprofit.

“You don’t do it alone,” she said. “It’s done with a wonderful board of directors and great staff who are so talented and all those volunteers in the community.”

Getting Clean City Uses Legal Methods to Clean House When it Comes to Sober Living

he City of Dana Point closed down the operation of three unlicensed sober living homes this month.

As of Monday, Jan. 13, three homes operated by New Method Wellness had been cleared out and placed under the control of a court-appointed receiver, an event that one of the operators describes as unbelievably sad. Sober living homes have been a controversial topic among residents and local officials.

“In response to community concern regarding homes associated with the treatment of drug and alcohol abuse in residential neighborhoods throughout Dana Point, the City of Dana Point’s Code Enforcement team, in association with the City Attorney’s office, began a long-term project to understand how these homes were operating in the South Orange County region,” a city statement said.

It was determined that some homes in Dana Point obtained a California State license through the Department of Health Care Services and were inspected and regulated by the State of California. Under those circumstances, the city must treat the property as a standard residence as long as the home has six or fewer residents.

But according to the city, other homes were found to operate in conjunction with a commercial facility, which acted as the licensed center with patients being transported from unlicensed and uncertified homes throughout Dana Point.

“With patient safety in mind, the city contacted homes that appeared to be operating Residential Recovery Facilities in residential neighborhoods without the proper state licensing and certification,” a city statement said.

The city’s code enforcement division allegedly informed the operators of the homes in question that if they were providing treatment to their residents, they needed to provide evidence that they held a state-issued license or immediately cease operations.

According to the city, several sober living home operators contacted staff and cooperated with code enforcement to obtain the proper state license, while others ceased operations.

“Unfortunately, several simply refused to comply with the law,” the city statement said.

owners and operators that city staff determined were not complying with the law.

On Feb. 21, 2017, the city filed a complaint against New Method Wellness. The complaint alleged that New Method Wellness was operating three properties within the City of Dana Point as alcoholism and drug treatment facilities without state-issued licenses, as required by the California Health and Safety Code.

The complaint argues that although New Method Wellness has a state-issued license to operate a treatment facility in San Juan Capistrano, the three residences in Dana Point were an integral part of the program and, therefore, needed separate state-issued licenses.

Dana Point brought this nuisance action on the grounds that this use of the properties is not authorized by the relevant zoning ordinance.

The court ruled in favor of the city requiring New Method Wellness to obtain a state license or cease operations in July 2018. This initial judgment was appealed

by New Method Wellness. The Court of Appeal upheld the decision and issued a published opinion in Aug. 23, 2019.

“The court found the homes were being used as part of the drug treatment facility and issued an injunction,” the opinion stated. “The evidence showed the Properties are advertised as part of the drug treatment facility, the residents’ lives are highly regulated, defendant NMW Beds, LLC (NMW Beds) imposes 24-hour super-

vision, provides transportation to defendant New Method’s drug treatment facility, and recovery treatments are offered at the Properties.”

The court found that this use of the Properties is not authorized under Dana Point’s relevant zoning ordinance, nor under any exception to the zoning ordinance, and thus it constituted a nuisance per se.

According to the city, after the judgment and the appeal, New Method Wellness continued not to comply with the law.

City Attorney Patrick Muñoz applied to the court for the appointment of a receiver to uphold the court’s judgment.

The request was granted on Jan. 2, and the receiver inspected all three New Method Wellness homes on Jan. 7.

“The home inspections revealed that the operators appeared to have jammed as many beds into the single family residential home as possible. Some homes had as many as 13 beds,” a city statement said.

The statement goes on to say that this confirmed city staff’s belief that the operator ignored licensing requirements in order to avoid being limited to six or fewer residents.

“Our houses were not licensed,” said Susie Hopson-Blum, owner and founder of New Method Wellness. “But we were not doing treatment. The City of Dana Point said we were doing treatment, but we weren’t. We have 24,000 square feet of office space in San Juan Capistrano where treatment is done.”

Hopson-Blum confirmed that there were, indeed, 13 beds in one residence, but that there had only been eight residents living there.

According to the city, the receiver has been working with the city and New Method Wellness’ legal counsel to ensure that residents at all three of its facilities were given sufficient notice to find other lodging, treatment centers or return home.

“They gave us 72 hours to get clients out. These clients are sick, they have behavioral issues, we tried to tell them and they didn’t care,” Hopson-Blum said. “I just hope to God that this event hasn’t further added to their trauma.”

