Have you ever given a homeless person part of your lunch out of concern that they are hungry, only to be horrified when they reject it or worse, throw it away when they pass the next rubbish bin? It can be a real kick in the gut and makes you more than a little angry and disappointed in people in general. You can’t help but think the person ungrateful and bemoan the loss of a few more bites of your cheese and tomato sandwich. Sometimes this is how Debt Counsellors feel about their own clients. Debt review can help consumers deal with their debt in a dignified way and helps credit providers get their money back in a reasonable time frame. It is a great process that works well and can help over indebted consumers get back on their feet. The service is so good that it is very troubling to those in the industry when we see the high number of

people who start the process but never finish it. We understand that many consumers who enter debt review might do so without thinking things through very well and may do so, somewhat, on impulse. This means that later another impulse may make them want to ruin their debt review and financial future by abandoning the process before it is done. We get that but... it is frustrating to credit providers and Debt Counsellors alike. We would like to see people get the help they need and pay off their overwhelming debt. We want to see people use the process to start a better future for themselves and their families. Stats show that as many as 20% of the clients drop out within the first 60 days. That’s a lot of work for no money and it means that 20% of these clients are stuck with a debt review status at the credit bureaus and are thus unable to go get more credit (which they wouldn’t qualify for anyway). These drop out consumers then cause a lot of ruckus and extra work for themselves, credit providers, the NCR and Debt Counsellors. It is a real strain on the industry.


An even larger number of consumers push past the first two months only to drop out later and face some pretty big issues as a result (like demands for huge amounts from collections agents and legal action on arrears debt). Obviously then the process itself, which works so well, is not enough. This issue of Debtfree Magazine we look at why this is the case and what consumers, who are under debt review, can do to improve their chance of completing the process and getting the full benefit out of the program. Debt review can be a huge turning point in your life if done in conjunction with some other basic things. We look at some of these basics in this issue. We also have some Debt Review School lessons, news stories and other features which we hope you enjoy. So, don’t give up on helping the disadvantaged. Never stop helping others. And if you are getting help through the debt review process, don’t give up either. Help yourself. Keep at it from start to finish. Time flies and before you know it you will be debt free.

REDUCING INTEREST RATES When a consumer enters debt review their Debt Counsellor will contact all their credit providers and obtain balances for all their various accounts. Armed with this information, they can look at different ways for the consumer to repay the debt. Once the Debt Counsellor has helped work out a new monthly budget with the consumer (which takes into account monthly saving towards annual expenses) they will know how much money is available to repay debt. A Debt Counsellor can then make a recommendation to the court on how the debt can be settled over time (normally a longer time period). The court is empowered by the National Credit Act (NCA) to decide to accept or adjust the proposal and do several things like: delay payments on one or more accounts, reduce the amount being paid to each account or extend the time it takes to repay the debt. The NCA is however silent on the topic of interest rates. Thus a court cannot just adjust the rates simply because they want to. However, many credit providers want to assist their clients to get out of debt as soon as they can so that they can begin using credit again. Thus they will often volunteer lower interest rates. There are no rules that force them to do so but they can, if they want. Alternatively they don’t have to agree to any changes and can let the debt run to the induplum (double the amount) limit which when reached means that the consumer is finished with their obligations on the account. Some courts are happy to include these new arrangements on interest rates into their court orders for consumers while others prefer not to.

IS DEBT REVIEW ALL YOU NEED? Debt review is amazing. It is a wonderful provision made in the National Credit Act to help consumers deal with their debt in a dignified and reasonable manner. Hundreds of thousands of consumers have used the process to get their life back on track and reduce their crushing debt stress. Debt review enables consumers to pay what they can realistically afford each month towards their debts and not just according to the (sometimes outrageous) demands of collections agents. At the same time. it demands that consumers align their spending according to a balanced budget worked out by a professional Debt Counsellor. The more meticulous the budget is calculated, the higher the chance of the consumers actually finishing the process.

NOT EVERYONE FOLLOWS THROUGH A sad fact about debt review is that many consumers start the process, but ultimately drop out. Some do this within the first 90 days (a fairly high percentage) when they are confused about the process; others drop out when tricky months like December and January come around, and others (often due to fatigue) drop out at around 36 months. It is not uncommon for Debt Counsellors to get applications from consumers who were in debt review but dropped out. This proves that simply entering the process and getting a court order is not enough. More is needed.

