According to a phone survey conducted from April 28 to May 10, of the 1,171 Capo Unified voters surveyed, 62 percent of respondents would definitely or probably vote “yes” or lean toward voting “yes” in favor of an $889 million bond measure to fund repairs and upgrades to district facilities. About 29 percent of residents polled would definitely or probably vote “no” or lean toward voting “no.”

Five things Dana Point should know this week Monarch Beach Makes Bummer’s List for Water Quality

THE LATEST: A recent scorecard announced Dana Point’s Monarch Beach was named one of the bummer beaches of Southern California for receiving an F for water quality.

For the first time, Monarch Beach was named No. 4 on Heal the Bay’s Bummer List.

Heal the Bay is a nonprofit environmental organization based in Los Angeles County. The beach report card is an analysis of water quality for three time periods—summer dry season, winter dry season and year-round wet weather conditions—for more than 600 locations along the West Coast.

The grades are based on daily and weekly fecal indicator bacteria pollution levels in the surf zone, according to the report card.

According to Heal the Bay, the run-off that enters via Salt Creek is treated at an on-site ozone treatment facility.

“Another factor to consider at Monarch Beach is Orange County’s water-quality sampling location was moved to point zero—where a creek or storm drain meets the water,” the statement said. “This sampling switch may have played a role in poorer wet-weather grades.”

Monarch Beach received a D on the report card back in 2005-2006, but since then has received seven A’s and two B’s.

up a Destination Marketing Organization (DMO), a style of group commonly used by cities to attract tourism.

The TBID is a special tax district that puts a $3 tax on hotel stays per night at four large resorts in Dana Point. That money is then pooled and ostensibly used to enhance tourism in the city.

The four resorts that contributed to the TBID—Doubletree Hotel, Laguna Cliffs Marriott Resort, Ritz-Carlton and the Monarch Beach Resort—have seats on the regulatory panel. Previously, the city relied on an outside marketing company to use the funds acquired through the tax, but the creation of a DMO means that the city can hire a “boots on the ground” dedicated marketing professional to use the funds, said Assistant City Manager Mike Killebrew.

The move to hire a director, Bijlani, comes after grumblings from the city that IlluminOcean, a supposed $1 million light display, did not live up to the hype nor return enough on its investment.

WHAT’S NEXT: The board directed staff to prepare a June 8 bond presentation with the goal of voting on the bond measure on June 22. Since the deadline for placing a bond measure on the November ballot is Aug. 12, the last opportunity for the board to vote on the measure would be its regularly scheduled meeting on July 20. CUSD Board Considers Placing $889M Bond Measure on Nov. 8 Ballot THE LATEST: The Capistrano Unified School District Board of Trustees gave staff direction on May 25 to move forward with preparing a June 8 presentation on the specifics of placing an $889 million general obligation bond on the November 2016 general election ballot. The bond would be used to fund more than $800 million in deferred maintenance of district facilities.

THE LATEST: In celebration of National Running Day, the Dana Point Chamber of Commerce opened its early registration for the 39th annual Dana Point Turkey Trot this week.

Turkey Trot is held by the Dana Point Chamber of Commerce in partnership with Run Racing, the city of Dana Point, Dana Point Harbor, California State Parks, the County of Orange and Dana Marina Plaza.

Dana Point Chamber of Commerce Executive Director Heather Johnston said the annual event is a big Thanksgiving

tradition for families.

“What started 39 years ago has grown to be a premier Turkey Trot in Southern California,” Johnston said in a statement.

The event has brought in donations to local charities, including the 5th Marine Regiment Support Group, Doheny State Beach Interpretive Center, Family Assistance Ministries, Second Harvest Food Bank, Boys & Girls Club of Capistrano Valley and the Veterans of Foreign Wars Post 9934.

The event brings in more than 17,000 participants and has a 5K, 10K, kids’ gobble wobble and a two-day health and wellness expo.

The event is also looking for sponsors, ranging from title sponsors to supporting levels.

Early bird registration for the 5K is $35, the 10K is $40, the combo 5K and 10K is $40, the kids’ gobble wobble is $15 and the virtual runner is $30.

