As people enjoy the last of the long weekends, for a while, and those in the winter rainfall areas give a sigh of relief that finally some rain is falling to keep the drought at bay you may be excused for thinking that all is well in SA.

Even debt review is somewhat like that. The process helps consumers pay off their debt in a reasonable manner and relieves much of their former debt stress. At the same time, it does bring some limitations and legal ramifications and restrictions. The good news is that the benefits far outweigh the negatives.

After all, the NCR report that bad debt has reduced quite a bit recently and we have seen some good performance by the Rand and relief from ratings agencies.

In this issue we get ‘back to basics’ and talk about how debt review works and how it benefits consumers. The online version of the magazine is somewhat similar to a special print edition of the magazine that is available via the Payment Distribution Agents at present. So, if you are a Debt Counsellor please feel free to ask them if you can have some copies for your clients and potential clients.

These positive factors have been enjoyed by all and lift the spirits despite the cold but at the same time we see people on strike, people rioting, food companies being investigated and new taxes and levies pushing up the cost of everyday items and services. It is a real mix of the good with the bad. A lot of life is like that. You just have to deal with the negative, while focusing on the positive.

This issue we also discuss some tips and the latest news surrounding the industry, including the industry wide online peer review which is wrapping up in the next few weeks. Next issue we will let you know all the results of

CAN DEBT REVIEW HELP YOU? In 2007 Government introduced the exciting new National Credit Act. These new laws were aimed at helping protect consumers’ rights and balancing them with the need to repay debts to credit providers. Part of the new Act (known as the NCA) was a way for consumers, with debt problems, to repay their debt responsibly but much more manageably. This was called debt review. The NCA made provision for people to get help from trained individuals who would be able to both advise them of their rights and ensure that credit providers were getting regular, reasonable repayments. These trained and registered individuals are called Debt Counsellors. This is why debt review is sometimes called debt counselling. The basic idea of debt review is for a consumer to go to a Debt Counsellor and get advice on their monthly household budget. A balanced budget

ensures that all basic needs are taken care of first before the consumer’s debt is considered. After adjusting the budget, the Debt Counsellor then gets all the available information about the consumer’s debt from each credit provider. A new payment plan is then created to repay the debt. Normally, the plan will involve paying a lot less on each debt, each month but over a longer time period. The plan will ensure that using the available funds each credit provider receives regular payments over time until the debt is paid off. The plan is then taken to either a local court or the National Consumer Tribunal. Consumers then pay this much more reasonable repayment amount each month and their debts slowly reduce over time. Many credit providers kindly agree to charge much less interest and don’t charge monthly fees which helps their clients get out of debt faster. This can even save consumers thousands of Rand over time. Debt review repayment plans can be from 3 months to 3 years or longer. Each consumer’s situation is unique, as are the plans. After the planned amount of time is over and after checking all the balances are at zero, the consumer gets given a clearance certificate saying they have no more debt or that they no longer need debt review. They are now debt free! FINDING A GOOD DEBT COUNSELLOR If you are considering getting help with your debt from a professional then you want to choose the right people to help you. Although many companies advertise that they can help you with your debt, you need to find people that you can trust and that you can work with over the months and years ahead. Getting into debt can take time and it takes time to get out of debt. You want someone you can work with through the entire process. Finding the right company to help you get out of debt is important. Like any professional service, you want the best person for the job - someone who you can easily talk to and someone who is good at doing their job. You particularly want someone who is trustworthy and legitimate. A lot of dodgy firms out there tell you they can help with your debt through what

