TERMS AND CONDITIONS OF AUCTION The following, as amended by any posted notices, specific bills of sale or similar instruments relating to a transaction or oral announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalogue shall be offered for sale or sold by Murad Auctions, the auctioneer conducting the sale on behalf of any consignor for whom we act as agent. DDFAA (as subsequently defined) is not an auctioneer and is not conducting the auction or arranging any resulting transaction. In these Conditions of Sale, “We” and “Our” refer to Murad Auctions. 1. As used herein the term “bid price” means the price at which a lot is sold to the purchaser and the term “purchase price” means The aggregate of (a) the bid price, (b) A PREMIUM PAYABLE BY THE PURCHASER OF 20% of the hammer price (or 25% if bidding via LiveAuctioneers.com online) and (c) unless the purchaser is exempt by law from the payment thereof, any Texas or local sales tax (or compensating use tax of another state) and applicable taxes. Murad Auctions has been authorized by the consignor to retain, as part of our remuneration, the premium payable by the purchaser. 2. On the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot, and title to the lot shall pass to the purchaser, in accordance with all of the conditions set forth herein and thereupon the purchaser (a) assumes full risk and responsibility therefore (b) if requested will sign a confirmation of purchase, and (c) will pay the purchase price in full in cash for all lots purchased. To prevent misdelivery and inconvenience in settlement of a purchase, no lot may be transferred. All property shall be removed from our premises at the purchaser’s expense immediately following the sale. If not so removed we may, as an accommodation to the purchaser, transfer the property to a public warehouse or other premises under our control or the control of DDFAA at the purchaser’s sole risk and expense. Each sale made pursuant to these Conditions of Sale will be deemed to constitute a grant of security interest by the purchaser to us in, and we may retain as collateral security for the purchaser’s obligations to us or our assignee, any of the purchaser’s property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the purchaser. Each purchaser consents to the filing of public notices or our lien. Whenever the purchaser pays only a part of the total purchase price for one or more lots purchased, we may apply such payments, in our sole discretion, to the lot or lots we choose. Payment will not be deemed made in full until we have collected all amounts due in cash or good funds represented by cleared checks or cashier checks. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including but without limitation, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or b) resell the property with a three day notice to the original defaulting purchaser, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorney’s fees and incidental damages; or (c) take any measures it deems necessary. If Murad Auctions must resell the property, the original defaulting purchaser will be held responsible for any deficiencies in the purchase price, including any and all associated expenses including reasonable attorney’s fees, warehousing, commissions or any other costs associated with the default. No actions by us or any third party before or after the auction shall be deemed a waiver of any of the foregoing. 3. We reserve the right to withdraw any property at any time before the actual sale. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalogue and no lot shall be divided for sale. 4. The auction will be conducted by Louis Murad TXS 13362. We reserve the right to reject any bid 2
from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects. 5. If we are prevented by fire, theft or any reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages. 6. Some lots are offered subject to a “reserve,” which is an undisclosed minimum price below which the lot will not be sold. If a lot is offered subject to a reserve, the auctioneer may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. 7. ALL STATEMENTS CONTAINED OR IN ANY BILL OF SALE, INVOICE OR ELSEWHERE, OR MADE BY THE AUCTIONEER, AS TO AUTHORSHIP, PERIOD, CULTURE, SOURCE, ORIGIN, MEASUREMENT, QUALITY, RARITY, PROVENANCE, IMPORTANCE, EXHIBITION AND LITERATURE OF HISTORICAL RELEVANCE OR PHYSICAL CONDITION ARE QUALIFIED STATEMENTS OR OPINION AND NOT REPRESENTATIONS OR WARRANTIES. WE AND CONSIGNORS MAKE NO REPRESENTATION AND WARRANTIES AS TO WHETHER THE PURCHASER ACQUIRES ANY COPYRIGHTS, INCLUDING BUT NOT LIMITED TO, ANY REPRODUCTION RIGHTS IN THE PROPERTY. No employee or other agent of Murad Auctions, the auctioneer, David Dike Fine Art, L.L.C., Dike Management, LLC, David Dike Fine Art Auction, David Dike Fine Art or of David Dike (collectively “DDFAA”) is authorized to make on behalf or that of the consignor any representation or warranty, oral or written, with respect to any property. Prospective bidders should inspect the property before bidding to determine its condition, size and whether or not it has been repaired or restored. All deliveries will be shipped COD unless otherwise agreed to by purchaser and Murad Auctions. If packing and handling of purchased lots is done by us, it is done at the entire risk of the purchaser. We are not liable for any acts or omissions of carriers or packers, including those we may recommend. Such carriers or packers may carry their own insurance and any claim for loss or damage should be addressed directly to them. No items will be shipped unless we specifically agree to do so. 9. Unless prior arrangements have been made with Murad Auctions, there may be a seven day waiting period if purchasing artwork with a personal or company check. To avoid delay of this sort, bidders are encouraged to prearrange check approval or establish a line of credit
with Murad Auctions by calling (214) 720-4044 no later than 5pm on Friday, October 29, 2021. There will be no exceptions. Bank card purchases will be honored at our option. 10. These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by Texas law. By bidding at an auction, whether in person or by agent, telephone or other means, the purchaser or bidder agrees to be bound by these Conditions of Sale and to consent to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of Texas. All of our obligations under these Conditions of Sale and the obligations of purchaser to pay, are performable in Dallas, Dallas County, Texas. 11. These Conditions of Sale shall bind the successors and assigns of all bidders and purchasers and inure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof (other than posted notices or oral announcements during the sale) shall bind us unless specifically stated in writing by us. As a service to those wishing to place bids, we may at our discretion accept bids without charge in advance of sale by telephone, or in writing on bidding forms available from us. “Buy” bids will not be acceptable; all bids must state the highest bid price the bidder is willing to pay. As noted above, a premium payable by the purchaser will be added to the bid price. In the event identical bids are submitted, the earliest will take precedence. Absentee bids shall be executed in competition with other absentee bids, any applicable reserve and bids from the audience. Successful absentee bids may not be acknowledged, but sale results and selling prices for any lot may be obtained by telephoning us during normal business hours. We assume no responsibility for failure to execute these bids for any reason whatsoever. 13. As a convenience to our clients, we furnish pre-sale estimates for all lots included in the catalogue. These are intended as an approximate guide to current market value, and should not be interpreted as a price or as an appraisal. The final bid may well be less or more than any estimate printed. 14. It was installed in a fountain in San Jacinto Plaza, El Paso, TX. “Four bronze plaques that graphically portray the evolution of the West and the men who had a part in it are now displayed in the new fountain in San Jacinto Plaza. Clyde Connell is a Louisiana born artist whose family (the Dixons) were planters and had a plantation. She became a full time artist only in her 60’s, compared herself to William Faulkner in that she wanted to create important art using the local environment. However, living with her husband TD Connell in the small cabin on Lake Bistineau near Shreveport, LA limited her resources. Paper became a popular medium of choice for Connell on which she created in collage and drawing. Her big breakthrough as an artist hit later in life, when she was in her 70’s, via Texas. She shared her work with Murray Smithers of the Delahunty Gallery in Dallas, TX. Her sales rocketed across Dallas and Houston and her energized esteem landed her a show at the important Manhattan, NY venue the Clocktower Gallery; The New York Times review to follow was an impressed and positive one. From that point on, her work has been recognized on the national level.

