confirmed. A suspected gunman has been arrested. “Our hearts go out to all families impacted. There are ten fatalities,” Boulder Police Chief Maris Herold

told a press conference on Monday evening, several hours after a gunman went on a shooting rampage at a King Soopers supermarket in the Table Mesa neighborhood.

Among the victims was officer Eric Talley, who was first to respond to the reports of a gunman with “a patrol rifle” at the store, Herold said, calling the officer’s conduct “heroic.”

March 15 would have

been Justice Ginsburg’s 88th birthday. As a champion of women’s rights and equality, Ginsburg’s statue was unveiled Friday in her hometown of Brooklyn, New York. And today in New

Haven, she’ll be honored in a ceremony by Connecticut women who call themselves the “Outraged Elders.” Dori Dumas, president of The Greater New Haven NAACP and a member of the Elders group, said Ginsburg’s support of reproductive rights is an issue they feel strongly about, especially with the current conservative majority in the Supreme Court. “That’s something that she spoke out about; that’s something that we know, especially with the last administration, and ongoing that people are trying to turn back,” Dumas explained. She noted the group also wants to draw attention to gender-justice issues, such as the disproportionate health and economic disparities faced by Black and Latina women in the pandemic compared to white women in the U.S. Justice Ginsburg died last September of pancreatic cancer. Dumas added the Outraged Elders, composed of Black and white women advocating for racial justice, won’t back down from their mission any time soon. “The women in our community are paying attention,” Dumas remarked. “We’re paying attention to March 24, 2021

legislation; we’re going to be a part of writing letters and organizing. And we’re going to keep her legacy going and make sure that the clock is not turned back on some of the things that we have been able

almost tripled in February compared to one year earlier, and are on track to hit a two-decade high, Homeland Security Secretary Alejandro Mayorkas said last week. Photos from inside one of these facilities in Donna, Texas, reveal massive overcrowding inside makeshift tent shelters. The pictures, shared with Axios on Sunday by Rep. Henry Cuellar (D-Texas), show these plasticlined “pods” operating at double capacity, with groups of children huddled between crude, plastic sheet dividers. O’Keefe’s claims have been backed up by the New York Times, which last month described conditions within such facilities as “akin to jails.” There has been no mention of sexual assault in the Donna facility, but reports of sexual assault in detention centers increased during the Trump years. Throughout his campaign, Biden promised a “fair and humane” border policy, and his administration insists that its host of recently opened “overflow facilities” are a world away from the “cages” former President Donald Trump kept unaccompanied minors. Although Mayorkas has described CBP facilities as “no place for a child,” he insisted last week that federal agents would “safely receive,

shelter and transfer” them into more suitable, longerterm accommodation. Yet, the kids are spending an average of 136 hours in these facilities, far beyond the legal limit of 72 hours. Moreover, getting an accurate look at the conditions they are kept in has proven difficult. Until now, no public photos from inside these facilities have been shared, journalists have been kept out, and an unofficial gag order has reportedly forbidden CBP agents from speaking to the media. Asked about this apparent stonewalling, some Democrat lawmakers have defended Biden’s no-access policy. “I don’t necessarily think that it’s appropriate for journalists to be inside centers that are not permanent places

for children,” Rep. Linda Sanchez (D-California) told CNN on Friday. The current border surge came immediately after Biden reversed nearly all of Trump’s immigration policies by executive order, including a coronavirus-related policy turning back all asylum seekers at the border and the so-called ‘Remain in Mexico’ policy that saw Central American migrants wait in Mexico until their asylum claims could be processed. Nevertheless, the Biden administration has blamed Trump for the current crisis, with Mayorkas accusing Trump of tearing down “the orderly systems” supposedly established by the Obama administration. Trump, meanwhile, has been scathing in his criticism

of Biden. “We proudly handed the Biden Administration the most secure border in history,” he said in a statement on Sunday. “All they had to do was keep this smoothrunning system on autopilot. Instead, in just a few weeks, the Biden Administration has turned a national triumph into a national disaster. They are in way over their heads and taking on water fast.” Though she worded her statement differently than Trump did, Roberta Jacobson, Biden’s border czar, admitted earlier this month that reversing Trump’s strict policies may have freed “pent up demand” from migrants to enter the US and that Biden’s “more humane policy” may be driving more people to make the “decision” to cross the border.

