Draft Financial Sector Regulation Bill

December saw the circulation of a draft Financial Sector Regulation Bill. The Bill will be step one in introducing the Twin Peaks financial regulatory system. Under twin peaks responsibility over the financial sector is split between 2 bodies. The first being the Reserve Bank and the second, probably, the Financial Service Board (FSB). Council of Financial Regulators The Draft mentions the creation of a Council of Financial Regulators who will co-ordinate all Regulators. The focus of the Council will be on competition, enforcement, financial stability, market conduct and legislation. First Peak The Draft Bill gives primary responsibility for financial stability to the Reserve Bank .Thus as planned the Reserve Bank will fill the role of one of the two “peaks” or top dogs in the regulatory model. FSB vs NCR under Twin Peaks Recently the FSB and the National Credit Regulator (NCR) – who oversee the debt review process and industry- have been arguing about the NCR’s future under twin peaks. The NCR asked the FSB to stop saying that they will be absorbed by the FSB or disbanded. Various parties will now comment on the draft Bill and then the actual Bill will eventually be produced and sent to Parliament. The process of introducing and bringing Twin Peaks to life is set to take a number of years as various pieces of Legislation need to be amended and changed to allow for the new regulatory model

Constitutional Court rules in favour of FRB The matter: Ferris v FRB was granted in favour of the credit provider (as have all previous judgements on this matter in all the lower courts leading up to the Con Court). This means that FRB can now proceed to sell the consumers home on auction to settle some of the debt, if they want and then ask the consumers to pay off the shortfall over time. This is because FRB are now allowed to ignore the debt restructuring court order that was previously granted. Why ignore the other “issues”? FRB did not respond to the consumers debt review proposals and the Ferris’ argued this showed bad faith (as per the Collett judgement) and wanted the debt put back into their debt review. So why did the Constitutional Court ignore this and other info about the service of 86(10) letters (as per Sebola)? Well, it comes down to one very important detail: the consumers missed a payment. This means the debt review fell away. All other considerations in the courts opinion are thus irrelevant. The missed payment showed the court that the consumers did not take the restructuring seriously. The couple failed to show good reason (in their papers) as to why they had missed a payment. Never miss a payment If you are under debt review then you should learn from this matter. Never, ever miss a payment. If you do miss a payment then you should expect to lose your assets and to end up in serious trouble.

Living on Less is about spotting a great deal and letting others know. It’s about changing our mind set to reflect the reality that times are tough and we need to get savvy. SCHOOL FEE EXEMPTION OR REDUCTIONS Do you qualify?


In South Africa education is a basic right. In fact, Section 29 (1) (a) of the Constitution says that “everyone has the right to a basic education”. In the Schools Act of 1996, the Department of Education made going to school compulsory for all children aged seven to fifteen (completion of Grade 9). An interesting consequence of this is that compulsory education places a responsibility not only on parents to send their kids to school, but also on the State to ensure that schools are accessible and affordable. In an effort to do just that the State introduced something called the School Fee Exemption policy .

We have heard you have resigned from DCASA... Why? One of my new year resolutions are to choose my battles. Certain battles are unavoidable, like climbing the next hills in our industry. There are critical decisions about the future direction of our industry to be made and I had to choose a forum who has the same questions, affinities and vision as I have.

Well known Debt Counselling figure Annora Mostert has decided that she is ready for a change. She recently announced that she will be stepping down from DCASA leadership in the Western Cape where she has played an integral role over the last few years. The Western Cape has the second largest amount of Debt Counsellors in SA at the moment. Of the 3 Different Debt Counselling Associations, the province remains split mostly between DCASA and AllProDC. The BDCF have only recently

Credit Industry Forum - latest Member Gerald Rodrigues attended the January 2014 Credit Industry Forum Subcommittee meeting regarding the 2010 NCR Task Team recommendations and was able to participate (due to the changes in our constitution made last month). The discussions showed that the NCR Task Team is now somewhat outdated and many of the things mentioned are now no longer relevant. However there was concern that changing one aspect of the report might mean that other positive aspects get thrown out by credit providers. So, in an effort to speed things along it was decided to remove some of the preamble to the NCRTT report and to split up comments made by DCs into two categories namely: old matters which have now been resolved by court cases and new issues which will have to be handled by the CIF at a later stage and maybe added as an annexure or amendment to the NCRTT report. This left only a few issues which were then reported on by the subcommittee. The recommendation has now been sent on to the NCR. Much of the focus was on practical operational issues with not too much focus on jargon or semantics rather the overall picture. Two more meetings of other sub committees will be held this month and AllProDC will be

in attendance. The meetings will relate to End balances and Section 103(5). AllProDC feel that there is a real need for practical implementation of this section of the Act. We hope to discuss issues such as: Repeat debits on accounts month after month, the cost to creditors trying to recon and provide proper balances which is quite time consuming and expensive so it may simply be easier to write off small balances. There will also be a meeting about early exiting of the debt review process. National Credit Amendment Bill Don’t forget: The DTI are holding a series of public hearings across the country this month, where our members can have their say in regard to the National Credit Amendment Bill. These public hearings will be held on 28, 29 and 30 January 2014. Representatives from AllProDC will attend and we will notify our members of the locations should they also wish to attend.
