Bill Healy founded Mt. Bachelor Ski Area December 19, 1958 with a rope tow and a single lift. Mt. Bachelor has since grown to be one of the largest ski resorts in the U.S. The resort boasts a wide variety of terrain. Guests can ski or ride 360 degrees off the summit, hike the adjoining cinder cone for a thrilling run down, or, ski the trees to find that great cache of powder! Not only is Mt. Bachelor a great place for expert skiers and riders to get that burn, it is also a fantastic place to learn a snow sport or take the family for an exciting day out. what is sunriver?

Sunriver is a planned residential and resort community. Sunriver’s 3,000+ acres are part of Deschutes County, but it is essentially self-governing. The Sunriver Owners Association (SROA) staff provides administrative services, recreation programs and facilities, and maintains more than 65 miles of roads, 33 miles of pathways and a variety of community amenities for property owners, their guests and visitors. The Sunriver Fire and Police Departments are part of the tax-based Sunriver Service District, a special service district within Deschutes County’s government. There are four types of development in Sunriver • Residential areas: There are 4,206 homesites (96% buildout) consisting of privately-owned, singlefamily homes and condominium units. • Recreational Facilities: Located on common areas owned/administered by the Sunriver Owners Association, this includes the Sunriver Homeowners Aquatic & Recreation Center (aka SHARC: indoor/ outdoor pools, lazy river, tubing hill, park, outdoor amphitheater and community meeting spaces) North Pool, 26 tennis courts, Fort Rock Park, Mary McCallum Park and paved pathways for pedestrians and bicycle riders. • The Sunriver Resort: Owned and operated by Sunriver Limited Properties and Destination Resorts, resort properties include the lodge complex, the Woodlands and Meadows golf courses, airport, marina, stables and other resort-afiliated facilities. Sunriver Environmental LLC is owned by the resort and is responsible for water and sewer services in Sunriver. • Commercial Development: In addition to Sunriver’s commercial core, including The Village at Sunriver, there is a north grocery store/gas station on Cottonwood Road. The Sunriver Business Park is outside Sunriver a short distance west of Sunriver’s main entrance on South Century Drive. a message from sroa’s general manager Dear Owner, On behalf of the Sunriver Owners Association Board of Directors, I welcome you to Sunriver. We have enclosed some information we hope you will ind helpful as you become a member of the Sunriver Owners Association. The purpose of the Sunriver Owners Association is to provide services to the Sunriver property owners and their guests. We provide recreational amenities and programs, maintain the bicycle pathways and road system, publish the Scene newspaper, operate channel 4 and the association’s website. We manage the natural areas of Sunriver to reduce ire hazard and sustain healthy ecosystems. We ensure the quality of the built environment by administrating the Design Committee Rules. Fire and emergency medical services are provided by the Sunriver Service District. Sunriver Owners Association is governed by a nine member Board of Directors, elected by all association members. The board meets on the third Saturday of each month at 9 a.m. in the board meeting room at the association ofice. Additionally, an annual member meeting is held the third Saturday of August. I encourage you to attend board meetings and to participate in other association activities. The strength of the association is in the members. Sunriver has a long tradition of volunteers providing service to the community, either through the association or by participation in the many ine community organizations. how SROA communicates with owners • Website. Available anytime day or night, the SROA website (www.sunriverowers.org) is an ofice that never closes. Information available on the site includes downloadable forms and applications, meeting and event dates, rules and regulations, recreation programs, SROA news, weather and more. If you’re new to the site, follow the sign-up instructions under Online Ofice to create a login/ password to access all areas. • E-mail. Owners can add their email addresses to their directory listing on the website to receive electronic updates directly via email. • Walk in. To the SROA Administration Building, 57455 Abbot Drive (between circles 3 and 4). Staff can answer questions or direct you to the person that can. Hours are 8 a.m. to 5 p.m. Monday-Friday. • Bulletin Board. A bulletin board in the SROA ofice foyer and at SHARC posts meetings and items of interest. • Telephone. Call 541.593.2411 during regular business hours to speak to staff. The SROA front desk is a clearinghouse of information about SROA and Sunriver in general. Toll free: 888.284.6639. • Monthly meetings of the SROA Board of Directors are held the third Saturday of each month at 9 a.m. in the board meeting room of the SROA administration building. Board work sessions are held at 9 a.m. Friday prior to the Saturday meeting. Meetings begin with an Owners Forum where owners may ask questions, express concerns and make comments. Attending meetings is the best way for owners to observe how the board administers association business and to understand how the association works. • The Annual Meeting held the third Saturday of August. The annual meeting features reviews of the previous year’s accomplishments, presentations about current issues and future projects, introduction of new board members and oficers, recognition of outgoing board members, and awarding of the Volunteer of the Year award. • From the Board Room is published monthly in the Sunriver Scene, as well as in the electronic version of the Scene posted on the Web. The message reviews association activity, comments on issues before the board and expresses his or her opinion about what is happening. • Mailings: SROA periodically employs direct mailings to communicate issues with owners. The annual election is the most common direct mailing, though surveys and an occasional letter from the board president have also been distributed this way. • Annual and special election ballot packages which are sent to all members via US mail. Topic speciic explanations of ballot measures appear in each voter information pamphlet, and are often accompanied by a statement from the board of directors. Owners can submit pro and con statements regarding ballot measures for publication in the voters information pamphlet. • Channel 4. Channel 4 is a community-access TV channel on the Chambers Cable system that SROA programs with information about community events, meetings and other items of local interest. Short topical videos (ice safety, Citizens Academy, candidates for the SROA board) have also run on this channel.

