There was a ribbon cutting to start the event in grand style. The Iconic Comic Book guru Stan Lee, Palm Springs Mayor Robert Moon, founder of Palm Springs Comic Con, Christopher Spellman and the original Hulk portrayer, Lou Farrigno, did the ribbon-cutting
honors. Thousands of people waiting in line to enter this first ever Comic Con in the Valley at the Palm Springs Convention Center. It took that large facility to be able to hold the influx of people wanting to see what a Comic Con event was like. Comic book fans were in awe of all the vendors that sold not only Comic books, but everything related to Comics and their super heroes. The
By Desert Star Staff Actor Gene Wilder has departed for the giant chocolate factory in the sky. His family says he passed away from complications of Alzheimer’s disease, at the age of 83. Wilder died Sunday night in Stamford, Connecticut, his nephew Jordan Walker-Pearlman said. The family chose not to disclose Wilder’s Alzheimer’s diagnosis three years ago. “The decision to wait until this time to disclose his condition wasn’t vanity, but more so that the countless young children that would smile or call out to him ‘there’s Willy Wonka’, would not have to
be then exposed to an adult, referencing illness or trouble and causing delight to travel to worry, disappointment or confusion,” the family said in a statement. “He simply couldn’t bear the idea of one less smile in the world.” Born Jerome Silberman in Milwaukee, Wisconsin, Wilder began acting at the age of 12. Wilder’s stage name came from the main character of Thomas Wolfe’s novel Look Homeward, Angel and from the playwright Thornton Wilder. Later in life, he said his psychoanalyst suggested that his name honored his mother, Jeanne. Although his career
floor was lined with booths that sold posters, toys, T-shirts, memorabilia, costumes and masks, art work, etc. and of course all the comics you could want to fill a collection. Comic Book artists had booths where you could get an autograph or buy an original work of art or just meet and talk to the artists. Some of the artists were busy drawing, and fans could
watch them at work. I was amazed at the amount of people that entered the Convention Center. The line was never ending, and people brought their children to see first-hand what goes on at a Comic Con Convention. People were stopping at vendors to look or talk to them about their collections. There were groups of people talking to the artists. Others took time out to partake
of a little food and beverage and watch all the many costumed fans. Parents even had their children in costume. The costumes ranged from Super Heroes to Villains. Fans of Stan Lee purchased tickets to get an autograph from him or had their photo taken with him. Stan Lee is the godfather of Continues on Page 2

comics and is considered the person that got Marvel Comics and Super Heroes to be the big entity that it has become. Almost everyone has read a comic in his youth, and some like me still have a lot of those comics in a box somewhere. Hundreds of Stan Lee fans stood in line to buy those tickets and Stan Lee signed autographs all three days. This is an amazing 93-year-old man who is humbled by his success that has lasted for 7 decades.

Comic Con Sunday, Stan Lee Q&A Story and Photos by Pat Krause Comic Con Palm Springs has proven to be another big convention for our Valley. Thousands of people came every day, as there was one event after another. There were game rooms, Panels, guest speakers, a zombie walk, raffles, prizes, seminars, and workshops with comic book professionals actors and so much more. This was such a well-planned convention. There were posters set up in the lobby with costumed people for photographs and more inside the main room, as it seems everyone has a cell phone to take photos these days. This was better than Halloween as everyone likes to dress up sometime and this was the biggest venue for that. The costumes ranged from a simple outfit to a very elaborate comic book

hero costume complete with swords and other weapons. It was hard to determine who was the professional or a costumed artist and everyone else. This event was the biggest costume party, and fans were eager to take photos of those in costume or be photographed. There was a Stan Lee table full of Stan Lee dolls, Pop’s toys, autographed photos, and even a limited edition of a Stan Lee guitar. Stan Lee is the biggest name in Comics and is a legend in the industry. Stan Lee held a panel in the main ballroom area that could handle all the people that wanted to attend. Stan Lee would answer questions from the audience and tell about his life in comics that have lasted over 70 years. He told about his start in comics and never thought it would become as big as
it has. He was President of Marvel Comics but liked being an editor more. He created a lot of fictional characters like Spider-man, The Hulk, Iron Man, Thor, The X-men and many more. He said he would think up a super hero and then ask the artists to create them, costumes and all. He was the writer and idea man and said he had the best artists to work with. He said he was an artist but didn’t pursue that part in his career. Another comic icon, Todd Mcfarlane was part of the Sunday Q&A with Stan Lee. Todd created the comic SPAWN and drew the Hulk, Barman, Spiderman, and other for comic book publishers. They joked with each other on stage while Todd asked Stan questions. Ingles wore a Power Rangers costume and invited guests to his Costume Party that was a part of Comic Con on Saturday night, August 27th. BB is known for his costume parties that are held in Palm Springs on holidays. Many of the events connected to Comic Con were held at the Renaissance Hotel in Palm Springs. Other Palm Springs businesses held after parties, concerts, costume parties and more. Guests were treated to pasta dishes, a variety of small tacos, A salad table and delicious desserts. The upstairs of LULUs was filled with people all excited about the upcoming Comic Con and what they were hoping it would be like. Owners Barbara and Jerry Keller came up to greet the guests as well. There were a few others in costume that was going to be a big part of the event. This first Comic Con Palm Springs was going to be a huge event bringing in comic lovers from all over, many coming from far away just for these events.

