Parent informational meetings, or “Kindergarten Roundups,” will be held at each elementary school from the end of January through February. First Gray Calves of 2019 Spotted in Dana Point THE LATEST: A cow-calf gray whale pair was seen near Dana Point Harbor on Friday, Jan. 11 by Captain Frank Brennan, with Dana Wharf Sportfishing & Whale Watching. It was the first calf sighting in Dana Point for the New Year.

The calf was estimated to be about 15 feet long, according to the Gray Whale Census at Point Vicente. It’s believed that the calf was a week to two weeks old, as indicated by how the calf is swimming and taking breaths.

WHAT’S NEXT: Gray Whale season began in November and continues through March and April, as they make their long migration down to the bays and lagoons in Baja California.—Lillian Boyd

First City Council Meeting of the Year WHAT’S NEXT: The first Dana Point City Council meeting of the year addressed 24 items on the agenda and ran past midnight, lasting more than six hours.

In a closed session, city council went over an update on unlicensed residential recovery facilities with legal counsel to address existing litigation. After reconvening, the meeting began with City Manager Mark Denny delivering a presentation on sober living homes versus unlicensed residential recovery facilities.

According to the presentation, unlicensed residential recovery facilities are sober living arrangements for persons recovering from substance abuse, with no license requirements and cannot be regulated. Sober living homes do not have the ability for local regulation. Denny clarified the city’s stance on a guide released by the U.S. Department of Housing and Urban Development and the Department of Justice.

“It was circulated as a positive guide on what cities can do to regulate sober living homes,” Denny said. “In reality, it’s a summary which embraces all limitations cities have experienced and sets forth the HUD and DOJ’s position on group homes.”

The City of Dana Point is currently involved in 15 legal cases involving allegedly unlicensed residential recovery facilities and is named as a defendant in two lawsuits.

services monthly report, a development update, a comprehensive annual financial report for the previous fiscal year, recruitment for the planning commission and traffic improvement subcommittee, 2018 community survey results, long-term financial planning and budget priorities, city council-appointed representatives and city commissions, committees and subcommittees and task forces and several items placed by Councilmember Debra Lewis.

A five-minute break was called before the last item on the agenda, which was brought forth by Mayor Joe Muller to address how items are placed on the agenda.

According to Policy 201, the councilmember initiating action shall ask the city clerk to place the item on the agenda under a heading other than council comments and written material regarding the item shall be provided by the councilmember one week and one day before the meeting.

Councilmember Richard Viczorek pointed out that Policy 208 calls for the mayor to set the agenda, which directly contradicts Policy 201.

Several speakers came to the podium during the public-comment session, urging the council to continue allowing members to add agenda items, echoing sentiments that attempts to limit how council members placed items on the agenda were an attempt to silence the minority.

“I don’t appreciate that there’s a conspiracy theory circulating on social media that I’m trying to silence councilmembers.

I brought this forward because, plain and simple, we are a divided council. If we can’t even pick up the phone to call the mayor about placing an item on the agenda, how are we supposed to work together?” Mayor Muller said.

Councilmember Lewis called to continue allowing for members to place items on the agenda through city staff but to also reach out to the mayor when doing so. No action was taken on the matter other than verbal agreement among members to communicate more openly and respectfully.

First Coffee Chat Guest of the Year Announced THE LATEST: The Dana Point Civic Association will hold the first “Coffee Chat” meeting of 2019 on Friday, Jan. 25 at 8:30-10 a.m. at Jim Miller’s Coffee Importers. The guest speaker will be Dana Point Mayor Joe Muller, who will be presenting an update on the city and plans for the future.

Coffee will be complimentary, courtesy of Coffee Importers. All are welcome to attend.

CUSD Extends Kindergarten to Full Day THE LATEST: Beginning next school year, kindergarten classes across all elementary schools will go from half-day sessions to full days, the Capistrano Unified School District (CUSD) announced on Wednesday, Jan. 16.

“Both CUSD and the Capistrano Unified Education Association recognize the benefits in partnering to enhance student academic and social achievement,” CUSD Superintendent Kirsten Vital said in a press release.

The decision to extend the schools’ kindergarten programs was based on several studies that found full-day kindergartens benefit the students as well as teachers and parents.

