EDITOR’S NOTE Winter has bitten hard. Even Eskom is feeling the pinch and has instituted rolling blackouts to try cope with the increased demand as people country wide try to warm up. In fact, winter always pushes up peoples household expenses as we all try get warm (and eat more comfort food) and few of us budget for it. Keep an eye on your budgets over the next month or two and be strict with yourselves. Add more blankets onto your bed and wear jerseys before switching on that heater. We were all so very excited when we heard that the President had signed and gazetted the amendments to the National Credit Act. This was somewhat dampened when we realised that there was no effective date for the new amendments shown. That said, it gives us all a chance to get ready for the imminent changes. In this issue we delve into the National Credit Amendment Act in some detail from both an industry, as well as consumer perspective. Be sure to check out what has changed and what that will mean for you. Excitement over the upcoming Debt Review Awards also continues to grow. There are two separate parts to the Awards; a Public voting portion (think: People’s Choice Awards) and the Industry Panel Awards (think: Oscars). The industry has spoken, the panels have deliberated and in this issue we announce the Debt Review Awards 2014 Nominations in
various categories. Congratulations to all those nominated! You are leading our industry and setting a high standard of service. Well Done! NATIONAL CREDIT AMMENDMANT ACT WHAT IT MEANS FOR YOU
The National Credit Amendment Bill has been passed and is now called the National Credit Amendment Act 2014 (NCAA2014). The Act has been published in the Government Gazette. Please note however that the NCAA2014 will only be in effect from the date that is released by the Presidents office in the Government Gazette.
Short title and commencement 39. This Act is called the National Credit Amendment Act, 2014, and shall come into operation on a date fixed by the President by proclamation in the Gazette.
This date is rumoured to be July 1st 2014 (at this time).
THE BIG CHANGES Several big changes have happened. The DTI minister will now be able to issue regulations about how creditors must workout who can or can’t afford access to credit; The DTI Minister will now appoint the NCR CEO, Payment Distribution Agencies have been added to the Act and consumers can choose whether to use their services or not; Nobody can just run around calling themselves debt mediators or alternative dispute resolution agents without being registered with the NCR; The National Credit Tribunal (NCT) will be able to hear reckless credit applications. We look at four of the new amendments and how they will effect you as either a Debt Counsellor or consumer.
Section 129 (we are going to sue you, unless...) letters No. 37665 GOVERNMENT GAZETTE, 19 May 2014 Act No. 19 of 2014 National Credit Amendment Act, 2014 Amendment of section 129 of Act 34 of 2005 32. Section 129 of the principal Act is hereby amended— (a) by the substitution for subsection (3) of the following subsection: ‘‘(3) Subject to subsection (4), a consumer may at any time before the credit provider has cancelled the agreement, remedy a default in such credit agreement by paying to the credit provider all amounts that are overdue, together with the credit provider’s prescribed default administration charges and reasonable costs of enforcing the agreement up to the time the default was remedied.’’. (b) by the substitution in subsection (4) for the words preceeding paragraph (a) of the following word: ‘‘A [consumer] credit provider may not re-instate or revive a credit agreement after—’’; and (c) by the addition of the following subsections: ‘‘(5) The notice contemplated in subsection (1)(a) must be delivered to the consumer— (a) by registered mail; or (b) to an adult person at the location designated by the consumer. (6) The consumer must in writing indicate the preferred manner of delivery contemplated in subsection (5). (7) Proof of delivery contemplated in subsection (5) is satisfied by— (a) written confirmation by the postal service or its authorised agent, of delivery to the relevant post office or postal agency; or (b) the signature or identifying mark of the recipient contemplated in subsection (5)(b).’’. Section 86 of the principal Act is hereby amended— (a) by the substitution for subsection (2) of the following subsection: ‘‘(2)An application in terms of this section may not be made in respect of, and does not apply to, a particular credit agreement if, at the time of that application, the credit provider under that credit agreement has proceeded to take the steps contemplated in section [129] 130 to enforce that agreement.’’; Amendment of section 130 of Act 34 of 2005 33. Section 130 of the principal Act is hereby amended by the substitution in subsection (1) for paragraph (a) of the following paragraph: ‘‘(a) at least 10 business days have elapsed since the credit provider delivered a notice to the consumer as contemplated in section 86[(9)](10), or section 129(1), as the case may be;’’.

