death of George Floyd at the hands of Minneapolis police a week ago today. In short: • Protests raged in Minneapolis over the death of George Floyd, a 46-yearold black man who died after
an officer pinned Floyd’s neck under his knee. • The Hennepin County Attorney announced May 29 that Derek Chauvin, the officer who restrained Floyd, has been charged with murder and manslaughter.
• Investigations into the incident and the other officers involved are ongoing. It’s the latest in a long series of fatal encounters between black men and white police. Gov. Gavin Newsom proclaimed Los Angeles to
2020 Graduates Celebrated in Drive-Up Event
NBC PS-Nico Payne Seniors at Desert Hot Springs High School had the opportunity to walk across the stage in their caps and gowns this morning. All three Coachella Valley districts will be holding drive-up celebrations for grads, but all graduations will be held virtually. After being off-campus for quite some time, grads were able to create a memory on stage Thursday morning at Desert Hot Springs High School. Graduates may not be taking the stage in a normal fashion, but here in Coachella Valley, drive up celebrations have started, and seniors will have an opportunity to put on their cap and gown. “At first, the situation
was really grim, and it looked like the only thing we would be able to do was virtual graduation,” said Caroline Cota, Principal at Desert Hot Springs High School. Then things quickly changed. “It became evident that we’d be able to do some sort of a staged ceremony, we had to come up with a plan that would provide social distancing for our families and try to bring our kids as close as we could to the stadium,” explained Cota. A stage was then set up, and students had the opportunity to take a photo and commemorate their

Desert Jet Announces James McCool has Acquired Sole Ownership By Desert Star Staff Palm Springs, California, – Desert Jet, the premier full-service business aviation company based in Greater Palm Springs, California, announces that James D. McCool, co-owner of Desert Jet Holdings, the parent company of all Desert Jet entities, has acquired sole ownership of the companies from founder and co-owner Denise Wilson. Desert Jet will continue to be led by its Chief Executive Officer, Jared Fox. Desert Jet was founded in 2007 as an aircraft management company by entrepreneur and aviation professional Denise Wilson. The new independent FBO features a
modern terminal, conference rooms, offices, and the only air-conditioned hangar in the Coachella Valley. As McCool became more involved with Desert Jet, he realized the further potential of the businesses, the Thermal airport, and the Coachella Valley and has agreed to purchase the entire company. “I’ve worked closely with the Desert Jet team since 2018 and have seen firsthand the value these companies hold. owners should review: Property Insurance: As with most industries, questions regarding Business Interruption coverage are prevalent. While these claims may not be covered, organizations should still file a claim to put a carrier on notice as courts, and legislative action might change the carriers’ current position on these coverages. With buildings shut down and the property being moved to different locations, nonprofits should also consider vacancy issues and potential exposures from a property at locations not listed on the policy. When the property becomes vacant, many carriers will no longer cover the building or business. Review your exclusions in the contract. General Liability: If your business is vacated, you may wish to switch liability to General Liability Ins. Most businesses have Products and Completed operation Liability, which is more costly. Nonprofit organizations have potential liability exposures for claims that the organization failed to take the necessary steps to safeguard or notify the public. In addition to concerns about exposures to the virus at the insured’s location, there may be exposed if the nonprofit adjust their services to address the pandemic, and those services are not listed on the policy. Directors & Officers Liability: As Directors make challenging decisions, there could be claims that the organization’s assets were not adequately protected. There is the potential for liability claims that management did
not pursue eligible funding under the CARES Act. For organizations relying on grant funding, there could be claims that the financing was jeopardized based on changes in operations due to COVID-19. Workers’ Compensation: As with other industries, there are concerns around workers’ compensation exposures for employees who are being required to work. Nonprofits, however, often rely on volunteers, and, depending on the state, those volunteers might not be covered under the workers’ compensation policy. Workers Compensation costs will be adjusted downward, as the estimated payroll will be decreased. Hired and Non-Owned Auto: As more organizations rely on volunteers, they should consider whether volunteers are covered under their hired and non-owned auto policy. Endorsing current policies to include hired/non-owned auto should be considered by restaurants that are now utilizing delivery options and establishing new ways of performing their operations. Professional Liability and Malpractice: For nonprofits in the health and human services sector, there are concerns around professional liability and malpractice claims resulting from patient exposures, illnesses, and deaths related to COVID-19. Cyber Liability: With many employees working from home, there has been a spike in cyber attacks by criminals attempting to steal information or gain access to online bank accounts. Cybercriminals are
