Story and Photos by Pat Krause The 27th Annual VIP gala, Paris En Rouge, was held on May 12th at the Ritz-Carlton in Rancho Mirage. This is the fourth year the Ritz-Carlton Hotel has hosted the event.

There was a special cocktail hour with a “Rouge Cocktail” for the guests. This gala is growing each year for the

United Way of the Desert.

They raised over $150,000 last year and hope to increase even more this year. The event was underwritten by local Philanthropist and owner of Spencers Restaurant, Harold Matzner.

By Desert Star Staff Donald Trump said he wanted to discuss “facts” with Russia, ranging from airline safety to terrorism, during last week’s White House meeting. A Washington Post story has accused him of revealing classified information to Russian officials.

In a tweet, Trump said he had an “absolute right” to discuss these matters with Russia, noting that the conversation was held at an “openly scheduled” White House meeting.

The “facts” discussed included terrorism and airline flight safety, according to Trump, who noted that he wants Russia to “greatly step up their fight” against Islamic

State (IS, formerly ISIS/ISIL).

Trump sent out the tweets after a Washington Post story accused him of revealing highly classified information to Russian officials during last week’s Oval Office meeting.

“We had a very, very successful meeting with the foreign minister of Russia,” Trump said on Tuesday, answering a question at a White House event with Turkish President Recep Erdogan. “We want to get as many to help fight terrorism as possible. And that’s one of the beautiful things that happening with Turkey.”

The cocktail reception heard the fabulous band, The Sensation Showband, entertain. Several guests enjoyed dancing to the music prior to the dinner.

entertained for dancing after dinner. There was a large live auction during the cocktail hour and an active auction just before dessert was served.

There were nine dynamic auction items to help raise money for this worthy cause.

They brought in A. J. Lambert, the granddaughter of old blue eyes, Frank Sinatra. Sinatra was a Valley resident, singer, actor and more who was loved and famous all over the world. The event starts

with a delectable dinner and refreshments before the show.

Lambert comes on stage to tell everyone that she will be singing the songs of a Sinatra album, “In The Wee Hours.” She told about how the album was conceived differently at that time.

Producers told singers what to sing, but Frank Sinatra wanted to do an album with songs that told a story from

She said the stories in the songs were part of his ups and downs in life. She didn’t know if the songs were picked because of this romances or losses but the songs did tell a story, and it was a lot about his feelings at the time.

Thompson in Palm Springs. David and L.D. introduced the brand new Program Manager, John Casey to the guests. Casey has years of experience and will bring his ideas to help this fresh important program in our Desert.

Board members were also introduced along with Program Directors and the House Managers. The newest resident to Sanctuary is a young woman who will finish High School at the end of the year and is so excited to be able to go to a home that will help her. The Residents will be kids who are 18 up till their 21st birthday that came from Foster Homes and have no

place to go. The first house will be operational the end of May, and the other will open in August. They already have kids who are looking forward to being in one of the homes.

Many of these kids have terrible stories of loss of family when they came out to abuses and bullying. These homes will give them dignity and a place of safety with kids who came from similar circumstances. Sanctuary started with just one donated home and now has two houses that will have six kids in each home, and the homes will be gender neutral. People have donated their time to upgrade these homes to be a place for kids who have met the standards required by law.

She sang one of my favorites from the album, Mood Indigo, which she sang with a lot of emotions. Then she sang many more songs from that Album. She has a great voice which she inherited from her Granddad and Mom. She talked lovingly about her grand father and her time with him.

I noticed her mother Nancy Sinatra was in the audience to support her

daughter. What a nice tribute to have her Mother in the audience just before Mothers Day. Purple Room owner, Michael Holmes, graciously posed for a photo with Nancy Sinatra before the Show.

The room was very quiet, so they were definitely enjoying her performance. There are a lot of other singers coming soon. Everyone can always dine on the great

procedures, architectural standards, or other topics.

However, many associations are not aware that each association, regardless of size, must have five sets of rules prescribed by statute.

Election rules: Civil Code 5105 requires associations to have election rules. The statute gives the basic requirements of election rules.

These rules would apply not only to board elections, but also to any matter on which a membership vote is required and which requires the 30 day notice and other procedures required by Civil Code 5100(a). These rules must conform to the bylaws, but also can add additional requirements regarding candidate eligibility, per the appellate case of Friars Village v. Hansing from 2013.

Internal Dispute Resolution (“IDR”) Policies: Civil Code 5905 requires all associations to adopt a fair and reasonable policy to establish an IDR procedure,

in which a homeowner may meet with another homeowner or the board to try to work things out short of litigation. If an association fails to create such a policy, Civil Code 5915 sets forth the procedure.

Architectural Modification Request Procedures: A frequent board and management function is to respond to homeowners who wish to modify their residence or adjacent common area.

Civil Code 4765 requires associations to have a written procedure for the process.

If the association has no procedure in its rules, then homeowners and board alike have no guidance as to how applications are to be processed.

Assessment Delinquency Enforcement Policies: Civil Code 5730 recites detailed disclosures regarding association handling of delinquent assessments, and under Civil Code 5310(6) is part of the Annual Policy Statement to be published

to members. Civil Code 5310(7) also requires that the association policies in enforcing lien rights be specified and annually given to members. Associations might adopt the contents of Civil Code 5730 as rules and then add any lien enforcement policies to satisfy Section 5310(7).