A 2005 policy brief published by the educational research organization, WestEd, reported that full-day kindergarten programs help prepare students for primarygrade learning and could enhance “social,

Holtec Defends Its Spent Nuclear Fuel Canisters at NRC Violation Conference THE LATEST: Krishna Singh, Ph.D., defended his company’s response and corrective action at every turn during a Nuclear Regulatory Commission hearing on Wednesday, Jan. 9 intended to examine two violations alleged by the commission.

Singh, the president, founder and CEO of Holtec International, Inc., which is providing the dry-cask storage of canisters at San Onofre Nuclear Generating Station (SONGS), addressed what happened when it was discovered some of the pins that help with helium circulation to keep the canister temperatures lower had been bent or broken off.

The violations stemmed not necessarily from the shim pins breaking off or being damaged but the designs that the NRC officials said were not submitted when it made the change to its canisters in 2016.

Holtec came to the table ready to accept most of the terms of the NRC’s violation findings but disputed that they merited major enforcement.

“We wanted (to harness) the same kilowatts out of one canister, and that motivated us to build the shim stand-off,” Singh said, describing the design as engineering “greed” to get the most out of the canisters.

Although the broken shim pins did not cause one of the canisters stored at SONGS to exceed maximum temperatures, the canister did get hotter, according to Holtec’s own analysis of the situation.

WHAT’S NEXT: On Thursday, Jan. 10, the NRC announced that it would discuss preliminary findings on the Aug. 3 incident involving a canister at SONGS that was stuck on an outer ring while being loaded by contractors, during a webinar with Holtec on Jan. 24.

South Coast Singers Accepting Applications for Competition The South Coast Singers have begun accepting applications from Orange County high school students wishing to audition for the 2019 Stars of Tomorrow competition.

The annual event gives high school vocalists from any Orange County high school, public or private, an opportunity to compete for scholarship money in two categories: classical and musical theater. More than $5,000 in prize money will be awarded.

Students of all high-school grade levels are welcome to apply. Applications must be turned in no later than 11:59 p.m. on Saturday, Jan. 19.

South Coast Singers will hold preliminary auditions for the applicants on Saturday, Jan. 26 at Capistrano Valley High School.

South Coast Singers is encouraging students to “choose a song that best reflects your musical interests and showcases your individual talent.”

Applicants are allowed to sing one song from each category, but if selected as a finalist, they’ll only compete in one category. Songs should also be limited to four minutes.

About 18 applicants will be selected as finalists to perform in the annual vocal competition, which will be held Sunday, March 10 at Capistrano Valley High School’s Performing Arts Center.

Local Red Cross Seeking Nominations If you know someone who has saved a life, helped a neighbor in need, or made a difference in Orange County, the American Red Cross Serving Orange County is accepting nominations for people who demonstrate “extraordinary courage.”

The Orange County Heroes Luncheon honors local individuals who have made a personal commitment to creating safer and stronger communities and providing help when disaster strikes—in Orange County and beyond. Award recipients will be honored at the event on Friday, May 3 at Hotel Irvine.

“Orange County is home to many whose deeds of courage often go unnoticed,” said Linda Voss, Regional CEO of the American Red Cross Desert to the Sea Region, in a press release. “We need the public’s help to identify everyday heroes in our community who we can recognize for their contributions.”

Red Cross is accepting nominations for the following categories: Animal Welfare Hero; Community Hero; Corporate Hero; First Responder; Gift of Life Hero; Service to the Armed Forces Hero; Water Rescue Hero; and Youth Hero. Heroes are nominated by the public and are chosen by an awards selection committee.

All nominees must work or reside in Orange County. The heroic act may have occurred elsewhere, but must either be an ongoing commitment to the community for more than one year or have occurred 12 months preceding the Heroes event.

Nominations are due by Friday, Feb. 15.

DHHS Girls Soccer Holding Rummage Sale The Dana Hills High School girls soccer team is hosting its annual rummage sale fundraiser. All proceeds will benefit the girls’ soccer program. It will be held on Saturday, Jan. 26 from 7-11 a.m. in the Dana Hills High School senior parking lot, 33333 Golden Lantern.

