First major Second Amendment case could topple gun restrictions
By Eric Ruben Assistant Professor of Law, Southern Methodist University The stakes in one of the most significant Second Amendment cases in U.S. history are high. The Supreme Court’s ruling in New York State Rifle & Pistol Association v. Bruen, expected by mid-2022, could declare a New York state restriction on carrying concealed handguns in public places unconstitutional. Such a ruling in favor of the plaintiffs, which include a National Rifle Association affiliate, could loosen gun regulations in many parts of the country. In my view as a Second Amendment scholar, this
case is also noteworthy in that how the court reaches its conclusion could affect the Second Amendment analysis of all weapons laws in the future. The court is set to hear oral arguments on Nov. 3. Long on the books In 1911, after an increase in homicides, New York instituted a handgun permitting system. In 1913, the permitting system was amended to address concealed carrying. For more than a century, someone seeking to carry a concealed handgun for selfdefense in the state has needed to file a permit application showing that they have what

An unvaccinated woman pulled from Kidney Transplant waiting list
A Colorado Springs woman was removed from an active kidney transplant waiting list because she is unvaccinated, with the UCHealth hospital system saying it will deny the potentially life-saving procedure to the unvaxxed. The transplant candidate, Leilani Lutali, said she received a letter from the University of Colorado Hospital informing her that she was “inactivated” on the waiting list for “noncompliance by not receiving the Covid vaccine” and that she had 30 days to get her first shot to return to active status, a local Fox affiliate reported on Wednesday. “If you decide to refuse Covid vaccination, you will be removed from the kidney transplant list,” the letter continued, as quoted from a copy obtained and shared on Twitter by Colorado state Rep. Tem Geitner.

and as a consumer, I’m not an early adopter. So I wait and see what’s going on.” I feel like I’m being coerced into not being able to wait and see and that I have to take the shot if I want this life-saving transplant. Lutali, moreover, said she already contracted the virus last summer and was “almost asymptomatic.” But, she added: “If I… came down with the second case of Covid, it would be minimal,” suggesting she may have some level of natural immunity. The UCHealth hospital system outlined its vaccination policy in a lengthy statement provided to media outlets on Wednesday, explaining that transplant surgeries are “unique” procedures that carry risks of “serious complications,” up to and including death and that every precaution must be taken to October 8, 2021
avoid adverse outcomes. “In almost all situations, transplant recipients and living donors at UCHealth are now required to be vaccinated against Covid-19 in addition to meeting other health requirements and receiving additional vaccinations,” the hospital said, noting that other transplant centers across the US have adopted the same policies. The hospital noted that organ recipients face “significant risk” from Covid-19 post-surgery, citing research that found a much higher coronavirus mortality rate among transplant patients. Nonetheless, State Representative Geitner, a Republican representing El Paso County, tore into UCHealth for the decision, saying on Tuesday: “The understanding is basically… conform to this demand. Take this Covid vaccine, or otherwise, you will be denied a life-saving procedure.” Geitner also stated during a Facebook Livestream that
he had contacted the hospital system multiple times, looking to carve out an exception for Lutali’s case in particular. unlimited” and is “not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose,” Scalia wrote. His opinion even contained a list of “presumptively lawful regulatory measures,” such as restrictions on the possession of firearms by felons or bans on carrying them in sensitive places like schools and government buildings. The NRA and other gun rights supporters have bristled at the general acceptance by judges of the constitutionality of laws restricting firearm use. That discontent culminated in Bruen. More and more states have allowed concealed handguns In 1980, most Americans lived in places that either banned concealed carry or had a New York-style “proper cause” permitting regime. An NRA push beginning in the late 1980s loosened public carry laws around the country. In states where gun rights advocates possess relatively little clout, they hope that Bruen will accomplish through the courts what they have failed to accomplish through the political process. Today, New York is one of eight states requiring that people seeking to carry concealed handguns have a “proper” or “good” cause. California, Delaware, Hawaii, Maryland, Massachusetts, New Jersey and Rhode Island have similar laws on the books. If the court strikes down New York’s law, Americans in those states could expect an increase in the number of people legally carrying handguns in their communities. Anyone who wants to carry a concealed handgun would have an easier time doing so. A ‘text, history and tradition test’ Bruen could also be a turning point for how judges evaluate all Second Amendment cases – whether they’re about assault weapons, tasers or
felon-in-possession offenses. Until now, judges have generally assessed whether such restrictions are justified by current public safety concerns. Many gun rights advocates are asking the Supreme Court to reject that approach. Instead, they want judges to decide cases on the sole basis of history and traditionunless the judiciary’s interpretation of the text of the Second Amendment resolves the issue. This is known as the “text, history and tradition” test. Justice Brett Kavanaugh is credited with first articulating this test in a dissent he issued prior to his rise to the Supreme Court. Justices Clarence Thomas, Neil Gorsuch and Amy Coney Barrett all have embraced similar judicial philosophies to some degree. But there’s a catch: Guns have always been regulated in America. New York’s regulation has been on the books for over a century and had a legacy that extended back even further. If the justices abandon a conventional approach for the text, history and tradition test, I would expect a new round of lawsuits over weapons laws that have already survived prior court challenges. Gun rights advocates would likely, for example, sue over restrictions on large-capacity magazines or safe storage requirements
