Governor’s Multibillion Dollar Boost to Education Budget Thinks Big By Suzanne Potter/PNS SACRAMENTO, Calif. -- Education advocates are cheering Gov. Gavin Newsom’s May budget revise, which pours almost $122 billion into public schools, the highest level

of funding in California’s history. The money will support the California for All Kids Plan, a five-year strategy of public school investment. Jeff Freitas, president of the California Federation of

Teachers, said low-income school districts in particular will see big improvements. “The additional funding for summer-school programs, after-school programs, for making a universal early-

Volunteer Puppy Raisers Needed Guide Dogs of the Desert has an urgent need for puppy homes

By Desert Star Staff WHITEWATER, CA — What if volunteer work could be gratifying, meaningful, and totally adorable? It’s paws-ible with Guide Dogs of the Desert! Right now, the organization is in urgent need of potential foster families for 20 puppies by June 2021. But you can help! By becoming a volunteer puppy raiser for Guide Dogs of the Desert, you’ll be an integral part of the process that helps people with visual impairment find independence through the use of a guide dog. You’ll also spend 18 months with a smart, playful new friend.

The puppies are black Labrador Retrievers and Standard Poodles, each between 8-12 weeks old when they are placed with a puppy raiser. As a puppy raiser, your job is to help the dog learn about the world and interact with humans in various situations. The puppy will remain in your home until they are 18 to 24 months old. Guide Dogs of the Desert will be with you throughout the journey with training sessions, puppy raiser outings, Zoom meetings, and constant support. And when the puppy is old enough

to be matched with their human — well, that’s when you change someone’s life. The Coachella Valleybased Guide Dogs of the Desert is an accredited guide dog school and has been helping visually impaired students find independence and companionship through service dogs for almost 50 years. US begins first clinical trials testing cannabis as migraine treatment

By Desert Star Staff Researchers in the US have begun the nation’s first double-blind, randomized, placebo-controlled study testing the efficacy of cannabis in treating the major symptoms of migraines. Some 16 states and Washington DC have legalized marijuana use by adults over the age of 21, while 37 states have legalized medical marijuana. New Mexico and

Virginia will follow suit, but their legislation won’t take effect until the summer. Despite the recent about-face by many state legislatures on marijuana, research into the efficacy of cannabis products such as THC and CBD has yet to begin in earnest, especially in chronic pain conditions such as migraine. However, researchers at the University of California

San Diego (UCSD) recently began the first clinical trials to test whether cannabis products might be both a safe and effective treatment for acute migraines. At present, the researchers are working with 20 participants who live with frequently occurring migraines. However, they hope to expand the test subject group by an additional 70 volunteers shortly.

Acute migraines are highly debilitating, as the pain can last for hours or, in extreme circumstances, even days. At the same time, other symptoms sufferers must contend with include nausea, vomiting, and extreme sensitivity to light or sound. Despite many treatment options, those living with migraines still struggle to find adequate relief via traditional pharmaceutical or medical interventions. To make matters worse, not all patients respond the same to the currently available treatments, and even the ones that do might see the beneficial effects wane over time or cease working altogether. In the interim, people have anecdotally reported success with the use of cannabis as an alternative treatment. “Many patients who suffer from migraines have experienced them for many years but have never discussed them with their physicians. They are, rather, self-treating with various treatments, such as cannabis,” says neurologist and headache specialist

Nathaniel Schuster of UCSD. Given the lack of any meaningful research into the efficacy of cannabis or its derivatives as a treatment for chronic pain conditions such as migraines, the UCSD got to work. First, its researchers separated the volunteers into four random groups: one that received vape pens with fake cannabis, another which received four puffs of cannabis flower with the psychoactive ingredient THC still present; a third group that was given cannabis with CBD; and the final group that was administered a cannabis vape containing both THC and CBD. The team will test the efficacy of each group against common migraine symptoms such as headache pain, nausea, vomiting, and sensitivity to light and sound over the long and short term. Initial results from existing preclinical trials have already shown promise, but this study, and the likely followup analyses to come, will hopefully provide some much-needed relief for those living with intense migraines.

How Do You Know You’re Ready For Retirement?