Aetna and UnitedHealthcare, have exited certain markets and are leaving large portions of the country with functional monopolies for next year. According to an analysis done for The Upshot by the McKinsey Center for U.S. Health System Reform, 17 percent of Americans eligible for an Affordable Care Act plan may have only one insurer to choose next year. The analysis shows that there are possibly seven entire states currently set to have one insurer. The market is still in some flux, while final contracts between insurers and the federal government won’t be signed until late September. That means it is still possible that additional insurers will choose to enter new markets between now and then, and the competitive picture could improve. It is also possible that some carriers will decide to exit. By comparison, only 2 percent of eligible customers last year had only one choice.
Aetna surprised regulators and others with the news that it was leaving most of the markets where it offered policies on the exchange, leaving it in just four states. The Obama administration says it is too early to evaluate competition in the ACA markets for 2017. Open Enrollment begins Nov. 1st. A number of steps remain before the full picture of marketplace competition, and prices are known. Many large population centers like Denver, Los Angeles, New York, and Miami consumers will have multiple choices. Lower occupation areas have limited choice, like the seven states that now have only one issuer: Alabama, Alaska, Oklahoma, South Carolina, Wyoming, Kansas and North Carolina. Large sections of other states may also be down to one carrier, including Florida, Utah and Missouri. While the dwindling competition may not be fatal, it isn’t ideal. A rule in the health law limits how much of their premium’s
insurers can keep for overhead and profits, which may hinder a monopoly insurer’s ability to overcharge, even in the absence of competition. People shopping for plans in the exchanges will be left with fewer insurer choices and probably fewer choices of doctors and hospitals because the companies that remain will most likely offer sharply smaller networks than the plans offered “ Off exchange�. It may force enrollees to change doctors and other health providers, if the providers do not contract on Exchange plans. Tax credits are not available for “Off Exchange� plans, leaving those with lower incomes with fewer choices.
Insurers say the current rush to the exits, underscores their contention that changes need to be made to the law. The decline in participation must be addressed by Congress and the administration to move forward with solutions that will improve the stability of the market and provide the affordable coverage options that consumers need.

[In our association] some homes have decks, some have balconies, some have chimneys, some have both and some have neither. I understand that in January of next year DavisStirling will change to make EUCAs the responsibility of the HOA unless the CC&Rs say otherwise. Our HOA is having a contentious debate about an amendment to our CC&Rs that our board president is pushing and will result in the HOA being responsible for everything but doors and windows. This will result in increasing our dues substantially, special assessments and possibly a bank loan to cover all these repairs. That is why I am motivated to understand this issue and any help you can provide will be appreciated. R.G., San Francisco
association may not have a copy of the subdivision map, but it is easy to obtain with the help of your friendly local title insurance company. Planned developments typically will not have exclusive use common area, which more typically is found in condominium projects. Exclusive use common areas are defined by Civil Code 4145, unless the association governing documents define such areas. Under current Civil 4775, unless the governing documents say otherwise, the association maintains and repairs common area, and the individual member maintains “their� exclusive use areas. This left a question – who has responsibility for repairing exclusive use areas? Mainstream HOA attorneys have been saying for many years that the conclusion is that the HOA repairs exclusive use areas, since they are still
common area. In January 2017, the law changes and closes that gap in the law. In 2014 the Executive Council of Homeowners sponsored AB 968, which confirms what HOA lawyers said for years – that the HOA repairs exclusive use common areas. The bill was non-controversial, and was passed. However, despite that the change to the law was quite modest, the law will not become effective until two years later – January 1, 2017. The bottom line is that the change in the law will not affect most HOAs, because most associations either have specific governing document provisions allocating repair responsibilities or the HOA already handles exclusive use area repairs. Some anti-HOA groups decried AB 968 as a big negative change for HOAs, but in so saying, they betray their ignorance - AB 968, when
implemented, won’t change what most associations already are doing. Chances are, in fact, that the change in the law next year won’t be even noticed by most – because most are already allocating repair responsibility the same as will the new Civil 4775. Remember that if the repair to exclusive use common area is due to homeowner abuse or neglect, the HOA is still going to expect the homeowner to pay. Thanks for your question, Kelly.

