Taylor Fritz upsets Rafael Nadal in Final Match at the Bank Paribas Open
By Richard Rowland The world’s best players competed the past two weeks at the BNP Paribas Open for the 45th edition of the ATP Masters 1000 event, held in Indian Wells, CA. New World No. 1, Daniil Medvedev, and three-time 2022 titlist, Rafael Nadal, led the way at the first Masters 1000 of the season. Crowds were back to the desert this season in full force to witness the event, as things returned to a high level of normalcy after the recent pandemic obstacles. This two-week event saw 475,372 fans in 2019, and this year’s attendance was close to that level, after cancellation in 2020, and a switch to October in 2021. San Diego native Taylor
Fritz upsets Rafael Nadal in the final, realizing his dream to win on home turf, after almost having to withdraw due to an ankle injury sustained in the semifinal match. Fritz worked with his team in warm ups and an on-site doctor for an hour prior to being able to compete in the Final Match. Fritz attributed his success against Nadal to his forehand, his serve, and success on the big points. A thrilling final match brought the conclusion to a great week in the desert for tennis and Fritz as an up and coming player. Fritz is the first American player to win this event in 21 years. Groups Tackle Immigration, Conservation for Latino Advocacy Week
By Desert Star Staff It’s Latino Advocacy Week - an initiative designed to empower local groups to go out and effect change in their communities. The Hispanic Access Foundation is holding a series of webinars, open to the public, on ways to further goals on issues such as conservation and immigration reform. Jessica Godinez, conservation program manager with the Hispanic Access Foundation, said there is enormous untapped potential and an appetite for change in the Latino community. “Our hope is to really provide our community with

the resources and the training to take leadership of their own advocacy,” said Godinez. Godinez noted that every 30 seconds a Latino American citizen turns 18. As of 2020, 32 million registered voters identified as Hispanic. From 2016 to 2020, Latino voter turnout tripled. And while Latinos comprise 18% of the population, they make up only 1% of elected officials. On Tuesday, as part of Latino Advocacy Week, advocates and policymakers toured the site of the proposed Western Riverside County Wildlife Refuge. Frank Ruiz, Salton Sea Program director with Audubon
California, said low-income communities need better access to nature to decompress. “It will improve the quality of life of many of those communities that may not have the opportunity to live in areas where they have better parks,” said Ruiz. “They don’t have open green areas. They don’t have the infrastructure that many other communities have.” House Resolution 927, the Wildlife Refuge Conservation and Recreation for the Community Act, would establish the urban refuge. It has been introduced but has not had a hearing or a vote.

CA Gets a “D” on the 2022 Environmental Scorecard By Suzanne Potter/PNS California only got a “D” grade on this year’s Environmental Scorecard, a report card put out each year since 1973 by the nonprofit California Environmental Voters. The low score mostly comes from inaction on the many climate bills that stalled in the state Senate, even though Democrats have a supermajority. Mary Creasman, CEO of California Environmental Voters, said many Democratic lawmakers talk a good game but then vote to delay climate action. “We actually have the solution and the technology,” said Creasman, “and all of those things are job creators

Health-Care Advocates Release 2022 Legislative Package By Suzanne Potter/PNS A coalition of 70 health and community groups called Care4All California released its 2022 package of 16 bills and budget requests on Monday will make health care more affordable and accessible. The most well-known is Assembly Bill 4, which would extend Medi-Cal to all incomeeligible adults regardless of immigration status. Anthony Wright, executive director of the nonprofit Health Access, said that the package would give health care to an additional 700,000 people and benefit millions more. “The package would represent the biggest expansion of coverage since the Affordable Care Act and would be the most far-