By Desert Star Staff An intriguing find once emerged from a RAND Corp. survey on Americans and their working conditions. It turned out that 40 percent of employees 65 and older had previously retired, but something lured them back to the working world. In some cases, financial troubles might have been the cause. But often, the reason is that people neglect an essential component in their retirement planning. They don’t think about what they will do with their extra time or how they will give their life the meaning and purpose work provided, says Patti Hart, co-author with her husband, Milledge, of The Resolutionist: Welcome to the

Anti-Retirement Movement (www.antiretirement.com). “Money is certainly important, but it’s not the only thing that determines whether your retirement is a success,” she says. “It may be that you are financially ready to retire but are a long way from being emotionally ready.” The Harts offer tips for figuring out when to retire and for making sure you’re successful when you do: • Know your catalysts. Identify milestones or signs that will let you know you are ready to embark on a new post-work life, Milledge Hart says. Yes, that could be when you’ve accumulated a certain amount of savings. But it might also be related to when your spouse quits their job or when your children graduate college and head out on their own. On the other hand, maybe you plan to work until your health gives out. “Knowing your catalysts can mean the difference between successfully transitioning to a fulfilled life after your career is over or boomeranging back to the fulltime workforce simply because you didn’t know why you quit, to begin with,” he says. • Plan to avoid separation anxiety from work. For many people, moving from the excitement and fulfillment of a career to the quietness of retirement is too much, Patti Hart says. As a result, they develop a form of “separation anxiety,” longing for their

old way of life rather than venturing boldly into the new one. “You need to make a plan for what you want to do in your new post-career life, so you aren’t floundering when you get there,” she says. • Get comfortable with the uncomfortable. At work, people are thrown into awkward situations and have no choice but to face them head-on. In retirement, it’s easier to avoid discomfort, but doing so diminishes your confidence, and you miss out on opportunities for personal growth and fun, Milledge Hart says. “It would seem counterintuitive to think that being uncomfortable brings happiness, but it does,” he says. “Go at life as if it’s an

adventure – because it is. When you accomplish something you didn’t think you could, you get a jolt of endorphins that drives you to your next challenge.” • Learn to be your own best friend. Even when people want to try a new hobby or activity, they sometimes are afraid to do it alone. “In retirement, you might not have the social network you once did,” Patti Hart says. “You may long for a good friend you can rely on.” But if you think about it, she says, you already have that friend – yourself. So as you prepare for retirement, be ready to go solo on occasion. “When you get to this stage, you will often find that some things on your list are on your list alone,” she says. “No

one in your universe shares your interest or has the time to join you. That’s all right. If you are going to continue to grow, you sometimes need to feel like you did something completely on your own.” “Don’t convince yourself that in retirement, you are going to be destined to a life of watching evening game shows and baking pies, unless, of course, that is what you love to do,” Milledge Hart says. “My advice is nothing is off-limits, so reach for the stars. Look forward rather than backward, and embrace the new you.” Source: Patti and Milledge Hart, co-authors of The Resolutionist: Welcome to the AntiRetirement Movement(www. antiretirement.com)

Protections Sought for Desert National Wildlife Refuge

By Suzanne Potter The Desert National Wildlife Refuge north of Las Vegas turns 85 today, and conservation groups want to see it protected forever. The U.S. Senate is expected to hold a hearing in the coming months on the Southern Nevada Economic Development and Conservation Act. The bill would better protect 2 million acres in the refuge, Red Rock Canyon Conservation Area and more. Kevin J. DesRoberts, U.S. Fish and Wildlife project leader for the four southern Nevada refuges in the Desert National Wildlife Refuge Complex, said public lands saw a massive jump in visitors during the pandemic. “It’s essential for people to have that access and be able to connect with nature and also to learn how to be

good stewards,” DesRoberts asserted. “Because the future of all these lands and the wildlife depends on people caring about them and being good stewards of the land.” Opponents concerned about government overreach say current protections are sufficient. The area is considered critical habitat for the desert bighorn sheep, the desert tortoise and hundreds of other species. Grace Palermo, southern Nevada programs director for Friends of Nevada Wilderness, said the bill would stop a proposed 300,000acre expansion of nearby Nellis Air Force Base. “Some of their proposals include putting in landing strips, lots of roads, fencing throughout,” Palermo outlined. “And that’s going to be very impactful for May 21, 2021

the bighorn sheep. They need these big spaces.” The bill also would give Clark County more money to manage its growth by building affordable housing

and supporting initiatives to fight climate change. The Pew Charitable Trusts provided support for this reporting.