If you get this letter you have very, very little time to act. Talk to a Debt Counsellor the same day if possible or pay up the debt swiftly. Don’t ignore this letter or it will make your life very difficult.
We all knew (with the exception of the courts) that the wording in Section 86 regarding this section was messed up and that a simple numbering error had resulted in debts with section 129 letter being excluded from debt review even though the very letter said go see a DC. It was ridiculous and it is great this has been sorted out.
Though a Section 129 letter may also refer you to a alternative dispute resolution agent remember that owing someone money and not being able to pay it is not a ‘dispute’. It is a problem. You need to talk to a Debt Counsellor about your situation ASAP.
Essentially this means that every Section 129 letter is a letter promoting your services. The key is now educating consumers in your area to act swiftly as the allotted days can disappear very quickly. Creditors are now realising how cost effective debt review is as a collections mechanism and pretty soon it will probably not be uncommon for DCs to be asked to make repayment plans for debts where even a summons has been issued
Section 86(10) - Termination letters No. 37665 GOVERNMENT GAZETTE, 19 May 2014 Act No. 19 of 2014 National Credit Amendment Act, 2014 Section 86 of the principal Act is hereby amended— … (b) by the substitution for subsections (10) and (11) of the following subsections, respectively: ‘‘(10) (a) If a consumer is in default under a credit agreement that is being reviewed in terms of this section, the credit provider in respect of that credit agreement may, at any time at least 60 business days after the date on which the consumer applied for the debt review, give notice to terminate the review in the prescribed manner to— [(a)] (i) the consumer; [(b)] (ii) the debt counsellor; and [(c)](iii) the National Credit Regulator[, at any time at least 60 business days after the date on which the consumer applied for the debt review][.]; and (b) No credit provider may terminate an application for debt review lodged in terms of this Act, if such application for review has already been filed in a court or in the Tribunal.’’; (11) If a credit provider who has given notice to terminate a review as contemplated in subsection (10) proceeds to enforce that agreement in terms of Part C of Chapter 6, the [Magistrate’s Court] court hearing the matter may order that the debt review resume on any conditions the court considers to be just in the circumstances.’’.

In the past consumers under debt review almost got sent these letters 60 days after entering debt review regardless of whether they were paying or not. This should now stop. What is important is that your debt review application needs to be set down in court. Ask your Debt Counsellor or attorneys (for your debt review) when this is happening. If more than two months has gone by and you have not had to sign court documents or been notified of your court date then start to pester your Debt Counsellor about this as your protected 60 work days period is almost over. If you do get a letter like this please contact your Debt Counsellor straight away even if you do have your court date or court order.
Finally, you will have to deal with less of this nonsense. The abuse was horrific and undermined every large credit providers claim of supporting the process. You can be sure, there are still going to be issues but you can reduce them by ensuring that your maters go to court promptly. Not doing so may leave you exposed to claims from consumers should things go wrong. If you feel any credit provider is delaying the process on purpose by not responding timeously then report them to the NCR (and CIF) and add the creditors ‘bad faith’ action in your court application. Please note that setting a matter before the NCT (and getting a temporary case number) will also count.
Clearance Certificates No. 37665 GOVERNMENT GAZETTE, 19 May 2014 Act No. 19 of 2014 National Credit Amendment Act, 2014 Amendment of section 71 of Act 34 of 2005 21. Section 71 of the principal Act is hereby amended by the substitution for subsections (1), (2), (3) and (4) of the following subsections respectively: ‘‘(1) A consumer whose debts have been re-arranged in terms of Part D of this Chapter, [may apply to a debt counsellor at any time for a clearance certificate relating to that debt re-arrangement] must be issued with a clearance certificate by a debt counsellor within seven days after the consumer has— (a) satisfied all the obligations under every credit agreement that was subject to that debt re-arrangement order or agreement, in accordance with that order or agreement; or (b) demonstrated— (i) financial ability to satisfy the future obligations in terms of the re-arrangement order or agreement under— (aa) a mortgage agreement which secures a credit agreement for the purchase or improvement of immovable property; or (bb) any other long term agreement as may be prescribed; (ii) that there are no arrears on the re-arranged agreements contemplated in subparagraph (i); and (iii) that all obligations under every credit agreement included in the re-arrangement order or agreement, other than those contemplated in subparagraph (i), have been settled in full. (2) A debt counsellor must for the purposes of the demonstration envisaged in subsection (1) (b), apply such measures as may be prescribed. (3) If a debt counsellor [refuses] decides not to issue or fails to issue a clearance certificate as contemplated in subsection [(2)(b)(i)] (1), the consumer may apply to the Tribunal to review that decision, and if the Tribunal is satisfied that the consumer is entitled to the certificate in terms of subsection [(2)(b)(i)] (1), the Tribunal may order the debt counsellor to issue a clearance certificate to the consumer. (4) (a)A [consumer to whom a clearance certificate is issued in terms of this section may] debt counsellor must within seven days after the issuance of the clearance certificate, file a certified copy of that certificate, with the national register established in terms of section 69 of this Act [or any credit bureau] and all registered credit bureaux. (b) If the debt counsellor fails to file a certified copy of a clearance certificate as contemplated in subsection (1), a consumer may file a certified copy of such certificate with the National Credit Regulator and lodge a complaint against such debt counsellor with the National Credit Regulator.’’.