CUSD Board Votes to Reconsider Mandarin Immersion Program Policy THE LATEST: The Capistrano Unified School District Board of Trustees will reconsider this fall the district’s Mandarin Immersion Program (MIP) policy, including the program’s feeder pattern, which trustees previously approved in April.

On April 13, the board voted 5-2 to approve the program’s pathway from Marian Bergeson Elementary School to Niguel Hills. Two trustees requested the middle school location be reconsidered, pointing to about $1 million in renovations that would need to be completed in order to house the program at Niguel Hills Middle School.

District staff’s recommendation in April was MIP matriculation from Bergeson to Fred Newhart Middle School in Mission Viejo, which didn’t settle well with some South Orange County MIP families who presented a petition and asked the board to consider centrally located Niguel Hills.

Following approval of the policy, another faction of MIP parents argued that the families pushing for Niguel Hills were in the vocal minority and asked for Fred Newhart to be reconsidered.

What exactly do Measure H and Measure I mean for Dana Point?

I

t might seem like Ballot Measures H and I were created solely to confuse the residents of Dana Point. With all the town hall meetings, signs posted around town, encyclopedia-length ballots, heated letters to the editor in the Dana Point Times, videos, court rulings—well, it’s OK to be confused. But in its best light, the back-and-forth between Measure H and Measure I supporters is democracy in action. So the DP Times met and spoke with the proponents and writers of each ballot issue to get the answer to this one simple question: What would it mean if either ballot measure passed?

ESSENTIAL BACKGROUND In 2004, the city of Dana Point decided it was time to redevelop Town Center— the area between Pacific Coast Highway and Del Prado, and between Street of the Copper Lantern and Street of the Blue Lantern. It had long gone underdeveloped and the city said it was hearing input from residents that it wanted a development plan.

The city initiated a planning process, which included hiring urban design consultants to study the area and make recommendations. It also involved creating a 15-member panel, called the Town Center Subcommittee, which was established by the City Council and included two city council members and one planning commissioner, among other residents and consultants.

Over the course of a year, the Town Center Subcommittee held 30 public meetings to get input into what residents wanted in the Town Center area and to share design elements as they emerged.

The city mailed meeting notices to business and property owners in the surrounding neighborhoods to get their insight into the process—in all, over 300 newspaper articles were published in local papers.

And in June 2005, the Council adopted 10 guiding principles to use going forward with the Town Center development.

Number One was to “Keep the familyoriented, beach community character of Dana Point.”

The city recognized that a “mixed-use, pedestrian-friendly environment” would encompass what they heard designers, developers and residents said they wanted.

This included the creation of pedestrian courtyards, art features, centrally located public restrooms, safety buffers between sidewalks and roads, and more. It also called to make Del Prado and PCH twoway roads.

Also notably, the city recognized that “accessible and convenient public parking is essential to the health and the vitality of the Town Center.” The original plan said that “it is expected that the City Council would acquire land in the Town Center for a centralized parking facility(ies) funded by fees from new building construction and located in a parking district.” It laid out in policy that the city would, at least, create an off-street parking district, and would also provide “opportunities for shared parking” in the area—parking spots that users of multiple businesses and residences can use. It required developers to provide parking according to existing city code (more on that later) and allowed developers to create off-site parking to

meet their parking requirements or pay to offset costs of creating their required spaces elswhere, called in-lieu fees.

And the last major thing the original plan determined was the building heights in the Town Center area could not exceed 40 feet and three stories, measured from the level of the sidewalk at the midpoint of the front property line.

This ordinance, and all its plans, which totaled about $19 million, was passed in 2008, and received approval from the California Coastal Commission, which oversees land use concerns in the state’s coastal regions. But with the economy tanking, no action was taken for many years. But eventually the city felt enough momentum and economic vitality to go forward with

the Town Center revitalization.

A development group called Majestic Partners submitted plans in July 2014 for a mixed-use project calling for the construction of 30,000 square feet of retail space and 111 residential units to be built on seven non-contiguous lots in the city’s downtown. It was the first example of the Town Center plan in action.

The Dana Point Planning Commission voted two members for and two against those plans, which included the construction of three elevator shafts that rose to higher than 55 feet and were required by the Americans with Disabilities Act to give access to the rooftop for disabled people.