In previous years, there have been more than 50 families participating in the annual event, with items priced to sell.

This year, all three teams will be participating: freshman-sophomore, junior varsity and varsity.

There will also be coffee, bottled waters, snacks, donuts and bagels for sale.

Money raised will go toward uniforms, referee fees and tournaments.

The girls soccer season ends at the end of January. The team is currently competing in a tough South Coast League,

fighting to make the playoffs for a fifth consecutive season.

Sen. Patricia Bates Will Hand Off Minority Leader Role The California State Senate Republicans unanimously elected Senator Shannon Grove (R-Bakersfield) to succeed Senate Republican Leader Patricia Bates (R-Laguna Niguel) as the next minority leader.

Bates will continue to work with Leaderelect Grove as an engaged member of the Senate Republican Caucus during the transition and will stay on in a leadership post with the Caucus.

“I congratulate Senator Shannon Grove on her election to become the next Senate Republican Leader,” said Bates in a news release. “Shannon is an experienced legislator, and I have no doubt she will be an effective messenger and leader for our Caucus.”

Leader Bates succeeded Senator Jean Fuller in April 2017 as the second woman in the history of the state Senate to serve in the top leadership post of a party caucus— Democrat or Republican. She represents Dana Point as well as South Orange County and North San Diego County in the Senate.

Voters elected Bates to the California State Assembly in 1998, the Orange County Board of Supervisors in 2006 and the California State Senate in 2014.

“I am humbled by the support of my Senate Republican colleagues and value the trust they have in me to lead the Republican Caucus,” said Grove. “Senator Bates has been a wonderful leader, and I look forward to her counsel as we begin the leadership transition.

n Tuesday, Jan. 15, the City of Dana Point celebrated its 30th birthday with cake after a closed city council session. Upon reconvening, it received recognition from the Dana Point Historical Society.

On Jan. 1, 1989, the first five councilmembers were sworn in onboard the brig Pilgrim, according to a Dana Point Historical Society release.

As the 28th city to incorporate in Orange County, Dana Point is a relatively new city, but the effort to incorporate dates back to 1959, as reported in 20 years Before the Mast: A History of the City of Dana Point. The book was written by Autumn Hayner and Carlos N. Olvera, former Dana Point mayor.

The first city council sent out a request for submissions for a city seal to reflect a nautical design and after 33 submissions, Rick

Morgan’s design was selected in July 1989.

“The seal conveys our early history in a contemporary, yet timeliness way, connecting Dana’s 1835 visit to the present,” said Barbara Johannes, president of the Historical Society. “The sculpted likeness of our namesake surveys the stylized scene representing Capistrano Bay with the Pilgrim lying quietly at anchor. The sun shines above the headlands and breaking wave pays homage to ‘Killer Dana,’ the legendary surfing spot east of the Headlands until Dana Point Harbor was built in 1966.”

The gold rope surrounds the entire seal in accordance with the nautical theme

required for submissions.

“To me, the rope symbolizes the incorporation of the three seaside communities of Capistrano Beach, Dana Point and Monarch Beach tied together into the sea coast city of Dana Point,” Johannes said.

The first attempt to develop a community named Dana Point dates back to the 1920s, when the San Juan Point Corporation advertised in a booklet entitled “Dana Point and Vicinity.” One of the officers associated with the corporation was Anna Walters, Executive Manager and Sales.

Walters is the only original founding officer who remained in Dana Point, where

she built a home in 1925 and a commercial building in 1927.

The San Juan Point Corporation developed the Scenic Inn and Dana Point’s first park, now the Bluff Top Park, in the early 1920s, according the Historical Society.

Johannes presented Dana Point City Council with a proclamation celebrating 30 years since the city’s incorporation on Tuesday, Jan. 15.

“I’d really like to thank the Historical Society for taking care of our history,” Mayor Joe Muller said. “I love seeing old photographs of the city and the Dana Point Harbor. It shows us where Dana Point started, how far we’ve come, and where we are today.”

While reflecting on the 30 years of incorporation, Dana Point City Manager Mark Denny says this city is a wonderful place to create childhood memories and family traditions.

