I encourage younger clients to start by looking at the “Big Picture” of how we spend our lifetime income,… and by examining the average expenditures, they come to realize that by cutting taxes and money paid on interest, and avoid frivolous spending, we can design a plan which aligns us of how to live debt-free.

Financial Freedom will overcome many of the problems that families have Today. How one manages their portfolio to stay out of Debt struggles will determine the lifestyle ahead. In Today’s world, we are challenged to spend at every turn we meet. We have become victims of being preyed upon constantly, to buy, buy, buy.

Both younger generations and even younger Gen Z anticipate that 401(k) or IRA assets will be their primary funding source in retirement, contributing around 40% or 45%.

But the ability of all three groups to save for retirement will be hampered by the amount of debt they hold.

Sixty-seven percent of workers paying student loans say this burden is an obstacle to saving for retirement, and 31% of millennials, along with about 25% of Generation X and Generation Z members, say they have an “unmanageable” amount of debt. We must teach our children how to

manage their money and determine what type of return they will get from spending and investing. (Risk VS. Reward!)

What these and all other workers need is a “planning mindset” to save enough for retirement. Parents must emphasize the importance of Financial Peace of Mind to help their children’s future.

Only 35% of workers have adopted a planning mindset.

Still, those who have been near twice as confident they will ultimately save enough for retirement, 2.5 times more likely to have a strong sense of control over their debt situation and five times more likely to have a plan for handling the unexpected.

There are emotional benefits as well to that way of thinking. People who have adopted a planning mindset

are happier than those who have not, more comfortable talking with a spouse about financial matters and far less likely to be divorced.

When people have a planning mindset, extraordinary things happen.

They win more often! Baby boomers have tried to give their children what they did not have growing up. In doing so, we have created adults who feel a sense of entitlement when spending. Helping them to understand the benefits of Financial Freedom is the greatest gift we can give them.

Although those retirees Today feel more comfortable with their retirement, on the negative side, many workers expect to remain in debt throughout their lives: 52% of millennials, 43% of Gen Xers and 34% of boomers.

Debt is a problem across all generations and a tough challenge. Many people struggle to choose between investing money or paying down debt, but it’s never too early to start saving for retirement.

It’s a crucial issue for all generations, and eight out of 10 workers believe retirement policy should be a top priority for all presidential candidates.

Our CC&Rs Expired; Ours Has No Name!

By Kelly G. Richardson, Esq. CCAL Kelly, do you have any information regarding the expiration of CC&Rs? I’ve heard 20 years from the time of the recorded filing of the CC&Rs. My subdivision development of homes has no common areas but does have an HOA. The CC&Rs don’t show up in the San Mateo county recorder system. I need to confirm whether the HOA should have renewed and recorded the revitalization of the CC&Rs as they are over 30 years old.

Any information would be appreciated. O.M., South San Francisco

Dear O.M.: Unless the CC&Rs were recorded on the property they do not automatically bind all owners, so some title research help may be needed.

The recording information on CC&Rs should be reflected on title insurance policies as a coverage exception, so you may find information that way.

In past decades,

developers filed CC&Rs with expiration dates.

However, CC&Rs in recent years normally do not have expiration dates, or included automatic renewal.

Associations with expired CC&Rs do not fall under the Davis-Stirling Act, because Civil Code Section 4200(a) requires, among other things, a recorded declaration for the Act to apply. This can be a calamity for larger communities, since reinstating the CC&Rs requires the consent of all members and mortgage holders. Research is needed to determine if the CC&Rs were ever recorded (filed with the County Registrar-Recorder). If the CC&Rs have not expired, take the necessary steps to amend the document and delete the expiration date. If the document has expired, legal help will be needed to explore the available options.

All HOAs, and particularly HOAs older than 30 years, should note whether their CC&Rs ever expire.

I am on the board of a small HOA. I am new to this so I truly appreciate and learn so much from your column.

We are having a slight existential crisis because our Articles of Incorporation state our HOA name but the CC&Rs do not mention the name at all. So, our board is confused if the HOA only exists to care for the common area or if we are to uphold the CC&Rs even though we have no document linking the two. I assume that the two are linked but some of my colleagues need more explicit proof.