CASETA—The Center for the Advancement and Study of Early Texas Art is a statewide 501(c)(3) nonprofit organization formed in 2003 to promote the preservation, study, and appreciation of Texas visual art and its history. CASETA focuses on art produced by artists who were born in and/or lived and worked in Texas through 40 years prior to the present date. Throughout the year, CASETA presents public programs to advance interest, learning, and enjoyment of Early Texas Art, including in 2021 a free, virtual Fall Forum (October 1-2). CASETA’s 18th Annual Symposium will be hosted in Dallas in late spring, 2022. CASETA is supported through annual memberships, contributions, and special initiatives. A Selection of Paintings from the Reaves Collection of Texas Art LOTS: 113–167 David Dike Fine Art is pleased to offer a selection of 50 works from the collection of long-time Texas art collectors and advocates, Linda and William Reaves.
The Reaves have been active as collectors in the Texas art community for over four decades. The couple assisted in the formation and growth of the Center for Advancement and Study of Early Texas Art (CASETA), and subsequently operated one of the state’s foremost Texas art galleries in Houston for over a dozen years. Since 2017 they have served as General Editors of the Joe and Betty Moore Texas Art Series at the Texas A&M University Press, co-authoring or co-editing eight books on Texas art as well as contributing to other publications related to the field. They currently serve as independent art researchers and curators of Texas art. Most recently the couple has partnered with the J. Wayne Stark Galleries at Texas A&M University to develop the Texas Art Project, curating and underwriting an important new exhibition series of Texas art at the university.