“We have a rich history and while we are excited about the future, we are also careful to protect the character of our community and what makes Dana Point so special to so many,” Denny said.

any people share their resolutions or predictions for the new year, but I’d like to start my first article of 2019 by thanking God, my family and this beautiful community for helping me find my purpose and encouraging my passion for music and the arts, so I can then nurture that same passion in others.

I have the honor to serve on the City of Dana Point Arts and Culture Commission, and was recently named chairman by my fellow commissioners. Nancy Jenkins, Karin Schnell, Janie Raub, Maria Elena Banks and ex-officio member Kimberly Williams are all wonderful examples of community service, creativity and encouragement.

If you are the mother or father of a high school athlete here in California, this message is primarily for you.

When you attend an athletic event that involves your son or daughter, cheer to your heart’s content, enjoy the camaraderie that high school sports offer and have fun. But when it comes to verbally criticizing game officials or coaches, cool it.

Make no mistake about it. Your passion is admired, and your support of the hometown team is needed. But so is your self-control.

Yelling, screaming and berating the officials humiliates your child, annoys those sitting around you, embarrasses your child’s school and is the primary reason California has an alarming shortage of high school officials.

It’s true. According to a recent survey by the National Association of Sports Officials, more than 75 percent of all high school officials say “adult behavior” is the primary reason they quit. And 80 percent of all young officials hang up their stripes after just two years of whistle-blowing.

All are welcome at our next City of Dana Point Arts and Culture Commission meeting on Wednesday, Jan. 23 at 6 p.m. in the Public Works conference room at City Hall. Additionally, all are welcome to my band Small World’s show at Swallow’s Inn on Saturday, Jan. 26, 2-6 p.m.

I know that, because last year we commissioners scoped out each of them as potential locations for art inclusion in the master plan or otherwise. This year, I’d love to help facilitate at least one major art installation, with the city council’s approval and direction, using the Art in Public Places Fund.

Why? They don’t need your abuse.

Plus, there’s a ripple effect. There are more officials over 60 than under 30 in many areas.

And as older, experienced officials retire, there aren’t enough younger ones to replace them.

If there are no officials, there are no games. The shortage of licensed high school officials is severe enough in some areas that athletic events are being postponed or canceled—especially at the freshman and junior-varsity levels.

Research confirms that participation in high school sports and activities instills a sense of pride in school and community, teaches lifelong lessons like the values of teamwork and self-discipline and facilitates the physical and emotional development of those who participate.

So, if the games go away because there aren’t enough men and women to officiate them, the loss will be infinitely greater than just an “L” on the scoreboard. It will be putting a dent in your community’s future.

Perigean spring tides are the tides that coincide with the moon's closest approach to the earth (nothing to do with the spring season). This was a contributing factor in the loss of the Beach Club, its swimming pool and the pier, which were eventually replaced by the current parking lot and basketball court. The Atlantic Coast endured the most damage (over $500 million) in 1962 by perigean spring tides.

When I lived in Fiji, they were called "King Tides," and people learned not to build in those areas.

I

t’s interesting that the two biggest foreign films of 2018 were both black-and-white, mid20th-century period pieces loosely based on the parental figures of the filmmakers’ childhoods.

The first, of course, was Alfonso Cuarón’s Roma, and the second is Paweł Pawlikowski’s Cold War. The latter finally comes to more U.S. theaters after spending the holidays in LA and NYC, following a summer European release. Cold War is one of the most dialogue-heavy, war-set films, but in the best way.

From 1949 to 1964, during the height of the Cold War, musical composer Wiktor Warski (Tomasz Kot) and vocalist/performer Zula Lichoñ (Joanna Kulig) have a passionate professional and physical relationship sporadically. The two begin their union in their home country, Poland, before settling in France. For various reasons—political and personal—the couple can’t make it work completely and settle on visiting each other at various times for 15 years.

The writer-director dedicated the movie to his parents, who served as the inspiration for his story. While Roma was a family-centered feature, Cold War is a romance. It follows Ida (2013) as Pawlikowski’s second film in black and white and also becomes some of the most stunning cinematography this past year.