Coachella Valley students lagging behind their peers By KMIR News Staff COACHELLA VALLEY - Coachella Valley-area school districts lagged far behind their counterparts from across the state in math and English testing, according to results released today by the California Department of Education. State Superintendent of Public Instruction Tom Torlakson said California students overall showed improvement on the California Assessment of Student Performance and Progress, which was implemented last year to reflect new Common Core standards, replacing the previous Standardized Testing and Reporting Program. The CAASPP online tests were administered in the spring to more than 3.2 million students across the state in grades 3-8 and 11. In the Palm Springs Unified School District, 12 percent of students exceeded the state standard in English, while 26 percent met it, 25 percent ``nearly’’ met it and 37 percent failed to meet it. In math,
just 8 percent of students exceeded the standard, while 15 percent met it, 29 percent nearly met it and 48 percent failed to meet it. Students in the Lake Elsinore Unified School District performed about the same in English, with 12 percent exceeding the standard, 29 percent meeting it, 29 percent nearly meeting it and 30 percent failing to meet it. The news was worse in math, with 9 percent exceeding the standard, 18 percent meeting it, 32 percent nearly meeting it and 41 percent falling short of the standard. Numbers were significantly lower in the Coachella Valley Unified School District, where just 5 percent exceeded the state standard in English, 18 percent met it, 26 percent nearly met it and 51 percent failed to meet it. In math, 59 percent of the district’s students failed to meet the state standard. Just 4 percent of students exceeded the standard, 10 percent met it and 27 percent nearly met it. Across Riverside County,
16 percent of the more than 220,000 students who took the tests exceeded the state standard in English, up from 13 percent last year. According to the test results, 29 percent met the English standard, up from 28 percent in 2015, and 25 percent ``nearly’’ met it, down from 27 percent the previous year. In math, 11 percent of county students exceeded the standard, up from 9 percent last year, while 20 percent met the standard and 30 percent nearly met it -- compared to 19 percent and 31 percent, respectively, from 2015. Statewide, 20 percent of students exceeded the standard in English, while 29 percent met the standard, 24 percent nearly met it and 28 percent did not meet it. In math, 17 percent exceeded the standard, while 20 percent met it and 28 percent nearly met it and 35 percent failed to meet it. ``The higher test scores show that the dedication, hard work and patience of California’s teachers, parents, school employees and
administrators are paying off,’’ Torlakson said. ``Together we are making progress towards upgrading our educational system to prepare all students for careers and college in the 21st Century.’’ Torlakson noted that the statewide test results continued to show an achievement gap, with 37 percent of Latino
students and 31 percent of black students meeting or exceeding standards in English, compared to 64 percent of white students. ``The achievement gap is pernicious and persistent, and we all need to work together to find solutions that help all groups rise, while narrowing the gap,’’ he said. USCIS Proposes Rule to Welcome International Entrepreneurs
By Desert Star Staff WASHINGTON— Today, U.S. Citizenship and Immigration Services (USCIS) is proposing a new rule in the Federal Register, which would allow certain international entrepreneurs to be considered for parole (temporary permission to be in the United States) so that they may start and scale their businesses here in the United States. “America’s economy has long benefitted from the contributions of immigrant entrepreneurs, from Main Street to Silicon Valley,” said Director León Rodríguez. “This proposed rule, when finalized, will help our economy grow by
expanding immigration options for foreign entrepreneurs who meet certain criteria for creating jobs, attracting investment and generating revenue in the U.S.” The proposed rule would allow the Department of Homeland Security (DHS) to use its existing discretionary statutory parole authority for entrepreneurs of startup entities whose stay in the United States would provide a significant public benefit through the substantial and demonstrated potential for rapid business growth and job creation. Under this proposed rule, DHS may parole, on a case-by-case
basis, eligible entrepreneurs of startup enterprises: · Who have a significant ownership interest in the startup (at least 15 percent) and have an active and central role to its operations; · Whose startup was formed in the United States within the past three years; and · Whose startup has substantial and demonstrated potential for rapid business growth and job creation, as evidenced by: o Receiving significant investment of capital (at least $345,000) from certain qualified U.S. investors with established records of successful investments;
o Receiving significant awards or grants (at least $100,000) from certain federal, state or local government entities; or o Partially satisfying one or both of the above criteria in addition to other reliable and compelling evidence of the startup entity’s substantial potential for rapid growth and job creation. Under the proposed rule, entrepreneurs may be granted an initial stay of up to two years to oversee and grow their startup entity in the United States. A subsequent request for re-parole (for up to three additional years) would be considered only if the

