For many, 2010 was the year not only of the World Cup (wow was that this year‌it seems so long ago) but also the year they went into debt review. Well done, on doing the responsible thing! For others, 2010 was the year they finished off their debt review (24 months is a common time frame for being under review) we hope your improved circumstances keep you out of further debt.

UNDERSTANDING THE CONSUMER PROTECTION ACT Last month we considered the contractual requirements, necessary for a valid and lawful agreement, between the debt counsellor and their client. In this our final instalment, we expand on those requirements by focusing on section 51. Unlike section 48, the requirements of section 51 are more explicit (legal jargon excluded). Debt counsellors should review their contracts and ensure that the terms and conditions comply with the requirements of section 51. Bear in mind that the requirements of section 51 are applicable, even if the debt counsellor does not conclude a written contract with its client. In instances where the debt counsellor is concluding agreements or transactions by way of the internet or telephone, they must still ensure that the respective transaction complies with section 51 requirements. Section 51 In terms of section 51 (1), a supplier must not
make a transaction or agreement subject to any term or condition if – • its purpose or effect is to • Mislead or deceive the consumer; • Subject the consumer to fraudulent conduct; • Deprive or get a consumer to waive a right granted in this Act; • Permit a supplier to avoid their obligation or duty under this Act; • Set aside or override a provision of this Act; • Authorise the supplier to – • Do anything that is unlawful under this Act; or • Fail to do anything that is required under this Act; • Limit or exempt a supplier from liability for any loss directly or indirectly attributable to the gross negligence of the supplier or any person acting for or controlled by the supplier; • Constitute an assumption of risk or liability by the consumer for a loss arising from the gross negligence of the supplier; • It results from an offer prohibited in terms of
section 31 [negative option marketing]; • It requires the consumer to enter into a supplementary agreement or sign a document prohibited by subsection (2) (a). Subsection (2) (a) precludes a supplier from Requiring a consumer to enter into a supplementary agreement or sign any document that contains any of these (set out herein) provisions; • It purports to cede to any person, charge, set-off against a debt, or alienate a right of the consumer to any claim against the Guardian’s Fund; • It falsely expresses an acknowledgement by the consumer that – • Before the agreement was made no representations or warranties were made in connection with the agreement by the supplier or a person on behalf of the supplier; or • The consumer has received goods or services or a document that is required by this Act to be delivered to the consumer; • It requires the consumer to forfeit any money to the supplier – • If the consumer exercises any right in terms of this Act; or • To which the supplier is not entitled in terms of this Act or any other law; • It expresses on behalf of the consumer – • An authorization for any person acting on behalf of the supplier to enter any premises for the purposes of taking possession of goods to which the agreement relates; • An undertaking to sign in advance any documentation relating to enforcement of the agreement, irrespective of whether
such documentation is complete or incomplete at the time it is signed; o A consent to a pre-determined value of costs relating to enforcement of the agreement, except to the extent that is consistent with this Act; or • It expresses an agreement by the consumer to – • Deposit with the supplier, or any other person at the direction of the supplier, an identity document, credit or debit card, bank account or ATM card or any similar identifying document or device; or • Provide a personal identification code or number to be used to access an account. In terms of section 51 (3), a transaction or agreement, provision, term or condition of such transaction or agreement, is void to the extent that it contravenes these requirements. What does this mean for the debt counsellor? 1. know what rights a consumer has, under the Act, and observe them; 2. know what your obligations are and render your service in accordance with them; • you cannot contract out of liability, arising from your acts of gross negligence or transfer such liability to the consumer; 3. contractual terms must be lawful (in terms of this Act and any other relevant legislation) and avoid misrepresentation; and 4. strive to treat customers fairly.

INEFFECTIVE DEBT COUNSELLORS:
Are consumers bound by their debt counsellor’s negligence? This question appears to have been answered in the matter of COETZEE AND ANOTHER V NEDBANK LTD (2793/10) [2010] ZAKZDHC 46 handed down on the 12th October 2010. This matter concerned a couple who fell into default on a mortgage loan agreement and as a consequence thereof sensibly (or so they thought!) approached a debt counsellor for assistance. Having no doubt been given the necessary assurances that their assets were henceforth going to be protected from the circling credit providers, imagine their dismay when confronted by the sheriff of the court informing them that default judgment had been obtained against them and that the bank intended to sell their home in execution. They then approached their debt counsellor only to ascertain that, save for the debt counsellor having sent the required notice placing the consumers under debt review, the debt counsellor had done little else. Whilst the degree of ineptitude on the part of the debt counsellor in this case can, in my view only

NEWS FLASH enhancements and restructuring rules in 2011. Non compliance to the voluntary agreement can be reported to the Credit Ombud. The Task Team Agreement represents a voluntary agreement to standardise forms, enhance the debt review process and to implement a set of restructuring rules. This agreement is not in conflict with the requirements of the NCA but a voluntary agreement to unlock the bottlenecks in the debt review process and to facilitate automatic acceptance of repayment plans that conforms to the restructuring rules. This agreement was the result of 257 hours of work by the Task Team over a 12 months period. The enhanced process and restructuring rules should have a positive impact to the work of Debt Counsellors but Consumers stand to benefit most from the voluntary Task Team Agreement. The process will be streamlined to expedite completion of the debt review and in addition the Consumers will benefit greatly from the fee and rate reduction agreed in the restructuring rules.
On the 6th of December a milestone was achieved with the signing of the document above by all parties involved in Debt Counselling to indicate acceptance of the Task Team Agreement as well as the Code of Conduct for Credit Providers, Debt Counsellors and PDA’s. The acceptance of the Task Team Agreement and the Code of Conduct by all parties enables the implementation of voluntary process
DCASA’s new Membership fee structure DCASA has approved a new Membership fee structure. Registered Debt Counsellors can now elect to join as an Associated Member (R65/mthn) or as a Full Member (R300/mnth) of DCASA. A great deal of work has been done by DCASA. Over the last four years DCASA has built up its membership to 230 members. They have tackled the issues of the Debt Counselling
Fees, a Code of Conduct and the appointment of an Ombud who will deal with Debt Review matters. Why is such an Ombud so important? Well while the NCR will continue to perform its statutory role, the Credit Ombud will be able to rule on industry debt review matters where voluntary agreements (beyond the NCA requirements) have been reached. This is a great leap forward, as DC’s can now for the first time ensure that all parties keep to the signed NCR Task Team guidelines. DCASA has established branches in most Provinces and we will shortly be providing Debtfree DIGI with the details of the planned meetings for 2011. During February 2011 all DCASA Provincial Branch Committees will be re-elected and in March a Special General Meeting will be held and the NEC will be re-elected. It is therefore necessary that any DC who wishes to join DCASA does so prior to the end of Jan 2011 to be eligible to vote and be elected to any of the structures within DCASA.
A break in the 86(10) storm The major banks have agreed to a moratorium on 86(10) notices from December 1st 2010 till 1 April 2011. This “gap” should allow the industry time to breathe and collect its breath. The recent deluge of notices issued may have been an effort by some of these banks to get those terminations in before the moratorium hits. Ironically this may mean that DC’s will be dealing with the issued notices well into next year. This of course will tie in with the result of the Wesbank vs. Pappier from the Cape Town High Court which the industry is eagerly awaiting.
Should the court rule that matters that are set down cannot receive 86(10)’s then many of the issued 86(10)’s will not be valid anyway. Whatever the outcome for now the industry will only benefit from a reduction in these termination letters, which tend to frighten clients and create huge amounts of time consuming work for all parties.