owner access identification cards As a Sunriver property owner, you and your immediate family (spouse and children ages 4-23) are entitled to an SROA Owner ID card. The card entitles you to unlimited use of all swimming facilities, tubing hill, SROA-owned tennis courts and parks. In addition, many local restaurants and retail shops offer discounts to current cardholders.

Independent Rental Access Program (IRAP) The Independent Rental Program is available to owners who manage their own rental homes. The program offers owners’ guests unlimited use recreation access cards for swimming and tennis for an annual fee based on ownership and occupancy listed with the Deschutes County DIAL system.

Owners must have a current ID card to obtain the passes, which are good for one use to SROA pools or tennis courts. Each year Sunriver Owners Association also enters into a Recreation Access Agreement with several of the large-scale property management companies. This agreement allows their guests access to the recreation facilities for a fee. The monthly SROA maintenance fee does not cover any recreation costs. Rather, all recreation facility costs are covered by gate fees, owner ID card fees and access agreement revenue. Homeowners with activated ID cards will be allowed unlimited access to the pools, tennis courts and a variety of recreation program discounts. Your questions or comments are welcome. FORT ROCK PARK is located between circles 4 and 11 and provides recreational facilities for softball, basketball, tennis, volleyball and horseshoes (see map). A large, grassy ield is available for soccer, baseball, football and other activities. A pavilion shelter is available for picnic and barbecue events. PAULINA PARK is located at SHARC off circle 2 and Overlook Road. The park is open dawn to dusk daily, and offers a covered pavilion available for rent (reservations required). The park also has a grassy area with picnic tables, climbing wall, play slide and a bocce ball court. MARY MCCALLUM PARK, located on the river adjacent to the Marina, is restricted to use by Sunriver property owners. It offers picnic and barbecue facilities and a shelter with a ireplace. There are also horseshoe pits, a half basketball court and ball ield. The park is gated and a key code is needed for access. The gate code for the month is available to registered owners signed in on the SROA website under Welcome>Sunriver Parks or contact SROA. recreational vehicle storage yards Parking recreational vehicle (boat, motorhome, snowmobile, ATV, travel trailer, etc.) is allowed in Sunriver driveways only for 48 hours during your stay. There is no overnight parking at condo complexes (they have separate condo rules in addition to SROA rules). Roadside parking of ANY vehicle is prohibited anytime/ anywhere in Sunriver. After 48 hours, homeowners and guests must use the SROA short- or long-term storage facilities for their recreational vehicles. Both storage areas are fenced and locked, and a key code is required for access. We accept cash, checks, MC, Visa and Discover cards for payment. Space sizes available (in feet): 8x10, 10x15, 10x20, 12x25, 12x30, 12x35 and 12x40. SHORT-TERM (up to 60 days) storage can be arranged through the SROA administrative ofice. Shortterm space rental is $5 per night for Sunriver property owners or $10 per night for guests. There are no electrical hookups in short-term storage. Vehicles need to be removed by noon following the last night’s reservation. The lots are located between circles 3 & 4 behind the SROA ofice and Fire Station and off Cottonwood Road and North Imnaha on Thielsen. First ill out a reservation form at www.sunriverowners.org. sunriver