the Desert Symphony and was asked to perform for their organization on March 9th. When Marie came on stage, she said she was thrilled to

participate in this gala. The local Orchestra played before she came on stage. It’s always a thrill to hear them play. The sound they give is incomparable

to any other. They played behind while she sang, which provided an incredible sound. Her voice, the Orchestra and the songs were so magical. Marie spoke to the crowd of guest diners and her fans seated in the audience. First,

she told of her faith and gratitude for her remarkable life. She has been performing for years since her childhood and is grateful for her long career. Next, she told the story about Continues on Page 7

Coachella set to unveil a new mural at Veterans’ Park

By Desert Star Staff COACHELLA, Calif. – The City of Coachella has planned a formal unveiling of their new Vietnam War Memorial art mural at Veterans’ Park on Thursday, March 17th at 10 am. Located on 4th Street between Vine and Orchard, the mural features the poem titled “Forgotten, Unforgettable .”Local artist Autumn Martino, born and raised in the Coachella Valley, conceptualized the rendering. “As a community, we always have to do more for our veterans. Honoring and recognizing veterans past and present will always be a priority in Coachella,” said Mayor Steven Hernandez. The City’s Art in Public Places Program provided funding for the new mural.

The initial design went through multiple iterations, and the final rendering was determined based on feedback from local veterans and the community. “The mural is a wonderful addition to Veterans’ Memorial Park as it reminds us of the freedoms we are afforded because of the sacrifices our hometown heroes have made for us,” said Councilman Neftali Galarza. The program for this event includes a welcome from Mayor Steven Hernandez, commentary from mural historian Susie DelToro and artist Autumn Martino, and remarks from City Council and other local dignitaries. Eagerly-awaited returns from Australia’s Hoodoo Gurus, American rock troupe Band of Horses and Nashville-based songstress Jackie Bristow are among the new essential titles featured in my column this week. William Hurt, Oscar-winning actor, has died aged 71

By Desert Star Staff “It is with great sadness that the Hurt family mourns the passing of William Hurt, beloved dad and Oscar-winning actor, on March 13, 2022, one week before his 72nd birthday. The announcement came by Hurt’s son Will; he passed away peacefully, amidst family, of all-natural causes.” Variety stated that a good household friend verified the news. Hurt won the best actor Oscar in 1986 for ‘Kiss of the Spider Woman,’ ‘in which he had played a gay guy that shares a cell with a political prisoner in Brazil. After that, he got other Oscar nominations for the best male actor for ‘Kid of a Lesser God’ and ‘Program News’ and a bestsupporting lead for ‘A History of Physical violence.’ In 1950, Hurt studied religion at university yet turned to act and signed up at the Juilliard Institution in 1972. After a collection of part jobs, he won

his first substantial movie role in the Ken Russell body scary film, the ‘Altered States,’ which was quickly complied with by the then-sensational erotic thriller’ Body Heat,’ in which he starred opposite Kathleen Turner. Body Heat notoriety made his name, and Hurt became a significant star of the 1980s. Next, he was included in a famous role in the ensemble comedy-drama ‘The Big Chill,’ and the spy thriller Gorky Park and was cast in Kiss of the Spider Woman by supervisor Héctor Babenco. Hurt would undoubtedly make a mind-blowing success of the role. First, he played the drag-queen cellmate of Raul Julia’s leftist revolutionary, winning the best star honor at Cannes as well as the best actor Oscar. Then, the following year, he played a teacher in Children of a Lesser God, contrary to Marlee Matlin (later his partner), the first deaf winner of an acting Oscar. After that, in 1988, he made it three

Oscar nominations in a row for his part as a television press reporter in Broadcast News. In the 1990s, functional roles appeared elusive; to name a few, mainly with an arthouse curved, he remained in Wim Wenders’ monstrous but unsatisfactory ‘Till the End of the World,’ Chantal Akerman’s ‘A Couch in New York,’ and the Carl Franklindirected’ One True Thing.’ In 2005 he had an unforeseen success with an irregular role; criminal offense manager Richie Cusack in David Cronenberg’s ‘A History Violence’ garnered another Oscar nomination for the best-supporting star. Three years later, he made potentially a much more unforeseen entry into the Wonder Cinematic Universe, playing General Thaddeus “Thunderbolt” Ross, a duty he would repeat in Captain America: Civil War, Avengers: Infinity War and Endgame, as well as Black Widow. In 2009, Matlin published March 16, 2022

a memoir in which she defined physical and psychological abuse by Hurt during their connection. Hurt stated later: “I did as well as did apologize for any pain I triggered.” Hurt was wed twice,