According to city staff, the facilities received a letter to vacate that was addressed on Jan. 8 and required clients to be out by Jan. 13. One residence, on Calle Ramona in Capistrano Beach, is 4,391 square feet with four bedrooms and 12 beds in it.

One residence on Calle Hermosa is 4,169 square feet with five bedrooms and 13 beds in it. A Camino Capistrano house is 4,679 square feet with six bedrooms and 13 beds in it.

“We own these homes,” Hopson-Blum said. “For them to do this is really sad. We treat both the addiction and the mental illness, and we do a good job. We run a tight ship. We’re not one of those houses where people call all the time. We did nothing wrong.”

For now, the homes remain under the control of the receiver, who will continue to take such action as is necessary to ensure they do not reopen in violation of the court’s judgment.

As of press time, the city and legal counsel representing New Method Wellness had a court date in which New Method Wellness tried to have the receiver dismissed since the residents were cleared out.

Muñoz opposed and asked the judge to clarify the receiver can sell the properties to ensure the same situation does not reoccur. The receiver was not discharged, and there are plans for the properties to be sold.

City staff says it is also aware of four unlicensed residential recovery facilities that continue to operate, and are in active litigation with those facilities “in an effort to compel them to comply with the law.”

“If I wasn’t a person that believed in hope no matter what, then I wouldn’t be in this business,” said DeAnna Crosby, the clinical director at New Method Wellness.

“So I will continue to search for ways to help addicts.”

A total of 19 residents were displaced over the weekend, and Crosby says she’s grateful for all the people who came together to help make sure they could find shelter.

SDG&E Explains Time-of-Use Plans SDG&E officials explained their Timeof-Use plans and billing rates during a community forum on Thursday, Jan. 9, at the San Juan Capistrano Library. Assemblymember Bill Brough hosted the forum, introducing the SDG&E representatives.

Different plans have different rates, with 4-9 p.m. considered peak hours of use when energy costs can be higher. Users can save costs if they reduce energy use and use energy outside of those peak hours. Some SDG&E users have already begun transitioning to Time-of-Use plans.

For instance, under the TOU-DR1 plan, typical baseline off-peak rates Monday through Friday would be 25 cents per km/h (kilometers per hour). Users going above 130% of their baseline would be charged 33 cents per km/h.

Typical on-peak rates Monday through

Friday would be 27 cents for the baseline and 34 cents above 130% of the baseline. Baselines vary depending on several factors, including the climate zone and number of days in a billing cycle.

Local Republican Group Hosts 2020 Candidates for Q&A The San Clemente Area Republican Women Federated recently hosted its monthly luncheon, where it featured several of the Republican candidates running for office in this year’s elections.

At the group’s Jan. 8 luncheon, San Juan Capistrano Councilmember Brian Maryott, who is campaigning to unseat Democratic incumbent Rep. Mike Levin for the 49th Congressional District, was among a slew of other local officials who are also currently seeking either reelection or higher office.

The group of candidates also included Mission Viejo Councilmember Greg Raths, Laguna Hills Councilmember Don Sedgwick, Yorba Linda Councilmember Peggy Huang and special education teacher Rhonda Furin. Those four are challenging Democratic incumbent Rep. Katie Porter for the 45th Congressional seat.

Laguna Niguel Mayor Laurie Davies and Mission Viejo Councilmember Ed Sachs, who are vying for State Assemblymember Bill Brough’s seat in the state’s 73rd Assembly District, also attended the luncheon.

Each of the candidates made a presentation as to why he or she should be voted into office. Following the presentations, each candidate participated in a Q&A session.

Next month, the SCARWF will feature more 2020 Republican candidates at its luncheon.

I

t’s a new year, and there’s so much to look forward to in 2020 and lots to be thankful for from last year, but the song remains the same. Personally, I want to give back to our community, encourage others and help share unique perspectives through art, music and cultural history.

Thank you to my fellow Commissioners and to our City Council for allowing me to serve as Chairperson of the City of Dana Point Arts and Culture Commission in 2019.

I’m really encouraged and proud of the things we’re working on, such as a Utility Box Art Program, Art Displays in the Community Center and Council Foyer and the big one, Art Inclusion in the Master Plan. My fellow Commissioners inspire me with their commitment, and we’re in great hands working with the City’s Kelly Reenders and DyAnne Weamire and our new Chairperson, Janie Raub.

Mayor Viczorek’s vision statement for 2020 made me sad and frustrated.

What survey? It also concerns me that our once-charming surf town with its once Aloha spirit and pride of community is now more quantity then quality. How he thinks turning South County charm into Irvine quality is baffling.