The building itself was 40 feet high, but the elevator shafts added 15-18 feet more height on top of the building. The Majestic plans also called for four stories of units on the side Lantern streets.

That tied Planning Commission vote (one member was not in attendance) meant that the plans were not passed.

However, Majestic appealed to the City Council in 2014, which approved their plans by a 3-1 margin, with current Councilman Carlos Olvera and Assemblyman Bill Brough voting in favor. They stipulated that Majestic would have to pay in-lieu parking fees, in accordance with the Town Center plan, but Mayor Lisa Bartlett was the lone dissenter of the plans, citing concerns about a lack of parking.

(The Majestic project was then later acquired by the group Raintree Partners, and the development plans were modified and approved to include 32,500 square feet of retail space and 109 units.)

Then in 2015, the current City Council voted to amend the Town Center plan.

The amendment changed the name of the Town Center plan to the “Lantern District” plan. But, to much more public outcry, the city also amended its parking regulations for new development. Those changes included the allowance of non-residential projects to pay fees in lieu of providing parking spots. For non-residential units, it required two parking spots per 1,000 square feet, which may be provided offsite. And for residential units, it required one spot per 2,000 square feet, with a minimum of one parking space per unit. That is reduced from the original Town Center plan, which called for the use of existing zone regulations, which called for four spaces per 1,000 square feet of commercial space, 10 spaces per 1,000 square feet for restaurant parking, and between 1.7 and 2.7 spaces for 1-3 bedroom residential units.

That’s a lot of numbers, but the point is it was the parking plan that the city devised after it had “punted” on it in their original Town Center plan. The Majestic/ Raintree project would be the parking plan’s first test run.

But, shortly after this passage, a group of citizens filed a petition to put a measure on the ballot that would revert many of the changes made by the City Council in that amendment, while also adding a number (Cont. on page 8) www.danapointtimes.com

EYE ON DP (Cont. from page 6) of new regulations. That ballot measure, now known as Measure H, garnered enough signatures and is now on the June 7 ballot.

After it appeared Measure H would go to voters, the City Council voted in February 2016 to put up their own ballot measure that essentially codifies the changes they made in September 2015.

That’s Measure I. Since, you’ve seen the signs and heard the speeches. No small chaos ensued when a court ruled to amend parts of Measure H supporters’ rebuttal to Measure I. There was a Hitler video.

But as it stands, there are three key issues on which the two ballot measures diverge. This breakdown is in no way exhaustive, but features the key points we heard from both sides.

PARKING Measure H: Measure H would require new development to follow previous zoning regulations. A few of those were outlined above, but the zoning code includes specific requirements for many different types of buildings—hospitals, day care facilities, libraries, etc. which all have different requirements. Simply put: They require developers to provide more parking spots or pay for those spots with in-lieu fees than Measure I would.

Measure H would continue to allow in-lieu parking, and would require developers to pay $40,000 per space.

Measure I: Measure I marries the parking code approved by Council in September 2015 with the Town Center, now Lantern District, plan. That means the city will continue to seek shared parking spaces—they have acquired over 100 spaces that were previously private and made them public.

The city says it has also gained a concession from Raintree that their development will include over 100 public parking spots.

It will also follow the guidelines for parking for new development outlined on page 6.

Measure I would also call for the installation of valet stations where parking is a concern, and institute preferential parking zones (if approved by a given neighborhood) where residents can park for free with a sticker, and visitors would pay.

The city maintains that it has too much parking currently, citing a parking study they contracted, and can institute a parking district when needed, and can also look at creating a parking structure if the need develops.

For instance: Consider a development project with 30,000 square feet of retail space and 100 residential units. Half the retail is restaurants and half is other retail.

And 75 percent of the residential units are two-bedrooms, and the other 25 percent are one-bedroom units.

Under Measure H, that project would have to provide or pay for about 417 spots.

Under Measure I, that project would have to provide or pay for about 235 spots.

Some developers might think Measure H’s parking requirement is cost prohibitive, some residents might say Measure I doesn’t provide enough parking.

