Open to the public on September 24 in Palm Desert By Pamela Price Whole Foods Market have arrived in the desert with their Grand Opening in Palm Desert set for Sept. 24th at 9 a.m. Meeting the minds behind the Whole Foods concept was the moving force behind their Community Dinner (‘Come Break Bread With Us’) held at the Living Desert in Palm Desert on September 9. Keeping up with the conversation which was punctuated now and then by the calls of a congenial kookaburra, one of the Living Desert’s resident birds added to the ambiance.
About 80 guests mingled with speakers from Whole Foods; Daniel Miller, Specialty Team Leader, Chris Steele, Associate Seafood Coordinator ( he spoke about seafood sustainability), Todd Pinner, Associate Meat Coordinator ( sharing thoughts on their 5-step Animal Welfare Rating System), Armando Mendez, Associate Produce Coordinator, ( explaining the Whole Foods guarantees Program) , Abbigale Urioste, Marketing Team Leader and Casey Coyle, Team Leader Palm Desert.
The menu was a Whole Foods statement, with appetizers; fresh shucked oysters and rustic roasted pepper crostini. The dinner served family style was hearty and healthy, with shaved Brussels sprout kale slaw and heirloom tomato gazpacho followed by smoked tri tip with an arugula salsa verde enhanced by the ‘Three Sisters of Life’, hard squash, corn, black beans and peppers. otherwise have, but also provide diversification of investment assets, particularly for families with concentrated business wealth. Younger family members literally become partners with other family members, including their parents and grandparents. Family meetings in the LLC become business meetings that provide ideal forums for education on investments, economics and budgetary literacy. With the increased emphasis on enhancing fiscal fluency, we think this vehicle will gain popularity as a family investment and education tool. FLLCs are still useful for transferring wealth to younger family members in ways that tax efficient. If the children or grandchildren own the majority of the LLC as a result of estate planning transfers, most of the income generated flows through them and is taxed at their lower marginal tax rate, while the managing members—the parents—retain control over distributions. One of the differences between LLCs formed for wealth transfers, and those shaped for pooling wealth and educating young family members occurs at family formation. For wealth
transfers, parents typically provide the entire funding and transfer interests in the LLC to the children, giving them a limited equity stake while retaining management control. For investment pools, LLCs are formed by family members who are often in several different generations, all contributing together, taking interests in the LLC and appointing a manager. In either case, one of the most attractive features of an FLLC is its flexibility. Unlike some estate planning strategies that must be “irrevocable” in order to be effective, the FLLC document can be modified to respond to changes in the family or business structure. Regardless of the purpose or how the LLC is formed; the entity should be managed as a bona fide business. As a general rule, assets transferred to the FLLC should be invested for growth, and it is important that the FLLC be structured properly. Among the factors that should be considered are the following: The FLLC should have a significant business purpose other than to obtain discounts or reduce tax. FLLC accounts should
be managed separately from own accounts and properly documented and cannot be used for private expenses. When dealing with family it is wise to appoint an independent manager. Due to the complexity of FLLCs, they are not appropriate for every individual or family situation. They involve complexity and ongoing accounting and tax reporting. Additionally, the documentation for an FLLC must be carefully designed to comply with federal and state laws. However, they are useful tools that can fulfill a number of family wealth planning goals in the proper circumstances.
Our HOA is over 50 years old and our CC&R’s were updated about 15 years ago. My problem is that in the past few years our board started picking and choosing which CC&Rs they will enforce and which they will ignore and passing rules that are in direct conflict with the CC&Rs. Several stories are found in published appellate case
reports of associations which reportedly violated their CC&Rs for reasons the board felt were important. Those stories, such as the Marquesa at Monarch Beach HOA (Ekstrom v. Marquesa – failing to enforce tree height limits) or the Churchill Condominium Association (Ritter v. Churchill – failing to correct defect in common area floors between units) often end very unhappily. If a CC&R provision is believed undesirable, present it to the members for amendment – do not ignore it or pass contrary rules.

What the heck is an Alibaba?