pathway & other common rules • Ride only at a safe speed on surfaced paths & permitted roads. • Non-motorized cycle & pedestrian use only. • Pedestrians and people walking cycles have right-of-way on paths and at road crossings. • People riding cycles must yield to vehicles at road crossings. • Walk cycles through ALL tunnels. • Helmets required for riders and passengers under 16 years (state law). • Headlights and red relectors required at dusk and after dark. • Ride or walk on the right-hand side of pathway. • Pass safely on the left after giving an audible warning. • Stop without obstructing other trafic. • Pets must be secured in baskets or trailers; do not ride with leashed pets alongside. • Smoking and littering are prohibited on paths, roads and common areas. PETS – Pets must be attended when not conined to their owner’s property. Keep pets under effective voice or leash control. Persons walking dogs must have a leash in possession at all times. The person responsible for a pet must clean up after it. SMOKING & FIRES – Smoking is prohibited on other than private property except within an enclosed motor vehicle, or when speciically permitted by signs. No ires are permitted, except in indoor ireplaces and wood stoves. Use only gas or electric barbecues outdoors. Discard burning material, such as cigarettes and ireplace ashes, in a ireproof container only (containers available at Sunriver Fire Department). WILDLIFE – Do not approach wildlife; they may appear tame, but they are unpredictable wild animals. Never feed wildlife, except birds. Control pets so they do not harass or chase wildlife. VEHICLES & PARKING – Maximum speed limit is 25 mph in Sunriver. Vehicles must be parked on owner’s property or in designated parking areas. Do not park along roads and do not block passage of emergency vehicles or snowplows. RECREATIONAL VEHICLES – Motor homes, campers or trailers may not be used for overnight accommodations. Recreational vehicles including motor homes, campers, boats, snowmobiles, motorcycles and trailers may be parked only in an enclosed space on owner’s property or in the driveway on a temporary basis not to exceed 48 hours within a seven day period. RV storage is available for a nominal fee. WEAPONS & FIREARMS – Use of weapons and irearms is prohibited, including guns, paint ball guns, bows and arrows and ireworks. CARDINAL LANDING BRIDGE – Do not jump or dive from the bridge; underwater obstructions create extremely hazardous conditions. RENTAL UNITS – Nuisance caused by over occupancy, noise, illegal parking or other unacceptable behavior is prohibited.

ladder fuels pickup for property owners The annual schedule for ladder fuels pickup by the Sunriver Owners Association Public Works Department takes place between April and October. All roads will be checked and brush picked up on the irst full week of each month. Please have brush ready for collection by the irst of the month. How long it will take to reach your area depends on the amount of brush to be collected from other areas. PLEASE OBSERVE THE FOLLOWING: • There is no need to call us to come get your pile. All roads in Sunriver will be checked each month from April to October. • Cut branches to 8-foot maximum lengths. • Stack brush next to and parallel with the road edge so equipment can reach it without going off road. • Be careful not stack on top of or near electric/telephone/cable boxes, water/sewer valves and meters, big rocks or sprinklers. • Bagged materials will NOT be collected. • We cannot pick up pine needles, grass, leaves or small branches that our grapples cannot hold. If you try to include this material we will leave the entire pile.