BUILDING HEIGHT AND STORIES Measure H: Measure H would require the maximum height of any building feature to not exceed 40 feet, plus 42” for select items like machinery and chimneys. This includes the prohibition of elevator shafts that exceed 40 feet that give access to the roof deck.

In all likelihood, developers would have to choose between adding a third floor of living space or providing a roof deck, since elevator shafts can rise to 18 feet above the roof.

Measure H also calls for the instillation of story poles at prospective development sites, which would allow the public to see how high a project would be for 20 days ahead of a Planning Commission meeting where the project would be reviewed.

Measure H would also require buildings to only have three stories—units on the ground floor on the side Lantern streets would still need to meet height requirements of an 18-foot ceiling. This is because Measure H’s floor regulations apply to all of the Lantern District streets, while Measure I only applies to development units on Del Prado and PCH. Lastly, Measure H would require building height to be measured from the middle of the lowest and highest points on the entire lot—as opposed to the middle of the highest and lowest points of the property at the sidewalk level, which is the current stipulation. This would result in starting points that are both higher and lower than current regulations.

Measure I: The current Lantern District Plan regulations for building height would be confirmed. That would mean as long as the building itself stops at 40 feet, elevator shafts can rise above it. For instance, on the Raintree project, some estimates are that elevator shafts make up less than one percent of the total roof area. This would allow developers to create roof decks on top of three- and four-floor buildings.

The city found that buildings up to 60 feet in the Lantern District do not impede views, as found in a study by Focus 360.

Measure I would also allow the units on side Lantern streets to be stacked in four stories, allowing bottom floor units to drop from 18 feet to 10 feet, but the bottom floor must still be non-residential. The city says this would encourage businesses to rent those smaller units, and incur less cost.

Measure I would measure building height from the middle point of the property at sidewalk level. This, like Measure H, would result in varying heights.

Both Measure I and H call for the enforcement of at least a 10-foot setback for buildings on Del Prado and PCH, to prevent, in theory, the “canyon” effect— where streets appear narrow because of

tall buildings on either side.

LAWSUITS AND BALLOT BOX ZONING Measure H says “Any aggrieved person or Dana Point registered voter shall have the right to maintain an action for equitable relief to restrain any violation of this Act, or City failure to enforce the duties imposed on it by this Act.” It is unclear, even to those in the city, how much litigation would be incurred by this inclusion. Currently, to lodge a complaint against development, a resident would need to attend all relevant hearings and log public complaints, according to the city. Measure H would possibly allow people to file lawsuits without going through that process.

City officials could not confirm how many zoning changes would occur under

Measure H’s regulation. However, if Measure H passes, any zoning changes would have to go to a vote of Dana Point residents, at taxpayer’s expense, and then also have to pass through the Coastal Commission. This is typically called “ballot box zoning.” That said, the city’s current parking plan, which would be codified with Measure I’s passage, was delayed by the Coastal Commission until fall or winter 2016 in order to see how the ballot measures play out.

ONE LAST THING Both measures need 50 percent of votes to pass, plus one extra vote. If both measures pass, the measure with the most votes will win. If both measures fail, then the city will continue with its current plan, which is essentially Measure I. DP www.danapointtimes.com

Letters to the Editor COUNCILMAN’S COLUMN MISSES THE MARK DR. WILLIAM PETERSEN, Dana Point

In his May 2016 “Guest Opinion,” Joe Muller, who has served as a Dana Point City Councilman just over 18 months now, offered voters his advice on Measures H and I. His misguided views are both annoying and amusing, but I would like to address a number of his particularly misleading comments (and omissions) here.

First, he notes that only 3,081 initiative petition signatures were verified by the county registrar of voters to quality Measure H for a special election. How is that relevant to anything, Mr. Muller? Only 3,081 petition signatures were verified because that was the number required to qualify the citizen’s initiative for a special election. It would have been an idle and expensive act at taxpayer cost to continue authenticating signatures once there were enough to merit a special election. When the special election requirement was satisfied, and the registrar stopped counting, I understand there were hundreds more signatures tendered to check.

Second, Mr. Muller contends that this City Council is not biased toward special interest developers because the Council denied the only variance application it has heard during his term as a Councilman.