By Kevin Powell I’m sure many of you have heard or read something about the Alibaba IPO over the past few weeks. Alibaba is the largest online commerce company in China. They are the most popular destination for online shopping in the world. On-line transactions were $248
billion last year . . . more than E-Bay and Amazon combined. They are diversified into many different sectors. Banking, a shipping company, search engine, etc. In 2013 they had $8 billion in revenues and profits of $3.5 billion. Taobao is the largest part of their business and is an
on-line market place. TMall is an upscale online shopping mall with many name brands. Alipay is China’s largest payment processor. Alipay has its own money market fund for shoppers and it has already attracted more than $87 billion in deposits. That ranks it as the fourth largest money market
in the world! They have more users annually than there are citizens in the United States. And in China, it is estimated that they have an 80% market share of on-line shoppers. Facebook just topped the $200 billion valuation mark last week. With the demand that appears to be building for the stock, Alibaba will likely open with an even higher valuation. It’s not as easy a decision as it might sound though. Financial data for many Chinese companies is skeptical at best. They don’t conform to traditional reporting or accounting standards. Transparency is lacking because China is a communist nation and the government regulates nearly everything. Control is another big concern as Alibaba’s founder, Jack Ma, and a few other insiders will control more than half the board. Two corporations, Yahoo and SoftBank will initially own about 57% of the company. This isn’t normal either. Alibaba has stiff competition in the mobile area. Of course
they can make up a lot of ground with the $30 billion plus that may ultimately be generated from the IPO. For comparison sakes, Facebook was a $16 billion IPO, Twitter $2.1 billion and Google just $1.9 billion ten years ago. There have been lots of allegations about fake goods, manipulated sales, strong arming merchants, and on and on. Investors must decide if all these negatives are worth what might be a once in a lifetime opportunity. I believe it’s something that many of us should consider even with the higher than normal risk accompanied with many IPO’s. Don’t bet the farm on it and be prudent with whatever you decide. Consult your advisors and do your own research. The stock starts trading on Friday under the ticker of BABA. As with any stock investment, buyers beware! By Angela Monroe COACHELLA -- More than 15,000 people celebrated Mexico’s Independence Day at an event in Coachella Sunday night. Fiestas Patria’s event grows each year in Coachella. Mexico’s Independence Day is on Tuesday, September 16th, but thousands of people celebrated at Rancho Las Flores Park in Coachella. Organizers say it’s one of their most popular events because it combines the history and culture of Mexico, while bringing together people from across the valley. La Jolla Playhouse Presents World Premiere Drama By Jack Lyons Theatre and Film Critic When the world is going through upheavals of all sorts: Global unrest, regional wars, economic instability, and who knows what else, the writers of the world begin writing in an attempt to help us understand what’s going on. Language in the hands of a skilled practitioner can be a powerful weapon or tool for social change, or at least, for clarity. But remember: be careful for what you ask… you just might get it. The La Jolla Playhouse launched the world premiere of “Kingdome City” by playwright Sheri Wilner last Friday. Directed by Jackson Gay. “Kingdom City” is playwright Wilner’s take on the state of censorship in the United States in the 21st century. Like Arthur Miller before her she uses the metaphor of “The Crucible” to examine thorny problems and issues plaguing American society when it comes to religious issues versus political situations and protected First Amendment rights to free speech. In short, the story revolves around and is set in motion by the decision of Miriam, a New York City stage director (Kate Blumberg) and her novelist husband Daniel (Todd Weeks) who find themselves in a small town in Missouri during the summer break at the local High School. Miriam has been asked to direct a production of Arthur Miller’s play “The Crucible” using high school students. Once rehearsals begin her vision and style of directing sets off a firestorm of controversy with school officials, parents, and the ire of local Christian youth counsellor Luke (Ian Littleworth) to the point that the production is in danger