reaching in terms of providing cost relief to millions of Californians,” Wright asserted. Senate Bill 944 and Assembly Bill 1878 would eliminate deductibles on Silver plans on the Covered California exchange. Assembly Bill 1995 would eliminate premiums on Medi-Cal. And Senate Bill 644 would require the state to reach out to people who apply for unemployment assistance to see if they need help finding health care coverage. Sen. Scott Wiener, D-San Francisco, is sponsoring Senate Bill 858, which would raise the fines for insurance companies that unlawfully deny or delay medically necessary services. “And so we’re increasing that $2,500-per-violation fine
to $25,000 so that it means something,” Wiener explained. Asm. Blanca Rubio, D-San Gabriel Valley, is sponsoring Assembly Bill 2402, which would extend continuous coverage to children on MediCal for the first five years of life. “Right now, we have about 90,000 children ages 0 to 5 in Medi-Cal that have had a coverage gap,” Rubio pointed out. Other bills in the package include Senate Bill 923, which requires health plans to list doctors providing gender-affirming care, and Assembly Bill 1130, which would create an office of health care affordability. Membership Quorum Is Important AND Attainable! By Kelly G. Richardson, Esq. CCAL Some of the most important HOA decisions must be made by membership vote, but many associations cannot make those decisions because they fail to attain quorum. “Quorum” is the minimum number of members participating (in person, by ballot cast in advance, or by proxy) so that a membership vote can be taken. The failure to attain quorum can prevent the HOA from making actions such as election or recall of directors, major assessment changes, or amending CC&R’s or bylaws. Minimum Quorum. Membership quorum is needed for decisions by the entire HOA body, not the board. Bylaws usually specify the required membership quorum, but if the governing documents are silent, Corporations Code 7512(a) applies a quorum of one third of the members. The common quorum in many bylaws is 51% or a majority of the voting power. “Voting power” is the number of members entitled to vote, but under Civil Code Section 5115(c) all members vote, so that term now means “all members.”
Unfortunately, many associations have been unable to attain quorum for years and cannot elect directors. In such associations, the boards simply appoint to fill board vacancies as they arise. One client association received a recall petition demanding election of a new board. Unable to achieve a quorum in over five years, the board agreed and asked the petitioners for help! Membership quorum is also critical because HOAs cannot take advantage of the election by acclamation process unless there has been at least one valid election conducted in the prior three years. Tips toward meeting quorum. 1. Some associations make their annual meeting a social event, with a party or catered snacks during or following the meeting, or simply a “pot-luck” meal accompanying the meeting without HOA expense. 2. Make sure the voting materials are easy to follow and the ballots are clear. Members might abstain if they don’t understand the issue. 3. Investor owners often do not participate in HOA governance. Ask them for “quorum-only” proxies, so the other members
can make decisions. 4. Consider a prize drawing for those that vote in advance, attend, or give a proxy that is voted (if voting proxies are used). The expenditure can be added to future budgets as part of the annual meeting cost. 5. Amend the bylaws by membership vote state that after failure to attain quorum the meeting can be adjourned to another date with a reduced quorum of 25% of members. There is an urban legend that a 25% reduced quorum is found in the Corporations Code, but that is incorrect. Some lawyers recommend eliminating quorum, but that
recommendation ignores quorum’s purpose. Quorum provides stability by ensuring decisions have broadbased member support. Except perhaps for electing directors, preserve quorum minimums. Membership decisions should be made by a representative group and not a small handful of members. Corporations Code Section 7515 provides a “last resort” provision allowing courts to dispense with quorum requirements upon a finding that it is “impractical or unduly difficult” for the association to conduct a meeting. This requires a court petition (legal
expense) with proof that the association tried and failed. Don’t give up. Quorum is important and achievable. Remind neighbors that, to paraphrase Paul Sweeney, “[HOA] Democracy, like love, can survive any attack— save neglect and indifference.” Kelly G. By Janice Gough Every once in a while, an event shakes the market to its core. Two years ago, it was the COVID-19 pandemic. Today, it’s Russia’s invasion of Ukraine. This is a concerning development. No one knows how long it could last and what the effects could be, both inside the stock market and on the global scale. Ukraine is an absolute tragedy and what that part of the world is going through, but it’s important to remember that it can be easy to slip into a spiral of gloom and doom in a situation like this. And that’s when you become your own worst enemy and sell at the worst possible times. So, today, I want to share with you a simple wealth-building secret that helped me stop being my own worst enemy when outside forces impacted my investments. And I hope it does the same for you… Getting wealthy is a strange journey. It’s almost as if the universe wants to see if you’re worthy. Because it will continue to throw obstacles in your path to blow up your future wealth. I look back on decisions that I made in the past and sometimes asked, “What was I thinking?” First, I www.desertstarweekly.com
was not focused on a system of building wealth. I was more focused on making a living and building my business. I now see so many lost opportunities by not understanding the future technology and how it would change the world. In 1978, there was not much opportunity for women in financial businesses. So, I chose to become an insurance broker. I worked with various companies In Silicon Valley providing employee benefits; however, I missed the boat in not realizing precisely what they were creating … would change the world. This is primarily Warrant Buffett’s goal in selecting companies and assets to create his wealth. The market is already on edge and worried about interest rates and the Fed. If you look at estimates, Wall Street is projecting that the Federal Reserve will raise interest rates anywhere between six and nine times over the next year. They estimate that rates will increase by 150–225 basis points. I do not feel that this is going to happen. Why not? Currently, the federal government is the largest debtor in the world. It pays approximately 1.5% in interest March 23, 2022
on its debt. Those payments go to over $700 billion a year if interest rates double. That’s almost 20% of the entire federal budget allocated to interest payments. And there’s just no way that the federal government will allow that to happen. Now, as it relates… While these assets can take a temporary hit from outside events, don’t confuse short-term chaos with a long-term trend. They are two different things Continue Focusing on the Big Picture As long as you stay focused on the long-term picture of continued American growth and technological adoption – you’ll be positioned to profit from these assets. That’s it. If you bought Apple stock in 2007, the only thing you had to be right on was, “Well, I think these smartphones are real, and most of the world will own one.” That’s it. That was the only thing you had to get right to make a lot of money. Or look at Microsoft… Its stock got hammered in the ‘87
crash, but all you had to say was, “Well, I think Microsoft will be the go-to software for desktop computers. I don’t know how long it’ll take, but I think everybody will have a desktop computer. “That’s all the research you needed to make a fortune in Microsoft. Thus, if you can stay rational through these periods… and not sell at the bottom during a panic sell-off like we are going through now… your life will be absolutely transformed so that you can’t even begin to imagine. So, enjoy your life, let time do the heavy lifting… and hold your significant assets. That’s my goal for you… to transform your life without putting your current life at risk. Report: U.S. Incarcerated 250,000 Kids in 2019
By Suzanne Potter/PNS Almost a quarter-million American children were incarcerated in 2019, according to a new report called “Too Many Closed Doors” from the Sentencing Project, about five times more than the annual point-in-time counts reveal. Josh Rovner, a senior advocacy associate for The Sentencing Project and the report’s author, said we have been looking at the wrong numbers. “As of one day in 2019, there were about 36,000 kids in youth facilities, and the actual number of kids in the facilities over the course of the year was closer to 240,000,” Rovner explained. “And that is actually an undercount.”
The report found juveniles are overwhelmingly being detained for low-level offenses. In addition, the disruption to their schooling and home life makes them more likely to be rearrested in the future. In addition, the detention rates are much higher in poverty-stricken communities of color, where there is more police presence. Rovner pointed out it leads to significant racial disparities. “Overall, 1 out of every four kids who are sent to court are detained at the outset,” Rovner outlined. “Now, for white youths, that is 1 out of every 5. For Black and Latino youths, closer to 30%. And that is not connected to the seriousness of the offense.”
Daniel Macallair, executive director of the Center on Juvenile and Criminal Justice in San Francisco, said youth crime had dropped dramatically in the past 30 years. California once detained about 10,000 youths; now, it’s down to about 3,000. He noted the state overbuilt juvenile detention centers in the ‘90s and now have 12,000 beds and thinks it creates an incentive to use them. “I think it’s partly just a matter of bureaucratic convenience,” Macallair asserted. “And the concern over, well, we built these detention beds, and if we don’t keep them filled, what implications will that have for the department’s budget, employment, the unions get upset, and so
there’s a whole lot of factors that are weighing in here.” California will close the last of its state youth detention facilities by next summer. Instead, juvenile justice will be handled entirely at the county