CHANGE IS REQUIRED Change is never easy. We like things to stay as they are. This is one of the reasons why, when consumers lose their jobs they don’t immediately make dramatic changes to their spending habits. They often rely more and more on credit to maintain a lifestyle they can no longer afford. This drives them deeper and deeper into debt and eventually they end up necessitating debt review. Entering debt review is in itself a big change. Firstly, you need to make the decision to get help. Then you need to find the right person to help you, and then you need to go and talk to a stranger about your debt. This is not an easy thing! Once the papers have been signed and after some frank advice, it is hard to make the other changes that are needed to make a success of the process. However, if these changes are not made then it is all too likely that you will fall out of the process before it has helped you get back on your feet.

MINDSET CHANGES Changing our way of thinking can be really difficult. Our brains are lazy and like to keep running electricity through the same familiar neural pathways. It likes forming habits. Habits like grabbing that nice snack while in the final part of the queue at the shops (admit it). You know you shouldn’t, but your brain says: Hey, let’s have a snack. You deserve it. Ignore the cost. Feed Me!! So making the mental change from a credit lifestyle to a ‘spend only what you have’ lifestyle can be difficult, it can take months. Also it is very easy over time to fall back into bad habits.

LIFESTYLE CHANGES You do not have to compare debt review with “being poor”. No, rather, you need to link it with being responsible. It means making better choices in regard to where to eat, what to eat, where to shop and what to buy. You also need to learn to hold back from spending money immediately, this can be difficult. In the past you were able to solve problems immediately by using credit. Once under debt review, it becomes necessary to hold back from spending when a problem first comes up. You may need to wait - wait until the end of the month or until you can save enough. Perhaps it means waiting until you sell something you don’t really need to afford something you do (like fixing an appliance). You may need to adjust where and how you ‘treat’ yourself. Small indulgences are not in themselves bad, but you may need to do these things a lot less often than before and be less extravagant.

SHOPPING CHANGES You probably used to shop at expensive retail stores for clothes and putting everything on your account. When this is not possible or practical, you may need to broaden your horizons and find shops that offer reasonable products at better prices. You may even have to wait for a good sale to come around before you head to the shops. When it comes to grocery shopping you may also need to make adjustments. You will benefit from learning to buy in bulk when discounted sales come around. You may also have to stop fooling yourself that the quality at that shop is so much better than the others that it is actually ‘cheaper”. Nope, no it isn’t, cheaper is cheaper. It is also vital that you shop according to your list and a budget. If you find that a challenge, then ask your Debt Counsellor for advice.

RELATIONSHIP CHANGES Most couples who have been struggling with debt end up struggling in their relationship. This is often due to the stress of dealing with debt and also hiding debts from one another. Entering debt review often means having to be honest with each other about debt for the first time in many years. This can be difficult, but makes a massive positive difference in relationships. Honest and regular communication is the lifeblood of any long lasting relationship. Working together to defeat a common enemy rather than hiding things and the resulting shame will bring couples closer together than ever before. This won’t happen automatically though, it takes work. A regular pleasant financial meeting as a family once a month (or more) can really help, if handled properly. Open and non-confrontational discussions about the family budget and spending plans ensures everyone is on the same page. Avoiding a ‘your debt’ and ‘my debt’ mentality also helps a lot. Don’t fall into the common trap of ‘your money’ and ‘my money’, work as a team.

MAKE THE CHANGE If you are able to embrace your new reality, then you will go far in the debt review process. You will see a dramatic improvement in your life and your finances. It takes hard work to change and requires an adjustment in your thinking, being honest with yourself and others. It takes restraint and planning, but it will bring your life back on track, if you are able to make the change. If you are in debt review make the other changes that help make a success of the process. Don’t do things half heartedly. Do it now, don’t procrastinate. If you are struggling with debt and are getting deeper and deeper into the debt hole, then make a change and talk to a Debt Counsellor today. Try getting out of debt for a change rather than simply taking on more debt. If you are able to do these things, then your debt review will be the first step on the road to financial freedom, to an improved responsible credit future. Making these additional changes will help you to see the process through from start to finish. Debt review can really help you get your life back on track.