By Desert Star Staff An estimated 11 million Syrians have fled their homes since the outbreak of the civil war in March 2011. Stories of these refugees are continuing to emerge and make national headlines, like the viral video of 5-year-old bombing victim, Omaran Daqneesh and Yusra Mardini, the teenage swimmer part of the refugee Olympic team. Ani Apelian, 59, is originally from Syria. Ani and her husband owned an organic olive oil soap factory, an e-commerce store, and various rental properties, in addition to Ani running a local Christian school.

That all changed on March 21, 2014, when terrorists entered her hometown of Kessab, a quiet resort town in Syria only a little north of the Turkish border. Ani Apelian, her husband and 13-yearold son had no choice but to flee, with nothing but the clothes on their backs and their American passports. “In half an hour, all of the town was empty.” Ani and her family went to the nearest city with their neighbors and friends from church, some of them still in their pajamas. Soon after, they went to stay with her older daughter living in Dubai with her husband,
before finally landing in Corona, California to join her parents who had already left Syria earlier to live with Ani’s brother. Here they’ve begun to piece their lives back together while caring for their elderly parents. When Ani’s husband was looking for work initially, he stumbled upon Avon on the Internet. They needed work quickly and when Ani heard stories of women who had thriving Avon businesses, she said – “I can do that!” – and was determined to learn all she could. Ani has been able to supplement her husband’s income with her Avon business, and is able to help support August 31, 2016
her elderly parents, both in their 80s and 90s, because of the job’s flexibility. Coming to a country knowing no one, and unsure of the culture, Ani says she owes Avon so much. “Every friend I have Corona is because of Avon,” she says. As part of an enterprising

The proposed rule does not take effect with the publication of the notice of proposed rulemaking. It will take effect on the date indicated in the final rule when a final rule is published in the Federal Register.

Julie Regan, chief of external affairs at the Tahoe Regional Planning Agency, said President Bill Clinton attended the first summit back in 1997, when the lake seemed to be at a tipping point, getting cloudier by the day. “Today we’ve arrested that decline,” she said. “We have been holding steady on lake clarity for the last 15 years. And we are hopeful that if we continue in this good direction, we’ll actually get back to 100 feet of clarity, which is what it was in the 1960s.” Regan said since then
regional planners have attacked the problem by instituting mandatory inspections for all boats to keep invasive species out, by lessening pollution with more public transit, and by clearing 65,000 acres of dry brush and dead trees. Regan is hoping Congress will reauthorize the Lake Tahoe Restoration Act by the end of this year, so the good work can continue. “We have unprecedented challenges from climate change and prolonged droughts,” she added. “We’re looking at tree mortality and threats from wildfire. By Desert Star Staff DES MOINES, Iowa – As they dig into the fall semester, Iowa community college students can take comfort in knowing their education comes from a top-rated community college system. A new study from the online research site WalletHub ranks Iowa 15th among community college systems in the nation. Rob Denson, president of Des Moines Area Community College, credits the state’s board system, in which elected members represent the needs of local colleges. He adds community colleges are well integrated into the business community, so they’re seen as workforce drivers for the state. “Knowing that 60 percent or more of all the jobs in this state require more than high school, but no more than a two-year degree,” he points out. “So, our responsiveness to the government, the parents and students, the businesses that hire our students, is exceptional.”
In fall 2015, more than 93,000 and students were enrolled at an Iowa community college, including 33,000 jointly enrolled high school students. Denson says community colleges also work with local high schools on Career Colleges that combine two years of secondary education with an associate’s degree in a career preparatory program. He maintains it’s a great partnership. “Because of pooled funding and community college funding, we can get the equipment, so it’s state of the art,” he says. “And because all of our academic programs have advisory committees of businesses, we’re teaching competencies that are absolutely current. “And then, it’s easier for us to find an academicallyqualified college instructor to teach that class.” One area that Denson says needs to be addressed is rising tuition. When the community college system was created 50 years ago, operating costs were to

