By Jack Lyons Theatre and Film Critic Member American Theatre Critics Association (ATCA) Member Academy of Television Arts and Sciences (ATAS) In the sometime labyrinthine and complicated world of art and paintings for sale of the great masters over the centuries, it is easy to get lost in the authenticity, and/or forgery issues, plus ownership claims that occur when money blends with desire on the part of collectors, museums, and the prestige that comes to the owners of such art treasures. Following World War II, the Allies created commissions to insure the return to the rightful owners of the art masterpieces that had been stolen and hidden by the Nazis during the war years. “The Last Vermeer”, a TriStar Pictures film based on the book “The Man Who Made Vermeers” by Jonathan Lopez, opened in over 800 ‘live’ theatres on November 20, 2020; centers around one such court case and trial reparation event in the Netherlands in 1945. The War in Europe ended with VE Day, May 8, 1945. Over 23, 000,000 European civilians perished. Collaborators were being executed in public squares in cities all over Europe. The survivors from Nazi occupied countries began
seeking revenge on the collaborators and war profiteers. Passions were out of control as public executions by government officials were taking place in public squares throughout Europe. Long-time American hands-on producer Dan Friedkin, now a first time film director, brings to the screen the probing and dramatic story of the notorious 20th century Dutch art dealer, painter, hedonist, aesthete Han van Meergeren, who sold Dutch art treasures to Hermann Goring and other high ranking Nazis during the war years making millions in his dealings with the Nazis. Reverence for the Netherlands Golden Age of Dutch masters practically borders on being a religion in Holland. Rembrandt van Rijn, Johannes Vermeer, and Pieter de Hooch are but three giant names that quickly come to mind. The Dutch style of painting in the ‘Golden Age’, inspired new lighting techniques for 17th century Dutch painters who credit Rembrandt and his style, of creating and capturing in his brush strokes the skill and magic that influenced painters that followed for generations to come. The story in short is set in Amsterdam in 1945. Canadian Captain Joseph Piller, a Dutch Jew, who fought in the Resistance during the War, is stoically underplayed
by Danish actor Claes Bang. The witty Bon vivant art dealer Han van Meergren is sensationally portrayed by Australian actor Guy Pearce, in a highly nuanced bravura performance that should nab him acting nominations from several festivals from countries where the film will be screened (despite the pandemic). After WW II ended in 1945, Piller becomes an investigator for the Allied Commisions assigned to the task of identifying and redistributing stolen art, resulting in Dutch art dealer Van Meergaren being accused of collaboration – a crime that brings a death penalty if convicted. But, despite mounting evidence, Piller, with the aid of his assistant Minna
Holberg, played by well known, wonderful, European actor Vicky Krieps, (who is wasted in a small role in this film), becomes increasingly convinced of Van Meergren’s innocence, finding himself in the unlikely position of fighting to save his life (Shades of Tom Cruise as Jack Reacher in the eponymous 2012 action movie). Solid supporting turns come from Roland Moller as Piller’s security enforcer and aide Esper Vesser and Adrian Scarborough as Dirk Hannema, the art critic expert as a witness for the prosecution in Van Meergaren’s trial for collaborating with the Germans. Movies about art heists (“The Thomas Crown Affair” with Steve McQueen and its
later re-do with Pierce Brosnan had a certain sophistication and style to their storylines. “The Last Vermeer”, however, is a richly textured film set in post-war ravaged Europe. There no glamour there just the appropriate grit and destruction that the legacy and folly of war provides. Non-the-less the technical credits along with the performances are first rate. The production design by Arthur Max brilliantly recreates Amsterdam of 1945 both externally and internally. The court room and trial sequences have the ring of authenticity as do the period costumes of Guy Speranza. I always find the courtroom dramas fascinating in the rules
into the world of words and wordplay is vastly entertaining, and you actually get to share that “communal experience” that live theatre provides. Some participants eagerly raised their hands when they had solved a particular clue, while others never said a word but doggedly stayed the course, mostly due to the
star’s pun-kish humor and charm. “Jeopardy” producers, are you listening? He’d make a perfect host someday, and I’m sure his mother would agree. The show has proven so successful that it has been extended beyond the initial run; the show is sold out through January 3, 2021, but additional dates are being
added. The Geffen is also offering five $25 Mobile Rush tickets at each performance on a first-come, first-served basis. “Inside the Box” By Lisa Lyons Apart from being known as one of the best regional theaters in the country, the Geffen Playhouse in Los Angeles was one of the first local venues to successfully attack live entertainment by COVID-19. The first production, the Frank Marshall-directed “The Present,” starring master prestidigitator and performer Helmer Guimaraes, allowed the show’s compact staging to easily transition to the Zoom platform. While it sounded risky, it actually brought audience members into even more intimacy with the star and the unique story of art, love, memory and card tricks. The latest production from the Geffen, “Inside the Box,” is even better suited to the live stream format as its entire concept is based on boxes -- grids, squares and puzzles. The world-premiere production from writer and performer David Kwong is described as an exhilarating glimpse into the world of