also using social engineering schemes to get money from businesses and individuals. IT and accounting controls should be reviewed to ensure proper processes and security protocols are in place. Event Cancellation: Many nonprofits rely on fundraising events, and some of these events may have had event cancellation policies. While these types of policies written in 2020 may exclude COVID-19, policies written prior to this may contain applicable coverage. In addition, if events will be canceled, Organizations should verify that any bonds or event liability policies are canceled as well to possibly recoup premiums paid As with the for-profit sector, nonprofit organizations have had vast layoffs and furloughs. With these layoffs come exposures related to Employment Practices Liability Insurance (EPLI) claims and coverage during furloughs. Workers employed in human service organizations, such as group homes, drug treatment centers, or mental health facilities, who are still working, are also at a high risk of exposure to COVID-19. Some organizations are expanding their use of telemedicine services to minimize vulnerabilities. Regardless of how they obtain funding, whether from the government, large donors, events, grants, or member donations, almost all nonprofits are being impacted financially by COVID-19. Although the impact is across the board, this is particularly true for organizations such as arts and
cultural venues where donors may shift their donations to other mission-based groups, and more significant donors might cut back. With widespread unemployment and the potential for a substantial economic downturn, the impact of the pandemic will be felt by nonprofits for a considerable amount of time. Employee Benefits: The CARES Act also does not include provisions for health coverage for those losing benefits due to layoffs or benefits cuts, adding concerns about having adequate health insurance to the list of concerns restaurant owners and employees are experiencing. On a positive note, most carriers have relaxed eligibility requirements so that temporarily laid-off employees, furloughed employees, and employees who have had their hours reduced can stay on their company’s benefit plans, as long as premiums continue to be paid. Many small businesses are making an effort to, at minimum, cover these employees through these relaxed eligibility timeframes. Consider adding Life Insurance to your plan if you do not have it. It is inexpensive and is needed by everyone.
By Kelly G. Richardson, Esq. Unfortunately, too many HOA boards overlook or disregard the reserve fund as unnecessary. This is unwise, because the reserve fund is a critical component of the healthy HOA. Don’t fall for the myths. MYTH – Funding is not expressly required by law, so it is less important. California law does not expressly require associations to accumulate money in reserve accounts. However, the law requires that such an account exist, that the board review it monthly, that the association every three years obtain an analysis (“Reserve Study”) of the funds needed, and make detailed disclosures annually to members and to prospective buyers. While state law does not require funding, federal lending guidelines since 2009 do require it. For condominium projects to be eligible for FanniMae or FHA loans, they must confirm that 10% of the
annual budget is deposited into the reserve account. California Realtors® have long been concerned that HOA residence prices were unaffected by the level of the HOA’s reserve funding, despite that logic would dictate that homes in well-funded HOAs should be worth more than in poorly funded HOAs. This led to several new laws sponsored by the California Association of Realtors expanding disclosure requirements, requiring more detailed disclosure of the money it has actually accumulated for each building component (Civil Code 5570) and requiring boards to have a plan regarding how it will accumulate the money recommended by its reserve study (Civil Code 5550(b)(5)). MYTH – We can’t afford it. Many associations suspend reserve fund deposits, based on the belief that this helps hold assessments down and protects the members. However, the project components (roofs, paint, decks, and so on) are steadily deteriorating, and there is a cost accumulating for the HOA
each and every day – there isn’t a bill, but it is a hidden debt being incurred. If money is not set aside, the HOA increasingly falls into debt and endangers the members – and the day will come when the bill “becomes due” and new roofs are needed. MYTH – We should put that money to good use, it isn’t doing any good. I attended a meeting once where a member stood up and said the board was doing a horrible job, because the “reserve money is just sitting there” and should be put to “better use”. However, that money IS being put to good use, by protecting the HOA (and members) from financial hardship. MYTH – We’ll address it all later. Procrastination is easier but can lead to painful outcomes. When major repairs are needed, if the HOA has not accumulated refurbishment funds, it has two choices – ask members to approve a major special assessment, or get a bank loan (officially putting the HOA into long-term debt). If the HOA assumes that it can
always apply for a loan, what happens if the HOA does not qualify and is rejected? State Consumer Warning. In 2012, the Department of Real Estate weighed in, issuing a Consumer Warning on “Underfunded Homeowner Associations”. [Read it at www. dre.ca.gov] It is important reading for those considering buying an HOA residence. Everyone agrees it is a bad idea to live on credit cards, building up debt, so why is it acceptable for the HOA to do the same? Boards must take responsibility and protect their association’s solvency.