they call ‘mediation’. The promises they make sound almost too good to be true. The problem is that mediation offers no legal protection and it can actually make things a lot worse. Many firms take upfront fees from you with big promises but do little other than send a letter to credit providers, who probably won’t cooperate with them. When that happens these firms just dump you saying they tried and your fees are gone and you are left out of pocket. Be careful of these debt mediators and any firm who tries to offer you another loan or offers to use credit to ‘consolidate’ your debt. You know you can’t afford more debt, so don’t deal with firms who make empty promises. You want less debt, not more. Your goal should be to pay off the debt you already have, in the fastest possible way. If you want to pay off your debt in a reasonable and responsible manner every month, then you want to find a professional debt counsellor who is registered with the National Credit Regulator (NCR). Rather than try to get help from a dodgy mediation company or someone trying to offer you more credit which you can’t afford, try to find a trustworthy debt counselling firm. You can find information about debt counsellors in local newspapers, on TV or radio and in the monthly online version of Debtfree magazine (visit www.debtfreedigi.co.za). HOW TO IDENTIFY A GOOD DEBT COUNSELLOR Each NCR registered Debt Counsellor has a certificate issued to them which they will be able to show you. They probably even display this certificate on their office wall or website. Many people prefer to deal with a local firm where they can walk into the offices and meet the debt counsellor face to face. If dealing with a firm online or via phone, be sure to investigate where their physical offices are so that you could visit one day. Avoid firms who hide their physical location. Beware of any firm who asks for large amounts of money upfront or ask you to put money into their bank account. Debt counsellors can only ask for R350 in fees at the start of the process. Other fees will apply at the end of each month but these are the only fees they should be asking for upfront.


HOW TO IDENTIFY A GOOD DEBT COUNSELLOR

A good debt counsellor will explain that debt review is a legal process done through the courts. The debt counsellor is not in charge. They will tell you that it is serious and you need to stick to the repayment plan the courts issue. They will take their time to explain the whole process. You will forget much of what you discuss at first so, a good debt counsellor will give you access to information online or in brochures to help you remember. They will send you forms which you can keep with their details on. Feel free to ask for a copy of your Form 17.1. A good debt counsellor will also spend time with you discussing your budget and how to save money. They will not just give you a monthly budget figure and tell you that you need to spend only this much on your monthly household costs. They will explain why and how. A good debt counsellor also balances the needs of the consumer with the credit provider. They will not favour you over the credit provider. If you feel like they are promising you too much take a moment to consider if they can actually deliver on what they are promising.

IF SOMEONE CALLS YOU OFFERING DEBT REVIEW If you have received a sms or call from someone offering help with your debt you need to be careful of what you agree to and what you say. First of all, you need to find out if it is genuine debt review or some sort of mediation or consolidation scam. If it is about debt review then you need to find out a lot of information about the process before you commit to something. Because debt review is a legal process you need to be aware that if you ask for debt review help, even on the phone, you are beginning a legal process. This means that you cannot say you want help today and then later just change your mind.



IF SOMEONE CALLS YOU OFFERING DEBT REVIEW

If you get a call from a company the first thing you should do is get the companies details. Maybe even write them down while on the phone. Also you should get the name of the person you are talking to (write it down). Ask that person who they are in the company. If the information you discuss sounds good and you want to start the debt review process you should be sure you know: 1. What company you are dealing with? 2. Who is the Debt Counsellor who is handling your matter? (Ask if you are talking to the Debt Counsellor or just a member of staff) 3. Find out what it is going to cost you (they should be able to give you some idea) 4. Find out what you are expected to do each month 5. Find out whether they make use of a Payment Distribution Agent. (You don’t have to if you don’t want to but Debt Counsellors can only get funds from you via a PDA). Is It Bad to Deal with Your Debt Counsellor only online or via the Phone? Many people prefer to deal with business matters via email or on the phone. Ask yourself if you prefer standing in queues at the bank or banking online or on your phone? While doing business over the phone or online is extremely common these days, what you want to ensure, whether you are face to face or online is that you know exactly what service is being offered and what is expected of you. You can always ask for a contract which sets out these details. What is bad is to begin a several years long professional relationship with a Debt Counselling firm without ever speaking to the NCR registered Debt Counsellor. Always feel free to ask to speak to your counsellor directly. Also, be sure to know who you are dealing with and where their physical offices are.