NEWS NCR CALL FOR QUARTERLY REPORTS DCs are reminded that they have until Aug 15th to submit their required Quarterly reports to the NCR for the period 1 Apr - 30 June 2018. Reporting to the NCR is part of their conditions of registration and failure to do so can lead to trouble with the Regulator. The NCR use these reports to help figure out who is under debt review and how many have entered and left the process. The NCR also can draw this information directly from their own internal Debt Help System which Debt Counsellors are obliged to update with this same information.

PORTFOLIO COMMITTEE TO MEET REGARDING DEBT INTERVENTION BILL The Portfolio Committee on Trade & Industry will be meeting in Cape Town Parliament on Tuesday 31st July to discuss matters pertaining to their proposed amendments to the National Credit Act . These proposed amendments include the creation of Debt Intervention (a type of poor man’s debt review designed to replace administration) and the criminalizing of non reporting of possible acts of reckless credit (which a lot of creditors and Debt Counsellors are nervous about). Public access to the meeting is allowed.


DEBT COUNSELLORS MUST PAY THEIR ANNUAL RENEWAL FEES Debt Counsellors have to pay a fee to the NCR every year to remain registered with the Regulator. Failing to do so before the end of July will put Debt Counsellors in danger of being deregistered (lapsed). If they do not make the payment within the required time period (incl the short extension period) they can have their registration lapsed. This means they can then not practice as a Debt Counsellor until they have applied to be registered once more. This process can take many months and the NCR has in the past forced consumers to move to another Debt Counsellor without their consent. Once registered again there has been no indication that the NCR will once again

move those same clients back to the services of their original Debt Counsellor with whom they signed a contract. The bottom line is that Debt Counsellors should make absolutely sure they have paid the right amount (Debt Counsellors have been lapsed before for paying R400 to little) within the required time period. Debt Counsellors are also reminded that in the view of the NCR your main office is defined as a “branch” and not just a satellite or additional premises. Thus the “branch fee” applies to your main office as well as any other outlets they may have. Short paying by this R250 fee can also lead to being lapsed and the subsequent chaos. Over the last 2 years the number of registered Debt Counsellors has dropped by 50%.


SUMMIT & CAPITEC BANK ARE FRIENDS AGAIN Over the last while, Summit Financial Partners(Summit) and Capitec Bank have been at each other’s throats over accusations of reckless lending. Things got ugly as the National Credit Regulator and the Courts got drawn into the furor. Over the last two years, Summit has brought five different cases as well as a complaint to the National Credit Regulator (NCR) against the bank. Most of the dispute relates to a multi-loan product which Capitec used to offer but pulled the plug on in February 2016 (when they began to offer credit cards). After years of fighting the two parties have now reached an accord and the matters have been settled out of court (they paid people money to stop the

legal action). Capitec says that the court costs were just going to mount and they would rather deal swiftly with the matters than drag things out. There was, obviously, also the risk of the court cases – if the rulings went against Capitec – triggering a wave of legal action from other consumers who made use of the same product in the past. Summit say they are happy not only for the affected consumers but also since Capitec stopped offering the product several years ago now. The two firms have agreed to also work together in the future in a new partnership to promote, among other things, workplace financial education. Recently, the SA Reserve Bank in something of a surprise move asked the NCR to have a closer look at Capitec Bank once again over accusations made by investor company Viceroy. This is even though the Reserve Bank have been a big supporter of Capitec Bank throughout the entire media war campaign by Viceroy against the bank.

NEDBANK BAIL OUT VBS CLIENTS VBS Mutual Bank are famous for providing former President Zuma with urgently needed cash to cover his expenses when times were hard even though it was doubtful he could actually repay the loan. Recently, however, some very serious problems at the bank manifested when it was realised that the bank had illegally been accepting funds from municipalities and there had been fraudulent activity among the management. This caused the bank to go into free fall and ended up with the bank under curatorship. Consumers grew concerned that they might not be able to access their funds (it is common for there to be a “run on the

bank� during such a situation). Now it seems that the Reserve Bank and curator of VBS have arranged for Nedbank to help provide up to R100 000 per depositor. These depositors would include individual consumers, stokvels and burial societies but definitely not themunicipalities involved in the crisis. The bank was hard hit when management made off with around R1.5 Billion and ended up in curatorship when the entire matter (and others) came to light. It was a perfect storm which left the bank in chaos. Now it seems the Reserve Bank has coordinated with Nedbank to come to the rescue of the man on the street.


