Under the business judgment rule, the board should be taking action which is in good faith, in the best interests of the association as a whole and upon reasonably diligent inquiry. There is little guidance in published appellate case law on this question. The 2000 case cited frequently by some attorneys, Finley v. Superior Court, does not address the issue. In Finley, a large senior community HOA in South Orange County donated money to fight the proposed El Toro airport, and a homeowner sued, arguing the donation was “ultra vires” or outside the power of the board. Yellen Testimony more Alarming than Calming

nonexistent for way too long and has actually declined when you consider how many full-time jobs no longer exist having been replaced with part-time workers. The truth is the Federal Reserve can’t do a lot to help with labor issues. Keeping interest rates low might help but there are other greater risks if we continue to do that. It would be refreshing to hear the Chairman challenge the legislative and executive branches of the government to take real steps to create more jobs. The QE stimulus will end in October of this year. That’s $1 trillion that could be shifted to creating jobs. Corporations are sitting on record levels of cash today, and they have no incentive to spend any of that money other than repurchase huge amounts of their stock to artificially boost their financial statements. Give tax credits for creating jobs, building plants, etc. Lower the corporate tax rate. Establish a one-time, lower tax program to get companies to repatriate foreign dollars back to the US but ONLY if that money is put to work in these areas. It’s so disingenuous to listen to Congressmen question the Fed Chair about jobs when they are the ones who are doing very little to address the problem.

By Kevin Powell Last week Fed Chairman Janet Yellen testified before Congress. After sitting through her entire testimony, I couldn’t help but feel her remarks were somewhat muted. She continued to insist that while the economy improves, it is still too fragile to pull away all forms of support. She briefly spoke about the shocking 2.9% decline in GDP in the first quarter. She dismissed it

to “unusual conditions in many sectors.” Others have said it was totally weather related, but that’s a bigger “snow job” than the white stuff that was actually on the ground. Personal consumption was said to be a driving factor yet it grew by 0.7%. Government spending was up. Neither declined as the headlines would like for us to believe. Chairman Yellen talked at length about the unemployment

situation and how concerning it was. She confirmed that nearly 40% of employable Americans are not working for one reason or another. That is called the participation rate, and it hasn’t been this bad since Jimmy Carter graced the White House. She also stated that the participation rate could come down as unemployment continues to decline. However, her own data doesn’t support

that belief. Unemployment has fallen from a high of 10% in 2009 to 6.1% today. Yet we have not seen a 40% decline in the participation rate. Could A Pill Reverse The Aging Process? by Art Kunkin Mr. Life Extension Age reversal may seem impossible now but Dr. David Sinclair, a Professor of Genetics at Harvard Medical School, is working to make it a reality. Sinclair, who is listed among Time Magazine’s 100 Most Influential People of 2014, has already identified a chemical that may reverse the aging process. Increasing the levels of that chemical in humans could change the way we live and age. Dr. Sinclair speaks very clearly and concisely about his remarkable research. Therefore, what follows are Dr. Sinclair’s words as actually spoken in interviews recently published on the Internet. Unfortunately, I was not able to personally interview Dr. Sinclair. What is Nicotinamide adenine dinucleotide (NAD) and why do we need to study it? NAD is a chemical found in every living organism and is essential for life. Recently, scientists have discovered that our bodies also use NAD to turn on our defenses against aging. When we exercise or diet, NAD levels go up and we become healthier. The problem is that as we age, our body makes less and less NAD. We need to find ways to boost it up again. How do you envision the type of medications or treatments that will be available to fight aging? As we get better at reversing aging it will be possible to take one medicine, and within weeks feel and even look younger. Imagine going to a doctor to get a pill for diabetes and this same medicine will prevent heart disease, Alzheimer’s, cancer, and

When I started in the field, aging research was the backwater of biology. The idea that you could find a molecule that would prevent many diseases at once was considered impossible. Then, in the 1990s, labs around the world discovered single genes that control the aging process. It made it possible to imagine a drug that could turn on the body’s defenses against aging and slow down many diseases at once. The research became respectable and began to be published in the world’s leading scientific journals. It is no longer embarrassing for scientists to say they work on aging. You’ve also looked into the anti-aging effects of resveratrol, the antioxidant found in red wine. What did you discover? We d i s c o v e re d t h a t resveratrol activates a very special enzyme in the body called SIRT1 that protects us from diseases of aging and controls how fast we age. Resveratrol turns on our body’s genetic defenses against diseases and aging itself. We are now working on molecules that are 1000 times more effective than resveratrol at turning on SIRT1. What would a world in which humans live much longer be like? It will be a world that will look back on today the way we look back at the days before antibiotics. It will be a world where we do not have to worry about getting cancer in our 50s and 60s or getting Alzheimer’s in our 70s and 80s. We will be able to play tennis with our great grand kids and will be productive members of society until the very end, perhaps around 100 or older. It will be a world where people will not spend ten years of their lives in a nursing home. This will be a much more productive and richer society to live in. Retirement will have to occur later in life, perhaps 75 or 80. But then you can look

