Apple Fire News Photo by Dina Rivera By Desert Star Staff Officials announced Monday afternoon a vehicle malfunction, specifically a diesel-fueled vehicle emitting burning carbon from the exhaust system, was the cause of the fire. The determination

is reinforced by multiple independent witnesses, as well as supporting physical evidence. Cal Fire Peace Officers are seeking information from anyone that may have seen a vehicle which appeared to have mechanical

problems or unusual smoke emitting from it. The Apple Fire is spreading primarily to the north and east into the San Gorgonio Wilderness. The fire is burning in an area with no recent fire history. It is expected to burn

into less dense fuels as it progresses. Fire activity is being driven primarily by record low moisture content of the vegetation combined with high temperatures and low relative humidity. These conditions are contributing to active fire behavior

Recognized for her legendary commitment to

local charities, Phyllis pulled out all the stops during the current health emergency. Her friends Sarah Milmet and Marshall Brown gifted the birthday girl with a jovial video produced by Lani Garfield, capturing the twohour procession of birthday revelers. Phyllis, dressed in a custom designed hot dog-

themed T-shirt displaying a bevy of appetizing “add ons.” compatible with the traditional hot dog, from chopped onions and dill pickle slices to a dollop of mustard was original enough for a mention in Vanity Fair magazine. Marvin Eisenberg, the husband of Phyllis, founded the Eisenberg Hot Dog

Company in Chicago. off with low-cost tax-efficient investments in a taxable account. 401(k) fees have fallen sharply since 1980; however, the prices may not offset in tax-efficient diversified index funds for little or no cost. Third-Party Administrator’s fees are high since there are many items the T.P.A. may need to perform, such as compliance, discriminatory testing, loans, and emergency response planning and defense against non-compliance. The Third-Party administration fees are sometimes paid by the employee and the company. Workers should be allowed to roll over 401(k) funds into self-directed I.R.A.s while they’re still working — not just when they leave a job — which would force 401(k) platforms to compete in an open market, encouraging them to lower fees. 401(k) plans do not offer as much tax benefit these days as they did 40 years ago, since fees are often too high and expected returns have declined, while marginal tax rates and capital gains tax rates are way down for middle-income people and the decline is significant. The biggest problem future retirees will face is paying much higher tax rates when the distribution of funds starts, which will reduce their

retirement spendable income. Another concern is that the government has control over these plans and can change rules anytime since the planning model was approved by the I.R.S., whereas if you rolled over your savings to a program that is a contract, such as an equity-indexed annuity, the government’s future legislative changes, cannot impact a deal. The solution is not to eliminate the 401(k) or discourage participation in 401(k) plans. There are Roth 401(k) plans funded with aftertax, rather than before-tax contributions, and employees can usually choose lower-cost funds in their plans. Other

solutions are to roll over to a qualified annuity that offers, tax shelter, tax deferment, and advantages of the effect of compounding interest. The dilemma of all employees, especially in a volatile market, is that much guidance is needed to manage their savings to not lose money. The employee has the burden of making a living, managing family, and now worrying about the pandemic. Little time is left to watch the market or the knowledge to understand the market. As Will Rogers stated, “I am not as concern about the return on my money. But the more concerned about the return of it.”

Proposed Law Would Override HOA Self-Determination

By Kelly G. Richardson, Esq. CCAL Assembly Member Ting from San Francisco has authored Assembly Bill 3182. In its original form it was a horrible bill but later amendments improved it from horrible to just bad - a poorly drafted bill cutting back on private property ownership rights. AB 3182 would restrict the ability of homeowners in an HOA to vote to prohibit or limit rentals. The bill proposes to make several amendments to current Civil Code Section 4740 –the section which was enacted in 2012 to “grandfather,” or exempt, current owners from prohibitions on leasing of HOA residences. The bill would remove the current grandfathering and make several other changes regarding rentals in HOAs. Rental bans or limits are normally imposed by HOAs after they are voted upon by the homeowners within the community when they amend their CC&Rs, the contract binding them together. AB 3182 would make rental bans illegal, regardless of how the owners vote to operate their community. Associations choose

to adopt rental restrictions for many reasons. The most common reason is to preserve a higher quality of resident, based upon the belief that owners will take more pride in their home and will behave better than tenants. Another common reason is availability of FHA and FNMA-backed mortgages as FHA and FNMA will not allow HOA rentals to exceed a certain maximum amount. AB 3182 would outlaw any restriction which prohibits, effectively prohibits, or unreasonably restricts HOA rentals. Short-term rentals (under 31 days) could still be banned, and HOAs are permitted to have a rental maximum of 25%. One of the bill’s oddities is that HOAs could have a HIGHER (more liberal) rental maximum if they could justify it as necessary for loans or insurance, but how can the HOA show the need for more rentals in its community? So, HOAs desiring more liberal rental maximums might not be allowed to have them. The issue of “unreasonably restricting” rentals is a vague standard which could lead to litigation between homeowners and their HOA, since the definition of “reasonable” in this context is not obvious to all. HOAs often impose August 5, 2020

many restrictions on rentals – such as one year waiting periods, or requiring tenants promise to obey the rules, or one-year minimum lease terms. Are these requirements “unreasonable restrictions”? Another troubling aspect of the law is that it specifically also protects the right to rent Accessory Dwelling Units (sometimes called “granny flats”) or junior ADU’s and excludes them from any rental maximum. Since under this proposed law the ADU’s are not considered part of the “separate interest,” the landlord of the ADU would not be required by 4740(e) to inform the HOA of the tenant’s name and contact information. As with last year’s SB323, AB3182 is another piece of legislation which does not reflect the complexities of the existing law and disrespects the right of homeowners to manage their own

communities as they see fit. Why do Legislators not seek input from the organizations which educate HOAs, such as Community Associations Institute, or ECHO, before tinkering with HOA law? AB3182 passed the Assembly on June 11 with a substantial number of “no” votes. The bill is now in the state Senate, in the committee stage. Brain Cancer Survivor Speaks Out on Mask-Wearing

He says the experience has deeply affected how he views maskwearing and its role in curbing

the spread of coronavirus. Smith, who is currently undergoing radiation and chemotherapy treatments, said he now faces a higher risk from COVID-19 since he is immuno-compromised. But, he said, you’d never know by looking at him.