Schedule of Fines: Most associations have a practice of imposing fines, after a hearing, to discourage members from violating association rules and covenants. However, many do not know that the only fines which can be imposed are those which are disclosed in the association’s written rules. Civil Code 5850(c) restricts fines to those as stated in the written fine schedule in effect at the time of the violation.

Each of these five rule sets apply to all residential or mixed use common interest developments in California.

The IDR, delinquency,

architectural modification application procedures, and the schedule of fines must be disclosed annually as part of the Annual Policy Statement under Civil 5310.

Each of these rules must be adopted pursuant to the process in Civil Code 4360, so remember to give the members the exact text of the proposed rule change at least 30 days before the board vote on the proposed changes, and allow for open forum comments before adopting the rules.

By Janice Gough Investors should begin to re-balance their portfolios if they are to make further gains this year. Forecast from many investor analysts sees most markets ending the year about where they are right now, citing that the market has already made the majority of gains for the year.

The S&P500 achieved these returns during this recent cycle. Mid-to lower, singledigit returns are expected from the S&P 500. With an expectation of future volatility there may be some opportunities for those who can make changes and rebalance, as opportunities arise. Most asset classes are up currently, however, that’s not a condition expected to persist. All asset classes, with the exception of commodities, are higher. Commodity prices are expected to trade within a very narrow range of values in the coming year.

According to analysts, here are some suggestions for opportunities in today’s environment and investments that may reward investors.

High quality stocks added to a diversified portfolio, which is regularly rebalanced could provide more stability.

Some sectors to consider are industrials, consumer discretionary, financials and health care sectors.

Consumer discretionary sector encompasses durable goods, apparel, leisure and entertainment, and automobiles. Considering

the current volatility in the sectors of energy, utilities and consumer staples, low growth is expected. Opportunities could emerge in industries who will benefit from trends such as globalization, growing and aging populations, and alternative energy.

Real estate investment trusts should benefit from their relatively attractive yields and potential for growth as the current recovery continues to support demand for real estate.

Alternatives are good investments in many markets for more sophisticated investors. Alternative investments’ potential may enhance both returns and diversification while also protecting against the downside risk and can be used by qualified investors seeking to build more flexible portfolios, especially as the economic and credit cycles mature. Strategies that have low net exposure profiles, such as “equity hedge” and “relative value” can be used to offset volatility. Strategies like these allow investors to participate in global equity, credit and fixed income markets without having to rebalance. Investors who make portfolio adjustments as opportunities arise, will be more likely to achieve their long-term investment goals.

If you have invested in bonds, you may consider moving up in credit quality.

The U.S. dollar appreciation could negatively affect performance of investments in developing markets. There is the potential for wide swings

in the currency’s value as markets adjust to normalizing interest rates and inflation.

Consideration should be given to currency factors and oil prices when adding international bond exposure.

As interest rates continue to rise, active strategies should be employed to mitigate downside risks and capture the upside of the market.

Equal Pay for Women Would Cut Colo. Poverty Rate in Half DENVER – How many moms asked for equal pay for Mother’s Day?

By Desert Star Staff Women are now the sole or co-breadwinner in half of American families with young children, and if they were paid the same as comparable male workers, 26 million children across the U.S. would benefit, according to new analysis by the Institute for Women’s Policy Research.

Study director Jessica Milli, a senior research associate at the institute, stresses closing the gender wage gap is much more than a women’s issue.

“The additional income that equal pay would add to family incomes would reduce the poverty rate among children by nearly half, and so that was also a really striking finding from our analysis,” she states.

The report found Colorado’s poverty rate would drop from 5.6 percent

to under 3 percent.

Milli says the pay gap isn’t always a result of unfair bosses – it’s partly because more women work in jobs that have traditionally paid less.

But Milli contends new policies, such as prohibiting employers from asking applicants for their salary histories, would prevent lower earnings from following women into new jobs.

Researchers compared women and men of the same age, education levels and working the same number of hours.

In Colorado, women would see a bump in pay of more than $5,800 a year if paid the same as men.

Milli notes equal pay would also boost states’ economies.

“Equal pay would add more than $500 billion in

Prepare for “Age Tax” Under Health Care Bill, Say Opponents

By Desert Star Staff NASHVILLE, Tenn. -Analysts predict insurance premiums could go up by as much as $8,000 for people 50 and older under the American Health Care Act that will go before the U.S. Senate in the coming days.

In addition to removing

protections for people with pre-existing conditions, the bill would allow insurers to charge as much as five times the premiums for older policyholders compared to their younger counterparts. The plan is raising concerns for people like Cecilia Munoz, who served as director of domestic policy

in the Obama administration.

“The AARP is calling what the House passed an ‘age tax.’ If Congress is going to be tinkering with health care coverage, they should be focusing on ways to make sure that costs go down, rather than up,” Munoz said. “The results of what the House passed are

really very clear: people lose coverage, fewer people will have coverage; the people who have coverage will be paying more for their premiums.”

AARP estimates premiums would increase for all ages starting at about age 46. While people between the ages of 20 and 29 will see some savings, it would amount to about $700 a year. The advocacy group also estimates 40 percent of adults ages 50 to 64 have a pre-existing condition that could cause their coverage to be denied.

Dave Chaney, vice president with the Tennessee Medical Association, said he and others are concerned about any possible reduction in state block-grant funding that supports programs such as TennCare.