DEBT REVIEW OFFERS LEGAL PROTECTION Have you ever had the situation where you make an arrangement with a creditor to pay them back a smaller amount and feel relieved when they agree, only to have a different person from the same creditor call weeks later and demand a different repayment arrangement? It can be frustrating to keep getting these calls and to never have clarity on exactly what the creditors are happy with or not. You constantly worry that somewhere, one of your credit providers is starting to take legal action against you and might send you a summons any day. That is very stressful. With debt review that is not the case. Debt Review and Debt Counselling is part of a legal process of restructuring your debt. What this means is that because every debt review matter goes before a judge, magistrate or tribunal, you get finality and the protection of a court order. The

restructuring plan is set out in a court order. That court order means that credit providers can’t later change their mind and try sue you. The matter has already been to court. Since debt review is a legal process, you will probably also need some legal help from an attorney or from the Debt Counsellor to get the court papers and court order in place. There are small costs associated with the legal side of things that are built into the process but these small costs are worth the peace of mind of knowing you have a real solution in place that everyone has to stick to. Debt Review matters can be dealt with by either your local Magistrates Court or in some cases by the National Consumer Tribunal (NCT). In either case, your Debt Counsellor will need you to sign an ‘affidavit’ which is a legal document that simply shows that you agree with the repayment plan and really want to pay off your debt through debt review. Most of the time that means you will not actually have to go to the court itself and these papers can talk for you. Ask your Debt Counsellor about what your local Magistrates prefer: You being there in person to say you agree or just these papers. Your Debt Counsellor will advise you about whether your matter will go to court or go to the NCT. Each court and each matter is unique. You should ask your Debt Counsellor in advance what they think the legal side of things will cost. Every Debt Counsellor will work the legal costs into the debt restructuring plan they put before the courts and send to credit providers. This means that the legal fees will come out of your monthly repayment amount and you will be able to afford the costs since they are built in. The court side of the process offers you and your assets legal protection.

PAYING THE DEBT According to the NCA, consumers can choose one of two ways to repay their debts while in debt review. An organized consumer, who doesn’t mind the risk and effort it takes, can pay each credit provider themselves according to the Debt Counsellor’s repayment plan. Alternatively, if the consumer wants convenience and less risk, they can make use of a NCR registered Payment Distribution Agency (PDA). PDAs are an important part of the National Credit Act. Your Debt Counsellor may advise you on what they feel is best for you. 1. Paying the Debt Yourself Paying your court restructured debt yourself allows you more control but it does expose you to additional risks and a lot more work. If you have struggled to handle payments to all your creditors on time in the past then be cautious of this option.


You will have to make lots of different payments to different accounts each month (with associated costs). You need to make sure each credit provider gets the right amount and keep records. Accounts get different amounts each month according to the plan. These amounts can change often and you need to pay the right amount to the right account each month. You need to be an excellent record keeper, as your records may later be needed to resolve disputes and to reconcile accounting differences over time. Many times, it is best to send copies of all payments to your Debt Counsellor for their records in case you lose yours. Make backup copies. You carry the risk of making mistakes and have to accept the risk of credit providers holding you accountable for wrong payments. If they receive the wrong amount or money is put in the wrong account with the wrong reference it can cause them to start additional legal action due to short payments. Make sure you pay your debt counsellor their fees each month when you pay your debts or you could end up stranded in the process without anyone to help you. By handling payments yourself you pay normal banking costs for each payment. Sometimes this can be slightly cheaper than via a PDA.

2. Paying Via A Payment Distribution Agency Using a payment service provider will mean you have to pay some fees for their services each month. This is offset by not having to pay lots of bank fees and all the time and effort it saves you. Make sure that you are dealing with an NCR registered Payment Distribution Agent. These are the only companies recognized by the National Credit Act as allowed to assist. Making a single payment to the PDA and letting them handle the rest of the work makes your life easier. PDAs carry insurance in case they make mistakes. This allows for some peace of mind. Also the fact that the NCR regularly checks up on them helps you feel confident your funds are being cared for. They are not perfect but can be held accountable for any mistakes. PDAs keep detailed records of each payment and report to you monthly on your distribution. REMEMBER: The PDA is not the Debt Counsellor. They are separate companies. Debt Counsellors never handle your money. They are not allowed to. NEVER MISS A PAYMENT! Your Debt Counsellor can advise you on whether they think you can handle payments yourself or whether they recommend using a NCR registered Payment Distribution Agent to make your life easier. The most important thing to remember is to never, ever miss a payment or pay less than you are meant to each month.

