Desert Ensemble Theatre Announces Move To Palm Springs Cultural Center By Desert Star Staff Desert Ensemble Theatre will take up residence at the Palm Springs Cultural Center when it returns from lockdown in October with its 11th season. In its most ambitious season, the company will

expand from four to five productions and work in partnership with the Cultural Center to reach an even greater audience. Season subscription packages are now on sale at DET’s website, desertensembletheatre.org.

DET Executive Director Shawn Abramowitz and Artistic Director Jerome Elliott announced the move. Abramowitz stated: “We have had many wonderful years at the Palm Springs Woman’s Club, and we thank them

for their partnership. The Palm Springs Cultural Center brings new and exciting possibilities to our theatre company and our community. We look forward to getting back into the theatre and creating art.”

Hearings regarding member discipline (Civil Code Section 4935(a)) or regarding requiring a member to reimburse the HOA for common area damage (Civil Code Section 5855(b)). These statutes allow a member to request closed session for such hearings, but boards should routinely hold such hearings in closed sessions without waiting for a request. Closed sessions avoid embarrassing the member involved. 4. Personnel matters. Managers are not “personnel” unless the manager receives their paycheck directly from the HOA. Vendors are not “personnel,” nor are directors or committee members. If someone is paid directly by the association as an employee, they are “personnel,” and discussions regarding them must be confidential to protect their privacy.

5. Meeting with members regarding their proposed delinquent assessment repayment. Closed discussions protect the member from the revelation of personally embarrassing information. 6. Votes to start foreclosure on a delinquent owner’s property. It is not clear to me why the statute requires a lien vote in open session but the foreclosure vote (the next step) in closed session. Nevertheless, Civil Code 4935(d) requires foreclosure votes in closed session and then (as all action items) noted generally in the minutes of the NEXT open session meeting. One other topic may be best handled in closed session, even though the Open Meeting Act does not specifically authorize it. California Fair Housing Regulation 12176(b) requires that matters regarding resident requests for accommodation of a disability to be kept confidential. If the HOA obeys the Open Meeting Act, the

board will violate this regulation (and could be sued or subject to DFEH discipline). Boards may wish to consult their legal counsel regarding how to address this conflict. I have alerted Kevin Kish, Director of California’s Department of Fair Employment and Housing, and hope this regulation can be adjusted soon to resolve the current conflict with board responsibilities under the Open Meeting Act. Avoid overuse of the closed session function, which should be used sparingly, because misuse will create distrust in the board and ultimately harm community cohesion. Kelly G. The American Chemical Society stated that a dozen are already in critical shortages, and 30 elements could go in short supply by the end of the century. Even though the governments are all printing up money like crazy, little of that money goes to commodities. Most commodities are not being sold at the price of production, making them very cheap. By Desert Star Staff The issue of transgender athletes in sports has been a divisive one - and again hit the headlines after thousands of sports fans signed a petition in opposition to transgender weightlifter Laurel Hubbard’s Olympics participation. Hubbard, 43, was selected to represent New Zealand in this summer’s Olympic Games in Tokyo and is slated to become the world’s first transgender athlete to compete at the highest level of the sport some nine years after Hubbard transitioned from male to female in 2012 at the age of 35. Before that, Hubbard had competed and trained in male weightlifting since a teenager. However, the move has drawn scorn online, particularly amid claims that Hubbard’s performances as a male before their transition fell below the general standards for Olympic qualification - but has since become one of the top female weightlifters in New Zealand. An online petition in opposition to Hubbard’s upcoming Olympic appearance, though, has garnered almost 22,000 signatures as of Monday afternoon. They claim that the rules that currently allow Hubbard to compete namely the fact that Hubbard identifies as a woman and has testosterone levels below the acceptable amount - are unfair to similar athletes born female. “This completely ignores the physical advantages in speed, height, stamina and strength that a malewww.desertstarweekly.com

You Don’t Need to Be ‘High-Risk’ to Contract Hepatitis A By Desert Star Staff It was August of 2019 when cabaret performer and New Jersey native, Angela Frost, found her summer sidelined by hepatitis A. About a week after she and a group of friends dined out together, she started to feel sick. Her symptoms began like the flu—body aches, loss of appetite, nausea—and then she developed jaundice. “I remember going to work and my boss saying, ‘You look yellow,” Frost recalls. “I knew jaundice was a sign of a liver issue and my friend had just tested positive for hepatitis A, so I went to the doctor.” Frost’s doctor was hesitant to test her for hepatitis A because she was at low risk for the disease. Frost was insistent, and eventually got tested. Her test results came back positive—she had hepatitis A. Four of Frost’s friends would ultimately test positive, including

