L A County says maskless Emmys ceremony was NOT in violation of Covid-19 rules By Desert Star Staff Los Angeles health officials sprang to the Emmys’ defense, hailing safety protocols at the show and noting that it’s exempt from the mask mandate as a television production after the sight of maskless celebrities stoked outrage.

The 73rd annual Emmy Awards at the Event Deck at LA Live, which is considered an indoor-outdoor venue, has courted massive controversy due to the guests sporting no masks despite it being tightly packed. The organizers were accused of hypocrisy and

elitism at a time when children have to mask up at school – a highly politicized issue, which has been fueling legal battles between Republican governors and proponents of school-mask mandates. Responding to the backlash sparked by the ceremony, LA County’s health

officer on Monday defended the gathering, insisting that neither the assorted celebrities nor the organizers had done anything wrong. The official invoked exemptions for film, television, and music production, arguing that they fall under this category since the Emmys were televised.

The Golf Boom Continues By Desert Star Staff DAZN has its eye on Premier League rights — and could make a significant acquisition to get them. “I would love to see the Premier League on DAZN,” executive chairman Kevin Mayer said at Wednesday’s Royal Television Society convention. “It’s a huge market, trendy sport, high-quality experience, of course, we’d want that.” DAZN missed out on the latest bidding round for the United Kingdom’s top soccer league, which opted to renew existing deals with Sky Sports, BT Sport, BBC Sport, and Amazon. Those agreements are collectively worth $7 billion and run to 2025.

College Adopts COVID-19 Vaccination Requirements for Spring

By Desert Star Staff Free, on-campus testing and vaccinations are now available To support the health and safety of students and employees, the College of the Desert Board of Trustees, on September 17, announced plans to require proof of COVID-19 vaccination from employees and students who plan to attend face-to-face instruction or on-campus activities in the Spring 2022 term. “The highly contagious Delta variant caused coronavirus cases to surge across the U.S., and most new infections and hospitalizations are among the unvaccinated,” said Board Chair

Aurora Wilson. “Throughout the pandemic, we have prioritized the safety and well-being of our employees and students. As we increase the number of people accessing our facilities, the Board believes it is important to embrace a comprehensive strategy that includes proactive measures to reduce the possibility of the transmission of COVID-19 on our campuses.” Students and employees over the age of 12 can choose among three COVID-19 vaccines with full or emergency use authorization from the U.S. Food and Drug Administration. They will have until January 31, 2022, the beginning of the Spring semester, to

submit proof of vaccination. The College’s leadership is developing a secured system to track vaccination status and testing results. Details on how to submit proof of vaccination are forthcoming. Waiving IP rights means waving goodbye to future medical breakthroughs By Sandip Shah and Deep Patel The Biden administration recently announced that it would back a proposal by South Africa and India at the World Trade Organization to nullify American innovators’ intellectual property rights for Covid-19 vaccines. While the proposal’s adoption would not increase the number of global vaccine doses available, it would dissuade investment in innovation -- effectively inhibiting the next generation of medical breakthroughs and hurting patients in the process. To understand the importance of intellectual property, look no further than the Covid-19 vaccines developed by Moderna and Pfizer-BioNTech. They discovered that by taking advantage of the body’s own molecular devices, mRNA could teach our cells how to make a protein similar to that of a given pathogen -- which triggers an immune response. mRNA technology could create an entirely new class

of medicines. Once scientists have the genetic sequence of a targeted virus or disease, they can equip mRNA with the means to fend it off. This new approach of custom-made mRNA can address a host of diseases ranging from cancer and heart disease to Alzheimer’s and multiple sclerosis. For instance, Moderna and fellow biotech firm Merck have seen promising results for an mRNA-based therapeutic vaccine to treat cancer. Each treatment arms mRNA with a unique code to fight particular mutations in individual patients’ tumor cells. These experimental vaccines and therapies could soon help millions of Americans live longer, healthier lives. That is if our innovative ecosystem maintains the incentives necessary to fund them. Pharmaceutical research and development are inherently risky. Most experimental treatments and vaccines meet dead ends, despite the billions of dollars invested.

Intellectual property protections help assure innovators that they have exclusive rights to their medical inventions for some time. Without that sense of security, innovation would come to a standstill. Investors would have to expend resources elsewhere as development ventures -- even those pursuing new applications for the technology as promising as mRNA -- simply won’t be financially feasible to pursue. That’s precisely why it’s so concerning that the Biden administration has decided to support the intellectual property waiver that South Africa and India are pushing. Administration officials likely felt pressured by the waiver’s proponents, who claim that stripping protections is necessary to ramp up global vaccine access. But there’s no evidence in support of that. Giving away intellectual property rights will not expand supply because the real September 22, 2021

bottleneck lies with the logistical challenges of scaling up production. It takes time to retrofit manufacturing facilities so that they are capable of safely and effectively producing high-tech vaccines. Not to mention there is a worldwide shortage of the vaccines’ essential raw materials. The WTO proposal is not a policy option to adopt and abandon when it inevitably proves ineffective in achieving its purported aim. There are real-world consequences of continuing down this path. If intellectual property is no longer protected, patients

can say goodbye to future treatments and cures. Those who recognize the value of American innovation can -- and must -- push back on this disastrous proposal before it’s too late. Inheritance Crime