games. Kwong is one of the crossword puzzle constructors at the New York Times, the gold standard for puzzle fans worldwide. With a combination of keen insight, sly wit and personal history, the affable Kwong displays his knowledge of the subject without ever sounding like a puzzle wonk...well, almost never. Twenty-four guests all have a front-row seat in the evening’s entertainment and in the Zoom proscenium, resemble a slightly whack “Hollywood Squares” episode. When you purchase your ticket for the show, you receive a package a day or two before the performance with interactive props and instructions for your participation. In between solving puzzles, Kwong regales the crowd with stories of the most celebrated puzzle makers throughout history while letting his audience create their own moments of head-scratching joy. Indexed Annuities, REITs (real estate investment trusts), MLCDs ( Market Linked CDs) are not normally offered. Other investments which may not be included are risk products, such as individual stocks and bonds, ETFs (exchange traded funds), and using alternative investments. Liquidation of numerous investments left to heirs in the 401K can require a lot of work, because each investment will require it’s own liquidation. Qualified plans (such as 401(k)s and profit- sharing plans are subject to a different set of rules that do not allow the funds to be distributed over time. As a result, when your 401(k) is inherited, the funds will usually be distributed immediately in a single lump sum payment, resulting in an immediate tax liability for the beneficiary. This could result in an increase in all of your taxes if the income received, boost you to a higher tax bracket. Further, if the estate is the beneficiary of an inherited qualified plan (401(k)), you lose the option of rolling the funds into an Inherited IRA in order to maximize
the tax-deferral potential. Failing to name a beneficiary, will cause benefits to be paid out to your estate upon death, which will cause a loss of the tax-deferral benefits that can otherwise be realized with an inherited IRA. This is because the favorable rules that allow the account value to be distributed over time, only apply if the account’s designated beneficiary is an individual or a trust. There must be a life expectancy. Through the inherited IRA, The Generation -skipping transfer tax is a federal tax that results when there is a transfer of property by gift or inheritance to a beneficiary who is at least 37½ years younger than the donor. The legislation effectively closed the loophole where inheritances could skip a generation to avoid double estate taxation Typically the beneficiary will exhaust the account funds within five years of the original owner’s death, which allows the account value to continue to grow and stretches the tax liability that accompanies the distributions
over that period of time. The rollover must be accomplished through a trustee-to-trustee transfer whereby the 401(k) plan administrator transfers the funds directly into a new IRA account that only holds the inherited 401(k) funds. In the inherited retirement account arena, how beneficiary designations are stated is critical to a successful transfer of the account to the next generation. Important to note, the account’s beneficiary designation trumps even the client’s will in determining who will inherit the account, While most beneficiaries cannot control the type of retirement accounts that they have inherited, when it comes to maximizing the taxdeferral benefits associated with inherited accounts, knowing the rules of the game is key to avoiding a major tax hit when these accounts change hands. The Secure Act, an expansive retirement law that went into effect Jan. 1,2020, eliminated the “stretch IRA,” which allowed non-spousal beneficiaries to withdraw assets of inherited
accounts over their lifetimes. Now, those who inherited an IRA since the beginning of 2020 and thereafter have 10 years to withdraw the assets, however or could take a lump sum and face taxation of the money all at once. Spouses and disabled beneficiaries are among the exceptions to the Rule. The Grantor can establish an irrevocable trust that assigns a beneficiary who is younger than the settlor by at least 37 ½ years. It is called a generation skipping trust and can be a part of a comprehensive estate plan that aims to minimize tax liability. HOA Homefront - Assessment Payment
By Kelly G. Richardson, Esq. CCAL Dear Kelly: Recently our board stopped dues collection for 6 months because they said some homeowners were experiencing financial hardship. The board has no plans to ask owners to pay back dues. Is this legal? P.B., Marin County Dear P.B.: One of the HOA board’s fundamental responsibilities is to make sure the association’s bills are paid, and that means also collecting the money to pay those bills. Civil Code Section 5600 states that “the association shall levy regular and special assessments sufficient to perform its obligations…” A similar situation came up in the Great Recession of 2008-2009, when many owners were in financial distress and some boards struggled with whether to require such owners to pay their assessments. However, members who fail to pay assessments harm those who are paying their share of the HOA costs, so associations must insist that all members pay their assessments. The HOA’s bills do not stop during the pandemic so assessments cannot stop either. The board should be businesslike in its handling of HOA finances,
which includes good stewardship of the HOA’s income – and not cutting it off! Best regards to your HOA, Kelly Mr. Richardson: Our HOA over the last 20 years has used up its reserves because of increasing maintenance and irrigation costs. The CCRs forbid raising the annual dues and special assessments are only permitted for litigation emergencies. We have tried to modify the CCRs but we cannot get a majority of the homeowners to vote to OK a change. What would you suggest? A.B., Solana Beach Dear A.B.: The law has a provision which allows HOA boards to adopt modest increases in assessments, and that is Civil Code Section 5606(b). Under this statute, HOA boards can increase regular assessments by up to 20% per year without member approval, regardless of anything contrary in the governing documents. The same statute allows boards to
impose a special assessment each year of up to 5% of the association’s annual budgeted gross expenditures. Such an action must occur in an open board meeting, and it is helpful to explain to the members the necessity of the increase. Depleting reserves to subsidize long term operating cash deficits is a bad idea; discipline is better. Thanks, Kelly.