As you continue your research about age reversal, what are you looking to discover? We are looking for new molecules that are more potent than the ones we’ve previously discovered. We are excited about molecules that raise NAD levels. We recently showed that raising NAD levels in mice can reverse aspects of aging within just one week of treatment. How much more do we know about aging than we did when you first entered the field? We’ve gone through a paradigm shift in our understanding. When I first started, we thought we aged just like a car—things just wore out and then we died. Now we know we have inbuilt mechanics to take care of our bodies that we will one day be able to keep active through a simple pill. When I started in the field, I did not believe that I would see medicines that slow aging become a reality in my lifetime. Now I’m sure that I will. Man Accused of Enslaving Woman to be Sentenced

CLEVELAND (AP) - A man accused of enslaving a mentally disabled woman in northeast Ohio is scheduled to be sentenced in federal court in Youngstown. A jury in March found Jordie Callahan, 27, guilty of forced labor, conspiracy to defraud the U.S. and a drug charge. His sentencing is Tuesday. Prosecutors contend that Callahan and his girlfriend repeatedly injured the woman so she would have to seek treatment and that they would then take any painkillers she’d be prescribed. They also allowed their juvenile sons to physically abuse the woman and her young daughter, prosecutors alleged. That jury found the girlfriend, 31-year-old Jessica Hunt, guilty of the same three charges. She is expected to be sentenced Thursday. Prosecutors presented evidence at trial that Callahan and Hunt, who lived about 67 miles southwest of Cleveland

in Ashland, threatened to harm the woman’s daughter if the woman did not obey them. It was alleged that the couple at one point made the woman and child sleep in a damp, dark basement with no mattress or access to a bathroom and would make the woman shop, cook, do chores and clean up after their pit bull dogs. Prosecutors have asked Judge Benita Pearson to sentence Callahan and Hunt to life in prison. Callahan’s and Hunt’s attorneys continue to fight for a new trial. They have questioned the credibility of the government’s witnesses, including the alleged victim, and have argued that the woman left the house nearly every day, including trips to a convenience store and to social service agencies. Idyllwild Remembers Mountain Fire By Angela Monroe IDYLLWILD -- The city of Idyllwild is celebrating the city’s return from the Mountain Fire. The Mountain Fire ignited July 15th, 2013, and forced the entire city to evacuate. No homes were lost in Idyllwild. Sunday, they held a celebration at the fire station. One year after the quiet mountain town of Idyllwild was rocked by wildfires. They are celebrating being a year of being back, and a newly renovated fire station made possible all through donations. Idyllwild Chief Patrick Reitz says that the town was saved through the efforts of many, and it is important to remain cognizant of the dangers of wild fires.

Sheila Zacker, a realtor and Idyllwild resident, volunteered her efforts at the fire station last year answering phones and doing whatever she could help. After seeing how the thirty-year-old building had deteriorated will little to no upgrades throughout the years, Sheila enlisted the help of volunteers who wanted to show their appreciation. After raising over 2,800 dollars and countless donations of supplies, time, and effort, after a year of hard work, the station is like new, and the firefighters wanted to show their appreciation. 61 Dogs up for Adoption after House Fire By Angela Monroe RIVERSIDE -- Dozens of dogs are looking for new homes after a fire burned a home near Riverside. Saturday afternoon an

attic fire damaged a home on Pick Place, south of Riverside. Three people were in the home, along with 61 sheepdogs on the property. No people or animals were

hurt, but the American Red Cross was asked to help the three adults. As for the dogs, they were taken to the animal shelter in Jurupa Valley.

Animal services says the owner surrendered the dogs. It was not certain if the owner had been cited recently for having that many dogs on the property. Anyone with more than five dogs would need a kennel permit.

Aviation Program Takes off at SBBCollege Ventura By Desert Star Staff SBBCollege Ventura is meeting growing industry demand for commercial pilots by giving local students the chance to become qualified aviators through its new degree program. The two-year Associate of Science in Aviation program will be offered beginning in the fall and will provide students with the theory and flight time required to earn a total of five aviation licenses: commercial pilot – single engine, commercial pilot – multi engine, private pilot, instrument-rated pilot and certified flight instructor.

