$38 M State Housing Investment for Indio

By Desert Star StaffThe Biden administration is now taking public comments on a proposal to grant the California Spotted Owl protection under the Endangered Species Act.
The move reverses the Trump administration’s 2020 decision to deny the brown-and-white bird further protection, even though its population has declined for decades.
Pamela Flick, California program director for Defenders of Wildlife, noted the proposed listing stems from the settlement of a yearslong lawsuit by conservation groups.
“When the species is listed, logging on national forests will have to undergo more scrutiny and be determined by the U.S. Fish and Wildlife Service not to cause harm to the owl or their habitat,” Flick explained.
An exception would allow some logging to reduce fuel load for wildfire management. The proposal splits California spotted owl population into two groups: Birds in the Sierra Nevada range would be listed as threatened. In contrast, those in the southern/coastal region would be listed as endangered.
The birds have lost significant habitat over the years to logging. They are
sometimes poisoned by rodenticides used on illegal marijuana grows, and they also face competition from an invasive species known as the barred owl. Flick emphasized that global warming is fueling the biggest threats to the spotted owl’s survival.
“The threats currently impacting the Sierra Nevada population include large-scale high-severity fire, tree mortality due to drought, and native bark beetle killing millions of trees,” Flick outlined. “Those are impacts that came about from climate change.”
The public comment period is open through the end of April.

By Desert Star StaffAccording to a new report from Georgetown University, two million children and adults in California could lose health insurance coverage over the next year - as the state winds down the continuous-coverage requirements during COVID.
The pandemic health emergency officially ends on May 1, but on April 1, California will start redetermining eligibility for 50 million people on Medi-Cal.
Mike Odeh, senior director of health with the nonprofit Children Now, said recipients must
ensure the program has their current address.
“The state has proactively asked families to ensure their contact information is current. And we know that they have launched a campaign,” Odeh said. “So families can visit keepmedicalcoverage. org to sign up for email and text alerts with updates about medical renewals.”
Children still eligible could lose coverage if the renewal notice goes to the wrong address or if there is an administrative error. During the pandemic emergency, the state was required to keep all Medi-Cal recipients
on the program. But now, the income requirements will kick in once again. More than 56% of kids in California and 52% nationwide are covered under Medicaid or CHIP.
Federal research indicates that 72% of the kids who lose their Medicaid coverage will still be eligible and that Black and Latino families are at greater risk of losing coverage.
Report co-author Joan Alker, executive director of the Center for Children and Families at Georgetown University’s McCourt School of Public Policy, said many factors come into play.
“Language issues may
be a barrier when you have families who are perhaps mixed-status immigrant families, who have some fear about engaging with the government; families who live in rural areas, who don’t have good internet connectivity,” Alker said. “There are many reasons families are going to be at greater risk.”
Starting in 2025, California will begin keeping kids on Medi-Cal enrolled until their fifth birthday, with renewals annually after that. Undocumented children have been eligible for Medi-Cal since 2016.

Nine Myths Regarding Member Discipline

Myth #1: HOAs can impose any fine amount that seems appropriate to punish the violating homeowner. Truth:
Civil Code Section 5850(c) limits monetary penalties (aka “fines”) to those as stated in the HOA’s written list of penalties in effect at the time of the violation. No list of fines? Then no fine can be imposed.
Myth #2: A committee can impose discipline.
Truth: Under Civil Code 5855 discipline is imposed by the board. Some HOAs have enforcement agents or disciplinary committees sending out notices of fines, but those