He also depicted, from memory, several important Panhandle-area people: Grover Hill, Undersecretary of Agriculture under President Franklin D. Roosevelt, has his back to the viewer; Facing Hill is Hugh Gouldy of Gouldy Brothers Feed Store; to Hill’s left, Mead wanted to depict William (Wm.) Gouldy, Hugh’s cousin, but did not know him well enough.

Alexandre Hogue is an important and influential American Regionalist artist. During the 1950s to the 1970s, Hogue created a series of watercolors based on scenes from sketching trips to Sand Creek in Osage Hills State Park near Bartlesville, OK. Through these and other works from this time, he was experimenting and pushing the boundaries of his media. He was seeking to unite abstract brush strokes, and a painterly approach, with the structure and foundation of representation. In this piece he captured, with exuberant colors, the life force of the water coursing through the shelf rock as it carved out new pathways.
note: Brad Place joined the University Tulsa Art Department in 1947. In 1963, he succeeded Hogue as Department Chair and served until his retirement in 1986.

Stella Lee Story Martindale was born in 1870s (died in 1937). In 1906 the family moved from Martindale to San Antonio. In 1912 James Bruce and Stella Lee Story Martindale returned home to Martindale, TX to commission Julian Onderdonk to paint this scene of the dam on the San Marcos River near their home. They had three children: Olive Martindale Legean, Howard Martindale and James Bruce Martindale, Jr (1916-1987). Stella Lee Story Martindale passed in 1937 and James Bruce Martindale passed 1939. The painting went to their daughter Olive M. Legean by her will. Olive Legean gave the painting to her daughter Catherine Legean, who then loaned the painting out and it was lost for a brief period. Olive then paid an art dealer in Houston $900 to get the painting back. Bruce Martindale, Jr. should have been direct descendant of the painting, but he purchased the painting from his sister, Olive Legean in the 1960s. James Bruce Martindale, Jr. passed away in 1992, James Bruce Martindale III inherited the painting. This painting is included and pictured as cat. No 623 on page 185 of Julian Onderdonk A Catalogue Raisonné, by: Harry Halff © 2016 by the Museum of Fine Arts, Houston.

Robert Onderdonk became a permanent resident of Dallas from 1889-1895. His artistic production during that period was divided between North Texas landscapes and portraiture. In 1893 Onderdonk was selected to organize and lead the Art Students League of Dallas. He regularly took his students to Old City Park and Turtle Creek, which were both accessible to his studio on Elm via streetcar. At the time, Turtle Creek was an undeveloped wild area on the outer edge of the city. wThis 1893 painting fits the description of Dallas Old City Park as described in “Centennial History of the Dallas, Texas Park System” with its broad areas of mowed lawn, gravel trails, rustic fence, and wandering creek.

Leon Shulman Gaspard is known for his identifiable loose impressionist renderings in bright colors of peasant life, which convey his skilled eye for balanced soft yet bright palates and directional brushwork application. The Smolensk Bridge is a prevalent subject for the artist as he painted versions of this heavily trafficked foot and carriage bridge in Smolensk, Russia. Painting this locale during the winter allows dramatic contrast of the colorful peasant dress against the winter white snowscape. The Smolensk Cathedral’ colorful domes flower up on the horizon, adding depth to the painting. 206. Gaspard was born in Vitebsk, outside of Moscow, in 1882. His father was a fur and rug trader, resulting in Leon’s early travels across parts of Asia. During WWI he served in the French Air Force, married, and later moved to the US with his wife. The couple made their way to Taos, New Mexico in 1918 where he joined the burgeoning art scene. He continued to travel and explored parts of Mongolia during which time he amassed inspiration that are the themes of his paintings. Throughout his career, Gaspard was well represented, and his paintings fervently collected for their exotic subject matter. He was represented by Stendahl in Los Angeles and Milch and Reinhardt in New York to name a few. Today his works remain a mainstay in American and International fine art collections. His Taos School involvement connects him to collectors of the American Southwest. Gaspard’s work can be found in the following collections: New Mexico Museum of Art; Panhandle-Plains Historical Museum; Art Institute of Chicago; Phoenix Art Museum; and Colorado Springs Fine Arts Center to name a few.

