Five things Dana Point should know this week Capo Unified Moves Forward with Plans to Lease Dana Point Bus Yard THE LATEST: The Capistrano Unified School District Board of Trustees voted unanimously Wednesday night to move forward with plans to lease the district’s 5.51-acres of surplus property in Dana Point, known as the South Bus Yard.

Specifically, the board voted to request a waiver from the State Board of Education that would set aside the competitive bidding process for the property and allow the district to enter into a Request for Proposals process. District staff is recommending the RFP process over the competitive bidding process because it would “give the district more flexibility to pursue a ground lease with terms that benefit the district,” rather than just accepting the highest bidder.

“The Request for Proposals process allows interested parties to submit proposals with various proposed ground lease terms, and allows the district to select the proposal that offers the best overall proposal by considering different factors such as the length of the lease term, the proposed use of the property, as well as the total rent payment,” staff reported.

Currently, the site—located at 26126 Victoria Boulevard in Dana Point—is used by the district’s grounds and transportation departments for vehicle parking and surplus storage. The district attempted to sell the land back in 2006 but was unsuccessful.

This past January, district staff presented the board with options for the use of the property, and in February, the board voted to direct staff to explore options for the long-term repurposing of the site.

“After exploring several options, district staff believes the option that will maximize revenue for the district would be to enter into a long-term ground lease,” staff reported. “This will generate significant funding that can be reinvested into neighborhood schools. The type of development to be proposed by developers is believed to be consistent with the city of Dana Point’s Doheny Village Plan.”

Prior to voting on Wednesday night, the board held a public hearing on the waiver request. CUSD parent Michele PloesselCampbell was the lone public comment.

“As a member of the facilities and Dana Point Times September 15-21, 2017

finance advisory committee, I request that the board please quickly move forward with the soliciting of lease proposals for the south bus yard,” Ploessel-Campbell said. “We need the revenue to help fund needed facility deferred maintenance projects within the district. Working quickly and accepting the most strategic plans will provide much needed funds.”

Without any discussion from the board, the motion was moved by Jim Reardon, seconded by Amy Hanacek, and approved unanimously.

WHAT’S NEXT: The district’s next step will be to submit a completed online general waiver request form to the California Department of Education. District staff will then seek further direction from the Board of Trustees if the waiver is granted.

Council to Hold Public Hearing Regarding Duplex Project in Capo Beach THE LATEST: City Council will vote on whether they should appeal the Planning Commission’s decision on a duplex project in Capistrano Beach at their Sept. 19 meeting.

The proposed project involves construction of detached duplex at 34466 Via Verde and demolition of a single-family residence and construction of a detached duplex at 34468 Via Verde.

The project, if upheld, will consist of two detached dwelling units on each of the two contiguous parcels that are approximately 2,500 square feet. Each will have four bedrooms and four-and-a-half bathrooms.

The project was heard at two Planning Commission meetings and was tabled the first time. The second time, Planning Commission voted 5-0 in support of the project.

According to the staff report, in a letter addressed to the City Clerk, the appeal is based “primarily on design compatibility and enhancements items (b) massing and bulk and (d) scale and proportion.”

The letter also states the previous staff report should have compared the proposed project with the “residential scale of the neighborhood.”

Other letters in the staff report indicate concerns over traffic, parking, additional drainage and more.

WHAT’S NEXT: Public hearing notices were mailed to property owners within 500 feet and occupants within 100 feet of the site, according to the staff report.

The Council may grant the appeal, overturn the decision of the Planning Commission and remand the application to staff with direction to prepare an alternate resolution.

Murder Conviction Affirmed for Men in 2015 Jewelry Store Burglary THE LATEST: On Sept. 11, the California Court of Appeal, Fourth Appellate District, Division Three, affirmed the murder conviction of two men who were involved in a botched burglary at Monaco Jewelers on Doheny Park Road in San Juan Capistrano in 2015.

The Court of Appeal affirmed a 2015 judgment by the Superior Court of Orange County for the “provocative act” murder conviction of Alan Keith Hunter, 45, of Moreno Valley, and James Stephan Paschall, 47, of Gardena.

“Two of the defendants’ accomplices were shot to death by a jewelry store owner in a botched attempted robbery of the man’s store,” the Orange County District Attorney’s office stated in a press release.

“Hunter and Paschall were each found guilty by a jury on April 9, 2015, of felony first degree murder and attempted second degree robbery, and were sentenced to 30 years to life in state prison on May 15, 2015.”