By Suzanne Potter/PNS The primary election is coming up in just three months, so it’s time to make sure your voter registration is up to date. Many people moved during the pandemic - so you can update your records at registertovote.ca.gov. Ballots will be mailed to all registered voters in early May. Carol Moon Goldberg, president of the League of Women Voters, said people’s most significant mistake is forgetting to sign the envelope. “Be sure to sign the envelope when the ballot is being returned,” said Moon Goldberg. “That has been traditionally the number one reason that a ballot

has not been counted.” Legislative boundaries changed with redistricting, so you may find yourself in a different district with new candidates running. The Star will be unveiled on Friday, March 18, 2022, at 3:00 p.m. at the Downtown Park behind the Stage. The Star Dedication Ceremony is open to the public. “We are so honored to host the star dedication for this amazing nine-time Emmy award-winning director, producer and writer. David Lee is a true Palm Springs star,” said Nona Watson, the Palm Springs Chamber of Commerce CEO. David Lee wrote and produced The Jeffersons and Cheers, co-created, and directed Wings and Frasier. He lives in Palm Springs, and he is very active in local philanthropic endeavors. Speakers for the event include Jeffrey Richman, David Gerbitz, Danny Feldman, Barbara Boxer, David Hyde Pierce, and Geoff Kors. Lee has been nominated nineteen times for Primetime Emmy Awards and has won nine of those nominations. He also won the Directors Guild Award, the Golden

some association documents from as recently as the 1970’s or 80’s will occasionally have illegal restrictions against children. The empowerment of Civil Code Section 4225 does not only authorize amendments to remove such discriminations, but at subpart (b) of the statute requires it. Developer construction and marketing provisions - Many governing documents (typically CC&Rs) contains language to protect the developer’s ability to complete the construction and to market the remaining unsold homes in the project. After construction and marketing by the developer has concluded, Civil Code Section 4230 allows a board to remove such provisions from the governing documents. Outdated statute references – In 2014, the DavisStirling Act was relocated, reorganized, and amended in many ways. As a result, CC&Rs or bylaws predating 2014 contain inaccurate

Civil Code references. Civil Code Section 4235 allows a board to amend and update the statute references in the CC&Rs and bylaws to match the new statute numbers. Illegal rental restrictions - Civil Code Section 4741, effective in 2021, bans “unreasonable” restrictions against rentals and directs HOAs to remove such restrictions from their governing documents. Many HOA lawyers in 2021 urged their clients to try to amend their CC&Rs, an effort that often causes frustration and wasted expense due to member apathy. However, a very unique but short opportunity is currently available, pursuant to a new amendment in 2022 to Civil Code Section 4741 with the addition of a new subpart “f.” That subpart opened up a window from January 1, 2022 through and including July 1, 2022 in which boards can amend CC&Rs or bylaws without a membership vote to remove illegal rental restrictions, March 16, 2022

The BOARD Amending CC&Rs and Bylaws? By Kelly G. Richardson, Esq. CCAL CC&Rs and bylaws are governing documents that normally can only be amended by a vote of the HOA membership. However, there are some narrow circumstances under the Davis-Stirling Common Interest Development Act in which a board of directors actually is empowered by statute to make certain limited amendments to CC&Rs or Bylaws. Illegal discriminatory language – Unfortunately, many HOAs have governing documents (typically CC&Rs) containing illegal discrimination. Provisions against language discriminating against race, or sex, or children (except in senior communities, which can ban children) are required to be removed by HOA boards pursuant to Civil Code Section 4225. Older associations still have racial restrictions, and

recognizing your talents and your work in the world. Tell everyone what you want to do and be. Work transforms us.

