By Desert Star Staff Unauthorized border crossings decreased 40 percent after President Donald Trump’s first month in office, the US Customs and Border Protection reports. Homeland Security Secretary John Kelly credited enforcement and Trump’s tough talk. On Wednesday, CBP released figures showing that 18,762 undocumented immigrants were stopped at the US-Mexico border in February, a steep drop from the previous month when 31,578 were apprehended. What made the 40 percent drop all the more notable was that typically there is an increase in traffic this time of year, according to Secretary Kelly. “CBP historically sees a 10-20 percent increase
in apprehensions of illegal immigrants from January to February,” the DHS chief said in a statement Wednesday. There had been an increase in traffic in the months leading up to the sudden decrease as well, according to DHS. The border agency recorded 157,000 captures from October 1, 2016 to January 20, 2017, the day of the presidential inauguration, representing a 35 percent uptick from the same period a year before, Kelly said. Additionally, families crossing illegally went up over 100 percent. Kelly also cited price increases from “coyotes,” or smugglers, who “hiked their fees in some areas by roughly 130 percent - from $3,500 to

‘No such thing as absolute privacy in America’ By Desert Star Staff FBI Director James Comey has warned that absolute privacy does not exist in the US, noting that a judge can compel anyone to testify about their communications – and even their memories. “There is no such thing as absolute privacy in America,” Comey told a cybersecurity conference in Boston on Wednesday, while speaking about the rise of encryption since whistleblower Edward Snowden revealed National Security Agency (NSA) spy practices in 2013.”There is no place in America outside of judicial reach,” he added. “Even our communications with our spouses, with our clergy members, with our attorneys are not absolutely private in America,” Comey said. “In appropriate circumstances, a judge can compel anyone of us to testify in court about those very private communications.” He went on to state that although Americans have
a “reasonable expectation” of privacy in their homes, cars, and on their devices, the government can still “invade our private spaces.” “Even our memories aren’t private. Any of us can be compelled to say what we saw...,” Comey said. Despite downplaying the existence of “absolute privacy” in America, Comey went on to assure those at the conference that the government cannot invade a person’s privacy without “good reason,” adding that it is a “vital part of being American.” The FBI director shared figures from the last four months of 2016, in which the bureau had lawfully invaded the privacy of Americans, or at least tried to. He noted that 2,800 devices were recovered in criminal, terrorism, and counterintelligence investigations over that period, stating the FBI was unable to open 43 percent of them. Comey’s statements come
FBI Director James Comey shortly after the release of ‘Vault 7’ by WikiLeaks, which reportedly reveals the CIA’s extensive hacking abilities. The whistleblowing site has stated that more documents will soon be released, noting that only 1 percent were included in the first installment of Vault 7. The US has opened a
federal criminal investigation into the WikiLeaks publication, with the FBI and CIA coordinating their reviews. Comey’s statements also follow President Trump’s claims that his predecessor Barack Obama ordered the wiretapping of his phones in Trump Tower ahead of his
election victory – a claim which Comey has urged the Justice Department to refute, as it falsely insinuates the FBI broke the law, according to officials cited by the New York Times. Comey did not address the WikiLeaks publication or Trump’s claims during his Wednesday speech.
Estrada-Reyes posted bail to the tune of $20,000. In early December, he was arrested by Immigration and Customs Enforcement (ICE) officers and charged with illegal re-entry. On Monday, he pleaded guilty to that charge, was sentenced to time served ‒ 45 days in jail ‒ and was placed in ICE custody pending deportation, the Denver Post reported. “You have the last word,” Estrada-Reyes told District Judge Philip A. Brimmer through an interpreter before the sentence was handed down. “I’m five days short of having been detained in jail for three months.” Brimmer wasn’t to have the last word, however. On Thursday, Denver Chief Deputy District Attorney Julie Hill asked for bail in the hitand-run case, which EstradaReyes had already posted, to be raised to $1 million. “We have an absolute guarantee that if there is not a high enough bond in this case, ICE will not transfer him to Denver’s custody,” she argued. District Judge Shelley Gilman agreed and ordered the
