RANCHO MIRAGE –Sunnylands Center & Gardens is reviving its in-person participation in the Great
ShakeOut with an invitation to the public to learn about the importance of earthquake and emergency preparedness on Thursday, Oct. 20.
From 9:30 a.m. to noon, various community organizations and school groups will be at Sunnylands in Rancho Mirage to
share information on the preparations residents need to make in the event of a major earthquake or other natural disasters.
At 10:20 a.m., guests and staff will participate in an earthquake drill interrupting
CALGARY, AB. – The Coachella Valley Firebirds, proud affiliate of the National Hockey League’s Seattle Kraken, won their first game in franchise history on Sunday afternoon by defeating the Calgary Wranglers by 6-5 in Calgary. Kole Lind (x2), Andrew Poturalski, Michal Kempny, Max McCormick, and Jesper Froden scored, while Joey Daccord stopped 25 in the team’s inaugural victory.
The Firebirds drew their first blood at 6:59 of the first period. Ryker Evans put a
pass right on the stick of Kole Lind to notch the first goal in franchise history.
Cameron Hughes tallied the secondary helper to help give Coachella Valley a 1-0 lead, the period’s only goal.
Coachella Valley scored 4:47 into the second period on an Andrew Poturalski powerplay goal. Just 33 seconds after the Wranglers scored to make it 2-1, Michal Kempny wristed a shot past Calgary netminder Dustin Wolf to put the Firebirds back by two goals. McCormick and Froden added to the Firebird’s totals with goals to
put Coachella Valley ahead 5-1. Calgary netted two quick goals toward the end of the second period to cut Coachella Valley’s lead to two.
Less than five minutes into the third period, Kole Lind rushed into the offensive zone on a semi-breakaway and beat Oskar Dansk, who replaced Wolf in the second period, to regain a three-goal lead for the Firebirds. A new report from Stanford University finds tobacco companies continue to directly target African Americans, women, and young people with their advertising, creating a larger market for a product linked for years to cardiovascular disease and cancer.
It comes as efforts are underway at the state and federal levels to remove menthol cigarettes from the market.
Dr. Robert K. Jackler, professor at the Stanford University School of Medicine and the report’s lead author, said the preference among the
targeted groups for menthol cigarettes is the product of a concerted campaign.
“Urban heavily Blackpopulated areas got carpeted by billboards and signs in store windows, discount coupons,” Jackler explained. “The companies would have vans that would give out free samples of cigarettes in poor neighborhoods.”
In 2020, the California Legislature prohibited most flavored tobacco products, but the law was put on hold when the industry gathered signatures to force a referendum. In November, voters will consider Proposition 31, which upholds the restrictions. And the industry is funding the “No on 31” campaign, arguing that blocking adults from buying menthol products would lead to a drop in sales-tax revenue and create an illegal market, increasing crime.

Jackler predicted voters would pass the ballot initiative, reaffirming the California Legislature’s intention to remove most forms of flavored tobacco from the market.
“The tobacco industry is very cynical,” Jackler asserted. “They used the initiative petition to buy a couple more years of profit off California. They knew they were going to lose this, I think, in the election.”
The report finds that tobacco companies market menthol to youth because it makes it easier to smoke, masking the
taste and numbing the throat. It also noted that menthol encourages deeper inhalation and, thus, greater exposure to nicotine.
Dr. Jessica Sims, medical director of managed care at UCLA Health and an American Heart Association volunteer expert, thinks removing menthol cigarettes and flavored vaping products from the market
will improve public health.
“Nicotine itself has been demonstrated to cause permanent harm to the teenage brain that’s still developing,” emphasized. “It causes difficulties with attention and memory and can impact someone’s trajectory in life.”
In April, the FDA proposed removing menthol and flavored cigars from
the market, but no final rule has been issued. In 2009, Congress passed the Family Smoking Prevention and Tobacco Control Act, which prohibited all flavors other than tobacco and menthol in cigarettes.

However, our CC&Rs make no mention of termites and we do not have a “different maintenance scheme” as prescribed in 4780(b). What must our HOA do to legally have the authority to treat wooddestroying pests? Section 4780(b) calls for a vote of the membership. Are there other avenues? I would like to present all compliance options to

W.R., Aptos.Dear W.R.: If your HOA is a condominium project, Civil Code Section 4780(a) places termite treatment responsibility on the HOA, while subpart (b) places that responsibility for planned developments on individual owners. I am assuming you live in a planned development with attached homes. If your CC&Rs say nothing about termite treatment (most developers don’t consider that in setting up attached planned developments) it creates a problem –it doesn’t help to try to treat homes individually when they are interconnected.