The announcement comes in response to a recent industry forecast projecting almost half a million new commercial airline pilots will be required globally in the next 20 years. Matthew Johnston, SBBCollege President, said: “The new program will enable students to earn a wellrounded academic degree while simultaneously learning to fly from experienced, FAAcertified pilots. I am excited for our students to have this opportunity.” Classes will be offered at the SBBCollege campus in

Ventura and at the SBBCollege Aviation Pilot Education Center at Camarillo Airport. The College is partnering with Channel Islands Aviation in Camarillo, an FAA Approved Part 141 Flight School, to provide inflight training. “We are pleased to be offering this program in an effort to help meet the high demand for pilots due to the looming pilot shortage,” added Sarah Bartush, Channel Islands Aviation Flight School Manager. Students must be 18 years or older to enroll, have a high school diploma, GED, or

equivalent, and be able to pass a medical certification from an FAA certified examiner. Traditional educational financing is available to those who qualify.

s p o rt s POWER makes Fifth Straight SCCBL Title Appearance by Daniel marinelli

PALM SPRINGS – After 16 leagues, and 42 games total, the Palm Springs POWER has clinched first place in the Southern California Collegiate Baseball League (SCCBL) and will be headed to the conference championship for the fifth straight year. The new-to-the-league Inland Valley Pirates (25-6 Overall, 12-4 in SCCBL) did exceptionally well in their inaugural season, finishing with an identical league record to the POWER (34-8 Overall, 12-4 in SCCBL). Team San Diego (23-21 Overall, 7-0 in SCCBL) finished in third, rounding out the final playoff spot. By defeating Team San Diego in a one-game playoff on Monday, the scrappy Pirates team advanced to play the POWER in the SCCBL championship series. Unlike previous years, winning the championship will not be a cakewalk for the dynastic POWER. The Pirates were a more than formidable opponent this year. The team that calls Cal Poly Pamona home has a competitive roster, equipped with the pitching needed to win a series against the Palm Springs Stadium residents. The teams split two-game series in 2014, meaning that the SCCBL’s final hurrah should be a dozy. Both POWER losses to Inland Valley came at the hands of pitcher Andrew Alverez (5-0, 1.17 ERA, 30 Ks). In his victories over the POWER, Alverez combined to pitch 16.1 innings, allowed five runs and struck out four. Lengthy ace Morgan Earman (4-1, .88 ERA, 39 Ks) is a sure start in one of the games for the POWER; Brooks Kriske (5-0, 1.75 ERA, 36 Ks) is likely to take to the mound in the other game. A disconcerting fact, however, Alverez already bested Earman earlier this year. Thus, the Pirates’ go-to pitcher will likely be the favorite in whichever game he pitches. Back in June, Kriske won the only game he pitched against the Pirates. Because Alverez will likely face off against Earman, Kriske will be going head-to-head against a lesser pitcher, and will probably to take the game he pitches from the SCCBL second-place finishers.

(Photo by Dan Marinelli) Despite having to face Alverez, the POWER remains confident. “I think we’re going to win out,” Said Mitch Bluman, who got the save in Earman’s victory over the Pirates. “I mean I expect to, there’s no reason not to, were the best team every night we go out there.” If the they defeat the Pirates, the POWER play the winner of the Orange County Collegiate Baseball League championship in the So Cal World Series. The So Cal World Series pairs the winner of the SCCBL On Tuesday, the POWER traveled to Cal Poly Pamona to start the best-of-three championship series with the Pirates. On Wednesday, the POWER and Pirates head back to Palm Springs to conclude the series at Palm Springs Stadium. If the teams split the first two games, a third game will be held at Palm Springs Stadium on Thursday. Wednesday and Thursday’s (if necessary) games start at 7:05 pm. Rebels Release Train with Bodies from Downed Jet By Nicolas Garriga and Nicolae Dumitrache Associated Press HRABOVE, Ukraine (AP) Bowing to international pressure, pro-Moscow separatists released a train packed with bodies and handed over the black boxes from the downed Malaysia Airlines plane, four days after it plunged into rebel-held eastern Ukraine. With body parts decaying in sweltering heat and signs that evidence at the crash site was mishandled, anger in Western capitals has mounted at the rebels and their allies in Moscow. Their reluctant cooperation will soothe mourning families and help investigators, but may do little to reconcile the East-West powers struggling over Ukraine’s future. Russia’s Defense Ministry said Monday it saw no evidence a missile was fired and denied involvement in the downing of Flight 17 - and suggested the Ukrainian military was at fault. President Vladimir Putin spoke out but showed no sign of abandoning the separatists as fighting flared anew near the site of the crash. President Barack Obama accused the rebels of tampering with evidence and insulting victims’ families, warning of new sanctions. Europeans will consider their own sanctions Tuesday.