Kulig is striking with her allure and delivery, with a presence that harkens back to Gena Rowlands or Cate Blanchett. Kot is just the right amount of aloof as the slightly older mentor and lover. It’s almost like an R-rated, post-WWII Casablanca (1942) for modern audiences. DP

What does Dana Point think of sidewalk vendors?

alifornia Senate Bill (SB) 946 legalized sidewalk vendors to encourage “entrepreneurship,” promote “culturally significant food and merchandise” and “dynamic public space.” Newport Beach and Laguna Beach quickly came up with many restrictions to protect “the health, safety and welfare of its residents, businesses and visitors.”

Travelers know street vendors bring life to the street, which is desperately needed on Del Prado— a charming street with quiet stores and vacant units. So I went to Del Prado to ask people if they thought sidewalk vending could help the business.

I got more than what I asked for.

Some were very upset about what has been going on in the Town Center in recent years: the constructions, the empty lots, the parking issue, the lack of governmental support for local businesses, etc. Generally, people thought sidewalk vendors could help foot traffic, but questioned which vendor would come to an empty street such as Del Prado. The overall concern about food vendors was trash or plastic litter. Indeed, sidewalk vendors are exempt from the plastic bag and plastic straw regulations, and sometimes the Styrofoam ban, too.

But is having food vendors fair to those businesses that pay rent? SB 946 prohibits local authorities from regulating sidewalk vendors on where they can conduct business, unless it is a concern for health, safety or welfare. Can the city and Chamber of Commerce lead us to address fairness as

welfare of the community?

Essentially, sidewalk vendors provided us a reason to work on the changes that have been delayed or simply avoided.

On environment, my first thought was that sidewalk vendors should not provide single-use plastics, such as utensils and bags. We cannot afford another layer of plastics on our streets and in our ocean. But is it fair to regulate only the sidewalk vendors?

in our downtown? I just wonder how many households come to downtown, spend a minimum of $250 a quarter on something other than food, other than drink.”

These are not comfortable thoughts. But we don’t have a comfortable reality. One thing clear from my conversations on Del Prado was that people didn’t want to lose the unique Dana Point identity to chain or online stores and the drive-through culture, which is also the spirit of SB 946.

It’s time to really think outside the box. As Jodi Picoult said, “Extraordinary things are always hiding in places people never

think to look.”

Boys Basketball in the Thick of League The Dana Hills boys basketball team is following through on its league mission.

The Dolphins (13-7, 2-1) have dominated in their two league wins sandwiched around their one league loss to leagueleading Tesoro. Last season, Dana Hills lost tight games in league and struggled down the stretch.

However, the Dolphins, ranked No. 6 in Division 4AA, have come out strong in the Sea View League as they head into a crucial matchup at El Toro on Friday, Jan. 18.

Dana Hills is currently third in league and one win behind second-place El Toro.

Both have one loss. Tesoro is ahead of the pack at 5-0 and considered one of Orange County’s best teams this season. The Titans dropped down from the South Coast League but might be better than any team in either of the Coast View leagues.

The Dolphins open the second round of league play at San Juan Hills on Wednesday, Jan. 23 and host Tesoro on Friday, Jan. 25.

The Dana Hills girls basketball team has jumped right back into the thick of things in the South Coast League.

The reigning Sea View League champion Dolphins (13-8, 2-1) opened league play against their longtime rival, San Clemente, on Thursday, Jan. 10. The Tritons led out of the gate and used a 17-7 second quarter to increase their lead to 14 points at halftime.

Dana Hills pushed back in the second half, but San Clemente held on, 57-48.

The loss was merely a blip for the Dolphins, who have won eight of their past 11 games, including back-to-back league games.

Dana Hills rebounded with a strong win over Tesoro, 51-43, on Saturday, Jan. 12 and a defensive win over Trabuco Hills, 37-26, on Tuesday, Jan. 15. The Dolphins held Trabuco Hills to only six points in the first half.

Dana Hills closed out the first round of league play at defending South Coast League champion Aliso Niguel on Thursday, Jan. 17. Results were not available at press time.

Right Place, Right Time Local Dana Point surfers save teenager’s life during afternoon sailboat race

T

here’s a long, colorful history of Dana Point surfers falling in love with sailboats. It goes back to Phil Edwards building an outrigger on the sand at Capo Beach, which led to Hobie Alter and Wayne Shafer innovating the Hobie Cat shortly thereafter, and so on and so forth. The tradition continues to this day and is maybe most visible during the weekly 2 p.m. Thursday sailboat races.