Myth #3: A fine can be imposed without a hearing so long as there is a “right to appeal” the notice. Truth: The disciplinary process under Civil Code 5855 is clear – before ANY discipline is considered or imposed, the homeowner must be given written notice of the hearing at least ten calendar days before that meeting. Section 5855 Subpart (d) says: “A disciplinary action … shall not be effective … unless the board fulfills the requirements of this section.”
Myth #4: Homeowners have the right to an attorney or representative present at their discipline hearing. Truth: No, the law does not give this right. HOA hearings are not court proceedings but are meetings of neighbors to address unneighborly behavior. Nothing in the law requires hearings to be conducted like criminal proceedings, with counsel, 5th
amendment protections, and a jury of peers. I occasionally see governing documents allowing homeowners to bring counsel to hearings, but, generally, these should be meetings between homeowners.
Myth #5: Homeowners have the right to be present, so if they don’t attend the hearing it cannot proceed. Truth: The statute requires the homeowner to be given notice of the date, time, and place of the hearing (and the governing document provision violated), but it does not say that the board cannot proceed without the homeowner present. Boards should use their fair and reasonable judgment in determining whether to reschedule hearings, but rescheduling is not legally required.
Myth #6: HOAs can suspend voting rights and board eligibility in response to violations. Truth: HOAs cannot suspend homeowner voting rights, because of
the prohibition of Civil Code 5105(g), and unresolved rule violations is not a board eligibility standard allowed by Sections 5103(d)(2) and 5105(b),(c)(d).
Myth #7: The HOA cannot control tenant violations. Truth: The HOA has no direct control over tenants as non-members, but it can hold landlords responsible for the actions of their tenants or guests.
Myth #8: The HOA should keep imposing fines indefinitely until the problem is resolved. Truth: Fines are intended to deter, but when they don’t work, court action may be necessary. A cautionary tale is recited in the Ritter v. Churchill case from 2008, where the HOA fined the homeowner $200 per day until the balance reached $77,000… and the court ultimately found no violation, costing the HOA hundreds of thousands of dollars in attorney fees.
Myth #9: Boards must punish all violations. Truth: Boards may decide not to pursue minor violations if circumstances warrant and if owners are treated equally. Also, sometimes warnings are sufficient.

Emergency Response Officials, Receive Update on Winter Storms

He received an update on winter storms and the state’s work to support disaster response and relief efforts.
Last week, the Governor proclaimed a state of emergency. He activated the California Guard and State Operations Center to bring state support to county-led emergency response efforts and coordinate mutual aid from neighboring jurisdictions.
Significant numbers of state personnel are on the ground supporting affected areas, including the Governor’s Office of Emergency Services (Cal OES), Caltrans, the
California Highway Patrol, CAL FIRE, and the California National Guard working closely with the county-led Incident Command to deploy resources and address emergency management needs rapidly.
Statewide, CAL FIRE and other state agencies have 24 crews active to help communities impacted by winter storms. That includes six crew strike teams (totaling 12 crews) committed to the San Bernardino Storm incident.
Over 57 Caltrans employees operating 40 highpowered pieces of equipment, including graders, loaders, dump trucks, snow plows, and blowers, have removed more than 7.2 million cubic yards of snow off state highways in San Bernardino County as
of March 4, which equates to nearly 2,270 Olympic-size swimming pools. In addition, private contractors have removed another 970,000 cubic yards of snow from
state routes 18 and 330.

KNOW: California is extending the tax filing deadline for Californians impacted by December and January winter storms to October 16, 2023 – aligning with the IRS SACRAMENTO – In addition to tax relief measures that Governor Gavin Newsom announced in January, California is also extending the state tax filing and payment due dates to October 16, 2023, for Californians impacted by the winter storms in December and January. This aligns California with the Biden Administration, which also announced that the IRS extended various due dates until October 16.
“As communities across the state continue recovering from the damage caused by the winter storms, California is working swiftly to help recovering Californians get back on their feet,” said Governor Newsom. “The state is aligning with the Biden Administration and extending the tax filing deadline in addition to the tax relief announced earlier this year.”
Last month, Governor Newsom announced tax relief for those impacted by winter storms, allowing people to claim a deduction for disaster loss and extending specific filing deadlines.
According to the IRS announcements, the following counties are eligible for
this extended tax relief.

Regenerative Gala to Spotlight
By Desert Star StaffTo kick off Earth Month in April, a Bay Area event called the Regenerative Gala will promote the concepts of ethical consumerism and fashion and art as a vehicle for change.
The event’s fashion show rejects so-called “fast fashion,” which produces clothes in sweatshops, often made from petroleumbased synthetic fabrics.
Joelle Provost, a lowimpact painter whose works will be featured, said the focus is on natural fabrics
produced on farms avoiding pesticides, rejuvenating the soil, and paying a living wage.
“So many small brands are saying, let’s source our textiles from the farmers so that we know that the ecosystems are being supported on those small farms,” Provost explained. “It’s all about small-batch fabrics.”
The art auction will feature works promoting a healthy environment and the fight against climate change. The gala is on April 1 at the Piedmont Center for the Arts near Oakland.
Julian Adon Alexander, another featured artist, will offer paintings raising awareness about the lack of green space in urban neighborhoods of color.
“I just think exposure to new ideas is the point of art,” Alexander noted. “I