By Janice Gough The American Bar Association calls elder abuse “the crime of the 21st century.” The three main causes of “inheritances gone awry” are Alzheimer’s, widowed stepmothers, and estate crimes. What exactly is an “estate crime”? It is the unauthorized, unlawful taking of someone’s assets while they’re alive. Signals of abuse are generally apparent when the property has been transferred before death. For example, a personal representative, such as a trustee, suppresses assets and takes them for themself. The wealthy are easily targeted due to the number of assets to be accounted for because it is assumed the relatives will not know the assets are missing. Another group who are victims are recent immigrants. They often have a lot of cash stored in a safe, maybe as much as half a million dollars, but that money almost always is gone at their death. These experiences are common. So, if someone’s keeping a lot of cash around,

they should have proof of it and give that documentation to a person they trust. As financial advisors, we are the main link in the prevention of a fractured inheritance. First, we need to be connected to the family attorney and accountant; we can collaborate with those we trust if we see irregularities. Financial advisors can play an essential role in helping to sort out or even prevent these bitter feuds. Second, we may see the red flags go up when we have requests to make changes on accounts, questionable asset transfers, especially if we know our client’s medical and mental conditions and how the client perceives his potential heirs. “Undue influence” and abuse of older people, crooked conservators, cognitively impaired clients, disinherited children, and stepmoms freezing out their husbands’ kids from an earlier marriage while changing Dad’s estate plan to their benefit are the primary causes of Fraud. Appointing an honest and knowledgeable conservator can alleviate many attempts of abuse. However, what if

your conservatory was not so honest? There have been cases where a conservator and an attorney have basically looted the conservatorship accounts. Scams in which large payments for mediation or other services have been charged to the estate. Well, that money wasn’t coming out of the air. It was coming out of some poor old guy’s conservatorship account. So that situation can be very abusive. Those who have Alzheimer’s must be looked at from the standpoint of how advanced their disease has become. For questions of abuse, first, you must ask, “Was there undue influence, and did the person lack cognitive ability?” Sometimes it is very clear in which people can no longer even write their names. Other times it is not so clear because one of the things about Alzheimer’s is the lack of awareness that you have it, called anosognosia. There is a higher standard of proof required to prove “undue influence.” Challengers have a tough uphill battle trying to overturn a trust or will, based on “undue

influence” or lack of cognitive capacity. Many attorneys would prefer to pursue elder financial abuse challenges because they are not directly tied to overturning a will. Elder abuse is more directed to making a wrongdoer responsible, and it can also be used as leverage for those attempting to Fraud an elder, as they may back away when charges are made public. Based on the increasing number of seniors, Estate Crime will increase rapidly, as we have about 40 million people 65 and above. If you include baby boomers who aren’t 65 yet, there are even more seniors facing these problems in the future. In addition, since longevity is increasing, as people live to age 100 plus, dementia is expected; therefore, more people are susceptible to cognitive impairment. Alzheimer’s is said to be growing at around 500,000 cases a year. The striking statistics are that over the next 20 or 30 years, $30 trillion of baby boomer assets will be transferred. This is because more people are getting older,

However, a defining moment in my HOA law career was when I realized that my role is to tell the board the truth and provide to them my best advice, but compelling the board to follow my advice was not my responsibility. Once I had better understanding of my role, things became less stressful. Each member of the HOA team has its own boundary, and each team member staying within that role helps the entire HOA team. Managers – Managers take action managing the association, carrying out board directions and providing important advice helping boards operate within the Business Judgment Rule. Managers do not make decisions, except those specifically assigned to them by the board. Boards – The board decides things but doesn’t implement its decisions. The Board provides direction to management and approves contracts with other HOA vendors. Boards should not co-manage the HOA, but should allow the www.desertstarweekly.com

manager to carry out the board’s directives. Boards normally don’t oversee vendors - that is what you pay management to do. Vendors - Service providers (including managers) should perform their contract and avoid HOA politics. Endorsing or opposing board candidates is outside their role and is unethical - they must stay neutral. Officers – in HOAs, individual officers (even Presidents) have little power. Everything they do is only upon the express authorization of the board. HOA officers occasionally confuse their limited nonprofit role with the more powerful role given officers in for-profit corporations. Individual Directors- A single director has no power except the power to cast a vote on board decisions - the power rests in the board. Well-intentioned directors can usurp the board’s role by acting without board authority; usually justifying it by claiming action was needed. But the well-intentioned director becomes a “renegade” by taking actions, which is reserved for the board, such as instructing the manager or other vendors, or making contractual commitments for the association. Committees – Except for architectural committees, most committees are advisory

to the board and do not act. Committees typically are assigned an ongoing important subject, and advise the board by issuing “reports,” hopefully written, suggesting certain board actions. Committees do not make commitments to association vendors, and their meetings are less formal. Boards should avoid doing committee work in the board meetings, just as the committee avoids doing board work. Committee Members – A committee member should be part of a team. However, sometimes extremely interested and active committee members step outside their role by

speaking for the committee when the committee has not met. A committee of one is not a committee! Individual Homeowners – The governing documents list certain matters that are subject to membership vote where individual homeowners can participate. Beyond these, let the board handle things because they are legally responsible. Non-directors should not participate in board discussions except for open forum input. Another common homeowner boundary issue arises when homeowners instruct HOA vendors, but that is the manager’s role. One of the great benefits of association living is that the

While boosting the immune system sounds like a good plan in an emergency.