City to Hold Historical Inventory Workshop on Sept. 26 THE LATEST: The city of Dana Point will hold a public workshop to provide information about a historical inventory the city is conducting.

The workshop will also inform the public about the benefits of owning a historic

resource.

According to the city, the historical inventory was developed in 1997 and has a total of 73 historical resources, of which 39 were voluntarily added to the Historic Register and 37 are participating in the Mills Act Program.

The city aims to obtain public input and will share the results of the draft Historical Inventory.

WHAT’S NEXT: City staff will present the updated inventory to City Council with recommended updates to the Historic Resources Ordinance for their consideration later this fall.

CUSD Superintendent to Hold First Community Forum of School Year THE LATEST: In an effort to engage with parents, students and community members, Capistrano Unified School District Superintendent Kirsten Vital will hold her first community forum of the school year on Tuesday, Sept. 19 at 6:30 p.m.

Crews will be performing repairs to sections of the large retaining wall along a section of the road.

The road will be open on weekends 6 p.m. Fridays to 6 a.m. Mondays.

A temporary road closure is needed due to the limited area available to perform the repairs, county officials said.

Outlets at San Clemente to Hold Job Fair The Outlets at San Clemente are partnering up with local Chamber of Commerce’s to hold a South Orange County Job Fair on Thursday, Sept. 21.

The Outlets will be teaming up with the San Clemente Chamber, the Dana Point Chamber, the Laguna Niguel Chamber as well as the San Juan Capistrano Chamber to feature more than 75 businesses including Outlets at San Clemente merchants.

Ritz-Carlton, Laguna Niguel to Feature Wyland’s Artwork The Ritz-Carlton, Laguna Niguel will present a curated exhibition of marine life art by Wyland. The exhibit is titled “Hope for the Ocean” which recognizes his foundation’s new partnership with the United Nations Environment Program.

The exhibit will feature 25 original oil paintings, Chinese sumi brush paintings, gicless on cavas, aluminum, watercolors, a bronze sculpture and a mixed media coffee table.

Cove Road Closure Scheduled through Mid-December

The Ocean Institute was named the recipient of the 2017 annual marketing services award by Forge54, according to a press release by the company.

In October, more than 100 volunteers will come together during a 54-hour weekend to create marketing collateral which will help the Institute spread their mission and expand their efforts.

Forge54 works to bring together a community of passionate and creative marketing professionals to serve nonprofit organizations, according to their statement.

When customers arrive at Pacific Acupuncture, Chou and fellow acupuncturist Mike Hsu will discuss with patients the treatment process. Chou said the most common reason people seek help through acupuncture is for neck and back pain.

Once Chou and Hsu perform the acupuncture sessions, they then discuss further methods such as cuppings, massages or herbal treatments available at the location that can further alleviate the patient’s pain.

“We have people who come in with walk-

Coastal Cleanup Volunteers to gather to keep Dana Point beaches clean

ast year, a TV, a boat, buckets and more were brought to the surface by volunteers diving into the Dana Point Harbor during California Coastal Cleanup Day. This year, the effort to clean waters off Dana Point will continue throughout the city on Saturday, Sept. 16.

“Each year, hundreds of thousands of volunteers turn out to rid their beaches, waterways and ocean of trash and plastic debris,” said Nick Mallos, director of Ocean Conservancy’s Trash Free Seas Program.

Last year, more than 700 people attended the cleanups and more than 7,000 pounds of trash were collected, according

to the Ocean Conservancy.

In the city, volunteers will head to multiple locations, both in and above the water, to clean.

In the Harbor, there will be two events occurring.

The first is hosted by the Dana Point Yacht Club and will be on the water. “[Volunteers] will use double kayaks donated by Dana Point Jet Ski and Westwind Sailing,” said Stephanie Lenthall, site captain for the Harbor’s event.

She said the volunteers will clean the outer channel of the Harbor.

Every year, prizes are awarded for most debris collected and most unusual item found.

The second event is the underwater cleanup. Volunteers will be diving to scour a section of the Harbor for items to bring to the surface.

At Doheny State Beach, volunteers will focus on the shoreline, the jetty, San Juan Creek and the general grounds of the park, said Vicki Wiker, Park Naturalist Interpreter for Doheny State Beach.

At Salt Creek Beach, volunteers can join Surfrider Foundation South OC Chapter, OC Parks, UPS, South Cove and Native West to help clean the area. DP

The Dana Point City Council will discuss this topic during an appeal of the Planning Commission’s approval of two adjacent duplexes on Tuesday, Sept 19 at the Dana Point Community Center on Del Obisbo. The meeting will start at 6 p.m. and this agenda item will be the first action item following public comments so come early if you would like to speak.