What he doesn’t mention is that the variance application did not involve a commercial developer like Majestic/Raintree seeking approval of a major project in the Lantern District or elsewhere in the city.

Finally, he suggests that if voters are unhappy with their city council their remedy is to “work hard” and change the council members when elections are held every two years. Not really, Councilman Muller. Since the early 20th century, California voters have had other choices to register their lack of confidence in elected officials and take direct, democratic action to correct perceived abuses of authority, namely the initiative, referendum and recall processes. Indeed, many Dana Point residents (none of whom was paid for his or her efforts) worked very hard over the past year to gain the signatures necessary to qualify Measure H for an up or down vote in a special election, only to see a fair electoral process spoiled by three City Councilmen who chose to put a competing initiative on the ballot as an “informational measure.”

Measure I is nothing more than a statement of existing city law pertaining to the Lantern District, including the drastic reduction in parking requirements for development projects within that area, which Dana Point Times June 3-9, 2016

the City Council approved in September 2015. Since Measure H proposes certain changes to existing Lantern District law, especially the provisions concerning parking standards, an evaluation of, and comparison to, existing law is already built into a voter’s decision about Measure H. There was never any logical or valid reason for the city council to advance the sham Measure I as an “informational measure,” so it begs the question why the Council really placed it on the ballot in the first place?

Councilman Muller appears to have a lot to learn about government and his role as an elected official. If he continues to disrespect thousands of residents that he was narrowly elected by a slim margin of 61 votes to represent on an at-large basis, I suspect he will probably learn those lessons the hard way! Please support competent and fair government in Dana Point.

We deserve much better in our city.

BLUES FESTIVAL PARKING A DISAPPOINTMENT GEORGE STUPSKI, Dana Point

As new, part-time residents of Dana Point, my wife and I enjoyed last weekend’s blues festival very much, and would go again. There was, however, one exception to our enjoyment. We took the shuttle bus from the high school and were dismayed to be dropped off on Dana Point Harbor Boulevard, not even inside the park, let alone at the entrance to the festival. It was a long walk for some elderly and handicapped folks; we even saw a woman pushing a wheelchair all the way up the hill from the festival, to the shuttle.

We also noticed taxi cabs queuing up on the street, not allowed in either. But we saw cars going all the way in. We asked a couple of event staff members about this, and were told that the organizers had “made a deal with Uber,” and allowed their drivers in, but not any competition. If true, this is no way to encourage people to use public transportation. It also seems unfair to me in the spirit of fair competition. This needs to be corrected for next year—otherwise, good job.

I had a curious phone call this week— my caller ID said it was from Washington, D.C! The call was to encourage me to vote yes for Measure I. Now why would someone in Washington, D.C. be so concerned about what’s going on in Dana Point? That call, in addition to two cards from the California Republican Assembly, the Orange County Republican Party and the Lincoln Club saying that the Republican establishment wants me to vote for Measure I because they support it, leads

me to believe that the backers of Measure I have some shadowy politics in the Dana Point waters, making things even more fishy than usual.

My reading of Assemblyman Bill Brough’s letter on the oversized mailing this week finds that the writer makes false accusations about the Measure H voter information and does not mention anything about parking requirements of business owners and building height regulations, which Measure I would change. What do you think?

I hope that you readers will read the ballot measures’ information and think carefully when voting. I believe we need to support our local interests and keep heights of buildings low and small town parking regulations consistent with the rest of the city’s rules, by voting Yes on H; No on I. Assemblyman Bill Brough mailed color, 8-by-11, two-sided flyers to my home telling voters that a yes vote for “H” means the residents will be “satisfied with tattoo parlors, bead shops, and sober living homes being the only businesses looking to open in Dana Point.” This is not true in my opinion.

When Assemblyman Bill Brough served on the Dana Point City Council, he voted to approve the Majestic condominium project, which is now a Raintree rental project with 109 rental apartment units on 2.2 acres. This is despite the fact that the Dana Point Planning Commission had been split on the issue, rendering a no vote. These rentals projects are in the middle of the Lantern District, and do not provide adequate guest, residential or public parking.

A vote for Measure I means lowering property values due to congested, inadequate parking as a result of his vote. This will not serve Dana Point businesses or residents well.