of being cancelled. Cast members Katie (Christina Gerla), Matt (Austyn Meyers), and Crystal (Katie Sapper) are beginning to discover new feelings and insights in themselves through the characters they portray in this play within a play. Their hope is that Miriam will stay on and continue with the show. In the meantime, Daniel with time on his hands and a case of writer’s block, has been exploring the town of Kingdom City, where he meets Luke. Over time Daniel is drawn to the slower paced, small-town outdoor lifestyle, in the small Christian community and strikes up a friendly relationship with Luke, the town’s Christian youth counsellor. When Miriam decides to leave the production and return to New York City, the couple begin to reevaluate their priorities and motives. They’re joined at the hip and both are willing to make life choices together. Stay in the Midwest or return to the Big Apple? Stay tuned. The production under Gay’s direction is weakened somewhat by her decision not to stage the production in the traditionally configured Potiker Theatre. Instead, she chooses to use the convention of a long narrow rectangular area as the staging space; placing the audience facing one another like fans in a football stadium. This choice, at times, makes it somewhat difficult for dialogue to be heard at either end of the rectangle when action and blocking is called for at those points. However, the cast has no trouble in being heard hurling numerous expletives and sexual innuendos along with more than 100 F-bombs at the audience (always in character of course). character you love to hate is the worst offender. I’m sure there were some audience members who just wanted to smack her up the side of the head, and then have a chat with her parents; offering a large bar of soap to go along with their chat for later use. When feelings like that spill over, you know the actor is doing an outstanding job, which is exactly what Miss Sapper does in this production. Each talented cast member performs solidly and when an ensemble scene is called for, the cast responds with conviction. Blumberg and Weeks are especially effective as the “outsiders”. Ian Littleworth’s youth counsellor is empathetic and his firmness in rationally stating in his opposition to Miriam’s play direction is well

presented. There has been a lot of talk and hand-wringing these days over the lack of young and talented playwrights emerging from the playwright pipeline. My fervent hope is that when they do pop out of that pipeline, they rush to the nearest bookstore and purchase the latest thesaurus. Our writers need to come up with more synonyms and vocabulary on how to express themselves when it comes to discourse and dialogue without using adjectives that employ “f…ing” in between every other word. And, I refuse to accept the excuse that it’s “real life” dialogue spoken in the vernacular of
the day. Yes, of course it is, so are vomiting and diarrhea “real life” experiences, but I don’t care to see them on a stage performed by actors. What’s wrong with a little judicious editing in the number of times the country’s favorite shock and awe word is used? But I digress. Director Gay leads her creative team with a spare, space-staging design by Robert Brill, neatly lighted by Paul Whitaker. The costumes designed by David Israel Reynoso and sound by Nicholas Drashner ably support the production. “Kingdom City”, runs at the Potiker Theatre through October 5, 2014.

“Third Person,” starring Liam Neeson, Adrian Brody, Mila Kunis, Olivia Wilde, James Franco, Maria Bello and Kim Basinger, was written and directed by Academy Award winner Paul Haggis (“Crash”). In his latest film, attainable on DVD Sept. 30, Haggis intricately weaves together the stories of three couples in three different cities. In Paris Pulitzer Prize-winning author (Neeson), who recently left his wife (Basinger), is having a tempestuous affair with an ambitious young journalist (Wilde). In Rome, a shady American businessman (Brody) links up with a mysterious woman, and in New York a lawyer (Bellow) is helping a young mother (Kunis) in a custody battle with her famous ex-husband (Franco). “Third Person” is a mystery and a puzzle in which truth is revealed in glimpses and clues. Nothing is truly what it seems. The various stories deal with love, passion, trust and betrayal involving lovers and estranged spouses as well as children lost and found. Bonus features include a filmmaker commentary with writer/director Paul Haggis and others as well as “The Making of Third Person” and a Q & A with Haggis. “Third Person” has a running time of approximately 137 minutes and is rated R for language and some sexuality/ nudity.