N.P., Placentia Dear N.P.: When creating new HOAs, developers file Articles of Incorporation with the State separately from filing the CC&Rs with the county Registrar-Recorder.

The Articles document the creation of a new legal entity, a corporation, to be the HOA. An attorney should review your HOA documents.

The CC&Rs contain a legal description of the property contained in the association project and apply to all

properties contained in that description. Also, a lawyer or paralegal can retrieve your association’s subdivision map or condominium plan (a public document filed with the Registrar-Recorder) to confirm which lots are within the subdivision and then which lots are owned by the HOA. Hopefully the ownership of common lots will reflect the HOA name as listed in the Articles of Incorporation.

Since your HOA is small, it should be easier to amend the CC&Rs to identify the name of the association. That requires a vote of all your members, which is usually easier in smaller associations.

Kids’ Eye Health at Risk During Pandemic

By Desert Star Staff Remote learning during the pandemic has meant excessive screen time for children. A Maryland health care group is raising awareness to prevent too much exposure to potentially damaging blue light.

The light emitted from digital devices can cause severe retinal damage in children with long-term exposure.

According to Scott Edmonds, the chief eye-care officer for UnitedHealthcare, children’s eyes are still developing, and more blue light enters their retinas than adults’ eyes. It can also cause digital eyestrain, headaches and blurred vision.

In addition to taking breaks, Edmonds suggested teaching kids to follow what he calls the “20-20 Rule” to protect their eyes.

“Every 20 minutes, you should look off into the distance, at something 20 feet or further, for 20 seconds,” said Edmonds. “So, breaking

up your screen time every 20 minutes lessens the chance you’re going to get myopia, gets you away from the blue light, and it lets all your eye elements relax and will minimize the digital eyestrain.”

He added it’s important not to sit too close to the screen, keeping about 30 inches away.

Marylanders with United Healthcare vision coverage can also add a student eye protection option to their insurance plan to get special glasses that block blue light.

Another eye issue to look out for from excessive screen time is nearsightedness.

Edmonds pointed out that myopia among children and adults has increased dramatically with the introduction of computers and other digital devices that require sitting close to a screen for extended periods.

“Back in the 70s, when we started to track this kind of data, it was about 25% of the population was nearsighted in

Biden Orders Quick Action on Hunger

By Desert Star Staff Many New Yorkers receiving SNAP and Pandemic EBT will soon get increases in their benefits.

An estimated 29 million adults and at least eight million children nationwide are experiencing food insecurity because of the pandemic.

On Friday, President Joe Biden signed an executive order directing the Agriculture Department to allow states to increase SNAP benefits to the lowest-income recipients. And to raise emergency benefits for families whose children would typically be getting free meals at school by 15%.

Joel Berg, CEO of Hunger Free America, said the order should benefit at least three million New Yorkers.

“This is the boldest, biggest administrative step to fight hunger that any administration has taken, really, in the modern era, at least since the Great Society program,” Berg contended.

The White House said a 15% increase in Pandemic EBT benefits could give a family of three about $105 more to buy food over two months.

The order could mean a 15% to 20% increase in SNAP benefits to about 12 million of the lowest-income recipients.

Berg predicted the overall impact of the increased benefits will be huge.

“This is going to benefit tens of millions of American families and be billions of dollars extra food - and maybe even tens of billions of dollars of extra food - when this all works out,” Berg explained.

The president will also ask Congress for a $1.9 trillion COVID-relief package, including other kinds of direct aid for people who have lost jobs in the pandemic.

But a large relief bill will take time to negotiate and get through both the U.S. House and Senate.

Biden Eviction Moratorium Called “Good Start”

By Desert Star Staff As an estimated 230,000 Pennsylvania families face a possible eviction, civil-rights advocates say President Joe Biden’s executive order extending the moratorium on evictions is a good start - but Congress could do more to protect tenants who have fallen behind on rent because of the pandemic.

The moratorium was set to expire at the end of this month on evictions from federally

assisted or financed properties and foreclosures on federally guaranteed mortgages. But the executive order extends it through the end of March.