NOTE: This service is provided ONLY to individual Sunriver property owners for reduction of ladder fuels. Should owners decide to use contractors to reduce ladder fuels on their property, the contractor is responsible for disposal of all debris created. Vegetative materials generated for building construction is also the responsibility of the owner and their contractor and will NOT be removed by SROA.. IF A MAJOR EMERGENCY OCCURS If a major emergency occurs, a need to unriver iSaSter lan evacuate part or all of Sunriver may be necessary. At this time the following will happen: 1. Overhead emergency sirens will sound continuously with a message describing the emergency and the procedures to be followed. 2. An announcement describing the emergency will be broadcast on radio station KLRR 101.7 FM and on Chambers Cable TV channel 4 (SROA) and/or channel 5 (KTVZ-Bend). 3. If an evacuation is required, emergency vehicles may utilize a continuous high-low (European) siren in combination with public address announcements. EVACUATION PROCEDURES 1. As you exit your residence, emergency services personnel will direct you to an appropriate designated evacuation area, depending on the emergency. Leave your location immediately. Do not pack; it wastes valuable time. 2. If you require transportation, or need special assistance because of physical disabilities, call 911 and give your location. Someone will pick you up. 3. I. INTRODUCTION 1. Community Organization 2


Every homeowner of Sun River is a member of the Sun River Homeowners Association (the “Association”). The Association is responsible for the management of all common areas, as well as the administration of the affairs of the community. The Association is created by the recording of the Declaration of Covenants, Conditions and Restrictions (hereinafter referred to as the “CC&R’s”). The CC&R’s sets forth procedures, rules and regulations which govern the community. The Guidelines are prepared and updated by the Board as an extension of the CC&R and are designed to enhance and clarify the CC&R’s. The Board of Directors (the “Board”) is charged with the responsibility of overseeing the business of the Association and has a wide range of powers. The Architectural Committee (the “Committee”) is established by the Board, in accordance with the CC&R’s and the Bylaws, to review all improvements within Sun River including new construction and modifications to existing properties. The Committee has adopted Architectural guidelines and Community rules for the evaluation of proposed construction activities and for the control of the community standards.

2. Architectural Review Process Any improvements, alterations, repairs, additions, or other work to a lot or a building, including exterior painting, requires the prior written approval of the Committee. Homeowners with proposed changes should contact the Property Management Company, with whom the Association has contracted for full Association management to obtain the necessary forms for the submittal of proposed additions/changes. The following information should be included in the submittal: a. Application Form completed and signed (copy may be obtained from the Association Management Office). b. Plot Plan – A site plan showing dimensions of the existing dwelling, property lines (setbacks, etc.) and the improvements to be made. c. Elevation view – Plans showing finished appearance of the improvements in relation to the existing dwelling and property lines. d. Specifications – Description detailing materials to be used with color samples attached; or brochure. Submit the application and plans to: Sun River Homeowners Association Post Office Box 12510 Chandler, AZ 85248 Please Note: It is the homeowner’s responsibility to ensure that any proposed construction is coordinated with, if applicable, all government agencies. The Committee, the management Company and the Association assume no responsibility for obtaining these reviews and approvals. The submittal will be returned either approved, denied, or for more information within forty-five (45) days of receipt of request. If a reply from the Committee is not received within 30 days, the homeowner must contact the Management Company to make sure that the submittal was received. If approved, the work must start within 60 days from the date of approval and be completed, as approved within 120 days from the date of approval unless a time extension is granted by the Committee. If the work is not started and completed within this time, the approval of the Committee may be revoked. The approval by the Committee of any work shall not be deemed a waiver of the Committee’s right to withhold approval of any similar work subsequently submitted for approval. Homeowners may appeal the decision of the Committee to the Board for consideration. The Board will review the appeal and may ask the Committee for re-evaluation if the owner has information that 3


warrants reconsideration. The Committee will review the new submittal, using alternate members of the Committee, for a final decision.