bond to be paid in cash, saying she has seen “enough cases” where defendants were not tried because of deportation, according to the Denver Post. It’s not the only time recently where a judge has gotten in the way of deportation plans. Unlike the Colorado case, where ICE officials had sought for Estrada-Reyes to remain in custody, a judge in Multnomah County, Oregon is accused of helping an illegal immigrant escape from custody. On January 27, Diddier Pacheco Salazar, a Mexican-born construction worker in his mid20s, had a second hearing where he pleaded guilty to driving recklessly and under the influence of intoxicants, even though he and his courtappointed attorney knew that plainclothes ICE agents would be outside the courtroom. After the hearing, though, Pacheco Salazar disappeared, the Wilamette Week reported “I prepped my client. I said, ‘I don’t know if they’re going to pick you up outside or what, but here’s how to prepare,’” said lawyer John Schlosser. “After the court appearance, I went out in the hallway and sat. My client never came out. I can’t say that I’m surprised he didn’t come out, but I gave him his options, and assume he had to have been escorted out some other way.” Pacheco Salazar appears to have slipped out a courtroom door reserved for employees. Now the court referee on the bench that day, Judge Monica Herranz, is facing an internal investigation for her alleged role in the escape, Chief Judge Nan
Waller told KPTV on Tuesday. ICE agents met with US Attorney for Oregon Billy Williams and representatives from the Department of Justice’s Office of Professional Responsibility to discuss the case, but ultimately decided not to pursue a criminal investigation or bar complaint against Herranz, the Willamette Week reported. Two weeks after his escape, immigration agents arrested Pacheco Salazar at a follow-up hearing. He is currently detained at a privately-operated ICE detention center in Tacoma, Washington. Schlosser has not been able to contact his client there, however. In a twist, one attorney is seeking to use Trump’s immigration orders to help his client be deported. That client is none other than notorious drug lord Joaquin “El Chapo” Guzman, who was extradited to the US from Mexico in mid-January. Lawyer Jose Luis Gonzalez Meza believes that Mexican prosecutors violated due process by extraditing Guzman, he told reporters outside the Mexican Attorney General’s Office on Wednesday. “That means he is in the United States illegally,” said Gonzalez Meza. “We are going to ask he be returned, because he is illegal and criminal!” He also held up a banner that read: “Mr. Trump, Deport the illegal and criminal Chapo Guzman,” AP reported. Mexico is a far more appealing place for El Chapo to serve time, after all, since he has a history of escaping from their prisons.
‘Deport El Chapo’: Will immigration crackdown Trump criminal cases?
Joaquín “El Chapo” Guzmán By Desert Star Staff President Donald Trump’s immigration crackdown was designed to get “bad hombres” out of the US, but it’s affecting criminal cases in different ways, however, from million-dollar bail bonds to a deportation request for ‘El Chapo.’ Less than a week after he assumed office, Trump signed an executive order that called on US Immigration and Customs Enforcement (ICE) and other federal agencies to “unapologetically enforce the law, no ifs, and’s or buts” when it comes to immigration, according to White House press secretary Sean Spicer. Trump signed a second one on February 22 that sought to “take the shackles off” immigration officers to speed up deportations. Since then, federal authorities have carried out multiple raids on and deportations of illegal immigrants. “You see what’s happening at the border, all of the sudden for the first time, we’re getting gang members out, we’re getting drug lords out, we’re getting really bad dudes out