We have watched old historic buildings being torn down, and parks sold off behind closed council doors. Council meetings only seem to be a formality of the job,

Martin contributes original music to CBS’ NCIS: New Orleans, was heard on Raw Craft with Anthony Bourdain and appeared in the HBO series about post-Katrina New Orleans, Treme. Martin also works as an instructor for incarcerated youngsters through the prestigious Preservation Hall Foundation.

We asked Martin a few questions, leading up to the Music Preserves anniversary event:

Q: What was it that connected you to Music Preserves Foundation and our mission to inspire and educate our community through the preservation and presentation of music?

A: I believe that music education is important

and often underappreciated, and I love the work that the Music Preserves Foundation does. Music education stimulates brain development, encourages working together such as in a band environment, and can create a sense of goal and achievement. Music brings people together. I see that in the New Orleans community; music crosses so many boundaries to bring us all together in the streets, at the festivals, at the parties, and in the clubs.

Visitors once came for our charm and rich history, tall ships, whales, surfing and active, healthy lifestyle. Now they see very little charm here and keep going south to San Clemente, which has kept the history and quality of life.

Unlike Dana Point, which has torn down our history and removed the surf lifestyle communities, leaving us with pictures of our past and statues of the surfing pioneers that placed us on the map.

We need our tax dollars to work for us and our council to do the same; put community first. Align with cities like San Clemente, Santa Barbara, Santa Cruz, etc.

Stop wasting funds on design teams and stop rehabs advertising and recruiting to

Q: Music Preserves Foundation supplements fifth grade U.S. History with American Music History (piloted in Capistrano Unified School District) and also brings high school music students backstage to meet artists at local music festivals such as OHANA. Why are these perspectives important to share with kids and the community-at-large?

A: Music is one of America's greatest

exports to the world, and I think it's great that American Music History is offered to students. Being able to meet the artists is a really cool way to introduce children to the possibilities and the realness of a career in music. Most artists I've met are really supportive and encouraging to young musicians.

Having an artist that a young musician looks up to give them advice and inspire them directly is powerful.

Q: You do wonderful work with incarcerated youth via the Preservation Hall Foundation.

Can you share what that means to the kids and to you?

A: I feel like one of the ways to disrupt the cycli-

cal nature of crime is to expose at-risk youth to possibilities that their environment may not be able to provide them. My work teaching incarcerated youths is small, but maybe a child leaves my class and thinks, "I like that. I want to learn more," or "maybe there's another way," or "maybe I could have a career in music." If I can inspire positivity in someone through music, that's the least I can do to help my community.

Our quality of life has diminished, and our council seems out of touch for California coastal lifestyle.

New Mates’ Family Threatened by Potential Loss of Inheritance

n Sunday, Jan. 5, my partner, Greta, and I thoroughly enjoyed the movie, Knives Out. As we settled into our seats, I had no idea the movie would inspire my first column of 2020.

Why did it?

The movie, a humorous, modern-day, Agatha Christie-type of murder mystery, focused on estate planning and how family members can be greedy over their inheritance.

The movie coincided with an email I received from a woman who had similar estate distribution issues with the daughter of the new man in her life.

The woman requested to remain anonymous.

She met a widower on an Internet dating site who lived 500 miles from her.

Her family and friends, in her words, “gave him the seal of approval.” Her children were happy for her.

She added, “The only regret I have about the decision to move to his home is that I didn’t meet his daughter, his only child, before I made the move and didn’t talk to him about his relationship with her as much as I should have.

“While he and his daughter lived 10 minutes from each other, she had a demanding job and they didn’t see each other often. I assumed their relationship was closer than it is.

“Before I moved, I asked him if he had asked his daughter how she felt about me moving into the home where she was raised and where her mother had lived.

“His daughter told him she had no objection and thought it made sense and wondered why we hadn’t talked about doing it sooner.

“However, a red flag was raised the first week I lived with him, as his daughter asked him to meet with her privately. The discussion centered around money. He assured her that we were keeping our finances separately and she would not be affected financially by our partnership.

“A short while later, he and I met with the daughter and her boyfriend. During the outing, he mentioned that he had made a slight change in his will to provide funds for me to return to my home should he predecease me.

“That news seemed to be the catalyst for her subsequent alienation/estrangement.

He has had no contact with her in more than two years. It’s a very sad situation for them and affects me as well.

“So, I encourage seniors to thoroughly investigate family relationships that a potential partner has, to understand what the possible repercussions might be in making a

long-term commitment.”

Tom concludes: Finding love later in life can be a wonderful thing. But remember, when children or other family members are involved, tread lightly regarding the subject of inheritance distribution.