Some Bad Pending HOA Legislation

By Kelly G. Richardson, Esq. CCAL Last week’s column recapped five bills proposing to help HOAs. This week addresses the other side of the coin, as four legislative proposals are pending, which would not help California’s 50,000+ HOAs. AB 1410 (author Rodriguez) This year’s worst HOA bill is Assembly Bill (AB) 1410, by Member Freddie Rodriguez. The bill states that it responds to the pandemic emergency, yet most of the bill is not temporary. The bill would eliminate any ban on leasing portions of residences. This means that HOAs could not stop someone from renting each bedroom to a different tenant or subdividing the residence into multiple rented parts. This would effectively destroy the longstanding rule that HOA homes must be single “family” residences and allow them to become mini boarding houses. AB1410 would also add a new Civil Code Section 4754, banning anything in governing documents restricting “critical

discussion” of the HOA. That sounds like a nice idea; however, I have not seen such a provision in any HOA CC&Rs or rules during 32 years of advising HOAs. Several years ago, the Community Associations Institute sponsored a bill proposing low-cost training for HOA directors, but it did not become law. AB 1410 would add a Civil Code Section 5101 requiring all of California’s 200,000 or more volunteer directors and every HOA employee (including everybody from managers to maintenance personnel) to take a course on “ethics and harassment prevention.” No information on course content, legitimacy, length, or cost is provided. AB 1410 would also create a new Civil Code Section 5870, prohibiting HOAs from pursuing enforcement actions of any kind during declared emergencies or quarantines, and would create a new Section 5880 permanently requiring HOAs to give photographs or any other evidence to members accused of violations. During emergencies or quarantines, apparently March 24, 2021

scofflaw members can behave without consequence if this bill is passed and can demand to inspect any “evidence” against them.

AB 1466 (authors McCarty, Bonta, and Chiu) AB1466 addresses the problem of old CC&Rs containing illegal discriminatory restrictions (most commonly racial or against children). The bill would allow HOA members, brokers, escrows or “other persons” to submit to County Recorders a proposed CC&R amendment. There are no proposed protections to ensure that County Recorders can confirm that only discriminatory portions are affected, and County Recorders are given only 90 days to record the amendments demanded. Under this bill, anybody inside or outside the HOA could modify its CC&Rs. The “Safe At Home” program protects victims of domestic violence, and AB 611, from Member QuirkSilva, would add a new Civil Code Section 5216 requiring HOAs use a designated state address instead of the member’s actual address for those in the Safe At

Home program. However, this is unnecessary, since HOA members under Civil Code Section 4040(a)(2) can already designate an email address instead of postal mail for notifications. AB 1584 (author Housing and Community Development Committee) AB 1584 would declare “unreasonable” restrictions on accessory dwelling units (“ADUs”) or junior ADUs to be void. This would make the third major change in the law regarding ADUs in HOAs in three years, while HOAs are still figuring out 2019’s AB 670 and 2020’s AB 3182. Wright, the statewide organizer for the New York Campaign for Alternatives to Isolated Confinement, said Cuomo must sign the bill immediately to send a clear message. “That criminal justice in this state is not going to be done with trauma and torture,” Wright asserted. “That it’s going to be done with treatment, programming, and rehabilitative services.” Cuomo has not indicated whether he will sign the bill. Some corrections officers argue the HALT Act would take away an essential disciplinary tool and put officers at risk. But Wright noted the HALT Act doesn’t prevent the separation of violent or disruptive prisoners. He added treating prisoners

humanely makes prisons safer for everyone. “Every place that something like this has been enacted in other states and jurisdictions, they report a 25% to 75% drop in violence,” Wright observed. The bill prohibits solitary confinement for longer than 15 days for all people in prison. It eliminates it for those under age 21, over 55, people with disabilities, pregnant women, and women caring for children. Prolonged isolation has severe impacts on mental health and has been banned by the United Nations, and Wright pointed out the UN’s Convention Against Torture binds the United States. “You can’t be the lawmaker and the lawbreaker,” Wright insisted. “It’s about time we started following the law, like the rest of the civilized world, although we call ourselves the ‘most civilized place on the planet.’” www.desertstarweekly.com


Palm Canyon Theatre Presents Youth Program Spring Concert By Desert Star Staff Palm Springs, Calif., – Palm Canyon Theatre’s Youth Program will stream a Spring Concert featuring students ages 12-21. The concert culminated in two months of training that PCT offered as part of its ongoing live stage education. For nearly 25 years, students participating in PCT’s youth program receive realworld experience by working alongside professional actors on mainstage productions. Today, with stages across the nation closed to live audiences, training was done virtually and in small groups at the Palm Springs theatre. The instruction was offered at no cost by talented actors, vocalists, and directors who volunteered their time to prepare a troupe of 22 young performers. “Because most schools were still engaged in distance learning, families were looking for a creative and social outlet for their kids.