of this country,” Trump said last Friday. “And at a rate that nobody’s ever seen before, and they’re the bad ones.” In some cases, though, a hastened deportation would actually be an injustice to the courts of law. A district judge in Denver, Colorado raised the bail for an illegal immigrant charged in a fatal hit-and-run to $1 million on Thursday, all to make sure that he wouldn’t be deported before trial. Norlan Estrada-Reyes, 27, is accused of killing a woman and fleeing the scene, a class 3 felony. He has already been deported back to his native Honduras once, in 2007, before illegally returning to the US. Estrada-Reyes had already been arrested twice in the Denver area before the October 30 car accident. He turned himself into authorities on November 3, and was charged with hit-and-run involving death, driving without proof of insurance and careless driving resulting in death. Two days later, immigration agents interviewed him and issued an immigration detainer. On November 11,

Their highly praised egg, cheese and bacon sandwiches found their way to the Cosmopolitan— however, because the place was jammed and the line seemed endless (perhaps it’s something in the name!) we defaulted to The Henry, next to the hotel’s casino which was not nearly as busy, and where breakfast for four was $80. Dodging long lines in Las Vegas is an art form, and at the Cosmopolitan (if you do have to linger in line) their digital floor to ceiling columns put on a show that speeds up the check in process. They call this The “Lobby Digital Experience” because it combines contemporary art and technology with architecture that I bet (not that I’m a gambler) you won’t find
anywhere else in Las Vegas. The installation spans the entire length of the front desk with eight 15-foot high columns, “transforming the space into an immerse living narrative” which are often poetic interpretations of life’s travels. This astounding masterpiece of digital art has earned the Cosmopolitan three major awards, including the London International Award Bronze in 2013, and all this even before you have located your suite! The Cosmopolitan has broken with in room amenity tradition and ramped it up with a world-class display of art and design books worthy of a high-end museum bookstore, and each are for sale along with a strange item at the mini bar. While there is no inroom coffee maker, there is odd can, amidst the candy jars labeled Love Box. Picking it up by mistake could cost
you $20, according to the mini bar menu. If you are in the mood for a love inspired temporary tattoo and a few other novelties, this little can could be your can-do a recipe for romance. Rates at the Cosmopolitan vary according to where your room or suite is located but they all have two daily add-ons that are the everyday resort fee, $35 and the 13.38 per cent resort tax. Military drama on stage at St Joseph Players in Yucca Valley
By Jack Lyons Theatre and Film Critic Yucca Valley, California, is only a stone’s throw away from one of largest Marine bases in the country. It’s only natural then that one out of the four live theatre venues in the area present military themed plays during any year, and why not? They have a captive audience ready and waiting to be entertained. This year it’s The St. Joseph Players of Yucca Valley’s time to produce another military-themed play and they have chosen well. Theatre founder and artistic director Rebecca Havely has a winning track-record when it comes to producing military-style plays. Her 2015 “Biloxi Blues” comedy production was a crowd pleasing audience favorite. Now Havely has selected the powerful military courtroom drama “A Few Good Men”, written by Academy and Emmy Award-winning screenwriter and playwright Aaron Sorkin as her directing choice for 2017. The story in short, centers round the courts-martial and trial of two Marines who have been charged with the death of fellow Marine as a result of a hazing and discipline incident at Guantanamo Bay (Gitmo), Cuba in 1986. The dilemma facing Lt. JG, Naval lawyer Daniel Kaffee (Ben Bees), who has never tried a capital case before,

is to face up to his penchant for plea bargaining his cases instead of rigorously defending his clients. At the prodding of Lt. Commander Joanne Galloway (Liyan Lagevardi) a female member of the defense team, along with his defense team lawyer buddy Lt.JG Sam Weinberg (Jericho McWilliams), Kaffee struggles to agree in doing the right thing by presenting a vigorous defense to save his two clients Lance Cpl. Harold W. Dawson and Pfc Louden Downey (Malcom Stanley-Wolfe and Jessie Scheckler respectively) thus mitigating the possible life sentences in a Federal prison if the defense pleads Guilty. After much soul-searching, Kaffe decides to go all the way in entering a Not Guilty plea, knowing by so doing, he runs the risk of putting the ‘Military mindset’ and the Marine code of honor on trial. Now the control game begins in earnest between Kaffee, a junior officer and his no nonsense, highly decorated, career Marine and Base Commander, Colonel Nathan Jessup (played by Abe Daniels in a stunning performance) a man who is used to being obeyed. The Marines under his command, live, breathe, and die to Jessup’s code of “Unit, Corps, God, Country!” All actors love good writing. It makes their job that much more enjoyable. Good courtroom dramas can be riveting when the writing is sharp and insightful, and it doesn’t get any better than