“And in Tennessee we’ve supported block grants, or a per-capita allotment, to give the flexibility in how we administer our Medicaid program or TennCare,” Chaney said. “But

The meeting was packed as people for and against voicing their thoughts on the proposed now 40 mile path for walkers, golf carts and bikers.

Cathedral City resident Leititia Collins said, “We provide rides for people that have physical disabilities, and we ride low profile bikes.

on the road safely, visibility is much lower, and we need a safe place to ride.”

Palm Springs resident Anna Nevenic said, “This is just something that will be used by the people who do not live here, local people will get no benefit at all and we are the ones paying the price, so what is for us: nothing.”

Munoz said “making the plan better” means looking at ways to lower medical costs and prescription drug expenses.

Immigrants: When ICE Comes Calling, Be Prepared

By Desert Star Staff PHOENIX – Families of mixed immigration status in Arizona are being told to make a plan.

Under President Donald Trump’s new immigration policy, just about anyone who lives in the U.S. who is not a legal resident can be deported, sometimes quickly.

U.S. Immigration and Customs Enforcement agents are stopping people on their way to work, or when they appear for a routine meeting.

In two recent Phoenix cases, parents were detained and deported in less than 48 hours.

Abril Gallardo, program developer with the immigrants’ rights group Living United for Change in Arizona (LUCHA), says that doesn’t give a family much time to react.

“They should be connected with an attorney,

but also have a plan in case the individual – their family member, their loved one – is detained,” she stresses.

Almost two-thirds of undocumented immigrants have lived in the U.S. for a decade or longer, and many own homes or have children who are U.S. citizens.

Gallardo says these families need to decide ahead of time who will watch the children and take care of their property if an adult family member is detained.

Trump maintains the crackdown is needed to protect public safety.

Recently, LUCHA went door-to-door through parts of Phoenix, handing out flyers and telling immigrants about their rights should ICE agents come knocking.

Their advice? Don’t open the door unless agents have a warrant, and don’t sign anything without

“There is uncertainty. But I think all of that together is moving people to take action.”

Immigrants’ Advocates Rally at Calif. Capitol for “Sanctuary State”

By Desert Star Staff SACRAMENTO, Calif. -Advocates for immigrants are promoting the idea of making California a “sanctuary state,” with a big rally this morning on the steps of the Capitol

building in Sacramento.

Monday is the 21st annual California Immigrant Policy Day, and groups are showing support for Senate Bill 54.

Known as the California Values Act, it would ban

immigration enforcement at public schools, libraries, courthouses and hospitals.

Jon Rodney is communications director with the California Immigrant Policy Center, which is coordinating

the event. He said the Golden State should resist the Trump Administration’s deportation policies wherever possible.

“This year, all of us have a choice,” Rodney said. “Will we be complicit in the federal government’s cruel persecution of our neighbors and our loved ones? Or will we stand up for our values of equality, dignity and community?”

The State Senate has already passed SB 54, and it now goes to the Assembly. The bill instructs local police not to notify Immigration and Customs Enforcement when they’re about to release people who are undocumented, except for those convicted of serious, violent felonies.

By Desert Star Staff Nutrient-rich foods are disproportionately wasted at high rates, says a new study that researchers believe could breathe new life into solutions addressing the nearly 40 percent of food wasted out of all produced in the US. Between 30 and 40 percent of food produced in the US is wasted at one point or another in the supply chain.

Yet, past studies of American food waste have not included information on the nutritional content of this wasted food.

Researchers at the Johns Hopkins Bloomberg School of Public Health’s Center for a Livable Future sought to remedy this, using Loss-

Adjusted Food Availability data from the US Department of Agriculture to calculate the nutritional value of food waste for 213 commodities in 2012.

On Monday, researchers revealed their findings in the Journal of the Academy of Nutrition and Dietetics.

Focusing on 27 different nutrients, researchers found that the “lost nutrients” of food wasted in the US in 2012 could have supplied 1,217 calories, 33 grams of protein, 5.9 grams of dietary fiber, 1.7 micrograms of vitamin D, 286 milligrams calcium and 880 milligrams potassium per person, per day.

“Our findings illustrate how food waste exists alongside inadequate intake of many

nutrients,”said Marie Spiker, the study’s lead author.

For instance, the amount of dietary fiber wasted daily could provide for more than 73 million American women, a group that under-consumed fiber by 8.9 grams per day in 2012.

In addition, “the daily amount of wasted dietary fiber is equivalent to the amount needed to fill this nutritional gap for as many as 206.6 million adult women,” the study found.

The authors said that food waste occurs in a variety of ways, and there is currently new and developing awareness of how to curb such waste in the face of so much need. They believe their approach of analyzing

the nutrients that are wasted in this process could help reframe food recovery efforts.

“This study offers us new ways of appreciating the value of wasted food. Mother’s Day Health “Garden” Planted Opposing Health Bill

By Desert Star Staff SALT LAKE CITY – In honor of Mother’s Day, activists with the group, Utah Indivisible, concerned about the impacts of the American Health Care Act, planted more than 300 paper flowers outside the offices of Utah’s congressional delegation Monday.

Kellie Henderson - one of the event’s organizers - says each flower has the name of a constituent on the front, and on the back is an account of how the new health-care law making its way through Congress would affect them or their families.