We loved working with this group of energetic young people who were craving to get back on stage,” said Se Layne, co-artistic director and the visionary behind the particular show. Singing classes began on Zoom in mid-January and then transitioned to small groups in the PCT auditorium. Students and teachers wore masks and socially distanced during all rehearsals. Once small cohorts were rehearsed, a few full-cast sessions were run to record portions of songs that included the entire group. The entire concert is recorded; it will be featured as a streaming event for 2 DAYS ONLY, March 30-31, 2021. “Minari” The Challenges of New Beginnings For a Korean-American Family

Photo Courtesy of A24 This heartfelt, compelling film has already garnered dozens of awards, including the Audience Award and Grand Jury Prize at the 2020 Sundance Film Festival, an Independent Spirit Award, and the Black Film Critics Circle Award for Best Original Screenplay. Adding to that are multiple Oscar nominations in several categories for Lee Isaac Chung, including Best Picture, Director, and Original Screenplay, which he wrote. Other cast members who are also up for awards include Steven Yeun for Actor in a Leading Role, the first Asian-American actor to be nominated in that category in Oscar history, and Yuh-Jung Youn for Actress in a Supporting Role. When faced with all these accolades, one’s expectations are incredibly high, and sometimes those expectations are not met. However, I’m happy to say that the film deserves every award it has won and the current nominations. The movie, loosely based on Chung’s own life, is a tender story about a Korean-American family that moves from California to rural Arkansas in 1980. The dad, Jacob Yi, is portrayed by Steven Yeun, whose internal characterization is fascinating and compelling. The myriad feelings and challenges he faces are visible on his body and soul.

Jacob is determined to achieve the American Dream and purchased 50-acres of farmland. His wife Monica, well played by Yeri Han, is filled with dismay as she sees their new home, which is akin to Army barracks. She is also concerned about medical care for their son David, played by a talented, adorable young Alan Kim, who makes his film debut. His character is pivotal to the unfolding action as well as providing comic relief. His sister Anne, nicely played by Noel Kate Cho, is a typical teenager with the angst that comes with making new friends. Ever optimistic, Jacob knows exactly what he wants to do. That is to plant his fields with fruits and vegetables to sell to the growing Korean population in Oklahoma City eventually. Despite the lack of enthusiasm from his wife, his vision is clear and his determination unbridled. To support themselves until his dream comes to fruition, they work in a factory separating the male chicks from the female chicks. Sorry to have to say this, but the male chicks are disposed of because they cannot reproduce, but I’ll spare you from the details of that method. When not working at the factory, Jacob prepares his land for planting by searching for a water source and purchasing

His ultrareligious next-door neighbor Paul, wonderfully played by Will Patton, becomes Jacob’s good friend and helper. This kind man is what you might describe as a Holy Roller, so there are lots of prayers of thanks to Jesus. At home, there are many arguments between Paul and Monica, who wants to return to California with the kids, with or without her husband. However, she fixes up their home little by little, and Jacob proceeds with plowing the land. Grandma Soon-ja, humorously played by the talented Yuh-Jung Youn, arrives on the scene, much to David and Anne’s dismay. The boy takes an instant dislike to her, which she handles in a very amusing way. He complains that she’s not a traditional grandmother because she curses, laughs a lot, and snores. The young grandson hates her cooking and says, “She smells like Korean.” Wanting to torment Soon-ja, David brings her a mystery drink which she spits out quickly and, laughing, calls him a bastard. Jacob sends him out to get a rod with which he will be spanked but given his rebellious nature, coupled with his sense of humor; he returns with a wilted weed. Dad forces his son to apologize, which he reluctantly

does, but still insists that she is not a real grandmother. The fields are beginning to blossom, and as with any rural farm, water issues appear and solutions are sought, always with Paul praying for help from Jesus. Grandma and David explore the property, and he spots a crawling snake that scares him and wants her to kill it. She consoles him, saying, “Things that are hidden are dangerous – better to see the snake.” Grandma brought minari seeds* from Korea and planted them on a hill near the stream – an action that has unexpected future ramifications. With their relationship improving, David confides to her that he doesn’t want to die, and she tenderly sings him to sleep, saying, “I won’t let you die.” Unfortunately, this force-of-nature grandmother is faced with a health crisis of her own which is resolved with some residual side effects that eventually impact Jacob’s vision in a most catastrophic way. Good neighbor Paul is invited for dinner, following which he sprinkles holy water throughout the house to purge out the demons and cure David of his health issue. In the meantime, the crops are becoming fruitful, and Jacob makes a deal with a local distributor to sell his fruits and vegetables to Korean