surplus in the Golden State. Freitas noted the windfall comes from taxes on the ultrawealthy who continued to prosper during the pandemic. “The unexpected revenue came in because of factors like Prop 30 and Prop 55, the millionaires’ tax that we passed a few years ago,” Freitas explained. The plan also puts

more than $3 billion toward programs to attract more teachers. The legislature now has until June 15 to pass a budget for the next fiscal year. Mainstream outlets gushed over ‘misogynistic’ book

By Desert Star Staff A former Apple employee who claims the tech giant sacked him due to internal complaints about a book he authored has pointed out that leading newspapers praised his “sexist” memoir. This week, Apple announced that Antonio Garcia Martinez, a former Facebook product manager who was hired to help develop its advertising business, was no longer with the company. Martinez, who joined the tech giant in April, became the target of an internal petition which claimed that his 2016 book ‘Chaos Monkeys’ contained “misogynistic statements” and “racist” passages. Signed by more than 2,000 Apple employees, the statement called for Martinez’s immediate termination, as well as an investigation into how the company “missed or ignored” the book’s allegedly offensive content. The petition also demanded that Apple implement a plan to ensure that it would never again hire someone who has published similar views.

Billed as an autobiography, ‘Chaos Monkeys’ details Martinez’s experience working in Silicon Valley. The petition cited one passage in which he describes women in the Bay Area as “soft and weak” and “generally full of s**t” despite their attempts to appear sophisticated. In another excerpt highlighted by the complaint, Martinez likens an Indian colleague to a “bored autorickshaw driver.” Announcing his departure, Apple said in a statement that it was committed to creating an inclusive work environment and that “behavior that demeans or discriminates against people for who they are has no place here.” Martinez responded in a series of tweets, claiming that the company had “actively

recruited” him and alleging that the decision to terminate him in response to the internal protest was a “snap decision.” He further stated that the insinuation that he was guilty of misconduct during his time at Apple was “defamatory and categorically false.” While some on social media seemed to think Martinez got what he deserved, the former Apple employee noted that his book was wellreceived, even among leading publications, when it was first released. “Just to do a sanity check on my awful book and just how boiled our political frog has been over the past five years, this is just a small sample of the globally positive reviews from elite mainstream institutions at the time,” he tweeted, adding a screengrab of some

of the flattering comments about ‘Chaos Monkeys.’ For example, one review from the New York Times described the book as “irresistible” and a “mustread,” while the Washington Post hailed it as “perceptive and funny and brave.” Feedback from several other leading publications was similarly complimentary. The glowing reviews appear to have sparked a renewed interest in the book. Numerous people announced that they had purchased the book. In addition, several comments said that they had never heard of ‘Chaos Monkeys’ but were now excited to read it. announced that they had purchased the book. In addition, several comments said that they had never heard of ‘Chaos Monkeys’ but were now excited to read it. Others pointed out that despite Apple’s alleged objections to the book, it was still available on the company’s online bookstore. However, some said it wasn’t accurate to claim that ‘Chaos Monkeys’ had never been the subject of scrutiny. Popular liberal pundit Matthew Yglesias noted that some reviews pointed to the book’s “sexism.” Yglesias later acknowledged that the book was “widely reviewed, and the reviews were mostly positive.” Like many corporations, Apple has been accused by critics of caving in to pressure from the “woke” mob. In June, the Silicon Valley giant programmed its voice assistant, Siri, to respond to questions about the Black Lives Matter movement and chide users who ask about “all lives matter,” a famous retort to the social justice movement.

IDF jets launch ‘extensive attacks’ on Gaza as violence enters 2nd week By Desert Star Staff Dozens of loud explosions could be heard throughout the Gaza Strip as the IDF carried out another round of “extensive attacks on terrorist targets,” with ongoing violence between Israel and Hamas entering the second week. “Our fighter jets are currently striking terror targets in Gaza,” the IDF tweeted around 2 am Monday, amid reports of Israeli warplanes targeting dozens of locations all across the Gaza Strip. There were also reports of several Hamas rocket interceptions over Israel earlier on Sunday night, although on a much smaller scale than the night before. While there were no immediate reports of new

