TERMS AND CONDITIONS of AUCTION The following, as amended by any posted notices, specific bills of sale or similar instruments relating to a transaction or oral announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalogue shall be offered for sale or sold by Murad Auctions, the auctioneer conducting the sale on behalf of any consignor for whom we act as agent. DDFAA (as subsequently defined) is not an auctioneer and is not conducting the auction or arranging any resulting transaction. In these Conditions of Sale, “We” and “Our” refer to Murad Auctions. 1. As used herein the term “bid price” means the price at which a lot is sold to the purchaser and the term “purchase price” means The aggregate of (a) the bid price, (b) A PREMIUM PAYABLE BY THE PURCHASER OF 17.5% of the hammer price (or 20.5% if bidding via LiveAuctioneers.com online) and (c) unless the purchaser is exempt by law from the payment thereof, any Texas or local sales tax (or compensating use tax of another state) and applicable taxes. Murad Auctions has been authorized by the consignor to retain, as part of our remuneration, the premium payable by the purchaser. 2. On the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot, and title to the lot shall pass to the purchaser, in accordance with all of the conditions set forth herein and thereupon the purchaser (a) assumes full risk and responsibility therefore (b) if requested will sign a confirmation of purchase, and (c) will pay the purchase price in full in cash for all lots purchased. To prevent misdelivery and inconvenience in settlement of a purchase, no lot may be transferred. All property shall be removed from our premises at the purchaser’s expense immediately following the sale. If not so removed we may, as an accommodation to the purchaser, transfer the property to a public warehouse or other premises under our control or the control of DDFAA at the purchaser’s sole risk and expense. Each sale made pursuant to these Conditions of Sale will be deemed to constitute a grant of security interest by the purchaser to us in, and we may retain as collateral security for the purchaser’s obligations to us or our assignee, any of the purchaser’s property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the purchaser. Each purchaser consents to the filing of public notices or our lien. Whenever the purchaser pays only a part of the total purchase price for one or more lots purchased, we may apply such payments, in our sole discretion, to the lot or lots we choose. Payment will not be deemed made in full until we have collected all amounts due in cash or good funds represented by cleared checks or cashier checks. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including but without limitation, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or b) resell the property with a three day notice to the original defaulting purchaser, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorney’s fees and incidental damages; or (c) take any measures it deems necessary. If Murad Auctions must resell the property, the original defaulting purchaser will be held responsible for any deficiencies in the purchase price, including any and all associated expenses including reasonable attorney’s fees, warehousing, commissions or any other costs associated with the default. No actions by us or any third party before or after the auction shall be deemed a waiver of any of the foregoing. 3. We reserve the right to withdraw any property at any time before the actual sale. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalogue and no lot shall be divided for sale. 4. The auction will be conducted by Louis Murad TXS 13362. We reserve the right to reject any bid

from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects. 5. If we are prevented by fire, theft or any reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages. 6. Some lots are offered subject to a “reserve,” which is an undisclosed minimum price below which the lot will not be sold. If a lot is offered subject to a reserve, the auctioneer may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. 7. ALL STATEMENTS CONTAINED OR IN ANY BILL OF SALE, INVOICE OR ELSEWHERE, OR MADE BY THE AUCTIONEER, AS TO AUTHORSHIP, PERIOD, CULTURE, SOURCE, ORIGIN, MEASUREMENT, QUALITY, RARITY, PROVENANCE, IMPORTANCE, EXHIBITION AND LITERATURE OF HISTORICAL RELEVANCE OR PHYSICAL CONDITION ARE QUALIFIED STATEMENTS OR OPINION AND NOT REPRESENTATIONS OR WARRANTIES. All deliveries will be shipped COD unless otherwise agreed to by purchaser and Murad Auctions. If packing and handling of purchased lots is done by us, it is done at the entire risk of the purchaser. We are not liable for any acts or omissions of carriers or packers, including those we may recommend. Such carriers or packers may carry their own insurance and any claim for loss or damage should be addressed directly to them. No items will be shipped unless we specifically agree to do so. 9. Unless prior arrangements have been made with Murad Auctions, there may be a seven day waiting period if purchasing artwork with a personal or company check. To avoid delay of this sort, bidders are encouraged to prearrange check approval or establish a line of credit with Murad Auctions by calling (214)