“People who are afraid for their mother who is a cancer survivor, or their children who are born with heart conditions, or their brother who uses Medicaid and relies on those services and would be hurt by cuts,” she explains.

The flowers were

delivered to representatives in the afternoon.

Backers of the bill say people with pre-existing conditions still could get coverage in high-risk pools, and claim shifting Medicaid costs to states will allow for more innovative approaches to covering children and low-income residents.

According to a national poll released last week, just 21 percent of voters support the proposed law.

The Congressional Budget Office estimates that 24 million Americans would lose coverage under the AHCA. Henderson attended a town-hall meeting last week with Rep. Chris Stewart, a Republican in Utah’s 2nd District, and disagrees with his claim that lost coverage would only happen by choice.

By Desert Star Staff Two women have sued Walmart, America’s largest private employer, claiming it discriminates against pregnant employees. The suit seeks class-action status, and comes as a settlement has been proposed in another discrimination case against the company.

Talisa Borders and Otisha Woolbright say that, until 2014, Walmart had a company-wide policy that denied pregnant workers the same accommodations as workers with other disabilities, treating expectant mothers as “second-class citizens.”

That policy, they said, was in violation of federal law, which requires employers to treat pregnancy as a temporary disability and provide work accommodations to pregnant women. Such accommodations include providing “light duty, alternative assignments, disability leave, or unpaid leave to pregnant employees if it does so for other temporarily disabled employees,”according to the US Equal Employment Opportunity Commission (EEOC).

If the proposal to turn the case into a class-action lawsuit is accepted, it could include at least 20,000 women and possibly up to 50,000 who worked at Walmart while pregnant before the policy was changed.

Borders worked at a Walmart in Illinois, where she was reprimanded for asking her co-workers to climb ladders and lift heavy boxes for her during her pregnancy. She was forced to take unpaid leave, and her pay was $2.00 less per hour when she returned, according to the lawsuit.

Woolbright worked at a Walmart in Florida. Her manager in the deli department told

her that pregnancy was “no excuse” for avoiding heavy lifting, according to the lawsuit.

She was fired after injuring herself lifting trays that weighed up to 50 lbs and then making inquiries about Walmart’s pregnancy policy, she said.

In March 2014, the Arkansas-based company changed its policy, but lawyers for the two women say the new version did not go far enough to protect expectant employees, and they are considering filing a second lawsuit over the new policy, Reuters reported. It is unclear whether that separate lawsuit over the new policy would also seek class-action status.

One woman who could join the second lawsuit is Candis Riggins, who filed a pregnancy discrimination charge with the EEOC against Walmart in December 2014, after the company changed its policy.

Riggins was a maintenance worker in Maryland, and became sickened by toxic cleaning chemicals she was using at work. When she gave her Walmart managers a doctor’s note and asked to be temporarily transferred to another position during her pregnancy, she was instead told twice to take a career preference test, the complaint read. She was never reassigned, and was eventually fired, two months after the new pregnancy policy went into effect.

“I didn’t hear back from anyone,” Riggins told the Washington Post at the time she filed the complaint.

“Even though I wasn’t able to stomach anything.”

In response to Riggins’ case and those like hers, Senator Bob Casey (D-Pennsylvania) introduced the Pregnant Workers Fairness Act in June 2015, but it never gained any

Cote, worked as an associate in Massachusetts from 2006 to 2012. During the annual open enrollment periods for benefits, Cote attempted to add her wife to her insurance. Samesex marriage has been legal in the Bay State since 2004.

“When Cote entered her spouse’s gender as ‘female,’ the online system would stop her from proceeding further,” the lawsuit said. “When she called Walmart’s home office to investigate, she was told

that Walmart did not offer health insurance coverage to same-sex spouses.”

Walmart changed its policy in 2013. By that point, Cote’s wife was battling ovarian cancer, and faced $150,000 in medical bills. Her wife died last year.

The proposed settlement between Walmart and its current and former employees is $7.5 million, the Springfield Republican reported. A fairness hearing is scheduled for Monday.

How to Cash in on the Gig Economy

By Desert Star Staff There’s an exciting career revolution taking place for those who want to call their own shots, set their own schedules and control their destinies. Say hello to the “gig economy,” a booming new job market.

Nowadays more and more Americans are becoming a part of this employment shift. In fact, according to a CareerBuilder survey, 29 percent of workers have some sort of side hustle, especially millennials -- 44 percent of 2534 year-olds and 39 percent of those between 18-24 report having a side gig. According to a Princeton University study, the percentage of workers engaged in alternative work arrangements rose from 10.7 percent in February 2005 to 15.8 percent in late 2015, while employment in traditional jobs rose by only 0.4 percent during the same period.

These days, being a freelancer, consultant or independent contractor might mean selling goods through a company like Arbonne or running a home-based business. NYC Freelancers Get Protection from Wage Theft

By Desert Star Staff NEW YORK – Freelance workers and independent contractors in New York City now have added protection from people who don’t pay.

The Freelance Isn’t Free Act went into effect on Monday.

More than a million New Yorkers work as freelancers, and according to Caitlin Pearce, director of member engagement for the Freelancers Union, more than 70 percent have been cheated out of pay they’ve earned at an average of $6,000 a year.

who hire freelancers will have to use a contract, will have to pay within 30 days, and if they pay their freelancers late then they’re going to be facing a host of different types of penalties,” she explains.