Kelly Mayhew, a professor of English, humanities and gender studies at the college, called it a “must-pass” initiative. “Before we passed Prop 30, we were going through terribly draconian budget cuts, which meant closing classes, fees were going up,” she said. “And so, I can’t imagine going back to before, when students in our schools suffered profoundly.” Opponents have argued that high-income earners will flee the state if Prop 30’s taxes are extended, but statistics show that California has seen an increase in its numbers of millionaire and billionaire residents
since Prop 30 passed. Mayhew added that before Prop 30, class sizes in kindergarten through 12th grade went up dramatically and programs that had once been considered vital had to be cut. She said schools now have reversed some of the cuts from eight years ago, restoring school counselors and extracurricular activities, and she wants to see that progress continue. “I’m involved in Prop 55 because that will at least stabilize the funding at the current levels without raising any extra taxes, but keeping the taxes on the top earners for the next 12 years,” she said. By Desert Star Staff The European Commission ruled on Tuesday that “selective treatment” by Ireland allowed Apple to pay a tax rate of one percent on EU profits in 2003 down to 0.005 percent in 2014. The US company has been ordered to pay up to €13 billion to cover the unpaid tax. “Member States cannot give tax benefits to selected companies – this is illegal under EU state aid rules. The Commission’s investigation concluded that Ireland granted illegal tax benefits to Apple, which enabled it to pay substantially less tax than other businesses over many years. In fact, this selective treatment allowed Apple to pay an effective corporate tax rate of one percent on its European profits in 2003 down to 0.005 percent in 2014,” said EU Competition Commissioner Margrethe Vestager EU in a press release before her speech. Apple was attributing its profits to a “head office” in Cork that had no employees, premises or any economic
activity, and paid almost no tax, said Vestager. The 130-page ruling on Apple’s Irish operations was published on Tuesday following a three-year investigation. “I disagree profoundly with the commission’s decision,” said Irish Finance Minister Michael Noonan, adding that the country’s tax system leans on the law “without exception.” According to a FT source familiar with the matter, Apple would have to restate its accounts as a result of the ruling. The US company allegedly paid tax at a rate of one percent, well below Ireland’s then official 12.5 percent corporate tax. The investigation was accompanied by strong warnings from Washington not to fine American companies. The US Department of Justice accused the European Commission of becoming a “supranational tax authority” overriding the tax codes of its member countries. The Obama administration warned the EU that the

He is soft, green and loyal to those he loves like the little boy in the story. This dragon will not only captivate your imagination, he will steal your heart as well. And for Mom, Robert Redford is also in the film. The other late summer film of note, is “Florence Foster Jenkins.” It is too adult for the younger kids in

Usually her protective ‘husband’ manager was able to shield her from critics, but things change when she sings at Carnegie Hall in 1944. Funny, sad and well worth seeing. Presently there are not too many new films to enjoy so the next best thing to going to the movies is to bring the movies home to you via DVD. And this method is cheaper since the whole family can sit down and watch a show together for just one very small rental fee. Here are a few suggestions for DVD viewing. If you are romantic at heart, don’t miss seeing “Me Before You,” which arrives on Blu-ray, DVD and digital

Granted, there was practically no budget, which mitigated any real production values. That restriction is understandable and easily forgiven, but to ignore basic theatre craft just bespeaks of amateurs. According to press notes, the playwright grew up with survivors of World War II and, “The majority of the women in my family were nurses.” Perhaps his own personal experiences, motivated the playwright to write “As Straw Before The Wind,” and enlist Lesley Asistio to direct his play.
Despite honorable intentions, the association turned out to be an artistically bankrupt alliance. It is difficult to say how Racelis’ interesting material would fare under a more professional cast and seasoned director, as the story is really compelling as it does touch on several aspects of the human condition – from the warehousing of the elderly to ambition and childhood experiences that haunt us. Perhaps he was thinking the same thing as he did check his email from time to time during the performance. Sea Rise Threat to Norfolk, Atlantic and Gulf Military Bases By Desert Star Staff RICHMOND, Va. – Climate change represents a serious problem for U.S. coastal military bases – especially in and around Norfolk, according to a recent study. The report, “The U.S. Military on the Front Lines of Rising Seas,” from the Union of Concerned Scientists, looked at the impact of sea-level rise on 18 Atlantic and Gulf Coast military installations – including Paris Island, Camp Lejeune and Annapolis. Report author Astrid Caldas, a climate scientist at the Union of Concerned Scientists,

