Five things Dana Point should know this week Local Transient Pleads Not Guilty After Naked Break-In THE LATEST: On Oct. 31, at approximately 4:45 a.m., Orange County Sheriff’s Department deputies responded to a call on the 35000 block of Camino Capistrano after Hannes Michael Wood, 44, walked into a residence naked through an open sliding glass door.

An adult female inside the residence was awakened by the suspect, who fled after she screamed. Upon arrival, deputies found Wood hiding in the garage and took him into custody without incident.

Sgt. Rich Himmel of Dana Point Police Services reported that Wood has been arrested more than 30 times, serving time at Wasco State Prison in 2009. Himmel said his last listed residence is one in Dana Point on Calle Verano.

WHAT’S NEXT: Wood pled not guilty to one felony count of burglary of an occupied residence during his arraignment on Nov. 1. Wood remains in the Orange County Jail on $150,000 bail. His preliminary hearing is set for Tuesday, Nov.14.

Surfing Heritage and Culture Center Possible Centerpiece for Dana Point Harbor THE LATEST: The Surfing Heritage and Culture Center (SHACC), currently based in San Clemente, could be expanding as a centerpiece of the new Dana Point Harbor.

Listed as one of the “Top Ten Things to Do in Orange County” on Trip Advisor, the SHACC has been in discussion with Burnham Ward (commercial developer of the Dana Point Harbor Partners) as a cultural attraction.

SHACC president Glenn Brumage said that the potential location would be designed as a museum.

“Historically, being within the Dana Point Harbor would be a perfect fit,” Brumage shared, saying that SHACC is very confident that this progress will move forward “as planned.”

Brumage said a new Harbor museum would allow for a more public presence in comparison to their current location in the Rancho San Clemente business park off of Avenida Pico in San Clemente, but he added that this addition does not indicate abandonment of the San Clemente location.

Finance Review Committee Votes to Maintain Contract City Attorney Model THE LATEST: On Oct. 26, after a staff agenda report presentation from Asst. City Manager Mike Killebrew, the Dana Point Financial Review Committee voted to continue the current contracted City Attorney legal representation program.

Since 2002, Dana Point has contracted with private law firm Rutan & Tucker LLP, currently at an hourly rate of $253 per hour. The annual cost for the 2018 fiscal year for an estimated 2,835 hours of work from Rutan & Tucker equates to $717,255, or $140,000 dollars below the city’s current budget of $857,000 dollars.

The city’s staff agenda report computed three options estimating personnel costs based on the last five and one-half calendar years of billings.

The report states, “…an estimate was produced of the annual attorney work hours needed to cover each category of

the city’s legal needs. This number is debatable, but assumptions have to be made in order to compute estimated costs.”

In scenario one, computing the annual cost of personnel and other costs to support a fully-staffed, in-house city attorney department were estimated at $683,700.

Scenario two, based on employing only an appointed City Attorney and contracting out all additional work came out to just under $700,000. Scenario three, which included employing an appointed city attorney and an assistant or deputy city attorney and contracting out all additional work including specialty work, ranged from $615-$635,000.

Another hot topic of conversation was a detailed table comparing Orange County cities and their populations, manner of representation and the 2018 fiscal year legal representation budget. Currently, only four of 34 Orange County cities have in-house staff serving as city attorneys.

These include Anaheim, Santa Ana, Huntington Beach and Newport Beach.

After much deliberation, which included a lengthy discussion concerning the staff report’s “Considerations for Selecting an Attorney” section, the committee voted 3-2 in favor of continuing the current contract city attorney model.

Killebrew noted, “As the city’s risk manager, I feel compelled to advise that when considering who to choose to provide legal advice, the city should view risk management as a critical factor in the decision.

Less than the most skilled advice can and does result in legal losses, large payouts or settlements, and can easily cost much more than any savings that might be gained by selecting a lower-cost legal advisor.”

THE LATEST: On Oct. 31, the South Coast Water District (SCWD) reviewed a comprehensive “Final Technical Studies Update,” composed by GHD, the potential developer of a desalinization plant intended to supply Dana Point and potentially the surrounding region with a more secure and sustainable water source.

Notably, the report included three additional southeastern intake wells near Capistrano Beach that are conceptually based on ongoing sea floor geo-science evaluations, to be refined as needed following completion of ongoing research.