In this painting, Grammer depicted a 300-ton dockside crane designed by Ewbank, Tupper & Assocs., located in Toronto harbor. Grammer noted, “I came back after dark to watch freight being unloaded from a vessel. The weather had given way to rain and sleet, hampering the work considerably but providing a dramatic shroud for the spotlight patterns. Winter coal had been piled in black mountains on the next pier, lending a deeper contrast to the whole, creating visual excitement. Everett Franklin Spruce, a native of Conway, Arkansas, moved to Texas by way of scholarship to the Dallas Art Institute when he was 17 and immediately became a force in the North Texas art scene. Spruce is known as being part of the burgeoning group of young artists named the “Dallas Nine” — originally titled as such in 1932. Decades after this group’s acclaim was celebrated, the “Nine” grew, adding many more talented artists. Over seven decades of painting, Spruce achieved well-deserved acclaim at every stage, his works reveal his continued exploration and growth as an artist. The major turning in his career came when he was hired to be on faculty in the newly formed Art Department at the University of Texas, Austin. Spruce was among a group of select artists who reformed the department, which elevated the reputation of Texas art nationally. Spruce played a key role in this reform, and his artwork reflects that advancement even today.

The Amon Carter Museum of American Art presented: Texas Made Modern: The Art of Everett Spruce, May 30 – September 20, 2020. The book: Texas Made Modern: The Art of Everett Spruce by Shirley Reece-Hughes was released in conjunction with the show and describes the latter decades of Spruce’s career. During this time, he created some of his most poignant and evocatively elevated work. Reece-Hughes quotes Spruce (page 73) on joining the UT department as, “my first real opportunity to concentrate on the business of being a painter.” Reece-Hughes explains Spruce’s technique in depicting the land and sky as having a “profound ability to show how it felt to be in the prairie.” This painting represents the culminations of his unique style and is part of a rare collection of prairie works from the 1970’s. The impact of this painting goes beyond Spruce’s own perceptions in the mystery of the lunar prairie moment; a viewer looking closely can appreciate the sensory experience Spruce must have felt. Prairie Night – Eclipse of the Moon represents Spruce’s mastery of atmospheric representation in rendering the rare Texas phenomena of lunar light on the prairie, his admirable technique transcends today. For Spruce, the mountain landscape was a significant theme he explored in his work throughout his career. In Lot 218, he presented the mountain as a large, nearly monolithic, form that anchors the composition. As part of his practice, Spruce loved walking and hiking in nature to experience firsthand the vast nuances of the terrain and moody changing weather. He would steal away for inspiration and come back and try to capture more of the essence of the landscape than what can be seen with the naked eye. Over this mountain terrain he captured strong geometric forms yet softened their edges by dry brush and scumbling techniques. Patches of yellow ocher, taupe, teal green, burgundy, and orange pop through the strong blacks and mid-tone grays of the landscape. This painting is framed in a Douglass frame.

This painting was purchased directly from the artist. Kelly explained he had just moved to Fort Worth and was working at the Consolidated Vultee Bomber Factory where he met other members of the Fort Worth Circle. The letter on the table was addressed to his parents in Louisiana. The newspaper headlines contain the words, “…to declare war on Japan.” Kelly explained the cigars in the cup were to symbolize “Fat Cats” making all the decisions. The severed foot and seashell symbolize the surrealism of the entire situation and mark the artist’s fascination with the surrealist leanings of his newfound friends in the Fort Worth Circle. It is a very early example of Fort Worth School Art at the beginning of the war.

Ben Culwell was a Texas painter who had several abstract expressionist works in the 1946 national exhibition Fourteen Americans at the Museum of Modern Art in New York. Dorothy Miller edited the catalogue of artists for the show and describes them as “All are concerned not only to utter the unique and spontaneous experience of the artists, but to make that experience embody the moods and intentions of our time.” -Dorothy Miller, Fourteen Americans, 1946, pg. 8. Job II exemplifies a unique period in Culwell’s oeuvre. Much of his works are non-objective, abstract and highly emotional. This is conveyed with thick layers and varied tempos of paint application. His early works reflect the turmoil of American youth and their role in WWII. Job II, created around 1962, reflects an advancement in his work. In Katie Robinson Edwards book, Midcentury Modern Art in Texas, she describes Now II, a similar work to Job II, as well as his 1960’s period as, “In the mid-1940’s Culwell retained the German-inspired Expressionism of his war time mixed-media works that were exhibited at MoMa in New York, later shifting into the equally expressive but wholly unique, multifaceted style, apparent in the higher key in his 1960’s work.” Much like Now II, Job II as Edwards describes is, “meticulously gridded geometrical areas in play with free flowing pours.” -pg. 81.