in places where those issues have already been resolved. This litigation would call on judges to rule on the sole basis of a difficult historical exercise: comparing modern laws addressing modern guns and contemporary gun violence to the laws, practices and weapons of a bygone era. Trump’s justices may tip the scales The court has three main options. It could uphold New York’s law. It could strike it down. Or it could find a middle ground, such as issuing a narrow ruling that punts big questions about gun restrictions down the road. Six of the nine members of the Supreme Court are conservatives. If You’re Tired of Fighting the Squirrels, Feed ’Em
Tips to feed squirrels and birds to create harmony in your backyard
By Desert Star Staff Countless backyards are battlegrounds between die-hard homeowners and squirrels fighting over bird feed. Squirrels need not be an inevitable element of bird feeding; even though keeping squirrels out of bird feeders is an age-old problem, there are ways to thwart these thieves. One common tactic is stocking feeders with seed squirrels dislike, such as safflower, nyjer, white proso millet and seed infused with capsaicin, a compound derived from hot peppers that makes mammals’ tongues smart. An
option like Cole’s Hot Meats features nutritious sunflower meats infused with fiery habanero chili peppers. They’re a no waste, no mess feed, birds enjoy but squirrels’ dislike. Some people find squirrels adorable, fascinating to watch and have nothing against them, even allowing them to share seed with birds. The real problem begins when squirrels take their share and then some. To combat this, consider adding a baffle to your bird feeder on a pole about 5 feet high so squirrels don’t jump over it. Bird feeders on poles can be set in open
spaces where there’s no trees or structures squirrels can jump from onto feeders. Try a “squirrel-proof” feeder that employs cages, or spring-loaded doors, keeping squirrels at bay. You can then offer food specific to squirrels’ taste preferences away from bird feeders. Because squirrels are territorial, they’re less likely to go to other locations once they’re accustomed to eating in a designated place. Establishing a feeding space just for squirrels can satisfy their appetites and keep them out of bird feeders.
You can use an open feeder or scatter feed on the ground for easy access. Try 100% whole peanuts or Cole’s Critter Munchies, which includes ingredients squirrels love. Another way to help squirrels thrive is to provide access to fresh, clean water. Squirrels are interesting creatures and worth the watch. Plus, they can jump up to 20 feet and run 20 miles per hour. • Squirrels can see behind them, but they’re blind at birth. • When given a mixture of nuts, squirrels sort them by type before burying each variety in a different area. • Squirrels can rotate their hind feet 180 degrees when descending trees and poles. • Squirrels are one of the most important animals for helping spread oak trees. They
store acorns in the ground but only recover about 70% of them, allowing forgotten acorns to grow into healthy trees. As for the birds: In cold weather, it’s important to provide high-quality choices that offer the most fat, nutrients and energy. Look for black oil sunflower, which is rich in oil, attracting birds and providing energy. Birds also love suet, the solid fat rendered from beef, venison or vegetables, which provides concentrated energy, helping them make it through freezing weather. 100yo former camp guard oldest person to be tried in Germany for Nazi-era crimes By Desert Star Staff A 100-year-old exconcentration camp guard has been put on trial in Germany, making him the oldest person yet to face the country’s docks for Nazi-era atrocities, on suspicion of being complicit in the murders of thousands. The suspect, Josef S, appeared in court on Thursday, accused of “knowingly and willingly” aiding in the murder of 3,518 prisoners at the Sachsenhausen camp in Oranienburg, north of the German capital, Berlin, between 1942 and 1945. Allegations stacked against the senior include being complicit in the
“execution by firing squad of Soviet prisoners of war in 1942,” as well as using the highly poisonous gas Zyklon B to murder the camp’s prisoners. According to a court spokeswoman, the pensioner is not accused of having shot anyone in particular. Still, while serving as a guard, his knowledge of the slayings means that he contributed to these acts. His lawyer, Stefan Waterkamp, said that the defendant “will not speak, but will only provide information about his personal situation” at the trial. Despite the centenarian’s old age, a medical
assessment found that he was partially fit to stand trial, which is expected to last until early January. His appearances at court, however, will be limited to only a few hours per day. The landmark trial comes shortly after a 96-year-old exNazi secretary went on the run to avoid facing court, only to be found a few hours later. She was later released from custody in Germany, pending her next court hearing. On Wednesday,
Germany expanded pension contributions to 6,500 Holocaust survivors, including those who endured the almost 900-day siege of Leningrad during World War II, now St Petersburg, Russia. Tens of thousands of inmates met their fate in the Sachsenhausen camp due to forced labor, murder, medical experiments, starvation, and disease, before Soviet troops liberated it. More than 200,000 people were
detained there, including Jews, Roma, political opposition, and gay people. The 2011 trial of former camp guard John Demjanjuk, who was sentenced for aiding and abetting the murders of almost 30,000 people at Poland’s Sobibor death camp, set the precedent that ex-Nazi accomplices will be held accountable for their involvement in crimes, regardless of their age or the significance of their role.