said the Norfolk Navy base has averaged about 10 flood events a year in the recent past. “Under the intermediate sea-level rise scenario, it’s going to see roughly 280 flood events per year,” Caldas warned; “and if the highest scenario plays out, by 2050, about 540 flood events per year - more than once daily.” According to the report, daily high tides likely will cover the entire Langley Air Force Base by the end of the century. Caldas stressed that the Department of Defense is well aware of the issue and is actively pursuing steps to
deal with the higher seas. But there has been resistance to that policy from members of Congress who criticize global warming as a hoax. Caldas said steps such as building floodwalls and relocating installations need to be taken, and the sooner the better. But, she said, it’s all but impossible to move a huge Navy base such as Norfolk. “With the U.S. fleet, they need deep channels for the big ships to go in,” Caldas said. “And if you talk about some places, some bases being relocated, where’s Norfolk going to go, right?” August 31, 2016

These musicians are all well-known artists and come together for these unique concerts. Sammy Hagar has been thrilling fans with his music for decades. Michael Anthony is a guitarist who has played with Van Halen and Chickenfoot. Vic Johnson is another rock guitarist who has been a part of Busboys and Sammy Hagars Waborita’s band. Jason Bonham is a drummer and the son of John Bonham, Drummer for

Dreamer Challenging Nationwide Immigration Injunction By Desert Star Staff NEW YORK - A Mexican immigrant in New York is challenging a nationwide injunction on two Obama administration immigration programs. Martin Batalla Vidal’s parents brought him to this country eighteen years ago, when he was seven years old. When the administration expanded the Deferred Action for Childhood Arrivals program, known as DACA, he was granted a three-year work permit. But that was revoked after 26 states challenged the expansion in court, saying it would cost them money. Amy Taylor, legal director at Make the Road New York, said the injunction issued by a Texas district court should not apply to immigrants living in New York. “A state that intentionally chose not to participate in that litigation because the state supported these programs,”
she said. “Mr. Batalla Vidal really feels it was an unjust infringement on his rights.” A lawsuit, filed in the Federal District Court in New York, said the Texas court did not have the authority to issue a nationwide injunction. That injunction also applies to the Deferred Action for Parents of Americans, or DAPA, program. Justin Cox, a staff attorney with the National Immigration Law Center, pointed out that the injunction forces millions of immigrants in states that have not challenged these programs to spend extra time and money renewing their work permits at more frequent intervals. “There have been individuals who have sought to renew their employment authorization and there have been delays, and they’ve actually had to quit their jobs because they’re no longer work authorized,” he said. Each application to renew a work authorization

A new study provides stark evidence on how money shapes U.S. elections. (Pixabay)
By Desert Star Staff DENVER – As public outrage over the influence of money in politics continues to grow – seen in both the Bernie Sanders and Donald Trump campaigns – a new study provides compelling evidence that the U.S. political system is more “one dollar, one vote” than “one person, one vote.” Thomas Ferguson, director of research at the Institute for New Economic Thinking in New York and his team, tapped data on congressional races and discovered a stark correlation. “Basically, you get the percentage of votes that you have of the percentage of money,” he explains. “It’s an amazingly crass relationship, and it’s very direct and it holds for hundreds of elections.”
Researchers created a chart to track spending and votes in U.S. Senate and House races since 1980. Ferguson says if money and votes were unrelated, the chart would be scattered. Almost without exception, he says the results produced a straight line: when parties spend little to no money, they get the fewest votes, and spending the most money results in the most votes. Ferguson says the research supports findings from a Princeton and Northwestern study that shows the poor and middle class have virtually zero influence on government when the wealthiest Americans oppose policies. Ferguson cites the preference by a majority of
corporations and top earners for lower taxes as one example of what can happen when money drives politics. “The rest of us have to live with the consequences of that,” he states. “Roads that don’t work, schools that are collapsing. And the notion that the last dollar rather than the last votes should determine things strikes me as a crazy idea.” Ferguson says he hopes the data will force a conversation about the need to create a more democratic political system in the U.S. He notes public financing of elections and giving candidates free and equal time on publicly owned airwaves would be good first steps to reduce the influence of money in politics.