While reviewing the city’s General Plan and other documents, several statements in the Design Guidelines were especially appropriate. “They are intended to promote higher quality design that is sensitive to Dana Point's natural setting, surrounding environment and community design goals.”

“In older neighborhoods of Capistrano Beach and ‘The Lanterns’ residential area, the proper size, bulk and height of new infill development is an issue. Escalating land values have encouraged oversized houses and additions. The demolition of older, modest houses, and their replacement with large scale homes has, in some areas, created a discontinuous urban design.”

Further in the Guidelines the Urban Design Concepts are listed and they include; Preserve the scale and character of the existing residential neighborhoods; Maintain existing residential development standards for yard setbacks, minimum

Employment is not a Stroll in the Park

he Associated Press article titled “Many find U.S. workplace hostile” is revealing. It reports on an in-depth study by the Rand Corporation, the Harvard Medical School and UCLA, of American workers’ attitude toward their employment. Nearly three quarters of those surveyed reported their dissatisfaction that substantial time on the job required “intense or repetitive physical labor.” To add to their displeasure, 78 percent of those interviewed expressed consternation at being “required to be present at their workplaces during working hours.”

Funny that they didn’t do that when switching from the old flight paths, which is precisely what the Newport Beach/Laguna Beach/ Orange County lawsuits are all about.

Rep. Rohrabacher then went one step further since he received no real response from the FAA. He added two amendments to HB2997 or the 21st Century Aviation Innovation, Reform and Reauthorization Act. They basically said that planes shall fly no lower than necessary for safety over the SoCal Metroplex and that safety should be considered first and community concerns second in analyzing changes to the flight path. This is extremely important because this was not done before they created the new flight paths in March. I would think that Newport Beach/Laguna Beach and the Board of Supervisors would be very happy to use this information in the mediation proceedings for their lawsuit. Thank you Rep. Rohrabacher.

not “work on their own time to meet the demands of their job,” or of being unable to “take a break whenever they want to.”

As to intense or repetitive physical labor, I recall the several years in the late 1940s I worked as a bowling alley pinsetter. Setting double lanes for six to eight hours each night enabled me to go home with a princely wage, often as much as $15. I don’t recall ever complaining about the intensity or repetitiveness. As for setting my own hours and taking breaks when I chose, that never seemed an option when I later served as a deck seaman aboard STRAIGHT TALK a Navy destroyer. More

By Al Jacobs specifically, I always felt the employer for whom I worked had the right to set the rules. I retained the option to accept or reject the employment. In retrospect, that attitude served me well. Over the decades I’ve prospered handsomely. I never resented the terms of the employment I chose to accept; I matured in a

society with different values. Whether or not the worker is better served in today’s permissive environment is questionable, somehow, I doubt it.

The business I operate, rental real estate, requires I employ a variety of persons: resident managers, rental agents, maintenance workers and clerical employees. Some of these jobs are physically demanding or time-consuming. Others require a favorable professional appearance. Thus far no laws prevent us from supervising our employees rationally.

A final thought: Though both the government and societal pressure may be adversely affecting worker attitudes, the employer may still set reasonable rules.

T

he best way to go in to Andy Muschietti’s new adaptation of Stephen King’s classic 1986 epic novel, It, is to have absolutely no nostalgic ties to the first mini-series adaptation back in 1990. The new version—or more accurately the first half of the new version, as it’s directly referred to as It: Chapter One in the credits—is not only a technological update, but also a cultural one. We follow the kids of Derry, Maine, throughout 1989 instead of 1959.

As most fans already know, King’s fictional town of Derry is cursed with a supernatural being (Bill Skarsgård) that haunts, abducts and ultimately kills children every 27 years. Its latest victim includes middle schooler Bill Denbrough’s (Jaeden Lieberher) little brother, Georgie (Jackson Robert Scott), while Bill himself and his friends soon become victims of terror. The creature takes many faces and personas to terrify the kids, but its main identity is a clown.

Muschietti’s It is an upgrade with makeup, effects and atmosphere, as the TV version retrospectively is a bit corny in retrospect. But readers and viewers familiar with the original story will notice there are a few changes to fit a film narrative, but it’s nothing a casual movie fan wouldn’t mind. In many ways, the new It is probably going to be best enjoyed by those who don’t care for the book or TV series. What does need to be enforced is the R rating—which this movie very much deserves for the frightening and graphic content, although it’s probably appropriate for audiences at least 14 years old, despite the characters’ young ages. GUEST OPINION: On Life and Love after 50 by Tom Blake

The Importance of Estate Planning for Seniors

T

his year, I received stories from two senior couples who reunited at their respective high school 50th class reunions. Their stories are quite similar.