‘Who broke the Internet?!’
By Desert Star Staff Many of the world’s largest apps and websites, including banks and airlines, faced a cascade of outages all in the space of a few hours, prompting panic among netizens as some demanded to know who “broke” the internet. While the glitches affected several popular social media platforms – among them Twitter, Reddit, Facebook, Instagram and SnapChat, other more significant institutions also faced major tech issues on Monday, such as Bank of America, Southwest Airlines, the professional networking site LinkedIn and the cryptocurrency exchange Coinbase, all according to outage tracker DownDetector. The tracking website noted that the problems at Facebook marked the “largest outage we’ve ever seen on DownDetector” with more
than “10.6 million problem reports from all over the globe,” however the platform, along with the Facebook-owned site Instagram, appears to have come back to life since, having been down for some six hours. Chat apps such as Zoom and Telegram, and Gmail – among the world’s most heavily trafficked email services – were also reportedly caught up in the internet-wide meltdown. All three have seen a significant surge in use amid the Covid-19 pandemic, driving many firms to transition to more remote work. As a result, Monday’s glitches were sure to cause headaches for countless professionals attempting to work from home, even prompting some to demand to know “who broke the internet.” Other users offered some novel theories about what might have caused the outages, ranging from
a widespread cyberattack, a covert CIA operation, to the usual scapegoat – the “Russians.” It remains unclear precisely what caused the widespread outages on Monday. However, a Facebook employee who
declined to be named told NBC the company faced a DNS [Domain Name System] problem, referring to a ‘phone book’-like system used to look up individual websites. The employee added that there is “no reason at this

Calls to Reconsider Police in Schools After Teen Shot by Officer Likely to Die
By Suzanne Potter/PNS LONG BEACH, Calif. Mona Rodriguez, the teen mom shot by a school resource officer in Long Beach, is brain dead and is expected to be taken off life support. The officer, who fired at the car after Rodriguez fled the scene of a fight, is on administrative leave - but the incident has reignited debate over the role of police in schools. Nate Balis is the director of the Juvenile Justice Strategy Group at the Annie E. Casey Foundation, which sponsored a new report from the Sentencing Project on the so-called school-to-prison pipeline. He recommended that districts pivot toward restorative justice and counseling - so students who misbehave get help rather than get arrested. “Instead of school being a place where young people grow,” said Balis, “young people who get in trouble are pulled away from school rather than www.desertstarweekly.com
engaged in school and end up in the juvenile justice system. “ Supporters of School Resource Officer programs point to the many examples where school resource officers have protected students from harm. But Balis argued that schools should use some of the extra pandemic funding to revamp their approach to discipline - making it less punitive and more preventive. Pfizer asks FDA to authorize vaccine for children aged 5-11
By Desert Star Staff US drugmaker Pfizer is seeking an Emergency Use Authorization to allow its Covid-19 vaccine to be given to children aged between five and 11. The shot has already been authorized for kids over 12. Pfizer announced on Thursday that it had submitted a request for an Emergency Use Authorization (EUA) to the Food and Drug Administration (FDA), several weeks after it began submitting trial data from five- to 11-yearolds to the US regulator. Should the FDA grant Pfizer’s request, the pharma firm’s vaccine would be the first Covid-19 shot authorized for children so young. Pfizer’s two-shot regimen has already been given a EUA for children aged 12 to 15 and is fully approved for anyone over 16. The FDA could issue an authorization by the end of this month. Then, in September, White House coronavirus adviser Dr. Anthony Fauci
told MSNBC, “We could start vaccinating children, hopefully before the end of October.” However, the FDA will need to consider whether Pfizer’s data makes a clear enough case for pediatric vaccination and what dosage would be appropriate for kids so young. The FDA does not always march in lockstep with the Biden administration, and even within the agency, there is sometimes dissent. Last month, an FDA panel voted overwhelmingly against rolling out Pfizer’s jab booster shots to American adults, shutting down President Joe Biden’s promise to make these boosters available by September 20. The FDA ended up approving booster shots for older adults and those at heightened risk of Covid-19 – which, according to the agency, includes teachers and healthcare workers. With the FDA set to decide in the coming weeks, schoolchildren in certain areas
will face mandatory vaccination if the agency greenlights Pfizer’s application. Last week, California Governor Gavin Newsom issued a mandate requiring all eligible grade school kids to be vaccinated against Covid-19. At present, the order only applies to children over 11 but would
affect kids as young as five if the FDA sides with Pfizer and grants the authorization. Children are far less likely to suffer from severe illness or death as a result of Covid-19. For example, fewer than 500 children under 18 have died of the coronavirus in the US since the pandemic began,
accounting for 0.07% of all Covid-19 deaths, according to data from the Centers for Disease Control and Prevention (CDC). In the UK, researchers recently found that a child’s chance of dying from Covid-19 is somewhere around one in 500,000.