By Desert Star Staff Brock Turner’s sixmonth sentence for sexually assaulting an unconscious woman is coming to an end three months early. The exStanford swimmer’s light penalty provoked outrage and inspired California legislation now just one-step away from becoming law. Turner, 20, will likely be released from jail Friday having served only half of his sixmonth sentence. Three months may be a short time to serve for sexual assault, but a lot has changed between when he was convicted and now. Three months ago, Turner was found guilty of assault with intent to commit rape of an intoxicated woman, sexually penetrating an intoxicated person with a foreign object, and sexually penetrating an unconscious person with a foreign object. On top of his brief jail time, Turner will spend the rest of his life on the sex offender registry and will have to complete a sex offender management program. Although life on the sex
offender registry is no one’s idea of fun, it is a far cry from what the prosecutors were originally seeking, which was a six-year sentence in federal prison. While California has mandatory minimum sentencing laws for forcible rape, the same is not true for cases where the victim is unconscious or severely intoxicated – which is what allowed Turner to slink out of court with what was seen by many as a slap on the wrist. But on Monday, state lawmakers passed legislation that would remove a judge’s ability to use discretion during sentencing of such crimes. “Sexually assaulting an unconscious or intoxicated
victim is a terrible crime and our laws need to reflect that,” Democratic Assemblyman Bill Dodd, a co-author of the legislation, said in statement. He went on to say, “This bill is about more than sentencing, it’s about supporting victims and changing the culture on our college campuses to help prevent future crimes.” The bill now moves to Governor Jerry Brown (D), but he has made no mention of whether or not he will sign it into law. Turner’s sentence was cut short largely due to the fact that he had no prior runins with the law, which was also what inspired Judge

DHS to Review Use of For-Profit Detention for Immigrants

The announcement by Homeland Security Secretary Jeh Johnson comes on the heels of a decision by the Department of Justice to phase out private companies used to operate federal prisons. immigration programs director with Grassroots Leadership, said her group has documented a litany of problems and abuse at the for-profit immigration facilities located in Texas and elsewhere. “They say that they’re going to conduct a review looking at all aspects of contracting in these facilities, how they’ve operated and what happened there, the kind of abuses and neglect that we see in those facilities,”
she said. “Any honest review looking at that would have to result in them terminating their contracts just like the DOJ did.” Detention center facilities are located in Karnes City, Dilley and several other places across Texas. The majority of the centers are operated by the GEO Group and Corrections Corporation of America. A recent report said private companies manage about 72 percent of all beds in immigration detention facilities in the country. August 31, 2016
Parker said Grassroots Leadership and other advocacy groups have documented the same type of conditions in federal immigration detention centers that the Department of Justice cited in its decision to phase-out the use of forprofit prison corporations. “Pretty regularly, we see in here issues of medical neglect, poor food, of unsanitary and inhumane conditions, and abuse by guards,” she added. “These are just places that shouldn’t exist at all, but
certainly shouldn’t be run by private prison corporations.” Johnson ordered the Homeland Security Advisory Council, chaired by former FBI and CIA Director William Webster, to review the use of private prison companies. Two Texans, Austin Police Chief Art Acevedo and former Houston Mayor Annise Parker, are also on the panel. The council’s report is due by November 30th.

Trucking Industry Faces Tougher Emissions Rules
By Desert Star Staff SACRAMENTO, Calif. California drivers have to share the road with thousands of heavy-duty trucks that transport thousands of pounds of goods across the state every day. Because we also share the air, the Obama administration announced this week that new carbon-emission standards will require up to a 25-percent reduction for trucks and buses over the next 10 years. Paul Billings, senior vice president for advocacy at the American Lung Association, said the standards will improve the health of people and the economy. “These rules will provide tremendous climate and health benefits to the American people,” he said, “and the great thing about them is they actually save people money too, because the vehicles will be more efficient to operate, because they’ll burn less fuel and operate more efficiently.”
There are more than 2,500 miles of interstate in California and 25 segments of interstates, making the state one of the most heavily traveled regions for big-rig traffic. California already has some of the toughest heavy-truck emission standards in the country. With semi-trucks often lasting at least 10 years on the road and driving 1 million miles during that time, Billings predicted that the new emission standards will have a long-term impact on the country’s air quality. “The thing about trucks is, they last a long time, and so it takes a long time for new technology to come in and replace the older trucks as they retire,” he said. “But this is a forward-looking rule, so we’ll continue to see benefits as these cleaner, more efficient vehicles replace the older, less efficient vehicles.” The Obama administration estimates the new rules will