II. OBJECTIVES OF ARCHITECTURAL COMMITTEE 1. Enforcing the CC&R’s The purpose of the Committee is to ensure compliance with the CC&R and the Architectural Design Guidelines. The Committee monitors changes to lots that are visible from other lots, the street, or the Association common areas. This would include backyards that are visually open to other lots or the Association common areas. The Architectural Design Guidelines ensure that changes in Sun River keep the high standard of attractiveness of the community. These include a harmonious relationship among structures, vegetation, topography, and overall design of the community. These Guidelines will be enhanced, modified, or changed as necessary by the Committee. Any change, modification, or enhancement must be unanimously agreed on by the Architectural Committee and approved by the Board. Therefore, it is important to note that while these Guidelines are consistent with the CC&R, they do not cover all possible situations. It is recommended that the CC&R be studied carefully prior to making additions or changes and to submit all plans to the Committee for approval, in accordance with the latest Guidelines, before starting. 2. Protecting Neighboring property The interest of neighboring properties must be protected by making reasonable provisions for such matters as access, surface water drainage, sound and sight buffers, lights, and other aspects of design, which may have a substantial effect on neighboring properties. 3. Design Compatibility The proposed addition/modification must be compatible with the design characteristics of the property itself, adjoining properties and the community. Compatibility is defined as harmony in style, scale, materials, color, and construction details. Any exterior addition or alteration to an existing residence shall be compatible with the design character of the original structure.

III. ASSOCIATION CC&R’S USE RESTRICTIONS 4


The CC&R’s should be referenced to identify association rules and to help homeowners make property changes. While the CC&R’s is the primary reference for helping homeowners make property changes. Additional interpretation and definition of the CC&R’s is provided to help homeowners understand the guidelines used by the Committee in reviewing each submission. These guidelines do not replace the CC&R’s, but are provided as a supplement to them. The guidelines are listed as follows: 1. Concrete Additions and Driveway Expansions◊ All concrete additions must be approved by the Committee prior to installation. A single, thirty-six (36) inch wide walkway may be installed from the gate to the driveway and it may be extended to the sidewalk (see two diagrams in Appendix 1) provided that it matches the sidewalks in color and texture. Landscaping must be part of the plan submittal showing where and what will be added to soften the look of the concrete. Other restrictions are: a. Concrete that is poured to widen the driveway must not extend beyond the edge of the garage structure, see diagram in Appendix 2. The concrete must match the existing driveway in color and texture. b. Concrete poured from the double-gate to the driveway requires a buffer of at least two feet to the sidewalk; the buffer must be landscaped with trees, shrubs or rocks. See diagram in Appendix 2. If any other material, other than concrete with same texture and color as the driveway, is used then this area can only be used to access the doublegate.◊ 2. Flagpoles◊ Flagpoles are allowed in residential areas, provided that they do not exceed 15 feet in height. They must be located at least ten feet from the sidewalk. If the flagpole is not located in the front yard, the committee will decide on the restrictions. Also, brackets mounted on the house or garage can be used to display the flags. Flags approved for display are listed in Arizona statute ARS 33-1808. 3. Gutters and Downspouts◊ Gutters and downspouts will require approval by the Committee prior to installation. The finish on the gutter must match the adjacent surface of the home in color. High-quality materials that offer long life are necessary, as the homeowner will be required to maintain these additions in good repair. Plans must include the proposed locations of the gutters and downspouts, the quality of material to be used and warranty by the manufacturer. 4. All landscape design and improvements for front yard must be approved by the Committee prior to the beginning of construction/installation. Please check list below for prohibited trees and plants. Lots with an open view fence in the rear yard must submit plans for the backyard showing landscaping and tree/shrub locations. It is strongly recommended that the owner retain professional service for landscape planning and design. In all cases, the installation must comply with the City of Chandler drainage and grading requirements. Ornamentation and Holiday Decoration◊ The utilization of non-living objects as ornaments in the landscape must be harmonious with the character of the neighborhood and must be approved in writing by the Committee. Individual expression is encouraged as long as it does not detract from this goal. Lights and decorations used during the holiday season are permitted from Thanksgiving through January 15. Any other holidays, decorations are permitted as long as they are removed within one week after the holiday. Planters◊ Planters, stepping stones, walkways, and other landscape features, visible from neighboring property must be submitted for approval by the Committee. Surface textures and colors are to compliment the paint color and materials of the house. Maintenance◊ All landscaping shall be maintained in a neat and attractive condition. Minimum maintenance requirements include watering, mowing, edging, pruning, removal and replacement of dead or dying plants, removal of weeds and trash. Lots with front yard grass must over-seed for the winter prior to the month of November. Backyards with view fence must be kept neat and attractive. Anything placed/stored in the backyard (such as a small trailer, a camper shell, wood piles, storage area, pool pumps & filters, or similar objects) must be screened or concealed to minimize its visibility from the common area. This could be accomplished with walls that are compatible with the architectural character of the house or the fence wall. If the view fence is damaged or destroyed through the act of the homeowner, the homeowner will be held responsible for all the necessary repairs. To prevent rusting, please exercise particular care when watering near the view fence.