Penalties can include double damages and attorney fees. The Freelancers Union hopes the law becomes a model for other cities and states around the country.

The New York City Department of Consumer Affairs will be assisting freelancers who are having problems getting paid. And

as Pearce points out, the definition of “freelancer” in the law is quite broad.

“As long as you’re working for yourself and you’re a 1099er and you’ve been

doing more than $800 worth of work over the course of four months, the law would apply to you,” she adds.

Between 2005 and 2015, the percentage of American workers in “alternative work arrangements” increased from 10.1 percent to almost 16 percent.

Pearce adds that it’s often hard to find legal help to collect relatively small amounts of money, so the Freelancers Union also has launched a new smartphone app to put freelancers in touch with a team of 30 attorneys.

“So if someone is having a nonpayment issue, they can just come to us, and download our app, and connect with one of our lawyers,” she says.

The phone app is available on the web at freelancersunion.org.

Guardians Rock the Galaxy Once Again in Vol. 2

by Vin Diesel) is now an adorable part on the team.

As in many comic book style adventures, the story begins with a battle. In the end, the Guardians, who are working for a golden queen,

are victorious. However, things take a turn for the worse when Rocket, the fast-talking rascal raccoon (voiced by Bradley Cooper) steals some high-powered batteries for no reason. He did it just because he could. This was a bad idea and incurs the wrath of the queen and her golden minions.

Family twists and turns are coupled with sibling rivalry between Gamora (Zoe Saldana) and her estranged younger sister Nebula. Will

Dark moments at The Arthur Lyons Film Noir Festival

By Pam Price It’s a daunting albeit deliciously devilish retrospective of 20th century’s classic Film Noir films, from Address Unknown (1944) to Charley Varrick (1973). The 18th Annual Arthur Lyons Film Noir Festival produced and hosted by Alan K. Rode at the Camelot Theater and presented by the Palm Springs Cultural Center opened on May 11th with nary an empty seat in sight. The new, comfortable seating meant few people could be bothered to

get up even for popcorn and cookies. By 7:30 PM, after a briefing by Mr. Rode, the opening film Hollow Triumph , a restored 35mm print took avid back to downtown Los Angeles in the late 1940’s and a rather psychiatric, psychotic plot that twisted and turned, filling 83 mysterious moments like a nonstop Tommy Gun. The film was followed by a post screening discussion with Monika Henreid, daughter of the film’s main character, Paul Henreid (who famously played Victor Laszlo in Casablanca).

Each film is accompanied by guest stars who put their own spin on films that still turn movie fans on, despite the absence of digitized drama.

The Film Noir Foundation , a registered 501 (c) (3) nonprofit organization continues to rescue “orphaned examples of one of cinema’s greatest artistic movements” and is supported by patrons worldwide. Alongside Mr. Rode are Eddie Muller, known as “The Czar of Noir” and host of the new Turner Classic movies Franchise, “Noir Alley” airing

Sundays at 10AM EST and Foster Hirsch, author of 16 books focused on theatre and film including my favorite, Film Noir: The Dark Side of The Screen. You’ll find him at Brooklyn College in New York where he has been for teaching for fifty years. Jonathan does not drive and was coming from Imperial County with friends. Those friends have not been identified or interviewed. It is believed that Jonathan and Audrey did meet at an unknown location sometime on Wednesday, May 10, 2017. Friends and family tried to contact both Audrey and Jonathan throughout the day and night on Thursday, May 11, 2017. Audrey’s family

reported Audrey missing in the early morning hours of Friday, May 12, 2017.

The vehicle was recovered by IPD and the initial search of the vehicle showed no signs of foul play or forced entry. The vehicle was fueled and operated normally when started.

Detectives continue to follow-up on all leads old and new. The investigation is

US workers testing positive for illegal drugs hits 12yr high

By Desert Star Staff More than one in 25 American workers tested positive for illicit drugs during employer tests last year, with cocaine and amphetamine positivity increasing rapidly, according to analysis by a top workplace drug-testing lab.

Detection of cocaine, marijuana, amphetamines went up significantly in 2016 workplace drug testing, while heroin positivity remained mostly steady, Quest Diagnostics announced Tuesday.

The 2016 annual positivity rate among the combined US workforce was 4.2 percent, Quest said, a 5 percent relative increase over 2015’s rate of 4.2 percent and the highest since 2004’s 4.5 percent.

“This year’s findings are remarkable because they show increased rates of drug positivity for the most common illicit drugs across virtually all drug test specimen types and in all testing populations,”said Barry Sample, senior director of science and technology at Quest Diagnostics Employer Solutions.

The positivity rate for cocaine via urine testing increased for the fourth

consecutive year among the general US workforce and the second straight year for the so-called federally-mandated, safety-sensitive workforce.

The latter category includes the likes of pilots and bus drivers who are routinely tested for drug use pursuant to federal law.Cocaine positivity went up 12 percent in 2016, hitting a sevenyear high among the general workforce, Quest reported.

Marijuana positivity has increased “dramatically” in the last three years, Quest said, due in part to recreational legalization in some US states.

Marijuana positivity through oral fluid testing has gone up by 75 percent since 2013 among the general US workforce and has also risen in both urine and hair testing. Among the federally-mandated workforce, marijuana positivity increased by ten percent from 2015.

Both Colorado and Washington state, the first two states to legalize recreational marijuana in the US, had urine positivity rates for marijuana that exceed the national average, Quest reported.