5 Ways To Build Trust When Starting A New Remote Job By Desert Star Staff While working remotely has become the norm during the pandemic, starting a new job while working from home brings added challenges – and perhaps extra anxiety for some. The work-from-home dynamic has required some adjusting for managers and employees who previously interacted full-time in an office. But imagine being a new hire – excited, young, and nervous – who’s starting the job from home while trying to make a good early impression on co-workers – and most importantly, on their new boss. “Building relationships with a new boss and colleagues by digital means can certainly make the early transition period tougher for a new employee,” says Bob Slater, co-author with his son, Nick Slater, of Look Out Above! The Young Professional’s Guide to Success. “But it doesn’t have

to be more arduous. There are strategies to help the new employee, even from afar, feel a part of the group quickly and get to know their boss.” Nick Slater says this new normal for new hires has its advantages. “From the beginning, starting a new job remotely puts a brand-new employee a little further out of their comfort zone, “he says. “But it can force a new hire to sharpen their communication skills and assimilate faster. If you do those things, the boss will quickly notice.” The Slaters offer these tips to help young professionals build relationships with their boss and co-workers while starting a new job remotely: • Optimize your workspace. Nick Slater says that if you hope to get off on the right foot, you’ve got to do your homework friendly. “First, eliminate all distractions around your work schedule

Show up on video conferencing with the same appearance you would want in the regular office. Film yourself doing practice runs (using whatever video communications software you’ll be using for work) so that you become more comfortable on-camera.” • Show your soft skills. Companies are making more hiring decisions based on critical thinking, problem solving, collaboration, communication, and adaptability. “Be flexible,” Nick Slater says. “As most companies are forced to adapt because of the pandemic, your role likely will change in the future, and proving you are agile is critical. Ask your boss about having a regularly-scheduled check-in, and create an agenda in advance.” • Expand your learning. “Seek out professional development opportunities that will help you do your job better,” Bob Slater says. “Learn new software skills that will save you time and allow you to produce better work. Work on your vocabulary –having a robust vocabulary enhances your writing, your presentations, and your ability to move
people to your point of view.” • Be patient. “Starting a new job in lockdown, you can feel disorganized and discouraged,” Nick Slater says. “Don’t feel guilty. Keep things in perspective and be patient with yourself. Few people hit the ground running in a new job, especially in these times. Margot Robbie Is a Cuddly Sociopath in “Birds of Prey”
Two recent Hollywood releases were set in Gotham. The two films have very different tones. Oscarnominated “Joker” starred Joaquin Phoenix, who landed the Best Actor Oscar for his stellar performance as the title character. On the lighter side, Margot Robbie starred as Harley Quinn in “Birds of Prey.” While it may not be nominated for anything this year, “Birds of Prey” is fun and not nearly as dark. The film, written by Christina Hodson (“Bumblebee”) and directed by Cathy Yan, takes us on a wild romp around Gotham City. Harley has just broken up with the Joker and is now on her own, except for her pet hyena. She is down on her luck but is befriended by nightclub singer Black Canary (Jurnee Smollett-Bell). Mary Elisabeth Winstead
portrays the Huntress, who is gifted with the bow and arrow, and Rosie Perez is police detective Renee Montoya, who, after losing her job on the force, joins the birds. And last, but by no means least, Ella Jay Basco is Casandra Cain, a teenaged pickpocket who has stolen an unimaginably valuable diamond from Black Mask Roman Sionis (Ewan McGregor). The diamond is what brings all the birds together. McGregor adds a lot of fun to the film as the egotistical narcissist Sionis, who will do anything to get the priceless diamondback. But will he? “Birds of Prey” is rated R for intense violence and language throughout and some sexual and drug material.