her boyfriend, who almost needed a liver transplant. Frost was so sick she could not work for two weeks and her jaundice remained for a month. World Hepatitis Day is July 28 and a good opportunity to learn more about hepatitis A, a highly infectious virus that affects the liver and can lead to sickness, hospitalization and even death, in some cases. Anyone can be at risk for hepatitis A, as it can be spread person-to-person or through contaminated food or drink. The best protection against hepatitis A is vaccination. “I couldn’t believe it,” Frost said. “Before this happened, I wasn’t even sure what hepatitis A was, that you could get it from food, or that vaccination was available to help prevent it. I hope that more people can become aware that hepatitis A isn’t just a disease that travelers, or people who

are ‘high risk’ can get.” Since 2016, there has been a multi-state outbreak of hepatitis A, with over 39,000 cases reported. Less than 15% of US adults have received even one dose of hepatitis A vaccination, according to the Department of Health and Human Services. “After what I went through, I started telling everyone I met about hepatitis A vaccination— from friends in my kickboxing class to strangers at the gas station—it’s so important to me to help others prevent this experience. ‘Rules are rules’: Biden wades into US sprinter’s cannabis ban By Desert Star Staff President Joe Biden sided with the US Anti-Doping Agency, which suspended rising US sprint star Sha’Carri Richardson for one month after testing positive for marijuana. However, he said he’s proud of how she handled the situation. Asked whether Richardson’s ban, which will likely cost her a spot in the women’s 100-meter event at the Tokyo Olympics, was fair, Biden said: “The rules are rules.” “Whether they should remain the rules is a different issue, but the rules are the rules,” Biden said while praising Richardson, who admitted she had used marijuana to cope with the death of her mother, for the way she responded. The 21-year-old clocked 10.86 seconds as she dominated the 100m race in the US Olympic trials in Oregon last month. However, after her test for marijuana – a banned substance under the World Anti-Doping Association (WADA) rules – returned positive earlier this week, her sizzling qualification result was nullified. Richardson agreed to receive counseling and was given a 30-day ban effective from June 28. The ban expires before the 100m event is set to occur on July 30 and before the start of the women’s 4×100 relay. However, with Richardson’s result at the trial run removed from the protocol, her spot will likely be taken by the 4th place finisher since the first three athletes automatically qualify for the Games. Richardson can still compete in the relay. Speaking to NBC on Friday, she said she would be grateful if Team USA

hand-picks her for the relay, but typically it’s the qualifying runners who make the team. Commenting on the ban, Richardson said she was in a state of emotional turmoil when she resorted to marijuana to deal with the loss of her biological mother. The latter died just a week before the trial. Richardson said that what made matters worse is that she found out about her mother’s passing from a reporter. Richardson’s suspension weeks before the Olympics not only sent shockwaves across the US sporting community but prompted bipartisan criticism and even accusations of systemic racism. Democratic Representatives Alexandria Ocasio-Cortez and Jamie Raskin wrote a letter to USADA and WADA, calling the ban a result of “USADA’s antiquated prohibition on the use of cannabis. “Pointing out that cannabis is not a performanceenhancing drug, the lawmakers argued that the fact WADA does not ban alcohol and other drugs “reflects anti-drug laws and policies that have historically targeted Black and Brown communities while largely condoning drug use in white communities.” Weed-enthusiast and entrepreneur Seth Rogen were even more outspoken in his criticism, tweeting that “The notion that weed is a problematic ‘drug’ is rooted in racism.” He went on to say that it’s “insane” for Team USA to boot Richardson “overthinking that’s rooted in hatred.” “It’s something they should be ashamed of. Also, if weed made you fast, I’d be FloJo,” he said in the post, which quickly went viral.

Fresh anthem scandal hits US sports

Women’s soccer team denies disrespecting WWII veteran by turning away from him

By Desert Star Staff The United States women’s soccer team has denied that it ‘disrespected’ a 98-year-old World War II veteran after some players turned away from him during the national anthem ahead of a match on Monday. A video showed several team members turn away from Pete DuPre, who was playing the national anthem on a harmonica. Facing away from him as he performed the anthem in advance of an Olympics send-off game against Mexico, several other team members, along with the Mexican squad, remained facing forward. National anthem protests have provided very fertile ground for activists throughout much of the last few years. Colin Kaepernick’s decision to ‘take a knee during the anthem ahead of NFL games several years ago being a particularly divisive issue in the US public. Discourse and later bleeding into several other sports across the globe throughout the ‘Black Lives Matter movement. Predictably, the scenes with the US women’s national team attracted heavy criticism online – with news site The Post Millennial writing: “Disgraceful behavior from some members