Hi Kelly: Our HOA tented every single building for termite fumigation. We didn’t want fumigation, because of the chemicals that would be pumped into our homes. So our building did not get tented. We have asked our HOA to find an alternative treatment, because we have health issues and have a doctor’s note to have an alternate treatment done at our home instead of fumigation. Our HOA wants to sue us for not complying with the treatment. I need to know if they can sue

Dear M.M.: This is a difficult conflict. Protecting the framing’s structural health is very important and a safety concern for the entire HOA. A powerful statute, Civil Code Section 4785, allows the HOA to pursue the “summary removal” of residents after giving notice of impending termite treatment. “Summary removal” does not mean that the HOA can just barge in and order you out –court action is still necessary.
Has your doctor said that you have a disability that would be affected by residual elements of the fumigation, harming your health? Would staying away a bit longer provide more time for the dissipation of the fumigation and address your health concern? The board has
great latitude while relying on expert advice regarding HOA maintenance methods, under the landmark 1999 Lambden v. La Jolla
Shores state Supreme Court decision (a case that involved a dispute over the method of termite prevention). If the HOA’s expert recommended overall fumigation, the HOA may argue that it is not a reasonable accommodation to risk the entire building’s structural health as an accommodation to you. The HOA and you should stay out of court- work this out with your HOA neighbors.

After all, WLAN is essential - not only for streaming our series but also for doing home office work or paying bills online. So the supposed culprit is often quickly found: the provider! But it’s usually not the Internet provider at all but has other reasons.

The Biden administration has set aside a massive oil and gas drilling project in the Uinta Basin due to its potential effect on the climate and greenhousegas emissions.
The Bureau of Land Management decision upholds a 2017 WildEarth Guardians appeal, challenging the planned Monument Butte oil and gas project.
The BLM ruled it had
not adequately considered the impact the exploration activity might have on the fragile environment.
Jeremy Nichols, climate and energy program director for WildEarth Guardians, said it is a significant step toward eliminating greenhouse-gas emissions on public lands.
“This is an opportunity for the Biden administration to chart a new path to climate consciousness, certainly underscore the need for transition,” Nichols
asserted. “We’re being held hostage now by an extremely volatile industry.”
Initially approved by the Trump administration, the project authorized almost 6,000 new oil and gas wells on publicly owned lands in northeastern Utah. Backers of more drilling say it is necessary to maintain the country’s energy independence. However, at least one of the principal Monument Butte developers recently announced it was selling
its interest in the project.
The BLM’s own analysis when it initially approved the development found that drilling and fracking would release more than 60 million metric tons of carbon pollution annually, which is as much as 17 coal-fired power plants.
Nichols pointed out carbon pollution would be enough to melt 70 square miles of Arctic sea ice yearly.
“We’re in a moment when everything said we need to transition away
from fossil fuels, which means we’ve got to start making it more difficult to extract oil and gas, if not impossible,” Nichols contended. “What better place than on public lands?” Nichols added the Monument Butte development is just one of several projects his group hopes to block by pushing the BLM to abide by a 2021 Biden administration order to reconsider all oil and gas leasing and drilling projects on public lands.
A new report from the Sierra Club called “The Dirty Truth About Utility Climate Pledges” finds that dozens of utility companies across the U.S. are not living up to their promises - risking the country’s goal of a clean, renewable electric grid by 2030.
The report examined data from the 50 utility parent companies most invested in a fossil-fuel generation. Again, the average grade was a D. Report co-author Noah Ver Beek, an analyst with the Sierra Club Energy Campaigns, said many climates pledges amount to little more than greenwashing.
“Overall, this is a really critical moment in our energy transition,” said Beek. “We see that utilities have little ambition and are not coming through on their climate commitments.”
The only California company on the second annual report is PacifiCorp,
which serves rural communities near the Oregon border and elsewhere. The company earned a D grade based on its reliance on fossil fuels such as coal and natural gas.
PacifiCorp’s Integrated Resource Plan for 2021 pledges to reduce carbon emissions by 74% compared with 2005 levels by 2030. And its plan includes additional wind and solar resources.
The LA Department of Water and Power and Pacific Gas and Electric both buy coal and gas-generated power but don’t own it, so they were not evaluated in this report.
However, University of California Santa Barbara Assistant Professor Leah Stokes, a report’s co-author, said the LA DWP has set a laudable goal of reaching 100% renewable energy between 2035 and 2045.
“Los Angeles Department of Water and Power is a leading utility and really in the whole
country,” said Stokes, “when it comes to making progress and taking the science seriously, and being in line with President Biden’s goals.”
The report calls on
utilities to take advantage of significant incentives in the new bipartisan infrastructure bill designed to help utilities retire coal plants and switch to renewable energy.