Kelly, can members delinquent in payment of their HOA dues be on the board? Thanks, J.P., Bonsall Dear J.P.: Civil Code Section 5105(c)(1) allows associations to “disqualify a person from nomination” due to assessment delinquency unless that person is in a payment plan with the HOA to catch up. Under the law as it changed in 2020, delinquency in assessments is one of four optional eligibility qualifications that associations may adopt along with the mandatory qualification of membership in the HOA. Such eligibility standard, if desired by the HOA, should
be adopted in a change to the HOA’s election rules. Many bylaws contain provisions also disqualifying sitting directors if they are delinquent in their assessment obligations. One of the many unanswered questions from this new law is whether in addition to the four specified optional candidacy standards there can be additional disqualifications of sitting directors (such as, for example, missing several meetings. Many HOA attorneys believe that the new law applies only to candidacy and not disqualification of sitting directors. Best, Kelly Kelly G. China vows a ‘necessary’ response to the US admiral’s visit to Taiwan
By Desert Star Staff On Monday, China’s foreign ministry announced that it will bring a “necessary” response to bear after a senior US Navy admiral made an unannounced visit to Taiwan over the weekend. Ministry of Foreign Affairs spokesman Zhao Lijian told reporters that China “resolutely opposes” any diplomatic or military relations between American and Taiwanese officials, calling on the United States to recognize the sensitivity of the ChinaTaiwan issue fully. Zhao warned that, depending on how the situation developed, his government would “make a legitimate and necessary response,” without explaining what specific action would be taken. According to people familiar with the situation, Rear

Admiral Michael Studeman, a two-star Navy admiral who oversees US military intelligence in the Asia-Pacific region, is believed to be the officer who made the trip. While the Pentagon refused to comment, Taiwan’s foreign ministry confirmed that a US official had arrived on Sunday. If Studeman has visited the island, he would be the most senior US military officer in Taipei in recent years. This is the latest visit from a US official to the territory in the last couple of months. US Health and Human Services Secretary Alex Azar took a trip to Taipei in August, and Under-Secretary of State for Economic Growth Keith Krach visited the capital in September. In response to each visit, China scrambled fighter planes near the island. The Trump administration
has clashed with China over Taiwan’s issue in recent months, approving a $1.8-billion weapons sale to the island and November 25, 2020
signing a memorandum of understanding on economic exchanges. While Taiwan claims to be a democratic, self-ruled island, Beijing
believes the island is one of its territories and opposes any move that sees it engage in other countries’ relations.

Saving the Legacy: Cole Henry Eyraud that produced centrifuges for hospitals and laboratories. He had visited the pueblo and found in Cabot a kindred spirit. Desert Sentinel newspaper broke the story on December 5, 1968, that the property had been sold to a group of individuals in Burbank and Saugus. Soon, newspapers identified the new owner as Landmark Conservators, but the deed of trust in March of 1969 vested title in “Colbert H. Eyraud, a married man, as his sole and separate property.” Cabot’s Old Indian Pueblo and Museum opened on July 4, 1969. The city council finally voted to recognize the pueblo museum as its first historical landmark in January of 1977. In 1981, Cabot’s Pueblo Museum hosted a dedication program for County of Riverside Historical Marker No. 054, donated by the Desert Hot Springs Improvement Association. Cole’s next major undertaking was installing a 43-foot-tall, Indianhead monument, carved on-site by Peter Toth, and now a prominent feature on Miracle Hill. Not surprisingly, Cole’s civic activity came to light in the historical arena when he set in motion plans for reorganizing Desert Hot Springs Historical Society. He also participated
on boards of directors for multiple Desert Hot Springs entities, including the chamber of commerce, architectural advisory commission, a lowcost housing project, and a project to build an arthritis treatment center. From March of 1976 until April of 1980, he served on the city council. He lost his bid to be the first elected mayor in 1980 but took a seat on the city’s planning commission and then rejoined the council in November of 1982. He served multiple terms, including as vice mayor, until January of 1991. Sadly, Cole Eyraud did not live to see one of his dreams come true when, in 2012, Cabot’s Pueblo Museum was added to the National Register of Historic Places. While walking in a parking lot in October of 1996, he was struck by a car and died. In 1998, his heir’s assigned title to the pueblo property to the City of Desert Hot Springs. A commission was formed to reopen the museum, which happened in 2001. A 501(c)(3) foundation was subsequently developed and now operates the museum with the mission “to promote and preserve Cabot Yerxa’s legacy of cultural respect, education, art, community, and the desert habitat.”