A note here might prove helpful: Sorkin wrote the movie first, however, with its success, he was urged to turn his story into a stage play as well. It follows the movie plot when it’s important to do so but the movie is episodic in its unfolding. The stage is a different medium and accommodations have to be made. So don’t look for Jack Nicholson or Tom Cruise, just keep your eyes on stage actors Abe Daniels and Ben Bees. You won’t be disappointed. They’re terrific as well. If I had to nit-pick, I would say when Act Two begins Lt. Kaffee needs to soften the earlier comic persona in Act One of a wisecracking glib lawyer, and get down to the serious business of representing two young March 3, 2017
Marines accused of murder. Military Tribunals are serious proceedings and are governed by strict military rules and courtroom behavior. Director Havely’s traffic management skills are put to the test on the small St. Joseph Players stage where a large cast of seventeen performers are needed to tell the powerful story of “A Few Good Men”. It’s a credit to the entire company that the scene changes are smoothly accomplished with precision (it must be that infectious Marine Corps discipline that kicks in even in the case of civilian actors), thanks to the creative talent and the personal vision of director Havely. There are many fine supporting actor performances in this production. But with a cast of seventeen it’s
impossible to list everyone. However, there are always a few standouts and this production is no exception. Cyrus Short as Lt. Kendrick, Liyan Lagevardi as Lt Commander Joanne Galloway, Janet Peercy as Lt. Ross, Bob Noble as Lt. Col Markinson, and Mike Shaw as the courtsmartial Judge Capt. Randolph, are among many nicely etched performances. Actually, that the production works so well is due in part to the true ensemble feeling generated by the entire company of performers and behindthe-scenes technicians. “A Few Good Men” is an entertaining evening in the theatre. It runs through March 26, 2017. For tickets and reservation, call 760-362-9319.

Switheart-The Watercolor Artistry of Loretta Swit
Loretta Swift
For most of us, the name Loretta Swit conjures up Major Margaret ‘Hot Lips’ Houlihan of M*A*S*H fame. The iconic television series ran for eleven seasons and she, and Alan Alda were the only stars who were with the series from start to finish. She has appeared on Broadway, in movies and in 1992 hosted the Discovery Channel’s 26-part series “Those Incredible Animals.” She continues to act in theatre, while pursuing her passion for the arts. She is actively involved
in philanthropic endeavors and in the prevention of animal cruelty and suffering. As part of being a true animal lover, she is also a vegan. In her delightful book SWITHEART she combines her watercolor artistry with interesting stories of the animals she has painted. Interspersed throughout she also paints lovely flower arrangements. And in one segment called “Isis in the Rosebuds” she painted one of her own cats that she
describes as a “gorgeous feline with the thick beautiful coat of a Turkish Angora.” In Swit’s impressionistic rendering Isis, a little feline goddess, is playing amid the flowers in a lush garden setting. One of my personal favorites is called “A Robin in Paris.” The puffy wideeyed robin has a little pout as it stares straight ahead. In a two-page spread entitled “My Wild Life With My Wild Life” there are photographs of Loretta

interacting with all sorts of critters. In one photo she is sitting on the trunk of an elephant, in another, an orangutan is hugging her. Fearlessly she also poses with a majestic tiger and stands behind an open mouthed alligator. She as well cuddles a baby kangaroo and an adorable cheetah cub. In her introduction Loretta says: ”This book is a full-circle journey of self-expression. As early as six years old, I loved to draw and just plain doodle. When I saw an ad for an art contest in a magazine, I begged my mother to enter my drawing. Relenting, she submitted my sketch, and I won the contest. I must have been driven by a need for self-expression, which ultimately has defined my life.” She continues, “ I was ‘out there’ being me, or rather, expressing the me; I wanted to become—painting posters for school, drawing my own greeting cards. Performing in and directing school plays. My serious study of theatre was a natural segue, but my artwork continued unabated.” Swit has worked with Wildlife Waystation, and
next to her portrait of a large cat named Montana, she describes him as “Big, bold and beautiful. He lived out his life at the Waystation and became so friendly and docile that with proper handlers, he would attend fundraisers with us.” One lion named Reisha, was rescued guarding a crack house and thirteen big cats came to the Waystation from New Zealand, where a zoo had gone bankrupt. She praises the work of her friend, Martine Collette, the founder that continues to supervise the large facility, a job she has done for forty years. According to Swit, “During those years, she’s rescued more than 77.000 animals. That’s not a typo— that’s an amazing woman.” This lavishly illustrated book is a must-read for animal lovers. The painting subjects range from tigers and chickens to dogs, cats and even a beautiful young wolf. Ultimate Symbol, 31 Wilderness Drive, Stony Point, N.Y. 10980, publishes the book. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call, 916-939-0772 for information regarding the trustee’s sale or visit this Internet Web site, www. nationwideposting.com, for information regarding the sale of this property, using the file number assigned to this case, T.S.# 9987-0172. Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the internet Web site. The best way to verify postponement information is to attend the scheduled sale. If the Trustee is unable to convey title for any reason, the successful bidder’s sole and exclusive remedy shall be the return of monies paid to the Trustee and the successful bidder shall have no further recourse.