A table showing the estimated changes to the average total monthly bill of SCWD customers showed a Tier 1 Single Family Residence (SFR) increase of $1.54 a month, a Tier 2 SFR increase of $5.14 a month, and a Tier 3 SFR increase of $12.86.

fter the first winter swell of the season swept through Southern California earlier this month leaving iconic palms uprooted, homes flooded and beaches dramatically altered, many Dana Point residents may be wondering what is in store for their native coastline in the upcoming winter season.

As these waves rumble south down the California coast from the north Pacific and the potential for rain increases, Capistrano Beach residents—specifically those along Beach Road—are caught in the timeless and tumultuous conversation of private ownership rights versus managed retreat.

Ambrose Masto is the current president of the Capistrano Bay District, a separate district under the city of Dana Point, and has lived in his home on Beach Road since 1989. His home is one of the four original Dana Point Times November 3–9, 2017

Standing on his back deck, surrounded by exposed piles of sand bags, Masto was calm when discussing the recent damage to his property.

“These things seem to come in waves.

They tend to be cyclical. We will remain diligent and a part of the progression,” Masto said. “We aren’t here to be combative with the California Coastal Commission (CCC), and we are in constant contact with the local powers-that-be to establish the best course of action. We just want to protect the homes (along Beach Road), the land and the beach we love.”

Masto said the City of Dana Point and CCC have both been receptive and understanding in awarding recent emergency repair building permits.

Orange County Parks have conducted recent studies concerning the local coastal erosion that could potentially continue to affect Beach Road residents like Masto for years to come. One of the studies they have commissioned for shoreline protection looks at both short and long-term solutions for Capistrano Beach, with the results currently in draft form.

Orange County Parks also said they are finalizing the Orange County Sand Compatibility and Use Program as a part of the Coastal Sediment Management Plan. A follow up-study is slated to be finalized this December.

“We plan to initiate a master plan that addresses long-term strategies to include structures, living shorelines, beach nourishment or managed retreat,” Orange County Parks Public Information Officer Marisa O’Neil said via email. “We are planning to release a request for proposals in early 2018 to develop a master plan. We are looking into potential funding sources, including grant opportunities and reaching out to potential partners. This comprehensive plan would address sea level rise, improve public access, protect infrastructure and restore coastal ecosystems.”

On a more regional level, Dana Point City Council Member Joe Muller believes the long-term health of the coastal ecosystem (including its residents) is best understood through a more cohesive scope.

Earlier this year, Councilman Muller began a project called “Save Capo Beach” in an effort to unite local stakeholders in a conversation aimed at achieving a longterm comprehensive solution to coastal environment change that satisfies the whole Dana Point community.

In a statement on Save Capo Beach’s Facebook page, Councilman Muller said, “It is time to bring the stakeholders together to get this discussion started. I am going to start the dialogue with: California State Parks, Orange County Parks, California Coastal Commission, Surfrider Foundation, Caltrans and Orange County Transportation Authority. The goal is to

As Lanes Open on I-5, Pico Expansion Project Nears Completion As the Interstate 5 Pico expansion project continues, traffic lanes are starting to open and the project is coming to a close.

“On the morning of Oct. 23, the traffic on the I-5 freeway shifted to the most recently constructed bridge at Pico, four generalpurpose lanes in each direction of the I-5 in their final configuration,” said Eric Carpenter, a media relations specialist for Orange County Transportation Authority (OCTA) in an email. “The lanes that are not yet open are the HOV lanes—one in each direction— in the median of the freeway.”

Carpenter said work is continuing on the freeway ramps, which will consist of installing lighting, landscaping and irrigation.

Regarding what happens next with the freeway on and off ramps, Carpenter said they will eventually be restored to their original design now that the project is entering its final phases.

“While the temporary configurations have met federal highway standards, we understand that some drivers were uncomfortable with how they had to merge on or off the freeway,” Carpenter said. “We understand that major construction like this is an inconvenience and we appreciate the patience of drivers.”

Carpenter said the lanes for merging on and off at some of the ramps have been restored to original lengths.

The northbound on ramps at Avenida Vista Hermosa are still a tight squeeze.