Ian Thompson, the senior legislative representative with the American Civil Liberties Union, said it needs to be expanded to cover all tenants and the COVID pandemic duration.

“We also need requirements put in place on landlords to make sure they are

not violating these important protections,” said Thompson.

He added that Congress needs to have emergency rental assistance in place before the moratorium is lifted.

Some landlords have already challenged the constitutionality of the federal moratorium in court.

Thompson pointed out that, each passing month, millions of tenants nationwide are falling further behind on their rent.

“Unless there is emergency rental assistance funding in place, all we are doing is kicking the can down the road for when this mass eviction crisis is going to hit,” said Thompson.

He said he thinks the federal government also should provide funding to help cities and states give renters facing eviction the right to be represented by legal counsel in court.

Overcoming Special Challenges to Get Food to Rural Kids

By Desert Star Staff Hunger is on the rise across the country because of the pandemic, and it can be tough to get food to children living in rural areas.

In Washington state, hunger is up at least 5% in every county.

The nonprofit Save the Children has helped distribute 600,000 meals to kids in rural parts of the state.

Amee Barlet, Washington state deputy director of programs for the group, said Save the Children also helped the Lake Quinault School District, a large district on the Olympic peninsula, purchase a van and truck to get to hard-to-reach families.

“They have families that live down logging roads, and they’re able to deliver food directly to those families’ doorsteps,” Barlet explained. “Those families probably otherwise

would not be able to receive the meals. They might not be able to get to the school.”

Barlet noted transportation is a barrier for many families.

Save the Children has provided $250,000 to nutrition programs in the state, assisting its partners and school districts.

Tamara Sandberg, U.S. advisor for food security and nutrition for the group, said widespread school closures have affected many children, mostly the 30 million who rely on free or reduced-priced meals.

She added hunger due to COVID-19 is worse and more pervasive in rural America.

“We’re very concerned,” Sandberg stated. “This is a generation that is missing out on the nourishment that they need to grow and thrive. Kids cannot be hungry for knowledge when they’re hungry for food.”

NAMM’s Believe in Music Week recap

NAMM is a worldwide community of companies that manufacture, distribute and/or retail musical instruments and products. For decades NAMM — whose headquarters are in Carlsbad, CA — has staged its highly-anticipated winter show in Southern California every January. The annual event attracts more than 100,000 visitors annually, with attendees coming from more than 100 nations across the globe.

However, with the continuing challenges related to the COVID-19 health crisis, it was impossible for The NAMM Show to be staged in Anaheim earlier this month.

However, rather than remain silent this month, NAMM staged its new virtual event Believe in Music Week, Jan. 18-22, 2021. The event offered more than 80 hours of content including the debut of new products, live performances and educational sessions.

I was able to enjoy much of the content which was provided online from the comfort and safety of my home.

A highlight of the event was the 9th Annual She Rocks Awards which recognized the growing role that women play in the music industry — including as composers and performers, as well as in the manufacturing and recording part of the music industry. Among the welldeserving honorees this year were groundbreaking band the Go-Go’s, singer-songwriterguitarist Nancy Wilson (of Heart), Evanescence front woman Amy Lee, Cherie Currie (lead singer of The Runaways) drummer Cindy Blackman Santana, comedian Margaret

Vallarta Supermarkets to Help Raise Funds for Teletonusa

By Desert Star Staff SYLMAR, CA—Vallarta Supermarkets has partnered with Children’s Rehabilitation Institute TeletonUSA (TeletonUSA) to raise funds supporting TeletonUSA’s work, which provides care to children with neurological, muscular, and skeletal disabilities. In mid-December of last year, TeletonUSA hosted its fundraiser on Univision, raising over 6 million dollars from viewers.

Vallarta, one of the largest Latino-owned supermarket chains in California, hopes to help grow that number by supplying its stores as TeletonUSA donation centers.

As of January 4th, instore donations are being accepted, and supermarket patrons will be able to support TeletonUSA’s cause until January 17th. Patrons can donate at all 52 Vallarta locations—locations spanning southern and central California.