Amphetamine positivity via urine testing increased from 2015 among both classes

of workforces, the company said. After years of decline in the mid-2000s, then a steady rate from 2008 to 2012, amphetamine positivity is on the rise; it went up 64 percent in 2016 among the general workforce and 14 percent among the federallymandated workforce.While the opioid epidemic in the US has reached new heights, urine testing positivity for heroin remained steady among general workers and declined

among the federally-mandated, safety-sensitive workforce.

These numbers differ from the four straight years of increases prior to 2016, Quest said.

Positive tests for prescription opioids such as hydrocodone, hydromorphone and oxycodones declined in urine tests for the general workforce, Quest found.

The drug-testing data are part of the annual Quest Diagnostics Drug Testing Index, which the company

will present this week at the Drug and Alcohol Testing Industry Association conference in Florida.

Positivity rates were generally the highest in the US South, according to Quest.

Alabama and Oregon had the highest rates (6.3 percent), followed by Arkansas (6 percent), North Carolina and Vermont (both 5.7 percent), and Louisiana and South Carolina (both 5.6 percent).

By Desert Star Staff Bullying is a major problem at US schools, according to a new report which found that students are often shoved, hit and kicked by their peers.

It also states that reports of sexual assault have more than tripled on university campuses over the past decade. The study by the National Center for Education Statistics (NCES) and the Justice Department, released Tuesday, examined school crime and safety in US schools.

It found that one out of every five middle and high school students has complained of being bullied.

Specifically, 21 percent of students aged 12-18 reported

being bullied in 2015.

The research examined students grade-by-grade, finding that “in the spring of 2014, about 15 percent of third-graders reported that they were frequently teased, made fun of, or called names by other students.”

In addition, 22 percent of third-graders were “frequently the subject of lies or untrue stories,” while 14 percent were “frequently pushed, shoved, slapped, hit, or kicked.” Fifteen percent were frequently excluded from play activities on purpose.

Meanwhile, around 15 percent of fourth-graders and 7 percent of eight-graders reported being bullied “at least

once a month,” the report states. The figures were even more disturbing for gay, lesbian and bisexual students, with 34 percent of those identifying as LGBT complaining of bullying, compared to 19 percent who identified as heterosexual.

The report also found that black students are disciplined more frequently than other students. In 2012, 15 percent of African-American students received out-of-school suspensions, compared to just 6 percent of all students.

While figures from the past decade indicate that bullying seems to be on the decline overall, study author Lauren Musu-Gillette says there remain “areas of concern in

terms of bullying and rates of victimization being high.”

“We are seeing a longterm decline, but we still want people to be paying attention to areas where rates are still high,” she said, as quoted by AP. While bullying is going down, however, sexual assaults appear to be on the rise. The study found that such reports have more than tripled on college campuses over the past decade.

Sexual assault reports jumped from 2,200 in 2001 to 6,700 in 2014 – a 205 percent increase. However, Musu-Gillette warned that it’s not clear whether the number of actual sex crimes

has increased or whether victims now feel safer reporting them to authorities.

In addition, although some positive findings were revealed in the report – including a decrease in students carrying weapons and consuming alcohol – NCES acting commissioner Peggy Carr said “there is much work left to be done.”

“The data show that many students do not feel safe at school and are victimized physically, verbally and emotionally,” she said.

State Senate Committee Presses Pause on 5G Wireless Bill

By Desert Star Staff SACRAMENTO, Calif. – Opponents of a bill intended to smooth the way for the rollout of next-generation cell technology are cautiously optimistic - after a key committee put the measure on hold on Monday.

The state Senate finance committee put Senate Bill 649 in the suspense file - in the face of vocal opposition from groups concerned that the 5G technology emits harmful millimeter-wave frequencies when compared with the 3G and 4G now commonly in use.

Josh Hart, director of the group, StopSmartMeters. org, says the bill would limit local governments’ ability to use zoning laws to block the proliferation of these towers near schools, hospitals and residential areas.

“This bill was basically written by the Cellular Telecommunications Industry

Association, the CTIA,” he says. “This is their wish list. Local governments are the biggest impediment to them putting wireless wherever they want to.”

Supporters of the bill say it will boost the economy by encouraging the spread of super-fast wireless connections in the Golden State.

The bill already sailed through the governance and finance committee but faced determined opposition from advocates on Monday, who organized hundreds of people to call into the hearing on a central conference line and express their concern.

A recent study by the National Toxicology Program found that male rats exposed to cell phone-like signals had a higher incidence of brain and heart tumors, compared with a control group.

By Desert Star Staff Those familiar with Parkinson’s disease (PD) are likely aware of the disorder’s most visible symptoms, including slower movements, impaired balance, rigidity/ stiffness and involuntary shaking. However, Parkinson’s, which is a neurodegenerative brain disorder, can cause a range of non-motor symptoms, which can bring about a new set of challenges for people with Parkinson’s and their caregivers.

It’s important to learn more about these nonmotor symptoms, such as hallucinations, delusions and mood disorders, so you can be sure to discuss them with your doctor.

1. Hallucinations. More than half of all people with Parkinson’s will experience hallucinations or delusions over the course of their disease. Hallucinations can

cause people to see, hear, or experience things that aren’t real. For example, people with Parkinson’s commonly report seeing groups of people or animals that in actuality are not there. As hallucinations become more frequent, people with PD may become unable to distinguish what’s real and what’s imagined and react to their hallucinations.