And be particularly cautious about saying the words to your beneficiaries, “I’ve made a slight change in my will.”

As we see from this woman’s story, and from the film Knives Out, those words, or

similar words, can cause chaos.

Fountain of Youth Young DHHS girls water polo team bonds ahead of league

A

scoreboard equipment issue before the Dana Hills girls water polo team’s game on Wednesday, Jan. 15 turned out to be the most encouraging moment of the season for coach Carrie Pierce.

There was an issue with the game and shot clock that necessitated Pierce to retrieve a new antenna for the clock in Lake Forest just 90 minutes before Pierce normally gets to the pool to set up and organize the team.

This unplanned errand ended up being a test of sorts for the Dolphins’ three junior captains to lead their young team, a team with only three seniors in its ranks.

“I told my captains I wanted to focus on our team chemistry going into this game,” Pierce said. “That was a moment for me where I had to let go and say, ‘Captains, you’re in charge. Get the group ready.’

And they were ready to go.”

Dana Hills (7-5) dominated early against Mission Viejo and cruised to a 12-4 win.

The Dolphins took the play straight to the front of the Diablos net and established themselves quickly.

“That was probably the most intensity and passion they had coming out in that first quarter,” Pierce said. “That’s what

I remember about last year’s group, and that’s what we’ve been missing.”

Last year’s Dana Hills team was the most successful in program history, with a run that included the Dolphins’ first CIF-SS championship game appearance after playing in only their second CIF-SS semifinal.

The Dolphins graduated eight seniors, but that team was also packed with impact sophomores who have taken leadership roles as juniors, such as captains Kat Bescanceney, Ashley Bellavia and Emma Mason, as well as leading scorer Paige Riester.

Those captains are tasked with passing down that experience of a run to the final to another strong group of young players including a sophomore goalkeeper in Madi McGowan and a group of four freshmen who are either starting or coming first off the bench.

“Last year’s group was so close,” Pierce said. “It’s always hard to rebuild that culture. To get these freshmen to buy into the legacy that was before them, having the best season in school history, it’s hard to be right behind that group, but I think they’re showing all the signs of being willing to go even further than last year’s group.”

Those four freshmen—Paige’s sister, Sadie Riester, Kate and Emma McCulloch and Claire Berger—are taking to the task quite well and are among the Dolphins’ top scorers.

With junior leaders, a hearty group of impact sophomores and freshmen, a strong work ethic and a goal to push farther than the group before them did, it all portends to a strong future for the Dana Hills program.

That’s not to forget the here and now.

Wednesday’s game against Mission Viejo was the final tune-up before South Coast League play begins.

With a move up from Division 4 to Division 3, Dana Hills has played a tougher schedule in its nonleague schedule, but Pierce is happy with where the team is ahead of its league opener at Tesoro on Tuesday, Jan. 21.

“We’ve spent the beginning of this season establishing who we are as a group,” Pierce said, “and establishing our offensive system, defensive system and getting ready to play San Clemente and El Toro.

I feel that we’re making the right steps.

We’re doing everything we need to be doing: coming through in close games, playing physical teams so that we’re ready for El Toro or San Clemente.”

As it was last year, there is only one round of league play before the league tournament, so league teams play only once before that bracket format.

Last season, Dana Hills played both El Toro and San Clemente on the road and lost both matches. At the league tournament at San Clemente, the Dolphins beat El Toro to advance to the final against San Clemente, which the Tritons won.

This year, Dana Hills will host El Toro on Jan. 28 and San Clemente on Jan. 30 ahead of the league tournament, which is played at the league-leading school at that point.

“This year, having them at Dana, it’ll be huge,” Pierce said. “It’ll be really good for the girls’ morale, being on our home turf.”

Dana Hills can attack league now and prepare for another playoff run, and no matter the results, the future remains bright for the Dolphins program. DP

Boys Basketball Bounces Back The Dana Hills boys basketball team (14-6, 1-2) earned its first league win over Laguna Hills, 6134, on Wednesday, Jan. 15.

The Dolphins had lost their first two games of Sea View League play in similar fashion, with a 4632 loss to Tesoro and a 45-37 loss to San Juan Hills.

The Dolphins continue at El Toro on Friday, Jan. 17 and play at San Clemente in a nonleague game on Wednesday, Jan. 22.

Boys Soccer Even in League The Dana Hills boys soccer (4-8-1, 1-1-1) evened up through the first three games of Sea View League play.