casualties, the death toll in Gaza reached 192, including 58 children and 34 women, with more than 1,200 injured by Sunday. In Israel,l 10 people were killed, including two children, and over reportedly 500 wounded after a week of nightly fire exchanges, most by shrapnel or rushing for cover in bomb shelters. The latest Israeli-Palestinian conflict escalation follows days of unrest in Jerusalem, prompted by Israel’s plans to forcefully evict several Palestinian families in an occupied East Jerusalem neighborhood. The plan triggered mass protests, which were met with a heavy-handed response. Israeli police even holy month of Ramadan, stormed the Al-Aqsa Mosque prompting accusations that in the last days of the Muslim it deliberately cracked down

on worshippers. In retaliation, Hamas launched the first volley of rockets into Israel last Monday, triggering a full-scale Israeli military operation. Prime Minister Benjamin Netanyahu repeatedly vowed that the airstrike campaign against Hamas would last “as long as necessary to restore calm and quiet to Israel’s citizens.” The IDF claims that Hamas launched over 3,000 missiles into Israel indiscriminately, while it destroyed hundreds of terrorist targets and neutralized dozens of top operatives in pinpoint strikes. Claiming to do its best to minimize any collateral damage among civilians, Israel dismissed any criticism of striking Gaza disproportionately. Tel Aviv argued that any perceived

disparity in casualties between the two sides only proves that the IDF and it is Iron Dome missile defense system is operating at an “incredible level,” while Hamas was misfiring its rockets and committing “double war crimes” by targeting Israeli civilians while using Palestinians as “human shields.” With no end to violence in sight after seven days of fighting, UN Secretary-General Antonio Guterres has warned that the “utterly appalling” hostilities in Israel and Gaza could plunge the whole region into an “uncontrollable crisis.” The United Nations is “actively engaging all sides toward an immediate ceasefire,” he said, urging both sides “to allow mediation efforts to intensify and succeed.” www.desertstarweekly.com

Tourism, Economy & Jobs boom for the Coachella Valley

By Desert Star Staff Rancho Mirage, CA -The Greater Palm Springs Convention & Visitors Bureau (CVB)today announced the findings from its tourism impact study for the Coachella Valley Arena, a new state-of-theart sports and entertainment arena in the Thousand Palms community of Riverside County. The stadium is being privately financed by Oak View Group (OVG), the global venue development, advisory, and investment company for the sports and live entertainment industries. This is leading the redevelopment and operations of Climate Pledge Arena in Seattle, WA, and projects in Elmont, NY; Austin, TX; Manchester, UK; and Milan, Italy. Developed in conjunction with Tourism Economics, an Oxford Economics company, the tourism impact study looks ahead to the arena’s entire one-year period of operation in 2023. Examine the benefits

of the visitor component of scheduled events at the arena, including professional sports, concerts, family shows, and conventions and conferences. “The Coachella Valley Arena represents a significant and important investment in the Coachella Valley,” said Scott White, president & CEO of the Greater Palm Springs Convention & Visitors Bureau. “The privately funded $250 million, the 11,000-seat venue will have a very positive impact on the region and our tourism economy. Oak View Group’s partnership with Live Nation, the world’s largest live events promoter, will elevate the visitor experience with over 100 events annually, including concerts, sporting events, family-oriented events, and more. The Coachella Valley Arena will solidify Greater Palm Springs as a global entertainment destination.” The arena will also help the local economy in its COVID-19 recovery efforts.

“The Greater Palm Springs tourism economy has been hit hard by the COVID-19 pandemic, and projects like the proposed Coachella Valley Arena will help the region recover by attracting visitors and their spending from out of town,” said Zachary Sears, director, Tourism Economics. “We estimate the project will generate more than 1,300 direct jobs in the local economy and nearly 1,600 jobs overall.” “Over the course of constructing the arena, we’ll see the creation of 1,400 jobs and the generation of more than $200 million to the county,” said John Bolton, senior vice president and general manager of the new Coachella Valley Arena. “The entire Coachella Valley won’t have to wait until the arena opens to feel the financial boost to the local economy.” With an average of 159 events at the arena expected per year, approximately two per week with an average