720-4044 no later than noon on Saturday, January 21, 2017. There will be no exceptions. Bank card purchases will be honored at our option. 10. These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by Texas law. By bidding at an auction, whether in person or by agent, telephone or other means, the purchaser or bidder agrees to be bound by these Conditions of Sale and to consent to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of Texas. All of our obligations under these Conditions of Sale and the obligations of purchaser to pay, are performable in Dallas, Dallas County, Texas. 11. These Conditions of Sale shall bind the successors and assigns of all bidders and purchasers and inure to the benefit of our successors and assigns. These are intended as an approximate guide to current market value, and should not be interpreted as a price or as an appraisal. The final bid may well be less or more than any estimate printed. 14. This painting is reproduced as image on page 5 in the book: Sweetie Ladd’s Historic Fort Worth, Paintings by Sweetie Ladd, Text by Cissy Stewart Lale © Texas Christian University. In the book Lale describes Ladd as: “A sophisticated woman who deliberately chose the medium of folk art to preserve Fort Worth history… Her work frequently was compared to that of Grandma Moses.” Moses’ approach and subject matter has been described as being more simple than Ladd’s work. Ladd’s renderings of Fort Worth are historically accurate, with her own unique additions of memory painting and her own slices of life. Ladd describes her approach as “eclectic primitive.” All four of these pieces are from the Ron Hall collection.

Grace Zillah Briggs Spaulding John was born in Battle Creek, Michigan and lived in Vermont until 1903 when her family moved to Beaumont, Texas as her father became editor of the Beaumont Enterprise. She went on to study at Beaumont High School and then later at the School of Fine Arts, Washington, St. Louis; and in 1912 at the Art Institute of Chicago with muralist John Warner Norton. She was a student of Joseph Pennell at the National Academy of Design in New York from 1921-1922; and then was a student of Edward John Hambridge at the Parsons School of Design, New York. She also painted at the Art Students League in New York in 1923, then to study under Charles Webster Hawthorne at Laurelton Hall, Oyster Bay, New York. After her period in New York she went on to paint in France, Spain and Italy. Then in 1931 became a student of Emil Bisttram in Taos, NM, followed by a year at the Escuela de Bellas Artes, Mexico City. She continued to paint across the U.S.; had studios in both New York and Alameda, California, but maintained Houston as her home residence. Throughout her lifetime she exhibited at: Rice University, Houston; Museum of Fine Arts, Houston; American Federation of Arts, New York; Pennsylvania Academy of the Fine Arts, Philadelphia and the Los Angeles County Museum of Art. Posthumously her artwork was exhibited at Panhandle Plains Historical Museum in Canyon; Corcoran Art Gallery, Washington; Museum of Fine Arts, Santa Fe and the Isaac Delgado Museum of Art, New Orleans. Her works are in the following permanent collections: Museum of Fine Arts, Houston; National Museum of American Art, National Museum of Women in the Arts and the National Portrait Gallery, Washington, D.C. and the Museum of the City of New York, to name a few. She is referenced in numerous books and dictionaries on American artists. THIS SELECTION OF THREE WORKS ON PAPER were created while Preusser studied under Laszlo Maholy-Nagy at the New Bauhaus School of Design in Chicago in 1939. At the young age of 18, he was one of a select few Texas artists to have gained national recognition. These works represent Preusser’s exploration and experimentation in the Constructivist movement which was an innovative movement coined by Ben Nicholas and Russian sculptor Naum Gabo; an ideal loosely described that “sees and values Art only as a creative act.” Preusser was a Texas artist who embraced contemporary international ideals in art. Traditionally trained in Houston under Olla McNeal Davidson, she saw his advanced artistic abilities. He had a keen perception on the relationship between scientific and creative worlds; the result is art that is not pidgeon holed into a singular idea. These drawings are works of art that give us a glimpse into the brilliant creativity and aesthetic of this important Texas and American artist. These renderings have been described as representations of the nonobjective interior landscapes at the core of Preusser’s mind.