so long as notice is given to the membership at least 28 days before the board acts on the amendment. The complete verbatim text of the proposed amendment must be included in the announcement. This amendment could be tricky, since Civil Code Section 4741 does not list all the ways in which a rental restriction could be “unreasonable.” Consult legal counsel to try to ascertain if the governing documents violate the statute. Many HOAs may miss the July 1 cutoff or the 28-day notification requirement if they are not careful. Boards should always seek assistance of qualified legal counsel before considering amendments by the board to

the CC&Rs or Bylaws. Counsel can help ensure that the amendment qualifies for one of these four exceptions to the membership vote requirement and draft the amendment. Also remember that any of these amendments must be approved in an open board meeting with the normal Open Meeting Act agenda announcement to the members. CC&R amendments must be filed with the County Recorder, not bylaw amendments. Kelly G. How to Host a College Hoops Watch Party By Desert Star Staff It’s tournament time, and that’s the perfect reason to gather with your fellow fans and watch both the top-seeded teams and Cinderella stories shoot their way to the top. Get ready to host this season’s most memorable college basketball watch party with these tips: Show Your Colors: Get your house game ready and show your team spirit by decorating in the team’s colors you’ll be cheering to victory. Since the tournament spans multiple rounds, you don’t need to go all out; grab some simple decorations like streamers, balloons and disposable tablecloths to add energy. If you’ll have guests cheering on both sides of the court, mix and match your decor and let guests pick their plate and cup color to root for their favorite team. Break Out the Brackets: The entire tournament hinges on brackets, so be sure your guests have a chance to fill out their own bracket to predict the winning teams.

You can find printable versions online and make copies for everyone. Then, for a little extra fun, have everyone chip in a set amount to play, and the person who predicts the most winning teams wins the pot. “TRAYF”- A Peek Into the Non-Secular Lives of Two Best Friends On Stage at the Geffen Playhouse’s intimate Audrey Skirball Kenis Theater is TRAYF,* a very compelling and entertaining play, written by Lindsay Joelle and directed by Maggie Burrows. The production is basically presented on a bare stage except for a few chairs and a boom box. That said, what takes place in the 80 minutes running time is quite fascinating and a searing but non-judgmental look at the restrictions inherent in the world of Hasidic Jews as manifested by Joelle’s two main characters. Zalmy, very well played by Ilan Eskenazi and his childhood buddy Shmuel, well-characterized by Ben Hirschhorn, live in the Crown Heights section of Brooklyn. They have been given an important task by their Chabad “Rebbe”** to drive around in their mitzvah tank to give out candles and blessings to passersby who might have lost their way. The secular world is a complete mystery purposely avoided in the education the

two young men received at their Yeshiva. A slight crack begins to emerge in Zalmy’s devotion to his religion after he encounters hearing music at a Manhattan music store. Excitedly, he shares with his pal that he heard a song by someone named Elton John, to which Shmuel asks, “Is he Jewish?” He is appalled that his buddy would set foot inside a music store as that is part of the secular world that is forboten. However, during Zalmy’s forbidden visit, he meets Jonathan, a slightly older young man who works at that music store. He just found out that his father, who had recently passed away, was Jewish and a Holocaust survivor, setting him on a path of exploration and selfdiscovery. Nicely played by Garrett Young, his character wants to say Kaddish, the prayer for the dead, so Zalmy writes out part of the prayer on a piece of paper and gives it to him. In search of meaning to his life, Jonathan decides to be Jewish because he feels

He meets Shmuel, who is dead set against Zalmy’s new friend’s conversion as the mother was Catholic and under Jewish law, you can only be Jewish through the mother. The new friend is adamant about converting,

and eventually, Shmuel agrees. Zalmy takes the potential convert under his wing, inviting him to his home for traditional Friday night Shabbat dinners and sleepovers. Along with that, Zalmy is becoming more and more curious about the

secular world and, quite by accident, comes upon a skating rink. He confesses to his friend that he sneaks out after dinner to watch the skaters, which he thinks is one of the most Continues on Page 11

Budget Bill Blocks Endangered Species Protections for Sage Grouse

By Suzanne Potter/PNS Conservation groups are slamming a spending deal in Congress that’s expected to pass this week - because it would forbid Endangered Species Act protections for an imperiled bird in the West. The sage grouse population in the high desert country of Western states has dropped 80% since 1965. Yet federal spending bills have included this prohibition since 2014. The initial bill dropped the ESA prohibition this year, but the final version restored it. Robert Dewey, vice president for government relations with the group Defenders of Wildlife, called it a huge missed opportunity. “Policy on the sage grouse must be driven by science and not politics,” said Dewey. “I think it’s time to end this prohibition and allow biologists to determine whether this species needs federal protection.” Sage grouse rely on sagebrush for food and shelter, and their habitat has dwindled with development and energy exploration. In 2015, the Obama administration negotiated a significant compromise to