“The entire I-5 South County Improvements Project—through San Juan Capistrano, Dana Point and San Clemente—is set to be completed by early spring 2018,” Carpenter said. “That is subject to change depending upon the amount of rain and any unforeseen issues. We will keep the public updated on an exact date as completion nears.” —Eric Heinz

Councilman Muller claimed that meetings have started with many of these stakeholders individually, and that all will be brought together in a staggered timeline in order to effectively offer concise, tangible results.

Standing on the back porch of his home overlooking the ocean, Masto said the water’s potentially dangerous and powerful overflow wouldn’t be stopped with his neighbor’s recently constructed soft sand barrier which overlapped into his stretch of private beach. A more impactful solution needs to come forth.

WSA-OC members who participated in the 2017 Transpac Race, the bi-annual regatta from Long Beach to Diamond Head, Hawaii, will share their experiences. Stephen Ashley, Bill McNamara and Charles Buckner will share stories from their 2,000mile journey across the Pacific including boat prep, crew selection, teamwork, race strategy, women participants on the water, behind the scenes and more. WSA-OC is a co-ed group dedicated to supporting women sailors throughout the Orange County area through land-based educational programs and on-the-water activities.

Your Future in the Social Security System

D

uring a radio interview I gave recently, the interviewer picked up on one of my “Straight Talk” articles titled, “Is Social Security a Giant Ponzi Scheme?” During our exchange, we discussed such subjects as the regularly increasing FICA payments by all wage earners and the uncertain nature of the system’s trust fund as well as the perennial question as to whether our government will risk going so far into the red that Social Security could bankrupt the country.

At one point I got the impression the interviewer was more concerned about his own personal situation than simply airing a topic for the benefit of his listeners.

Near the end of our conversation, he asked if I thought there was a “fix” for Social Security. Thinking he meant some way the system might be revamped in a fairer and equitable manner to become fiscally sound, I answered, “I see none.” Had I taken a few more moments to reflect, I’d

I attended my first meeting of the Homeless Task Force in Dana Point.

There was an excellent presentation by Larry Haynes of Mercy House regarding statistics on our local homeless. Dana Point has 64 homeless individuals that have been assessed and have been homeless in our city for an average of five years.

Prior to attending this meeting, I had read numerous articles of various states like New York and Utah and cities using a new technique that has a 96 percent success rate to keep those individuals housed and off neighborhood streets. That new method is housing the homeless first instead of last. As with most programs, one of the biggest hurdles is the willingness of elected officials and citizens to try something new. This plan requires funding of $12,000 per individual homeless person to place in rapid rehousing; in the case of Dana Point, that would be $144,000 for 17 individuals.

The best results nationwide are to house the homeless first and then get services that are currently available to help them with what they need to function in life. Our Dana Point Police Services Dana Point Times November 3–9, 2017

There’s no collective “fix” for the system, as the politics and economics make the system unalterable for the mass of its contributors and recipients. However, if you’re viewing this singularly, there are a number of things you might do to decrease your personal risk. Where does that leave us? Perpetual homelessness in Dana Point, unless we take the steps to try something new and go with the housing-first plan and make the commitment and fund this proven method to get our “street residents” into housing and off our streets.

Mayor Pro Tem Wyatt wants to move cautiously, as he has just taken over chairing this group in July, and that is understandable. However, people want to see some results and we should have a timeline when solutions will be implemented.

This document explains in detail why our beaches are disappearing (no, not just rising sea levels), how to solve the problem, including numerous examples of how it has been done elsewhere, and even state and federal funding options. This is nothing new and managed retreat is definitely not an option.

The loss of sand is due to man-made intervention. Sand that historically traveled down the rivers and replenished the normal sand erosion on the beaches now gets trapped behind dams built to control water flow. So now another man-made intervention to bring that sand to our beaches in other ways is needed to get things back to a normal state.

At the Movies: ‘Thank You for Your Service’ Doesn’t Overwhelm with Bias

riter-director Jason Hall’s military drama Thank You for Your Service might as well have been released on Halloween weekend, as its target audience wasn’t compelled enough (based on poor box-office weekend returns) to support it, and it probably wouldn’t have succeeded during any other month. Although it is essentially a loose, modern remake of the classic The Best Years of Our Lives (1946), it appears to be not patriotic enough for some viewers and a bit esoteric for others. Despite the poor box-office feedback, Hall’s film is still a fascinating character study, with an ironic movie title.