Both couples married and both husbands died within months of marrying.

But the stories differ in one significant way: estate planning. The purpose of today’s column is to remind seniors to ensure their estate plans are up-to-date.

COUPLE NUMBER ONE: RANDY AND JACKIE Jackie wrote, “I went to my 50th class reunion in September 2015 and met ON LIFE AND a classmate. It became LOVE AFTER 50 a wonderful love story.

By Tom Blake Randy lived in Illinois and I lived in San Clemente. We married in September 2016. We had a lot of love and laughter.

However, Randy passed away in April, seven months after we were married.

Randy updated his estate to pay off the house, and I was made (an) equal trustee with his son. He gave me his IRA, which I will be taxed on. I have the house to sell, if I need to, and I have his car.

I can’t imagine another love story happening like what just happened to me. To add to the pain, I got a denial letter from the Social Security Administration that you must be married nine months to get your husband’s Social Security, which was over $2,000 a month, compared to my $152.

Note from Tom: I checked with the Social Security Administration and found this: “For a Social Security survivor’s benefit, a widow or widower must have been married to the deceased worker at the time of his or her death and for at least nine months

immediately prior to the day in which the worker died, unless one of the exceptions is met.”

Jackie added, “I know Randy left in peace saying I would be okay having his Social Security. I joke and say if he knew about the S.S. law, I could see him wanting to be on life support for two more months.

“I meet people worse off than me and I am very grateful for all I have.”

COUPLE NUMBER TWO: PHIL AND SUE Jackie mentioned she couldn’t imagine another love story like what happened to her. I know of one. In fact, I wrote about it.

The couple, Phil and Sue, were high school classmates of mine from the graduating class of 1957 in Jackson, Michigan. At our 50th high school reunion, they talked face-to-face for 20 minutes, the only time they had talked to each other in 50 years.

On Feb. 1, Sue, who lived in Michigan, telephoned Phil, who lived in California. They had never dated in high school. Both had been married and their spouses had died.

After several lengthy February phone conversations, they decided to get married.

On Feb. 24, when Sue got off the airplane in Ontario, they headed directly to the County Clerk’s office in Fullerton and got married.

They were happy together, time flew by.

They visited classmates across the country, including me. They went to Michigan to prepare for Sue’s move to California. They were planning on attending our 60th high school reunion a week from Saturday in Michigan.

After that, they would return to California and move into a place in Orange County. According to Sue, one of their first chores would be to update Phil’s estate

plan. Phil had no children, everything was being left to charity. He was going to change his estate plan to include Sue in his distribution of assets.

However, Phil passed away from heartrelated issues just four months after he and Sue were married. They didn’t even get to attend the reunion together.

So there Sue was—back in Michigan, having to deal with a California trust that did not include her and did not designate her as a trustee or executor. To make matters worse, both trustees opted out of the task.

Here we had two couples: one couple whose estate plan was updated, which provided nicely for the wife. And the second couple where the estate plan was not updated and provided nothing for the wife.

These stories inspired me to update my estate plan. I was signing my updated documents in the office of Jeffrey Hartmann, an estate planning attorney in San Clemente, on Aug. 31, and happened to mention Phil and Sue’s situation to him.

Jeffrey said that in California, Sue would be entitled to be provided for in Phil’s estate as a pretermitted spouse.

Even though she lives in Michigan, she may consider pursuing this avenue in California.

Seniors, including those who marry quickly, should have their estate plans and

wills updated. Having an air-tight estate plan is very important, and that includes having at least two successor trustees/executors who can be counted on.

In California, if you own property and pass away without a living trust, your property will go into probate—a prolonged and expensive process.

My stand up paddle boarding buddy, Russell Kerr, a retired financial planner and previous chairman of the Dana Point Chamber of Commerce, said there are two words to stress to seniors regarding updating estate plans: “What if?”

Even people who do not own property should have a simple will, so that their assets will be distributed according to their wishes. Dying intestate, without a will, leaves those decisions up to the state.

he second annual Ohana Festival rocked Doheny State Beach last weekend, with three days of music featuring acts such as Jack Johnson, Social Distortion, Fiona Apple, HAIM, Ray Lamontagne, the Pixies, and of course, Eddie Vedder.