lot 236, letter from jack boynton: Bill Reaves asked me to send you a history of my watercolor Structure & Eclipse which you recently purchased… and thank you by the way. I think it is the only watercolor that I did until the early ‘70’s. In 1955, the Grumbacher Co. asked me to do a watercolor which would be exhibited on a circuit of their stores (etc.?). My motivation was a free set of watercolors plus paper. The invitation (as best I remember) came from Lon Hellums who had the only art supply store in Ft Worth, TX. My problem was in working with the transparency of watercolor and little or no experience with it (I had been working primarily with oil and casein). In those days, I worked from careful sketches. There was a deadline so instead of developing an original sketch for the watercolor, I lifted the idea from one of my earlier casein paintings. When completed it went on Grumbacher’s circuit and I never saw it again for 20 years. Somewhere in the ‘70’s I asked a Grumbacher dealer here to find it for me, which they couldn’t do until I asked for payment (I gave them a high price for the moment), after which it reappeared magically. Structure & Eclipse was done at a time when I read a lot of science fiction and my work of that time reflected that interest. As to where it has been shown, you’d have to ask Grumbacher. From the Western Art Collection of William Moore Noble, Sr. LOTS: 278–291 William “Bill” Noble, Sr., was born in Texas City, Texas and fought in World War II in the South Pacific in the Air Force at the age of 16. When he was 26, he started his first bank in Victoria, Texas called American Bank of Commerce and eventually expanded his banks to Sinton, Texas City and Johnson City Texas. Bill’s passions were banking, ranching, hunting, and deep-sea fishing. In 1970, at the age of 43, after a dinner with the late President Lyndon Johnson at the LBJ ranch; Bill bought the Johnson City Bank and LBJ’s exotic game ranch. LBJ became a close friend and inspired Bill into collecting Western Artists such as Melvin Warren and G. Harvey. Bill spent over 30 years on the Great Barrier Reef in Australia catching record size Black Marlin in addition to keeping a boat in Bimini and Rockport, Texas. Towards the end of his life, he divided his time between Rockport and Fredericksburg, Texas.

Texas native Trent Tate graduated from the University of Texas at Austin and moved to Hollywood to pursue scriptwriting for movies. After becoming disenchanted with Hollywood and his ability to creatively influence the direction of his screenplays, he returned to Texas and shifted his focus to one of his early passions, painting. In his works, he vividly captures western landscapes. He now lives in Austin, and takes painting trips throughout the West, traveling to Colorado, Montana, Texas, and Mexico.

John Bob Payne was an important early San Antonio painter who was inspired to paint by his friend Julian Onderdonk in 1914. His studio was in La Villita where this painting was executed. It shows San Antonio’s oldest 300 year old historic neighborhood, La Villita in the foreground with the old Tower Life Building/ Transit Building, built in 1927, towering above the city. He was a member of the River Art Group in San Antonio and organized their first show in 1943. Also exhibited at The Coppini Academy of Fine Arts, and was President there in the 1950’s, as well as the Texas Artist’s Circuit Exhibition 1953 and San Antonio local artist’s exhibition in 1954. He is primarily self taught showing a unique plein-air style capturing the light, colors, and movement of the South Texas landscape.

Hector Bernal was born in Cd. Juarez, Chih. and has lived in El Paso since 1959. He attended Aoy Elementary and graduated from Bowie High School in 1968. He worked as an illustrator in retail advertising in the Popular and the White House department stores. But painting has always been his passion. He has recieved many awards and recognition for his work. He works full-time as a painter in El Paso. His work has been sold to local collectors as well as art collectors in Europe, New York, Houston, and Dallas. In 2007, Bernal was selected to represent The Chamizal National Memorial in Washington DC with one of his works. What he created was beautiful and well recieved in Washington. Bernal traveled by special invitation to The White house to take part in a reception hosted by former first lady Laura Bush to honor contributing artists.

Texas born John “Jack” Erwin was a painter, watercolorist and craftsperson. He studied architecture at UT Austin. Became a member of the American Watercolor Society. He was encouraged by his good friend and painting companion, Reveau Bassett. He served in the US Navy during WWII and Korea. His work was exhibited in Dallas Museum of Fine Art, Allied Arts, California Watercolor Society among others. His work is in private and museum collections around Texas, including the Panhandle Plains Museum in Canyon Texas. He was also an accomplished violin maker.