Sgt. Adam Schumann (Miles Teller), Specialist Tausolo Aieti (Beulah Koale) and Sgt. Billy Waller (Joe Cole) are returning home after serving tours in Iraq. Adam is having trouble opening

up to his wife Saskia (Haley Bennett) about his experiences; Solo is still reeling from his military tour and doesn’t feel right at home with pregnant girlfriend Alea (Keisha Castle-Hughes); and Billy returns to his house only to discover his fiancée has moved out.

Hall also adapted the script for Clint Eastwood’s American Sniper (2014), and his directorial debut is even more impressive than his previous feature with a Hollywood film legend. The portrayal of soldiers suffering from post-traumatic stress disorder (PTSD) in Thank You is stark and graphic, and takes the theme even further than Sniper did. Teller and Koale give two very strong and emotional performances, and Teller in particular is back in fine form after a string of duds the past couple of years. Thank You borders on anti-war rhetoric and themes, but never overwhelms the viewers with bias. DP

Dan Brown Does It Again with ‘Origin’

F

ans of Dan Brown will not be disappointed in his latest offering, Origin.

Back in for a fifth book, Harvard professor Robert Langdon is back in another nonstop, pulse-pounding, pageturning thriller. Like Brown’s previous titles, Origin deals with matters of science and faith. Without revealing too much, the premise of the book can be summarized by two questions: where did we come from and where are we going? As you can imagine, this is going to be a showdown between science and faith, but again, Brown masterfully pulls it off.

Events quickly go south when one of Langdon’s former students gives a presentation in Spain that Langdon is invited to. It isn’t long before the professor is on the run with a woman searching for clues to what might have caused events to spiral out of control. Assisting BOOK TALK

and the entire story takes place within 24 hours, although there are flashbacks to fill in the storyline. Brown does a fantastic job of not revealing anything until the very end, and, even then there are some unexpected twists.

While Brown sometimes stretches credulity, or, forced readers to suspend their disbelief in his books, this time, he weaves together a story that is entirely plausible from start to finish even if the technology is not yet available to the mass market.

In my opinion, I believe this is one of Brown’s best, right up there with Inferno.

chapters are short and fast-paced. Brown uses history, architecture, and art to weave a colorful story. Unless you are Robert Langdon himself, I suggest you keep a cell phone or computer with internet access nearby as you are certain to be looking up references in the book. By now, all Brown fans should know that is standard procedure. Additionally, several storylines are moving along to reach the conclusion, but each storyline draws you in to the point you forget what is happening previously and can be frustrated when he leaves you hanging to go back to another storyline. I know there are many

who don’t like his writing, but for those who do, this is a must read. The Dana Point Library owns a copy.

Dolphins Win Streak Snapped in FirstRound Playoff Loss After taking a two games-to-one lead in a first-round playoff game against Trabuco Hills on Oct. 31, the Dana Hills girls volleyball team watched as the Mustangs came roaring back to claim the final two sets and secure a five-set victory.

Trabuco Hills beat the Dolphins 23-25, 25-21, 22-25, 2515, 15-9 to advance to the second round.

It was the second time this season the Mustangs beat the Dolphins. The two teams squared off in a nonleague contest on Sept. 21.

The loss snapped what had been a 15-game Dana Hills winning streak. The Dolphins (24-5, 8-0 league) swept their way to a Sea View League title this season.

Boys Water Polo Ready for Wildcard Tilt A third-place finish in the South Coast League put the Dana Hills boys water polo team in a tough playoff situation. The Dolphins were set to travel to play Santa Barbara in a CIF-SS Division 2 wild card play-in game on Nov. 1.

Results were not available at press time.

Whichever team won the wild card game will earn a first-round meeting with Laguna Beach on Nov. 2.

The Dolphins, coincidentally, wrapped up their regular season with a nonleague game against Laguna Beach on Oct. 26. The Breakers were able to get past the Dolphins 12-9.

Cross Country Teams Eye Top Finishes at League Finals The Dana Hills boys and girls cross country teams only had one crack at the Irvine Regional Park course on Nov. 2 racing in the South Coast League finals.

The boys team entered the league finals as the reigning league champions. The girls team placed second one year ago.