On Friday, Oct. 7, 2022, the Riverside Superior Court tentatively approved the settlement of a class action lawsuit filed in September 2021 that stemmed from meter register failures, which began to occur in 2019.
“While not adversely impacting customer rates, this agreement is in the best interest of our ratepayers, with accountability, integrity, and excellence top of mind,” said MSWD General Manager
Arden Wallum. “This litigation, if continued, would likely have lasted for years and may have cost the ratepayers millions of dollars. Instead, settling this lawsuit allows us to focus on our mission of providing, protecting, and preserving our most valuable resource and ensuring reliable water delivery to our customers.”
In or about 2019, numerous water meter registers began to fail. While the problem was being addressed, MSWD was required to provide affected customers with an estimated water bill using prior usage averages; however, a question remained as to whether a higher Tier 2 rate, instead of the lower Tier 1 rate, could be charged
for Tier 2 consumption.
With no liability assigned, both parties agreed to enter into a $225,000 settlement agreement for impacted customers in the Tier 2 class. In addition, the court appointed a third-party settlement fund administrator who will soon contact and provide notice
to affected customers.
As a result of the failed meter registers, the District accelerated its transition to a new Advanced Meter Infrastructure (AMI) system, which was planned before the meter issue was detected.
The new meters are now in place, saving money by
reducing labor and other associated costs. In addition, these new meters allow for improved technology and an advanced customer portal that leverages technology and gives customers greater control over water use and conservation.

2 1/2 quarts popped popcorn
6 tablespoons butter or margarine
3 cups mini marshmallows
4 tablespoons lime gelatin powder red gum balls candy corn
flat green candy strips or fruit leather green sugar sprinkles
Place popcorn in large bowl; set aside.
In medium saucepan over medium heat, melt butter. Stir marshmallows into butter until melted. Stir in gelatin powder until evenly colored.
Pour melted mixture over popcorn and stir until evenly coated. With buttered hands, shape popcorn into seven ovals.
Flatten one oval slightly and squeeze one end to form “skull” shape.
Place on parchment-lined baking sheet. Repeat with remaining ovals.
To decorate: Press two gumballs into each skull to form “eyes.” Press candy corn into skull to form “teeth.”
Use scissors to trim candy strips and press into top for “hair.” Sprinkle with sugar sprinkles.
Allow “zombies” to set about 20 minutes before wrapping individually in plastic wrap or serve immediately.

1/4 cup butter 8 cups mini marshmallows, divided 1 tablespoon vanilla extract 9 cups popped popcorn, divided 1 cup semisweet chocolate chips, divided black string licorice candy eyes
Line round pizza pan with parchment paper; set aside. In large saucepan over low heat, melt butter; stir in 5 cups marshmallows, stirring constantly, 3-4 minutes, or until completely melted. Stir in vanilla. Remove from heat. Stir in 8 cups popcorn until coated. Spread onto prepared pizza pan in irregular round shape, about 1-inch thick, to resemble spider web.
Refrigerate about 15 minutes, or until firm.
In microwave, melt remaining marshmallows about 20 seconds, or until melted. Using spatula, string strands of melted marshmallow over popcorn spider web to create cobweb effect.
In heatproof bowl set over saucepan of hot (not boiling) water, melt 3/4 cup chocolate chips; cool slightly. In large bowl of remaining popcorn, pour chocolate over popcorn, folding gently to coat.
Spread mixture on waxed paper-lined baking sheet, separating into eight small clusters. Affix two candy eyes to each popcorn cluster. Refrigerate 10-15 minutes, or until set.
Melt remaining chocolate chips. Cut licorice into 1-inch lengths. Using small spoon, dab circles of chocolate onto spider web. Affix chocolate-coated popcorn onto chocolate circles. Affix licorice lengths to chocolate popcorn clusters to resemble spider legs.
Refrigerate 15 minutes, or until set. To serve, cut into smaller pieces.

3 cups miniature marshmallows
3 tablespoons (1/2 of 3-ounce box) lime gelatin dessert mix green food color (optional)
3/4 cup chocolate chips licorice strings
8 chocolate
orange sugar sprinkles, placed in small dish

Spread sheet of waxed or parchment paper over work surface and place wafer cookies on it.
Spray large mixing bowl with nonstick cooking spray and place popcorn inside.
In medium saucepan over low heat, melt butter. Stir in marshmallows and gelatin powder until marshmallows are melted and mixture is smooth. Adjust color with 1-2 drops food color, if desired. Pour mixture over popcorn and mix until coated.
Spray hands with nonstick cooking spray and press firmly to form into eight balls. Place balls on eight wafer cookies. Press candy decorations into popcorn balls to form “eyes,” “nose” and “mouth.”
In small, microwave-safe bowl, heat chocolate chips, covered, 10 seconds. Stir to aid melting. Repeat as needed until chocolate is melted and smooth.
Spoon about 1/2 teaspoon melted chocolate on top of each popcorn ball. Press licorice strings into chocolate to form “hair.”
Dip cone edges into melted chocolate then orange sugar sprinkles. Place on remaining wafer cookies to form “witches’ hats.” Place hats on popcorn balls. Allow chocolate to set about 45 minutes before serving.
Serve or seal individually in plastic wrap.