A clearance certificate is a certificate which shows that the debt review has been successfully completed and that the consumer is rehabilitated and the record of their debt review has been removed.
This change now means that we can start helping many more clients leave the debt review process. They still get the benefits of the arrangements in many ways but now can be rehabilitated. The last few accounts will have to be up to date contractually meaning some extra time may be required to catch up on bonds and cars after the smaller debts are gone. Get used to explaining this to consumers who may not understand. DCs will need to resist the urge to just leave consumers under review and collect their monthly after care fees. Remember that a rehabilitated consumer is most likely to recommend your services to others who are going through economic hardship.
In the past it was actually legally necessary to pay up all of your debts to qualify for a clearance certificate. This may sound totally normal but it was soon realised that all debt even a person’s bond would have to be paid up for the consumer to technically qualify for a clearance certificate. This was obviously not a great solution as it would keep a consumer out of the credit market for decades. This made no sense. Now consumers can apply for a clearance certificate at any point when they can afford to go back to their normal monthly debt repayments. You will need to work with your Debt Counsellor in regard to figuring out when this point will be. Normally it will be when your smaller debts to unsecured credit is paid up. You may still have payments on your vehicle and bond owing but you might be able to qualify for your clearance certificate.
Prescribed Debt No. 37665 GOVERNMENT GAZETTE, 19 May 2014 Act No. 19 of 2014 National Credit Amendment Act, 2014 Insertion of section 126B in Act 34 of 2005 31. The following section is hereby inserted in the principal Act after section 126A: ‘‘Application of prescription on debt 126B. (1) (a) No person may sell a debt under a credit agreement to which this Act applies and that has been extinguished by prescription under the Prescription Act, 1969 (Act No. 68 of 1969). (b) No person may continue the collection of, or re-activate a debt under a credit agreement to which this Act applies— (i) which debt has been extinguished by prescription under the Prescription Act, 1969 (Act No. 68 of 1969); and (ii) where the consumer raises the defence of prescription, or would reasonably have raised the defence of prescription had the consumer been aware of such a defence, in response to a demand, whether as part of legal proceedings or otherwise.’’.

When you owe someone money and they do not collect it from you for a period of over 3 years and they fail to sue you for the money then the debt is: “prescribed”. This is set out in one of the shortest Acts of all time the Prescription Act. The NCAA2014 also has added some information to this rule of law.
Warn consumers about reactivating prescribed debt before the NCAA2014 takes effect.
In the past (and at present till the effective date of the NCAA2014) what would happen is that creditors would sell their old debt (prescribed debt) to other companies who would then convince consumers to reactivate the debt by making even a small payment toward the debt. They then reset the 3 year prescription deadline and could even sue consumers for the debt if they wanted to. The Amendments now make it an ‘offense’ for a creditor to buy or sell prescribed debt. This is massive since so many debts are prescribed. Beware if you receive a call from a collections person asking you to make payments to old gym contract and doctors bills etc. The debt may have prescribed and if you do make a payment (even of R1) now, before the NCAA2014 kicks in, you will reactivate the debt and have to pay it all no matter what they promise you.
In the future keep an eye out for prescribed debt and report any collection attempts to the credit provider and NCR. It will be interesting to see what punishment this offence will earn. Investigating whether a debt has prescribed could be a big selling point for your services as which consumer wouldn’t love not having to pay a debt?
It is hoped that all the amendments to the National Credit Act will improve the granting of credit, consumer protection and the debt review process. It is common however for there to be a spree of new court cases when amendments are published in order to gain clarity on the exact implications of the changes.

PUBLIC VOTING Though the industry panel awards carry a lot of weight it is also important to see what the public think. Public perception of the industry and role players is vital in gauging the effectiveness and appeal of the debt review process. Thus in a totally separate section of the Debt Review Awards the public will vote for their favourite Debt Counsellors, Payment Distribution Agency and Credit Providers. Keeping Things Fair Though the public may not know exactly where each DC or credit provider fits in, in regard to size, this will be handled in the background to ensure that each candidate is only considered in their individual category.