Groups Question Effectiveness of CA Cap-and-Trade Program
By Julia Rosen Growing up in North Richmond, California, Denny Khamphanthong didn’t think much of the siren that wailed once a month, every first Wednesday at 11 a.m. The alarm is a test of the community’s emergency warning system, which has alerted residents to numerous incidents over the years at the nearby Chevron oil refinery. One recent accident there, a 2012 fire, sent a cloud of black smoke billowing over San Francisco Bay and left thousands of local residents struggling to breathe. Now, when Khamphanthong explains the sound to his young nieces, he sees the fear in their eyes. “I forget that this isn’t normal,” he says. Nor is the fact that Khamphanthong and most of his childhood friends carried inhalers. Richmond, a diverse, industrial city where housing prices and incomes have lagged behind its Bay Area neighbors, has poor air quality and some of the highest rates of respiratory and cardiovascular disease in California. “There’s a lot of beautiful things that happen out of [Richmond],” says Khamphanthong, a community organizer with the Asian

Pacific Environmental Network whose family emigrated from Laos in the 1980s. “But at the same time, when you look at the reality of it, it is sad.” Pollution, poverty, and race collide in many other disadvantaged communities across California and the country, and some argue that the state’s climate policies haven’t helped. While California has already cut its greenhouse gas emissions by 13% since their peak in 2004, many residents still suffer from high levels of air pollution, much of it produced by fossil fuels. In particular, controversy has dogged California’s capand-trade policy, which took effect in 2013 and regulates roughly 450 entities accounting for 85% of California’s emissions. The system works by setting a limit on the total amount of greenhouse gases released by refineries, power plants, and other large emitters, and requires polluters to obtain permits to cover their share. The overall “cap” lowers every year, forcing polluters to reduce their emissions or purchase allowances from others who do. Economists, environmentalists, and policymakers-many of them White-tout cap-and-trade as a cost-effective way to cut
emissions while generating money for other climate initiatives. But environmental justice activists say the program has not served California’s disadvantaged communities, and particularly communities of color, where many facilities operate. In their eyes, it doesn’t do enough to address climate change and allows emitters to continue polluting the air in the meantime. For example, Chevron’s Richmond Refinery, one of the state’s largest emitters, released more greenhouse gases in

2017 and 2018 - the last years for which data are publicly available - than it has since 2008. And in several recent years, it emitted as much or more of certain air pollutants. It has also dramatically increased the volume of gas flared off as waste, another source of harmful compounds. (Representatives from Chevron did not respond to requests for comment.) To many, cap-and-trade highlights a contradiction. “You’re hearing all this great stuff about how amazing your
governor and your state is on climate leadership,” says Lucas Zucker, policy and communications director at the Central Coast Alliance United for a Sustainable Economy. Sadly, it was Marley’s final tour before his death from cancer in May 1981. Artist: Little Richard Title: Southern Child (Omnivore Recordings) You might like if you enjoy: Little Richard, James Brown, Vintage Trouble Tell me more: The death of Little Richard on May 9, 2020 only increased interest in one of rock and roll’s most influential founding fathers. “Southern Child,” the rocker’s shelved third album for Reprise that was recorded following 1971’s acclaimed “King of Rock and Roll,” is a predominantly country-rock effort and was unheard until the tracks appeared on a longout-of-print label retrospective in 2005. The album was recorded in Los Angeles in spring of 1972; the LP was then mixed, mastered and handed to the label. However, Reprise instead opted to release “The Second Coming” in its place. Now “Southern Child” will be released on yellow vinyl on Friday, Nov. 27 (four bonus tracks are included on the audio CD version that follows on Dec. 4). The album is fascinating to be sure, and there are plenty of great songs here. The nuanced “If You Pick Her Too Hard (She Comes Out of Tune),” pretty “Ain’t No Tellin’,” uptempo “Southern Child,” tender “In The Name” and zealous “Over Yonder” are among the countryflavored standouts on the set.