W.A.C.E. now represents over 800 chamber professionals in 18 Western states and Canada. In addition to an overview and discussion of economic development trends, issues, and best practices, major components of the 18-hour program included Community Readiness and Assessment; Funding Economic Development Operations; Business Retention and Expansion; Small Business and Entrepreneurship Development; Marketing and Business Attraction; Building a Strong Economic Development Team; and Ethics in Economic Development. By David Bauder AP Television Writer NEW YORK (AP) - Daytime’s “The View” revealed its latest makeover Monday, opening the post-Barbara Walters era with a new set, new boss, mostly new team and a promise to be provocative again. Whoopi Goldberg is the only holdover on the daytime chatfest, which has faded in recent years as competitors sought to improve on its ensemble format. A slimmeddown Rosie O’Donnell returned
for her second run, joined by actress Rosie Perez and former Republican political operative Nicolle Wallace. “’The View’ is the show that everyone has copied but we’re the original,” Goldberg said. Backstage after the show, Goldberg said the hosts had been told the past few years to avoid political topics. That clearly wasn’t the case Monday, as the four cast members dove right into a discussion about domestic abuse and the National Football League, along
with changing attitudes toward corporal punishment. O’Donnell said that while she was able to look past abuse charges against Chris Brown and enjoy his work, she couldn’t do that with Woody Allen and no longer sees his movies. Goldberg couldn’t stifle giggles when talking to Wallace about Sarah Palin, with whom she clashed while working for the GOP’s 2008 national ticket. “When did you want to just pop her?” Perez asked. Otherwise, Wa l l a c e
struggled to get a few words in during her first show. “I’m a Republican, we should get that out of the way,” she said in introducing herself. “And I really like her!” O’Donnell shouted from two chairs away. “I swear to God.” O’Donnell, who has shed more than 50 pounds after a heart attack last year, sat barefoot and cross-legged in her chair, saying she’s recovering from a nerve ailment. She said later the show seems to be moving toward discussions of what women “really care about, and it’s not all about pop culture.” She said she’s expecting a smoother time than her previous eight months on “The View,” which ended in 2007. In part that’s because longtime producer Bill Geddie is out, replaced by Rachel Maddow’s former producer, Bill Wolff. “We had a different idea of what the show could or should be,” she said about her first tenure. “But when someone invites you into their house for dinner, you don’t rearrange the furniture. This is a new house with a new owner, and I was invited to consult on what the furniture should be.” O’Donnell was the ringmaster during commercial breaks, taking a microphone and interacting with the audience. It created some moments funnier than what appeared on the air,
like when one onlooker asked whether someone else might be added to the four-person cast. “This isn’t enough for you?” she joked. “Get the (expletive) out.” Onscreen, she played a brief game with an audience member and Perez, asking them to guess which Rosie had said or done certain things. Also Monday, Kristin Chenoweth came on for a song in tribute to the late Joan Rivers. Walters, who invented the format nearly two decades ago, watched the proceedings from offstage. She filmed an awkward show-opening segment seated in a “throne” where the four hosts briefly approached and bowed before her. Wolff said he talked to Walters a couple of times a week to get advice. The new executive producer, brought on midway through the show’s makeover, said he was largely responsible for hiring Perez and Wallace. “This is our chance to take our leap forward creatively,” Wolff said. He said he hoped the audience would recognize that the four cast members are all smart, accomplished, able to have vigorous conversations and disagree with one another while still liking each other at the end. Story and Photos by Pat Krause The Palm Springs Walk of Stars honored Comedian Larry Storch with the 373rd Star on the Palm Springs Walk of Stars on Tuesday Sept. 16th. The speakers included other local legends, Kaye Ballard and Shecky Green. The star dedication brought out many fans who knew his work on the 1960s TV show, F Troup. He was best known then as the bumbling Corporal Randolph Agarn and many television programs like Car 54. Where Are You, Get Smart and Fantasy Island. Larry Storch has had a brilliant career on Television, the Stage and Movies. His film credits include The Great Race, Airport1975, Funny Valentine and more recently the hit comedy documentary, The Aristocrats. He has done much voiceover work in a number of animated cartoons like the Underdog, The Pink Panther Show and Scooby Doo Where Are You. He even had his own TV show called The Larry Storch Show. The star was dedicated on 140 North Palm Canyon Dr. Larry Storch was presented with proclamations by Brian Nestande and John Benoit. Board members also talented him with other gifts. Matt Beckoff sponsored the Star and gave an emotional speech. Matt has worked for Larry and said were the best 8 years in his life. Larry gave him so many opportunities and is a wonderful friend and person.