protect the bird - a settlement between conservation groups, state agencies, the feds, ranchers, tribes, and the oil industry. However, the Trump administration opted to weaken that agreement. Dewey said this year, Republicans insisted on maintaining the requirement to keep the sage grouse from being classified as endangered. He blamed pressure from the fossil-fuel industry. “Since 2015, 1.6 million acres of sage grouse habitat have been leased for oil and gas purposes,” said Dewey. “So there’s no doubt the oil and gas industry is no fan of greater protections for the sage grouse.” Sage grouse habitat covers 11 states, from California east to the Dakotas. The same area supports more than 350 other declining species, including pronghorn, mule deer, pygmy rabbit, elk and almost 200 species of birds. Humanitarian Award Presented To Phyllis Mintz Eisenberg

By Pamela Price The Jewish Family Service ( JFS) of the Desert presented their Humanitarian Award to Phyllis Mintz Eisenberg on March 9 at the Mary Pickford Theatre in Cathedral City with two events the same day celebrating JFS’s 40th anniversary in the Coachella Valley. JFS currently offers support through emergency financial assistance, support through in-person and telecare mental health counseling to well-check phone calls and special programming for local Holocaust survivors. During 2021 JFS provided nearly 16,000 services to over 3200 Valley residents. The JFS program began with Hollywood Reporter columnist Sue Cameron sharing her latest book, “Secrets of TV Legends” based on her insider experiences as a reporter for the Hollywood Reporter. Her coverage, from Lucille Ball and Mary Tyler Moore to Milton

Berle and Dean Martin, revealed untold tales that transpired during the heyday of television. Jewish Family Services honors an outstanding individual annually, with the JFS Humanitarian Award presented to a deserving individual who has made an impact on the community. “Honoring Phyllis Mintz Eisenberg for her legendary support of desert charities was a perfect match; her enthusiasm is legendary. New Camera Study Tracks Wildlife Migration The nonprofit Wildlands Network worked with specialists at Pathways for Wildlife to place about 40 cameras on the route - to see where animals are trying to cross and where specialized fencing is needed to direct them to culverts or a wildlife overpass. fencing that could be improved or repaired and the best place for a new wildlife overpass. “In 15 years of study, I don’t think I’ve ever encountered a highway that needed this much extensive help,” said Diamond. “This is such an important area with the deer migrating like that.” The work builds on CalTrans and the California Department of Fish and Wildlife and their counterparts in Nevada. However, the construction of new culverts or overpasses is a few years off once environmental studies are complete.

Continuing the conversion steps for Jonathan, Zalmy gives him tefillin***, and he learns how to wrap the leather straps around his arm correctly. In the meantime, he makes mixed tapes for his friend, consisting of secular and non-secular music in cassettes, which were popular in 1991 and gives him his Walkman on which to play them. Throughout the play, we see Zalmy’s almost insatiable thirst for knowledge outside of his narrow world, and he even goes as far as seeing “Fiddler on the Roof” on Broadway. Worried that he might lose his friend, Shmuel pleads with him, “If you become secular, you’ll never see your family or me again.” As far as relationships, almost all marriages in the Orthodox community are arranged, and it is now Shmuel’s turn to be fixed up. Both Yeshiva boys are virgins as there is “No sex until we get married,” nor is there any sex education. In one of the funniest and sad scenes at the same time is a conversation between the two friends, which illuminates the lack of education on this subject. Shmuel tells his pal that he doesn’t know anything about sex. All he knows is that his thing goes into her, and

you have to pee inside her. Adding to his confusion is he understands there are two holes and “How do know which hole to use?” Meanwhile, jealous of the time Zalmy spends with the potential convert, he demands that he stop seeing him, to which he says, “No.” Eventually, Jonathan’s conversion is completed. We next see him in full Hasidic garb. Like many converts who morph into “super religious,” he tells Shmuel that “Zalmy is not one of us,” which does not receive the reaction he expected. There is a very short but interesting scene between Shmuel and Jonathan’s nonOrthodox Jewish girlfriend Leah (Louisa Jacobson) in which she practically begs him to release her boyfriend back to her as “we had a life together.” What is interesting about Joelle’s well-written script is that it does not attack what could be seen as the very repressed lifestyle of Hasidic Jews but simply illuminates the deficiencies inherent in the basic education, which lacks even a cursory understanding of the forbidden secular world. All this said, relax as the dénouement will leave you both smiling and curious with some surprising eye candy at the end. *Trayf is a Yiddish word referring to food that is not kosher and forbidden under Jewish law. **Rebbe: a Jewish spiritual leader or teacher