consumers. Jacob’s persistence appears to be paying off, but he will face an almost impossible challenge. This is the story of one man’s unrelenting vision of achieving the American Dream and how the family comes together in the face of extreme, unexpected adversity, catapulting them into yet another set of new beginnings. Director Chung assembled a top-notch technical team including Director of Photography Lachlan Milne, who captured the changing textures of the narrative, Emile Mosseri’s music, underscoring the action, as well as Film Editing by Harry Yoon, Production Design by Yong Ok Lee, Art Direction by W. Haley Ho, Set Direction by Hanrui Wang, and Susanna Song, whose period costumes are spot on. Women’s Equal-Pay Day Underscores Need for Equity in Pandemic Relief By Desert Star Staff Ahead of Women’s Equal Pay Day Wednesday, there’s an even greater emphasis on the pandemic to acknowledge and address the gender wage gap. March 24 marks the average date a full-time working woman earns as much as her male counterpart made in 2020. The latest research shows that white women earn 82 cents for every dollar a man makes, but it’s 63 cents for Black women. Native American

and Latina women make 60 and 55 cents, respectively. Madeline Granato, policy director for the Connecticut Women’s Education and Legal Fund, said closing the pay gap is an even more significant challenge in the pandemic. She predicted women in fields with the highest layoff rates, such as retail and hospitality, will likely see the recession’s long-term effects. “The unemployment rate will impact the gender wage

gap long term because that’s a large period where women have decreased their earnings, which adds up over time,” Granato explained. “And it impacts how much we’re able to save for retirement, how much we’re able to just put in savings in general.” In Connecticut, women have filed the majority of unemployment claims since the pandemic began, according to a 2021 Connecticut Essential Equity report. And more than one in three unemployment claims have been filed by women of color. Granato noted access to paid sick time and family medical leave is vital to help women, especially working on the front lines and in essential jobs, weather the storm of COVID-19. “Nationally, women make up about 88% of registered nurses, 85% of personal-care aides,” Granato observed. “Even before COVID, due to

the gender wage gap, there is research out there that shows that they lose about $5,000 per year because they don’t make equal to their male counterparts.” The equity report recommends Connecticut fully implement its paid family leave program, expand paid sick leave, and advance such policies as salary transparency for open positions, all to create a more equitable workforce.

There are 22 new COVID19 cases and four recent deaths in the Coachella Valley. This number is derived from the total number of confirmed

cases and the subtraction of the total number of recoveries and deaths. At this time age group 18 – 39, continues to have the highest number of confirmed cases in the county, with 115,061 cases. According to the Riverside University Health System, 175 patients infected with coronavirus were hospitalized countywide as of Friday. That number includes 37 patients in intensive care units. The 20 newly reported fatalities bring the county’s coronavirus death toll to 4,117. The number of documented patient recoveries stands at 285,218. The doubling time — or the number of days in which documented virus cases increase 100% — is 88 days. According to health officials, a doubling rate of seven days is the reason for alarm, while expanding doubling times point to moderation or gradual success in virus containment. The regulatory bar was lowered Tuesday when the county was moved into the red tier of the governor’s Blueprint for a Safer Economy framework. The county had been in the most restrictive purple tier since October. “If we continue to work together, we can keep this momentum going,” Board of Supervisors Chair Karen Spiegel said. Under the red tier classification, indoor operations are permitted in restaurants and movie theaters, limited to 25% capacity, or 100 people,

whichever is less. Museums, zoos, and aquariums also have a green light for up to 25% capacity, while gyms and fitness centers have a 10% capacity cap. However, some have remained open in the county despite the state-imposed lockdowns. Retail stores and shopping malls can operate at 50% capacity, under the California Department of Public Health guidelines. Public schools are also eligible to open for in-person instruction, provided they have established safety protocols in place. Many school districts have opted for hybrid models, with part in-class instruction and part remote learning. The county’s coronavirus positivity rate dropped to 3.3% Tuesday, down from 4.1% last week — the lowest since early October.