A few days before Christmas, Salt Creek surfer Tim Hines and his father, Emmett, who lives in San Clemente, were out racing their 27-foot boat, Island Breeze. The surf was up, the wind was down, and by all accounts it was a nice day to be on the water whether you were a sailor or a surfer.

“The waves were pretty big, but there was not a lot of wind,” Tim Hines told the Dana Point Times. “We were sailing up to the red whistle buoy, the one with all the seals on it, and since the wind was really light, we decided to sail closer to the jetty and the breakwater.”

Some decisions can only be explained as fortuitous. While the other boats took a

different tack, Tim and Emmett opted to search out another line that might provide them with more wind.

“We were actually going to turn around and head back to the harbor because there was no wind, but we decided to go a little bit further,” Hines said. “We thought we heard something. We weren’t sure what it was and decided to sail a little bit further.

Then we heard it again and thought, ‘Well, that’s kind of weird.’ So, we sailed a little bit further still. That’s when I heard somebody yelling for help.”

In an instant, their day on the water turned from a friendly race to a life-anddeath struggle.

“We took down the front sail of the boat, and I got out my binoculars and started looking around. I thought maybe somebody was stuck on the rocks at the top of the headland at Dana Point, but I couldn’t see anyone. Then I noticed a head of a kid bobbing in the water, kind of by where the lobster traps are,” Hines said. “I could hardly see him, his head was like the size of a coconut, and we literally thought the noises were coming from the beach. But there was this kid out there that kept yelling that he was sinking.”

Springing into action, Tim and Emmett pulled down the remaining sails of the boat, flipped on the motor and began to initiate a

rescue.

“Basically, we motored over to where he was, whipped the boat into the wind, threw down the swim step of the boat, and I was able to pull the guy onto the swim step and onboard. He started throwing up all over the boat,” Hines said. “We asked him what he was doing out here, and he said he was trying to swim to the boats. He had no wetsuit, just swim trunks and a rash guard on.

He explained how he’d gotten pulled out to the open water from Dana Strands in a rip current and was trying to swim out to the boats because he couldn’t get back in. The way the current was going, it pulled him all the way around the point to the other side.”

Had Tim and Emmett not been in the right place at the right time, this story would have had a much more tragic ending for the swimmer who identified himself as a 16-year-old from Irvine.

“He said he realized that once he started swimming out there, he couldn’t make it,” Hines said. “I guess he was so scared that he started swimming out to sea. And then once he realized it was too far out and was getting too cold, that’s when he started trying to get ahold of boats.

“He was lucky, because we were the last boat, and it was starting to get late. It was about 3 or 3:30 p.m. and it would be getting dark soon. So, we called the harbor patrol and we motored him towards the harbor.

We transported him to the harbor patrol boat, and they took him in and took him to the paramedics.”

Fortunately, the story had a happy ending.

“If we would have turned around before and not known, gosh, I’m just glad we were able to get him, because it was a real bad situation,” a relieved Hines said. DP

ig, chunky and cold—that was pretty much the surf report for the Toyota USA Surfing Prime Series presented by “Got Milk?” at Steamer Lane in Santa Cruz last weekend.

With wave heights hanging in the 6- to 10-foot range for the duration of the contest, just holding position in the lineup was a struggle, let alone linking together complete rides to garner scores and win heats.

And with over 100 of the best 18-and-under surfers from around the country making the commitment to show up, the level of competition proved to be as challenging as

the surf.

But 12-year-old Luke Wyler doesn’t seem to let things like pumping swell and stiff competition get in his way. Facing off against kids a couple years older, he was able to take the win in the 14-and-under division, besting fellow San Clemente ripper Dane Matson in the final.

Wyler’s been on a bit of a roll lately. At the end of 2018, he flew over to the North Shore of Oahu and made the final of the iconic Haleiwa International Open, which has been contested for 49 years.

When not traveling and competing, the probability is high that you’ll find Wyler tearing apart the peak at Lowers with his friends. After all, the kid’s Instagram handle is @lowersluke. Keep an eye out for him. He’s going places. DP