Hallucinations can lead to increased patient and caregiver distress, and even nursing home placement.

2. Delusions. Delusions are false beliefs not supported by evidence, and in people with Parkinson’s, delusions often have paranoid themes.

For example, a person with Parkinson’s might make accusations about their spouse or someone else trying to access their life savings. Another common delusion is even a longtime spouse committing adultery.

Depression, anxiety and irritability can also affect those with PD. In fact, one study showed that up to 40 percent of people with Parkinson’s will experience some form of anxiety during the course of their illness.

6. Additional Non-Motor Symptoms. The non-motor symptoms of PD are numerous, ranging from vision problems to hypertension to loss of sense of smell. These symptoms can also appear before a PD diagnosis and should be noted.

8yo ‘knocked unconscious & beaten’ at Cincinnati school

By Desert Star Staff An eight-year-old boy was knocked unconscious by a fellow student before being kicked and beaten by several others, footage from a Cincinnati elementary school reportedly reveals.

The third-grader committed suicide just two days after the vicious assault.

The footage, filmed on January 24, takes place inside a restroom at Carson Elementary School, according to Cincinnati homicide detective Eric Karaguleff, as cited by the Cincinnati Enquirer.

According to Karaguleff, the video shows a boy in a red and gray coat enter the bathroom, prompting other children to leave.

The boy punches another child in the stomach, “sending him to the floor in all fours” and threatens another.

Gabriel Taye, 8, then walks in and tries to shake hands with the boy. The boy in the red and gray coat then yanks Taye to the ground and “appears to celebrate and rejoice in his behavior” as Taye lies motionless.

Taye appears to have been knocked unconscious. For almost five minutes after the attack, “many students step over, point, mock, nudge, kick, etc.,” the boy. The family’s

lawyer, Carla Leader, says Taye was unconscious for about seven-and-a-half minutes.

Eventually, assistant principle Jeff McKenzie enters the bathroom and discovers the eight-year-old lying on the floor.

The school did not tell Taye’s mother, Cornelia Reynolds, that he had been assaulted, nor that he had been knocked unconscious, according to attorney Jennifer Branch, who is also representing the family.

Instead, the school told her that he had fainted and was in the nurse’s office with normal vital signs.

“If the school had told her what had happened to him in the bathroom, that he was unconscious for such a long period of time, she would have taken him to the hospital immediately, reported that to the medical professionals, and she would have called police,” Branch said.

Taye was picked up from school and taken home. Later that evening, he became nauseous and vomited twice.

His mother took him to Cincinnati Children’s Hospital Medical Center. The boy, according to Branch, only told his mother that his stomach hurt, noting that the mother believes he did not remember what had happened.

The boy stayed home from school the next day, but returned two days after the attack. After school, he went to his bedroom and hanged himself from his bunk bed with a tie.Although the school system initially refused a request by the Enquirer to release the video of the assault, it has since agreed to do so. Cincinnati Public Schools (CPS) spokeswoman Janet Walsh said it would be released “when it’s ready,” after it is edited to blur the faces of the children involved.

CPS has not addressed the allegation that Taye’s mother was not told what happened.

However, Walsh said on Thursday that Detective Karaguleff “mischaracterized the events in the video,” AP reported. She claims video evidence does not support the claim that Taye was being beaten by other students during the incident.

A statement from the school system claimed the school “immediately followed protocol” by calling the school nurse to evaluate Taye, and said the nurse advised the mother to take him to the hospital “to be checked out.”

Responding to that claim, Branch said that no one from the school had told Taye’s mother that he should be

taken to the hospital, adding that if she had been told what happened, she “would have taken him to the hospital and not let him return to Carson.”Taye’s family did not learn about the video until March, while their lawyers were investigating the boy’s death. They decided to release details of the footage this week, hoping that parents of other students involved might come forward with further details of what happened, Local 12 News reported.

News of the footage has also prompted the

office of Hamilton County Coroner Lakshmi Sammarco to ask police to reopen the investigation. The cause of death was initially marked as homicide.

“It was very hard for me to believe that an eight-yearold would even know what it means to commit suicide so I asked Cincinnati police to treat this as a homicide until proven otherwise and investigate it fully,” Sammarco told WLW Radio.

Research Links Low Birth Weight to Poverty, Stress

Researchers from The Ohio State Wexner Medical Center assessed financial strain, depressive symptoms, anxiety and pregnancy-specific stress among 138 pregnant women, and then reviewed the surveys after their babies were born.

Lead author Amanda Mitchell says prior studies have shown a greater risk of low-birth weights among socioeconomically disadvantaged mothers. And these new findings reveal specific pregnancy-related worries also play a factor.

Faith Communities Help OR Immigrants Targeted for Deportation

PORTLAND, Ore. – As immigration officials ramp up detentions and deportations in Oregon and across the country, immigrant families are left wondering how to prepare.

The Trump administration’s new policy leaves nearly everyone in the country that is not a legal resident open to deportation.

In Oregon, Immigration and Customs Enforcement (ICE) agents have targeted undocumented immigrants outside courtrooms and on their way to work, including the recent detention of a father of five living in Sandy.