GETTING OUT OF DEBT The debt review process is very useful when times are tough and you cannot afford to pay each creditor what they demand every month. Debt review makes it possible to repay a reasonable amount every month to help reduce your debt bit by bit. The ultimate goal of every debt review is to help you get out of debt. This means that you can then re-enter the credit market with a clean slate much better equipped to manage your future credit use. Some people are able to leave the debt review process after a short time because they begin to earn a lot more money. This means they may pay up their smaller debts quickly and no longer need debt review. If they have paid off their smaller debts but still have a bond left this is not a problem.


GETTING OUT OF DEBT

With the help of their debt counsellor they make arrangements with their creditor provider to resume normal bond payments and can then leave the process. Other consumers repay all their debts according to the debt counsellor’s plan and court order. This can take some time but every month they chip away at their debt until they eventually pay it all off. They are then also debt free. Either way, whether ending early or according to the plan, the debt counsellor will help the consumer with the appropriate paperwork perhaps including a clearance certificate which shows which debts are paid. This information is also updated at the credit bureaus, who then remove any relevant information about the consumer’s debt review and debts. Getting out of debt is a big deal. Very few people are able to say they are debt free. By sticking to the debt counsellor’s plan and never missing payments, consumers will be able to use the debt review process to not only repay their debts but learn to better manage their finances. This training helps them to build a better financial future for themselves and their family.

KEEPING THE WOLVES AT BAY One of the most scary things that can happen to a financially distressed consumer is the bank sending a Sheriff of the Court to tell them that they are taking back your home and going to sell it on auction. It is the stuff of nightmares. If the bank sells your property you can expect them to just try get whatever they can and leave you to pay the shortfall. Desperate debtors often realize that they need to sell their property before the bank does but the pressure to make the sale swiftly can be overwhelming and can take too long before the bank takes action. This is one of the reasons why stressed homeowners have been turning to joint ventures like the one offered by Certus Properties. The process involves selling your property together with them, while they help financially to keep the collections wolves at bay. They assist with upfront cash payments to settle any arrears, municipal accounts etc and if required spend funds on repairs to give the property a beter look and time to sell for a more reasonable amount.


It is interesting to note that Certus Property Solutions is not some sort of Bridging Finance Company and is not a credit provider, but they say that they can, through their ‘Property Value Redemption’ service, ‘legally unlock the value’ of the distressed homeowner’s property and help consumers get a better deal on their property. One of the benefits to cash strapped consumers is that there are no upfront costs to get the ball rolling. Rather you enter into a joint venture with Certus to sell your property at a market related value (which is much more than the banks will try do if they want to auction off your property). The process still eventually costs you some money after the sale happens and you do have to sell the property (that’s one of the reasons you invest in property in the first place) but it allows consumers time to try make as much money back on their investment as possible.

NCR STAFF COMINGS & GOINGS

SARB CONSIDER CRYPTOCURRENCY

Mr Peter Michaels has recently left the NCR. As the departure happened quite quickly, his position has as yet to be filled. Ms Kedilatile Legodi has returned to the NCR after half a year at a major credit provider and is now once again heading up the debt review department. It also seems that responsibilities relating to the possible ‘debt intervention’ programme - suggested in proposed amendments to the NCA currently being discussed - have been given to one of the NCR team to head up.

The SA Reserve Bank has invited the National Credit Regulator, Competition Commission, National Treasury and the Financial Intelligence Centre to join a working group on Cryptocurrency and Financial Technology. They are expected to advise an official government policy on cryptocurrency such as deciding if things like Bitcoin are actually currency or rather commodities.

IS AN AUCTION RESERVE PRICE NOW MANDATORY? Recently, a huge court battle around whether a house on auction has to have a reserve price resulted in a surprising ruling (which has been appealed). The ruling stated that selling property without a reserve price is not ‘unconstitutional’ despite recent legal changes in SA. In the particular case being argued, a R400 000 house was sold on auction for only R40 000 leaving the consumer with the shortfall balance to pay over the next 30 years.