Public-Service Workers Rejoice as Feds Forgive Student Debt By Suzanne Potter SACRAMENTO, Calif. -- Hundreds of thousands of teachers, nurses, social workers, military officers and others in public service can breathe a sigh of relief tonight as the Biden administration announced significant reforms to the public-service loan forgiveness program. Miguel Cardona, U.S. Secretary of Education, said the program would be streamlined to qualify about 550,000 more people. “In 2007, Congress made a pledge to forgive loans if you serve the community for ten years, and we’re going to make that right,” Cardona remarked. The program is supposed to pay off remaining loans for people who have made payments for ten years while working in a qualifying profession, but you had to have a specific type of loan.
Now, people can get a waiver and count payments on other types of student loans toward the forgiveness program. Merrie Wolf, a longtime math teacher from Tulsa, was told after a decade of payments that she would have to convert to a different type of loan and start the clock all over again. “The student-loan process has been a nightmare, to say the least,” Wolf asserted. “I was led to believe a whole ten years that I was headed toward Public Service Loan Forgiveness.” According to the Institute for College Access and Success, in 2018-19, the most recent year from which data is available, 48% of California college graduates had student loan debt, with an average debt load of more than $21,000. professor at Brown University School of Public Health, said the changes are a light at the end of the tunnel after years of crushing debt. “It’s a lot of money that
you don’t get to use to save for retirement, or save for, say, my son’s education either,” Gray pointed out. “It’s ending up costing so much more than I ever thought it would.”

Twitter feature to warn users conversations could become ‘heated or intense.’
By Desert Star Staff A new Twitter feature will warn users that controversial conversations on the platform could become “intense” if they join in and remember that there’s a human behind every post. “Ever want to know the vibe of a conversation before you join in? We’re testing prompts on Android and iOS that give you a heads up if the convo you’re about to enter could get heated or intense,” Twitter revealed on Wednesday, explaining that the new feature was an attempt to “better support healthy conversation.” The warnings are seemingly set to display if the site’s algorithms decide that a post appears controversial — and Twitter said that it “may consider the Tweet topic and the relationship between the Tweet author
and replier” when deciding how to trigger its notices. If Twitter does deem a post to be sufficiently controversial, it will advise, “Heads up: Conversations like this can be intense.” The new warnings will also encourage users to “look out for each other” and “remember the human” behind each post, reminding those who feel strongly about a topic that “diverse perspectives have value.” Twitter is notorious for overly-heated discussions on controversial topics. While some users applauded the site’s initiative, others questioned how useful such a feature could be when nearly every conversation has the potential to turn fiery. The point was demonstrated by one user who noted that even a simple post about corn dogs could get intense on the internet, to
which another user jokingly replied: “Corn dogs suck.” Thanks, we hate it,” reacted another user, while another person commented, “I like twitter’s flimsy attempts to pretend the site’s purpose isn’t just to yell at people.” Others expressed
skepticism over whether Twitter would be “capable of assessing the vibe of a conversation” and argued that if the poster wanted to “know the vibe of a conversation before joining in,” they could just read the conversation so far. In a follow-up tweet, Twitter
admitted that the feature was still in early testing and “we may not get it right every time.” Twitter has already begun testing the feature, as some users noticed it in action on Thursday, attached to a tweet about Texas’ controversial new abortion law.