Richard Manning Crisler was born in Dallas in 1908 and remained active in Dallas throughout his short life as an artist until the late 1920s through 1933. Starting in 1924 he began traveling back and forth between Dallas and Taos, NM. He worked later in his life in Chicago. Edmund Kinzinger was born in Pforzheim, Germany in 1888. He attended the Knirr Schule in Munich, the Art Academies in Munich and Stuttgart as well as the Academy Moderne in Paris. After WWI, Kinzinger returned to Germany and taught in Stuttgart and Munich for four years. He then married Alice Fish and moved to the US where he taught at the Minneapolis Art Institute. During that time he also painted in Taxco, Mexico. He returned to Europe for a period where he taught at Schule fur Bildende Kunst in Munich. He then returned to the US in 1933 where he taught at Baylor University in Waco. He became the director of the art department. He went on to earn the first doctorate in fine arts at the University of Iowa. In 1944 he started painting in Taos, NM during the summers. In 1948 he moved to Wisconsin and then North Carolina. He had ceased his painting career in 1948.

In a 1991 interview conducted by Mr. Robert F. Brown for the archives of American Art at the Smithsonian Institution, Mr. Brown discusses Preusser’s artistic career. Over the course of several months, Mr. Brown and Preusser talk about his enduring career in painting, his creative partnership with Gyorgy Kepes, whom he met through another one of his teachers, Laszlo Mahohl-Nagy and his teaching career at MIT. However, prior to all of this, in his formative years as an artist, Preusser recalls a period in Houston, during which “-there wasn’t much of a public there for modernistic art.” Preusser was a pioneer of style during this region and time, he painted in an autonomous and avant-garde style. He recalls Mr. James Chillman, director of the Museum of Fine Arts, Houston, and his backing of Preusser’s work in these early moments of his career and encouraged him to continue to work in this unique style, despite Texas’ demand for more representational art. Olla McNeill Davidson, Preusser’s first painting teacher, also encouraged and supported his innate aptitude for modernism. In this interview, Preusser makes the statement that this painting, “Warlike Theme is to me the most important work I ever did.” This was painted just one year prior to his departure to Chicago to study at the “New Bauhaus” Institute of Design in 1939. He goes on to explain: “It means more to me because of the experience. I was listening to the radio while Hitler – a report of Hitler’s march into Czechoslovakia, which was a year before war was declared, and this subject matter revealed itself only to me only after I’d finished it which I thought had a warlike quality. There are tanks, dirigibles, ships, and that’s why it’s titled that because – and it was titled that and revealed its subject to me subconsciously.” This painting was created at the young age of 18, by one of Texas’ most cutting edge, abstract painters, one can understand why this emotionally charged painting would continue to remain as a significant symbol in Preusser’s private collection through the end of his career. William Lester is known as one of the most important and influential Texas modernist painters. A native of Graham, TX, Lester moved to Dallas in 1924 where his painting studies excelled while he painted alongside Alexandre Hogue under the tutelage of Thomas Stell and Olin Travis at Travis’s Dallas Art Institute. After the start of his professional career as a draftsman at the Dallas Power and Light Company, working alongside Charles Bowling; at the same time as an artist at the Civilian Conservation Corps near Palo Duro Canyon; he went on to teach at the Dallas Museum of Fine Arts until 1942. Lester’s more influential decades began in the 1940’s when he was hired by the University of Texas, Austin to teach in the art department. His style evolved while he was there along side fellow art professors Everett Spruce, Loren Mozley, Seymour Fogel and sculptor Charles Umlauf to name a few. Lester’s style is most likened to his good friend and painter, Everett Spruce. Katie Robinson Edwards quotes Mr. Lester and his feeling on the evolution of his painting while at UT: “My color needed strength, more visual force, more drama. I wanted to be sure also that the shapes gained maximum strength.” These forceful techniques with his use of lines, defined shapes punctured with bold colors certainly evoke the strength, force and drama that he wanted to portray in each of these paintings in lots 200 through 204. Edwards goes on to describe Lester’s influential figurative work as “depicted in a heavy manner that makes them as solid as rocks, forecast the work of later artists such as David Bates.” Lester remained at UT until his retirement in 1972. During this time he was the chairman of the art department from 1952-54. Lester’s work continues to be admired and acknowledged in the following permanent collections: Dallas Museum of Art, Jack S. Blanton Museum of Art, Modern Art Museum of Fort Worth, Museum of Fine Arts, Houston, the Torch Collection, the Witte Museum, Metropolitan Museum of Art and the Whitney Museum of American Art to name a few.
