NOTICE TO BUYER: In 2014 the Oregon Spotted Frog was listed as a threatened species under the Endangered Species Act. Central Oregon has a large population of the Oregon Spotted Frog and environmental groups are advocating for its protection. In December 2015 two lawsuits were brought under the Endangered Species Act against Central Oregon Irrigation Districts and the US Bureau of Reclamation to provide adequate water flows in the Upper Deschutes River Basin to ensure the threatened Oregon Spotted Frogs and their habitat are not harmed. The parties to the lawsuit entered into a settlement agreement which will act as an interim agreement until a long term habitat conservation plan is developed. The settlement requires higher water flow levels and storage volume requirements. Because there is no final plan in place, it is still likely that a habitat conservation plan could affect individual’s property rights and more specifically water rights. Buyer is advised to investigate such issue in more depth to determine if the Oregon Spotted Frog will have any effect on the property Buyer has contracted to purchase.