Starting halfway through July retail depositors were able to head to a Nedbank and produce documentation and be verified (to avoid any scam artists taking chances). Then after signing away their rights to their VBS holdings, they have been able to receive their money in a brand new Nedbank account. It is estimated that over 95% of VBS former clients (retail depositor clients) should get their funds back. That’s around 20 000 people. That’s a lot of nice new clients for Nedbank and a lot of peace of mind for these consumers who were worried they may never get their hard earned cash back.

Duisende huishoudings is hierdeur geaffekteer, behalwe vir die ongerief om sonder krag te wees het mense groot hoeveelhede van hulle bevrore en bederfbare voedsel in hierdie periode verloor wat hulle moes weggooi. Ekstra koste is aangegaan om gasbottels aan te koop en vol te maak, diegene wat dit kon bekostig het kragopwekkers aangeskaf. Die oorsaak van die kragonderbreking is nie hier ter sake nie maar die gevolge daarvan. Elke man wat al die kar moes pak voor daar met vakansie of selfs ‘n naweek weggegaan word het al verstommend gestaan aan die hoeveelheid bagasie daar is vir die beperkte ruimte van die bagasiebak. Alles wat die wederhelf en die kinders voel is noodsaaklik en beslis nie tuis gelaat kan word nie en waag dit net om te sĂŞ gaan pak minder en in


kleiner tasse. Dit is al asof ons bang is om iets agter te laat en dat geen winkel by die eindbestemming die “noodsaaklikheid” in voorraad sal hê nie. Ek is lid van vele Facebook groepe omrede ek graag volg wat mense te sê het in gegewe situasies. Toe die krag aanvanklik afgaan was daar verontwaarding en skeltaal, by dag twee en drie was daar n moedeloosheid wat na vore gekom het. Die skatting van die Stadsraad was dat dit nog vyf dae kon duur weens die omvang van die skade by die kragsentrale. Dit was nou wel skoolvakansie, n bedekte seën, maar nog steeds daar is nie warmwater nie, wasmasjiene, tuimeldroërs en haardroërs kon nie gebruik word nie. Boonop is dit winter, behalwe dat dit bleddie koud is word dit vroeg donker, verstommend dat n woning ekstra koud voel as daar nie lig is nie. Inwoners het hul lot bekla, tereg so en die klagtes het so vermeerder. Tussen die klagtes was daar egter tog ligpunte. Wildvreemdes het hulp aangebied, kom bad/stort hier by my, bring jou bederfbare voedsel ek het plek in my yskas, kom laai jou foon en laptop. Kom maak jou kos gaar by my sodat die kinders n warm maaltyd kan geniet. Hierdie aanbiedinge was opreg en uit die hart uit van mense was omgee, mense wat nie wou sien hoe ander sukkel nie. Mense wat kon deel met die wat tekort gekom het. Interessant was dit om hierdie selfde mense wat hulp aangebied het se kommentaar te lees in die tydsverloop, niemand het hul aanbiedinge om hulp aanvaar nie en die vraag was gevra hoekom nie? Dit het my laat dink, waarom sou ons nie hulp aanvaar nie? Is dit omdat dit vreemdelinge is? Vertrou ons hulle nie? Is ons te trots om hulp te aanvaar wanneer dit aangebied word? Verkies ons om eerder self aan te sukkel? Is ons skaam? Wat ookal die antwoord is sal ons onself regverdig in ons besluit om nie hulp te aanvaar nie. Dit is seker ook die geval wanneer dit by finansies


kom. Ons hoef nie te sukkel nie, daar is mense wat gereedstaan om deur hul kundigheid vir ons hulp aan te bied. Waarom sal ons eerder in n trop kla as om as n individu hulp te kry? Hopelik het julle die antwoord en hopelik maak julle die regte besluit! Groete.

COURT MATTERS The recent De Beer V Nedbank appeal case (which the consumer lost) has some very interesting information relating to Section 129 letters and 130 enforcement. For a long time there has been something of a debate about when legal enforcement begins. This has relevance because once legal enforcement on an account begins then that account cannot be included directly into a consumer’s debt review (it is best to avoid double legal work on a single account). In the recent De Beer v Nedbank case the ruling said that legal enforcement does not begin when the summons is issued but rather that it begins when the summons is delivered to (or brought to the attention of) the consumer. This means that the consumer can have such an account put into debt review any time before service and not just the 10 day mentioned in a Section 129 letter.