The cross country season is beginning to heat up, as the teams will head to the CIF-SS Division 1 Championship Prelims meet in Riverside on Friday, Nov. 10.

Tennis Team Battles Tritons in League Finals Tournament Just like it was throughout the regular season, the Dana Hills and San Clemente girls tennis teams jostled for position at the top of a decisive tournament.

Playing in the South Coast League finals on Oct. 30, the championship matches in both the singles and doubles came down to matches between Dolphins and Tritons.

In the singles finals, San Clemente’s Lindsay Hung defeated Courtney Swift. Hung has yet to lose a match this season.

In the doubles bracket, San Clemente’s Samantha Neilson and Jenna Yeam upset the No. 1 seeded Dana Hills duo of Emilia Gorczyca and Dana Mackensen to claim the title.

The Dolphins entered the CIF-SS Division 1 playoffs on Nov. 1. The team was set to play Mater Dei of the Trinity League in the first round, but results were not available at press time.

The winner between Dana Hills and Mater Dei will play the winner of Oaks Christian and Notre Dame of Sherman Oaks in the second round on Friday, Nov. 3.

Golf Team Closes Out Season at CIF-SS Tourney The Dana Hills girls golf team placed ninth at the highly competitive CIF-SS Southern Division Team Championship tournament at Mile Square Golf Course on Oct. 30.

The team was led by junior Isley Grguric, who shot a team-best five-over-par 77. Lauren Wahlstrom shot an 82 (+10), Averee Dovsek shot an 84 (+12), Katie Jacobson shot an 88 (+16), Sam Lapple shot 91 (+19) and Maddie Bayless carded a 95 (+23) to round out the scoring for the Dolphins.

University won the tournament with a team score of 365.

The tournament marks the end to the Dolphins’ season.

Dana Hills placed second in the South Coast League and will return a strong crop of players next year.

In his weekly report, Dana Wharf Sportfishing & Whale Watching captain Brian Wooley outlined how Dana Wharf boats have been scoring lots of calico bass, sand bass, sheephead and handfuls of hefty yellowfin tuna.

Here is the latest fish count out of Dana Wharf: • Oct. 31: 2 boats; 44 anglers: 142 bonito, 25 mackerel, 10 whitefish, 6 sand bass, 1 white sea bass, 1 calico bass.

• Oct. 30: 2 boats; 33 anglers: 147 bonito, 13 calico bass, 12 rockfish, 5 boccacio, 5 sand bass, 5 whitefish, 3 sheephead.

• Oct. 29: 4 boats; 163 anglers: 65 bonito, 56 bluefin tuna, 49 calico bass, 17 sand bass, 13 sheephead.

• Oct. 28: 5 boats; 118 anglers: 175 bonito, 153 whitefish, 60 calico bass, 27 rockfish, 25 vermillion rockfish, 21 sand bass, 15 sheephead, 12 blue perch, 2 boccacio, 1 barracuda.

Football Falls to Wolverines, Eyes Capo Valley So far this season, no team has been able to stop the Capistrano Valley football team. Dana Hills will attempt to be the team that puts an end to the Cougars’ undefeated streak on Friday, Nov. 3.

The Dolphins (3-6, 1-2) will travel to play the Cougars (9-0, 3-0) after dropping their last two games to El Toro and Aliso Niguel.

The Dana Hills defense will be tested by a strong Capo Valley offense, which is led by junior quarterback Nathan Manning. Manning is averaging 255 passing yards per game and has thrown 27 touchdowns to just seven interceptions.

Six different Capo Valley receivers have caught at least two touchdowns, showing that Manning likes to spread the ball around the field.

Old School Longboarding’s New Look River Covey and his crew of plank-riders put new twist on surfing’s timeless ethos

pend enough time in the parking lot at San Onofre and you’ll probably notice a crew of young, hip, stylish surfers lurking somewhere around The Point or Four Doors. Perhaps they’re still too spry to venture all the way down to Old Man’s. Waiting for the tide and wind to sync up, they lounge around in their rusted out Ecoline and Volkswagen vans.

Contrasting this soul scene, less than a mile up the road, is the hotbed of high-performance talent that is Lowers. Sponsored professionals huck airs in hopes of having their photo taken.