Student Art and Poetry Contest Honors Holocaust History
By Pamela PriceOnce again, the Jewish Federation of the Desert reached out to all students from grades 8 to 12 in the Coachella Valley, including home-schooled students, with their annual Art and Poetry competition. All submissions meeting the January 6 deadline were considered for the contest, with awards presented at the Federation office in Rancho Mirage, California, on Feb. 28. Leslie Pepper, the Federation’s Director of Women’s Philanthropy and Community Engagement welcomed honorees and guests to the afternoon event.
Previously, students with their Art and Poetry submissions laid the foundation for this annual event which had been on hiatus due to the Covid-19 pandemic. After this interval, students were once again briefed on submission guidelines with advice such as “your poem or art entry should not be political but strictly historical as it applies to today.”
Art projects took several forms, from drawings, photographs, paintings, and posters to collages, with early submissions encouraged. Before the Feb.28 event, all winners were judged and
presented with their cash awards on January 29 at the Community Holocaust Commemoration held at the University of California Riverside Auditorium.
As I was leaving, I had a moment to interview the author of a small but powerful booklet authored by Goldie Jacoby, a desert resident, and Holocaust survivor. I had met her a month earlier when she was a guest speaker at a local high school in Palm Desert. As one of the youngest survivors of the Holocaust, her story, captured in her book, resonates powerfully to this day.

Emcee Patrick Evans was the only live auction item. He sold a private dinner he cooked for ten at their house for $5,400. Then, Evans announced all the speakers and introduced the final performance—Gennine Francis and her five-piece band. Much dancing followed to cap off the evening.

The immediate problem is simple: There is not enough fuel and, therefore, not enough electricity, so prices have skyrocketed for both. To a large extent, this is a result of decreased Russian exports of oil, natural gas, and coal, which have been hit by western sanctions and other policy efforts to curb Russian revenues...”Natural gas is a significant new energy source for nations worldwide, including Germany, France, and China. This problem isn’t going away anytime soon. And the CEO of Saudi Aramco, the largest oil producer in the world, recently issued a dire warning about oil prices, saying they could quickly spike. According to this CEO, one of the most influential men in the energy market...
“The world should be worried. The fate of an entire continent lies in the balance. There’s an energy crisis in Europe due to sanctions against Russia and its retaliation. This is a big problem, of course. While Europe has had some success in quickly finding other energy sources, and it’s fortunately been a mild winter so far, this still may be the most significant economic problem in the world right now. The energy problem is more important than inflation because high energy prices are a big culprit in the higher prices we’ve seen at the grocery store lately. And energy is a significant source of the political problems we see with Russia and China.
Every person on earth needs energy. Energy is as essential as food and water for every human. There is a limited supply of energy sources, from fossil fuels... to nuclear... to renewables. And these resources often exist in a limited number of places but not others. These energy sources are spread all over the planet. Somehow we must get these energy sources into the power plants and gas tanks to power the global Economy. It comes down to supply and demand and getting the energy where it needs to be. If this supply and demand dynamic gets screwed up, energy prices rise because supply is not meeting demand.
Consider the Strategic Petroleum Reserve. This is an emergency stockpile of crude oil maintained by the United States Department of Energy. It is the largest publicly known emergency supply in the world. Unfortunately, because of this energy crisis, the Biden Administration has sucked out this strategic reserve to its lowest levels since 1984. Over the past year, the account has been down 36%. It’s now going to have to be filled back up!
The total capacity of the underground facilities is 714 million barrels. Thus, if they wanted to fill it up, we’d need about 324 million more barrels of oil. If we assume $80 a barrel... and if we filled it, that’s $25 billion. This should give you a sense of the scale of the shortages we’re dealing with here. If oil goes up to $160 a barrel, it’ll cost double that: $50 billion...
Energy isn’t being produced to scale globally, and energy needs to be supplied to where it needs to go. This applies to oil, gas, green energy, and this energy, liquefied natural gas, or LNG. The exciting thing for investors is that LNG remains a “secret corner” of the energy markets. Consider that 25% of the EU’s energy consumption comes from natural gas.