Desert Symphony Gala 2022

Story and Photos by Pat Krause Desert Symphony is back after a 2-year hiatus because of Covid-19. They were proud with a gala to be one the biggest with guest artist Marie Osmond. The Gala was held at The Show in the Agua Caliente Resort Casino on March 9th. This was a special event as the floor of the concert area of The Show had many tables filled with people before Maria Osmond’s performance. The floor is usually filled with seats for concertgoers. Marie Osmond performed for her fans at 8 in all the upper seats, and the diners watched her from the floor. Over 250 people attended

to show support for this performing arts organization. Desert Symphony was devastated. They had to shut down for over 18 months. Their educational outreach programs for kids had to be stopped. It’s the children who missed out on all the programs and concerts. Desert Symphony has a core mission to bring music and symphonies to our local children. The Amadeus Award was given to Linda Rider for her continued support for Desert Symphony and her dedication to children and many other charities in the Desert. Through its Children’s Music Discovery Series, Concerts

are presented to children in the Coachella Valley at no cost. Children are exposed to this kind of music, many for the first time. They see and hear something different than they listen to most of the time. Maybe a String Quartet or Wind octet or a full symphony orchestra to the many sounds in the World of Music in a concert setting. Desert Symphony offers a scholarship program. Our youth who want to go further in music are helped thru this program. This is an ample opportunity for someone interested in a future in music or maybe just for their own enjoyment. Desert

These last two years have been trying for all non-profit charities and organizations. President Nancy Tapick has spent many hours reorganizing and rebuilding to bring back the Gala and its programs. Momentous owner Frank Goldstein was hired to put

this Gala together at the new venue and did an excellent job. Monies were raised with Live auctions with items like jewelry, paintings, dinners for many, several types of nights on the town and tickets to concerts. There was also a raise your paddle for donations to help continue Desert Symphony’s work for years for our children. The Desert Symphony is very important to our young children.

Sinatra Children’s Center Honors Luncheon with Lindsay Vonn Story and Photos by Pat Krause The Barbara Sinatra Children’s Center held its annual Champions luncheon at the JW Marriott Desert Springs Resort & Spa on Friday, March 12th. The “2022 Champion” guest was none other than America’s greatest woman skier, Lindsay Vonn. Frank and Barbara, the Barbara Sinatra’s Children Center was started many years ago, back in 1986. John Thoresen told how the program started with them and a few friends. They raised millions of dollars to create the Center. The day started with Helen McDaniel singing “America,” with all the guests standing with hands over their hearts and many silently singing along. She was accompanied by the Rancho Mirage High School Jazz Band. The next speaker was Helene Galen, who spoke about how the Center started and has helped thousands of children. Many people were thanked for their support over the years. Child abuse did not stop during the pandemic; it only increased. Thoresen spoke about the things and people that help the Center with

exams, forensics, protective services, law enforcement, professional telehealth, therapy, and so much more. Thoreson spoke about the 30 videos they have made that have now been seen by millions of children worldwide. He told of a new facility that will be coming soon at Sunnylands. Hal Gershowitz took to the stage and asked all the guests to fill out the Aunts and Uncles membership cards. Members join the club to support the programs. The Center relies on its donations to maintain the pledge that no child will be turned away due to an inability to pay for services. Most children who come to the Center are part of that group. The Barbara Sinatra Children’s Center addresses the need of physically, sexually, and emotionally abused children. They try to break the cycle of generational abuse. Lindsay Vonn came on stage with Alex Flannigan, who would interview her. Vonn told of her life as a skier, her work ethic and dedication and her love to go fast. She spoke about her new book, Rise and Strong is The New Beautiful.

returned to win more medals. Flannigan asked her about retirement. Vonn said she thought it would be great, but that was not the case. She had to find her way to a new life after competing. She said she had confidence in her ability as a skier but not so much as a celebrity. She had to push

herself and find ways to move forward after retirement. She wants to make progress for women. She said she loves challenges and will continue to work with her Lindsey Vonn Foundation. She worries about global warming and someday maybe no snow for her sport. www.desertstarweekly.com