of the US women’s soccer team as they turn their backs while 98-year-old World War II veteran Pete DuPré played the National Anthem on his harmonica.” However, scrambling to the team’s defense, it was pointed out by the US Soccer Federation that the players in question weren’t attempting to make a social statement by turning away from DuPre’s rendition of the Star-Spangled Banner. But that they had instead turned to face a large United States flag which was being displayed pitchside. “Some of the players were simply looking at the flag flowing on a pole in the stadium in that direction. They were not looking away from Pete as he played the national anthem,” US Soccer Federation chief communications officer Neil Buethe said. For some, though, the damage was done. A stream of abuse was evident on social media, with much of it targeting the socalled ‘disrespectful’ players and prompted United States Soccer to address the claims on social media directly. “Not true,” they wrote. “No one turned their back on WWII Veteran Pete DuPré during tonight’s anthem. Some

USWNT players were simply looking at the flag on a pole at one end of the stadium. The players all love Pete, thanked him individually after the game and signed a ball for him.” This analysis was endorsed by several others on social media who insisted that the players had no intention of disrespecting a war veteran, or indeed the flag or the anthem – but some others weren’t quite so convinced. “This is so petty and small on behalf of the team,” wrote one. “A 98-year-old veteran.

But I’m sure because he’s a Patriot, he must be canceled. These players should renounce their citizenship and play for some other nation. We have Patriots that’d be willing to represent this nation.” “I don’t know what was going through the player’s heads, but it didn’t look like they were protesting to me. The players that turned were looking at the flag. It was odd that some looked at the flag and others didn’t. As players have protested before, they’re not getting

any favors,” said another. “I call Bologna Salami here,” said another of US Soccer’s explanation. “Lots of pictures and actions to show otherwise. Don’t represent a country if you don’t respect it.” The US team won Monday’s game in Connecticut 4-0, thanks to first-half goals from Lindsey Horan, Carli Lloyd, Tobin Heath, and an own goal from Reyna Reyes. The US women’s team is now unbeaten in 44 matches as they head to Tokyo for the Olympics later this month.

something to these veterans, which is, number one, a sense of belonging. And number two, kind of this camaraderie,” Barkhuff explained. “So our goal is to redefine patriotism and to compete with these organizations in their own communities.” He pointed out they aim to show veterans there are other ways to find that sense of belonging. A Homeland Security bulletin obtained by ABC News raised concerns about extremist violence as COVID-19 restrictions ease, and more mass gatherings occur. George Black is a researcher and author of recent reports on the connections between the conspiracy theories that fueled the Capitol insurrection on Jan. 6 and the grievances of right-wing military officers after the Vietnam War. He argued the events at the Capitol were just one part

of a longer-term effort by farright anti-government groups to gain political power. “It’s part and parcel with the movement to suppress voting rights in Republican-led states,” Black observed. “It’s about replacing local officials who are in a position to certify or decertify future elections. So it’s very much with an eye on 2022 and taking Congress back.” Robert Pennoyer, retired Navy lieutenant and 96-yearold World War II veteran noted members of the military take an oath to defend the Constitution, which guarantees a Bill of Rights including freedom of speech and thought. He contended efforts to undermine democratic rights go against the values he fought for. “The disinformation is causing terrible harm,” Pennoyer asserted. “Many of the people believe this stuff. And the attempt to suppress the vote is hazardous and needs to be opposed.” Barkhuff added one thing that connects all veterans of military service. “We took an oath to support and defend the Constitution,” Barkhuff remarked. “It can’t be to winners and losers of the game; it has to be to the rules of the game. Our oath of loyalty is to the Constitution.”

Experts have some tips on getting back into your groove this summer. COVID-19 disrupted everyone’s food and exercise routines, stranded many in front of a screen all day, and led to increased isolation. Dr. Donna O’Shea, chief medical officer of population health with UnitedHealthcare, said the stress led some to overeat and others, especially teens, to develop an eating disorder. “We see both ends of the spectrum,” O’Shea explained. “People who had excess snacking, but we also see that in others the same kind of stress caused them not to eat and to put their health at risk.” She advised it’s important to re-establish routines that

include the basics: good nutrition, regular exercise and sufficient sleep. She recommended using a fitness tracker and getting your steps in a little at a time throughout the day before working up to a goal of 8,000 to 10,000 steps a day. the fitness spectrum are raising money at incredibly high valuations. • Tonal, CLMBR, Tempo, LiteBoxer, and many others have all capitalized on the same fitness-starved COVID-19 market that Peloton could exploit. • Others such as Icon and Echelon have become increasingly litigious in their attempts to unseat the current fitness king. Faulty hardware, corruptible software, supply chain difficulties, and myriad intellectual property issues are reasons to question how much higher Peloton can go from here. What Now? Peloton is still trading above its 50-, 100-, and 200-day moving averages, while price targets for Q4 2021 earnings are tracking ahead of schedule. As a result, the company should quickly post more than $4 billion in revenues this year.