“I appear as an otherwise very able-bodied, younger to middle-age male,” Smith said. “So a lot of times, you’re just not aware, you don’t know who you could be around that could be affected by COVID. And it’s just why it’s all the more important for us to look August 5, 2020

past ourselves and realize that we’re all in this together.” Research has indicated masks also reduce the wearer’s chances of contracting the virus by as much as 65%. To date, more than 31,000 Kentuckians have tested positive for COVID-19, and more than 740 have died. President of the Kentucky Medical Association Dr. Brent Wright said there’s growing evidence that people without symptoms are unknowingly passing the virus to others. “Before people show symptoms, the virus load of COVID-19 is the highest,” Wright said. “Which means they don’t appear sick, and if they don’t wear a mask, they’re talking to others and they’re spreading that virus to them.” One study of a COVID-19 outbreak in an Italian town found around 40% of people that tested positive were asymptomatic. Ben Chandler, CEO of the Foundation for a Healthy

Kentucky, said the “Wear It for Me” campaign, launched this month, urges all Kentuckians to wear a mask in indoor spaces and when they can’t maintain a six-foot distance from others. His organization, the Kentucky Medical Association and Kentucky Foundation for Medical Care collaborated on the campaign. “It’s extremely important for people to understand that this thing is very far from over and that it has great danger to a whole lot of people,” Chandler said. “We can get back to normal quicker only if we wear our masks and only if we pay attention to social distancing.” Data from the Kaiser Family Foundation show more than 40% of adults in Kentucky under age 65 are at higher risk of serious coronavirus complications due to underlying health conditions, such as diabetes, obesity, kidney and lung disease and a weakened immune system. Voters can visit FVAP. gov to find state-by-state official registration and ballot

65th Birthday Brings Key Decisions Regarding Health Care

By Desert Star Staff Your 65th birthday is an important milestone. That’s when you become eligible for the federal Medicare health insurance program. Medicare is a popular, affordable health insurance program for Americans 65 and older, and those under 65 with certain disabilities, providing hospital coverage (Part A) and physician visits (Part B) to those who qualify. But it can be complicated. To decide what coverage is best for you, take inventory of your current and future health, work and economic standing, including your personal preferences and goals. Here are a few tips to consider from Cigna, which serves hundreds of thousands of Medicare customers nationwide. 1. Timing is important! Medicare has a seven-month window around your 65th birthday called the Initial Enrollment Period. It begins three months before your 65th birthday and extends three months past your birthday month. Enrolling outside this window could result in higher premiums on Medicare Part B for the rest of your life. If you’re still working, your path forward depends on the size of your company. If you work for a company with fewer than 20 employees, generally, you must sign up for Medicare at 65. Cross-Bore: What Every Homeowner Should Know By Desert Star Staff In the midst of the coronavirus pandemic, learning about cross-bore is important, as certain lifestyle changes you may have made over the past few months could turn an existing cross-bore condition into a potentially dangerous situation. Fortunately, unlike many items on your list of concerns these days, cross-bore is something that you can do something about besides just worry. So, what is a “cross-bore” is and why is it important for you to know about it? Simply put, a “cross-bore” is the unintended intersection of two utility lines. This article is concerned specifically with natural gas utility and unpressurized sanitary sewer lines, both of which you likely have on your property. An “unintended intersection,” means the penetration of a sanitary sewer line by a gas utility line. According to the Cross Bore Safety Association, this is not an uncommon condition and, although statistics vary, some estimates suggest that it occurs at an average rate of 0.4 crossbores per mile of sewer line. So how does it happen? Cross-bores most frequently occur in association with “trenchless” methods of utility line installation. In other words, it involves installing a utility line without digging up the ground. The reasons for doing this typically involve minimizing surface disruption, increasing the speed of installation, and reducing costs. The downside to this method is that historically, installers have not been able see when the installed utility line penetrates a sanitary sewer line. The immediate result is typically uneventful, until the affected sewer line becomes blocked. As far back as 1976, there have been documented incidents of attempts to clear blocked sewer lines where there is an undiscovered cross-bore. The resulting rupture of the intersecting gas utility line by some mechanical device, like a root-cutter, allows gas to enter a home through the sewer where it is accidentally ignited, causing an explosion. As the existence of cross-bores has become better understood, steps are being taken to eliminate existing cross-bores, and to prevent them from occurring at all. Still, many “legacy” cross-bores remain. If you’ve been wondering what all of this has to do with the coronavirus pandemic and home quarantine, it’s this: More people at home for more hours means more sanitary sewer use, and the scarcity of toilet paper means more people using alternative materials that are

not designed to degrade in a sanitary sewer environment. The inevitable result? More blocked sewer lines. According to experts, here’s the part where you can make a difference – one that can actually save lives. First, be mindful to put only toilet paper into the sewer.