The Beach Party gala was such a hit that guests requested it for this year’s fundraiser. This is the 23rd year of helping residents living with Multiple Sclerosis. They are satisfied with free services that make a tremendous difference in the lives of the clients of Act for MS. Anne expressed such gratitude for the many volunteers that make all these services possible. The event was held at the Omni Rancho Las Palmas. The event brought
guests in colorful beach attire. Bright tops. Flowered skirts, brilliant men’s shirts and women with bows or flowers in their hair. Some ladies wore flowered hats in the theme of the gala. Each person at a table was gifted with a fun type of sunglasses. The whole room was filled with a beach sunset feeling. This was a unique Beach Party III that started with a cocktail party. The guests were offered a fantastic menu starting with tasty Hors d’oeuvres. Guests were offered three choices for their meal. They announced that the Beach Party VIII honoree
would be a Philanthropist, activist, and founder of Loving All Animals, Lindi Biggi. Lindi has been a big supporter of Act for MS for a long time. She is considered an inspiration to all and a real treasure. A video was shown of Lindi Biggi’s Life. Her dedication to so many charities and organizations around the Desert is well known. Lindi has a passion for animals and turned her home into a sanctuary. The house has been dubbed the Biggi Bird Gardens. She has hosted many events in that home for Fundraising efforts for non-profits. Lindi is an entrepreneur and visionary. She built Venus De Fido, a spa for animals and owners. She is now the proud owner of Shadow Mountain Golf Course, The oldest club in Palm Desert.
Videos were shown where ACT for MS clients told their stories of how they have thrived with their help. They said how help with mobility has changed their lives. Yoga and massages have helped them live a more normal life. Strength training has kept one man out of a wheelchair. Stories like that are part of ACT for MS’s history of service. The organization was started by Gloria Greer when her daughter Norma was diagnosed with MS. Some of the clients are helped with utility bills and other support. Luncheons and gatherings offset loneliness and depression. There was an upbeat live auction of jewelry and trips to exotic places. A, Feel the Need, or as many call it, Raise the Paddle, was started with many
donating money to support all the programs that serve ACT clients for MS. This is a muchneeded service to people in need dealing with MS. ACT for MS aids regardless of Income. Of course, the Master of Beach Music, Dean Torrence, formerly of Jan and Dean fame, arrived with his band of 5 musicians. People were on the dance floor at the first song. Their music is so well known and loved. Dean’s birthday was on March 10th, and someone yelled Happy Birthday, to which the audience cheered. It seemed everyone knew the words to Surfer Girl, In My Room, Lady From Pasadena and more and enjoyed dancing the night away to these hit songs.