The Dolphins grabbed their first win of Sea View League play with a win at Trabuco Hills, 2-1, on Wednesday, Jan. 15. Dana Hills tied at reigning league champion Aliso Niguel, 2-2, and opened league with a 3-0 loss to Tesoro.

If these requirements are not met, the AGENCY reserves the right to determine any and all bidders non-responsive, and reject any and all bids on this basis. These requirements are due to the critical nature of the work and the need for the AGENCY to insure adequate experience is provided to complete the project.

11. SELF PERFORMANCE: In accordance with Section 2-3.2 of the Project Specifications, CONTRACTOR shall perform or provide, with its own organization, contract labor, materials, and equipment amounting to at least 50-percent of the Contract Price. CONTRACTOR’S attention is directed to Section 2-3.2 of the Project Specifications for additional requirements pertaining to “Specialty Items”. The City may deem bidders non-responsive if this requirement has not been met.

12. RIGHT TO REJECT BIDS: The AGENCY reserves the right to reject any or all bids, to waive any irregularity and to take all bids under advisement for a period of 90 days.

13. PROGRESS PAYMENTS: The AGENCY will deduct a 5-percent retention from all progress payments as specified in Section 9-3.2 of the Project Specifications. The CONTRACTOR may substitute an escrow holder surety of equal value to the retention. The CONTRACTOR shall be beneficial owner of the surety and shall receive any interest thereon.

14. ast week, I ran into old friend Dino Andino at the Ole Hanson Swim Club. I know he likes to be kind of sneaky and dip in and out, but it was good to catch up and see him getting after it in the New Year.

Last season, his son, Kolohe, finished No. 5 in the world. He qualified for the U.S. Olympic team and will presumably be surfing in the Olympic Games this July and August. In an already stellar career, this was a personal best. Pops has a lot of which to be proud.

In the spirit of the New Year and resolutions and such, Kolohe says that Pilates, a specific diet and a lot of surfing are the cornerstones of his fitness routine. Dino likes the pool.

I can personally attest to the power of Pilates—or at least I better be able to, considering that my wife owns a Pilates and yoga studio in San Juan Capistrano. At present, I’m 43 years old, and I honestly believe regular Pilates sessions have saved my surf life.

But if you’ve been reading this column for a while, you may know that I’m first and foremost a swimmer. I try to make it down to Ole Hanson every day at lunch for a swim.

As I told Dino last week, “It’s the fountain of youth.”

And as I was pondering what to write this

week, I thought about doing a long-range surf outlook. Unless you’ve got wheels and time to get somewhere with a little more swell exposure, expect to sustain your surf appetite on a steady diet of waist-high waves. Looking at Surfline’s two-week outlook, it’s going to be slow goings for a while.

So, what do you do if your New Year’s resolution was to surf more? Here’s the drum I’ll keep beating: now, more than ever, is the perfect time to get in the pool (or take a Pilates class). There’s sure to be some swell later in the season, and keeping the rig tuned is imperative.

To take all of this full circle, a lot of times I talk to folks, and they don’t know where to get started with a swim workout. Easy.

Some years ago, Kolohe was injured, and

Dino asked me to put a few swim workouts together for him so he could stay active in the water. Happily, I obliged.

I recently found those workouts, so, in honor of seeing Dino at the pool, New Year’s resolutions, flat spells and getting ready for the next swell, what follows are the workouts I gave to Kolohe. It’s a great starting point even if you don’t swim regularly.

None of the workouts should take more than an hour. The key to it all is consistency.

Making a regular appearance at the pool is paramount, but hopefully it’s a nice break in your day. It’s a chance to put your head underwater, get away from phones and emails for a while, and refresh the mind and body.

y favorite thing about surfing is definitely being out in the water with my friends and always encouraging them,” says 11-year-old San Clemente ripper Kai Finn.

And he’s right, teamwork makes the dream work. A good time in the water’s not just about the waves you catch, but the company you keep and the stoke you share.

“I love seeing my friends and other people get a sick wave and come back out super stoked,” Kai says. “This is my favorite thing about surfing, because it’s super cool to see other people super stoked out Dana Point Times January 17-23, 2020

on surfing!”

Kai’s been surfing since he was 3 years old. His pops taught him how at San Onofre. These days, he goes to Shorecliffs Middle School, and when he’s not hammering the homework, you’ll probably find him out in the lineup with his crew at Lowers, T-Street or Cottons.

“I think that in the next 10 years surfing will take me to many great experiences in all kinds of waves all around the world,” Kai says about what the future may hold for him. “I think I will continue to stay positive, stoked and keep encouraging other kids, and hopefully that will take me far in my surfing career!”
