If Squeamish, Do Not Read On A couple of weeks back we touched on “governmental immunity,” meaning when you can’t sue the government when it hurts you or a member of your family. A sad and tragic case from New York City illustrates those concepts at work. A seventeen year old boy was killed in a car accident in Staten Island and his body was sent to the New York Medical Examiner’s Office for an autopsy. Although the cause of death seemed obvious (due to the nature of the boy’s physical injuries), the medical examiner removed the young man’s brain and held it in a jar of embalming fluid (with a name tag on it) for later examination by a brain specialist. The body (sans brain) was then returned to Jesse’s family, a funeral was had, and the family attempted to move on with life. About two months after the funeral, a science class from Jesse’s high school went on a field trip to the medical examiner’s office. In a surreal coincidence, several of the boy’s classmates observed the brain in the jar with the label on it. Naturally, it was extremely upsetting to the students, and word of the incident reached Jesse’s family, who hired an injury lawyer, and sued the City of New York and the medical examiner’s office. In the meantime, the brain was returned to the family, the body was exhumed and reunited with the brain, a second funeral held, and a second burial. In court, the City of New York claimed that it and the medical examiner’s office were not legally responsible for all of the emotional injuries claimed by the family, as the defendants were entitled to governmental immunity for all discretionary acts of City employees. The court agreed with the City in part, and dismissed those portions of the lawsuit based on “discretionary actions,” which were, according to the Court, the decision to autopsy Jesse’s body and the decision to hold onto the brain for subsequent expert examination. The court ruled partly in favor of the family, finding that the medical examiner had a legal obligation to tell the family that the brain was being withheld, which would have allowed the family to make an informed decision regarding a funeral(s). The Court has yet to decide how much money the Shipley family should receive. What do you think? Was the right decision made by the court? Children are safer when grandparents are driving lthough I try to view medical research in an objective manner, I must admit I do enjoy reading articles that agree with my point of view. Here is an example. I am one of the old breed who still wears the time-honored white coat when seeing patients. Therefore, I was very interested in an article that asked parents and children if they would rather the child's doctor wore a white coat. Another example is a recent article about grandparents, a union to which I am a member in good standing. I believe many grandparents experience the same "vibes" I receive when I am about to chauffeur my grandchildren to one of their many activities. The vibes I receive are that the parents believe their pre-

Not only have I been driving twice as long as they have, but since I don't know how to text, I don't do it while driving. With that as background,

you can imagine how delighted I was when I read the results of a recent research article titled "Grandparents driving grandchildren: An evaluation of child passenger safety and injuries." Children in cars driven by grandparents that were involved in accidents had a 50 percent lower risk of being injured compared with children in cars in accidents driven by parents. This is despite the finding that grandparents did not always use the best child restraint methods. I can relate to that -- you have to be an engineer to properly install some present-day car seats. Here's my unscientific reason for the decrease in risk of injury: When grandparents are driving their grandchildren, they are more cautious,

more focused and pay more attention to their driving. For many parents, having the kids in the backseat is a routine part of their day. They may multitask, thinking about all of the things they need to do and not focusing as much on their driving. But whatever the reason, I keep a copy of the article in my car, just waiting to hear another lecture about my driving skills, or lack thereof.