On the other hand, Measure H supporters advocate lovely commercial shops, and restaurants, with adequate public parking and three-story/40-foot height limits as was approved in the Town Center Plan and voted on in 2008; as opposed to the high rise apartments and inadequate parking as proposed in Measure I. The city complains they do not have the money to build a parking structure now.

Had they built the parking structure in 2007 when it was first proposed in open session; this town center project would be successful and revenue positive by now without variances needed to please developers.

Vote yes on H. Vote no on I.

eighbors 2: Sorority Rising is everything that a sequel to a successful, original movie is unfortunately fated to be. That’s not to say that the movie is a complete waste of time, but it isn’t the pleasant surprise the first delivers either, especially at the box office, where Angry Birds won No. 1 last weekend. Writing partners Seth Rogen and Evan Goldberg are now back with director Nicholas Stoller to give audiences a gender-swapped take on their first raunchy, slapstick comedy, Neighbors (2014).

Two years after experiencing the nightmare of living next door to a frat house, Mac (Rogen) and Kelly (Rose Byrne) are now expecting a second baby and planning on selling their old house. The problem is they didn’t realize they agreed to an escrow period with the new homeowners, and a sorority just moved into the former frat house. Founding member, Shelby (Chloë Moretz), started the independent sorority on the grounds to party as hard as the frats can. Former frat boy Teddy (Zac Efron) is also back, and on the girls’ team.

Dave Franco, Carla Gallo and Lisa Kudrow also return for appearances.

Neighbors 2 has many funny moments, particularly with all the returning actors, including an amusing Hannibal Burress cameo. But storywise the film is redundant with its structure and plays it safe. Moretz’s character’s motives are virtually the same as Efron in the original, and the parents haven’t made any development. Particularly uncomfortable are the large amount of inappropriate jokes aimed at the characters’ kids.

For a good Rogen-Goldberg romp, we might have to wait for Sausage Party. DP

Dana Point Veterans Honored During Annual Service

ith the Pacific Ocean as a backdrop, more than 40 Vietnam War veterans stood proudly waiting for their name to be called during Dana Point’s annual Memorial Day service on Monday morning at Pines Park.

The veterans stood shoulder to shoulder, with American flags blowing all around them, had their names called and a pin given to them by members of the city, while family members and Dana Point residents cheered and clapped.

The annual event, which had a special dedication for Vietnam veterans, marked the 50th anniversary of the Vietnam War. “Today, we honor those who have fallen in the defense of our country,” said Dana Point Mayor John Tomlinson.

In the audience, filling every seat, hundreds of residents and family members waved American flags, had Buddy Poppies pinned to them, and clapped as veterans from the Vietnam War, World War II and also those who served in Iraq, Afghanistan and the Gulf, stood to be recognized.

this year’s master of ceremonies and led the service, which included speakers, the presentation of colors and a gun salute.

“Sacrifice is meaningless without remembrance,” Manes said. “Whether done individually or collectively, it’s the thought that counts.”

The keynote speaker, Col. Michael J. Borgshulte, United States Marine Corp., told the audience he was honored to be the speaker for a second time.

Borgshulte has served in Okinawa as well as in Iraq and Afghanistan and has been awarded the Bronze Star Medal, the Defense Meritorious Service Medal, and multiple Strike/Flight Air Medals.

“We should do this and honor our warriors every year and not just on this day but every day,” Borgshulte said.

Borgshulte was the city’s speaker six years ago after he returned from a tour, and told the crowd about the Marine Corp.’s Core Values, challenging everyone to follow those beliefs.

“I present you with a challenge, to be a great American,” Borgshulte said. “Your presence honors those who have given their last breath to defending this great nation. I present you with a challenge, to be a great American, your country needs you. “ The service also included the presentation of colors by the Marine Aircraft Group 39 from Camp Pendleton and VFW Post 9934 Color Guard, TAPS by David Longoria, and the invocation as well as the benediction by Col. Tyler S. Guy, Chaplain, U.S. Air Force and senior pastor at South Shores Church.

During the roll call, fallen soldiers’ names were called, and a bell was rung after a member in the audience yelled “no response.” Dog tags and flowers were placed below a helmet and combat boots for each of those members.