Officials said vaccination of seniors continues to be a priority. Still, others who qualify under the CDPH Phase 1 guidelines include hospital workers, first responders, food service workers, teachers, and some agricultural workers. Beginning Monday, residents 18 to 64 years old with underlying medical conditions and most people with disabilities became eligible for vaccinations, according to the CDPH. “Individuals with conditions are strongly encouraged to seek vaccination with a primary health care provider or system, or in an alternate clinical setting,” the agency stated. “Check first with your usual health care provider.” The portal to make an appointment for vaccination can be accessed via www.rivcoph. org/COVID-19-Vaccine. Anyone

who needs assistance may also call the county’s 211 help-line. ICU availability countywide is 30.5%, up from 27.6% last week in the 11-county Southern California region. Miami Beach’ spring break chaos’ “out-of-control.”

By Desert Star Staff Update: The Miami Beach City Commission unanimously voted to extend the state of emergency in South Beach until April 12, following yet another night of wild partying, after the Florida governor declared the state an “oasis of freedom.” The commission granted Interim City Manager Raul Aguila the authority to extend

the restrictive measures for up to three more weeks if needed, following an emergency meeting on Sunday. The emergency curfew will remain in place for South Beach parts until 6 am Monday and extended as authorities see fit. Simultaneously, inbound traffic will also remain restricted on the three main causeways connecting the island city with Miami.

After the crowd ignored the curfew order on Saturday evening, it took officers more than two hours to clear the area. At one point, SWAT officers in bulletproof vests even fired pepper spray balls to break up the rowdy crowd, according to local media reports. The mayor of Miami Beach, Florida, has declared a state of emergency,

shutting down roads leading into the city and imposing a nightly curfew on the entertainment industry to stop the “out-of-control” influx of spring breakers. “As we hit the peak – at the peak of spring break, we are quite simply overwhelmed in the entertainment district,” Interim City Manager Raul J. Aguila told a press conference Saturday. Folks, this is not an easy decision to make; we are doing that to protect public health and safety. Mayor Dan Gelber signed an emergency declaration, shutting down bars and restaurants in the South Beach district – the socalled ‘High Impact Zone’ – which will last for 72 hours starting at 8 pm Saturday. Massive crowds of college students and other vacationers on spring break have flocked to Florida in recent weeks, mainly ignoring Covid-19 social-distancing guidelines. Photos and videos shared on social media show

Miami’s beaches jammed with people, none of whom appear to be wearing a mask. Miami Beach Police Chief Rick Clements said on Saturday that despite a recently implemented “no-tolerance policy” and increased patrols, the crowds were simply “out of control.” Around 100 people were arrested last weekend alone, including for drug and weapons offenses, while police issued more than 900 citations and seized at least 13 guns. At least three dozen more arrests were reported since then. Florida Governor Ron DeSantis has touted his state’s success in keeping businesses and schools open during the pandemic while maintaining Covid-19 case and death rates comparable to those of states with strict lockdown measures, such as California. DeSantis not only hasn’t imposed a statewide mask mandate but also banned cities and counties from punishing those flouting the regulations or refusing to wear a mask.

Countless hours of great listening await those who pick up any of these new releases! Artist: Paul Stanley’s Soul Station Title: Now and Then (UMe) You might like if you enjoy: Al Green, Smokey Robinson, The Spinners Tell me more: Paul Stanley’s Soul Station is no publicity scheme. The KISS frontman’s love of soul music dates back before the Starchild’s New York-spawned band hit rock and roll pay dirt in the early ‘70s. I caught Stanley and his top-tier Soul Station back in 2016 at the Coach House in San Juan Capistrano, CA, and was blown away. Now, the ensemble’s long-awaited full-length debut (“Now and Then”) has been released, and it fully delivers on the magic I witnessed five years ago. Stanley revisits a slew of soul classics with faithful and affecting recordings; these include an excellent take on the Al Green 1972 classic “Let’s Stay Together,” romantic reading of the Miracles’ 1965 hit “Ooo Baby Ba, by” and an emotive version of the Spinners’ 1972 R&B favorite “Could It Be I’m Falling in Love.” Even more impressive are the five originals that equal the might of the reworked covers. The instantly-infectious “I, Oh I” is particularly stunning and is one of those ear candy cuts that you hear and can’t get out of your head. The wistful “Save Me (From You),” lovely “Lorel,ei” and shimmering “Whenever You’re Ready (I’m Here)” — the latter a duet with soprano Crystal Starr — are other welcome originals on “Now and Then.” Stanley’s full voice is consistently on them. Hishis mellifluous falsetto adds another critical element of the enchantment displayed across the release — his versions of the Temptations’ “Just My Imagination (Running Away With Me)” and the Stylistics’ “You Are Everything” are particularly impressive with Stanley utilizing his high-flying falsetto as the centerpiece of both songs.