Isaac Flores -- along with 18-year-old co-defendants Miguel Angel Ramirez, Luis Becerra-Gomez, and Nickolas Hernandez -- are charged with assault with a deadly weapon and conspiracy to commit a crime in connection with the Aug. 14 assault on Trey O’Connor. Flores additionally faces a sentence-enhancing allegation of rendering O’Connor comatose during the alleged assault, indicating prosecutors believe he threw the rock that hit the victim in the head and caused the most serious injury.

Officers found the 30-yearold victim at 9:17 p.m. Sunday at a home in the 82300 block of Santa Rosa Avenue, said Indio police Sgt. Daniel Marshall. “We were all in the room and we were talking on the phone and texting and we heard five gun shots all in a row,” said Maria Castro, a six-year resident of the neighborhood. The defendants then allegedly drove to another part of the community and planned their return attack. Ramirez allegedly hatched the plan to reciprocate by collecting two large rocks, which he gave to Hernandez and Flores, the declaration states. Steelhead Numbers in Northwest Far Below Prediction
By Desert Star Staff PORTLAND, Ore. - The number of steelhead making their way up the Columbia River and into its Northwest tributaries has fallen far below predictions this season. The migration of “A-run” steelhead from the ocean to freshwater is wrapping up through Bonneville Dam in the Columbia River Gorge, and the count is about half of the 10-year average. Jim Murphy, senior counsel with the National Wildlife Federation, said the emerging trend of warmer waters in the Northwest are most likely contributing to the drastic decline in numbers. “It is likely attributed to the fact that the waters are getting warmer,” he said. “Often times the streamflow gets lower at periods of the year when it used to be higher. We’re seeing things like snowmelt occurring
earlier, ending sooner.” B-run steelhead, which spend a longer time in the ocean before returning to freshwater to spawn, are returning now. However, it is too early to know what numbers will look like for this season. Bob Rees, executive director of the Association of Northwest Steelheaders, also said the low numbers are likely from poor water conditions, such as a pocket of unusually warm water that lingered near the Pacific coast last summer, often referred to as “the Blob,” and the low amount of runoff from snowmelt. He said keeping an eye on fish such as steelhead in the Northwest can provide a picture of the health of the environment. “We kind of call them our canary in the coal mine,” he said. By Desert Star Staff Sixty percent of groundwater in the Indus and Ganges river basin – essential for the lives of over 750 million people in India, Pakistan, Nepal and Bangladesh – is too contaminated to drink or use for irrigation, a new study says. The groundwater of the vast Indo-Gangetic basin, named after the Indus and Ganges rivers, is contaminated and inappropriate for use, a team of scientists wrote in Nature Geoscience. “Within 60 percent of the aquifer [permeable rock which can contain or transmit groundwater], access to potable groundwater is restricted by excessive salinity or arsenic,” says the study, which is entitled ‘Groundwater quality and depletion in the Indo-Gangetic Basin mapped from in situ observations’. Some 23 percent of the groundwater stored in the basin contains too much salt at a depth of up to 200 meters (650ft), while about 37 percent of it “is affected by arsenic at toxic concentrations,” the scientists explained. The groundwater extraction from the Indo-Gangetic basin
amounts to nearly one quarter of the total global figure, accumulating fresh water stored underground in soil or rock and fed by rivers and rainfall. This huge area is known for the Indus Valley Civilization, which gave birth to ancient South Asian culture. The study, which incorporates local records of groundwater levels and water quality from 2000 to 2012, has also found that the water table was stable or rising across about 70 percent of the aquifer. As a rule, groundwater can become salty due to natural causes and manmade activity, including inefficient irrigation and poor drainage. Arsenic is naturally present in groundwater, but levels may be affected by the use of farming fertilizers and mining. Arsenic contamination of drinking water is a major problem in the region and beyond. In the 2015, the World Water Development Report authored by the UN Environment Program (UNEP) warned that only 60 percent of the world’s demand for water will be met by existing resources at the