PNP GIVE R1BILLION IN FOOD CREDIT IN JUST 6 MONTHS Pick n Pay only started granting small amounts of credit 6 months ago but they are already up to a massive R1 Billion in credit to 56 000 store account users. Many of these consumers may have in the past used credit from other credit providers but have now turned to PnP’s internal offering. PnP has tied in with the new bank TymeDigital (which is a subsidiary of the Commonwealth Bank of Australia) to offer financial services. Recently PnP have had 300 000 signups for their money transfer service.

NCR DEBT HELP – LOGGING IN CAN BE TRICKY The NCR recently launched their updated and much improved version of the NCR Debt Help System (which Debt Counsellors use to report stats about their clients). The new system has a nice look and added functionality which many Debt Counsellors struggled to gain access to as the system gave out SQL errors and Debt Counsellors found that their log in details had changed somewhat or been reset. Most Debt Counsellors seem to have now worked through the teething pains of the change.


AFRICAN BANK’S NEW CEO Ms Basani Maluleke has been appointed the new African Bank CEO. For a while now Ms Maluleke has been sitting poised to take control. As CEO ‘designate’ at the “good” African Bank, she has been part of the “turnaround” since back in 2015 and has been climbing the ranks since. Ms Maluleke (40) has a background in law, having worked at Edward Nathan Friedland before joining RMB in 2005. She moved to FNB in 2011, heading up the private clients section, before the move to African Bank. She replaces CEO Brian Riley, who has been at the helm of the ship since the crash and subsequent rescue efforts.

EDCON DON’T WANT TO PAY BACK THE MONEY Edcon have been fighting back against the 2017 ruling by the National Consumer Tribunal that ordered that they repay club fees since 2007 to all their clients. In that case the NCR argued that Edcon charge club fees as part of their credit related services and that club fees are not allowed for under the National Credit Act and regulations. They have also been fighting the 10% of annual turnover fine which the NCT issued when they lost the same matter. The value of the dispute sits at around R5 Billion Rand. The fight has now made its way to the High Court (Edcon appealed) and looks set to decide the future of the Credit Provider.

As jy ’n vakansiereis per motor aanpak, volgepak met die gesin en al die bagasie, sal immers tog vooraf beplan word hoe ver met ’n tenk brandstof gereis kan word voordat die brandstof aangevul moet word. Net ’n uiters onverantwoordelike persoon sal aanhou ry tot die tenk leeg is en dan heel moontlik tussen niks en nêrens gaan staan en hoop om geholpe te raak. So beplan ons ook hoe lank dit ons gaan neem van punt A tot punt B en watter roete gevolg moet word. Sommige beplanning neem langer as ander, want ons wil tog die gewenste eindresultaat sien. Op ’n ligter noot: hoeveel mans het nie al ervaar dat ’n vrou se beplanning rondom kledingstukke vir ’n aandjie uit in ’n nagmerrie kan ontaard nie? Daar word aangepas, in die spieël gekyk, uitgetrek en weer aangepas, ’n ritueel wat liefs met ’n glimlag verdra moet word.


Wanneer vriende oorgenooi word vir ete, word beplan en afgespreek hoe laat hulle verwag word. Lank voor hul aankoms is daar reeds beplan wat voorgesit gaan word en seker gemaak dat die porsies voldoende gaan wees. Aankope word betyds beplan en gedoen, tafels word gedek en slaaie word berei. As dit so maklik is om te beplan dat dit eintlik tweede natuur is, waarom faal ons om te beplan vir sekere van die belangrikste besluite wat ons neem? Veral wanneer dit by ons finansies kom. Is dit omdat sulke besluite nie lekker is nie? Of is dit dat ons die beplanning daarvan uitstel totdat dit amper te laat en onvermydelik is? Inkopies word tog uiteraard vooraf beplan en ’n inkopielys saamgestel. Waarom dan van die beplande inkopielys afwyk en items aankoop waarvoor nie beplan of begroot is nie? Dit is een van die oorsake dat die geld voor betaaldag opdroog en dan wonder ons hoe het dit gebeur! Moenie die persoon wees wat nalaat om te beplan nie en daardeur die persoon wees wat beplan om te misluk nie.