A portion of the festival’s proceeds benefit the San Onofre Parks Foundation, a California nonprofit that works with California State Parks to develop, preserve and enhance the parks.

Dana Outrigger Shows its Strength in Catalina Crossing Championship

T

he Dana Outrigger Canoe Club continued its tradition of excellence as it competed against an international field, including teams from Tahiti, New Zealand, Washington D.C., and a number of teams from Northern California this past weekend at the Catalina Crossing-United States Championship.

Battling windy conditions exiting Newport Harbor on Saturday, Sept. 9, the female Dana Point Outrigger Canoe Club teams arrived in smooth seas at Avalon Harbor on Catalina Island several hours later. The men’s races took place on Sunday, Sept. 10 in clean conditions for a majority of the almost 40-mile crossing, coming from Catalina back to the mainland, the longest such race on the California circuit.

The outrigger races consisted of six competitors in 30-foot canoes, flanked by three rotating team members carried by a support boat. When paddlers need a rest, they literally “abandon ship”, and jump into the water before fresh team members climb onboard without interruption.

The Dana Outrigger Canoe Club, whose members consist of youth and adult paddlers from southern Orange County, had a number of teams participate in this grueling test of skill and endurance.

Coach Lori Long. a San Clemente resident, has been a member of the Club since 1989 and a coach since 2013. Long,

along with coach Bob Bright, lead the club’s Under-19 Women’s boat, which won the Catalina Crossing for a fourth straight time over the weekend.

Dana Point paddler Mya Harry has been a part of the U19 crew for four years, and is undefeated in four attempts at crossing the channel.

Coach Long glowed with pride when asked about her team’s end-of-season performance.

“It’s just amazing to see what these kids can do. They really wanted to finish the crossing in under five hours, and they did,” Long said.

The U19 team made the journey in 4 hours and 58 minutes.

“This is such a long, exhausting race,” Long said. “It’s hard not to get emotional with them. They really put everything into it.”

The Dana Outrigger’s Open women’s crew also had a solid showing in the crossing race, finishing second to a Tahitian team that has now bested them in consecutive races, Long said.

The local club’s Under-19 men’s boat, anchored by San Clemente High School multi-sport athletes Cole McDaniel and Nate Gerkin, took second place behind a club from Redondo Beach in their 34-mile return trip.

The Open men’s crew, coached by Long’s husband Rich, secured a top-10 finish, as did the club’s senior Masters crew, which took third. DP

‘Sacred Paddle Ground’ Infinity Surfboard owners talk about SUP, Pacific Paddle Games

uch like the crisp waves at the Doheny surf breaks, adrenaline crashes over Dave Bohene when he speaks about the Pacific Paddle Games.

He’s seen the sport of stand-up paddle boarding (SUP) flourish from humble beginnings to a global phenomenon within the last decade.

“As the games approach, you get nervous driving by; you look over and you get those feelings, like a big baseball fan walking on Wrigley Field, when you’re walking at Doheny,” Dave said. “It’s just like sacred paddle ground.”

Dave described the Pacific Paddle Games as the “Super Bowl” of SUP. The surf break at Doheny makes it an ideal location for SUP races. The waves are typically crisp and rarely over five feet, so competitors aren’t thrashed around by the ocean.

Dave said he has attended every Pacific Paddle Games, which started in 2008 as Battle of the Paddle, and this year’s events take place Sept. 30 and Oct. 1 at Doheny.

He said the popularity of the event draws thousands of spectators to the beach.

t’s been a couple of weeks, but hopefully everyone’s getting back into the school groove. And while nobody likes homework or getting up early, one of the perks of a new school year is a new NSSA season.

Last weekend, the NSSA Southwest Division kicked things up in Huntington Beach with the first contest of the new year. San Clemente’s up-and-coming young talent made the most of the clean, fun-sized surf.

Taking out the Open Women’s division and Grom of the Week honors was Samantha Sibley.

Edging out her friend and local sparring partner, Kirra Pinkerton, in the final, Sibley put a summer’s worth of solid competitive experience to good use. Surfing in a number of WSL events over the last couple of months, most notably finishing second in the Vans U.S. Open of Surfing Pro Junior, she’s climbed the Qualifying Series rankings from 231st in 2016 to 98th this year.

Likewise, on the North America Pro Junior circuit, she’s shot up the ratings from 50th in 2016 to fifth this year. It probably goes without saying, but big things are in store for Sibley. DP www.danapointtimes.com