The bodies of the 298 victims, most from the Netherlands, have become a part of the conflict in Ukraine because they could hold evidence of what brought the plane down on July 17 as it was flying from Amsterdam to Kuala Lumpur. Grief turned to anger as families begged to get the bodies of their loved ones back, while the separatists held on to the remains. “Bodies are just lying there for three days in the hot sun. There are people who have this on their conscience,” said Silene FredrikszHoogzand, whose son, Bryce, and his girlfriend Daisy Oehlers died on their way to a vacation in Bali, in an interview with The Associated Press in the Netherlands. “When I am in my bed at night, I see my son lying on the ground. ... They have to come home, not only those two. Everybody has to come home.” International forensics experts finally gained access to the crash site Monday - an emotional experience for the head of the Dutch National Forensic Investigations Team, Peter Van Vliet. Seeing the wreckage gave him goosebumps, he said. The team stumbled across remains that had not yet been removed and inspected the perished passengers’ luggage.

In Torez, a rebel-held town 15 kilometers (9 miles) from the crash site, inspectors bowed heads and clasped hands before climbing aboard refrigerated train cars holding the collected bodies. Armed rebels surrounded them, while commuters boarded other trains nearby. The smell of decay was overwhelming. Workers wore masks, while passersby twisted their faces in horror at the odor. Temperatures hit 84 degrees F (29 degrees C), and a train engineer told the AP that a power outage had hit the refrigeration system temporarily overnight. The rebels in Torez did not appear too conciliatory as the tense day wore on. They repeatedly tried to block reporters from access to the visiting experts, growing more aggressive throughout. Late Monday, trucks arrived at the Torez station with plastic bags apparently filled with body parts, as well as piles of luggage - suitcases, backpacks, a purse with a Louis Vuitton label. Ukrainian authorities said the total number of bodies recovered was 282. Dutch investigators demanded the separatists transfer the bodies immediately, and the rebels complied after several hours.

With a long whistle and puff of smoke, the train bearing the bodies pulled slowly out of the station. Rebels holding automatic rifles walked alongside as it chugged away, a cluster of children on bicycles looking on. It was headed through troubled territory, its destination not 100 percent clear. Dutch Prime Minister Mark Rutte said the train was heading for the rebel-held city of Donetsk, 50 kilometers (30 miles) west of the crash site, and then on to Kharkiv, site of a crisis center controlled by the Ukrainian government. He said Ukrainian authorities have agreed to let the bodies be transferred from there to the Netherlands for identification, but gave no time frame. Early Tuesday, the rebels handed over both black boxes from Flight 17 to Malaysian investigators in Donetsk. A rebel leader, Alexander Borodai, said the orange-colored flight recorders were being handed over to Malaysian officials on the condition that they would be delivered to experts at the International Civil Aviation Organization. “I can see that the black box is intact even though a little bit damaged, but in a good condition,” Col. On Sunday, the U.S. said there was “powerful” evidence that the rebels had shot down the plane with a Russian surface-

to-air missile, including video of a rocket launcher, one surface-toair missile missing, being driven away from the likely launch site; imagery showing the firing; phone calls claiming credit for the missile strike and phone recordings said to reveal a cover-up at the crash site. The Russian Defense Ministry offered its own evidence Monday, showing photos it said proved that Ukrainian surface-to-air systems were operating in the area before the crash - nine times alone the day the plane was brought down. Russian officials also said they had evidence a Ukrainian Su-25 fighter jet had flown “between 3 to 5 kilometers (2 to 3 miles)” from the Malaysia Airlines jet. “(The plane) is armed with air-to-air R-60 rockets, which can hit a target from a distance of up to 12 kilometers (7 miles) and guaranteed within 5 kilometers (3 miles),” said the chief of Russia’s General staff, Lt. Gen. Andrei Kartopolov. Defense Ministry officials insisted Russia had not given the rebels any surface-to-air missiles - and said they have no evidence that any missiles were launched at all. They asked the U.S. to share any satellite images of the launch. Putin accused others of exploiting the downing of the plane for “mercenary objectives.” He said Kiev authorities had reignited the fighting after a unilateral cease-fire expired without progress on peace talks. At the U.N., the Security Council unanimously adopted a resolution demanding international access to the crash site and an end to military activities around the area, following intense pressure on a reluctant Russia to support the measure. Fighting in eastern Ukraine began in mid-April after Russia annexed Ukraine’s southern Crimean Peninsula a month earlier. Battles erupted again Monday between the separatists and government troops in Donetsk, according to city authorities. An AP reporter heard several explosions and saw smoke rising from the direction of the city airport.