“This is one small way we can honor those who have made the ultimate sacrifice so that we could have freedom today,” said Phil Jimenez, commander of Dana Point VFW Post 9934. DP

OBITUARY

C. MARSHALL PAYNE

Long time Dana Point resident Charles Marshall Payne, 79, died at his home on Pequito Drive May 24th.

Marshall first established Dana Point residency in 1976, living on a sail boat in the marina.

He then moved to Pequito Drive in 1978 where he soon became the unofficial “Mayor of Pequito Drive.”

He was born April 28, 1937 in South Pasadena, the son of Charles Farrell and Helen Gray Payne. A 1955 graduate of South Pasadena High School, Marshall held a Bachelor’s degree in Engineering from Arizona State University and earned a Master’s degree in Engineering Geology from the University of Arizona in 1967.

A veteran of the U.S. Army Reserve, Marshall earned a Community College Teaching Credential and taught Earth Sciences at Saddleback College as an Adjunct Instructor for three years. He was also a qualified private pilot and a member of Sigma Gamma Epsilon professional geology fraternity.

Survivors include brother John Richie Payne, South Pasadena, CA; son Scott Marshall Payne, Sheridan, Montana; daughter Tara Diane Payne, Camino, CA and three grandchildren.

His former wife, Diane Lucille, died December 2, 2014.

Having A Ball After forming pickleball group, local couple hopes to grow the game

T

erms like “the kitchen” and “dinking” are thrown around with regularity on a pickleball court. The name is peculiar but the action is familiar.

The court is small but the boundaries and movements required to play are easily understood. It’s about as unique a sport as there is today.

“It’s like ping pong on steroids,” Dana Point Pickleball co-founder Gary Koupal said, perhaps more accurately, when describing the fast-growing game.

Pickleball was created in 1965 and has since become extremely popular nationwide. According to the USA Pickleball Association, more than 2 million Americans play the sport, and it has become a favorite amongst seniors. It is a mix between tennis and badminton that does not demand an excessive amount of movement when played at the recreational level.

Koupal and his wife and group co-founder, Patti, are the resident experts on the game. The couple can be found doling out game strategy and rules inside of the Dana Point Community Center gym to the more than 30 members of Dana Point Pickleball every Tuesday morning.

The Koupals started the club in February with the goal of bringing the sport to as many people in the area as possible.

Before starting the group in Dana Point, they had to travel to Fountain Valley or to Newport Beach, where they had to pay a fee every time they wanted to play.

There was no local option in south Orange County, so they started their own club.

The Koupals fund the entire Dana Point Pickleball operation. They pay for court fees and equipment and do not charge players for anything. They became certified ambassadors of the USAPA and will even teach beginners the fundamentals and basic rules so they can play the first time they show up to a gym session.

At first it was just Gary and Patti on the courts in the Community Center gym.

In four months, the group has swelled to

more than 30 members. The group has players that range from ages 40 to 80.

A reason for the game’s widespread popularity, according to Gary, is its accessibility. The game features four players, two to a side, that hit a plastic ball back and forth into the other team’s area with composite paddles, much like the action of tennis. The scoring system is similar to ping pong. There is a no-volley zone, or “kitchen,” several paces off the dividing net in the middle, where players are not allowed to make contact with a ball in the air if their feet are inside the restricted zone.

The game is primarily played a foot or two outside the no-volley zone, which makes for close-quarter action. It also means the players must think several shots ahead and strategize on where they want to place the next volley.

Dana Hills senior golfer Clay Feagler and junior Blake Brothers traveled to Brookside Golf Club to compete in the CIF/SCGA SoCal Regional Championship on May 26. The tournament was the penultimate round of the high school golf postseason, and golfers were vying for only a handful of spots in the upcoming CIF State Golf Championships.

Rocky starts plagued both Feagler’s and Brothers’ chances at the tournament and neither advanced to the state tournament.

Feagler, playing in his fourth SoCal Regional, carded a 77 (+5) and finished in a tie for 55th. Brothers shot an 81 (+9) and finished t-94. DP

“A lot of people are not as agile. …

When we first started playing, Gary said, ‘I’ll be your wheels on the court.’ I can’t run up to it, but I was practicing all the strategy,” Patti said. “Some people are naturally just stronger and better but you can kind of balance it off as you play around.”