The share price and expected earnings are not an unassailable defense. Margin compression — particularly for a company with the growth trajectory of Peloton — is nothing to trivialize. Any significant damage to the Peloton brand could topple the entire house. Plus, the connected fitness market will never be a winner takes all market. It’s too fragmented, and exercise modalities are too diverse for a “one ring to rule them all” scenario … but Peloton was pretty freaking close. During the height of the pandemic, its name was synonymous with at-home fitness. But when the brand is threatened, customers are flocking back to brick-andmortar gyms, and a cohort of competitors enters the market on what feels like a daily basis, Peloton’s bright future is no longer a promise.

What’s Next for Peloton After a Rocky, Record-Setting Year By Desert Star Staff Peloton expects to close out its fiscal 2021 with $4 billion in revenue on the year — up from $1.83 billion in 2020 and $915 million in 2019. Pretty good trajectory, right? The related fitness company has been a market darling for much of the COVID-19 pandemic as it rides the momentum of a shifting workfrom-home lifestyle in the U.S. Now, the company is looking to outperform in the market as its share price remains high and revenue continues to trend in a positive direction. The only issue? Peloton might be deboarding the growth train. COVID-19 and The Great Repositioning To properly set the table, let’s take a look at year-end figures for Peloton’s fiscal 2020: • Peloton had $1.8 billion in cash at the close of the year ended June 30, 2020. • Q4 of 2020 was, at the time, the largest quarter ever for the company, bringing in $607.1 million in revenue. • Connected fitness subscriptions reached 1.09 million at a 199% yearover-year growth rate. • The number of quarterly workouts grew at a 4x rate to ~77 million workouts, with the average monthly exercises per subscriber increasing 2x to 24.7. The company did so well that during Q3 and Q4 of 2020, they dealt with backlogged orders and had to defer some of their Q4 revenues to 2021 while realizing Q3 gains in Q4. The Peloton was also able to achieve some ridiculous profit margins. Of course, margin expansion isn’t sexy the way

“our subscriber base grew almost 200%” is, but growing at these outlandish rates while not only maintaining but IMPROVING profitability by 280 bps (2.8%) was impressive. In 2020, Peloton checked the box for a high-growth company with margins inching closer to a software-as-a-service company than one making regular consumer durables. The tale of 2021 appears relatively similar. Peloton has beaten earnings estimates every quarter this year so far and grown its revenues at a rate faster than it did in 2020. But, rarely, this type of ride lasts forever. The Bears Have A Case Peloton’s brand is its most important asset. The brand is why Peloton is considered a high-end luxury product. The brand is why Peloton can command prices previously inconceivable for at-home fitness equipment. What happens when that brand is tarnished? In May, Peloton recalled all of its Tread and Tread+ treadmills in the aftermath of several injuries and the death of a child. In June, cybersecurity company McAfee said that hackers could gain direct access to the cameras and microphones of Peloton bikes. In addition, the hackers can add fake apps that look like Netflix and Spotify and steal your login information straight from your Peloton. For the most part, Peloton has been able to rise beyond these blemishes on its record, but specific numbers show that such incidents come with a cost. • The voluntary treadmill recall in Q3 will set the

company back ~$170 million. • The company’s accounts payable increased almost 6x year-over-year to $444 million. Why? The increase in inventories associated with backlogged orders and — you guessed it — faulty treadmills. • Remember when I touted Peloton’s ability to grow while maintaining strong margins? Let’s forget about that. In Q3, the company’s profit margin decreased from 46.9% to 35.2%. Yikes. Stockpiling inventories and an order backlog are acceptable when you have a solid brand to lean on. Still, margin erosion could become a severe problem for Peloton if inventories keep growing and brand affinity further erodes. But Wait! There’s More! You didn’t think we’d get out of here without talking about meme stocks, did you? Peloton stock currently has $2.08 billion of short interest, representing 8.68% of the total float. So essentially, there is present ~$2 billion in the market betting on Peloton to fail. Is that a lot? Short answer: yes. Peloton has the most prominent temporary position in the domestic consumer durables market. Hearing that might make some Redditors want to YOLO their 401k’s into connected fitness long buys, but I’m skeptical. Peloton bears have recently been able to cover their short positions, which appeared a tall task earlier in the year when the company was deep in its growth narrative. The crowded marketplace is a factor, too. • Companies across