Synthetic Turf◊ Plans and specifications should be submitted to the Committee prior to installation. Synthetic turf can be installed in either front or backyards. For front yard installation, a number of parameters are important in maintaining a consistent standard throughout the community. These would include, but are not all inclusive as: (1) a minimum 7 year warranty for fade/failure of the product, (2) a UV coating for extended life, (3) a turf height of at least 1 1/2", and (4) a darker, mature green color as opposed to a new growth lighter green. For backyard installation, consideration should be given to maintaining proper drainage for the property and for normal consideration of quality specifications. 5. Outdoor Fireplaces◊ Installation of permanent outdoor fireplaces and fire pits requires advance written approval by the Committee. Outdoor fireplaces and fire pits may not exceed fence height. 6. Patio Covers and Storage Sheds◊ Backyard storage sheds, along with any permanent addition to a home, including patio covers and other buildings, must be submitted to and approved by the Committee prior to construction. All construction must match the home in materials, style and color. Homes without view fencing may construct a shed that will not be taller than or visible above the fence line without matching the home in material and color. 7. Play Structures◊ Play structures may be erected in rear yards only, subject to prior review and approval by the Committee, and must meet the following guidelines: a. Must be set back a minimum of 10 feet from any wall. b. Maximum height allowed to highest point of structure is 10 feet. c. Maximum height of any deck/platform is 4 feet above ground. d. The distance from the ground to the top of the perimeter fence must be measured and submitted with plans. e. The Committee will take the appearance, height, and proximity to the neighboring property into consideration. f. Any shade canopy must be a solid primary or earth tone color and must be maintained in good condition. Plans must be submitted showing elevations and other details. Include brochure, if available. 8. Ramada, Gazebo and Patio Structures◊ Ramada, gazebo, and patio structure additions must be approved in writing by the Committee prior to construction. They are subject to the following guidelines: a. Maximum square footage allowed is 150 square feet under roof. b. It must be set back a minimum of 10 feet from all walls. c. Materials, colors and design must match in character and quality to the house. d. Maximum height allowed is 10 feet at the highest point of the structure. e. Any lighting must be approved by the Committee. 9. Screen Doors/Security Doors◊ Screen doors and security doors, visible to neighboring properties, must be approved by the Committee. Doors must be high quality wrought iron in a color that matches the body of the house. Overly ornate designs will not be allowed. Picture or brochure must be submitted. 10. Swimming Pools◊ Prior to construction of a swimming pool, a homeowner should contact the Management Company to coordinate the point of construction access. In all cases, residents will be required to enter through the side yard wall, or from the front of their homes. Access through common area walls is prohibited. Pools may not be backwashed into the drainage ditches, natural washes, common landscaped areas, drainage-ways, or streets. All backwash water is to be drained directly into the sewer system through an access port on the homeowner’s lot. The City must be contacted to determine the safety fence requirement for the pool. For safety reasons, all openings in walls must be securely covered during construction to prevent anyone from entering and being injured. Pool plans require prior approval for setbacks and height restrictions. Structures/steps that are above the deck elevation which could be used for sitting or standing and features such as pool slide which could be visible above the top of the wall require prior approval. All pool equipment shall be screened from the view of neighboring property, streets, and common areas with walls that match the architectural character and color of the house or the fence wall. If pool equipment is placed near view fencing, space must be allowed to accommodate a screening wall. Also, if pool equipment is noisy, screening wall maybe necessary to reduce the noise to neighboring property. 11. Trampolines◊ Trampolines may be erected in rear yards only, subject to prior review and approval by the Committee, and must meet the following guidelines a. Set back a minimum 10 feet from any wall. b. Maximum height allowed to highest point of structure is 12 feet. c. The committee will take the appearance, height, and proximity to the neighboring property into consideration.