attendance of nearly 6,000 per event, out-of-area visitors are expected to account for just over 40% of event attendees. Projections for the first full year of operation in 2023 include annual direct spending of $108 million; total business sales of $141 million annually; a total of $42 million in additional income earned by local workers; nearly 1,600 jobs supported each year, including full-time and part-time employment, on-site and off-site; and state and local tax revenues resulting from the additional economic activity totaling $11.0 million. Located on 43.35 acres of land at I-10 and Cook Street, in Riverside County on land owned by the Berger Foundation, the arena will be more than 300,000 square feet and feature 11,000-plus seats as well as modern suites and premium hospitality clubs. It will be the home of the Seattle Kraken’s American Hockey League (AHL) team. In addition, it will include an adjoining

facility that will serve as a yearround community gathering space and the training center for the AHL team. With a focus on the prioritization of technology, sustainability, and green initiatives, the world-class arena will also be built for music and host the best and most prominent names in the music industry annually. In addition to sports and entertainment, the arena will accommodate conventions, large meetings, international events, as well as award shows and exhibitions and will be privately funded at no risk to Riverside County taxpayers. Construction of the new arena is expected to create hundreds of permanent and temporary jobs for the community. The arena is projected to open in the last quarter of 2022. Hmong Farmers in M.N. Part of Grant Effort to End Health Disparities We’re in a Rate Rally Again!! 10 YEAR FIXED INTEREST ONLY 40 YEAR AMORTIZED LOANS TO $10 MILLION

3.879% APR Since 2011, Minnesota’s Hmong American Farmers Association has helped producers with access issues, including financial tools. (photo courtesy of HAFA) By Desert Star Staff Hmong farmers in Minnesota are playing a role in trying to end health disparities for marginalized residents. They’re getting help from a new grant program that seeks to remove barriers to healthier outcomes. In 2019, the American Heart Association launched its Social Impact Fund in a handful of U.S. cities. Now, the organization is giving nearly 500,000 dollars to three Minnesota groups. Janssen Hang, executive director of the Hmong American Farmers Association, which will receive one of the grants, said farming is strongly tied to the Hmong culture. In Minnesota, he explained their producers grow many staples, such as corn and tomatoes, and crops that are culture-specific to a variety of racial groups. www.desertstarweekly.com

“They’re very determined farmers here,” Hang remarked. “They just grow vast varieties of crops.” His organization will get 100,000 dollars, with most of the money bolstering the group’s Food Hub program. The initiative gets produce to educational institutions, health organizations and co-ops in the greater Twin Cities. According to the 2021 County Health Rankings, certain racial groups in Minnesota have poorer health outcomes when compared with the general population. That includes Black residents nearly doubling their white counterparts in premature deaths. Justin Bell, vice president of health strategies for the American Heart Association of Minnesota, said that his organization had placed greater emphasis on

social determinants of health in recent years. “And some of those things are housing, and access to healthy foods and education and transportation,” Bell outlined. County Health Rankings also reported that only 20% of a person’s overall health is determined by medical care, while social and economic factors determine the rest. Other Minnesota grant recipients include a community group in Bloomington that puts people on a path toward homeownership while preserving Islamic religious principles. The third group tries to establish better life outcomes for those formerly incarcerated. Surviving Cicada Swarm May Mean Protecting Young Trees

Hoosiers will soon start hearing the cicadas’ Brood X mating call at a constant, high volume. And it’s expected to last four to six weeks. (Smuangtim/Adobe Stock) By Lily Bohlke /PNS The giant brood of 17-year cicadas, known as the Great Eastern Brood, is on its way - and Hoosiers can expect

to see their swarms and hear their deafening mating calls in the next few weeks. Jerad Oren, a certified arborist and the co-owner

of Bluestone Tree services in Bloomington, pointed out that cicadas don’t eat trees or their leaves when they come out of the ground -

but they mate and lay their eggs in tree branches. While many trees can withstand the crevices cicadas carve into horizontal branches, Oren said they could damage young trees. “There are lots of different things that they’re dealing with,” said Oren, “whether it’s drought, too much water, too deep of a root system, or whatever. So, a treeless than five years [old] that we planted, it may be wise to go ahead and protect with netting.” Oren recommended draping white netting less than a quarter-inch thick over the tree’s canopy and brace the smaller or softer branches using a bamboo pole or a stick for support to keep them from breaking. He said people are much less skilled at planting trees than Mother Nature, but when folks do plant them, they should at least have the

best chance of survival. Oren also noted younger people and anyone who’s moved to Indiana in the last 17 years might not be familiar with the sheer size and impact of the cicada brood. It’s been that long since the state has seen a significant swarm. “We’re talking millions of cicadas that are going to be flying around,” said Oren. “They’re very slow flyers, and they will be crawling on everything. And it will be extremely loud, and it will be constant. And they will probably creep a lot of people out. But actually, some people may have a lot of fun with this.” He added birds and other animals will feast off the cicadas, as well as some humans - at least, those who are brave enough to try it. He said he’s considering baking a few in the oven with some olive oil and seasoning.