This new San O crew is not that. Harkening back to a time when surfers took more pride in the salt on their boards than the stickers, Miki Dora, not Kelly Slater, stands as their savior.

“The competitive part of it all is a whole different ballgame, a whole different camp from what I am involved in. I don’t want to think about it. It destroys the whole purpose of riding waves. I don’t like noises, I don’t like crowds, I don’t like bullhorns going off, and people giving me orders how to ride, how to do certain maneuvers,” famously said the late Dora, who built a career and a reputation as surfing’s preeminent rebel, hustler and sometimes-con man. “I’m a freak of nature and don’t fit in with anybody.”

unning herd in the Kenworthy family isn’t easy, but somehow little Waylon does it. One of five dedicated surf rats, his oldest sister, Bella, has been turning heads in the surf world and on a skateboard since the time she could walk.

Just like the rest of his other brothers and sisters, Waylon jumped right on board. As handy on four wheels is he is on three fins, as is the case in big families, Waylon’s doing things is own way.

Enter, 18-year-old River Covey. Born in San Diego, he moved to Dana Point when he was 11 and these days calls Capistrano Beach home. Like Dora, he’s got style for days and a penchant for taking the alternative path. When his classmates were psyching on Kolohe Andino at T-Street, he was cross-stepping down at San O. “I had always been around the ocean and found inspiration in watermen like surfers, fishermen, lifeguards,” said Covey about his start in the game.

When it comes to his favorite surfers, he’s more traditionalist than a fantasy surfer fan.

“Butch Van Artsdalen, Phil Edwards, Lance Carson, Miki Dora, David Nuuhiwa and so many more,” he rattles off, sounding more like an old editor of SURFER Magazine back in 1968 than an 18-year-old kid with nearly 40,000 Instagram followers.

“The new age of longboarding is incredible to watch grow. The guys like Nick Melanson, Kyle Perez, Andy Nieblas, Noah and Ben Cardoza, and also the girls, like Makala Smith, Hallie Rohr and Karina Rozunko, have been ripping as hard if not harder than “There’s always one more way to do things and that’s your way, and you have a right to try it at least once,” said his namesake, Waylon Jennings.

“The kid’s got his own sense of style, that’s for sure,” jokes his father, Jason.

“Somehow I got lucky and all my kids seem to get along best when they’re in the water or on a skateboard.”

From meandering family road trips down to the points in Mexico, to skate jams with sis, to long weekends on the amateur surf circuit, Waylon’s soaking it all in. You may see him drop into a NSSA or WSA final, and he’d be stoked if he did, but he’d be just as stoked to catch a few good waves and have some fun with his crew. DP

This “new age of longboarding” sprouted up as a result of millennials looking for something different in surfing while the industry bottomed out in 2008. It’s a more back-to-basics perspective that celebrates the culture rather than the sport of surfing. With the World Surf League turning surfers into “athletes” and all the hype surrounding its acceptance into the 2020 Olympic Games in Tokyo, it’s little wonder a segment of the wave-riding populous turned back to the counterculture to lead them forward.

“I recently traveled to Australia’s East Coast (and) Mainland Mexico in the last year, as well as a bunch of small trips up and down the coast to Baja and northward,” said Covey of the places surfing’s already taken him.

When asked about his preferred type of wave, he doesn’t discriminate.

“Anywhere that’s breaking, I feel like it’s important to be grateful to surf no matter the conditions,” he said.

And although a lot of up-and-coming kids around Orange County are looking to

cash in on the Sport of Kings and make a pile of money doing something as trivial as surfing, Covey’s rolling with a different set of priorities. When pressed about what he wants out of it, he’s matter-of-fact, “Long healthy life with many good times.”

More than 100 years ago, famed American writer Jack London posted up in Waikiki, Hawaii. Between flurries at the typewriter and forays into local watering holes, London also learned to surf. The former San Francisco Bay oyster pirate was immediately enthralled. After a few beatings in the whitewater and being humbled by the Hawaiians’ natural adeptness in the surf, London clamored back to his writing desk.

“Go strip off your clothes that are a nuisance in this mellow clime. Get in and wrestle with the sea; wing your heels with the skill and power that resides in you,” London wrote. “Hit the sea’s breakers, master them, and ride upon their backs as a king should.”

It’s good to know that while the times may change, some of surfing’s finer traits remain the same. DP