Rae Anne Lafrenz, a coordinator for the Interfaith Movement for Immigrant Justice in Oregon, says immigrant families should “expect the best and prepare for the worst.”

“You need to have powers of attorney signed,” she stresses. “If you as a mother or a father are detained, who will take care of your kids?

Who’ll pick them up from school? How can you pay the rent? What sort of support structure do you have?”

Lafrenz also advises people not to open their door for ICE agents unless the agents have a warrant.

Almost two-thirds of undocumented immigrants have lived in the U.S. for a decade or longer, and many own homes or have children who are U.S. citizens.

President Donald Trump says the new, tougher immigration policy is needed to protect public safety.

The administration has also authorized expedited deportations, meaning people

can be removed from the country without seeing a judge.

Lafrenz says there are ways that members of the community who aren’t immigrants, but are concerned about the new policy, can help.

“I think it’s really important right now, for anybody who’s

interested in this, for anybody who’s angered by this and anyone who’s motivated by their conscience to work, is to connect with an immigrants rights organization, or connect with an immigrant-led organization,” she stresses.

“And they’re all over this state.”

Lafrenz says faith communities have been on the front line of protecting immigrants in the U.S. for decades, building a sanctuary movement during the 1980s and continuing it over the last 20 years. In her view, the crackdown on immigrants is a violation of human rights, which means it’s also a matter of faith.

“People of faith have been one of the first to take action when human rights are being violated,” she states.

“And I think that’s mostly because, coming from a place of faith, whatever tradition that is, when we have a faith tradition that compels us to act and we ignore it, we’re violating our own principles.”

Mark Taper Forum delivers a dark potent comedy in “Archduke”

By Jack Lyons, Theatre and Film Critic Playwrights can generally get away with a lot when dealing with subject matter that is uncomfortable to some, and fraught with danger to others, but nonetheless, need to be discussed in a public forum format.

The only vehicle for the exploration of odious and repellent subject matter often comes via the clarity that the genre of comedy provides.

Satires or farces are the favorite choices of playwrights that want to get a ‘tough sell’ message across. The great French, 17th century playwright Moliere employed the genre in order to have his head remain firmly attached to his shoulders during his lengthy writing career during the Divine Right of Kings era in Europe.

Cleveland-born playwright Rajiv Joseph, a journeyman writer, really had his breakthrough theatrical moment with his highly successful play “Bengal Tiger at the Baghdad Zoo”, when it premiered at Center Theatre Group’s Kirk Douglas Theatre in Culver City, CA. in 2009.

“Bengal Tiger”, then performed at the Mark Taper Forum (MTF) in 2010, before moving to Broadway; becoming a Pulitzer Prize finalist. Mr. Joseph hit his stride with “Guards at the Taj”, in 2016, again premiering at the Kirk Douglas Theatre; establishing him as a major American playwright.

Sunday, May 7th on the MTF stage in Los Angeles.

It’s the story of three dim, hapless and hungry young men suffering from tuberculosis who fumble their way through history as they take on a mission of martyrdom on the eve of World War I. They are wonderfully played by: Stephen Stocking, as Gavrilo, the lead assassin, Ramiz Monsef, as Trifko, the enforcer, and Josiah Bania, as Nedeljko, the most gullible of the three. Todd Weeks does a nice turn as Dr. Leko, the only sane grown-up in the room who attempts to keep Gavrilo from throwing away his life for a useless gesture of faux patriotism, and Sladjana played by JoAnne McGee, Dr. Leko’s cook and housekeeper manages to get in a few zingers of her own.

The gallows humor comedy is set in 1914 in the Balkan cities of Belgrade and Sarajevo. The question playwright Joseph explores is: are these three, uneducated, rural, village youths capable of becoming human bombs and martyrs? Those choices are still resonating with individuals fighting in many Middle East war zones today. It appears that the suicide bombers in “Archduke” have become the template for recruiting zealots and followers today.

The young men have been radicalized, recruited, and trained by the cynical, sly, and duplicitous Serbian Army Captain Dimitrijevic (a mesmerizing Patrick Page in a staggering performance), who is in need of naïve and gullible civilians, and these three young

men are easy marks who willingly sign up for the mission to assassinate the Austrian Archduke Franz Ferdinand and Princess Sophie, striking a blow, they believe, for an independent greater Serbia for the price of new clothes, and a few meals along the way.

Results of that mission has since been attributed as the event that set in motion WW I, ‘the war to end all wars’ … which, of course, it didn’t. War is far too profitable an industry to be totally done away with.

“Archduke”, is skillfully staged by long time Joseph collaborator and award-winning

director Giovanna Sardelli, and features a fabulous Scenic Design by Tim Mackabee, whose unique, creatively designed, on-stage replica of the Orient Express train brought a round of audience applause to open the second act. Also, visually eye-catching is a huge map of the Balkan countries that subliminally keeps the focus on the narrative of the story, as well as on the talents of its gifted ensemble cast.

Despite mentioning all of its pluses above, one gets the feeling that this fine production will undergo more tweaking, pruning and rewrites.

Broadway is a demanding mistress constantly in search of perfection. The first act is a tad long and a bit talky, but the second act is worth the wait.

Thanks to Sardelli’s direction and Joseph’s dialogue, the production seamlessly flows along bridging its 103-year history arc. Bittersweet comedy indeed, takes the sting out of ignored history lessons; easing the pain, the loss and the folly of war. Or at least, that’s the hope.