WHY SOME CREDIT PROVIDERS REFUSE TO CANCEL CREDIT INSURANCE
Recently a new challenge arose within the market, a challenge which is most definitely rooted in protecting personal interests at all cost. Does this sound familiar? - We regret to inform you that your request to replace the credit insurance has been declined...........blah blah blah!!! The insurance department’s at various credit providers have been mandated to repeat the sentence ad nauseam! Given the fact that Debt Counsellors are trying to find workable solutions for their clients which should unlock a degree of relief and right them on their path to financial recovery, every cost saving is of the utmost importance. More often than not, the question of Credit Insurance enters the budget equation. This cost sometimes highlighted on client statements – not by virtue of a BOLD font but by the mere fact that the cost thereof makes one shudder! A quick tickle on the calculator and a quote from another insurer or underwriter and suddenly the replacement of the insurance creates untold financial possibilities within the budget. With the proposal and the clients financial situation well on the way to recovery with the “spare” funds, all and sundry are timeously notified of the situation and the degree of relief is firmly insight. But alas, the insurance department at the credit provider does not share your sentiment and hit the “repeat” button of the aforementioned recording...........We regret to inform you ...........! And it’s back to the drawing board. This matter was recently raised at the NCR and is also under review at the FAIS Ombud. The NCR did question the reason as to why this type of behaviour has surfaced and on what
basis can a decision of this nature be made. Over and above the fact that the FSB has various regulatory frameworks by which, all who operate within the insurance space are subject, certain credit providers do feel that a “cavalier approach” is the acceptable norm within modern day business and simply choose to ignore the “TCF” mandate from the FSB – TCF you ask? Treating Customers Fairly. If a consumer can get cover that in certain cases is 10 times cheaper for the same benefits, if not more, then surely the consumer must be entitled to exercise his right of choice? The cost saving in most cases has a direct impact on the consumer’s financial situation and surely it makes good financial sense to try eradicate the debt quickly but also keeping an eye on insuring it. The reason certain credit providers are providing for the non-cancellation is nothing more than a mere technicality in the Act – “a client must be advised of his/her right to waive the proposed insurance and replace............” What they are saying is that the client can only exercise his right to waive at application stage and not during the term of the loan!! Really? Treating Customers Fairly? There are credit providers with insurance schemes that generate in excess of R2 billion in premiums annually which are highly profitable and most definitely worth protecting at all costs! The sentiment is that it is for this reason that the behaviour of some credit providers, with regards to insurance, hinges on unethical and is questionable. We will wait and see............ It is but a matter of time.

As per the terms and conditions of registration for most Debt Counsellors in South Africa Debt Counsellors do not handle your money. They will arrange for you to pay via a Payment Distribution Agent (or once the National Credit Amendment Act is in force on your own). The PDA are the ones who then handle the money. This arrangement was made so that Debt Counsellors could not be accused of taking consumers money and running away with it.
Direct them to your Debt Counsellor and politely refuse for your phone conversation to be recorded. If a creditor says something like: “we have not been paid” it does not mean that the Debt Counsellor is keeping your money. He does not have access to it in the first place. Often it means one of 2 things. 1) Due to professional fees to the Debt Counsellor and Attorneys during the first 2 months of the process (normally 2 months sometimes a bit more) there may not have been any funds left to go to the creditors. This is normal. The Debt Counsellor and Attorneys must get paid. Due to industry agreements all credit providers know this.
Learn to Trust your Debt Counsellor If the person on the line says something like “The debt review has been cancelled”, consider: By whom? Did you cancel it? Did you ask the Debt Counsellor to cancel the debt review? Can a debt review even actually be cancelled under the National Credit Act? Do you know who it is you are actually talking to? It is always a good idea to ask any caller to talk to your Debt Counsellor. You are paying the Debt Counsellor for their professional service and you did this for a reason. The Debt Counsellor is a trained and qualified expert at dealing with the debt review process. Are you? Do you know how to check if the person calling is really from the credit provider and not a scam artist? Who should you trust more? A professional Debt Counsellor who you are paying to help, and you have chatted with, visited at their office, who has provided documentation to you, who you have gone to court with OR a total stranger who simply says they a creditor of yours?
So, when you get a call from someone claiming to be a creditor, perhaps you should simply direct them to your Debt Counsellor and politely refuse for your phone conversation to be recorded. New Constitutional Court ruling on Section 129 Delivery The recent case Kubyana v Standard Bank of South Africa Ltd(cc) has once again changed our understanding of Sect 129 Notices. In this case which was heard at the constitutional court the Sebola ruling was shown to be a specific case where notice was sent to the wrong town’s post office and thus was invalid. In this case (Kubyana V Std) the ruling given once again places the onus of proof on the consumer to show why they did not collect a section 129 notice via registered mail. Failing that, the Constitutional court ruled that notice is served (if in the right town) as long as the creditor sends the notice via registered mail - even if the consumer then does not read the notice.