Tax Reforms Aim to Boost Assistance for Working Families By Eric Galatas/PNS Children’s advocates support a pair of bills introduced this week by state Democrats to update Colorado’s tax code, expand the state’s Earned Income Tax Credit and fully fund the Child Tax Credit. Sarah Barnes, manager of special policy initiatives with the Colorado Children’s Campaign, said the proposals would help the state’s families of color hit hardest by the pandemic due to systemic inequities and barriers, recover

from its economic fallout. She added tax reforms that prioritize kids can help bring tens of thousands of Colorado children out of poverty. “The earned income tax credit and the child tax credit are two of the most effective tools we have to fight child poverty,” said Barnes. “So those two tax credits taken together lift more kids out of poverty than any other program we have available.” House Bill 1311 would double Colorado’s Earned Income Tax Credit, from 10%

to 20% of the federal credit. The measure would also provide funding for the state’s Child Tax Credit, passed in 2013, for the first time. Alongside companion bill HB 1312, the proposals aim to pay for the tax credits by removing tax loopholes for the state’s wealthiest residents and corporations - a move critics could blunt the state’s economic recovery. The bill’s proponents say the reforms will make the tax code fairer for the families and small businesses that

drive Colorado’s economy. Barnes noted getting additional money into the pockets of families with kids will help them pay for necessities like rent, food, and child care. In addition, she said money invested in kids now also benefits the economy in the long term. “And as those kids grow up and become adults,” said Barnes, “they are also more likely to go on to college, and they’re more likely to be able to work more and earn more in adulthood because of

the money coming into their families when they’re kids.” A recent survey found more than 70% of Colorado voters support eliminating outdated tax exemptions and credits for corporations and wealthy individuals. The legislation targets tax loopholes that the state auditor’s office found are not performing as intended - by creating jobs or growing the economy, or benefiting most taxpayers - including severance tax credits and exemptions for oil, gas and coal production.

Supreme Court takes on major Mississippi abortion case By Desert Star Staff The US Supreme Court has agreed to hear a major abortion case from Mississippi that could allow states to ban abortions before fetal viability. If successful, the state could pave the way for a rollback of abortion rights. The Supreme Court agreed on Monday to hear Dobbs v. Jackson Women’s Health Organization this fall. The case, brought by Mississippi officials, asks the court to consider whether the state’s ban on most abortions after 15 weeks is constitutional. At present, states may not ban abortions before 22 weeks, though the earliest date a fetus can survive outside the womb. Lower courts have already decided that the Mississippi law, passed in 2018, clashes with the constitutional right to an abortion outlined in Roe v. Wade in 1973.

However, Mississippi asks the Supreme Court to weigh this right against subsequent rulings that permit states to restrict abortion so long as an “undue burden” isn’t placed on a woman seeking such a procedure. The filing from Mississippi’s Department of Health also asks the court to weigh these rulings against other precedents that assert a state’s interest in protecting a mother and the unborn child’s lives “from the outset of the pregnancy,” given that modern technology has made fetuses viable from an earlier age. The case will be heard by a court minus its most ardent supporter of abortion rights, Justice Ruth Bader Ginsburg, who died last September. Her replacement, Justice Amy Coney Barrett, is an opponent of abortion but has never ruled directly on the issue.

Since Barrett’s appointment by former President Donald Trump, conservative or conservative-leaning justices make up a 6-3 majority on the bench. Trump-appointed three of these conservatives: May 21, 2021

Justices Amy Coney Barrett, Brett Kavanaugh, and Neil Gorsuch. Gorsuch and Kavanaugh voted in dissent last year to allow Louisiana to impose limits on doctors carrying

out abortions. Still, fellow conservative Justice John Roberts sided with his liberal colleagues to ensure that the restrictions were struck down.