12. Window Coveringsâ—Š Window coverings such as awnings or shades must be approved by the Committee prior to installation. They must be compatible with existing awnings installed by the developers on some of the models. The interior or exterior of any window must not be covered with foil, paper, bed sheets, towels, newspapers or other temporary coverings. All windows facing the street must have permanent draperies, shutters, or blinds installed within 60 days from the close of escrow. Bronze, Charcoal, or Gray sunscreen material may be installed on windows. The frame of the sunscreen must match the existing window frames or the color of the screen.

IV. VIOLATIONS 1. Sun River Homeowners Association Policy 2005.2 – Guidelines for Handling Violations. The Board of Directors of Sun River Homeowners Association adopted the following policy, to the enforcement provisions of the Covenants, Conditions and Restrictions. a. VIOLATION FIRST NOTICE First written notification of the violation: If this violation is caused by extenuating circumstances or is out of homeowner’s control, the homeowners are to communicate with the Board of Directors through the management company immediately. b. VIOLATION EXISTING AFTER FIRST NOTICE IS SERVED Second written notification of the violation: Notice will include a hearing date, along with intent to impose monetary penalties if violation is not corrected within 14 days. c. SUBSEQUENT CONTINUED/REOCCURRING VIOLATION Third written notice of violation: All further notices will result in a monetary penalty ranging from $25.00-$500.00, as directed by the Board, until compliance is reached. In addition to the monetary penalty, refusal to abide by the decision of the Board to correct a violation or an unauthorized work will be referred to the Association’s lawyer for settlement in Court. If the Association prevails, the homeowner will bear all of the expenses incurred. d. ARCHITECTURAL VIOLATION Within 14 days of receiving a written notification of a violation, the homeowner must reply showing how and when the violation will be corrected, or request a hearing. The Committee may allow up to 60 days for the correction depending on the complexity of the work. All further notices will result in monetary penalty and/or referral to the Association’s lawyer. e. PARKING VIOLATION Within 24 hours of receiving a written notification of parking violation, the homeowner must remove the Camper, RV, Trailer, or Boat from the driveway or the street. All further notices will result in daily monetary fines ranging from $25.00-$100.00, as directed by the Board, until compliance is reached

V. DELINQUENCIES 1. Sun River Homeowners Association Policy 2005.2 – Guidelines for Handling Delinquencies The Board of Directors of Sun River Homeowners Association adopted the following policy, to the enforcement provisions of the Covenants, Conditions and Restrictions.

a. DELINQUENT 15 DAYS AFTER DUE DATE : 1. Management Company is to send their standard late payment notice. 2. Delinquent account will be charged/assessed a $10.00 late charge. 3. Treasurer to be notified via the monthly collections report. b. DELINQUENT 45 DAYS AFTER DUE DATE : 1. Management Company is to send their standard late payment notice. 2. Treasurer to be notified via the monthly collections report. c. DELINQUENT 75 DAYS AFTER DUE DATE : 1. Management Company is to send their standard late payment notice (by U.S. Mail registered and certified). 2. Management Company will send a 10 day Demand to Lien notice. d. DELINQUENT 90 DAYS AFTER DUE DATE : 1. If attempts by Management Company to bring the account current are not successful, a Declaration of Lien will be filed and the delinquent account will be charged a $140.00 Lien/Release fee, and a filing fee. 2. A copy of the recorded lien will be sent to the homeowner by U.S. Mail, registered and certified. 3. Board of Directors will be notified as to status of delinquencies.