Story and Photos by Pat Krause The Palm Springs Air Museum on Gene Autry Trail held a ribbon-cutting ceremony for the New Berger Foundation SMaRT Education SciTech Academy Building on Sept. 15th in the morning. Guests could tour the Facility and get a first hand informational speech on the merits of the Academy. Founders Liberty Naud and Maria Wren gave glowing reports on the progress the school is making thanks to the HN and Frances C.Berger Foundation for their generous donation The Palm Springs Air Museum and SMaRT education are partnering and presenting SciTech Science classes for grades’ k through 12. The Academy is offering exciting “Hands On” after school classes that combine Robotics, Computers and Video Gaming. The video game classes are for designing, not playing, that teach the concept of technology and programing. The Academy has many high-speed internet computers for students. There is a working robot that was built by 11 and 12 year olds. NASA has partnered with the school and constantly provides updated materials. NASA also sends astronauts and engineers 2 or 3 times yearly to speak to the Academy classes and general public. They teach Exploration and Experimentation by building and creating. There are no criteria to enter, and the classroom will hold about 20 kids. They serve 3700 kids ages 5 to 18 in after-school programs. They partner with several organizations like the Boys and Girls Club and the Girl Scouts. The Academy is very mobile so that they can take their equipment and teaching methods to the local schools. They teach skills that don’t always require college to get good jobs. Large companies are contacting them for qualified students in the future. The Academy has big plans for providing certification and accreditations for students in many fields in the future as Baby Boomers will soon be leaving these positions, and companies will need to fill these jobs with knowledgeable people that the school can provide.

player intercepted the ball, fittingly capping his superb night for the red and white. In the final minutes, Joshua Barlow punched in the final touchdown for Palm Springs, putting the cherry on top of the team’s third consecutive victory. The Indians looked great against the Titans but Coach Murphy believes some mistakes need to be corrected before DVL play starts in a few weeks. “We have to correct some of our mistakes we do on offense,” Coach Murphy said. “A lot of it is very correctable, jumping off sides and silly things like that – alignment. So we’ll work on that, but I told the kids if we put a complete game together, we’ll be scary. We just have to get better this week.” Olvera continues to make strides this season, finishing the game with 266 yards passing and three touchdowns. Despite not making the Desert Sun’s Elite 11, Miller gave an elite performance, ending the game with 131 receiving yards, three touchdowns and two interceptions. “Franklin Miller is a special kid, who is very unselfish and does everything for his teammates,” Coach Murphy said of Olvera’s new target. “Tonight it was his night to shine, and I’m proud of him. He’s a hard working kid on the practice field, his teammates love him, he’s a leader and he deserved what he got tonight.” This is the first time the Indians have started the season 3-0 since 2012, when they went 5-0 in league play and won the DVL championship. If they can tighten up their defense and nix the silly mental errors, the Palm Springs will be atop the league standings with perennial favorite La Quinta. The Palm Springs Indians travel to Murrieta Mesa High School to take on the Rams this Friday. The game starts at 7 pm. Friday’s Games: San Jacinto at Indio. PALM SPRINGS – The Hawkins brothers have received most of the preseason hype this year for the Palm Springs High School football team, but in Friday’s 42-14, cakewalk defeat of the Temescal Canyon High School Titans, junior Franklin Miller played like the star. The offense was not clicking for the Indians (0-0 in DVL, 3-0 Overall) at the start of the game but Miller was on point from the get-go, grabbing a 40-yard touchdown pass with only three and a half minutes gone by in the first quarter. Temescal Canyon (0-0 in Sunbelt, 0-3 Overall) tied up the game on a 5-yard touchdown run by its only real means of offense, six-foot-threeinch running back Michael Erim. With 3:00 left in the first half, Miller caught his second touchdown of the game on a 6-yard toss from junior quarterback William Olvera. The score was 14-7 at halftime but the Indians turned up the intensity as soon as the third quarter started. Sandwiching a Temescal Canyon score, A QB sneak, followed by a Taylor Hawkins catch and sprint down the sideline for the touchdown gave Palm Springs the 28-14 lead going into the final quarter. On the opening drive of the fourth, the Titans forced the Indians to punt, setting up the wildest play of the game. Senior Riley Hagar – the Indians do-everything receiver – lined up to boot the ball, however, with no defender on the player of the game, Miller, the Palm Springs coaching staff decided to call a gutsy fake. The play worked and the two connected on a 47-yard touchdown pass that surprised everyone. “I looked over at my special teams coach because I didn’t know what was going on,” Indians head coach Dan Murphy said. “He said no one was covering Franklin and Franklin did what he always does – comes up with big plays.“ Miller had one more big play left in him. With a 35-14 lead, the game would have been nearly impossible for Temescal Canyon to mount a comeback but they had to try and throw to gain yards in a hurry. At the eight-minute mark, the two-way