“People come and play (pickleball) and they have a smile. They come in and play and say, ‘Oh, that was a good shot, I had a good time.’ It’s just a natural instinct,” Gary added.

The Koupals are hoping pickleball will catch on in the area. They want Dana Point Pickleball to transition to outdoor sport-specific courts someday and will be holding open gym sessions on Thursdays, in addition to Tuesdays, throughout the summer. DP

Donavon Frankenreiter is Coming Home

y all accounts, musician and surfer Donavon Frankenreiter has had a bit of a dream life. Growing up in South Orange County, he surfed his favorite spots from the San Clemente Pier to Laguna Beach and eventually earned a sponsorship to surf professionally.

But at about the time his surfing career took off, Frankenreiter also took to music.

And his career playing with bands and on solo projects played out, well… swimmingly.

ana Point’s Brennan Lee has everything he needs to practice his favorite board sports in his garage: the “grompound.”

In the grompound are two ramp setups on which Brennan, and other neighborhood groms, can ride their skateboards.

Hanging overhead are rows of surfboards of varied sizes. They’re sort of a measuring stick in reverse that indicates his growth as a surfer—the shorter the board, the older he was when he rode it.

You’d think a third grader with a setup like this would be gung-ho on taking his surf, snowboarding and skateboarding skills to competitions.

Playing with seminal indie and surf rockers like Jack Johnson, Ben Harper, Matt Costa, G. Love & Special Sauce and more raised Frankenreiter’s profile. But it was his own unique acoustic singer/songwriter sound that had him featured in surf films (some he shot his own) and opening for acts like Willie Nelson and the Doobie Brothers.

It’s impossible to separate the Frankenreiter’s surf side from his music side. But DP Times tried to in a recent interview with Frankenreiter ahead of his visit to The Coach House in San Juan Capistrano on Wednesday, June 22.

DP Times: You hear the term “surf culture” a lot in Southern California, but people define it so many different ways. What exactly, in your opinion, is surf culture?

Donavon Frankenreiter: It’s everywhere, really, the surf and beach culture. It’s one people look for everyday. Being outside, close to the ocean or a body of water, and just enjoying the moment with family and friends. You don’t have to surf to love surf culture, but it helps.

Can you use things you cultivate and learn in surf in your music? And vis versa?

Yes, they both energize one another for me. I became a musician because of surfing, and love that they both complement one another.

Sometimes you watch old surf videos with acoustic music or music like yours and just think it sounds like a perfect match—the music and the images. Do you think surfing has a sound?

“I just like to chill,” Brennan said.

Brennan says the first time he got on a board alone was when he was 3 or 4 years old, and it was love at first sight.

“I pretty much liked it, and then later on I started doing cool things,” he said.

Brennan’s favorite beach to surf at is Doheny, but his favorite place to chill is Strands. In school, he picks his favorite subjects carefully.

“School… school,” Brennan says. “My favorite subject other than recess, which is not really a subject, is writing and science.

Science is a lot of fun.”

Brennan is looking forward to turning 10 in July, and enjoying the warm waters and the soft swells of summer surfing.

But like others his age, surfing isn’t his only grom activity—skateboarding is his favorite, and he’s got the tricks to prove it, and snowboarding is a close second. DP

Of course, and it’s whatever you’re feeling or into at that moment when it all goes down.

Whether you’re making a surf movie or spending a summer on the beach, they all have their own unique soundtrack.

Your self-titled album has the overriding emotion of positivity. Do you seek out to create the element in your music and in your live shows?

Yes, I couldn’t imagine seeking out hate or anger or a depressed state of mind when it comes to my music. Not to say I don’t like that some of my favorite songs are the darkest ones that other musicians have

been writing—I just haven’t gone there yet.

What can folks expect at your show at the Coach House in San Juan in a couple weeks?

Well the amazing Tom Curren is opening. He is one of the most loved surfing legends to ever ride a wave, and he is an amazing musician. We will play together at one point throughout the night, and we always try and play songs off all our albums. So it’s an electric/acoustic night with everything in between.
